          <heading>Objects of this Act</heading>
          <content>
            <p>The objects of this Act are the following:</p>

              <p>to assist the Commonwealth to monitor fuel security to aid the Commonwealth to develop policy relating to the prevention of, preparation for, or management of, fuel supply disruptions or potential disruptions;</p>

            <num>b</num>
            <content>
              <p>to assist the Commonwealth to give effect to Australia’s obligations under the Agreement, or under any other international agreement to which Australia is a party relating to:</p>

          </paragraph>
          <paragraph eId="part-1__sec-3__para-i">
            <num>i</num>
            <content>
              <p>international energy security; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-ii">
            <num>ii</num>

              <p>the reporting of data relating to petroleum, other fuels or fuel-related products;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-c">

              <p>to facilitate the publication of information relating to Australia’s petroleum and other fuel markets;</p>

              <p>	(d)	to support the implementation of the <i>Fuel Security Act 2021</i>.</p>

          <heading>Simplified outline of this Act</heading>
          <content>
            <p>This Act requires the reporting of certain information relating to fuels and fuel-related products.</p>
            <p><role refersTo="#secretary">The Secretary</role> may collect information relating to fuels and fuel-related products. <role refersTo="#secretary">The Secretary</role> may publish such information, unless the information is likely to enable the identification of a person or is commercial-in-confidence.</p>
            <p>There are protections for sensitive information.</p>

          <heading>Definitions</heading>
          <subsection eId="part-1__sec-5__subsec-1">
            <num>1</num>
            <content>
              <p>In this Act:</p>
            </content>
            <content>
              <p><b><i>affected</i></b>: see subsection 13C(2).</p>
              <p><term refersTo="#term-agreement">Agreement</term> means <def>the Agreement on an International Energy Program, done at Paris on 18 November 1974.</def></p>
              <p><term refersTo="#term-civil-penalty-provision">civil penalty provision</term> has the same meaning as <def>in the Regulatory Powers Act.</def></p>
              <p><term refersTo="#term-commercial-in-confidence">commercial-in-confidence</term> has the meaning given by <def><ref href="#sec-6">section 6</ref>.</def></p>
              <p><term refersTo="#term-constitutional-corporation">constitutional corporation</term> means <def>a corporation to which paragraph 51(xx) of the Constitution applies.</def></p>
              <p><term refersTo="#term-constitutional-trade-and-commerce">constitutional trade and commerce</term> means <def>the following:</def></p>

                <p>trade or commerce between Australia and places outside Australia;</p>
              </content>
            </paragraph>

                <p>trade or commerce among the States;</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-5__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>trade or commerce within a Territory, between a State and a Territory or between 2 Territories.</p>
              </content>
              <content>
                <p><b><i>covered activity</i></b> means:</p>
              </content>
            </paragraph>

                <p>wholesaling a covered product; or</p>

                <p>holding stock of a covered product; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-5__subsec-1__para-e">

                <p>importing a covered product; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-5__subsec-1__para-f">

                <p>exporting a covered product; or</p>

                <p>any other activity, in relation to a covered product, prescribed by the rules for the purposes of this paragraph.</p>

              <content>
                <p><b><i>covered product</i></b> means:</p>
              </content>
            </paragraph>

                <p>crude oil; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-5__subsec-1__para-b">

            <paragraph eId="part-1__sec-5__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>liquefied petroleum gas; or</p>

              <num>d</num>
              <content>
                <p>natural gas liquid; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-5__subsec-1__para-e">

                <p>liquefied natural gas; or</p>

            </paragraph>

                <p>an oil, lubricant or grease; or</p>
              </content>
            </paragraph>

                <p>paraffin wax; or</p>

            </paragraph>

                <p>a petroleum-based solvent; or</p>

                <p>biofuel; or</p>

                <p>hydrogen; or</p>

            </paragraph>

                <p>any other fuel prescribed by the rules for the purposes of this paragraph; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-5__subsec-1__para-u">
              <num>u</num>
              <content>
                <p>any other fuel-related product prescribed by the rules for the purposes of this paragraph.</p>
              </content>
              <content>
                <p><b><i>entrusted person</i></b> means:</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-5__subsec-1__para-a">
              <num>a</num>
              <content>
                <p><role refersTo="#secretary">the Secretary</role>; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-5__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>an APS employee in the Department; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-5__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>any other person employed or engaged by the Department.</p>
              </content>
              <content>
                <p><term refersTo="#term-fuel">fuel</term> means <def>any product that produces energy through a chemical reaction.</def></p>
                <p><b><i>fuel information</i></b> means:</p>

                <p>is derived from a fuel; or</p>
              </content>
            </paragraph>

                <p>is an input into or an output from the production or refining of a fuel.</p>
              </content>
              <content>
                <p><b><i>holding stock</i></b> of a covered product means:</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-5__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>keeping a covered product in storage (whether on land or at sea), but does not include:</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-5__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>storing a covered product in a service station, retail store, personal vehicle, road tanker, rail tank car or pipeline; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-5__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>keeping a covered product wholly or principally for private or domestic use; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-5__subsec-1__para-b">
              <num>b</num>

                <p>holding, in circumstances prescribed by the rules for the purposes of this paragraph, a contractual right to take possession of a covered product.</p>

                <p>the reporting of data relating to petroleum, other fuels or fuel-related products.</p>

              <content>
                <p><term refersTo="#term-offence-against-this-act">offence against this Act</term> includes <def>an offence against Chapter 7 of the Criminal Code that relates to this Act.</def></p>
                <p><b><i>offshore area</i></b>, in relation to a State or Territory, has the same meaning as in the <i>Offshore Petroleum and Greenhouse Gas Storage Act 2006</i>.</p>
                <p><b><i>person</i></b> has a meaning affected by section 38.</p>
                <p><term refersTo="#term-personal-information">personal information</term> has the same meaning as <def>in <ref href="">the Privacy Act 1988</ref>.</def></p>
                <p><term refersTo="#term-producing-a-covered-product">producing a covered product</term> means <def>recovering a covered product through a process of extraction or otherwise creating a covered product, but does not include refining a covered product.</def></p>
                <p><term refersTo="#term-protected-information">protected information</term> means <def>fuel information that is personal information, or fuel information that is commercial-in-confidence, that: 	(a)	is obtained under, or in accordance with, this Act, the <i>Fuel Security Act 2021</i>, section 95ZPA of the <i>Competition and Consumer Act 2010</i> or subsection 355-65(8) in Schedule 1 to the <i>Taxation Administration Act 1953</i>; or 	(b)	is derived from a record of personal information, or information that is commercial-in-confidence, that was made under, or in accordance with, this Act, the <i>Fuel Security Act 2021</i> or a provision referred to in paragraph (a); or 	(c)	is derived from a disclosure or use of personal information, or information that is commercial-in-confidence, that was made under, or in accordance with, this Act, the <i>Fuel Security Act 2021</i> or a provision referred to in paragraph (a).</def></p>

                <p>a constitutional corporation; or</p>
              </content>
            </paragraph>

                <p>a trust, all of the trustees of which are constitutional corporations; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-5__subsec-1__para-c">

                <p>a body corporate that is incorporated in a Territory; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-5__subsec-1__para-d">

                <p><term refersTo="#term-regulatory-powers-act">Regulatory Powers Act</term> means <def>the Regulatory Powers (Standard Provisions) Act 2014.</def></p>
                <p><term refersTo="#term-rules">rules</term> means <def>rules made under <ref href="#sec-41">section 41</ref>.</def></p>
                <p><term refersTo="#term-secretary">Secretary</term> means <def>the Secretary of the Department.</def></p>
                <p><term refersTo="#term-statistical-fuel-information">statistical fuel information</term> means <def>fuel information that is statistical information.</def></p>
                <p><b><i>wholesaling</i></b> a covered product means:</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-5__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>	(a)	entering a covered product for home consumption (within the meaning of the <i>Customs Act 1901</i> or the <i>Excise Act 1901</i>); or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-5__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>if a covered product is not subject to duty of excise or duty of customs—removing the covered product from an import terminal or domestic production facilities (such as a refinery); or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-5__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>if another activity is prescribed by the rules for the purposes of this paragraph for a kind of covered product—undertaking that activity in relation to the kind of product.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-1__sec-5__subsec-2">
            <num>2</num>
            <content>
              <p>	(2)	The rules must not prescribe a fuel for the purposes of paragraph (t) of the definition of <b><i>covered product</i></b> in subsection (1) unless the Minister is satisfied that prescribing the fuel will promote the objects of this Act.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-5__subsec-3">
            <num>3</num>
            <content>
              <p>	(3)	The rules must not prescribe a fuel-related product for the purposes of paragraph (u) of the definition of <b><i>covered product</i></b> in subsection (1) unless the Minister is satisfied that prescribing the product will assist the Commonwealth to give effect to Australia’s obligations, relating to the reporting of data relating to petroleum, other fuels or fuel-related products, under:</p>
            </content>
            <paragraph eId="part-1__sec-5__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>the Agreement; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-5__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>any other agreement with one or more countries.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-1__sec-5__subsec-4">
            <num>4</num>
            <content>
              <p>	(4)	A person is taken to be <b><i>holding stock</i></b> of a covered product that is an MSO product within the meaning of the <i>Fuel Security Act 2021</i> if the person holds stocks of that product within the meaning of section 19 of that Act.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-1__sec-6">
          <num>6</num>
          <heading>Meaning of commercial-in-confidence</heading>
          <content>
            <p>		Information is <b><i>commercial</i></b><b><i>-</i></b><b><i>in</i></b><b><i>-</i></b><b><i>confidence</i></b> if the Secretary is satisfied that:</p>
          </content>
          <paragraph eId="part-1__sec-6__para-a">
            <num>a</num>
            <content>
              <p>release of the information would cause competitive detriment to a person; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-6__para-b">
            <num>b</num>
            <content>
              <p>the information is not in the public domain; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-6__para-c">
            <num>c</num>
            <content>
              <p>the information is not required to be disclosed under another law of the Commonwealth, a State or a Territory; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-6__para-d">
            <num>d</num>
            <content>
              <p>the information is not readily discoverable.</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-1__sec-7">
          <num>7</num>
          <heading>Act binds the Crown</heading>
          <subsection eId="part-1__sec-7__subsec-1">
            <num>1</num>
            <content>
              <p>This Act binds the Crown in each of its capacities.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-7__subsec-2">
            <num>2</num>
            <content>
              <p>This Act does not make the Crown liable to be:</p>
            </content>
            <paragraph eId="part-1__sec-7__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>prosecuted for an offence; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-7__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>subject to civil proceedings for a civil penalty order under Part 4 of the Regulatory Powers Act; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-7__subsec-2__para-c">
              <num>c</num>

                <p>given an infringement notice under Part 5 of the Regulatory Powers Act.</p>

            </paragraph>
          </subsection>
        </section>
        <section eId="part-1__sec-8">
          <num>8</num>
          <heading>Offshore areas</heading>
          <subsection eId="part-1__sec-8__subsec-1">
            <num>1</num>
            <content>
              <p>This Act applies in relation to the offshore areas in respect of the States and Territories as if references in this Act to Australia, when used in a geographical sense, included references to the offshore areas in respect of the States and Territories.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-8__subsec-2">
            <num>2</num>
            <content>
              <p>The extended application given to this Act by subsection (1) extends only in relation to:</p>
            </content>
            <paragraph eId="part-1__sec-8__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>acts, matters and things directly or indirectly connected with exploration of, or exploitation of the natural resources of, the continental shelf of Australia; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-8__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>acts done by or in relation to, and matters, circumstances and things affecting, a person who is in an offshore area for a reason directly or indirectly connected with such exploration or exploitation.</p>

            </paragraph>
          </subsection>
        </section>

          <heading>Concurrent operation of State and Territory laws</heading>
          <content>
            <p>This Act does not exclude or limit the operation of a law of a State or Territory that is capable of operating concurrently with this Act.</p>

        <heading>Reports of fuel information and information-gathering powers</heading>

          <heading>Introduction</heading>

            <heading>Simplified outline of this Part</heading>
            <content>
              <p>Reports must be given to <role refersTo="#secretary">the Secretary</role> if certain activities (called covered activities) are undertaken in relation to certain fuels and fuel-related products (called covered products).</p>
              <p>The rules may set out exceptions to the duty to report. <role refersTo="#secretary">The Secretary</role> may determine that a particular person is not required to give a report in particular circumstances.</p>
              <p><role refersTo="#secretary">The Secretary</role> may request information or documents relating to Australia’s market for covered products if <role refersTo="#secretary">the Secretary</role> reasonably believes there is a disruption to Australia’s fuel supply which significantly impacts Australia’s fuel market.</p>

              <num>1</num>
              <content>
                <p>This section applies if:</p>
              </content>
              <paragraph eId="part-2__dvs-2__sec-11__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>a covered activity of a kind prescribed by the rules for the purposes of this subsection is undertaken in relation to a covered product of a kind prescribed by the rules in relation to the covered activity for the purposes of this subsection; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-11__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>the covered activity is undertaken by a regulated entity; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-11__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>the covered activity is undertaken in whichever of the following circumstances is prescribed by the rules in relation to the covered activity:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-11__subsec-1__para-i">
                <num>i</num>
                <content>
                  <p>in Australia;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-11__subsec-1__para-ii">
                <num>ii</num>
                <content>
                  <p>outside Australia, in connection with business carried on in Australia by the regulated entity;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-11__subsec-1__para-iii">
                <num>iii</num>
                <content>
                  <p>	(iii)	in the Greater Sunrise special regime area (within the meaning of the <i>Seas and Submerged Lands Act 1973</i>), in connection with business carried on in that area by the regulated entity.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-11__subsec-2">
              <num>2</num>
              <content>
                <p>The person prescribed by the rules must give <role refersTo="#secretary">the Secretary</role> a report in accordance with this section.</p>
              </content>

                  <p>Civil penalty:	<quantity refersTo="#penaltyUnit">250 penalty units</quantity>.</p>
                </content>

            </subsection>
            <subsection eId="part-2__dvs-2__sec-11__subsec-3">

                <p>To avoid doubt, rules made for the purposes of subsection (2) may prescribe more than one person who must give a report in relation to the same kind of covered activity and the same kind of covered product.</p>

            </subsection>
            <subsection eId="part-2__dvs-2__sec-11__subsec-4">
              <num>4</num>
              <content>
                <p>A report under subsection (2) must:</p>
              </content>
              <paragraph eId="part-2__dvs-2__sec-11__subsec-4__para-a">
                <num>a</num>
                <content>
                  <p>include the fuel information, in relation to the covered activity or the covered product, that is prescribed by the rules; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-11__subsec-4__para-b">
                <num>b</num>
                <content>
                  <p>be given in the manner and form approved in writing by <role refersTo="#secretary">the Secretary</role>; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-11__subsec-4__para-c">
                <num>c</num>
                <content>
                  <p>be given to <role refersTo="#secretary">the Secretary</role> within the period prescribed by the rules.</p>
                </content>

            <heading>Extended application of section 11</heading>

                <p>	(i)	whether a regulated entity that is subject to the minimum stockholding obligation under the <i>Fuel Security Act 2021 </i>is complying with section 7 of that Act; or</p>

                <p>The rules may make provision in relation to the auditing of compliance with <ref href="#sec-11">section 11</ref>, so far as that section relates to the giving of reports that relate to:</p>
              </content>
              <paragraph eId="part-2__dvs-2__sec-13B__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>MSO activities undertaken in relation to MSO products by regulated entities; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-13B__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>the refining of FSSP fuels.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-13B__subsec-2">

                <p>Without limiting subsection (1), rules made for the purposes of that subsection may do any of the following:</p>
              </content>

                  <p>empower <role refersTo="#secretary">the Secretary</role> to require an audit to be conducted;</p>
                </content>
              </paragraph>

                  <p>prescribe matters to which an audit may relate or be required by <role refersTo="#secretary">the Secretary</role> to relate;</p>

            <heading>Duty to provide reasonable facilities and assistance for audit</heading>

                <p>	(1)	A person affected by an audit required to be conducted under rules made for the purposes of subsection 13B(1) must provide the person conducting the audit (the <b><i>audit team leader</i></b>), and any person assisting the audit team leader in the conduct of the audit, with all reasonable facilities and assistance necessary for the effective exercise of the audit team leader’s duties in relation to the audit.</p>

                  <p>if the audit relates to compliance with <ref href="#sec-11">section 11</ref> so far as that section relates to the giving of reports that relate to MSO activities undertaken in relation to MSO products by a regulated entity:</p>

                <num>i</num>
                <content>
                  <p>the regulated entity; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-13C__subsec-2__para-ii">

                  <p>if the regulated entity has an Australian controlling corporation—the Australian controlling corporation; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-13C__subsec-2__para-iii">

                  <p>	(iii)	any entity in possession of stocks of an MSO product that are held (<i>Fuel Security Act 2021</i>) by the regulated entity;<ref href="#sec-19">within the meaning of section 19</ref> of the </p>

                  <p>the entity’s orders for any upcoming supply of the product to the market, and the scheduled timeframes for that supply;</p>

                  <p>the entity’s orders for any upcoming demand for the product by customers;</p>

          <heading>Simplified outline of this Part</heading>
          <content>
            <p>This Part permits <role refersTo="#secretary">the Secretary</role> to collect fuel information.</p>
            <p>Fuel information is raw data or value added information product that relates to covered activities, or to the quantity, quality or characteristics of covered products, or to the holding (within the meaning of the <i>Fuel Security Act 2021</i>) of certain covered products. Fuel information includes metadata describing such data, and contextual information.</p>
            <p><role refersTo="#secretary">The Secretary</role> may publish or make available fuel information. The information must not be likely to enable the identification of a person or be commercial-in-confidence.</p>

              </content>

                <p>for the purpose of the publication or making available of fuel information under <ref href="#sec-16">section 16</ref>.</p>

                  <p>make a record of or use protected information for the purpose of disclosing protected information to <role refersTo="#minister">the Minister</role>.</p>

                  <p>	(a)	disclose protected information to a person employed by the Minister under the <i>Members of Parliament (Staff) Act 1984</i>; and</p>

                  <p>make a record of or use protected information for the purposes of disclosing the information under paragraph (a).</p>

            <heading>Disclosure to certain agencies, bodies or persons</heading>
            <subsection eId="part-4__dvs-2__sec-24__subsec-1">

                <p><role refersTo="#secretary">The Secretary</role> may disclose:</p>
              </content>
              <paragraph eId="part-4__dvs-2__sec-24__subsec-1__para-a">

                  <p>protected information to an agency, body or person referred to in paragraph (2)(a), (b), (c) or (d); or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-24__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>protected information that is statistical information to a body referred to in paragraph (2)(e);</p>
                </content>
                <content>
                  <p>if <role refersTo="#secretary">the Secretary</role> reasonably believes that the information will enable or assist the agency, body or person to exercise its powers, or perform its functions or duties.</p>
                </content>
              </paragraph>
            </subsection>

                <p>The agencies, bodies and persons to which protected information may be disclosed under this section are the following:</p>
              </content>
              <paragraph eId="part-4__dvs-2__sec-24__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>the Australian Competition and Consumer Commission;</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-24__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p><role refersTo="#commissioner-of-taxation">the Commissioner of Taxation</role>;</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-24__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>an agency or authority of the Commonwealth prescribed by the rules;</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-24__subsec-2__para-d">
                <num>d</num>
                <content>
                  <p>a State or Territory government, agency or authority prescribed by the rules;</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-24__subsec-2__para-e">

                  <p>the International Energy Agency or any other international energy security body prescribed by the rules.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-4__dvs-2__sec-24__subsec-3">

                <p><role refersTo="#secretary">The Secretary</role> may, in writing, authorise an entrusted person to disclose:</p>
              </content>
              <paragraph eId="part-4__dvs-2__sec-24__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>protected information to an agency, body or person referred to in paragraph (2)(a), (b), (c) or (d); or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-24__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>protected information that is statistical information to a body referred to in paragraph (2)(e);</p>
                </content>
                <content>
                  <p>if <role refersTo="#secretary">the Secretary</role> reasonably believes that the information will enable or assist the agency, body or person to exercise its powers, or perform its functions or duties.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-4__dvs-2__sec-24__subsec-4">
              <num>4</num>
              <content>
                <p>If an entrusted person is authorised to disclose information under subsection (3), that person may disclose the information.</p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-2__sec-24__subsec-5">
              <num>5</num>
              <content>
                <p>An entrusted person may:</p>
              </content>
              <paragraph eId="part-4__dvs-2__sec-24__subsec-5__para-a">
                <num>a</num>
                <content>
                  <p>make a record of protected information; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-24__subsec-5__para-b">
                <num>b</num>
                <content>
                  <p>use protected information;</p>
                </content>
                <content>
                  <p>for the purpose of disclosing protected information under subsection (1) or (4).</p>
                  <p>Conditions</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-4__dvs-2__sec-24__subsec-6">
              <num>6</num>
              <content>
                <p><role refersTo="#secretary">The Secretary</role> may, by writing, impose conditions to be complied with in relation to protected information disclosed under subsection (1) or (4), other than information disclosed to the Australian Competition and Consumer Commission.</p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-2__sec-24__subsec-7">
              <num>7</num>
              <content>
                <p>A person commits an offence if:</p>
              </content>
              <paragraph eId="part-4__dvs-2__sec-24__subsec-7__para-a">
                <num>a</num>
                <content>
                  <p>the person is subject to a condition under subsection (6); and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-24__subsec-7__para-b">
                <num>b</num>
                <content>
                  <p>the person engages in conduct; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-24__subsec-7__para-c">
                <num>c</num>
                <content>
                  <p>the person’s conduct breaches the condition.</p>
                </content>

                <p>Protected information disclosed to the Australian Competition and Consumer Commission</p>

              <content>
                <p>	(9)	Protected information disclosed under subsection (1) or (4) to the Australian Competition and Consumer Commission is taken, for the purposes of <i>Competition and Consumer Act 2010</i>, to be protected information within the meaning of section 95ZP of that Act.<ref href="#part-VII">Part VII</ref>A of the </p>

            <num>25</num>
            <heading>Disclosure with consent</heading>
            <content>
              <p>An entrusted person may make a record of, use or disclose protected information that relates to the affairs of a person if:</p>
            </content>
            <paragraph eId="part-4__dvs-2__sec-25__para-a">
              <num>a</num>
              <content>
                <p>the person has consented to the recording, use or disclosure; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__dvs-2__sec-25__para-b">
              <num>b</num>
              <content>
                <p>the recording, use or disclosure is in accordance with that consent.</p>
              </content>
            </paragraph>
          </section>

                <p><role refersTo="#secretary">The Secretary</role> may disclose protected information to an agency referred to in subsection (2), if:</p>

                  <p><role refersTo="#secretary">the Secretary</role> reasonably believes that the disclosure of the information is necessary for:</p>

                  <p>the enforcement of the criminal law; or</p>
                </content>
              </paragraph>

                  <p>a Department, agency or authority of the Commonwealth, a State or a Territory; or</p>
                </content>

                  <p>the Australian Federal Police; or</p>
                </content>
              </paragraph>

                <p>Contraventions of civil penalty provisions</p>

              <p>This section applies to a contravention of a civil penalty provision in a corresponding way to the way in which it applies to an offence.</p>

          </subsection>
        </section>

          <num>39</num>
          <heading>Delegations</heading>
          <subsection eId="part-6__sec-39__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#secretary">The Secretary</role> may, in writing, delegate any or all of his or her functions or powers under:</p>

            <content>
              <p>In performing a function, or exercising a power, under a delegation, the delegate must comply with any directions of <role refersTo="#secretary">the Secretary</role>.</p>

          </subsection>
        </section>
        <section eId="part-6__sec-40">
          <num>40</num>
          <heading>Review of operation of this Act</heading>
          <subsection eId="part-6__sec-40__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> must cause an independent review to be conducted of the operation of this Act and the rules.</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-40__subsec-2">
            <num>2</num>
            <content>
              <p>Without limiting the matters to be covered by the review, the review must consider the following:</p>
            </content>
            <paragraph eId="part-6__sec-40__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>	(a)	the definition of <b><i>fuel information</i></b> in section 5;</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-40__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>	(b)	the definition of <b><i>covered product</i></b> in section 5;</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-40__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>	(c)	the definition of <b><i>covered activity</i></b> in section 5.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-6__sec-40__subsec-3">
            <num>3</num>
            <content>
              <p>The review must be conducted as soon as practicable after the end of 3 years after this section commences.</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-40__subsec-4">
            <num>4</num>
            <content>
              <p>The persons who conduct the review must give <role refersTo="#minister">the Minister</role> a written report of the review.</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-40__subsec-5">
            <num>5</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> must cause copies of the report to be tabled in each House of the Parliament within 15 sitting days of that House after the report is given to <role refersTo="#minister">the Minister</role>.</p>

          </subsection>
        </section>
        <section eId="part-6__sec-41">
          <num>41</num>
          <heading>Rules</heading>
          <subsection eId="part-6__sec-41__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, make rules prescribing matters:</p>
            </content>
            <paragraph eId="part-6__sec-41__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>required or permitted by this Act to be prescribed by the rules; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-41__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>necessary or convenient to be prescribed for carrying out or giving effect to this Act.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-6__sec-41__subsec-2">
            <num>2</num>
            <content>
              <p>To avoid doubt, the rules may not do the following:</p>
            </content>
            <paragraph eId="part-6__sec-41__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>create an offence or civil penalty;</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-41__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>provide powers of:</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-41__subsec-2__para-i">
              <num>i</num>
              <content>
                <p>arrest or detention; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-41__subsec-2__para-ii">
              <num>ii</num>
              <content>
                <p>entry, search or seizure;</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-41__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>impose a tax;</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-41__subsec-2__para-d">
              <num>d</num>
              <content>
                <p>set an amount to be appropriated from the Consolidated Revenue Fund under an appropriation in this Act;</p>

                <p>directly amend the text of this Act.</p>

                  <b>Editorial changes</b>
                </p>
                <p>The <i>Legislation Act 2003</i> authorises First Parliamentary Counsel to make editorial and presentational changes to a compiled law in preparing a compilation of the law for registration. The changes must not change the effect of the law. Editorial changes take effect from the compilation registration date.</p>

                  <b>Misdescribed amendments</b>
                </p>
                <p>A misdescribed amendment is an amendment that does not accurately describe how an amendment is to be made. If, despite the misdescription, the amendment can be given effect as intended, then the misdescribed amendment can be incorporated through an editorial change made under <i>Legislation Act 2003</i>.<ref href="#sec-15V">section 15V</ref> of the </p>
