          <p>		This Act is the <i>Narcotic Drugs (Licence Charges)</i><i> Act 201</i><i>6</i>.</p>

        <heading>Commencement</heading>
        <subsection eId="sec-2__subsec-1">
          <num>1</num>

            <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

      <section eId="sec-3">
        <num>3</num>
        <heading>Definitions</heading>
        <content>
          <p>In this Act:</p>
          <p><term refersTo="#term-charge">charge</term> means <def>charge imposed by this Act.</def></p>
          <p><term refersTo="#term-licence">licence</term> means <def>a licence granted under <ref href="">the Narcotic Drugs Act 1967</ref>.</def></p>

      <section eId="sec-4">
        <num>4</num>
        <heading>Crown to be bound</heading>
        <content>
          <p>This Act binds the Crown in each of its capacities. However, it does not bind the Crown in right of the Commonwealth.</p>
        </content>
      </section>
      <section eId="sec-5">
        <num>5</num>
        <heading>Extension to external Territories</heading>
        <content>
          <p>This Act extends to every external Territory.</p>
        </content>
      </section>
      <section eId="sec-6">
        <num>6</num>
        <heading>Imposition of charges</heading>
        <content>
          <p>Charge on a licence</p>
        </content>
        <subsection eId="sec-6__subsec-1">
          <num>1</num>
          <content>
            <p>Charge is imposed on a licence that is in force at whichever of the following times is applicable:</p>
          </content>
          <paragraph eId="sec-6__subsec-1__para-a">
            <num>a</num>
            <content>
              <p>any time during a financial year;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-6__subsec-1__para-b">
            <num>b</num>
            <content>
              <p>any time during such other period as is prescribed by the regulations.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-6__subsec-2">
          <num>2</num>
          <content>
            <p>Without limiting subsection (1), the regulations may prescribe different periods in relation to the following:</p>
          </content>
          <paragraph eId="sec-6__subsec-2__para-a">
            <num>a</num>
            <content>
              <p>different classes of licence;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-6__subsec-2__para-b">
            <num>b</num>
            <content>
              <p>licences of the same class that authorise different activities.</p>
            </content>
            <content>
              <p>Charge on matters that relate to a licence</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-6__subsec-3">
          <num>3</num>
          <content>
            <p>Charge is imposed on each matter prescribed by the regulations, being a matter that relates to a licence that is in force.</p>
          </content>
        </subsection>
        <subsection eId="sec-6__subsec-4">
          <num>4</num>
          <content>
            <p>Without limiting subsection (3), the regulations may prescribe different matters in relation to the following:</p>
          </content>

            <num>a</num>
            <content>
              <p>different classes of licence;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-6__subsec-4__para-b">
            <num>b</num>
            <content>
              <p>licences of the same class that authorise different activities.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-6__subsec-5">
          <num>5</num>
          <content>
            <p>Subsection (3) imposes a charge only so far as that charge is neither a duty of customs nor a duty of excise <ref href="#sec-55">within the meaning of section 55</ref> of the Constitution.</p>
          </content>
        </subsection>
      </section>
      <section eId="sec-7">
        <num>7</num>
        <heading>By whom charges payable</heading>
        <content>
          <p>Charge is payable by the holder of the licence.</p>
        </content>
      </section>
      <section eId="sec-8">
        <num>8</num>
        <heading>Amounts of charges</heading>
        <subsection eId="sec-8__subsec-1">
          <num>1</num>
          <content>
            <p>The amount of a charge is the amount prescribed by, or worked out in accordance with a method prescribed by, the regulations.</p>
          </content>
        </subsection>
        <subsection eId="sec-8__subsec-2">
          <num>2</num>
          <content>
            <p>Without limiting subsection (1), the regulations may prescribe different amounts of, or prescribe different methods of working out amounts of, charge in relation to the following:</p>
          </content>

            <num>a</num>
            <content>
              <p>different classes of licence;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-8__subsec-2__para-b">
            <num>b</num>
            <content>
              <p>licences of the same class that authorise different activities.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-8__subsec-3">
          <num>3</num>
          <content>
            <p>In this section:</p>

          <content>
            <p><b><i>amount</i></b> includes a nil amount.</p>
          </content>

        <num>9</num>
        <heading>Regulations</heading>
        <content>
          <p>The Governor-General may make regulations prescribing matters:</p>
        </content>
        <paragraph eId="sec-9__para-a">
          <num>a</num>
          <content>
            <p>required or permitted by this Act to be prescribed; or</p>
          </content>
        </paragraph>
        <paragraph eId="sec-9__para-b">
          <num>b</num>
          <content>
            <p>necessary or convenient to be prescribed for carrying out or giving effect to this Act.</p>

              <b>Editorial changes</b>
            </p>
            <p>The <i>Legislation Act 2003</i> authorises First Parliamentary Counsel to make editorial and presentational changes to a compiled law in preparing a compilation of the law for registration. The changes must not change the effect of the law. Editorial changes take effect from the compilation registration date.</p>
            <p>If the compilation includes editorial changes, the endnotes include a brief outline of the changes in general terms. Full details of any changes can be obtained from the Office of Parliamentary Counsel.</p>
            <p>
              <b>Misdescribed amendments</b>
            </p>
            <p>A misdescribed amendment is an amendment that does not accurately describe how an amendment is to be made. If, despite the misdescription, the amendment can be given effect as intended, then the misdescribed amendment can be incorporated through an editorial change made under <i>Legislation Act 2003</i>.<ref href="#sec-15V">section 15V</ref> of the </p>
            <p>If a misdescribed amendment cannot be given effect as intended, the amendment is not incorporated and “(md not incorp)” is added to the amendment history.</p>
