          <p>		This Act is the <i>Comcare</i><i> and </i><i>Seacare</i><i> Legislation Amendment (Pension Age and Catastrophic Injury)</i><i> Act 2017</i>.</p>

            <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

                <p>If, as a result of a catastrophic injury to an employee, the employee obtains household services that he or she reasonably requires, Comcare is liable to pay compensation of such amount per week as Comcare considers reasonable in the circumstances.</p>
              </content>

              <num>2</num>
              <content>
                <p>Without limiting the matters that Comcare may take into account in determining the household services that are reasonably required in a particular case, Comcare must, in making such a determination, have regard to the following matters:</p>
              </content>

              <num>a</num>
              <content>
                <p>the extent to which household services were provided by the employee before the date of the catastrophic injury and the extent to which he or she is able to provide those services after that date;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-29A__para-b">
              <num>b</num>
              <content>
                <p>the number of persons living with the employee as members of his or her household, their ages and their need for household services;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-29A__para-c">
              <num>c</num>
              <content>
                <p>the extent to which household services were provided by the persons referred to in paragraph (b) before the catastrophic injury;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-29A__para-d">
              <num>d</num>
              <content>
                <p>the extent to which the persons referred to in paragraph (b), or any other members of the employee’s family, might reasonably be expected to provide household services for themselves and for the employee after the catastrophic injury;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-29A__para-e">
              <num>e</num>
              <content>
                <p>the need to avoid substantial disruption to the employment or other activities of the persons referred to in paragraph (b).</p>
              </content>
            </paragraph>

              <content>
                <p>If, as a result of a catastrophic injury to an employee, the employee obtains attendant care services that he or she reasonably requires, Comcare is liable to pay compensation of such amount per week as Comcare considers reasonable in the circumstances.</p>
              </content>

            <hcontainer name="subclause" eId="schedule-1__clause-29A__subclause-4">
              <num>4</num>
              <content>
                <p>Without limiting the matters that Comcare may take into account in determining the attendant care services that are reasonably required in a particular case, Comcare must, in making such a determination, have regard to the following matters:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-29A__para-a">
              <num>a</num>
              <content>
                <p>the nature of the employee’s catastrophic injury and the degree to which that injury impairs his or her ability to provide for his or her personal care;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-29A__para-b">
              <num>b</num>
              <content>
                <p>the extent to which any medical service or nursing care received by the employee provides for his or her essential and regular personal care;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-29A__para-c">
              <num>c</num>
              <content>
                <p>the extent to which it is reasonable to meet any wish by the employee to live outside an institution;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-29A__para-d">
              <num>d</num>
              <content>
                <p>the extent to which attendant care services are necessary to enable the employee to undertake or continue employment;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-29A__para-e">
              <num>e</num>
              <content>
                <p>any assessment made in relation to the rehabilitation of the employee;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-29A__para-f">
              <num>f</num>
              <content>
                <p>the extent to which a relative of the employee might reasonably be expected to provide attendant care services.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-29A__subclause-5">
              <num>5</num>
              <content>
                <p>An amount of compensation payable by Comcare under subsection (1) or (3) is payable:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-29A__para-a">
              <num>a</num>
              <content>
                <p>if the employee has paid for the household services or attendant care services, as the case may be—to the employee; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-29A__para-b">
              <num>b</num>
              <content>
                <p>in any other case—to the person who provided those services.</p>
              </content>
            </paragraph>

              <num>6</num>
              <content>
                <p>If Comcare pays an amount under subsection (1) or (3) to a person who provided household services or attendant care services to an employee, the payment of the amount is, to the extent of the payment, a discharge of the liability of the employee to pay for those services.</p>
              </content>

            <heading>Subsection 60(1) (definition of determination)</heading>

                <p>	(1)	The Minister may, by legislative instrument, make rules (<b><i>legislative rules</i></b>) prescribing matters:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-122A__para-a">
              <num>a</num>
              <content>
                <p>	(a)	required or permitted by this Act to be prescribed by the legislative<b><i> </i></b>rules; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-122A__para-b">
              <num>b</num>
              <content>
                <p>necessary or convenient to be prescribed for carrying out or giving effect to this Act.</p>
              </content>
            </paragraph>

              <content>
                <p>	(2)	To avoid doubt, the legislative<b><i> </i></b>rules may not do the following:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-122A__para-a">
              <num>a</num>
              <content>
                <p>create an offence or civil penalty;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-122A__para-b">
              <num>b</num>
              <content>
                <p>provide powers of:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-122A__para-i">
              <num>i</num>
              <content>
                <p>arrest or detention; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-122A__para-ii">
              <num>ii</num>
              <content>
                <p>entry, search or seizure;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-122A__para-c">

                <p>the extent to which household services were provided by the employee before the date of the catastrophic injury and the extent to which he or she is able to provide those services after that date;</p>

                <p>the number of persons living with the employee as members of his or her household, their ages and their need for household services;</p>

                <p>the extent to which the persons referred to in paragraph (b), or any other members of the employee’s family, might reasonably be expected to provide household services for themselves and for the employee after the catastrophic injury;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-43A__para-e">
              <num>e</num>
              <content>
                <p>the need to avoid substantial disruption to the employment or other activities of the persons referred to in paragraph (b).</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-43A__subclause-3">
              <num>3</num>
              <content>
                <p>If, as a result of a catastrophic injury to an employee, the employee obtains attendant care services that he or she reasonably requires, compensation is payable at the rate of such amount per week as is reasonable in the circumstances.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-43A__subclause-4">
              <num>4</num>
              <content>
                <p>Without limiting the matters that may be taken into account in determining the attendant care services that are reasonably required in a particular case, the employer must have regard to the following matters:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-43A__para-a">
              <num>a</num>
              <content>
                <p>the nature of the employee’s catastrophic injury and the degree to which that injury impairs the employee’s ability to provide for his or her personal care;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-43A__para-b">
              <num>b</num>
              <content>
                <p>the extent to which any medical service or nursing care received by the employee provides for his or her essential and regular personal care;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-43A__para-c">
              <num>c</num>
              <content>
                <p>the extent to which it is reasonable to meet any wish by the employee to live outside an institution;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-43A__para-d">
              <num>d</num>
              <content>
                <p>the extent to which attendant care services are necessary to enable the employee to undertake or continue employment;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-43A__para-e">
              <num>e</num>
              <content>
                <p>any assessment made in relation to the rehabilitation of the employee;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-43A__para-f">
              <num>f</num>
              <content>
                <p>the extent to which a relative of the employee might reasonably be expected to provide attendant care services.</p>
              </content>
            </paragraph>

                <p>An amount of compensation payable under subsection (1) or (3) is payable:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-43A__para-a">
              <num>a</num>
              <content>
                <p>if the employee has paid for the household services or attendant care services, as the case may be—to the employee; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-43A__para-b">
              <num>b</num>
              <content>
                <p>in any other case—to the person who provided those services.</p>
              </content>
            </paragraph>

                <p>If an amount of compensation is paid under subsection (1) or (3) to a person who provided household services or attendant care services to an employee, the payment of the amount is, to the extent of the payment, a discharge of the liability of the employee to pay for those services.</p>

                <p>However, if an employee who has reached the age that is one year before pension age suffers an injury:</p>

                <p>to the extent that this Act (other than subsection (1)) allows; and</p>

            </paragraph>

                <p>for a maximum of 52 weeks (whether consecutive or not) during which the employee is incapacitated.</p>

            <heading>Subsection 44(2) (definition of y [number of years])</heading>

              <p>Repeal the definition, substitute:</p>

            <heading>Constitutional safety net</heading>
            <hcontainer name="subclause" eId="schedule-2__clause-5__subclause-1">

              <content>
                <p>If the operation of this Act would result in an acquisition of property (within the meaning of paragraph 51(xxxi) of the Constitution) from a person otherwise than on just terms (within the meaning of that paragraph), the Commonwealth is liable to pay a reasonable amount of compensation to the person.</p>
              </content>
            </hcontainer>
