          <p>		This Act is the<i> Criminal Code Amendment (War Crimes) Act 2016</i>.</p>

        <heading>Commencement</heading>
        <subsection eId="sec-2__subsec-1">
          <num>1</num>
          <content>
            <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

        <heading>Schedules</heading>
        <content>
          <p>Legislation that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.</p>

            <heading>Paragraphs 268.70(1)(b) and (c) of the Criminal Code</heading>
            <content>
              <p>Repeal the paragraphs, substitute:</p>
            </content>

              <content>
                <p>the person or persons are neither taking an active part in the hostilities nor are members of an organised armed group; and</p>
              </content>
            </paragraph>

                <p>the perpetrator knows of, or is reckless as to, the factual circumstances establishing that the person or persons are neither taking an active part in the hostilities nor are members of an organised armed group; and</p>

            <heading>At the end of section 268.70 of the Criminal Code</heading>

                <p>	(3)	For the purposes of this section, the expression <b><i>members of an organised armed group</i></b> does not include members of an organised armed group who are <i>hors de combat</i>.</p>

            <heading>Paragraphs 268.71(1)(d) and (e) and (2)(d) and (e) of the Criminal Code</heading>

              <content>
                <p>the person or persons are neither taking an active part in the hostilities nor are members of an organised armed group; and</p>

                <p>the perpetrator knows of, or is reckless as to, the factual circumstances establishing that the person or persons are neither taking an active part in the hostilities nor are members of an organised armed group; and</p>

              <heading>Meaning of civilian</heading>
              <content>
                <p>		In this Division, the expression <b><i>civilian</i></b> does not include a person who is a member of an organised armed group.</p>

                <p>at the time the attack was launched:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-8__para-i">
              <num>i</num>

                <p>the perpetrator did not expect that the attack would result in the incidental death of, or injury to, civilians that would have been excessive in relation to the concrete and direct military advantage anticipated; and</p>
              </content>
            </paragraph>

              <num>ii</num>
              <content>
                <p>it was reasonable in all the circumstances that the perpetrator did not have such an expectation.</p>
              </content>
            </paragraph>

                <p>Subsection (2) does not apply if:</p>
              </content>

              <num>a</num>
              <content>
                <p>the serious endangerment of the physical or mental health, or integrity, of the person or persons occurs in the course of, or as a result of, an attack on a military objective; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10__para-b">
              <num>b</num>
              <content>
                <p>at the time the attack was launched:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10__para-i">
              <num>i</num>
              <content>
                <p>the perpetrator did not expect that the attack would result in the incidental death of, or injury to, civilians that would have been excessive in relation to the concrete and direct military advantage anticipated; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10__para-ii">
              <num>ii</num>
              <content>
                <p>it was reasonable in all the circumstances that the perpetrator did not have such an expectation.</p>

            </paragraph>

                <p>the perpetrator did not expect that the attack would result in the incidental death of, or injury to, civilians that would have been excessive in relation to the concrete and direct military advantage anticipated; and</p>
