          <heading>Objects of this Act</heading>
          <content>
            <p>The objects of this Act are:</p>
          </content>
          <paragraph eId="part-1__sec-3__para-a">
            <num>a</num>
            <content>
              <p>to regulate emissions from certain products by setting emissions standards; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-b">
            <num>b</num>
            <content>
              <p>in doing so, to achieve either or both of the following:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-i">
            <num>i</num>
            <content>
              <p>contribute to improving air quality in Australia in order to deliver associated health and environmental benefits;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-ii">
            <num>ii</num>
            <content>
              <p>assist in giving effect to Australia’s obligations under one or more of the Climate Change Conventions.</p>

          <num>4</num>
          <heading>Simplified outline of this Act</heading>
          <content>
            <p>This Act creates a framework for regulating emissions from products.</p>
            <p>The Act provides for an emissions-controlled product to be certified. To be certified, the product must meet an emissions standard.</p>
            <p>A person who imports or supplies an emissions-controlled product that is not certified will commit an offence. There are also offences related to false or incorrect marking of products as certified. Civil penalties are included as alternatives to offences.</p>
            <p>Products dealt with in breach of the Act are forfeited to the Commonwealth.</p>
            <p>The rules may exempt persons or products from the operation of the Act.</p>
            <p>Record-keeping requirements and regulatory powers (mostly drawn from the Regulatory Powers Act) are included to assist in enforcing the Act.</p>
            <p>The operation of the Act is to be reviewed periodically.</p>

          <heading>Extension to external Territories</heading>
          <subsection eId="part-1__sec-5__subsec-1">
            <num>1</num>
            <content>
              <p>This Act extends to every external Territory.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-5__subsec-2">
            <num>2</num>
            <content>
              <p>The Regulatory Powers Act, as it applies in relation to this Act, extends to every external Territory.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-1__sec-6">
          <num>6</num>
          <heading>Act binds the Crown</heading>
          <subsection eId="part-1__sec-6__subsec-1">
            <num>1</num>
            <content>
              <p>This Act binds the Crown in each of its capacities.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-6__subsec-2">
            <num>2</num>
            <content>
              <p>This Act does not make the Crown liable to be:</p>
            </content>
            <paragraph eId="part-1__sec-6__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>prosecuted for an offence; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-6__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>subject to civil proceedings for a civil penalty order under Part 4 of the Regulatory Powers Act; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-6__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>given an infringement notice under Part 5 of the Regulatory Powers Act.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-1__sec-6__subsec-3">
            <num>3</num>
            <content>
              <p>The protection in subsection (2) does not apply to an authority of the Crown.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-1__sec-7">
          <num>7</num>
          <heading>Definitions</heading>
          <subsection eId="part-1__sec-7__subsec-1">
            <num>1</num>
            <content>
              <p>In this Act:</p>
            </content>
            <content>
              <p><term refersTo="#term-australia">Australia</term> includes <def>the external Territories.</def></p>
              <p><term refersTo="#term-ceo">CEO</term> has the same meaning as <def>in <ref href="">the National Environmental Protection Agency Act 2025</ref>.</def></p>
              <p><term refersTo="#term-certified-for-the-purposes-of-this-act">certified for the purposes of this Act</term> means <def>certified for the purposes of this Act in accordance with the rules.</def></p>
              <p><term refersTo="#term-civil-penalty-provision">civil penalty provision</term> has the same meaning as <def>in the Regulatory Powers Act.</def></p>
              <p><b><i>Climate Change Convention</i></b><b><i>s</i></b> means:</p>

                <p>the United Nations Framework Convention on Climate Change, done at New York on <date date="1992-05-09">9 May 1992</date>; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-7__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>the Kyoto Protocol to the United Nations Framework Convention on Climate Change, done at Kyoto on <date date="1997-12-11">11 December 1997</date>; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-7__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>the Paris Agreement, done at Paris on <date date="2015-12-12">12 December 2015</date>;</p>
              </content>
              <content>
                <p>as amended and in force for Australia from time to time.</p>
                <p><term refersTo="#term-emissions-controlled-product">emissions-controlled product</term> means <def>a product that is prescribed by the rules for the purposes of <ref href="#sec-9">section 9</ref>.</def></p>
                <p><term refersTo="#term-emissions-standard">emissions standard</term> means <def>a standard dealing with matters relating to emissions from products.</def></p>
                <p><term refersTo="#term-engage-in-conduct">engage in conduct</term> includes <def>omitting to perform an act.</def></p>
                <p><term refersTo="#term-evidential-material">evidential material</term> has the same meaning as <def>in the Regulatory Powers Act.</def></p>
                <p><term refersTo="#term-forfeiture-notice">forfeiture notice</term> has the meaning given by <def>subsection 34(2).</def></p>
                <p><term refersTo="#term-inspector">inspector</term> means <def>a person appointed under <ref href="#sec-41">section 41</ref>.</def></p>
                <p><b><i>manufacture</i></b>, for a product prescribed for the purposes of the definition of <b><i>product</i></b>, means produce by any method.</p>
                <p><term refersTo="#term-mark">mark</term> includes <def>label.</def></p>
                <p><term refersTo="#term-person-assisting-an-authorised-person">person assisting an authorised person</term> has the same meaning as <def>in the Regulatory Powers Act.</def></p>
                <p><term refersTo="#term-product">product</term> means <def>a thing (including a substance or mixture of substances) that is: manufactured; or prescribed by the rules for the purposes of this definition.</def></p>

                <p><term refersTo="#term-regulatory-authority">regulatory authority</term> includes <def>a regulatory authority of, or located in, a foreign country.</def></p>
                <p><term refersTo="#term-regulatory-powers-act">Regulatory Powers Act</term> means <def>the Regulatory Powers (Standard Provisions) Act 2014.</def></p>
                <p><b><i>reporting period</i></b>, for an emissions-controlled product, means a period prescribed by the rules.</p>
                <p><term refersTo="#term-rules">rules</term> means <def>rules made under <ref href="#sec-51">section 51</ref>.</def></p>
                <p><term refersTo="#term-secretary">Secretary</term> means <def>the Secretary of the Department.</def></p>
                <p><b><i>supply</i></b>, in relation to a product, has the meaning given by subsection (2).</p>
                <p><b><i>this Act</i></b> includes instruments made under this Act.</p>

          </subsection>
          <subsection eId="part-1__sec-7__subsec-2">
            <num>2</num>
            <content>
              <p>	(2)	A <b><i>supply</i></b> of a product means a supply in the course of trading or commercial activities.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-7__subsec-3">
            <num>3</num>
            <content>
              <p>For the purposes of subsection (2), supply includes:</p>
            </content>
            <paragraph eId="part-1__sec-7__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>an offer to supply (including making available, exposing, displaying or advertising the product); and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-7__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>a supply (including a resupply) by way of sale, exchange, gift, lease, loan, hire or hire-purchase; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-7__subsec-3__para-c">
              <num>c</num>
              <content>
                <p>a supply as part of the supply of another thing.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-1__sec-7__subsec-4">
            <num>4</num>
            <content>
              <p>For the purposes of subsection (2), it is irrelevant whether the supply is:</p>
            </content>
            <paragraph eId="part-1__sec-7__subsec-4__para-a">
              <num>a</num>
              <content>
                <p>for consideration; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-7__subsec-4__para-b">
              <num>b</num>
              <content>
                <p>a wholesale or retail supply.</p>
              </content>
            </paragraph>
          </subsection>

              <p>The rules may prescribe a reporting period for an emissions-controlled product.</p>

              <p>If, during a reporting period for an emissions-controlled product that is manufactured in Australia, a person makes the first supply of the product, the person must give to <role refersTo="#ceo">the CEO</role> a report containing the information prescribed by the rules relating to such products that the person has so supplied during the reporting period.</p>

                <p>Without limiting subsection (1), the product may be seized by attaching to the product, or to the container in which the product is held, a notice in writing signed by the inspector that:</p>

                <p>This section applies if:</p>

                  <p>an inspector seizes an emissions-controlled product under Part 3 of the Regulatory Powers Act as it applies in relation to this Act; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-6__dvs-3__sec-34__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>the inspector reasonably suspects that a provision of <ref href="#part-3">Part 3</ref> of this Act was contravened in relation to the product.</p>
                </content>
              </paragraph>
            </subsection>

              <content>
                <p>	(2)	The inspector may, within 7 days after the product is seized, give a written notice (the <b><i>forfeiture notice</i></b>) to the owner of the product.</p>

                <p>If the owner of the product cannot be identified after reasonable inquiry, the inspector may give the forfeiture notice to the person from whom the product was seized.</p>

                <p>The notice must:</p>
              </content>

                  <p>identify the product; and</p>
                </content>

              <paragraph eId="part-6__dvs-3__sec-34__subsec-4__para-b">

                  <p>state that the product has been seized; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-6__dvs-3__sec-34__subsec-4__para-c">

                  <p>specify the reason for the seizure; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-6__dvs-3__sec-34__subsec-4__para-d">

                  <p>state that the product will be forfeited to the Commonwealth unless a court, on application under <ref href="#sec-35">section 35</ref>, orders the product to be returned.</p>

            <heading>Claims for return of seized product</heading>
            <subsection eId="part-6__dvs-3__sec-35__subsec-1">

                <p>This section applies if a forfeiture notice is given in relation to an emissions-controlled product.</p>
              </content>
            </subsection>
            <subsection eId="part-6__dvs-3__sec-35__subsec-2">
              <num>2</num>
              <content>
                <p>The owner of the product or the person from whom the product was seized may apply to one of the following for an order that the product be returned:</p>
              </content>
              <paragraph eId="part-6__dvs-3__sec-35__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>the Federal Court of Australia;</p>
                </content>
              </paragraph>
              <paragraph eId="part-6__dvs-3__sec-35__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>the Federal Circuit and Family Court of Australia (<ref href="#dvs-2">Division 2</ref>);</p>
                </content>
              </paragraph>
              <paragraph eId="part-6__dvs-3__sec-35__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>a court of a State or Territory that has jurisdiction in relation to matters arising under this Act.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-6__dvs-3__sec-35__subsec-3">
              <num>3</num>
              <content>
                <p>The application must be made <quantity refersTo="#deadline">within 60 days</quantity> after the forfeiture notice is given.</p>
              </content>
            </subsection>
            <subsection eId="part-6__dvs-3__sec-35__subsec-4">
              <num>4</num>
              <content>
                <p>The court must order that the product be returned if:</p>
              </content>
              <paragraph eId="part-6__dvs-3__sec-35__subsec-4__para-a">
                <num>a</num>
                <content>
                  <p>an application for the order was made in accordance with this section; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-6__dvs-3__sec-35__subsec-4__para-b">
                <num>b</num>
                <content>
                  <p>the court is satisfied that no provision of <ref href="#part-3">Part 3</ref> was contravened in relation to the product.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-6__dvs-3__sec-35__subsec-5">
              <num>5</num>
              <content>
                <p>If the court orders that the product be returned, the Commonwealth must take reasonable steps to return the product to the applicant.</p>
              </content>
            </subsection>
            <subsection eId="part-6__dvs-3__sec-35__subsec-6">
              <num>6</num>
              <content>
                <p>Subsection (5) does not apply if:</p>
              </content>
              <paragraph eId="part-6__dvs-3__sec-35__subsec-6__para-a">
                <num>a</num>
                <content>
                  <p>proceedings for which the product may provide evidence were instituted before the order was made, and have not been completed (including any appeal); or</p>
                </content>
              </paragraph>
              <paragraph eId="part-6__dvs-3__sec-35__subsec-6__para-b">
                <num>b</num>
                <content>
                  <p>returning the product could cause an imminent risk of death, serious illness, serious injury or serious damage to the environment; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-6__dvs-3__sec-35__subsec-6__para-c">
                <num>c</num>
                <content>
                  <p>an inspector is otherwise authorised (by a law or an order of a court) to retain, destroy or dispose of the product.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
          <section eId="part-6__dvs-3__sec-36">
            <num>36</num>
            <heading>Forfeiture of seized product to the Commonwealth</heading>
            <content>
              <p>A product in relation to which a forfeiture notice is given is forfeited to the Commonwealth if:</p>
            </content>
            <paragraph eId="part-6__dvs-3__sec-36__para-a">
              <num>a</num>
              <content>
                <p>no application has been made under <ref href="#sec-35">section 35</ref> for an order that the product be returned; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__dvs-3__sec-36__para-b">
              <num>b</num>
              <content>
                <p>such an application has been made, and the court decides not to so order.</p>
              </content>
            </paragraph>
          </section>
          <section eId="part-6__dvs-3__sec-37">
            <num>37</num>
            <heading>Right of compensation in certain circumstances</heading>
            <subsection eId="part-6__dvs-3__sec-37__subsec-1">
              <num>1</num>
              <content>
                <p>The person who owned an emissions-controlled product forfeited to the Commonwealth under <ref href="#sec-36">section 36</ref> may apply to one of the following for compensation:</p>
              </content>
              <paragraph eId="part-6__dvs-3__sec-37__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>the Federal Court of Australia;</p>
                </content>
              </paragraph>
              <paragraph eId="part-6__dvs-3__sec-37__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>the Federal Circuit and Family Court of Australia (<ref href="#dvs-2">Division 2</ref>);</p>
                </content>
              </paragraph>
              <paragraph eId="part-6__dvs-3__sec-37__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>a court of a State or Territory that has jurisdiction in relation to matters arising under this Act.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-6__dvs-3__sec-37__subsec-2">
              <num>2</num>
              <content>
                <p>The court must order that the Commonwealth pay compensation to the applicant if the court is satisfied that:</p>
              </content>
              <paragraph eId="part-6__dvs-3__sec-37__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>the applicant owned the product immediately before it was forfeited; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-6__dvs-3__sec-37__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>either:</p>
                </content>
              </paragraph>
              <paragraph eId="part-6__dvs-3__sec-37__subsec-2__para-i">
                <num>i</num>
                <content>
                  <p>Part 3 of the Regulatory Powers Act, as it applies in relation to this Act, was not complied with in relation to the seizure of the product; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-6__dvs-3__sec-37__subsec-2__para-ii">
                <num>ii</num>
                <content>
                  <p>if the product was forfeited under paragraph 36(a)—no provision of <ref href="#part-3">Part 3</ref> of this Act was contravened in relation to the product.</p>

            </subsection>

                <p>The amount of compensation must be the market value of the product at the time the product was forfeited under <ref href="#sec-36">section 36</ref>.</p>

            <p>This Part deals with the appointment of inspectors, the publication and disclosure of information, and the conduct of audits to ensure compliance with this Act.</p>
            <p>It also provides for the delegation of powers, requires periodic reviews of the operation of the Act, and enables <role refersTo="#minister">the Minister</role> to make rules.</p>

        </section>

          <heading>Inspectors</heading>
          <subsection eId="part-7__sec-41__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#ceo">The CEO</role> may, in writing, appoint an APS employee as an inspector for the purposes of this Act.</p>
            </content>
          </subsection>
          <subsection eId="part-7__sec-41__subsec-2">
            <num>2</num>
            <content>
              <p><role refersTo="#ceo">The CEO</role> must not appoint a person as an inspector unless <role refersTo="#ceo">the CEO</role> is satisfied that the person has the knowledge or experience necessary to properly exercise the powers of an inspector.</p>
            </content>
          </subsection>
          <subsection eId="part-7__sec-41__subsec-3">
            <num>3</num>
            <content>
              <p>An inspector must, in performing functions or exercising powers as an inspector, comply with any directions of <role refersTo="#ceo">the CEO</role>.</p>
            </content>

            <content>
              <p>If a direction is given under subsection (3) in writing, the direction is not a legislative instrument.</p>

          <heading>Publication of information relating to certifications and exemptions</heading>
          <subsection eId="part-7__sec-42__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#ceo">The CEO</role> may publish information relating to an emissions-controlled product that is certified for the purposes of this Act, including but not limited to:</p>
            </content>
            <paragraph eId="part-7__sec-42__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>information that identifies the product and the manufacturer of the product; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-42__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>information about emissions from the product; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-42__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>information about the certification.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-7__sec-42__subsec-2">
            <num>2</num>
            <content>
              <p><role refersTo="#ceo">The CEO</role> may publish information relating to an exemption of an emissions-controlled product or a person from a provision of this Act, including but not limited to:</p>
            </content>
            <paragraph eId="part-7__sec-42__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>circumstances in which the exemption applies; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-42__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>reasons for the exemption; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-42__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>the person who applied for the exemption.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-7__sec-43">
          <num>43</num>
          <heading>Disclosure of information</heading>
          <subsection eId="part-7__sec-43__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> may disclose information obtained under this Act to:</p>
            </content>
            <paragraph eId="part-7__sec-43__subsec-1__para-a">
              <num>a</num>
              <content>
                <p><role refersTo="#ceo">the CEO</role>; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-43__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>an agency, body or person prescribed by the rules;</p>
              </content>
              <content>
                <p>if <role refersTo="#minister">the Minister</role> reasonably believes that the information will enable or assist the agency, body or person to exercise its powers, or perform its functions or duties.</p>

              <p>This section applies if <role refersTo="#ceo">the CEO</role>:</p>

              <num>a</num>
              <content>
                <p>reasonably suspects that a person has engaged or is engaging in conduct that constitutes:</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-44__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>an offence against this Act; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-44__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>a contravention of a civil penalty provision; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-44__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>is satisfied that it would be in the public interest to give the person a notice under this section.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-7__sec-44__subsec-2">

              <p><role refersTo="#ceo">The CEO</role> may, by written notice given to the person, require the person:</p>
            </content>
            <paragraph eId="part-7__sec-44__subsec-2__para-a">

                <p>to undertake, or arrange for another person to undertake, an audit of whichever of the following is specified in the notice:</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-44__subsec-2__para-i">
              <num>i</num>
              <content>
                <p>the person’s compliance with this Act;</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-44__subsec-2__para-ii">
              <num>ii</num>
              <content>
                <p>one or more specified aspects of the person’s compliance with this Act; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-44__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>to give <role refersTo="#ceo">the CEO</role> a written report setting out the results of the audit.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-7__sec-44__subsec-3">
            <num>3</num>
            <content>
              <p>The notice must specify:</p>
            </content>
            <paragraph eId="part-7__sec-44__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>if the notice requires the person to arrange another person to undertake the audit—requirements relating to the qualifications and independence of the other person; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-44__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>the matters to be covered by the audit; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-44__subsec-3__para-c">
              <num>c</num>
              <content>
                <p>the period within which the audit must be undertaken; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-44__subsec-3__para-d">
              <num>d</num>
              <content>
                <p>the form and content of the report; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-44__subsec-3__para-e">
              <num>e</num>
              <content>
                <p>the period within which the report must be given to <role refersTo="#minister">the Minister</role>.</p>

            </paragraph>
          </subsection>

              <p><role refersTo="#minister">The Minister</role> must cause a review of the operation of this Act to be undertaken as soon as possible after the seventh anniversary of its commencement and afterwards at intervals of no longer than 10 years.</p>

              <p>	(1)	This section applies if a provision of this Act provides that a person contravening another provision of this Act (the <b><i>conduct rule provision</i></b>) commits an offence.</p>

          <heading>Contravening offence and civil penalty provisions</heading>
          <subsection eId="part-7__sec-49__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	This section applies if a provision of this Act provides that a person contravening another provision of this Act (the <b><i>conduct provision</i></b>) commits an offence or is liable to a civil penalty.</p>

          </subsection>

            <num>2</num>
            <content>
              <p>For the purposes of this Act, and the Regulatory Powers Act to the extent that it relates to this Act, a reference to a contravention of an offence provision or a civil penalty provision includes a reference to a contravention of the conduct provision.</p>

        </section>

          <num>50</num>
          <heading>Alternative constitutional bases</heading>
          <subsection eId="part-7__sec-50__subsec-1">
            <num>1</num>
            <content>
              <p>Without limiting the effect of this Act apart from this section, this Act also has effect as provided by this section.</p>
            </content>
          </subsection>
          <subsection eId="part-7__sec-50__subsec-2">
            <num>2</num>
            <content>
              <p>To avoid doubt, no subsection of this section limits the operation of any other subsection.</p>
            </content>
            <content>
              <p>Import</p>
            </content>
          </subsection>
          <subsection eId="part-7__sec-50__subsec-3">
            <num>3</num>
            <content>
              <p>This Act has the effect it would have if each reference to import were expressly confined to import in the course of trade or commerce.</p>
            </content>
            <content>
              <p>Supply</p>
            </content>
          </subsection>
          <subsection eId="part-7__sec-50__subsec-4">
            <num>4</num>
            <content>
              <p>This Act has the effect it would have if each reference to supply were expressly confined to supply in the course of trade or commerce:</p>
            </content>
            <paragraph eId="part-7__sec-50__subsec-4__para-a">
              <num>a</num>
              <content>
                <p>between Australia and places outside Australia; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-50__subsec-4__para-b">
              <num>b</num>
              <content>
                <p>among the States; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-50__subsec-4__para-c">
              <num>c</num>
              <content>
                <p>within a Territory, between a State and a Territory or between 2 Territories.</p>
              </content>
              <content>
                <p>Corporations power</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-7__sec-50__subsec-5">
            <num>5</num>
            <content>
              <p>This Act has the effect it would have if each reference to a person were expressly confined to a corporation to which paragraph 51(xx) of the Constitution applies.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-7__sec-51">
          <num>51</num>
          <heading>Rules</heading>
          <subsection eId="part-7__sec-51__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, make rules prescribing matters:</p>
            </content>
            <paragraph eId="part-7__sec-51__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>required or permitted by this Act to be prescribed by the rules; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-51__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>necessary or convenient to be prescribed for carrying out or giving effect to this Act.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-7__sec-51__subsec-2">
            <num>2</num>
            <content>
              <p>Without limiting subsection (1), the rules may provide for:</p>
            </content>
            <paragraph eId="part-7__sec-51__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>charging fees for services provided in the performance of functions under this Act; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-51__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>the review of decisions made under this Act.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-7__sec-51__subsec-3">
            <num>3</num>
            <content>
              <p>Rules setting out an emissions standard for the purposes of paragraph 10(2)(a) may apply, adopt or incorporate any matter contained in an instrument or other writing as in force or existing from time to time if the instrument or writing is produced by one or more of the following:</p>
            </content>

              <num>a</num>
              <content>
                <p>the International Electrotechnical Commission;</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-51__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>the International Organization for Standardization;</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-51__subsec-3__para-c">
              <num>c</num>
              <content>
                <p>the United Nations Economic Commission for Europe;</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-51__subsec-3__para-d">
              <num>d</num>
              <content>
                <p>any other organisation prescribed by the rules.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-7__sec-51__subsec-4">
            <num>4</num>
            <content>
              <p>Rules specifying an emissions standard for the purposes of subparagraph 10(2)(b)(ii) may specify a standard as in force or existing from time to time.</p>
            </content>
          </subsection>
          <subsection eId="part-7__sec-51__subsec-5">
            <num>5</num>
            <content>
              <p>To avoid doubt, the rules may not do the following:</p>
            </content>
            <paragraph eId="part-7__sec-51__subsec-5__para-a">
              <num>a</num>
              <content>
                <p>create an offence or civil penalty;</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-51__subsec-5__para-b">
              <num>b</num>
              <content>
                <p>provide powers of:</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-51__subsec-5__para-i">
              <num>i</num>
              <content>
                <p>arrest or detention; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-51__subsec-5__para-ii">
              <num>ii</num>
              <content>
                <p>entry, search or seizure;</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-51__subsec-5__para-c">
              <num>c</num>
              <content>
                <p>impose a tax;</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-51__subsec-5__para-d">
              <num>d</num>
              <content>
                <p>set an amount to be appropriated from the Consolidated Revenue Fund under an appropriation in this Act;</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-51__subsec-5__para-e">
              <num>e</num>
              <content>
                <p>directly amend the text of this Act.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-7__sec-51__subsec-6">
            <num>6</num>
            <content>
              <p>	(6)	Before making rules for the purposes of paragraph 43(1)(b), the Minister must consult the Information Commissioner in relation to matters that relate to the privacy functions (within the meaning of the <i>Australian Information Commissioner Act 2010</i>) and have regard to any submissions made by the Information Commissioner because of that consultation.</p>

              <p>	(7)	The rules may provide for the collection and recovery of charges imposed by the <i>Product Emission</i><i>s</i><i> Standards (Customs) Charges</i> <i>Act 201</i><i>7</i> and the <i>Product Emission</i><i>s</i><i> Standards (Excise) Charges Act 201</i><i>7</i>.</p>

                <b>Editorial changes</b>

                <b>Misdescribed amendments</b>

              <p>A misdescribed amendment is an amendment that does not accurately describe how an amendment is to be made. If, despite the misdescription, the amendment can be given effect as intended, then the misdescribed amendment can be incorporated through an editorial change made under <i>Legislation Act 2003</i>.<ref href="#sec-15V">section 15V</ref> of the </p>
