          <p>		This Act is the <i>Law Enforcement Legislation Amendment (State Bodies and Other Measures)</i><i> </i><i>Act 201</i><i>6</i>.</p>

        <heading>Commencement</heading>
        <subsection eId="sec-2__subsec-1">
          <num>1</num>
          <content>
            <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

          <p>Legislation that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.</p>

              <p>In this Schedule:</p>
              <p><b><i>new Commission</i></b> means the Law Enforcement Conduct Commission of New South Wales.</p>
              <p><b><i>old Commission</i></b> means the Police Integrity Commission of New South Wales.</p>
              <p>Telecommunications (Interception and Access) Act 1979</p>

            <num>2</num>
            <heading>Subsection 5(1) (paragraph (g) of the definition of certifying officer)</heading>
            <content>
              <p>Repeal the paragraph, substitute:</p>

                <p>in the case of the Law Enforcement Conduct Commission:</p>

              <p><b><i>Inspector of the Law Enforcement Conduct Commission</i></b> has the same meaning as <b><i>Inspector</i></b> has in the <i>Law Enforcement Conduct Commission Act 2016</i> (NSW).</p>

              <p><b><i>member of the staff of the Inspector of the Law Enforcement Conduct Commission</i></b> means a member of staff of the Inspector (within the meaning of the <i>Law Enforcement Conduct Commission Act 2016</i> (NSW)).</p>

            <heading>Subsection 5(1) (paragraph (dc) of the definition of permitted purpose)</heading>
            <content>
              <p>Repeal the paragraph, substitute:</p>
              <p>whether or not the subject of a complaint; or</p>
            </content>
            <paragraph eId="schedule-1__clause-12__para-dc">
              <num>dc</num>
              <content>
                <p>in the case of the Inspector of the Law Enforcement Conduct Commission—dealing with (by reports and recommendations) conduct amounting to:</p>

                <p>agency maladministration (within the meaning of subsection (6A)) on the part of the Commission; or</p>
              </content>
            </paragraph>

                <p>	(ii)	officer misconduct (<i>Law Enforcement Conduct Commission Act 2016</i> (NSW)) or officer maladministration (within the meaning of that section) on the part of officers (within the meaning of that Act) of the Commission;<ref href="#sec-122">within the meaning of section 122</ref> of the </p>
              </content>
            </paragraph>

            <heading>Subsection 5(1) (paragraph (e) of the definition of permitted purpose)</heading>

                <p>	(6A)	For the purposes of subparagraph (dc)(i) of the definition of <b><i>permitted purpose</i></b> in subsection (1), <b><i>agency maladministration</i></b> in relation to the Law Enforcement Conduct Commission has the same meaning as it has in the <i>Law Enforcement Conduct Commission Act 2016</i> (NSW) in relation to the NSW Police Force or the Crime Commission.</p>

              <content>
                <p>	(7)	For the purposes of subparagraph (e)(i) of the definition of <b><i>permitted purpose</i></b> in subsection (1), this subsection applies to conduct that:</p>

              <num>a</num>
              <content>
                <p>both:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-19__para-i">
              <num>i</num>
              <content>
                <p>involves a police officer, administrative employee or Crime Commission officer; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-19__para-ii">
              <num>ii</num>
              <content>
                <p>the Law Enforcement Conduct Commission has decided is (or could be) serious misconduct or officer maladministration that is serious maladministration and should be investigated; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-19__para-b">
              <num>b</num>
              <content>
                <p>both:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-19__para-i">
              <num>i</num>
              <content>
                <p>involves <role refersTo="#commissioner">the Commissioner</role> of Police or a Deputy Commissioner of Police; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-19__para-ii">
              <num>ii</num>
              <content>
                <p>is (or could be) police misconduct or officer maladministration; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-19__para-c">
              <num>c</num>
              <content>
                <p>both:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-19__para-i">
              <num>i</num>
              <content>
                <p>involves the Crime Commissioner or an Assistant Commissioner of the Crime Commission; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-19__para-ii">
              <num>ii</num>
              <content>
                <p>is (or could be) Crime Commission officer misconduct or officer maladministration; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-19__para-d">
              <num>d</num>
              <content>
                <p>	(d)	both Houses of the Parliament of New South Wales refer to the Commission for investigation under <i>Law Enforcement Conduct Commission Act 2016</i> (NSW).<ref href="#sec-196">section 196</ref> of the </p>
              </content>
            </paragraph>

              <num>8</num>
              <content>
                <p>	(8)	An expression used in subsection (7) of this section and in the <i>Law Enforcement Conduct Commission Act 2016</i> (NSW) has the same meaning in that subsection as in that Act.</p>

            <heading>Subsections 5AC(5) and (6)</heading>
            <content>

            <heading>Rules</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-55__subclause-1">
              <num>1</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, make rules prescribing matters of a transitional nature (including prescribing any saving or application provisions) relating to:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-55__para-a">
              <num>a</num>
              <content>
                <p>the amendments or repeals made by this Schedule; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-55__para-b">
              <num>b</num>
              <content>
                <p>the abolition of the old Commission (so far as it is relevant to an Act amended by this Schedule); or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-55__para-c">
              <num>c</num>
              <content>
                <p>the establishment of the new Commission (so far as it is relevant to an Act amended by this Schedule).</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-55__subclause-2">
              <num>2</num>
              <content>
                <p>To avoid doubt, the rules may not do the following:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-55__para-a">
              <num>a</num>
              <content>
                <p>create an offence or civil penalty;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-55__para-b">
              <num>b</num>
              <content>
                <p>provide powers of:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-55__para-i">
              <num>i</num>
              <content>
                <p>arrest or detention; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-55__para-ii">
              <num>ii</num>
              <content>
                <p>entry, search or seizure;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-55__para-c">
              <num>c</num>
              <content>
                <p>impose a tax;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-55__para-d">
              <num>d</num>
              <content>
                <p>set an amount to be appropriated from the Consolidated Revenue Fund under an appropriation in this Act;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-55__para-e">
              <num>e</num>
              <content>
                <p>directly amend the text of this Act.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-56">
            <num>56</num>
            <heading>Information acquired under the Telecommunications (Interception and Access) Act 1979</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-56__subclause-1">
              <num>1</num>
              <content>
                <p>This item applies to information that:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-56__para-a">
              <num>a</num>
              <content>
                <p>was acquired by the old Commission before, on or after the commencement of this item; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-56__para-b">
              <num>b</num>
              <content>
                <p>is information of the following kind:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-56__para-i">
              <num>i</num>
              <content>
                <p>lawfully intercepted information;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-56__para-ii">
              <num>ii</num>
              <content>
                <p>interception warrant information;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-56__para-iii">
              <num>iii</num>
              <content>
                <p>lawfully accessed information;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-56__para-iv">
              <num>iv</num>
              <content>
                <p>preservation notice information;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-56__para-v">
              <num>v</num>
              <content>
                <p>stored communications warrant information;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-56__para-vi">
              <num>vi</num>
              <content>
                <p>	(vi)	information or documents voluntarily disclosed to the old Commission in accordance with <i>Telecommunications (Interception and Access) Act 1979</i>;<ref href="#sec-177">section 177</ref> of the </p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-56__para-vii">
              <num>vii</num>
              <content>
                <p>information or documents disclosed under an authorisation made under <ref href="#dvs-3">Division 3</ref> or 4 of <ref href="#part-4">Part 4</ref>-1 of that Act.</p>
              </content>
            </paragraph>

              <num>2</num>
              <content>
                <p>(2)	Nothing in the <i>Telecommunications (Interception and Access) Act 1979</i> prevents the Commissioner of the old Commission from communicating that information to the new Commission on or after that commencement.</p>

            <num>57</num>
            <heading>Information acquired under the Surveillance Devices Act 2004</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-57__subclause-1">
              <num>1</num>
              <content>
                <p>This item applies to information that:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-57__para-a">
              <num>a</num>
              <content>
                <p>was acquired by the old Commission before, on or after the commencement of this item; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-57__para-b">
              <num>b</num>
              <content>
                <p>is protected information.</p>
              </content>
            </paragraph>

              <num>2</num>
              <content>
                <p>(2)	Nothing in the <i>Surveillance Devices Act 2004</i> prevents the Commissioner of the old Commission from communicating that information to the new Commission on or after that commencement.</p>

            <heading>Things shared under the Crimes Act 1914</heading>

                <p>(1)	Subitem (2) applies if before, on or after the commencement of this item, a thing or an original or copy of a document was made available to the old Commission under subsection 3ZQU(5) of the <i>Crimes Act 1914</i>.</p>
