          <p>		This Act is the <i>Marriage Amendment (Definition and Religious Freedoms) </i><i>Act 201</i><i>7</i>.</p>

            <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

            <heading>Objects of this Act</heading>
            <content>
              <p>It is an object of this Act to create a legal framework:</p>
            </content>
            <paragraph eId="schedule-1__clause-2A__para-a">
              <num>a</num>
              <content>
                <p>to allow civil celebrants to solemnise marriage, understood as the union of 2 people to the exclusion of all others, voluntarily entered into for life; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-2A__para-b">
              <num>b</num>
              <content>
                <p>to allow ministers of religion to solemnise marriage, respecting the doctrines, tenets and beliefs of their religion, the views of their religious community or their own religious beliefs; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-2A__para-c">
              <num>c</num>
              <content>
                <p>to allow equal access to marriage while protecting religious freedom in relation to marriage.</p>
              </content>
            </paragraph>

            <num>2</num>
            <heading>Subsection 5(1) (definition of authorised celebrant)</heading>
            <content>
              <p>Repeal the definition, substitute:</p>
              <p><b><i>authorised celebrant</i></b> means:</p>
            </content>
            <paragraph eId="schedule-1__clause-2__para-a">
              <num>a</num>
              <content>
                <p>in relation to a marriage proposed to be solemnised in Australia:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-2__para-i">
              <num>i</num>
              <content>
                <p>a minister of religion registered under Subdivision A of <ref href="#dvs-1">Division 1</ref> of <ref href="#part-IV">Part IV</ref>; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-2__para-ii">
              <num>ii</num>
              <content>
                <p>a person authorised to solemnise marriages under Subdivision B of <ref href="#dvs-1">Division 1</ref> of <ref href="#part-IV">Part IV</ref>; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-2__para-iii">
              <num>iii</num>
              <content>
                <p>a marriage celebrant; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-2__para-iv">
              <num>iv</num>
              <content>
                <p>a religious marriage celebrant; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-2__para-b">
              <num>b</num>
              <content>
                <p>in relation to a marriage proposed to be solemnised in accordance with <ref href="#dvs-3">Division 3</ref> of <ref href="#part-V">Part V</ref>:</p>
              </content>
            </paragraph>

              <num>i</num>
              <content>
                <p>a chaplain; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-2__para-ii">
              <num>ii</num>
              <content>
                <p>	(ii)	an officer (within the meaning of the <i>Defence Act 1903</i>), other than a chaplain, authorised by the Chief of the Defence Force under section 71A to solemnise marriages under that Division.</p>

            <heading>Entitlement to be identified as a religious marriage celebrant  on the register of marriage celebrants</heading>
            <content>
              <p>A person is entitled to be identified as a religious marriage celebrant on the register of marriage celebrants if:</p>
            </content>
            <paragraph eId="schedule-1__clause-39DA__para-a">
              <num>a</num>
              <content>
                <p>the person is registered as a marriage celebrant under Subdivision C of this Division; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-39DA__para-b">
              <num>b</num>
              <content>
                <p>the person is a minister of religion.</p>
              </content>
            </paragraph>
          </hcontainer>

            <heading>Request to be identified as a religious marriage celebrant on the register of marriage celebrants</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-39DB__subclause-1">
              <num>1</num>

                <p>A person may, in writing, give <role refersTo="#registrar">the Registrar</role> of Marriage Celebrants notice that the person wishes to be identified as a religious marriage celebrant on the register of marriage celebrants.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-39DB__subclause-2">
              <num>2</num>
              <content>
                <p>The notice must be in a form approved by <role refersTo="#registrar">the Registrar</role>, and include all of the information required by the form.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-39DC">
            <num>39DC</num>
            <heading>Identification as a religious marriage celebrant</heading>
            <content>
              <p><role refersTo="#registrar">The Registrar</role> of Marriage Celebrants must identify a person as a religious marriage celebrant on the register of marriage celebrants if:</p>
            </content>
            <paragraph eId="schedule-1__clause-39DC__para-a">
              <num>a</num>
              <content>
                <p>the person has given <role refersTo="#registrar">the Registrar</role> notice in accordance with section 39DB that the person wishes to be identified as a religious marriage celebrant on the register; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-39DC__para-b">
              <num>b</num>
              <content>
                <p>the person is entitled to be identified as a religious marriage celebrant on the register.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-39DD">
            <num>39DD</num>
            <heading>Transitional provisions for existing marriage celebrants</heading>
            <content>
              <p>Marriage celebrants who are ministers of religion, but not ministers of religion of a recognised denomination</p>
              <p>Marriage celebrants who wish to be religious marriage celebrants on the basis of their religious beliefs</p>
            </content>
            <hcontainer name="subclause" eId="schedule-1__clause-39DD__subclause-1">
              <num>1</num>
              <content>
                <p><role refersTo="#registrar">The Registrar</role> of Marriage Celebrants must identify a person as a religious marriage celebrant on the register of marriage celebrants if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-39DD__para-a">
              <num>a</num>
              <content>
                <p>	(a)	the person was registered as a marriage celebrant under Subdivision C of this Division immediately before <i>Marriage Amendment (Definition and Religious Freedoms) Act 2017</i> commenced; and<ref href="#part-1">Part 1</ref> of Schedule 1 to the </p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-39DD__para-b">
              <num>b</num>
              <content>
                <p>the person is a minister of religion.</p>
              </content>
            </paragraph>

              <content>
                <p><role refersTo="#registrar">The Registrar</role> of Marriage Celebrants must identify a person as a religious marriage celebrant on the register of marriage celebrants if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-39DD__para-a">
              <num>a</num>
              <content>
                <p>	(a)	the person was registered as a marriage celebrant under Subdivision C of this Division immediately before <i>Marriage Amendment (Definition and Religious Freedoms) Act 2017</i> commenced; and<ref href="#part-1">Part 1</ref> of Schedule 1 to the </p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-39DD__para-b">
              <num>b</num>
              <content>
                <p>the person gives <role refersTo="#registrar">the Registrar</role> notice that the person wishes to be identified as a religious marriage celebrant on the register:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-39DD__para-i">
              <num>i</num>
              <content>
                <p>in writing; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-39DD__para-ii">
              <num>ii</num>
              <content>
                <p>in a form approved by <role refersTo="#registrar">the Registrar</role>; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-39DD__para-iii">
              <num>iii</num>
              <content>
                <p><i>	</i>(iii)	within 90 days after Part 1 of Schedule 1 to the <i>Marriage Amendment (Definition and Religious Freedoms) Act 2017 </i>commences; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-39DD__para-c">
              <num>c</num>
              <content>
                <p>the choice is based on the person’s religious beliefs.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-39DE">
            <num>39DE</num>
            <heading>Process of identification on the register as a religious marriage celebrant</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-39DE__subclause-1">
              <num>1</num>
              <content>
                <p><role refersTo="#registrar">The Registrar</role> identifies a person as a religious marriage celebrant on the register of marriage celebrants by annotating the register to include that detail.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-39DE__subclause-2">
              <num>2</num>
              <content>
                <p>If <role refersTo="#registrar">the Registrar</role> identifies a person as a religious marriage celebrant on the register of marriage celebrants, <role refersTo="#registrar">the Registrar</role> must, as soon as practicable, give the person written notice of that fact.</p>
              </content>
            </hcontainer>

                <p>A body established for religious purposes may refuse to make a facility available, or to provide goods or services, for the purposes of the solemnisation of a marriage, or for purposes reasonably incidental to the solemnisation of a marriage, if the refusal:</p>

                <p>(1)	To avoid doubt, subsection 104(3) of the <i>Family Law Act 1975</i> extends to a divorce, annulment or legal separation relating to a pre-commencement same-sex marriage, even if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-4__clause-4__para-a">
              <num>a</num>
              <content>
                <p>the relevant date (<ref href="#sec-104">as defined in section 104</ref> of that Act) was before the recognition time; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-4__para-b">
              <num>b</num>
              <content>
                <p>the divorce, annulment or legal separation occurred before the recognition time.</p>
              </content>
            </paragraph>

                <p>(2)	The <i>Family Law Act 1975</i> applies as if subsection 104(3) of that Act also provided for a divorce effected in accordance with the law of an overseas jurisdiction to be recognised as valid in Australia if the divorce related to a pre-commencement same-sex marriage and was effected before the recognition time.</p>

            <hcontainer name="subclause" eId="schedule-4__clause-4__subclause-3">
              <num>3</num>
              <content>
                <p>(3)	For the purposes of the application of subsection 104(4) of the <i>Family Law Act 1975</i> in relation to subsection 104(3) of that Act as it applies because of subitem (2), the mere fact that the divorce relates to a pre-commencement same-sex marriage does not mean that recognition of the divorce would manifestly be contrary to public policy.</p>

          </hcontainer>
          <hcontainer name="clause" eId="schedule-4__clause-5">
            <num>5</num>
            <heading>Financial agreements and separation declarations</heading>
            <hcontainer name="subclause" eId="schedule-4__clause-5__subclause-1">
              <num>1</num>
              <content>
                <p>This item applies if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-4__clause-5__para-a">
              <num>a</num>
              <content>
                <p>before the recognition time, the parties to a pre-commencement same-sex marriage made a <ref href="#part-VIIIAB">Part VIIIAB</ref> financial agreement relating to a contemplated, actual or former de facto relationship between them:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-5__para-i">
              <num>i</num>
              <content>
                <p>whether or not they were parties to the pre-commencement same-sex marriage at the time they made the agreement; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-5__para-ii">
              <num>ii</num>
              <content>
                <p>whether or not anyone else is a party to the agreement; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-5__para-b">
              <num>b</num>
              <content>
                <p>	(b)	under <i>Family Law Act 1975</i>, the agreement is binding on the parties to the agreement immediately before the recognition time.<ref href="#sec-90U">section 90U</ref>J of the </p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-4__clause-5__subclause-2">
              <num>2</num>
              <content>
                <p>(2)	For the purposes of a law of the Commonwealth (including the <i>Family Law Act 1975</i>) at and after the recognition time, the agreement, with the necessary changes, is taken:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-4__clause-5__para-a">
              <num>a</num>
              <content>
                <p>to be a financial agreement made under <ref href="#part-VIIIA">Part VIIIA</ref> of that Act relating to a contemplated, actual or former marriage between the parties to the pre-commencement same-sex marriage; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-5__para-b">
              <num>b</num>
              <content>
                <p>to be binding on the parties to the agreement under <ref href="#sec-90G">section 90G</ref> of that Act until the agreement is terminated or set aside in accordance with that Act.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-4__clause-5__subclause-3">
              <num>3</num>
              <content>
                <p>However, the agreement is taken not to include a provision that deals with a matter that could not validly have been dealt with in a <ref href="#part-VIIIAB">Part VIIIAB</ref> financial agreement, even if the matter could validly be dealt with in a financial agreement.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-4__clause-5__subclause-4">
              <num>4</num>
              <content>
                <p>(4)	Section 90E of the <i>Family Law Act 1975 </i>does not apply in relation to the agreement at and after the recognition time if the agreement was covered by section 90UE (agreements made in non-referring States that become Part VIIIAB financial agreements) of that Act before that time.</p>
              </content>
            </hcontainer>
            <content>
              <p>Note:	Section 90E and subsection 90UH(1) of that Act set out requirements for provisions in agreements relating to the maintenance of a party or a child or children. Subsection 90UH(1) does not apply in relation to a <ref href="#part-VIIIAB">Part VIIIAB</ref> financial agreement covered by <ref href="#sec-90U">section 90U</ref>E.</p>
            </content>
            <hcontainer name="subclause" eId="schedule-4__clause-5__subclause-5">
              <num>5</num>
              <content>
                <p>(5)	If, before the recognition time, a separation declaration was made, as described in <i>Family Law Act 1975</i>, for the purposes of giving effect to the agreement (whether the declaration was included in the agreement or not), the declaration is taken on and after that time to be a separation declaration made as described in section 90DA of that Act.<ref href="#sec-90U">section 90U</ref>F of the </p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-4__clause-5__subclause-6">
              <num>6</num>
              <content>
                <p>(6)	If, before the recognition time, a separation declaration was made as described in subsection 90MP(8), (9) or (10) of the <i>Family Law Act 1975</i> in relation to the agreement so far as it is a superannuation agreement for the purposes of Part VIIIB of that Act, the declaration is taken on and after that time to be a separation declaration made as described in subsection 90MP(3), (4) or (4A) of that Act.</p>

                <p>Subitem (6) applies whether the separation declaration was included in the superannuation agreement or not.</p>

                <p>The WA court is invested with jurisdiction to hear and determine the proceedings as continued under subitem (2).</p>

                <p>Any decision validly made by a court before the recognition time about the admissibility of particular evidence in the proceedings continues to have effect for the purposes of the proceedings after that time.</p>

                <p>In performing duties or exercising powers in relation to the proceedings under the Commonwealth Act, a court may ask questions of, and seek evidence or the production of documents or other things from, parties, witnesses and experts on matters relevant to the proceedings.</p>

                <p>whether or not they were parties to the pre-commencement same-sex marriage at the time they made the agreement; and</p>

            </paragraph>
            <paragraph eId="schedule-4__clause-8__para-ii">
              <num>ii</num>
              <content>
                <p>whether or not anyone else is a party to the agreement; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-8__para-b">
              <num>b</num>
              <content>
                <p>under <ref href="#sec-205Z">section 205Z</ref>S of that Act, the agreement is binding on the parties to the agreement immediately before the recognition time.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-4__clause-8__subclause-2">
              <num>2</num>
              <content>
                <p>(2)	For the purposes of a law of the Commonwealth (including the <i>Family Law Act 1975</i>) at and after the recognition time, the agreement, with the necessary changes, is taken:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-4__clause-8__para-a">
              <num>a</num>
              <content>
                <p>to be a financial agreement made under <ref href="#part-VIIIA">Part VIIIA</ref> of that Act relating to a contemplated, actual or former marriage between the parties to the pre-commencement same-sex marriage; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-8__para-b">
              <num>b</num>
              <content>
                <p>to be binding on the parties to the agreement under <ref href="#sec-90G">section 90G</ref> of that Act until the agreement is terminated or set aside in accordance with that Act.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-4__clause-8__subclause-3">
              <num>3</num>
              <content>
                <p>(3)	However, the agreement is taken not to include a provision that deals with a matter that could not validly have been dealt with in a financial agreement within the meaning of <i>Family Court Act 1997 </i>(WA), even if the matter could validly be dealt with in a financial agreement within the meaning of the <i>Family Law Act 1975</i>.<ref href="#part-5">Part 5</ref>A of the </p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-4__clause-8__subclause-4">
              <num>4</num>
              <content>
                <p>(4)	If the agreement was a former financial agreement (within the meaning of <i>Family Court Act 1997 </i>(WA)), then section 90E of the <i>Family Law Act 1975</i> (requirements for provisions in agreements relating to the maintenance of a party or a child or children) does not apply in relation to the agreement.<ref href="#part-5">Part 5</ref>A of the </p>
              </content>

              <num>5</num>
              <content>
                <p>(5)	Section 90DA (need for separation declaration) of the <i>Family Law Act 1975</i> does not apply in relation to the agreement unless the spouse parties separate, and begin living separately and apart, at or after the recognition time.</p>

            <num>9</num>
            <heading>Second marriage ceremonies for certain marriages by foreign diplomatic or consular officers that occurred in Australia before commencement</heading>
            <hcontainer name="subclause" eId="schedule-4__clause-9__subclause-1">
              <num>1</num>
              <content>
                <p>(1)	This item applies to a marriage (within the meaning of the <i>Marriage Act 1961</i>, as amended by this Act) that was solemnised:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-4__clause-9__para-a">
              <num>a</num>
              <content>
                <p>in Australia, before the commencement of this item; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-9__para-b">
              <num>b</num>
              <content>
                <p>by or in the presence of a diplomatic or consular officer of a foreign country (whether or not the country was a proclaimed overseas country at the time the marriage was solemnised).</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-4__clause-9__subclause-2">
              <num>2</num>
              <content>
                <p>(2)	Subsections 113(2) and (5) of the <i>Marriage Act 1961</i>, as in force on and after the commencement of this item, apply in relation to the marriage as if it took place outside Australia.</p>

          </hcontainer>
          <hcontainer name="clause" eId="schedule-4__clause-10">
            <num>10</num>
            <heading>Transitional rules</heading>
            <hcontainer name="subclause" eId="schedule-4__clause-10__subclause-1">
              <num>1</num>
              <content>
                <p>(1)	The Attorney-General may, by legislative instrument, make rules (<b><i>transitional rules</i></b>) prescribing matters of a transitional nature (including prescribing any saving or application provisions) relating to the amendments or repeals made by this Act.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-4__clause-10__subclause-2">
              <num>2</num>
              <content>
                <p>To avoid doubt, the transitional rules may not do the following:</p>
              </content>
            </hcontainer>

              <num>a</num>
              <content>
                <p>create an offence or civil penalty;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-10__para-b">
              <num>b</num>

                <p>provide powers of:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-10__para-i">
              <num>i</num>
              <content>
                <p>arrest or detention; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-10__para-ii">
              <num>ii</num>
              <content>
                <p>entry, search or seizure;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-10__para-c">
              <num>c</num>
              <content>
                <p>impose a tax;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-10__para-d">
              <num>d</num>
              <content>
                <p>set an amount to be appropriated from the Consolidated Revenue Fund under an appropriation in this Act;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-10__para-e">
              <num>e</num>
              <content>
                <p>directly amend the text of an Act.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-4__clause-10__subclause-3">
              <num>3</num>
              <content>
                <p>(3)	Subsection 12(2) (retrospective application of legislative instruments) of the <i>Legislation Act 2003</i> does not apply to transitional rules made during the period of 12 months starting on the commencement of this item.</p>
