                <p>	(1)	The object of this section is to modify the application of the <i>Judicial Misbehaviour and Incapacity (Parliamentary Commissions) Act 2012</i> (the <b><i>JMIPC Act</i></b>) so as to allow a Commission to be established by the Houses of Parliament to investigate and report on alleged misbehaviour or incapacity of an FWC Member, so the Houses can be well-informed to consider whether to pray for:</p>

                <p>immediately before that day, the review of the modern award had not been completed.</p>
              </content>
            </paragraph>

                <p>Despite the repeal of:</p>

                <p><ref href="#dvs-4">Division 4</ref> of <ref href="#part-2">Part 2</ref>-3 (which deals with 4 yearly reviews of modern awards); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-26__para-b">
              <num>b</num>
              <content>
                <p>paragraph 582(4)(a) (which deals with directions by the President); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-26__para-c">
              <num>c</num>
              <content>
                <p>subsections 616(2) and (3) (which deal with the FWC’s functions etc. that must be performed by a Full Bench);</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-4__clause-26__subclause-3">
              <num>3</num>
              <content>
                <p>Despite the repeal of paragraph 582(4)(a) (which deals with directions by the President) by the amending Act, a direction given by the President to an FWC Member under that paragraph that was in force immediately before the Schedule 1 commencement day continues to have effect, in relation to the review of the modern award, as if that repeal had not happened.</p>
              </content>

              <num>4</num>
              <content>
                <p>For the purposes of this clause, it is immaterial whether the review of the modern award is conducted in relation to an issue that the modern award has in common with another modern award.</p>

          </hcontainer>
          <hcontainer name="clause" eId="schedule-4__clause-27">
            <num>27</num>
            <heading>Dismissing applications</heading>
            <hcontainer name="subclause" eId="schedule-4__clause-27__subclause-1">
              <num>1</num>
              <content>
                <p>On or after the Schedule 1 commencement day, the FWC may dismiss an application under <ref href="#sec-158">section 158</ref> to vary, revoke or make a modern award if the FWC is satisfied that the specific matters in relation to which the application is made were dealt with, or are being dealt with, in a 4 yearly review of modern awards.</p>

              <p>Sunset provision</p>

                <p>This clause ceases to have effect at the end of 2 years after the Schedule 1 commencement day.</p>

            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-4__clause-28">
            <num>28</num>
            <heading>Application of amendments—when employees have genuinely agreed to an enterprise agreement</heading>
            <hcontainer name="subclause" eId="schedule-4__clause-28__subclause-1">
              <num>1</num>
              <content>
                <p>The amendments of <ref href="#sec-188">section 188</ref> of this Act made by Schedule 2 to the amending Act apply in relation to an application made under <ref href="#sec-185">section 185</ref> of this Act for approval of an enterprise agreement if the application is made:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-4__clause-28__para-a">
              <num>a</num>
              <content>
                <p>on or after the Schedule 2 commencement day; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-28__para-b">
              <num>b</num>
              <content>
                <p>before the Schedule 2 commencement day, if circumstances covered by subclause (2) apply.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-4__clause-28__subclause-2">
              <num>2</num>
              <content>
                <p>The circumstances covered by this subclause are:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-4__clause-28__para-a">
              <num>a</num>
              <content>
                <p>on or before the Schedule 2 commencement day, the FWC had neither approved, nor refused to approve, the enterprise agreement; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-28__para-b">
              <num>b</num>
              <content>
                <p>before the Schedule 2 commencement day:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-28__para-i">
              <num>i</num>
              <content>
                <p>the FWC approved, or refused to approve, the enterprise agreement; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-28__para-ii">
              <num>ii</num>
              <content>
                <p>an application was made under <ref href="#sec-604">section 604</ref> for an appeal against the decision to approve, or refuse to approve, the enterprise agreement; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-28__para-iii">
              <num>iii</num>
              <content>
                <p>the FWC had not yet made a final decision on the appeal; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-28__para-c">
              <num>c</num>
              <content>
                <p>all of the following apply:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-28__para-i">
              <num>i</num>
              <content>
                <p><quantity refersTo="#deadline">within 21 days</quantity> before the Schedule 2 commencement day, the FWC approved, or refused to approve, the enterprise agreement;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-28__para-ii">
              <num>ii</num>
              <content>
                <p>immediately before the Schedule 2 commencement day, an application had not been made under <ref href="#sec-604">section 604</ref> for an appeal against the decision to approve, or refuse to approve, the enterprise agreement;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-28__para-iii">
              <num>iii</num>
              <content>
                <p><quantity refersTo="#deadline">within 21 days</quantity> after the FWC approved, or refused to approve, the enterprise agreement, an application is made under section 604 for an appeal against that decision.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-4__clause-29">
            <num>29</num>
            <heading>Application of section 641B of the amended Act</heading>
            <content>
              <p>Section 641B of the amended Act applies in relation to alleged misbehaviour or incapacity of an FWC Member occurring before or after the commencement of Schedule 3 to the amending Act.</p>
