          <heading>Simplified outline of this Act</heading>
          <content>
            <p>This Act requires entities based, or operating, in Australia, which have an annual consolidated revenue of more than $100 million, to report annually on the risks of modern slavery in their operations and supply chains, and actions to address those risks. Other entities based, or operating, in Australia may report voluntarily.</p>
            <p>The Commonwealth is required to report on behalf of non-corporate Commonwealth entities, and the reporting requirements also apply to Commonwealth corporate entities and companies with an annual consolidated revenue of more than $100 million.</p>
            <p>Reports are kept by <role refersTo="#minister">the Minister</role> in a public repository known as the Modern Slavery Statements Register. Statements on the register may be accessed by the public, free of charge, on the internet.</p>
            <p>This Act also establishes the Australian Anti-Slavery Commissioner, sets out <role refersTo="#commissioner">the Commissioner</role>’s functions and deals with other matters relating to the role of <role refersTo="#commissioner">the Commissioner</role> (including administrative matters).</p>

        </section>
        <section eId="part-1__sec-4">
          <num>4</num>
          <heading>Definitions</heading>
          <content>
            <p>In this Act:</p>
            <p><term refersTo="#term-accounting-standards">accounting standards</term> has the same meaning as <def>in <ref href="">the Corporations Act 2001</ref>.</def></p>
            <p><b><i>Australia</i></b>, when used in a geographical sense, includes the external Territories.</p>
            <p><b><i>Australian entity </i></b>means:</p>
          </content>
          <paragraph eId="part-1__sec-4__para-a">
            <num>a</num>
            <content>
              <p>	(a)	a company which is a resident <i>Income Tax Assessment Act 1936</i>; or<ref href="#sec-6__subsec-1">within the meaning of subsection 6(1)</ref> of the </p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-b">
            <num>b</num>
            <content>
              <p>	(b)	a trust, if the trust estate is a resident trust estate within the meaning of <i>Income Tax Assessment Act 1936</i>; or<ref href="#dvs-6">Division 6</ref> of <ref href="#part-II">Part II</ref>I of the </p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-c">
            <num>c</num>
            <content>
              <p>	(c)	a corporate limited partnership which is a resident <i>Income Tax Assessment Act 1936</i>; or<ref href="#sec-94T">within the meaning of section 94T</ref> of the </p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-d">
            <num>d</num>
            <content>
              <p><i>	</i>(d)<i>	</i>any other partnership, or other entity, whether incorporated or unincorporated, if:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-i">
            <num>i</num>
            <content>
              <p>the entity is formed or incorporated within Australia; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-ii">
            <num>ii</num>
            <content>
              <p>the central management or control of the entity is in Australia.</p>
            </content>
            <content>
              <p><b><i>carries</i></b><b><i> on business in Australia</i></b>: see section 5 (meaning of <b><i>reporting entity</i></b>).</p>
              <p><term refersTo="#term-commissioner">Commissioner</term> means <def>the Australian Anti-Slavery Commissioner referred to in <ref href="#sec-20B">section 20B</ref>.</def></p>
              <p><b><i>consolidated revenue</i></b>, of an entity, means:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-a">
            <num>a</num>
            <content>
              <p>the total revenue of the entity, for a reporting period; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-b">
            <num>b</num>
            <content>
              <p>if the entity controls another entity or entities—the total revenue of the entity and all of the controlled entities, considered as a group, for a reporting period of the controlling entity;</p>
            </content>
            <content>
              <p>worked out in accordance with the accounting standards, even if those standards do not otherwise apply to such an entity (including a controlling entity) or group.</p>
              <p><b><i>control</i></b>, of an entity by another entity, means control of the entity within the meaning of the accounting standards.</p>
              <p><term refersTo="#term-entity">entity</term> has the same meaning as <def>in <ref href="">the Income Tax Assessment Act 1997</ref>.</def></p>
              <p><term refersTo="#term-modern-slavery">modern slavery</term> means <def>conduct which would constitute: 	(a)	an offence under <i>Criminal Code</i>; or<ref href="#dvs-270">Division 270</ref> or 271 of the  an offence under either of those Divisions if the conduct took place in Australia; or trafficking in persons, as defined in Article 3 of the Protocol to Prevent, Suppress and Punish Trafficking in Persons, Especially Women and Children, supplementing the United Nations Convention against Transnational Organized Crime, done at New York on <date date="2000-11-15">15 November 2000</date> ([2005] ATS 27); or the worst forms of child labour, as defined in Article 3 of the ILO Convention (No. 182) concerning the Prohibition and Immediate Action for the Elimination of the Worst Forms of Child Labour, done at Geneva on <date date="1999-06-17">17 June 1999</date> ([2007] ATS 38). <b><i>modern slavery statement</i></b>: see section 12.</def></p>

              <p>the worst forms of child labour, as defined in Article 3 of the ILO Convention (No. 182) concerning the Prohibition and Immediate Action for the Elimination of the Worst Forms of Child Labour, done at Geneva on <date date="1999-06-17">17 June 1999</date> ([2007] ATS 38).</p>

              <p><term refersTo="#term-paid-work">paid work</term> means <def>work for financial gain or reward (whether as an employee, a self-employed person or otherwise).</def></p>
              <p><b><i>principal governing body</i></b>, of an entity, means:</p>
            </content>
          </paragraph>

            <num>a</num>
            <content>
              <p>the body, or group of members of the entity, with primary responsibility for the governance of the entity; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-b">
            <num>b</num>
            <content>
              <p>if the entity is of a kind prescribed by rules made for the purposes of this paragraph—a prescribed body within the entity, or a prescribed member or members of the entity.</p>
            </content>

              <p>for a superannuation fund—the fund’s board of trustees.</p>

            <content>
              <p><term refersTo="#term-register">register</term> means <def>the Modern Slavery Statements Register established under <ref href="#sec-18">section 18</ref>.</def></p>
              <p><b><i>reporting entity</i></b>: see section 5.</p>
              <p><b><i>reporting period</i></b>, of an entity, means a financial year, or another annual accounting period applicable to the entity, which starts after the commencement of this section.</p>
              <p><b><i>responsible member</i></b>, of an entity, means:</p>

              <p>an individual member of the entity’s principal governing body who is authorised to sign modern slavery statements for the purposes of this Act; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-b">
            <num>b</num>
            <content>
              <p>if the entity is a trust administered by a sole trustee—that trustee; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-c">
            <num>c</num>
            <content>
              <p>if the entity is a corporation sole—the individual constituting the corporation; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-d">
            <num>d</num>
            <content>
              <p>	(d)	if the entity is under administration within the meaning of the <i>Corporations Act 2001</i>—the administrator; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-e">
            <num>e</num>
            <content>
              <p>if the entity is of a kind prescribed by rules made for the purposes of this paragraph—a prescribed member of the entity.</p>
            </content>
            <content>
              <p><term refersTo="#term-rules">rules</term> means <def>rules made by the Minister under <ref href="#sec-25">section 25</ref>.</def></p>
              <p><b><i>sensitive information</i></b>: information is <b><i>sensitive information</i></b> if:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-a">
            <num>a</num>
            <content>
              <p>the public disclosure of the information would, or could reasonably be expected to, prejudice the investigation of, or the prosecution of a person for, an offence; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-b">
            <num>b</num>
            <content>
              <p>the public disclosure of the information would, or could reasonably be expected to, endanger the life or safety of any person; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-c">
            <num>c</num>
            <content>
              <p>all of the following apply in relation to the information:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-i">
            <num>i</num>
            <content>
              <p>the public disclosure of the information would, or could reasonably be expected to, prejudice the security, defence or international relations of Australia;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-ii">
            <num>ii</num>
            <content>
              <p>the information was given in confidence to <role refersTo="#commissioner">the Commissioner</role>, a member of the staff assisting <role refersTo="#commissioner">the Commissioner</role> (see section 20F), a person engaged to assist <role refersTo="#commissioner">the Commissioner</role> under section 20G or a person engaged as a consultant under section 20H, acting in that capacity;</p>

          </paragraph>
          <paragraph eId="part-1__sec-4__para-iii">
            <num>iii</num>
            <content>
              <p>written consent to the public disclosure of the information has not been given by the person or body that gave the information.</p>
            </content>
            <content>
              <p><term refersTo="#term-strategic-plan">strategic plan</term> means <def>a strategic plan prepared under <ref href="#sec-20X">section 20X</ref> and includes a strategic plan as revised under that section.</def></p>
            </content>
          </paragraph>
        </section>
        <section eId="part-1__sec-5">
          <num>5</num>
          <heading>Meaning of reporting entity</heading>
          <subsection eId="part-1__sec-5__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	Each of the following is a <b><i>reporting entity</i></b> in relation to a reporting period:</p>
            </content>

          <heading>Voluntary modern slavery statements</heading>
          <content>
            <p>How an entity may volunteer</p>
          </content>
          <subsection eId="part-1__sec-6__subsec-1">
            <num>1</num>
            <content>
              <p>An entity covered by subsection (2) may volunteer to comply with the requirements of this Act for a reporting period, or reporting periods, by giving written notice to <role refersTo="#minister">the Minister</role> accordingly before the end of the reporting period (or the earliest of the reporting periods), in a manner and form approved by <role refersTo="#minister">the Minister</role>.</p>

              <p>An entity may revoke a notice given under subsection (1), to the extent that it applies in relation to a reporting period or periods, by giving written notice accordingly to <role refersTo="#minister">the Minister</role> before the start of the reporting period, or the earliest of the reporting periods.</p>

        <heading>Modern slavery statements</heading>
        <section eId="part-2__sec-11">
          <num>11</num>
          <heading>Simplified outline of this Part</heading>
          <content>
            <p>This Part requires modern slavery statements to be given annually to <role refersTo="#minister">the Minister</role>, describing the risks of modern slavery in the operations and supply chains of reporting entities and entities owned or controlled by those entities.</p>
            <p>The statements must also include information about actions taken to address those risks.</p>
            <p>Joint modern slavery statements may be given on behalf of one or more reporting entities.</p>
            <p><role refersTo="#minister">The Minister</role> must prepare an annual modern slavery statement on behalf of all non-corporate Commonwealth entities.</p>
            <p><role refersTo="#minister">The Minister</role> may request an explanation from an entity about the entity’s failure to comply with a requirement in relation to modern slavery statements, and may also request that the entity undertake remedial action in relation to that requirement. If the entity fails to comply with the request, <role refersTo="#minister">the Minister</role> may publish information about the failure to comply on the register or elsewhere, including the identity of the entity.</p>

          <heading>Meaning of modern slavery statement</heading>
          <content>
            <p>		A <b><i>modern slavery statement</i></b> is a statement prepared for the purposes of any of the following:</p>

            <content>
              <p><ref href="#sec-13">section 13</ref> (modern slavery statements for single reporting entities);</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-12__para-b">

              <p><ref href="#sec-14">section 14</ref> (joint modern slavery statements);</p>
            </content>
          </paragraph>

        </section>
        <section eId="part-2__sec-13">
          <num>13</num>
          <heading>Modern slavery statements for single reporting entities</heading>
          <subsection eId="part-2__sec-13__subsec-1">
            <num>1</num>
            <content>
              <p>A reporting entity must give <role refersTo="#minister">the Minister</role> a modern slavery statement for the entity, for a reporting period, unless a modern slavery statement has been given covering the entity for that period under section 14 (joint modern slavery statements) or 15 (Commonwealth modern slavery statements).</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-13__subsec-2">
            <num>2</num>
            <content>
              <p>The reporting entity must ensure that the statement:</p>
            </content>

                <p>complies with <ref href="#sec-16">section 16</ref>; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-13__subsec-2__para-b">

                <p>is prepared in a form approved by <role refersTo="#minister">the Minister</role>; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-13__subsec-2__para-c">

                <p>is approved by the principal governing body of the entity; and</p>
              </content>
            </paragraph>

              <p>An entity, other than the Commonwealth, may give <role refersTo="#minister">the Minister</role> a modern slavery statement covering one or more reporting entities (which may include the entity giving the statement), for a reporting period for those reporting entities.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-14__subsec-2">
            <num>2</num>
            <content>
              <p>The entity giving the statement must ensure that it:</p>
            </content>
            <paragraph eId="part-2__sec-14__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>complies with <ref href="#sec-16">section 16</ref>; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-14__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>is prepared in a form approved by <role refersTo="#minister">the Minister</role>; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-14__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>is prepared in consultation with each reporting entity covered by the statement; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-14__subsec-2__para-d">
              <num>d</num>

                <p>is approved by the principal governing body of:</p>

            </paragraph>

            <num>2</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> must ensure that the statement:</p>

          <heading>Mandatory criteria for modern slavery statements</heading>
          <subsection eId="part-2__sec-16__subsec-1">
            <num>1</num>
            <content>
              <p>A modern slavery statement must, in relation to each reporting entity covered by the statement:</p>
            </content>
            <paragraph eId="part-2__sec-16__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>identify the reporting entity; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-16__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>describe the structure, operations and supply chains of the reporting entity; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-16__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>describe the risks of modern slavery practices in the operations and supply chains of the reporting entity, and any entities that the reporting entity owns or controls; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-16__subsec-1__para-d">
              <num>d</num>
              <content>
                <p>describe the actions taken by the reporting entity and any entity that the reporting entity owns or controls, to assess and address those risks, including due diligence and remediation processes; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-16__subsec-1__para-e">
              <num>e</num>
              <content>
                <p>describe how the reporting entity assesses the effectiveness of such actions; and</p>
              </content>
            </paragraph>

                <p>describe the process of consultation with:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-16__subsec-1__para-i">

                <p>include any other information that the reporting entity, or the entity giving the statement, considers relevant.</p>

              <p>If <role refersTo="#minister">the Minister</role> is reasonably satisfied that an entity has failed to comply with a requirement under section 13 or 14 (which deal with requirements to give modern slavery statements), <role refersTo="#minister">the Minister</role> may give a written request to the entity to do either or both of the following:</p>

                <p>provide an explanation for the failure to comply within a specified period of 28 days or longer after the request is given;</p>
              </content>
            </paragraph>

              <num>b</num>
              <content>
                <p>undertake specified remedial action in relation to that requirement in accordance with the request within a specified period of 28 days or longer after the request is given.</p>

                  <p>Example:	For a request relating to a failure to give a modern slavery statement to <role refersTo="#minister">the Minister</role> within the period required by section 13, remedial action specified under paragraph (b) of this subsection may be to give a modern slavery statement to <role refersTo="#minister">the Minister</role> within a further period specified in the request.</p>

              <p><role refersTo="#minister">The Minister</role> may extend, or further extend, a period specified in a request under subsection (1) by written notice given to the entity. The extension may be given before or after the end of the specified period (or that period as previously extended).</p>

              <p>A request under subsection (1) must include a statement of the effect of subsections (2) and (4) to (6).</p>

              <p>Publication of information about failure to comply with request</p>

            <content>
              <p>If <role refersTo="#minister">the Minister</role> is reasonably satisfied that an entity has failed to comply with a request under subsection (1), <role refersTo="#minister">the Minister</role> may publish the following information on the register, or in any other way <role refersTo="#minister">the Minister</role> considers appropriate:</p>

                <p>the identity of the entity;</p>
              </content>
            </paragraph>

                <p>if the request relates to the entity’s failure to comply with subsection 14(2) (joint modern slavery statements) in relation to a modern slavery statement—the identities of the reporting entities covered by the statement;</p>

                <p>the date the request was given, and details of any extension given under subsection (2);</p>

              <p>	(5)	An entity <b><i>fails to comply</i></b> with a request if, and only if:</p>

        <heading>Access to modern slavery statements</heading>

            <p>This Part establishes the Modern Slavery Statements Register.</p>
            <p>The register is made available to the public on the internet.</p>
            <p>Modern slavery statements are registered by <role refersTo="#minister">the Minister</role>.</p>
            <p>Revised versions of registered modern slavery statements can be registered in some circumstances.</p>

          <heading>Modern Slavery Statements Register</heading>

              <p><role refersTo="#minister">The Minister</role> must maintain a register of modern slavery statements, to be known as the Modern Slavery Statements Register.</p>

          </subsection>

              <p>The register must be made available for public inspection, without charge, on the internet.</p>
            </content>
          </subsection>

          <heading>Registration of modern slavery statements</heading>
          <subsection eId="part-3__sec-19__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> must register a modern slavery statement:</p>
            </content>
            <paragraph eId="part-3__sec-19__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>given in accordance with <ref href="#sec-13">section 13</ref> (modern slavery statements for single reporting entities) or 14 (joint modern slavery statements); or</p>
              </content>

              <num>b</num>

                <p>prepared in accordance with <ref href="#sec-15">section 15</ref> (Commonwealth modern slavery statements).</p>

          <heading>Registration of revised modern slavery statements</heading>
          <subsection eId="part-3__sec-20__subsec-1">
            <num>1</num>
            <content>
              <p>An entity (other than the Commonwealth) may, by written notice to <role refersTo="#minister">the Minister</role>, accompanied by a revised version of a registered modern slavery statement given by the entity, request <role refersTo="#minister">the Minister</role> to register the revised version.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-20__subsec-2">
            <num>2</num>
            <content>
              <p>The revised version of the modern slavery statement must indicate the date of the revision and include a description of the changes made to the registered statement (or to the most recently registered revised version of the statement).</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-20__subsec-3">
            <num>3</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> must register the revised version of the modern slavery statement, if the revised version complies with the requirements mentioned in the following provisions:</p>

                <p>if the original statement was given under <ref href="#sec-13">section 13</ref>—paragraphs 13(2)(a) to (d);</p>

              <p><role refersTo="#commissioner">The Commissioner</role> has functions relating to addressing modern slavery and supporting victims of modern slavery. <role refersTo="#commissioner">The Commissioner</role>’s functions include consulting and liaising with a range of persons, and advocating to the Commonwealth Government, in relation to modern slavery.</p>
              <p>This Part deals with administrative matters relating to <role refersTo="#commissioner">the Commissioner</role>, including the appointment of <role refersTo="#commissioner">the Commissioner</role>, the terms and conditions on which <role refersTo="#commissioner">the Commissioner</role> holds office and arrangements relating to staff, contractors and consultants.</p>

                  <p>to support Australian entities and entities carrying on business in Australia to address risks of modern slavery practices in their operations and supply chains, and in the operations and supply chains of entities they own or control;</p>

                  <p>to support collaboration and engagement within and across sectors in relation to addressing modern slavery;</p>

                  <p>to collect, analyse, interpret and disseminate information relating to modern slavery;</p>
                </content>
              </paragraph>

                  <p>to consult and liaise with Commonwealth, State and Territory governments, agencies, bodies and office holders on matters relating to modern slavery;</p>
                </content>

                <num>j</num>
                <content>
                  <p>to consult and liaise with other persons and organisations on matters relating to modern slavery;</p>
                </content>
              </paragraph>

                  <p>to advocate to the Commonwealth Government on matters relating to modern slavery, including for continuous improvement in policy and practice;</p>
                </content>

                <num>l</num>
                <content>
                  <p>at the request of <role refersTo="#minister">the Minister</role>, to provide advice to <role refersTo="#minister">the Minister</role> on matters relating to modern slavery;</p>

                  <p>such other functions as are conferred on <role refersTo="#commissioner">the Commissioner</role> by this Act or any other law of the Commonwealth;</p>

                  <p>to engage with victims of modern slavery to inform and support the performance of the above functions;</p>
                </content>

                  <p>to do anything incidental or conducive to the performance of any of the above functions.</p>
                </content>
              </paragraph>
            </subsection>

                <p>To avoid doubt, <role refersTo="#commissioner">the Commissioner</role> may not investigate, or resolve complaints concerning, individual instances or suspected instances of modern slavery.</p>

            <num>20D</num>
            <heading>Commissioner must have regard to international obligations</heading>
            <content>
              <p>In performing <role refersTo="#commissioner">the Commissioner</role>’s functions, <role refersTo="#commissioner">the Commissioner</role> must have regard to Australia’s international obligations under the international agreements mentioned in subsection 7(2).</p>

            <num>20E</num>
            <heading>Application of finance law</heading>
            <content>
              <p>		For the purposes of the finance law (within the meaning of the <i>Public Governance, Performance and Accountability Act 2013</i>), the Commissioner is an official of the Department.</p>
            </content>
          </section>
          <section eId="part-3A__dvs-2__sec-20F">
            <num>20F</num>
            <heading>Arrangements relating to staff of the Department</heading>
            <subsection eId="part-3A__dvs-2__sec-20F__subsec-1">
              <num>1</num>
              <content>
                <p>The staff assisting <role refersTo="#commissioner">the Commissioner</role> are to be APS employees in the Department whose services are made available to <role refersTo="#commissioner">the Commissioner</role> by <role refersTo="#secretary">the Secretary</role> of the Department, in connection with the performance of any of <role refersTo="#commissioner">the Commissioner</role>’s functions or the exercise of any of <role refersTo="#commissioner">the Commissioner</role>’s powers.</p>
              </content>
            </subsection>
            <subsection eId="part-3A__dvs-2__sec-20F__subsec-2">
              <num>2</num>
              <content>
                <p>When performing services for <role refersTo="#commissioner">the Commissioner</role> under this section, a person is subject to the directions of <role refersTo="#commissioner">the Commissioner</role>.</p>

            </subsection>
          </section>
          <section eId="part-3A__dvs-2__sec-20G">
            <num>20G</num>
            <heading>Contractors</heading>
            <content>
              <p><role refersTo="#commissioner">The Commissioner</role> may, on behalf of the Commonwealth, engage persons under a written agreement to assist <role refersTo="#commissioner">the Commissioner</role> to perform or exercise the functions or powers of <role refersTo="#commissioner">the Commissioner</role>.</p>
            </content>
          </section>
          <section eId="part-3A__dvs-2__sec-20H">
            <num>20H</num>
            <heading>Consultants</heading>
            <content>
              <p><role refersTo="#commissioner">The Commissioner</role> may, on behalf of the Commonwealth, engage consultants to advise in relation to the performance of <role refersTo="#commissioner">the Commissioner</role>’s functions.</p>
            </content>
          </section>
          <section eId="part-3A__dvs-2__sec-20J">
            <num>20J</num>
            <heading>Independence of Commissioner</heading>
            <content>
              <p>Subject to this Act and any other Act, <role refersTo="#commissioner">the Commissioner</role>:</p>
            </content>
            <paragraph eId="part-3A__dvs-2__sec-20J__para-a">
              <num>a</num>
              <content>
                <p>has complete discretion in performing or exercising <role refersTo="#commissioner">the Commissioner</role>’s functions or powers; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3A__dvs-2__sec-20J__para-b">
              <num>b</num>
              <content>
                <p>is not subject to direction from anyone when doing so.</p>
              </content>
            </paragraph>
          </section>

            <heading>Commissioner not to be sued</heading>
            <content>
              <p><role refersTo="#commissioner">The Commissioner</role>, and any person acting under the direction or authority of <role refersTo="#commissioner">the Commissioner</role>, is not liable to an action, suit or proceeding in relation to an act done or omitted to be done in good faith in the performance or purported performance, or exercise or purported exercise, of a function or power conferred by this Act.</p>

          <heading>Appointment</heading>

            <heading>Appointment of Commissioner</heading>

              <num>1</num>
              <content>
                <p><role refersTo="#commissioner">The Commissioner</role> is to be appointed by the Governor-General by written instrument, on a full-time basis.</p>
              </content>
            </subsection>
            <subsection eId="part-3A__dvs-3__sec-20L__subsec-2">
              <num>2</num>
              <content>
                <p>A person must not be appointed under subsection (1) as <role refersTo="#commissioner">the Commissioner</role> unless <role refersTo="#minister">the Minister</role> is satisfied that:</p>
              </content>
              <paragraph eId="part-3A__dvs-3__sec-20L__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>the person has appropriate qualifications, knowledge or experience in two or more of the following fields:</p>
                </content>
              </paragraph>
              <paragraph eId="part-3A__dvs-3__sec-20L__subsec-2__para-i">
                <num>i</num>
                <content>
                  <p>human rights issues relating to business practices;</p>
                </content>
              </paragraph>
              <paragraph eId="part-3A__dvs-3__sec-20L__subsec-2__para-ii">
                <num>ii</num>
                <content>
                  <p>regulation;</p>
                </content>
              </paragraph>
              <paragraph eId="part-3A__dvs-3__sec-20L__subsec-2__para-iii">
                <num>iii</num>
                <content>
                  <p>public policy relating to modern slavery or related forms of human exploitation;</p>
                </content>

                  <p>the selection of the person for the appointment is the result of a process that:</p>
                </content>
              </paragraph>
              <paragraph eId="part-3A__dvs-3__sec-20L__subsec-2__para-i">
                <num>i</num>
                <content>
                  <p>was merit-based; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3A__dvs-3__sec-20L__subsec-2__para-ii">
                <num>ii</num>
                <content>
                  <p>included public advertising of the position.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3A__dvs-3__sec-20L__subsec-3">
              <num>3</num>
              <content>
                <p>Paragraph (2)(b) does not apply in relation to the reappointment of a person who, immediately before the start of the period of reappointment, holds office as <role refersTo="#commissioner">the Commissioner</role> under a previous appointment under subsection (1).</p>
              </content>
            </subsection>
          </section>
          <section eId="part-3A__dvs-3__sec-20M">
            <num>20M</num>
            <heading>Obligation to fill vacancy as soon as practicable</heading>
            <content>
              <p>As soon as practicable after the office of <role refersTo="#commissioner">the Commissioner</role> becomes vacant, a Commissioner or acting Commissioner must be appointed under section 20L or 20P.</p>
            </content>
          </section>
          <section eId="part-3A__dvs-3__sec-20N">
            <num>20N</num>
            <heading>Period of appointment</heading>
            <subsection eId="part-3A__dvs-3__sec-20N__subsec-1">
              <num>1</num>
              <content>
                <p><role refersTo="#commissioner">The Commissioner</role> holds office for the period specified in the instrument of appointment. The period must not exceed 5 years.</p>
              </content>
            </subsection>
            <subsection eId="part-3A__dvs-3__sec-20N__subsec-2">
              <num>2</num>
              <content>
                <p>A person is not eligible to be appointed to the office of <role refersTo="#commissioner">the Commissioner</role> more than twice.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-3A__dvs-3__sec-20P">
            <num>20P</num>
            <heading>Acting appointments</heading>
            <subsection eId="part-3A__dvs-3__sec-20P__subsec-1">
              <num>1</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may, by written instrument, appoint a person to act as <role refersTo="#commissioner">the Commissioner</role>:</p>

                <num>a</num>
                <content>

                <p><role refersTo="#minister">The Minister</role> may grant <role refersTo="#commissioner">the Commissioner</role> leave of absence, other than recreation leave, on the terms and conditions as to remuneration or otherwise that <role refersTo="#minister">the Minister</role> determines.</p>

            </subsection>
          </section>

            <num>20S</num>
            <heading>Other paid work</heading>

              <p><role refersTo="#commissioner">The Commissioner</role> must not engage in paid work outside the duties of <role refersTo="#commissioner">the Commissioner</role>’s office without the approval of <role refersTo="#minister">the Minister</role>.</p>

            <num>20T</num>
            <heading>Resignation</heading>
            <subsection eId="part-3A__dvs-4__sec-20T__subsec-1">
              <num>1</num>
              <content>
                <p><role refersTo="#commissioner">The Commissioner</role> may resign <role refersTo="#commissioner">the Commissioner</role>’s appointment by giving the Governor-General a written resignation.</p>
              </content>
            </subsection>
            <subsection eId="part-3A__dvs-4__sec-20T__subsec-2">
              <num>2</num>
              <content>
                <p>The resignation takes effect on the day it is received by the Governor-General or, if a later day is specified in the resignation, on that later day.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-3A__dvs-4__sec-20U">
            <num>20U</num>
            <heading>Termination of appointment</heading>
            <subsection eId="part-3A__dvs-4__sec-20U__subsec-1">
              <num>1</num>

                <p>The Governor-General may terminate the appointment of <role refersTo="#commissioner">the Commissioner</role>:</p>
              </content>
              <paragraph eId="part-3A__dvs-4__sec-20U__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>for misbehaviour; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3A__dvs-4__sec-20U__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>if <role refersTo="#commissioner">the Commissioner</role> is unable to perform the duties of <role refersTo="#commissioner">the Commissioner</role>’s office because of physical or mental incapacity.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3A__dvs-4__sec-20U__subsec-2">
              <num>2</num>
              <content>
                <p>The Governor-General may terminate the appointment of <role refersTo="#commissioner">the Commissioner</role> if:</p>
              </content>
              <paragraph eId="part-3A__dvs-4__sec-20U__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p><role refersTo="#commissioner">the Commissioner</role>:</p>
                </content>
              </paragraph>
              <paragraph eId="part-3A__dvs-4__sec-20U__subsec-2__para-i">
                <num>i</num>
                <content>
                  <p>becomes bankrupt; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3A__dvs-4__sec-20U__subsec-2__para-ii">
                <num>ii</num>

                  <p>applies to take the benefit of any law for the relief of bankrupt or insolvent debtors; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3A__dvs-4__sec-20U__subsec-2__para-iii">
                <num>iii</num>

                  <p>compounds with <role refersTo="#commissioner">the Commissioner</role>’s creditors; or</p>
                </content>
              </paragraph>

                  <p>makes an assignment of remuneration for the benefit of <role refersTo="#commissioner">the Commissioner</role>’s creditors; or</p>

                  <p><role refersTo="#commissioner">the Commissioner</role> is absent, except on leave of absence, for 14 consecutive days or for 28 days in any 12 months; or</p>

                <num>c</num>
                <content>
                  <p><role refersTo="#commissioner">the Commissioner</role> engages, except with <role refersTo="#minister">the Minister</role>’s approval, in paid work outside the duties of <role refersTo="#commissioner">the Commissioner</role>’s office (see section 20S); or</p>

              <p><role refersTo="#commissioner">The Commissioner</role> holds office on the terms and conditions (if any) in relation to matters not covered by this Act that are determined by the Governor-General.</p>

          <heading>Other matters</heading>
          <section eId="part-3A__dvs-5__sec-20W">
            <num>20W</num>
            <heading>Commissioner may request information from Commonwealth agencies</heading>
            <subsection eId="part-3A__dvs-5__sec-20W__subsec-1">
              <num>1</num>
              <content>
                <p>If <role refersTo="#commissioner">the Commissioner</role> reasonably believes that a Commonwealth agency has information relevant to the performance of <role refersTo="#commissioner">the Commissioner</role>’s functions, <role refersTo="#commissioner">the Commissioner</role> may, in writing, request the agency to give the information to <role refersTo="#commissioner">the Commissioner</role>.</p>
              </content>
            </subsection>
            <subsection eId="part-3A__dvs-5__sec-20W__subsec-2">
              <num>2</num>
              <content>
                <p>The request may specify a period within which the information is to be given. The period specified must be reasonable.</p>
              </content>
            </subsection>
            <subsection eId="part-3A__dvs-5__sec-20W__subsec-3">
              <num>3</num>
              <content>
                <p>The agency must, so far as is reasonably practicable, comply with the request.</p>
              </content>
            </subsection>
            <subsection eId="part-3A__dvs-5__sec-20W__subsec-4">

                <p>In this section:</p>

              <content>
                <p><b><i>Commonwealth agency</i></b> means:</p>
              </content>

                  <p>	(a)	a Commonwealth entity (within the meaning of the <i>Public Governance, Performance and Accountability Act 2013</i>); or</p>

                <content>
                  <p>a person who performs the functions of, or performs functions within, a Commonwealth entity (within the meaning of that Act).</p>

            <heading>Disclosure of information by Commissioner</heading>

                <p>This section applies to information obtained by any of the following persons in the person’s capacity as such a person:</p>

              <paragraph eId="part-3A__dvs-5__sec-20WA__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p><role refersTo="#commissioner">the Commissioner</role>;</p>
                </content>
              </paragraph>
              <paragraph eId="part-3A__dvs-5__sec-20WA__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>a member of the staff assisting <role refersTo="#commissioner">the Commissioner</role> (see section 20F);</p>
                </content>
              </paragraph>
              <paragraph eId="part-3A__dvs-5__sec-20WA__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>a person engaged to assist <role refersTo="#commissioner">the Commissioner</role> under section 20G;</p>
                </content>
              </paragraph>
              <paragraph eId="part-3A__dvs-5__sec-20WA__subsec-1__para-d">
                <num>d</num>
                <content>
                  <p>a person engaged as a consultant under <ref href="#sec-20H">section 20H</ref>.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3A__dvs-5__sec-20WA__subsec-2">

                <p><role refersTo="#commissioner">The Commissioner</role> may disclose the information to a person or body mentioned in subsection (3) if <role refersTo="#commissioner">the Commissioner</role> reasonably believes the disclosure will enable or assist the person or body to perform or exercise any of the person or body’s functions or powers.</p>
              </content>
            </subsection>
            <subsection eId="part-3A__dvs-5__sec-20WA__subsec-3">
              <num>3</num>
              <content>
                <p>The persons and bodies are the following:</p>
              </content>
              <paragraph eId="part-3A__dvs-5__sec-20WA__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>a Department, agency or authority of the Commonwealth;</p>
                </content>
              </paragraph>
              <paragraph eId="part-3A__dvs-5__sec-20WA__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>the Australian Federal Police;</p>
                </content>
              </paragraph>
              <paragraph eId="part-3A__dvs-5__sec-20WA__subsec-3__para-c">
                <num>c</num>
                <content>
                  <p>a person who holds an office or appointment under a law of the Commonwealth.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3A__dvs-5__sec-20WA__subsec-4">

                <p>This section does not limit any other powers <role refersTo="#commissioner">the Commissioner</role> has to disclose information.</p>

            </subsection>

            <heading>Strategic plan</heading>
            <subsection eId="part-3A__dvs-5__sec-20X__subsec-1">
              <num>1</num>
              <content>
                <p><role refersTo="#commissioner">The Commissioner</role> must:</p>
              </content>
              <paragraph eId="part-3A__dvs-5__sec-20X__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>prepare a strategic plan in relation to <role refersTo="#commissioner">the Commissioner</role>’s functions; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3A__dvs-5__sec-20X__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>ensure that:</p>
                </content>
              </paragraph>
              <paragraph eId="part-3A__dvs-5__sec-20X__subsec-1__para-i">
                <num>i</num>
                <content>
                  <p>the first strategic plan comes into force as soon as practicable after the commencement of this section; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3A__dvs-5__sec-20X__subsec-1__para-ii">
                <num>ii</num>
                <content>
                  <p>a strategic plan is in force at all times after the first strategic plan comes into force.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3A__dvs-5__sec-20X__subsec-2">
              <num>2</num>
              <content>
                <p>A strategic plan must:</p>
              </content>
              <paragraph eId="part-3A__dvs-5__sec-20X__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>relate to a period of up to 3 years; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3A__dvs-5__sec-20X__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>state <role refersTo="#commissioner">the Commissioner</role>’s priorities and principal objectives for the period in relation to the performance of <role refersTo="#commissioner">the Commissioner</role>’s functions; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3A__dvs-5__sec-20X__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>include, as one such principal objective, <role refersTo="#commissioner">the Commissioner</role> making guidance material publicly available to support victims of modern slavery.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3A__dvs-5__sec-20X__subsec-3">
              <num>3</num>
              <content>
                <p>A strategic plan must not include sensitive information.</p>
              </content>
            </subsection>
            <subsection eId="part-3A__dvs-5__sec-20X__subsec-4">
              <num>4</num>
              <content>
                <p>A strategic plan prepared by <role refersTo="#commissioner">the Commissioner</role> is in force for the period to which the plan relates.</p>
              </content>
            </subsection>
            <subsection eId="part-3A__dvs-5__sec-20X__subsec-5">
              <num>5</num>
              <content>
                <p><role refersTo="#commissioner">The Commissioner</role> may revise a strategic plan at any time during the period to which the strategic plan relates.</p>
              </content>
            </subsection>
            <subsection eId="part-3A__dvs-5__sec-20X__subsec-6">
              <num>6</num>
              <content>
                <p>In preparing or revising a strategic plan, <role refersTo="#commissioner">the Commissioner</role> must consult:</p>
              </content>
              <paragraph eId="part-3A__dvs-5__sec-20X__subsec-6__para-a">
                <num>a</num>
                <content>
                  <p><role refersTo="#minister">the Minister</role>; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3A__dvs-5__sec-20X__subsec-6__para-b">
                <num>b</num>
                <content>
                  <p><role refersTo="#secretary">the Secretary</role> of the Department.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3A__dvs-5__sec-20X__subsec-7">

                <p><role refersTo="#commissioner">The Commissioner</role> must cause a strategic plan to be published on <role refersTo="#commissioner">the Commissioner</role>’s website as soon as practicable after the plan is prepared or revised (as the case may be).</p>

                <p>A strategic plan is not a legislative instrument.</p>

                <p>The Commissioner must, <quantity refersTo="#deadline">within 3 months</quantity> after the end of a financial year, prepare and give to the Minister an annual report on the Commissioner’s activities during the financial year.</p>

                  <p>the progress made towards any objectives set out in the strategic plan or plans that were in force during all or part of the financial year; and</p>

          </subsection>

              <p>In performing functions or exercising powers under the delegation, the delegate must comply with any written directions of <role refersTo="#commissioner">the Commissioner</role>.</p>

        </section>
        <section eId="part-4__sec-23">
          <num>23</num>
          <heading>Delegation by Minister</heading>
          <subsection eId="part-4__sec-23__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> may, by writing, delegate all or any of <role refersTo="#minister">the Minister</role>’s powers and functions under this Act to an SES employee, or acting SES employee, in the Department.</p>
            </content>

            <content>
              <p>In exercising powers or functions under a delegation, the delegate must comply with any directions of <role refersTo="#minister">the Minister</role>.</p>

            <num>3</num>
            <content>
              <p>Subsection (1) does not apply to a power to make, vary or revoke the rules.</p>

        </section>
        <section eId="part-4__sec-23A">
          <num>23A</num>
          <heading>Annual reports about implementation</heading>
          <subsection eId="part-4__sec-23A__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> must cause a report to be prepared for each calendar year (including the year in which this section commences) about the implementation of this Act during the year, including the following (without limitation):</p>
            </content>
            <paragraph eId="part-4__sec-23A__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>an overview of compliance by entities with this Act during the year;</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-23A__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>the identification of best practice modern slavery reporting under this Act during the year.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-23A__subsec-2">
            <num>2</num>
            <content>
              <p>The report must be:</p>
            </content>
            <paragraph eId="part-4__sec-23A__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>started as soon as practicable after the end of the calendar year for which it is prepared; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-23A__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>completed before the end of the calendar year in which it is started.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-23A__subsec-3">
            <num>3</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> must cause copies of the report to be tabled in each House of the Parliament within 15 sitting days of that House after the completion of the report.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-4__sec-24">
          <num>24</num>
          <heading>Three-year review</heading>
          <subsection eId="part-4__sec-24__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> must cause a report to be prepared reviewing:</p>
            </content>
            <paragraph eId="part-4__sec-24__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the operation of this Act and any rules over the period of 3 years after this section commences; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-24__subsec-1__para-aa">
              <num>aa</num>
              <content>
                <p>compliance with this Act and any rules over that period; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-24__subsec-1__para-ab">
              <num>ab</num>
              <content>
                <p>whether additional measures to improve compliance with this Act and any rules are necessary or desirable, such as civil penalties for failure to comply with the requirements of this Act; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-24__subsec-1__para-ac">
              <num>ac</num>
              <content>
                <p>whether a further review of this Act and any rules should be undertaken, and if so, when; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-24__subsec-1__para-ad">
              <num>ad</num>
              <content>
                <p>whether it is necessary or desirable to do anything else to improve the operation of this Act and any rules; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-24__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>whether this Act or any rules should be amended to implement review recommendations.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-24__subsec-2">
            <num>2</num>
            <content>
              <p>The review must be:</p>
            </content>
            <paragraph eId="part-4__sec-24__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>started as soon as practicable after the end of the period of 3 years after this section commences; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-24__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>completed <quantity refersTo="#deadline">within 12 months</quantity> after it starts.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-24__subsec-3">
            <num>3</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> must cause copies of the report to be tabled in each House of the Parliament within 15 sitting days of that House after the completion of the report.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-4__sec-25">
          <num>25</num>
          <heading>Rules</heading>
          <subsection eId="part-4__sec-25__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, make rules prescribing matters:</p>
            </content>
            <paragraph eId="part-4__sec-25__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>required or permitted by this Act to be prescribed by the rules; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-25__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>necessary or convenient to be prescribed for carrying out or giving effect to this Act.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-25__subsec-2">
            <num>2</num>
            <content>
              <p>To avoid doubt, the rules may not do the following:</p>
            </content>
            <paragraph eId="part-4__sec-25__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>create an offence or civil penalty;</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-25__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>provide powers of:</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-25__subsec-2__para-i">
              <num>i</num>
              <content>
                <p>arrest or detention; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-25__subsec-2__para-ii">
              <num>ii</num>
              <content>
                <p>entry, search or seizure;</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-25__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>impose a tax;</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-25__subsec-2__para-d">
              <num>d</num>
              <content>
                <p>set an amount to be appropriated from the Consolidated Revenue Fund under an appropriation in this Act;</p>

              <num>e</num>
              <content>
                <p>directly amend the text of this Act.</p>

                  <b>Editorial changes</b>
                </p>
                <p>The <i>Legislation Act 2003</i> authorises First Parliamentary Counsel to make editorial and presentational changes to a compiled law in preparing a compilation of the law for registration. The changes must not change the effect of the law. Editorial changes take effect from the compilation registration date.</p>
                <p>If the compilation includes editorial changes, the endnotes include a brief outline of the changes in general terms. Full details of any changes can be obtained from the Office of Parliamentary Counsel.</p>

                  <b>Misdescribed amendments</b>
                </p>
                <p>A misdescribed amendment is an amendment that does not accurately describe how an amendment is to be made. If, despite the misdescription, the amendment can be given effect as intended, then the misdescribed amendment can be incorporated through an editorial change made under <i>Legislation Act 2003</i>.<ref href="#sec-15V">section 15V</ref> of the </p>
                <p>If a misdescribed amendment cannot be given effect as intended, the amendment is not incorporated and “(md not incorp)” is added to the amendment history.</p>
