          <p>		This Act is the <i>Intelligence Services Amendment (Establishment of </i><i>the </i><i>Australian Signals Directorate) Act 2018</i>.</p>

                <p>The Director-General of ASD is to be appointed by the Governor-General by written instrument.</p>

            <heading>Briefing the Leader of the Opposition about ASD</heading>

              <p>The Director-General of ASD must consult regularly with the Leader of the Opposition in the House of Representatives for the purpose of keeping him or her informed on matters relating to ASD.</p>

            <heading>Basis and period of appointment</heading>

                <p>The Director-General of ASD holds office on a full-time basis.</p>

                <p>The Director-General of ASD holds office for the period specified in the instrument of appointment. The period must not exceed 5 years.</p>

            <heading>Remuneration</heading>

                <p>The Director-General of ASD is to be paid the remuneration that is determined by the Remuneration Tribunal. If no determination of that remuneration by the Tribunal is in operation, the Director-General is to be paid the remuneration that is prescribed by the regulations.</p>

                <p>The Director-General of ASD may resign his or her appointment by giving the Governor-General a written resignation.</p>

            </hcontainer>

                <p>The resignation takes effect on the day it is received by the Governor-General or, if a later day is specified in the resignation, on that later day.</p>

            </hcontainer>
          </hcontainer>

            <heading>Termination of appointment</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-27H__subclause-1">

                <p>The Governor-General may terminate the appointment of the Director-General of ASD:</p>

            </hcontainer>

                <p>for misbehaviour; or</p>

            </paragraph>
            <paragraph eId="schedule-1__clause-27H__para-b">

                <p>if the Director-General is unable to perform the duties of his or her office because of physical or mental incapacity.</p>

            </paragraph>

                <p>The Governor-General must terminate the appointment of the Director-General of ASD if:</p>

            <paragraph eId="schedule-1__clause-27H__para-i">

                <p>applies to take the benefit of any law for the relief of bankrupt or insolvent debtors; or</p>

            </paragraph>

              <num>iii</num>
              <content>
                <p>compounds with his or her creditors; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-27H__para-iv">
              <num>iv</num>

                <p>makes an assignment of his or her remuneration for the benefit of his or her creditors; or</p>
              </content>
            </paragraph>

                <p>the Director-General is absent, except on leave of absence, for 14 consecutive days or for 28 days in any 12 months; or</p>

                <p>the Director-General engages in paid work that, in <role refersTo="#minister">the Minister</role>’s opinion, conflicts or may conflict with the proper performance of the Director-General’s duties (see section 27L); or</p>

                <p>the Director-General lacks, or has lost, an essential qualification for performing the duties of his or her office.</p>

                <p>The Governor-General may, with the Director-General of ASD’s consent, retire the Director-General from office on the ground of incapacity if the Director-General is:</p>

                <p>	(a)	an eligible employee for the purposes of the <i>Superannuation Act 1976</i>; or</p>

                <p>	(b)	a member of the superannuation scheme established by deed under the <i>Superannuation Act 1990</i>; or</p>

              </content>
            </paragraph>

            <heading>Delegation by Director-General of ASD</heading>

                <p>The Director-General of ASD may, in writing, delegate all or any of his or her functions or powers under <ref href="#part-5A">Part 5A</ref> to a staff member who holds, or is acting in, a position that is an Executive Level 1 position, or an equivalent or higher position, in ASD.</p>

              <p><b><i>Defence Department </i></b>means the Department of State that deals with defence and that is administered by the Minister responsible for administering section 1 of the <i>Defence Act 1903</i>.</p>
              <p><b><i>Minister</i></b> means the Minister responsible for the Australian Signals Directorate.</p>
              <p><b><i>new ASD</i></b> means the Australian Signals Directorate, as established on a statutory basis by section 27A of the new law.</p>
              <p><b><i>new law</i></b> means the <i>Intelligence Services Act 2001</i>, as amended by this Schedule.</p>
              <p><b><i>old ASD</i></b> means that part of the Defence Department known as the Australian Signals Directorate under the <i>Intelligence Services Act 2001</i>, as in force immediately before the commencement of this item.</p>
              <p><b><i>staffing procedures</i></b> includes procedures and policies related to:</p>

              <num>a</num>
              <content>
                <p>recruitment, promotion or performance management; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-100__para-b">

                <p>inefficiency, misconduct, forfeiture of position, fitness for duty or loss of essential qualifications; or</p>
              </content>
            </paragraph>

                <p>disciplinary action, grievance processes or reviews of, or appeals against, staffing decisions; or</p>

              <p>The person who holds the position of the Director of the old ASD, immediately before <date date="2018-07-01">1 July 2018</date>, is taken to have been appointed as the Director-General of the new ASD by the Governor-General under section 27B of the new law:</p>

                <p>for a term of 6 months; and</p>
              </content>
            </paragraph>

                <p>on the terms and conditions set out in <ref href="#dvs-2">Division 2</ref> of <ref href="#part-3">Part 3</ref>A of the new law.</p>

                <p>If, immediately before <date date="2018-07-01">1 July 2018</date>, a person was employed in the old ASD, the person:</p>

                <p>continues, on and after <date date="2018-07-01">1 July 2018</date>, to be employed in the new ASD; and</p>
              </content>
            </paragraph>

                <p>ceases to be an APS employee.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-104__subclause-2">
              <num>2</num>
              <content>
                <p>A person who, immediately before <date date="2018-07-01">1 July 2018</date>, was employed in the old ASD under a written agreement, continues to be employed on the terms and conditions specified in that agreement.</p>

            <hcontainer name="subclause" eId="schedule-1__clause-104__subclause-3">
              <num>3</num>
              <content>
                <p>(3)	A person who, immediately before 1 July 2018, had his or her terms and conditions of employment in the old ASD determined under <i>Public Service Act 1999</i>, continues to be employed on the terms and conditions specified in that determination.<ref href="#sec-24">section 24</ref> of the </p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-104__subclause-4">
              <num>4</num>
              <content>
                <p>Subitems (2) and (3) are subject to any determination made by the Director-General of the new ASD under subsection 38A(3) of the new law.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-104__subclause-5">
              <num>5</num>
              <content>
                <p>The accrued employment benefits of a person to whom subitem (1) applies are not affected by the person ceasing to be an APS employee.</p>
              </content>
            </hcontainer>

              <num>6</num>
              <content>
                <p>The service of a person to whom subitem (1) applies as an employee of the new ASD is taken, for all purposes, to have been continuous with his or her service as an employee of the old ASD.</p>

              <num>7</num>
              <content>
                <p>To avoid doubt, if a person ceases to be an APS employee (as mentioned in subitem (1)), the person is not entitled to receive any payment or other benefit merely because he or she ceased to be such an employee.</p>

            <num>105</num>
            <heading>Safety, Rehabilitation and Compensation Act 1988</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-105__subclause-1">
              <num>1</num>
              <content>
                <p>This item applies in relation to a person if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-105__para-a">
              <num>a</num>
              <content>
                <p>the person was a member of the staff of the old ASD before <date date="2018-07-01">1 July 2018</date> (whether or not the person was still a member of the staff of ASD immediately before that date); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-105__para-b">
              <num>b</num>
              <content>
                <p>	(b)	the person was an employee (within the meaning of the <i>Safety, Rehabilitation and Compensation Act 1988 </i>(the <b><i>SRC Act</i></b>)) of the old ASD when the person was a member of the staff as mentioned in paragraph (a); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-105__para-c">
              <num>c</num>
              <content>
                <p>the person suffered an injury (within the meaning of that Act) before <date date="2018-07-01">1 July 2018</date>.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-105__subclause-2">
              <num>2</num>
              <content>
                <p>The SRC Act applies, on and after <date date="2018-07-01">1 July 2018</date>, as if the person had been an employee of the new ASD during the period that the person was a member of the staff of the old ASD.</p>

          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-106">
            <num>106</num>
            <heading>Continuation of existing staffing procedures</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-106__subclause-1">
              <num>1</num>
              <content>
                <p>The staffing procedures of the old ASD that were in effect immediately before <date date="2018-07-01">1 July 2018</date> continue to apply on and after that date in relation to:</p>
              </content>
            </hcontainer>

              <num>a</num>
              <content>
                <p>processes begun before, but not completed by, that date; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-106__para-b">

                <p>things done by, for or in relation to the old ASD or an employee of the old ASD before that date.</p>
              </content>
            </paragraph>

                <p>The rules may prescribe details relating to how the staffing procedures of the old ASD will continue to apply under subitem (1).</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-106__subclause-3">
              <num>3</num>
              <content>
                <p>(3)	Subitem (1) and any rules made under subitem (2) have effect despite the <i>Public Service Act 1999</i>.</p>

          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-107">
            <num>107</num>
            <heading>Continuation of existing inquiries under the Inspector-General of Intelligence and Security Act 1986</heading>
            <content>
              <p>	If the Inspector-General of Intelligence and Security had begun an inquiry in relation to the old ASD under <i>Inspector</i><i>-</i><i>General of Intelligence and Security Act 1986</i> before 1 July 2018 but had not completed it on that day, then, for the purposes of completing that inquiry:<ref href="#sec-8">section 8</ref> of the </p>
              <p>Note:	This means, for example, that a person who was given a notice under <i>Inspector</i><i>-</i><i>General of Intelligence and Security Act 1986</i> before 1 July 2018 in relation to an inquiry is still required to comply with the notice after that date if the person hasn’t done so.<ref href="#sec-18">section 18</ref> of the </p>
            </content>
            <paragraph eId="schedule-1__clause-107__para-a">
              <num>a</num>
              <content>
                <p>	(a)	the <i>Inspector</i><i>-</i><i>General of Intelligence and Security Act 1986</i>, as in force on the day that the inquiry began, continues in force despite the amendments made by this Schedule; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-107__para-b">
              <num>b</num>
              <content>
                <p>any other Act amended by this Schedule, as in force on the day that the inquiry began, continues in force despite the amendments made by this Schedule.</p>

            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-108">
            <num>108</num>
            <heading>Power to make rules</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-108__subclause-1">
              <num>1</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, make rules prescribing matters:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-108__para-a">
              <num>a</num>
              <content>
                <p>required or permitted by this Act to be prescribed by the rules; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-108__para-b">
              <num>b</num>
              <content>
                <p>necessary or convenient to be prescribed for carrying out or giving effect to this Act.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-108__subclause-2">
              <num>2</num>
              <content>
                <p>Without limiting subitem (1), the rules may prescribe other matters of a transitional nature in relation to the transfer of persons who were employees of the old ASD before <date date="2018-07-01">1 July 2018</date>.</p>

                <p>To avoid doubt, the rules may not do the following:</p>
