          <subsection eId="part-1__sec-2__subsec-1">
            <num>1</num>
            <content>
              <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

          <heading>Simplified outline of this Act</heading>
          <content>
            <p>•	The Federal Court or the Federal Circuit and Family Court of Australia (<ref href="#dvs-2">Division 2</ref>) may grant an injunction in relation to a contravention of the relevant Commonwealth Procurement Rules (so far as those rules relate to a covered procurement).</p>
            <p>•	The Federal Court or the Federal Circuit and Family Court of Australia (<ref href="#dvs-2">Division 2</ref>) may order the payment of compensation for a contravention of the relevant Commonwealth Procurement Rules (so far as those rules relate to a covered procurement).</p>
            <p>•	A supplier may complain to the accountable authority of a relevant Commonwealth entity about a contravention of the relevant Commonwealth Procurement Rules (so far as those rules relate to a covered procurement).</p>
            <p>•	If a supplier makes a complaint, the accountable authority must:</p>

              <p>investigate the conduct the subject of the complaint; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-b">

              <p>if no public interest certificate is in force in relation to the procurement—suspend the procurement.</p>
            </content>
            <content>
              <p>•	A contravention of the Commonwealth Procurement Rules does not affect the validity of a contract.</p>

          <num>4</num>
          <heading>Definitions</heading>
          <content>
            <p>In this Act:</p>
            <p><term refersTo="#term-accountable-authority">accountable authority</term> has the same meaning as <def>in the Public Governance, Performance and Accountability Act 2013.</def></p>
            <p><term refersTo="#term-commonwealth-procurement-rules">Commonwealth Procurement Rules</term> means <def>the Commonwealth Procurement Rules in force under subsection 105B(1) of the Public Governance, Performance and Accountability Act 2013.</def></p>
            <p><term refersTo="#term-corporate-commonwealth-entity">corporate Commonwealth entity</term> has the same meaning as <def>in the Public Governance, Performance and Accountability Act 2013.</def></p>
            <p><term refersTo="#term-covered-procurement">covered procurement</term> has the meaning given by <def><ref href="#sec-5">section 5</ref>.</def></p>
            <p><term refersTo="#term-federal-court">Federal Court</term> means <def>the Federal Court of Australia.</def></p>
            <p><term refersTo="#term-goods">goods</term> has the same meaning as <def>in the Commonwealth Procurement Rules.</def></p>
            <p><term refersTo="#term-non-corporate-commonwealth-entity">non-corporate Commonwealth entity</term> has the same meaning as <def>in the Public Governance, Performance and Accountability Act 2013.</def></p>
            <p><term refersTo="#term-official">official</term> has the same meaning as <def>in the Public Governance, Performance and Accountability Act 2013.</def></p>
            <p><term refersTo="#term-procurement">procurement</term> has the same meaning as <def>in the Commonwealth Procurement Rules.</def></p>
            <p><term refersTo="#term-public-interest-certificate">public interest certificate</term> has the meaning given by <def><ref href="#sec-22">section 22</ref>.</def></p>
            <p><b><i>relevant Commonwealth entity</i></b> means:</p>
          </content>

            <num>a</num>
            <content>
              <p>a non-corporate Commonwealth entity; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-b">
            <num>b</num>
            <content>
              <p>	(b)	a corporate Commonwealth entity prescribed by rules made for the purposes of paragraph 105B(1)(b) of the <i>Public Governance, Performance and Accountability Act 2013</i>.</p>
            </content>
            <content>
              <p><b><i>relevant Commonwealth Procurement Rules</i></b> means:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-a">
            <num>a</num>
            <content>
              <p>a provision of Division 1 of the Commonwealth Procurement Rules that is declared by those rules to be a relevant provision for the purposes of this paragraph; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-b">
            <num>b</num>
            <content>
              <p>Division 2 of the Commonwealth Procurement Rules.</p>
            </content>
            <content>
              <p><b><i>supplier</i></b> means:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-a">
            <num>a</num>
            <content>
              <p>a person who supplies, or could supply, goods or services; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-b">
            <num>b</num>
            <content>
              <p>a partnership (or other group) of 2 or more persons that supplies, or could supply, goods or services.</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-1__sec-5">
          <num>5</num>
          <heading>Covered procurement</heading>
          <subsection eId="part-1__sec-5__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	For the purposes of this Act, a procurement is a <b><i>covered procurement</i></b> if:</p>
            </content>
            <paragraph eId="part-1__sec-5__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the rules in Divisions 1 and 2 of the Commonwealth Procurement Rules apply to the procurement; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-5__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>	(b)	the<i> </i>procurement is not included in a class of<i> </i>procurements specified in a determination under subsection (2).</p>
              </content>

            <content>
              <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, make a determination for the purposes of paragraph (1)(b).</p>
            </content>
          </subsection>
        </section>
        <section eId="part-1__sec-6">
          <num>6</num>
          <heading>Crown to be bound</heading>
          <content>
            <p>This Act binds the Crown in each of its capacities.</p>
          </content>
        </section>
        <section eId="part-1__sec-7">
          <num>7</num>
          <heading>Application of this Act</heading>
          <subsection eId="part-1__sec-7__subsec-1">
            <num>1</num>
            <content>
              <p>This Act extends to every external Territory.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-7__subsec-2">
            <num>2</num>
            <content>
              <p>This Act extends to acts, omissions, matters and things outside Australia.</p>
            </content>
          </subsection>

        <heading>Injunctions</heading>
        <section eId="part-2__sec-8">
          <num>8</num>
          <heading>Simplified outline of this Part</heading>
          <content>
            <p>•	The Federal Court or the Federal Circuit and Family Court of Australia (<ref href="#dvs-2">Division 2</ref>) may grant an injunction in relation to a contravention of the relevant Commonwealth Procurement Rules (so far as those rules relate to a covered procurement).</p>
          </content>

          <num>9</num>
          <heading>Injunctions</heading>
          <content>
            <p>Restraining injunctions</p>
          </content>
          <subsection eId="part-2__sec-9__subsec-1">
            <num>1</num>
            <content>
              <p>If:</p>
            </content>
            <paragraph eId="part-2__sec-9__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>a relevant Commonwealth entity; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-9__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>an official of a relevant Commonwealth entity;</p>
              </content>
              <content>
                <p>has engaged, is engaging or is proposing to engage, in any conduct in contravention of the relevant Commonwealth Procurement Rules (so far as those rules relate to a covered procurement), the Federal Court or the Federal Circuit and Family Court of Australia (<ref href="#dvs-2">Division 2</ref>) may, on the application of a supplier whose interests are affected by the conduct, grant an injunction:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-9__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>restraining the entity or official from engaging in the conduct; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-9__subsec-1__para-d">
              <num>d</num>
              <content>
                <p>if, in the court’s opinion, it is desirable to do so—requiring the entity or official to do something.</p>
              </content>
              <content>
                <p>Performance injunctions</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-9__subsec-2">
            <num>2</num>
            <content>
              <p>If:</p>
            </content>
            <paragraph eId="part-2__sec-9__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>either:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-9__subsec-2__para-i">
              <num>i</num>
              <content>
                <p>a relevant Commonwealth entity; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-9__subsec-2__para-ii">
              <num>ii</num>
              <content>
                <p>an official of a relevant Commonwealth entity;</p>
              </content>
              <content>
                <p>has refused or failed, or is refusing or failing, or is proposing to refuse or fail, to do an act or thing; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-9__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>the refusal or failure was, is or would be in contravention of the relevant Commonwealth Procurement Rules (so far as those rules relate to a covered procurement);</p>
              </content>
              <content>
                <p>the Federal Court or the Federal Circuit and Family Court of Australia (<ref href="#dvs-2">Division 2</ref>) may, on the application of a supplier whose interests are affected by the refusal or failure, grant an injunction requiring the entity or official to do that act or thing.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-2__sec-10">
          <num>10</num>
          <heading>Availability of alternative remedy of compensation</heading>
          <subsection eId="part-2__sec-10__subsec-1">
            <num>1</num>
            <content>
              <p>If:</p>
            </content>
            <paragraph eId="part-2__sec-10__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>a supplier has made an application to the Federal Court or the Federal Circuit and Family Court of Australia (<ref href="#dvs-2">Division 2</ref>) for an injunction under this Part in relation to a contravention or proposed contravention; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-10__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>the supplier has made an application to the court for an order under <ref href="#sec-16">section 16</ref> (compensation) in relation to the contravention or proposed contravention; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-10__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>a public interest certificate is in force in relation to the procurement concerned; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-10__subsec-1__para-d">
              <num>d</num>
              <content>
                <p>the procurement concerned has not reached the stage where a contract has been entered into with a supplier;</p>
              </content>
              <content>
                <p>then:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-10__subsec-1__para-e">
              <num>e</num>
              <content>
                <p>the court must consider:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-10__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>whether the grant of the injunction would result in a significant delay to the procurement concerned; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-10__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>if so, whether the making of an order under <ref href="#sec-16">section 16</ref> would be a more appropriate remedy for the contravention or proposed contravention than the grant of the injunction; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-10__subsec-1__para-f">
              <num>f</num>
              <content>
                <p>if the court is satisfied that:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-10__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>the grant of the injunction would result in a significant delay to the procurement concerned; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-10__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>the making of an order under <ref href="#sec-16">section 16</ref> would be a more appropriate remedy for the contravention or proposed contravention than the grant of the injunction;</p>
              </content>
              <content>
                <p>the court may refuse to grant the injunction.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-10__subsec-2">
            <num>2</num>
            <content>
              <p>Subsection (1) does not, by implication, limit the power of a court to refuse to grant an injunction.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-2__sec-11">
          <num>11</num>
          <heading>Limits on power to grant an injunction</heading>
          <content>
            <p>Complaint made by applicant to relevant Commonwealth entity</p>
          </content>
          <subsection eId="part-2__sec-11__subsec-1">
            <num>1</num>
            <content>
              <p>The Federal Court or the Federal Circuit and Family Court of Australia (<ref href="#dvs-2">Division 2</ref>) must not grant an injunction under this Part in relation to a contravention, or proposed contravention, by:</p>
            </content>
            <paragraph eId="part-2__sec-11__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>a relevant Commonwealth entity; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-11__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>an official of a relevant Commonwealth entity;</p>
              </content>
              <content>
                <p>unless:</p>
              </content>

                <p>the court is satisfied that the applicant for the injunction has made a complaint under <ref href="#sec-18">section 18</ref> to the accountable authority of the relevant Commonwealth entity about the contravention or proposed contravention; and</p>

                <p>Time limits for application</p>

            <num>2</num>
            <content>
              <p>The Federal Court or the Federal Circuit and Family Court of Australia (<ref href="#dvs-2">Division 2</ref>) must not grant an injunction under this Part in relation to a contravention that has occurred unless the court is satisfied that the application for the injunction was made:</p>

              <num>a</num>
              <content>
                <p><quantity refersTo="#deadline">within 10 days</quantity> after the later of the following days:</p>
              </content>
            </paragraph>

                <p>the day on which the contravention occurred;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-11__subsec-2__para-ii">

                <p>the day on which the applicant became aware, or ought reasonably to have become aware, of the contravention; or</p>
              </content>
            </paragraph>

              <p>The Federal Court or the Federal Circuit and Family Court of Australia (<ref href="#dvs-2">Division 2</ref>) must not allow a longer period under paragraph (2)(b), (3)(b) or (4)(b) unless the court is satisfied that:</p>

              <num>a</num>

                <p>the applicant’s failure to make the application within the 10-day period mentioned in paragraph (2)(a), (3)(a) or (4)(a) is attributable to the applicant’s reasonable attempt to resolve the complaint mentioned in paragraph (1)(c); or</p>

                <p>there are special circumstances that warrant allowing a longer period.</p>

          <heading>Discharge or variation of an injunction</heading>

            <p>A court may discharge or vary an injunction granted by it under this Part.</p>
          </content>
        </section>

          <heading>Certain limits on granting injunctions not to apply</heading>
          <content>
            <p>Restraining injunctions</p>
          </content>
          <subsection eId="part-2__sec-13__subsec-1">
            <num>1</num>
            <content>
              <p>The power of a court under this Part to grant an injunction restraining:</p>
            </content>
            <paragraph eId="part-2__sec-13__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>a relevant Commonwealth entity; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-13__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>an official of a relevant Commonwealth entity;</p>
              </content>
              <content>
                <p>from engaging in conduct of a particular kind may be exercised:</p>
              </content>
            </paragraph>

                <p>if the court is satisfied that the entity or official has engaged in conduct of that kind—whether or not it appears to the court that the entity or official intends to engage again, or to continue to engage, in conduct of that kind; or</p>

                <p>if it appears to the court that, if an injunction is not granted, it is likely that the entity or official will engage in conduct of that kind:</p>

                <p>whether or not the entity or official has previously engaged in conduct of that kind; and</p>

              <p>The power of a court under this Part to grant an injunction requiring:</p>

                <p>a relevant Commonwealth entity; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-13__subsec-2__para-b">

                <p>to do an act or thing may be exercised:</p>

        <heading>Compensation</heading>

          <num>15</num>
          <heading>Simplified outline of this Part</heading>

            <p>•	The Federal Court or the Federal Circuit and Family Court of Australia (<ref href="#dvs-2">Division 2</ref>) may order the payment of compensation for a contravention of the relevant Commonwealth Procurement Rules (so far as those rules relate to a covered procurement).</p>

          <num>16</num>
          <heading>Compensation for a contravention of the relevant Commonwealth Procurement Rules</heading>
          <content>
            <p>If:</p>
          </content>
          <paragraph eId="part-3__sec-16__para-a">

              <p>a relevant Commonwealth entity; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-3__sec-16__para-b">
            <num>b</num>
            <content>
              <p>an official of a relevant Commonwealth entity;</p>
            </content>
            <content>
              <p>has contravened, is contravening, or is proposing to contravene, the relevant Commonwealth Procurement Rules (so far as those rules relate to a covered procurement), the Federal Court or the Federal Circuit and Family Court of Australia (<ref href="#dvs-2">Division 2</ref>) may, on the application of a supplier whose interests are affected by the contravention or proposed contravention, make whichever of the following orders is applicable:</p>

            <num>c</num>
            <content>
              <p>if the relevant Commonwealth entity is a non-corporate Commonwealth entity—an order directing the Commonwealth to pay to the supplier, by way of compensation, an amount not exceeding the sum of:</p>

          </paragraph>
          <paragraph eId="part-3__sec-16__para-i">
            <num>i</num>
            <content>
              <p>reasonable expenditure incurred by the supplier in preparing a tender for the procurement; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-3__sec-16__para-ii">
            <num>ii</num>

              <p>reasonable expenditure incurred by the supplier in connection with making a complaint under <ref href="#sec-18">section 18</ref> to the accountable authority of the relevant Commonwealth entity about the contravention or proposed contravention; and</p>

            <num>iii</num>
            <content>
              <p>reasonable expenditure incurred by the supplier in connection with making a reasonable attempt to resolve such a complaint;</p>

              <p>if the relevant Commonwealth entity is a corporate Commonwealth entity—an order directing the corporate Commonwealth entity to pay to the supplier, by way of compensation, an amount not exceeding the sum of:</p>

              <p>reasonable expenditure incurred by the supplier in preparing a tender for the procurement; and</p>

        <heading>Complaints</heading>

          <heading>Simplified outline of this Part</heading>

            <p>•	A supplier may complain to the accountable authority of a relevant Commonwealth entity about a contravention of the relevant Commonwealth Procurement Rules (so far as those rules relate to a covered procurement).</p>
            <p>•	If a supplier makes a complaint, the accountable authority must:</p>

              <p>If:</p>

              <num>a</num>
              <content>
                <p>a supplier has reason to believe that:</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-18__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>a relevant Commonwealth entity; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-18__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>an official of a relevant Commonwealth entity;</p>
              </content>
              <content>
                <p>has engaged, is engaging or is proposing to engage, in any conduct in contravention of the relevant Commonwealth Procurement Rules (so far as those rules relate to a covered procurement); and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-18__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>the interests of the supplier are affected by the conduct;</p>
              </content>
              <content>
                <p>the supplier may make a written complaint about the conduct to the accountable authority of the entity.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-18__subsec-2">
            <num>2</num>
            <content>
              <p>A supplier may withdraw a complaint made by the supplier under subsection (1).</p>
            </content>
          </subsection>
        </section>
        <section eId="part-4__sec-19">
          <num>19</num>
          <heading>Investigation by accountable authority</heading>
          <subsection eId="part-4__sec-19__subsec-1">
            <num>1</num>
            <content>
              <p>If a supplier makes a complaint under <ref href="#sec-18">section 18</ref> to the accountable authority of a relevant Commonwealth entity, the accountable authority must:</p>
            </content>
            <paragraph eId="part-4__sec-19__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>investigate the conduct the subject of the complaint; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-19__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>prepare a report of the investigation.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-19__subsec-2">
            <num>2</num>
            <content>
              <p>The accountable authority may discontinue the investigation if:</p>
            </content>
            <paragraph eId="part-4__sec-19__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>the supplier withdraws the complaint; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-19__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>the supplier informs the accountable authority that the supplier considers the complaint to be resolved; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-19__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>in proceedings instituted in a court under this Act in relation to the conduct the subject of the complaint, the court makes either of the following findings:</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-19__subsec-2__para-i">
              <num>i</num>
              <content>
                <p>that the conduct was in contravention of the relevant Commonwealth Procurement Rules (so far as those rules relate to a covered procurement);</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-19__subsec-2__para-ii">
              <num>ii</num>
              <content>
                <p>that the conduct was not in contravention of the relevant Commonwealth Procurement Rules (so far as those rules relate to a covered procurement).</p>

              <p>If:</p>
            </content>
            <paragraph eId="part-4__sec-19__subsec-3__para-a">

                <p>proceedings are instituted in a court under this Act in relation to the conduct the subject of the complaint; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-19__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>the continuation of the investigation would be likely to result in prejudice to the proper administration of justice;</p>
              </content>
              <content>
                <p>the accountable authority must discontinue the investigation.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-4__sec-20">
          <num>20</num>
          <heading>Suspension of procurement</heading>
          <content>
            <p>If:</p>
          </content>
          <paragraph eId="part-4__sec-20__para-a">
            <num>a</num>
            <content>
              <p>a supplier makes a complaint under <ref href="#sec-18">section 18</ref> to the accountable authority of a relevant Commonwealth entity about conduct in relation to a procurement; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-4__sec-20__para-b">
            <num>b</num>
            <content>
              <p>when the complaint is made, no public interest certificate is in force in relation to the procurement;</p>
            </content>
            <content>
              <p>the accountable authority must suspend the procurement until the earliest of the following times:</p>
            </content>
          </paragraph>

            <num>c</num>
            <content>
              <p>if the supplier informs the accountable authority that the supplier considers the complaint to be resolved—the time when the supplier so informs the accountable authority;</p>

              <p>The accountable authority of a relevant Commonwealth entity may issue a written certificate stating that it is not in the public interest for a specified procurement by the entity to be suspended while:</p>
            </content>
            <paragraph eId="part-5__sec-22__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>applications for injunctions under <ref href="#part-2">Part 2</ref> are being considered; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-22__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>complaints under <ref href="#sec-18">section 18</ref> are being investigated.</p>
              </content>
            </paragraph>
          </subsection>

              <p>	(2)	A certificate issued under subsection (1) is to be known as a <b><i>public interest certificate</i></b>.</p>

              <p>For the purposes of subsection (1), it is immaterial whether the contravention occurred before, at or after the commencement of this Act.</p>

          <heading>Delegation by accountable authority</heading>
          <content>
            <p>		Section 110 of the <i>Public Governance, Performance and Accountability Act 2013</i> has effect as if the functions and powers conferred on the accountable authority of a non-corporate Commonwealth entity by this Act were functions or powers conferred by that Act.</p>

              <b>Misdescribed amendments</b>
            </p>
            <p>A misdescribed amendment is an amendment that does not accurately describe the amendment to be made. If, despite the misdescription, the amendment can be given effect as intended, the amendment is incorporated into the compiled law and the abbreviation “(md)” added to the details of the amendment included in the amendment history.</p>
            <p>If a misdescribed amendment cannot be given effect as intended, the abbreviation “(md not incorp)” is added to the details of the amendment included in the amendment history.</p>
