          <p>		This Act is the <i>Veterans’ Affairs Legislation Amendment (Omnibus) Act 2018</i>.</p>
        </content>

        <heading>Commencement</heading>
        <subsection eId="sec-2__subsec-1">
          <num>1</num>
          <content>
            <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

        <heading>Schedules</heading>
        <content>
          <p>Legislation that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.</p>

            <p>Military Rehabilitation and Compensation Act 2004</p>

            <heading>Subsection 319(3)</heading>
            <content>
              <p>After “in respect of a person”, insert “(except a claim made by the Chief of the Defence Force on behalf of the person)”.</p>

            <heading>After subsection 320(2)</heading>
            <content>
              <p>Insert:</p>

              <num>2A</num>
              <content>
                <p>Without limiting paragraph (2)(a), the person may approve the Chief of the Defence Force making a claim on behalf of the person if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-2__para-a">
              <num>a</num>
              <content>
                <p>the person is a member of the Defence Force; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-2__para-b">
              <num>b</num>
              <content>
                <p>the claim is for acceptance of liability by the Commission for a service injury sustained by the person or a service disease contracted by the person.</p>
              </content>
            </paragraph>

              <num>2B</num>
              <content>
                <p>However, if the person approves the Chief of the Defence Force making a claim as mentioned in subsection (2A), the Chief of the Defence Force is not required to make the claim on behalf of the person.</p>

            <num>3</num>
            <heading>Application provision</heading>
            <content>
              <p>The amendment of <i>Military Rehabilitation and Compensation Act 2004</i> made by this Schedule applies in relation to a service injury sustained by the person, or a service disease contracted by the person, on or after the commencement of this item.<ref href="#sec-320">section 320</ref> of the </p>

          <content>
            <p>Safety, Rehabilitation and Compensation (Defence-related Claims) Act 1988</p>
          </content>

            <num>1</num>
            <heading>Section 151</heading>
            <content>
              <p>Repeal the section, substitute:</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-2__clause-151">
            <num>151</num>
            <heading>MRCC may obtain information etc.</heading>
            <hcontainer name="subclause" eId="schedule-2__clause-151__subclause-1">
              <num>1</num>
              <content>
                <p>The MRCC may give a written notice to any person requiring the person, for the purposes of this Act:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-151__para-a">
              <num>a</num>
              <content>
                <p>to provide the MRCC (or a specified staff member assisting the MRCC) such information as the MRCC requires; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-151__para-b">
              <num>b</num>
              <content>
                <p>to produce to the MRCC (or a specified staff member assisting the MRCC) any documents in the custody or under the control of the person; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-151__para-c">
              <num>c</num>
              <content>
                <p>to appear before a specified staff member assisting the MRCC to answer questions.</p>
              </content>
            </paragraph>

              <num>2</num>
              <content>
                <p>To avoid doubt, the person given the notice may be:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-151__para-a">
              <num>a</num>
              <content>
                <p><role refersTo="#secretary">the Secretary</role> of the Defence Department; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-151__para-b">
              <num>b</num>
              <content>
                <p><role refersTo="#secretary">the Secretary</role> of the Department; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-151__para-c">
              <num>c</num>
              <content>
                <p>the Chief of the Defence Force; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-151__para-d">
              <num>d</num>
              <content>
                <p>a person employed:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-151__para-i">
              <num>i</num>
              <content>
                <p>in or in connection with a Department of the Commonwealth, a State or Territory; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-151__para-ii">
              <num>ii</num>
              <content>
                <p>by any authority of the Commonwealth, a State or Territory.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-151__subclause-3">
              <num>3</num>
              <content>
                <p>The notice must specify:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-151__para-a">
              <num>a</num>
              <content>
                <p>if paragraph (1)(a) or (b) applies:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-151__para-i">
              <num>i</num>
              <content>
                <p>the period within which the person must comply with the notice; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-151__para-ii">
              <num>ii</num>
              <content>
                <p>the manner in which the person must comply with the notice; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-151__para-b">
              <num>b</num>
              <content>
                <p>if paragraph (1)(c) applies:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-151__para-i">
              <num>i</num>
              <content>
                <p>the time at which the person must appear before the staff member; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-151__para-ii">
              <num>ii</num>
              <content>
                <p>the place at which the person must appear before the staff member.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-151__subclause-4">
              <num>4</num>
              <content>
                <p>The specified period or the specified time mentioned in subsection (3) must be at least 14 days after the notice is given.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-151__subclause-5">
              <num>5</num>
              <content>
                <p>The MRCC may require the information or answers to be verified by, or given on, oath or affirmation and either orally or in writing.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-151__subclause-6">
              <num>6</num>
              <content>
                <p>A staff member to whom information or answers are verified or given may administer the oath or affirmation.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-151__subclause-7">
              <num>7</num>
              <content>
                <p>This section does not require a person to give information, produce a document or give evidence to the extent that, in doing so, the person would contravene a law of the Commonwealth (not being a law of a Territory).</p>
              </content>
            </hcontainer>
            <content>
              <p>Note:	A law of a State or Territory cannot prevent a person from giving information, producing documents or giving evidence for the purposes of this Act (see <ref href="#sec-151A">section 151A</ref>).</p>
              <p>Penalty:	<quantity refersTo="#penaltyUnit">10 penalty units</quantity>.</p>
              <p>Note:	The defendant bears an evidential burden in relation to the matter in subsection (11) (see subsection 13.3(3) of the <i>Criminal Code</i>).</p>
            </content>
            <hcontainer name="subclause" eId="schedule-2__clause-151__subclause-8">
              <num>8</num>
              <content>
                <p>This section binds the Crown in each of its capacities, but does not make the Crown liable to be prosecuted for an offence.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-151__subclause-9">
              <num>9</num>
              <content>
                <p>A person commits an offence if the person fails to comply with a notice under this section.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-151__subclause-10">
              <num>10</num>
              <content>
                <p>An offence against subsection (9) is an offence of strict liability.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-151__subclause-11">
              <num>11</num>
              <content>
                <p>Subsection (9) does not apply to the extent that the person is not capable of complying with the notice.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-2__clause-151AA">
            <num>151AA</num>
            <heading>Self-incrimination</heading>
            <hcontainer name="subclause" eId="schedule-2__clause-151AA__subclause-1">
              <num>1</num>
              <content>
                <p>An individual is not excused from giving information or evidence, or producing a document, under <ref href="#sec-151">section 151</ref> on the ground that the information or evidence, or the production of the document, might tend to incriminate the individual or expose the individual to a penalty.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-151AA__subclause-2">
              <num>2</num>
              <content>
                <p>However:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-151AA__para-a">
              <num>a</num>
              <content>
                <p>the information or evidence given or the document produced; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-151AA__para-b">
              <num>b</num>
              <content>
                <p>giving the information or evidence or producing the document; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-151AA__para-c">
              <num>c</num>
              <content>
                <p>any information, document or thing obtained as a direct or indirect consequence of giving the information or evidence or producing the document;</p>
              </content>
            </paragraph>
            <content>
              <p>are not admissible in evidence against the individual in any proceedings, other than proceedings for an offence against <i>Criminal Code </i>that relates to this Act.<ref href="#sec-137">section 137</ref>.1 or 137.2 of the </p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-2__clause-2">
            <num>2</num>
            <heading>Before subsection 151A(1)</heading>
            <content>
              <p>Insert:</p>
              <p>(1AA)	Nothing in a law of a State or Territory operates to prevent a person from giving information, producing documents or giving evidence for the purposes of this Act.</p>
            </content>

            <heading>Application provision</heading>
            <content>
              <p>The amendments made by this Schedule apply in relation to a notice given under subsection 151(1) of the <i>Safety, Rehabilitation and Compensation (Defence</i><i>-</i><i>related Claims) Act 1988</i> on or after the commencement of this item.</p>
