              <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

            <p>•	This Act establishes the Independent Parliamentary Expenses Authority.</p>
            <p>•	<role refersTo="#authority">The Authority</role> has functions relating to:</p>

              <p>the travel, work and other resources of current and former members of parliament; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-b">

              <p>	(b)	the travel resources of persons employed under the <i>Members of Parliament (Staff) Act 1984</i>.</p>
            </content>
            <content>
              <p>•	Those functions include:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-a">
            <num>a</num>
            <content>
              <p>giving advice about certain resources; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-b">
            <num>b</num>
            <content>
              <p>monitoring certain resources; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-c">
            <num>c</num>
            <content>
              <p>preparing regular reports relating to certain resources; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-d">

              <p>audits relating to certain resources; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-e">

              <p>processing claims relating to certain resources; and</p>

          </paragraph>
          <paragraph eId="part-1__sec-3__para-f">
            <num>f</num>

              <p>giving rulings relating to certain resources.</p>

              <p>•	<role refersTo="#authority">The Authority</role> has a CEO who is responsible for its administration and for assisting it to perform its functions.</p>

          </paragraph>
        </section>
        <section eId="part-1__sec-4">
          <num>4</num>
          <heading>Definitions</heading>
          <subsection eId="part-1__sec-4__subsec-1">
            <num>1</num>
            <content>
              <p>In this Act:</p>
            </content>
            <content>
              <p><term refersTo="#term-appointed-member-of-the-authority">appointed member of the Authority</term> means <def>a member of the Authority who is not the President of the Remuneration Tribunal.</def></p>
              <p><term refersTo="#term-authority">Authority</term> means <def>the Independent Parliamentary Expenses Authority.</def></p>
              <p><b><i>Authority</i></b><b><i>-</i></b><b><i>administered MP resource</i></b>: see subsection 12(1A).</p>
              <p><term refersTo="#term-ceo">CEO</term> means <def>the Chief Executive Officer of the Authority.</def></p>
              <p><term refersTo="#term-claim">claim</term> includes <def>request.</def></p>
              <p><b><i>Commonwealth judicial officer</i></b> means:</p>
            </content>
            <paragraph eId="part-1__sec-4__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>a Justice of the High Court; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>a judge or justice of a court created by the Parliament.</p>
              </content>
              <content>
                <p><b><i>designated MP resource</i></b>: see subsection 12(1B).</p>
                <p><b><i>engage in conduct</i></b> means:</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>do an act; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>omit to perform an act.</p>
              </content>
              <content>
                <p><term refersTo="#term-harm">harm</term> has the same meaning as <def>in the Dictionary to the Criminal Code.</def></p>
                <p><term refersTo="#term-incidentals">incidentals</term> includes <def>the cost of transport.</def></p>
                <p><term refersTo="#term-legislative-rules">legislative rules</term> means <def>rules made under <ref href="#sec-64">section 64</ref>.</def></p>
                <p><b><i>member of parliament</i></b> means:</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>a senator; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>a member of the House of Representatives; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>a Minister of State who is not a senator or member of the House of Representatives; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-d">
              <num>d</num>
              <content>
                <p>	(d)	a person who is taken to be the President of the Senate under the <i>Parliamentary Presiding Officers Act 1965</i> and who is not a senator or member of the House of Representatives; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-e">
              <num>e</num>
              <content>
                <p>	(e)	a person who is taken to be the Speaker of the House of Representatives under the <i>Parliamentary Presiding Officers Act 1965</i> and who is not a senator or member of the House of Representatives.</p>
              </content>
              <content>
                <p><term refersTo="#term-member-of-the-authority">member of the Authority</term> includes <def>the Chair of the Authority.</def></p>
                <p><term refersTo="#term-mops-staff-member">MOPS staff member</term> means <def>a person employed under the Members of Parliament (Staff) Act 1984.</def></p>
                <p><b><i>MOPS travel resource</i></b> means:</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>an expense that is:</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>incurred in connection with travel by a MOPS staff member at the expense of the Commonwealth; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>authorised by or under, or by an agreement made under, a law of the Commonwealth (other than this Act); or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>an allowance that is:</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>payable to a MOPS staff member in connection with travel by the MOPS staff member; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>authorised by or under, or by an agreement made under, a law of the Commonwealth (other than this Act).</p>
              </content>
              <content>
                <p><term refersTo="#term-paid-work">paid work</term> means <def>work for financial gain or reward (whether as an employee, a self-employed person or otherwise).</def></p>
                <p><term refersTo="#term-secretary">Secretary</term> means <def>the Secretary of the Department.</def></p>
                <p><term refersTo="#term-staff-of-the-authority">staff of the Authority</term> means <def>the staff described in <ref href="#sec-49">section 49</ref>.</def></p>
                <p><b><i>vacancy</i></b>, in relation to the office of a member of the Authority, has a meaning affected by section 6.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-1__sec-4__subsec-2">
            <num>2</num>
            <content>
              <p>To avoid doubt, a reference in this Act to an amount or resource (however described) that is payable, or is or has been paid or provided, under this or any other Act includes an amount or resource that is purportedly payable, or that is or has been purportedly paid or provided under that Act.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-1__sec-5">
          <num>5</num>
          <heading>Expenses or allowances in connection with travel</heading>
          <subsection eId="part-1__sec-5__subsec-1">
            <num>1</num>
            <content>
              <p>For the purposes of this Act, expenses or allowances in connection with travel include expenses or allowances that relate to the following costs:</p>
            </content>
            <paragraph eId="part-1__sec-5__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the cost of fares;</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-5__subsec-1__para-aa">
              <num>aa</num>
              <content>
                <p>the cost of taxis or other local transport in connection with travel;</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-5__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>the cost of the provision of charter services;</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-5__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>the cost of accommodation;</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-5__subsec-1__para-d">
              <num>d</num>
              <content>
                <p>the cost of meals;</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-5__subsec-1__para-e">
              <num>e</num>
              <content>
                <p>the cost of incidentals.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-1__sec-5__subsec-2">
            <num>2</num>
            <content>

                <p>The Independent Parliamentary Expenses Authority is established by this section.</p>

                <p><role refersTo="#authority">The Authority</role> has the following functions:</p>

                  <p>to give personal advice:</p>
                </content>

                  <p>to MOPS staff members about matters relating to MOPS travel resources;</p>
                </content>

                  <p>to issue general advisory documents about matters relating to:</p>
                </content>
              </paragraph>

                </content>
              </paragraph>

              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-12__subsec-1__para-g">
                <num>g</num>
                <content>
                  <p>to prepare other such reports as <role refersTo="#authority">the Authority</role> considers appropriate about matters relating to:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-12__subsec-1__para-i">
                <num>i</num>
                <content>
                  <p>designated MP resources; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-12__subsec-1__para-ii">
                <num>ii</num>
                <content>
                  <p>MOPS travel resources;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-12__subsec-1__para-h">
                <num>h</num>

                  <p>if <role refersTo="#authority">the Authority</role> considers that a particular report prepared under paragraph (g) should be published—publish that report on <role refersTo="#authority">the Authority</role>’s website;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-12__subsec-1__para-i">
                <num>i</num>
                <content>
                  <p>to conduct, or arrange for the conduct of, such audits as <role refersTo="#authority">the Authority</role> considers appropriate of matters relating to:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-12__subsec-1__para-i">
                <num>i</num>
                <content>
                  <p>designated MP resources, other than resources prescribed by the legislative rules for the purposes of this subparagraph; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-12__subsec-1__para-ii">
                <num>ii</num>
                <content>
                  <p>MOPS travel resources;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-12__subsec-1__para-j">
                <num>j</num>
                <content>
                  <p>to process claims, on behalf of the Commonwealth, for:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-12__subsec-1__para-i">
                <num>i</num>
                <content>
                  <p>Authority-administered MP resources; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-12__subsec-1__para-ii">
                <num>ii</num>

                  <p>MOPS travel resources;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-12__subsec-1__para-k">

                  <p>on behalf of the Commonwealth, to incur expenses relating to, to pay or to provide Authority-administered MP resources (subject to subsection (2A));</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-12__subsec-1__para-l">
                <num>l</num>
                <content>
                  <p>on behalf of the Commonwealth, to incur expenses relating to MOPS travel resources;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-12__subsec-1__para-la">
                <num>la</num>
                <content>
                  <p>to provide for the management and disposal of Authority-administered MP resources;</p>
                </content>
              </paragraph>

                  <p>	(m)	to give rulings under <i> Parliamentary Business Resources Act 2017</i> relating to certain Authority-administered MP resources;<ref href="#sec-37">section 37</ref> of the</p>

              <paragraph eId="part-2__dvs-2__sec-12__subsec-1__para-n">
                <num>n</num>
                <content>
                  <p>if a law of the Commonwealth authorises <role refersTo="#authority">the Authority</role> to give rulings relating to MOPS travel resources—to give those rulings;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-12__subsec-1__para-o">
                <num>o</num>
                <content>
                  <p>on behalf of the Commonwealth, to recover (whether by way of set-off or otherwise) overpayments, repayments and cost recovery payments relating to:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-12__subsec-1__para-i">
                <num>i</num>
                <content>
                  <p>Authority-administered MP resources; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-12__subsec-1__para-ii">
                <num>ii</num>
                <content>
                  <p>MOPS travel resources;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-12__subsec-1__para-p">
                <num>p</num>

                  <p>such functions (if any) as are conferred on <role refersTo="#authority">the Authority</role> by any other law of the Commonwealth;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-12__subsec-1__para-q">
                <num>q</num>
                <content>
                  <p>such other functions (if any) as are prescribed by the legislative rules;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-12__subsec-1__para-r">
                <num>r</num>
                <content>
                  <p>to do anything incidental to or conducive to the performance of any of the above functions.</p>
                </content>
                <content>
                  <p>Authority-administered MP resources</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-12__subsec-1A">
              <num>1A</num>
              <content>
                <p>	(1A)	An <b><i>Authority</i></b><b><i>-</i></b><b><i>administered MP resource</i></b> is:</p>
              </content>
              <paragraph eId="part-2__dvs-2__sec-12__subsec-1A__para-a">
                <num>a</num>
                <content>
                  <p>	(a)	any resource (including an expense, allowance, goods, services, premises, equipment or other facility) that has been, or would be, paid or provided by the Commonwealth under <i>Parliamentary Business Resources Act 2017</i>, other than:<ref href="#part-2">Part 2</ref>, 3 or 5 of the </p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-12__subsec-1A__para-i">
                <num>i</num>
                <content>
                  <p>remuneration payable under subsection 14(1), (2) or (3) of that Act; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-12__subsec-1A__para-ii">
                <num>ii</num>
                <content>
                  <p>a resource payable under the Parliamentary injury compensation scheme determined under subsection 41(1) of that Act, except if the resource is prescribed by the legislative rules for the purposes of this subparagraph; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-12__subsec-1A__para-iv">
                <num>iv</num>
                <content>
                  <p>a resource provided under a scheme mentioned in paragraph 42(2)(a) of that Act (legal proceedings in which a current or former Minister of State is a party); or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-12__subsec-1A__para-v">
                <num>v</num>
                <content>
                  <p>a resource that is prescribed by the legislative rules for the purposes of this subparagraph; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-12__subsec-1A__para-b">
                <num>b</num>
                <content>
                  <p>	(b)	a Parliamentary Retirement Travel Entitlement under the <i>Parliamentary Retirement Travel Act 2002</i>.</p>
                </content>
                <content>
                  <p>Designated MP resources</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-12__subsec-1B">
              <num>1B</num>
              <content>
                <p>	(1B)	A <b><i>designated MP resource</i></b><b> </b>is:</p>
              </content>
              <paragraph eId="part-2__dvs-2__sec-12__subsec-1B__para-a">
                <num>a</num>
                <content>
                  <p>	(a)	any resource (including an expense, allowance, goods, services, premises, equipment or other facility) that has been paid or provided by the Commonwealth under <i>Parliamentary Business Resources Act 2017</i>, other than:<ref href="#part-2">Part 2</ref> or 3 of the </p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-12__subsec-1B__para-i">
                <num>i</num>

                  <p>	(b)	a Parliamentary Retirement Travel Entitlement under the <i>Parliamentary Retirement Travel Act 2002</i>.</p>

                  <p>Appointing persons to request and be given personal advice on behalf of members or former members of parliament</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-12__subsec-1C">
              <num>1C</num>
              <content>
                <p>	(1C)	A member or former member of parliament (the <b><i>appointer</i></b>) may, by written notice given to the Authority in accordance with subsection (1F), appoint a person covered by subsection (1D) (the <b><i>appointee</i></b>) to request and be given personal advice under subparagraph (1)(a)(i) on behalf of the appointer.</p>

                <p>This subsection covers:</p>
              </content>
              <paragraph eId="part-2__dvs-2__sec-12__subsec-1D__para-a">
                <num>a</num>
                <content>
                  <p>for a member of parliament—a MOPS staff member employed by the member, or a person in a class prescribed by the legislative rules for the purposes of this paragraph; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-12__subsec-1D__para-b">
                <num>b</num>
                <content>
                  <p>for a former member of parliament—any person, other than a person in a class prescribed by the legislative rules for the purposes of this paragraph.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-12__subsec-1E">
              <num>1E</num>
              <content>
                <p>The following paragraphs have effect:</p>
              </content>
              <paragraph eId="part-2__dvs-2__sec-12__subsec-1E__para-a">
                <num>a</num>
                <content>
                  <p>if, while the appointment is in force, the appointee requests <role refersTo="#authority">the Authority</role> to give the appointee personal advice about a matter mentioned in subparagraph (1)(a)(i) relating to the appointer—the request is taken for all purposes to have been made by the appointer under that subparagraph to <role refersTo="#authority">the Authority</role>;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-12__subsec-1E__para-b">
                <num>b</num>
                <content>
                  <p>if, while the appointment is in force, <role refersTo="#authority">the Authority</role> gives the appointee personal advice in response to such a request about a matter mentioned in subparagraph (1)(a)(i) relating to the appointer—the personal advice is taken for all purposes to have been given by <role refersTo="#authority">the Authority</role> under that subparagraph to the appointer.</p>

              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-12__subsec-1F">
              <num>1F</num>

                <p>One appointed member of <role refersTo="#authority">the Authority</role> must be a former member of parliament.</p>

            </subsection>

                <p>One appointed member of <role refersTo="#authority">the Authority</role> must be a person who <role refersTo="#minister">the Minister</role> is satisfied has:</p>

                <num>a</num>
                <content>
                  <p>substantial experience or knowledge; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-16__subsec-4__para-b">
                <num>b</num>
                <content>
                  <p>significant standing;</p>
                </content>
                <content>
                  <p>in the field of auditing.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-3__sec-16__subsec-5">
              <num>5</num>
              <content>
                <p>If <role refersTo="#authority">the Authority</role> consists of 5 members, one appointed member of <role refersTo="#authority">the Authority</role> must be a person who <role refersTo="#minister">the Minister</role> is satisfied has:</p>
              </content>

                <num>a</num>
                <content>
                  <p>substantial experience or knowledge; and</p>
                </content>
              </paragraph>

                  <p>in at least one of the following fields:</p>

                <p>A member of <role refersTo="#authority">the Authority</role> holds office on a part-time basis.</p>

            </subsection>
            <subsection eId="part-2__dvs-3__sec-16__subsec-7">
              <num>7</num>
              <content>
                <p>The performance of the functions, or the exercise of the powers, of <role refersTo="#authority">the Authority</role> is not affected merely because its membership is not as required by subsection (2), (3) or (4) unless a continuous period of 3 months has elapsed since its membership ceased to be as so required.</p>

            </subsection>
            <subsection eId="part-2__dvs-3__sec-16__subsec-8">

                <p>	(8)	An office of member of the Authority that is held by the President of the Remuneration Tribunal is taken not to be a public office for the purposes of paragraph 4(4)(c) of the <i>Remuneration Tribunal Act 1973</i>.</p>

            <heading>Period of appointment for members of the Authority</heading>
            <content>
              <p>An appointed member of <role refersTo="#authority">the Authority</role> holds office for the period specified in the instrument of appointment. The period must not exceed 5 years.</p>

            <heading>Acting members of the Authority</heading>

                <p><role refersTo="#minister">The Minister</role> may, by written instrument, appoint a person to act as the Chair of <role refersTo="#authority">the Authority</role>:</p>

                <num>a</num>
                <content>
                  <p>during a vacancy in the office of the Chair of <role refersTo="#authority">the Authority</role> (whether or not an appointment has previously been made to the office); or</p>

                <num>b</num>
                <content>
                  <p>during any period, or during all periods, when the Chair of <role refersTo="#authority">the Authority</role>:</p>

            <heading>Remuneration</heading>
            <subsection eId="part-2__dvs-4__sec-19__subsec-1">
              <num>1</num>
              <content>
                <p>An appointed member of <role refersTo="#authority">the Authority</role> is to be paid the remuneration that is determined by the Remuneration Tribunal. If no determination of that remuneration by the Tribunal is in operation, an appointed member of <role refersTo="#authority">the Authority</role> is to be paid the remuneration that is prescribed by the legislative rules.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-4__sec-19__subsec-2">
              <num>2</num>
              <content>
                <p>An appointed member of <role refersTo="#authority">the Authority</role> is to be paid the allowances that are prescribed by the legislative rules.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-4__sec-19__subsec-3">
              <num>3</num>
              <content>
                <p>	(3)	Subsections (1) and (2) have effect subject to the <i>Remuneration Tribunal Act 1973</i>.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-4__sec-19__subsec-4">
              <num>4</num>
              <content>
                <p>A member of <role refersTo="#authority">the Authority</role> who is the President of the Remuneration Tribunal is to be paid the fees and allowances that are prescribed by the legislative rules.</p>

            </subsection>
          </section>
          <section eId="part-2__dvs-4__sec-20">
            <num>20</num>
            <heading>Disclosure of interests</heading>
            <subsection eId="part-2__dvs-4__sec-20__subsec-1">
              <num>1</num>
              <content>
                <p>	(1)	A disclosure by a member of the Authority under <i>Public Governance, Performance and Accountability Act 2013</i> (which deals with the duty to disclose interests) must be made to the Minister.<ref href="#sec-29">section 29</ref> of the </p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-4__sec-20__subsec-2">
              <num>2</num>
              <content>
                <p>	(2)	Subsection (1) applies in addition to any rules made for the purposes of <i>Public Governance, Performance and Accountability Act 2013</i>.<ref href="#sec-29">section 29</ref> of the </p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-4__sec-20__subsec-3">
              <num>3</num>
              <content>
                <p>	(3)	For the purposes of this Act and the <i>Public Governance, Performance and Accountability Act 2013</i>, a member of the Authority is taken not to have complied with section 29 of that Act if the member does not comply with subsection (1) of this section.</p>

            </subsection>
          </section>
          <section eId="part-2__dvs-4__sec-21">
            <num>21</num>
            <heading>Paid work</heading>
            <content>
              <p>A member of <role refersTo="#authority">the Authority</role> must not engage in any paid work that conflicts or may conflict with the proper performance of his or her duties.</p>
            </content>
          </section>
          <section eId="part-2__dvs-4__sec-22">
            <num>22</num>
            <heading>Leave of absence</heading>
            <subsection eId="part-2__dvs-4__sec-22__subsec-1">
              <num>1</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may grant leave of absence to the Chair of <role refersTo="#authority">the Authority</role> on the terms and conditions as to remuneration or otherwise that <role refersTo="#minister">the Minister</role> determines.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-4__sec-22__subsec-2">
              <num>2</num>
              <content>
                <p>The Chair of <role refersTo="#authority">the Authority</role> may grant leave of absence to a member of <role refersTo="#authority">the Authority</role> on the terms and conditions that the Chair determines.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-2__dvs-4__sec-23">
            <num>23</num>
            <heading>Resignation</heading>
            <subsection eId="part-2__dvs-4__sec-23__subsec-1">
              <num>1</num>
              <content>
                <p>A member of <role refersTo="#authority">the Authority</role> may resign his or her appointment by giving the Governor-General a written resignation.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-4__sec-23__subsec-2">
              <num>2</num>
              <content>
                <p>The resignation takes effect on the day it is received by the Governor-General or, if a later day is specified in the resignation, on that later day.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-2__dvs-4__sec-24">
            <num>24</num>
            <heading>Termination of appointment</heading>
            <subsection eId="part-2__dvs-4__sec-24__subsec-1">
              <num>1</num>
              <content>
                <p>The Governor-General may terminate the appointment of an appointed member of <role refersTo="#authority">the Authority</role>:</p>
              </content>
              <paragraph eId="part-2__dvs-4__sec-24__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>for misbehaviour; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-4__sec-24__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>if the member is unable to perform the duties of his or her office because of physical or mental incapacity.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-4__sec-24__subsec-2">
              <num>2</num>
              <content>
                <p>The Governor-General may terminate the appointment of an appointed member of <role refersTo="#authority">the Authority</role> if:</p>
              </content>
              <paragraph eId="part-2__dvs-4__sec-24__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>the member:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-4__sec-24__subsec-2__para-i">
                <num>i</num>
                <content>
                  <p>becomes bankrupt; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-4__sec-24__subsec-2__para-ii">
                <num>ii</num>
                <content>
                  <p>applies to take the benefit of any law for the relief of bankrupt or insolvent debtors; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-4__sec-24__subsec-2__para-iii">
                <num>iii</num>
                <content>
                  <p>compounds with his or her creditors; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-4__sec-24__subsec-2__para-iv">
                <num>iv</num>
                <content>
                  <p>makes an assignment of his or her remuneration for the benefit of his or her creditors; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-4__sec-24__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>the member engages in paid work that conflicts or may conflict with the proper performance of his or her duties (see <ref href="#sec-21">section 21</ref>); or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-4__sec-24__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>	(c)	the member fails, without reasonable excuse, to comply with <i>Public Governance, Performance and Accountability Act 2013</i> (which deals with the duty to disclose interests) or rules made for the purposes of that section; or<ref href="#sec-29">section 29</ref> of the </p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-4__sec-24__subsec-2__para-d">
                <num>d</num>
                <content>
                  <p>the member is absent, except on leave of absence, from 3 consecutive meetings of <role refersTo="#authority">the Authority</role>.</p>

          </section>

            <heading>Other terms and conditions</heading>
            <content>
              <p>A member of <role refersTo="#authority">the Authority</role> holds office on the terms and conditions (if any) in relation to matters not covered by this Act that are determined by the Governor-General.</p>

          <heading>Decision-making by the Authority</heading>

            <heading>Holding of meetings</heading>

              <content>
                <p><role refersTo="#authority">The Authority</role> is to hold such meetings as are necessary for the efficient performance of its functions.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-5__sec-26__subsec-2">
              <num>2</num>
              <content>
                <p>The Chair of <role refersTo="#authority">the Authority</role> may convene a meeting at any time.</p>
              </content>
            </subsection>
          </section>

            <heading>Other employment of the CEO</heading>

              <p><role refersTo="#ceo">The CEO</role> must not engage in paid work outside the duties of his or her office without <role refersTo="#minister">the Minister</role>’s approval.</p>

            <heading>Resignation of the CEO</heading>

                <p><role refersTo="#ceo">The CEO</role> may resign his or her appointment by giving <role refersTo="#minister">the Minister</role> a written resignation.</p>

                <p>The resignation takes effect on the day it is received by <role refersTo="#minister">the Minister</role> or, if a later day is specified in the resignation, on that later day.</p>

                <content>
                  <p><role refersTo="#ceo">the CEO</role>:</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-46__subsec-2__para-i">
                <num>i</num>
                <content>
                  <p>becomes bankrupt; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-46__subsec-2__para-ii">
                <num>ii</num>
                <content>
                  <p>applies to take the benefit of any law for the relief of bankrupt or insolvent debtors; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-46__subsec-2__para-iii">
                <num>iii</num>
                <content>
                  <p>compounds with his or her creditors; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-46__subsec-2__para-iv">

                  <p>makes an assignment of his or her remuneration for the benefit of his or her creditors; or</p>

          <heading>Authority may obtain information and documents</heading>

              <p>This section applies to a person if <role refersTo="#authority">the Authority</role> has reason to believe that the person has information or a document that is relevant to the performance of a function conferred on <role refersTo="#authority">the Authority</role> by any of paragraphs 12(1)(e) to (i).</p>

              <p><role refersTo="#authority">The Authority</role> may, by written notice given to the person, require the person:</p>
            </content>

              <num>a</num>
              <content>
                <p>to give to <role refersTo="#authority">the Authority</role>, within the period and in the manner and form specified in the notice, any such information; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-53__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>to produce to <role refersTo="#authority">the Authority</role>, within the period and in the manner specified in the notice, any such documents; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-53__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>to make copies of any such documents and to produce to <role refersTo="#authority">the Authority</role>, within the period and in the manner specified in the notice, those copies.</p>
              </content>
            </paragraph>
          </subsection>

            <num>3</num>
            <content>
              <p>A period specified under subsection (2) must not be shorter than 14 days after the notice is given.</p>
            </content>
          </subsection>
          <subsection eId="part-5__sec-53__subsec-4">

              <p>A person commits an offence if:</p>
            </content>
            <paragraph eId="part-5__sec-53__subsec-4__para-a">
              <num>a</num>
              <content>
                <p><role refersTo="#authority">the Authority</role> has given a notice to the person under subsection (2); and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-53__subsec-4__para-b">
              <num>b</num>
              <content>
                <p>the person engages in conduct; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-53__subsec-4__para-c">
              <num>c</num>
              <content>
                <p>the person’s conduct contravenes a requirement in the notice.</p>
              </content>

                  <p>Penalty:	<quantity refersTo="#penaltyUnit">30 penalty units</quantity>.</p>

          <heading>Copying documents—reasonable compensation</heading>
          <content>
            <p>A person is entitled to be paid by <role refersTo="#authority">the Authority</role>, on behalf of the Commonwealth, reasonable compensation for complying with a requirement covered by paragraph 53(2)(c).</p>
          </content>
        </section>
        <section eId="part-5__sec-55">
          <num>55</num>
          <heading>Self-incrimination</heading>
          <content>
            <p>A person is excused from giving information or producing a document or a copy of a document under this Part if the information or the production of the document or copy might tend to incriminate the person or expose the person to a penalty.</p>
          </content>
        </section>
        <section eId="part-5__sec-56">
          <num>56</num>
          <heading>Copies of documents</heading>
          <subsection eId="part-5__sec-56__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#authority">The Authority</role> may inspect a document or copy produced under this Part and may make and retain copies of, or take and retain extracts from, such a document.</p>
            </content>
          </subsection>
          <subsection eId="part-5__sec-56__subsec-2">
            <num>2</num>
            <content>
              <p><role refersTo="#authority">The Authority</role> may retain possession of a copy of a document produced in accordance with a requirement covered by paragraph 53(2)(c).</p>
            </content>
          </subsection>
        </section>
        <section eId="part-5__sec-57">
          <num>57</num>
          <heading>Authority may retain documents</heading>
          <subsection eId="part-5__sec-57__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#authority">The Authority</role> may take, and retain for as long as is necessary, possession of a document produced under this Part.</p>
            </content>
          </subsection>
          <subsection eId="part-5__sec-57__subsec-2">
            <num>2</num>
            <content>
              <p>The person otherwise entitled to possession of the document is entitled to be supplied, as soon as practicable, with a copy certified by <role refersTo="#authority">the Authority</role> to be a true copy.</p>
            </content>
          </subsection>
          <subsection eId="part-5__sec-57__subsec-3">
            <num>3</num>
            <content>
              <p>The certified copy must be received in all courts and tribunals as evidence as if it were the original.</p>
            </content>
          </subsection>
          <subsection eId="part-5__sec-57__subsec-4">
            <num>4</num>
            <content>
              <p>Until a certified copy is supplied, <role refersTo="#authority">the Authority</role> must, at such times and places as <role refersTo="#authority">the Authority</role> thinks appropriate, permit the person otherwise entitled to possession of the document, or a person authorised by that person, to inspect and make copies of, or take extracts from, the document.</p>

          <heading>Relationship of information-gathering powers to other laws</heading>
          <subsection eId="part-5__sec-58__subsec-1">
            <num>1</num>
            <content>
              <p>The operation of this Part is limited by laws of the Commonwealth relating to the powers, privileges and immunities of:</p>
            </content>
            <paragraph eId="part-5__sec-58__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>each House of the Parliament; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-58__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>the members of each House of the Parliament; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-58__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>the committees of each House of the Parliament and joint committees of both Houses of the Parliament.</p>
              </content>
            </paragraph>
          </subsection>

              <p>This Part does not affect the law relating to legal professional privilege.</p>

          </subsection>

        <section eId="part-6__sec-60">
          <num>60</num>
          <heading>Sensitive information not to be included in public reports</heading>
          <subsection eId="part-6__sec-60__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#authority">The Authority</role> must not include particular information in a public report if:</p>
            </content>
            <paragraph eId="part-6__sec-60__subsec-1__para-a">
              <num>a</num>
              <content>
                <p><role refersTo="#authority">the Authority</role> is of the opinion that disclosure of the information would be contrary to the public interest because the disclosure would prejudice the security, defence or international relations of the Commonwealth; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-60__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>the Attorney-General has issued a certificate to <role refersTo="#authority">the Authority</role> stating that, in the opinion of the Attorney-General, disclosure of the information would be contrary to the public interest because the disclosure would prejudice the security, defence or international relations of the Commonwealth; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-60__subsec-1__para-c">
              <num>c</num>
              <content>
                <p><role refersTo="#authority">the Authority</role> is of the opinion that disclosure of the information would be likely to result in serious harm to, or would be likely to put at risk the safety of, the individual, or any of the individuals, to whom the information relates.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-6__sec-60__subsec-2">
            <num>2</num>
            <content>
              <p><role refersTo="#authority">The Authority</role> cannot be required, and is not permitted, to disclose to:</p>
            </content>
            <paragraph eId="part-6__sec-60__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>a House of the Parliament; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-60__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>a member of a House of the Parliament; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-60__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>a committee of a House of the Parliament or a joint committee of both Houses of the Parliament;</p>
              </content>
              <content>
                <p>information that subsection (1) prohibits being included in a public report.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-6__sec-60__subsec-3">
            <num>3</num>
            <content>
              <p>If <role refersTo="#authority">the Authority</role> omits particular information from a public report because the Attorney-General has issued a certificate under paragraph (1)(b) in relation to the information, <role refersTo="#authority">the Authority</role> must state in the report:</p>
            </content>
            <paragraph eId="part-6__sec-60__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>that information (which does not have to be identified) has been omitted from the report; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-60__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>that the Attorney-General issued the certificate because the Attorney-General was of the opinion that disclosure of the information would be contrary to the public interest because the disclosure would prejudice the security, defence or international relations of the Commonwealth.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-6__sec-60__subsec-4">
            <num>4</num>
            <content>
              <p>If, because of subsection (1), <role refersTo="#authority">the Authority</role>:</p>
            </content>
            <paragraph eId="part-6__sec-60__subsec-4__para-a">
              <num>a</num>
              <content>
                <p>decides not to prepare a public report; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-60__subsec-4__para-b">
              <num>b</num>
              <content>
                <p>omits particular information from a public report;</p>
              </content>
              <content>
                <p><role refersTo="#authority">the Authority</role> may prepare a report under this subsection that includes the information concerned. <role refersTo="#authority">The Authority</role> must give a copy of each report under this subsection to:</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-60__subsec-4__para-c">
              <num>c</num>
              <content>
                <p>the Prime Minister; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-60__subsec-4__para-d">
              <num>d</num>
              <content>
                <p><role refersTo="#minister">the Minister</role>.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-6__sec-60__subsec-5">
            <num>5</num>
            <content>
              <p>	(5)	For the purposes of this section, <b><i>public report</i></b> means a report that is to be published on the Authority’s website.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-6__sec-61">
          <num>61</num>
          <heading>Proceedings in the name of the Authority</heading>
          <subsection eId="part-6__sec-61__subsec-1">
            <num>1</num>
            <content>
              <p>Proceedings brought by the Commonwealth in relation to the functions or powers of <role refersTo="#authority">the Authority</role> may be brought in the name of <role refersTo="#authority">the Authority</role>.</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-61__subsec-2">
            <num>2</num>
            <content>
              <p>Proceedings brought against the Commonwealth in relation to the functions or powers of <role refersTo="#authority">the Authority</role> may be brought against the Commonwealth in the name of <role refersTo="#authority">the Authority</role>.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-6__sec-62">
          <num>62</num>
          <heading>Independent review</heading>
          <subsection eId="part-6__sec-62__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> must cause an independent review to be conducted of the operation of this Act and the legislative rules.</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-62__subsec-2">
            <num>2</num>
            <content>
              <p>The review must be conducted as soon as practicable after the end of 3 years after this section commences.</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-62__subsec-3">
            <num>3</num>
            <content>
              <p>The persons who conduct the review must give <role refersTo="#minister">the Minister</role> a written report of the review.</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-62__subsec-4">
            <num>4</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> must cause copies of the report to be tabled in each House of the Parliament within 15 sitting days of that House after the report is given to <role refersTo="#minister">the Minister</role>.</p>

        </section>

          <num>63</num>
          <heading>Transitional legislative rules</heading>
          <content>
            <p>		The legislative rules may prescribe matters of a transitional nature relating to the abolition of the body known as the Independent Parliamentary Expenses Authority that was established as an Executive Agency under <i>Public Service Act 1999</i>.<ref href="#sec-65">section 65</ref> of the </p>
          </content>
        </section>
        <section eId="part-6__sec-64">
          <num>64</num>
          <heading>Legislative rules</heading>
          <subsection eId="part-6__sec-64__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	The Minister may, by legislative instrument, make rules (<b><i>legislative rules</i></b>) prescribing matters:</p>
            </content>
            <paragraph eId="part-6__sec-64__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>required or permitted by this Act to be prescribed by the legislative rules; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-64__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>necessary or convenient to be prescribed for carrying out or giving effect to this Act.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-6__sec-64__subsec-2">

              <p>To avoid doubt, the legislative rules may not do the following:</p>
            </content>
