            <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

          <p>Legislation that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.</p>

            <heading>Subsection 4(1)</heading>
            <content>
              <p>Insert:</p>
              <p><b><i>law enforcement agency</i></b> means the following:</p>
              <p><b><i>s</i></b><b><i>ensitive law enforcement information</i></b> means information the disclosure of which is reasonably likely to prejudice Australia’s law enforcement interests, including Australia’s interests in the following:</p>

              <num>a</num>
              <content>
                <p>a body, agency or organisation that is responsible for, or deals with, law enforcement, criminal intelligence, criminal investigation, fraud or security intelligence in, or in a part of, Australia;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-1__para-b">
              <num>b</num>
              <content>
                <p>a body, agency or organisation prescribed by the regulations.</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-1__para-a">
              <num>a</num>
              <content>
                <p>avoiding disruption to national and international efforts relating to law enforcement, criminal intelligence, criminal investigation, foreign intelligence, security intelligence or the integrity of law enforcement agencies;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-1__para-b">
              <num>b</num>
              <content>
                <p>protecting the technologies and methods used to collect, analyse, secure or otherwise deal with, criminal intelligence, foreign intelligence, security intelligence or intelligence relating to the integrity of law enforcement agencies;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-1__para-c">
              <num>c</num>
              <content>
                <p>the protection and safety of:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-1__para-i">
              <num>i</num>
              <content>
                <p>informants or witnesses, or persons associated with informants or witnesses; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-1__para-ii">
              <num>ii</num>
              <content>
                <p>persons involved in the protection or safety of informants or witnesses;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-1__para-d">
              <num>d</num>
              <content>
                <p>ensuring that intelligence and law enforcement agencies are not discouraged from giving information to a nation’s government and government agencies.</p>
              </content>
            </paragraph>

            <heading>Paragraph 11(2)(a)</heading>

                <p>Despite subsection (3), the head of an agency is not required to give <role refersTo="#secretary">the Secretary</role> information if:</p>
              </content>

              <num>a</num>
              <content>
                <p>the holder of the information has advised the head of the agency that the holder knows or believes that the information is sensitive law enforcement information; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9__para-b">
              <num>b</num>
              <content>
                <p>the head of the agency informs <role refersTo="#secretary">the Secretary</role> of that advice.</p>
              </content>
            </paragraph>

            <heading>After section 14L</heading>

            <heading>Identification of sensitive law enforcement information</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-14LA__subclause-1">
              <num>1</num>
              <content>
                <p>If:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-14LA__para-a">
              <num>a</num>
              <content>
                <p><role refersTo="#secretary">the Secretary</role>:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-14LA__para-i">
              <num>i</num>
              <content>
                <p>requests a Commonwealth, State or Territory law enforcement agency to give information, documents or advice to <role refersTo="#secretary">the Secretary</role> under section 14K; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-14LA__para-ii">
              <num>ii</num>
              <content>
                <p>requires the head of a State or Territory law enforcement agency to give information or documents to <role refersTo="#secretary">the Secretary</role> under section 14L; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-14LA__para-b">
              <num>b</num>
              <content>
                <p>such information, documents or advice is given to <role refersTo="#secretary">the Secretary</role>; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-14LA__para-c">
              <num>c</num>
              <content>
                <p>the person who gave the information, documents or advice to <role refersTo="#secretary">the Secretary</role> knows or believes that the information is, or the documents or advice include information that is, sensitive law enforcement information;</p>
              </content>
            </paragraph>
            <content>
              <p>the person must, at the time of giving the information, documents or advice or subsequently, identify the information that the person knows or believes is sensitive law enforcement information.</p>
              <p><role refersTo="#secretary">the Secretary</role> must identify the information that <role refersTo="#secretary">the Secretary</role> knows or believes is sensitive law enforcement information.</p>
            </content>

                <p>the information was not given to <role refersTo="#secretary">the Secretary</role> by a Commonwealth, State or Territory law enforcement agency; and</p>

              <num>c</num>
              <content>
                <p><role refersTo="#secretary">the Secretary</role> knows or believes that the information is sensitive law enforcement information;</p>
              </content>
            </paragraph>

            <heading>Before section 14N</heading>

              <p>Insert:</p>

            <heading>Secrecy—unauthorised disclosures of sensitive law enforcement information</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-14MA__subclause-1">
              <num>1</num>
              <content>
                <p>A person commits an offence if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-14MA__para-a">
              <num>a</num>
              <content>
                <p>the person has information obtained in connection with the performance of a function, or the exercise of a power, by the person under this Act; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-14MA__para-b">
              <num>b</num>
              <content>
                <p>the information is information identified as sensitive law enforcement information under subsection 14LA(1) or (2); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-14MA__para-c">
              <num>c</num>
              <content>
                <p>the person:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-14MA__para-i">
              <num>i</num>
              <content>
                <p>discloses the information to another person; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-14MA__para-ii">
              <num>ii</num>
              <content>
                <p>uses the information.</p>
              </content>
            </paragraph>
            <content>
              <p>Penalty:	<quantity refersTo="#custodialSentence">Imprisonment for 2 years</quantity> or <quantity refersTo="#penaltyUnit">120 penalty units</quantity>, or both.</p>
              <p>Note:	A defendant bears an evidential burden in relation to a matter in subsection (2) (see subsection 13.3(3) of the <i>Criminal Code</i>).</p>
            </content>

              <num>2</num>
              <content>
                <p>Subsection (1) does not apply if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-14MA__para-a">

              <content>
                <p>the disclosure or use by the person is for the purposes of, or in connection with, the performance of a function or the exercise of a power under this Act; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-14MA__para-b">
              <num>b</num>
              <content>
                <p>the disclosure or use by the person is in compliance with a requirement under a law of the Commonwealth; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-14MA__para-c">
              <num>c</num>
              <content>
                <p>the person or agency that gave the information to <role refersTo="#secretary">the Secretary</role> consents to the disclosure or use; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-14MA__para-d">
              <num>d</num>
              <content>
                <p>the disclosure or use is required by a court or tribunal for the purposes of, or in connection with, proceedings for the purposes of giving effect to this Act or another law of the Commonwealth; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-14MA__para-e">
              <num>e</num>
              <content>
                <p>the information, or a document or advice that included the information, was given to <role refersTo="#secretary">the Secretary</role> by a person or an agency under section 14K or 14L, and the use or disclosure is by that person or that agency.</p>

            </paragraph>
