            <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

              <p>An aviation industry participant may give <role refersTo="#secretary">the Secretary</role> a transport security program for approval. The content and form of such programs is dealt with in Division 4. Division 5 deals with the approval, variation, revision, and cancellation of the approval of, such programs.</p>
              <p>If <role refersTo="#secretary">the Secretary</role> is satisfied that it is appropriate to do so, taking into account existing circumstances as they relate to aviation security, <role refersTo="#secretary">the Secretary</role> may give a transport security program to an aviation industry participant. This is dealt with in Division 6. That Division also deals with the content, revision and cancellation of such programs.</p>

            <heading>Secretary may give participants a program</heading>

              <content>
                <p><role refersTo="#secretary">The Secretary</role> may, by written notice, give a transport security program to an aviation industry participant referred to in subsection 12(1).</p>
              </content>

              <num>2</num>
              <content>
                <p>The notice must set out, or be accompanied by writing that sets out, the transport security program for the participant.</p>
              </content>

              <num>3</num>
              <content>
                <p><role refersTo="#secretary">The Secretary</role> may give a participant a transport security program under subsection (1) only if <role refersTo="#secretary">the Secretary</role> is satisfied that it is appropriate to do so, taking into account existing circumstances as they relate to aviation security.</p>

            <num>26C</num>
            <heading>Content of programs</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-26C__subclause-1">
              <num>1</num>
              <content>
                <p>A transport security program that is given to an aviation industry participant under <ref href="#sec-26B">section 26B</ref> must:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-26C__para-a">
              <num>a</num>
              <content>
                <p>set out the minimum security requirements that the participant must comply with for the purposes of safeguarding against unlawful interference with aviation; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-26C__para-b">
              <num>b</num>
              <content>
                <p>deal with any other matter required to be dealt with in the program by regulations made for the purposes of subsection (2); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-26C__para-c">
              <num>c</num>
              <content>
                <p>be appropriate for the operations or locations covered by the program.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-26C__subclause-2">
              <num>2</num>
              <content>
                <p>The regulations may prescribe other matters that are to be dealt with in one or more of the following:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-26C__para-a">
              <num>a</num>
              <content>
                <p>each transport security program given under <ref href="#sec-26B">section 26B</ref>;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-26C__para-b">
              <num>b</num>
              <content>
                <p>each transport security program for a particular kind of aviation industry participant given under <ref href="#sec-26B">section 26B</ref>;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-26C__para-c">
              <num>c</num>
              <content>
                <p>each transport security program for a particular class of a particular kind of aviation industry participant given under <ref href="#sec-26B">section 26B</ref>.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-26C__subclause-3">
              <num>3</num>
              <content>
                <p>A transport security program that is given to an aviation industry participant under <ref href="#sec-26B">section 26B</ref> may require the participant to have in place any of the following:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-26C__para-a">
              <num>a</num>
              <content>
                <p>procedures to manage and coordinate aviation security activities within the participant’s operation;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-26C__para-b">
              <num>b</num>
              <content>
                <p>procedures to coordinate the management of aviation security with other parties (including Commonwealth agencies) who have responsibilities for, or are connected with, aviation;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-26C__para-c">
              <num>c</num>
              <content>
                <p>technology, equipment and procedures that will be used by the participant to maintain aviation security;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-26C__para-d">
              <num>d</num>
              <content>
                <p>a plan for how the participant will respond to aviation security incidents;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-26C__para-e">
              <num>e</num>
              <content>
                <p>practices and procedures to protect security compliance information.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-26D">
            <num>26D</num>
            <heading>When a program is in force</heading>
            <content>
              <p>When program comes into force</p>
              <p>Period in which program remains in force</p>
            </content>
            <hcontainer name="subclause" eId="schedule-1__clause-26D__subclause-1">
              <num>1</num>
              <content>
                <p>A transport security program given under <ref href="#sec-26B">section 26B</ref> comes into force at the time specified in the notice giving the program. The time specified must not be earlier than the time the notice is given.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-26D__subclause-2">
              <num>2</num>
              <content>
                <p>The program remains in force until the earliest of the following times:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-26D__para-a">
              <num>a</num>
              <content>
                <p>if the notice giving the program specifies a time at which the program ceases to be in force—that time;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-26D__para-b">
              <num>b</num>
              <content>
                <p>if the program is replaced under <ref href="#sec-26F">section 26F</ref>—the time of replacement;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-26D__para-c">
              <num>c</num>
              <content>
                <p>if the program is cancelled under <ref href="#sec-26F">section 26F</ref>, 26G or 26H—the time of cancellation.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-26E">
            <num>26E</num>
            <heading>Relationship with Division 5</heading>
            <content>
              <p>If a transport security program given to an aviation industry participant under <role refersTo="#secretary">the Secretary</role> another transport security program under Division 5 unless <role refersTo="#secretary">the Secretary</role> has given the participant written permission to do so.<ref href="#sec-26B">section 26B</ref> is in force, the participant must not give </p>
              <p>Note:	The permission could be a permission under subsection 12(2).</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-26F">
            <num>26F</num>
            <heading>Secretary may revise or cancel inadequate programs</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-26F__subclause-1">
              <num>1</num>
              <content>
                <p>This section applies if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-26F__para-a">
              <num>a</num>
              <content>
                <p>	(a)	a transport security program given to an aviation industry participant under <b><i>existing program</i></b>) is in force; and<ref href="#sec-26B">section 26B</ref> (the </p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-26F__para-b">
              <num>b</num>
              <content>
                <p><role refersTo="#secretary">the Secretary</role> is no longer satisfied that the existing program is appropriate:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-26F__para-i">
              <num>i</num>
              <content>
                <p>because there is a change in the circumstances that relate to aviation security; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-26F__para-ii">
              <num>ii</num>
              <content>
                <p>because there is a change in circumstances that could impact on aviation security; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-26F__para-iii">
              <num>iii</num>
              <content>
                <p>for some other reason.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-26F__subclause-2">
              <num>2</num>
              <content>
                <p><role refersTo="#secretary">The Secretary</role> may:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-26F__para-a">
              <num>a</num>
              <content>
                <p>	(a)	give the participant another transport security program under <b><i>revised program</i></b>); or<ref href="#sec-26B">section 26B</ref> (a </p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-26F__para-b">
              <num>b</num>
              <content>
                <p>by written notice to the participant, cancel the existing program.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-26F__subclause-3">
              <num>3</num>
              <content>
                <p>If <role refersTo="#secretary">the Secretary</role> gives the participant a revised program, the revised program replaces the existing program when it comes into force.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-26G">
            <num>26G</num>
            <heading>Cancelling for failure to comply</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-26G__subclause-1">
              <num>1</num>
              <content>
                <p>If:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-26G__para-a">
              <num>a</num>
              <content>
                <p>a transport security program given to an aviation industry participant under <ref href="#sec-26B">section 26B</ref> is in force; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-26G__para-b">
              <num>b</num>
              <content>
                <p>the participant has accumulated the number of demerit points prescribed by the regulations as the number necessary for <role refersTo="#secretary">the Secretary</role> to be able to cancel the program;</p>
              </content>
            </paragraph>
            <content>
              <p><role refersTo="#secretary">the Secretary</role> may, by written notice given to the participant, cancel the program.</p>
              <p>Note:	For the demerit points system, see <ref href="#dvs-5">Division 5</ref> of <ref href="#part-8">Part 8</ref>.</p>
            </content>
            <hcontainer name="subclause" eId="schedule-1__clause-26G__subclause-2">
              <num>2</num>
              <content>
                <p>Before cancelling a program under subsection (1), <role refersTo="#secretary">the Secretary</role> may, by written notice given to the participant, request the participant to show cause why the program should not be cancelled.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-26H">
            <num>26H</num>
            <heading>Cancelling programs on request</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-26H__subclause-1">
              <num>1</num>
              <content>
                <p>An aviation industry participant may, in writing, request <role refersTo="#secretary">the Secretary</role> to cancel a transport security program given to the participant under section 26B.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-26H__subclause-2">
              <num>2</num>
              <content>
                <p>The request must set out reasons for making the request.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-26H__subclause-3">
              <num>3</num>
              <content>
                <p><role refersTo="#secretary">The Secretary</role> may, by written notice given to the participant, cancel the program if <role refersTo="#secretary">the Secretary</role> is satisfied that it is appropriate to do so, taking into account existing circumstances as they relate to aviation security.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-26H__subclause-4">
              <num>4</num>
              <content>
                <p>If <role refersTo="#secretary">the Secretary</role> is not so satisfied, <role refersTo="#secretary">the Secretary</role> must:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-26H__para-a">
              <num>a</num>
              <content>
                <p>refuse to cancel the program; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-26H__para-b">
              <num>b</num>
              <content>
                <p>give the participant written notice of the refusal.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-26H__subclause-5">
              <num>5</num>
              <content>
                <p>If <role refersTo="#secretary">the Secretary</role> does not cancel, or refuse to cancel, the program within the period of 60 days after the request was given, <role refersTo="#secretary">the Secretary</role> is taken to have refused to cancel the program.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-8">
            <num>8</num>
            <heading>Subsection 125(1)</heading>
            <content>
              <p>Repeal the subsection, substitute:</p>
              <p>Note:	For cancellations referred to in paragraph (a), see <ref href="#sec-26">section 26</ref>. For cancellations referred to in paragraph (b), see <ref href="#sec-26G">section 26G</ref>.</p>

                <p>	(1)	The regulations may establish a system (the <b><i>demerit points system</i></b>) under which, if an aviation industry participant accrues a prescribed number of demerit points:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-8__para-a">
              <num>a</num>
              <content>
                <p>the approval under <ref href="#dvs-5">Division 5</ref> of <ref href="#part-2">Part 2</ref> of a transport security program of the participant may be cancelled; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-8__para-b">
              <num>b</num>
              <content>
                <p>a transport security program given to the participant under <ref href="#dvs-6">Division 6</ref> of <ref href="#part-2">Part 2</ref> may be cancelled.</p>

            </paragraph>
