          <p>		This Act is the <i>Education Legislation Amendment </i><i>(Provider Integrity and Other Measures) </i><i>A</i><i>ct 201</i><i>7</i>.</p>

            <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

            <heading>Registered providers must notify their ESOS agency of certain other events</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-17A__subclause-1">
              <num>1</num>
              <content>
                <p>A registered provider must notify the ESOS agency for the provider of the occurrence of an event that would significantly affect the provider’s ability to comply with this Act.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-17A__subclause-2">
              <num>2</num>
              <content>
                <p>Notice under subsection (1) must be given within 10 business days after the event occurs.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-17A__subclause-3">
              <num>3</num>
              <content>
                <p>A registered provider must notify the ESOS agency for the provider of:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-17A__para-a">
              <num>a</num>
              <content>
                <p>any prospective changes to the ownership of the registered provider as soon as practicable before the change takes effect; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-17A__para-b">
              <num>b</num>
              <content>
                <p>any prospective or actual change in relation to a related person of the provider:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-17A__para-i">
              <num>i</num>
              <content>
                <p>if the change cannot be determined until it takes effect—within 10 business days of the change taking effect; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-17A__para-ii">
              <num>ii</num>
              <content>
                <p>otherwise—as soon as practicable before the change takes effect.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-17A__subclause-4">
              <num>4</num>
              <content>
                <p>Notice under subsection (3) must be accompanied by information on the new owner or the related person of the provider to enable the making of a decision under <ref href="#sec-7A">section 7A</ref> as to whether:</p>
              </content>

              <num>a</num>
              <content>
                <p>the ESOS agency is satisfied, or no longer satisfied, that the provider is fit and proper to be registered; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-17A__para-b">
              <num>b</num>
              <content>
                <p>the ESOS agency believes on reasonable grounds that the provider is not fit and proper to be registered.</p>
              </content>
            </paragraph>

              <content>
                <p>A notice under this section must be provided in the manner and form specified by the ESOS agency for the provider for the purposes of this subsection.</p>
              </content>
            </hcontainer>
            <content>
              <p>Note:	If a registered provider breaches this section, the ESOS agency for the provider may take action under <ref href="#dvs-1">Division 1</ref> of <ref href="#part-6">Part 6</ref> against the provider.</p>
            </content>

                <p>	(1A)	The Secretary, or the ESOS agency for a provider or registered provider, may give information obtained or received for the purposes of this Act to an enforcement body (within the meaning of the <i>Privacy Act 1988</i>), if the Secretary or the ESOS agency is satisfied that giving the information is reasonably necessary for one or more enforcement related activities (within the meaning of that Act) conducted by, or on behalf of, the enforcement body.</p>

            <heading>At the end of section 175</heading>

                <p>promoting compliance with the conditions of a particular student visa or visas, or of student visas generally;</p>
              </content>
            </paragraph>

                <p>For the purposes of:</p>

            </hcontainer>

                <p>promoting compliance with this Act, the national code, the ELICOS Standards and the Foundation Program Standards; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-15__para-b">
              <num>b</num>
              <content>
                <p>promoting compliance with the conditions of a particular student visa or visas, or of student visas generally;</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-15__subclause-5">
              <num>5</num>
              <content>
                <p>Without limiting subsection (3) or (4), the information given or published under those subsections may relate to:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-15__para-a">
              <num>a</num>
              <content>
                <p>the number of applications for student visas made by or on behalf of students recruited or otherwise dealt with by an agent that have been granted, refused or withdrawn, or are invalid; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-15__para-b">
              <num>b</num>
              <content>
                <p>the number of student visas granted to students recruited or otherwise dealt with by an agent that have been cancelled or have ceased to be in effect; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-15__para-c">
              <num>c</num>
              <content>
                <p>the number of students accepted for enrolment in courses provided by registered providers by students recruited or otherwise dealt with by an agent; or</p>

                <p>the completion rates of accepted students recruited or otherwise dealt with by agents.</p>

                <p>(1)	The amendments of <i>Education </i><i>Services </i><i>for Overseas Students Act 2000</i> made by this Schedule apply in relation to:<ref href="#sec-7A">section 7A</ref> of the </p>
              </content>

                <p>applications for registration made after the commencement of this Schedule; and</p>
              </content>

                <p>(2)	The amendments of <i>Education </i><i>Services </i><i>for Overseas Students Act 2000</i> made by this Schedule apply in relation to providers registered before or after the commencement of this Schedule.<ref href="#sec-17">section 17</ref> of the </p>

                <p>(3)	Section 17A of the <i>Education </i><i>Services </i><i>for Overseas Students Act 2000</i>, as inserted by this Schedule, applies in relation to providers registered before or after the commencement of this Schedule.</p>

                <p>the scope of courses and level of qualifications the body, and each person who makes or participates in making decisions that affect the whole, or a substantial part, of the body’s affairs, has experience in providing.</p>

            <heading>After subsection 16-40(1)</heading>

                <p>that units of study provided in a specified manner or by a specified mode of delivery by the higher education provider are units in relation to which FEE-HELP assistance is unavailable.</p>
