          <p>		This Act is the <i>Communications Legislation Amendment (Online Content Services and Other Measures) Act 201</i><i>8</i>.</p>

        <heading>Commencement</heading>
        <subsection eId="sec-2__subsec-1">
          <num>1</num>
          <content>
            <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

          <p>Legislation that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.</p>

              <p><b><i>online content service provider </i></b>has the same meaning as in Schedule 8.</p>

              <p>(3AB)	The Parliament also intends that gambling promotional content provided on online content services be regulated in a manner that:</p>

                <p>enables public interest considerations in relation to gambling promotional content to be addressed in a way that does not impose unnecessary financial and administrative burdens on the providers of online content services; and</p>

              <content>
                <p>will readily accommodate technological change; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-7__para-c">

                <p>encourages the provision of online content services to the Australian community; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-7__para-d">
              <num>d</num>
              <content>
                <p>encourages the development of technologies relating to online content services.</p>

              <p>Explanatory matter</p>
              <p>to ensure that, if live coverage of a sporting event is, or is to be, broadcast on a broadcasting service provided by the licensee or provider, explanatory matter that relates to the following is provided by the licensee or provider in a manner specified in the standard:</p>
              <p>Record-keeping</p>
              <p>to ensure that, if live coverage of a sporting event is, or is to be, broadcast on a broadcasting service provided by the licensee or provider, the licensee or provider will:</p>
              <p>Note:	See also subsection 33(3A) of the <i>Acts Interpretation Act 1901</i>.</p>
              <p>Accidental or incidental broadcast of gambling promotional content</p>
              <p>Live coverage of a sporting event</p>
              <p>any matter broadcast on the service during the break is taken to be live coverage of the sporting event.</p>
              <p>Gambling promotional content broadcast in conjunction with live coverage of a sporting event</p>
              <p>Administrative decisions</p>
              <p>This section does not limit <ref href="#sec-125">section 125</ref></p>
              <p>Implied freedom of political communication</p>
              <p>have no effect to the extent (if any) that their operation would infringe any constitutional doctrine of implied freedom of political communication.</p>
              <p>Acquisition of property</p>
              <p>have no effect to the extent (if any) to which their operation would result in an acquisition of property (within the meaning of paragraph 51(xxxi) of the Constitution) from a person otherwise than on just terms (within the meaning of that paragraph).</p>
              <p>Sporting event</p>
              <p>Scheduled start of a sporting event</p>
              <p>Conclusion of a sporting event</p>
              <p>Definitions</p>
              <p><b><i>commentator betting odds promotion </i></b>means gambling promotional content to the extent to which it consists of the provision of betting odds (however described) by a commentator.</p>
              <p><b><i>conclusion</i></b>, in relation to a sporting event, has a meaning affected by subsection (24).</p>
              <p><b><i>coverage</i></b> has the same meaning as in Schedule 8.</p>
              <p><b><i>gambling promotional content</i></b> means:</p>
              <p>that relates to a gambling service.</p>
              <p><b><i>gambling service</i></b> has the same meaning as in Schedule 8.</p>
              <p><b><i>gambling service provider</i></b> means a person who provides a gambling service.</p>
              <p><b><i>in conjunction with</i></b>, when used in relation to<b><i> </i></b>live coverage of a sporting event, has the meaning given by subsections (11) to (14).</p>
              <p><b><i>live</i></b>, in relation to coverage of a sporting event, has the same meaning as in Schedule 8.</p>
              <p><b><i>representative venue</i></b><b><i>-</i></b><b><i>based promotion </i></b>means gambling promotional content to the extent to which it consists of:</p>
              <p>where those visual images, or that speech, as the case may be, gives the impression that the representative is at, or around, the venue of a sporting event.</p>
              <p><b><i>scheduled start</i></b>, in relation to a sporting event, has a meaning affected by subsection (23).</p>
              <p><b><i>sporting event</i></b> has a meaning affected by subsections (20), (21) and (22).</p>

            <hcontainer name="subclause" eId="schedule-1__clause-125A__subclause-1">
              <num>1</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, give the ACMA a direction to:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-125A__para-a">
              <num>a</num>
              <content>
                <p>determine a gambling promotion program standard that complies with the requirements specified in the direction; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-125A__para-b">
              <num>b</num>
              <content>
                <p>do so within a period specified in the direction.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-125A__subclause-2">
              <num>2</num>
              <content>
                <p>The ACMA must comply with a direction under subsection (1).</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-125A__subclause-3">
              <num>3</num>
              <content>
                <p>The ACMA must not determine a gambling promotion program standard unless it does so in accordance with a direction under subsection (1).</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-125A__subclause-4">
              <num>4</num>
              <content>
                <p>The ACMA may, by legislative instrument, determine a standard, to be known as a gambling promotion program standard, prescribing matters required or permitted by this Act to be prescribed by a gambling promotion program standard.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-125A__subclause-5">
              <num>5</num>
              <content>
                <p>A gambling promotion program standard may make provision for or in relation to prohibiting or regulating the broadcast of gambling promotional content:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-125A__para-a">
              <num>a</num>
              <content>
                <p>on broadcasting services provided by any or all of the following:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-125A__para-i">
              <num>i</num>
              <content>
                <p>commercial television broadcasting licensees;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-125A__para-ii">
              <num>ii</num>
              <content>
                <p>commercial radio broadcasting licensees;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-125A__para-iii">
              <num>iii</num>
              <content>
                <p>subscription television broadcasting licensees;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-125A__para-iv">
              <num>iv</num>
              <content>
                <p>providers of subscription radio narrowcasting services;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-125A__para-v">
              <num>v</num>
              <content>
                <p>providers of subscription television narrowcasting services; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-125A__para-b">
              <num>b</num>
              <content>
                <p>in conjunction with live coverage of a sporting event.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-125A__subclause-6">
              <num>6</num>
              <content>
                <p>A gambling promotion program standard may make provision for or in relation to requiring any or all of the following:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-125A__para-a">
              <num>a</num>
              <content>
                <p>commercial television broadcasting licensees;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-125A__para-b">
              <num>b</num>
              <content>
                <p>commercial radio broadcasting licensees;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-125A__para-c">
              <num>c</num>
              <content>
                <p>subscription television broadcasting licensees;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-125A__para-d">
              <num>d</num>
              <content>
                <p>providers of subscription radio narrowcasting services;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-125A__para-e">
              <num>e</num>
              <content>
                <p>providers of subscription television narrowcasting services;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-125A__para-f">
              <num>f</num>
              <content>
                <p>whether a gambling promotion program standard made for the purposes of subsection (5) applies in relation to that live coverage;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-125A__para-g">
              <num>g</num>
              <content>
                <p>if so, how the gambling promotion program standard applies in relation to that live coverage.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-125A__subclause-7">
              <num>7</num>
              <content>
                <p>A gambling promotion program standard may make provision for or in relation to requiring any or all of the following:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-125A__para-a">
              <num>a</num>
              <content>
                <p>commercial television broadcasting licensees;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-125A__para-b">
              <num>b</num>
              <content>
                <p>commercial radio broadcasting licensees;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-125A__para-c">
              <num>c</num>
              <content>
                <p>subscription television broadcasting licensees;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-125A__para-d">
              <num>d</num>
              <content>
                <p>providers of subscription radio narrowcasting services;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-125A__para-e">
              <num>e</num>
              <content>
                <p>providers of subscription television narrowcasting services;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-125A__para-f">
              <num>f</num>
              <content>
                <p>make records that:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-125A__para-i">
              <num>i</num>
              <content>
                <p>are of a kind or kinds specified in the standard; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-125A__para-ii">
              <num>ii</num>
              <content>
                <p>are sufficient to enable compliance by the licensee or provider with a gambling promotion program standard made for the purposes of subsection (5) or (6) to be readily ascertained; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-125A__para-g">
              <num>g</num>
              <content>
                <p>retain those records for the period ascertained in accordance with the first-mentioned standard; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-125A__para-h">
              <num>h</num>
              <content>
                <p>make those retained records available to the ACMA on request.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-125A__subclause-8">
              <num>8</num>
              <content>
                <p>For the purposes of subparagraph (7)(f)(i), each of the following is an example of a kind of record:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-125A__para-a">
              <num>a</num>
              <content>
                <p>a written record;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-125A__para-b">
              <num>b</num>
              <content>
                <p>an audio record;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-125A__para-c">
              <num>c</num>
              <content>
                <p>an audio-visual record.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-125A__subclause-9">
              <num>9</num>
              <content>
                <p>A gambling promotion program standard does not apply in relation to the broadcasting of gambling promotional content on a broadcasting service if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-125A__para-a">
              <num>a</num>
              <content>
                <p>the gambling promotional content is broadcast as an accidental or incidental accompaniment to the broadcasting of other matter; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-125A__para-b">
              <num>b</num>
              <content>
                <p>the licensee or provider of the broadcasting service does not receive any direct or indirect benefit (whether financial or not) for broadcasting the gambling promotional content (in addition to any direct or indirect benefit that the licensee or provider receives for broadcasting the other matter).</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-125A__subclause-10">
              <num>10</num>
              <content>
                <p>For the purposes of this section, if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-125A__para-a">
              <num>a</num>
              <content>
                <p>live coverage of a sporting event is broadcast on a broadcasting service; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-125A__para-b">
              <num>b</num>
              <content>
                <p>there is an unscheduled break in the sporting event;</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-125A__subclause-11">
              <num>11</num>
              <content>
                <p>For the purposes of this section, gambling promotional content (other than a commentator betting odds promotion or a representative venue-based promotion) is broadcast on a broadcasting service in conjunction with live coverage of a sporting event if, and only if, the content is broadcast on the service during the period:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-125A__para-a">
              <num>a</num>
              <content>
                <p>beginning 5 minutes before the scheduled start of the sporting event; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-125A__para-b">
              <num>b</num>
              <content>
                <p>ending 5 minutes after the conclusion of the sporting event.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-125A__subclause-12">
              <num>12</num>
              <content>
                <p>However, if coverage of the sporting event is delayed, this section has effect as if there were a corresponding delay to the period mentioned in subsection (11).</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-125A__subclause-13">
              <num>13</num>
              <content>
                <p>For the purposes of this section, gambling promotional content that consists of a commentator betting odds promotion or a representative venue-based promotion is broadcast on a broadcasting service in conjunction with live coverage of a sporting event if, and only if, the promotion is broadcast on the service during the period:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-125A__para-a">
              <num>a</num>
              <content>
                <p>beginning 30 minutes before the scheduled start of the sporting event; and</p>
              </content>
            </paragraph>

                <p>	(1)	For the purposes of this Schedule, <b><i>exempt online simulcast service</i></b> means a service, or a part of a service, that is provided to end-users using an internet carriage service, and that:</p>

              <num>a</num>
              <content>
                <p>does no more than provide a stream of content that is identical to the stream of programs transmitted on:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-4__para-i">
              <num>i</num>
              <content>
                <p>a commercial television broadcasting service provided under a commercial television broadcasting licence; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-4__para-ii">
              <num>ii</num>
              <content>
                <p>a commercial radio broadcasting service provided under a commercial radio broadcasting licence; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-4__para-iii">
              <num>iii</num>
              <content>
                <p>a subscription television broadcasting service provided under a subscription television broadcasting licence; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-4__para-iv">
              <num>iv</num>
              <content>
                <p>a subscription radio narrowcasting service; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-4__para-v">
              <num>v</num>
              <content>
                <p>a subscription television narrowcasting service; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-4__para-vi">
              <num>vi</num>
              <content>
                <p>a broadcasting service provided by the Special Broadcasting Service Corporation; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-4__para-b">
              <num>b</num>
              <content>
                <p>provides that stream of content simultaneously, or almost simultaneously, with the transmission of that stream of programs.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-4__subclause-2">
              <num>2</num>
              <content>
                <p>	(2)	For the purposes of subclause (1),<b><i> </i></b>in determining whether a stream of content is identical to a stream of programs, disregard any differences that are attributable to the technical characteristics of the provision or transmission (for example, video resolution or sound quality).</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-4__subclause-3">
              <num>3</num>
              <content>
                <p>For the purposes of subclause (1), in determining whether a stream of content is identical to a stream of programs, disregard the presence or absence of:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-4__para-a">
              <num>a</num>
              <content>
                <p>a watermark-type logo; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-4__para-b">
              <num>b</num>
              <content>
                <p>a watermark-type insignia;</p>
              </content>
            </paragraph>
            <content>
              <p>that is not gambling promotional content.</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-2__clause-5">
            <num>5</num>
            <heading>Geographical link to Australia</heading>
            <hcontainer name="subclause" eId="schedule-2__clause-5__subclause-1">
              <num>1</num>
              <content>
                <p>	(1)	For the purposes of this Schedule, a service has a <b><i>geographical link to Australia</i></b> if an ordinary reasonable person would conclude that:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-5__para-a">
              <num>a</num>
              <content>
                <p>the service is targeted at individuals who are physically present in Australia; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-5__para-b">
              <num>b</num>
              <content>
                <p>any of the content provided on the service is likely to appeal to the public, or a section of the public, in Australia.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-5__subclause-2">
              <num>2</num>
              <content>
                <p>	(2)	For the purposes of this clause, content is <b><i>provided on</i></b> a service if the content is:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-5__para-a">
              <num>a</num>
              <content>
                <p>delivered by the service; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-5__para-b">
              <num>b</num>
              <content>
                <p>accessible to end-users using the service.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-2__clause-6">
            <num>6</num>
            <heading>Online content service provider</heading>
            <hcontainer name="subclause" eId="schedule-2__clause-6__subclause-1">
              <num>1</num>
              <content>
                <p>For the purposes of this Schedule, a person does not provide an online content service merely because the person supplies an internet carriage service that enables content to be delivered or accessed.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-6__subclause-2">
              <num>2</num>
              <content>
                <p>For the purposes of this Schedule, a person does not provide an online content service merely because the person provides a billing service, or a fee collection service, in relation to an online content service.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-2__clause-7">
            <num>7</num>
            <heading>When content is provided on an online content service</heading>
            <hcontainer name="subclause" eId="schedule-2__clause-7__subclause-1">
              <num>1</num>
              <content>
                <p>	(1)	For the purposes of this Schedule, content is <b><i>provided on</i></b> an online content service if the content is:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-7__para-a">
              <num>a</num>
              <content>
                <p>delivered by the online content service; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-7__para-b">
              <num>b</num>
              <content>
                <p>accessible to end-users using the online content service.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-7__subclause-2">
              <num>2</num>
              <content>
                <p>	(2)	For the purposes of this Schedule, content is <b><i>provided on</i></b> an online content service to an end-user if the content is:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-7__para-a">
              <num>a</num>
              <content>
                <p>delivered to the end-user by the online content service; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-7__para-b">
              <num>b</num>
              <content>
                <p>accessible to the end-user using the online content service.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-2__clause-8">
            <num>8</num>
            <heading>When a service is provided to the public etc.</heading>
            <hcontainer name="subclause" eId="schedule-2__clause-8__subclause-1">
              <num>1</num>
              <content>
                <p>	(1)	For the purposes of this Schedule, a service is <b><i>provided to the public</i></b> if, and only if, the service is provided to at least one person outside the immediate circle of the person who provides the service.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-8__subclause-2">
              <num>2</num>
              <content>
                <p>For the purposes of this Schedule, a service that is provided to the public is taken to be different from a service that is not provided to the public, even if the content provided on the services is identical.</p>

            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-2__clause-9">
            <num>9</num>
            <heading>Extended meaning of using</heading>
            <content>
              <p>		A reference in this Schedule to <b><i>using</i></b> a thing is a reference to using the thing either:</p>
            </content>
            <paragraph eId="schedule-2__clause-9__para-a">
              <num>a</num>
              <content>
                <p>in isolation; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-9__para-b">
              <num>b</num>
              <content>
                <p>in conjunction with one or more other things.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-2__clause-10">
            <num>10</num>
            <heading>Extra-territorial application</heading>
            <content>
              <p>This Schedule extends to acts, omissions, matters and things outside Australia.</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-2__clause-11">
            <num>11</num>
            <heading>Online content service provider rules</heading>
            <content>
              <p>		The ACMA may, by legislative instrument, make rules (the <b><i>online content service provider rules</i></b>) prescribing matters required or permitted by this Act to be prescribed by the online content service provider rules.</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-2__clause-12">
            <num>12</num>
            <heading>Administrative decisions</heading>
            <content>
              <p>The online content service provider rules may make provision for or in relation to a particular matter by empowering the ACMA to make decisions of an administrative character.</p>

                <p>whether online content service provider rules made for the purposes of subclause (1) apply in relation to that live coverage;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-13__para-d">
              <num>d</num>

                <p>if so, how those rules apply in relation to that live coverage.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-13__subclause-3">
              <num>3</num>
              <content>
                <p>The online content service provider rules may make provision for or in relation to requiring online content service providers to ensure that, if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-13__para-a">

                <p>the provider provides an online content service; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-13__para-b">

                <p>content that consists of live coverage of a sporting event is, or is to be, provided on the service;</p>

            </paragraph>

            <paragraph eId="schedule-2__clause-13__para-i">
              <num>i</num>

                <p>are of a kind or kinds specified in those rules; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-13__para-ii">
              <num>ii</num>
              <content>
                <p>are sufficient to enable compliance by the provider with online content service provider rules made for the purposes of subclause (1) or (2) to be readily ascertained; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-13__para-d">
              <num>d</num>
              <content>
                <p>retain those records for the period ascertained in accordance with the first-mentioned rules; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-13__para-e">
              <num>e</num>
              <content>
                <p>make those retained records available to the ACMA on request.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-13__subclause-4">
              <num>4</num>
              <content>
                <p>For the purposes of subparagraph (3)(c)(i), each of the following is an example of a kind of record:</p>
              </content>

            <heading>Accidental or incidental provision of gambling promotional content</heading>

              <p>The online content service provider rules do not apply in relation to the provision of gambling promotional content on an online content service if:</p>

            <paragraph eId="schedule-2__clause-14__para-a">
              <num>a</num>
              <content>
                <p>the gambling promotional content is provided as an accidental or incidental accompaniment to the provision of other content; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-14__para-b">
              <num>b</num>
              <content>
                <p>the provider of the online content service does not receive any direct or indirect benefit (whether financial or not) for providing the gambling promotional content (in addition to any direct or indirect benefit that the provider receives for providing the other content).</p>

                <p>the likely impact of a failure to make the determination on the quantity and quality of content provided on the online content service; and</p>
              </content>
            </paragraph>

                <p>the likely impact of a failure to make the determination on the quantity and quality of the content provided on the online content services provided by the provider; and</p>

                <p>For the purposes of this clause, in determining whether an online content service is a small online content service, the ACMA must have regard to:</p>

                <p>if the service has accounts for end-users—the number of accounts that are held by end-users who are ordinarily resident in Australia; and</p>
              </content>
            </paragraph>

              <content>
                <p>if the service does not have accounts for end-users—the number of end-users who are ordinarily resident in Australia; and</p>
              </content>
            </paragraph>

                <p>such other matters (if any) as the ACMA considers relevant.</p>
              </content>
            </paragraph>

            <heading>When a part of an online content service is taken to be an online content service in its own right</heading>

                <p>	(1)	For the purposes of the application of this Schedule to a sporting event, if content that consists of live coverage of the sporting event is, or is to be, provided on a distinct part of an online content service (the <b><i>overall online content service</i></b>):</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-17__para-a">
              <num>a</num>
              <content>
                <p>that part is taken to be an online content service in its own right; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-17__para-b">
              <num>b</num>
              <content>
                <p>that part is taken not to be included in the overall online content service.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-17__subclause-2">
              <num>2</num>
              <content>
                <p>For the purposes of subclause (1), it is immaterial whether:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-17__para-a">
              <num>a</num>
              <content>
                <p>gambling promotional content; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-17__para-b">

              <p>		For the purposes of this Schedule, <b><i>gambling service</i></b> means:</p>
            </content>

              <num>a</num>
              <content>
                <p>a service for the placing, making, receiving or acceptance of bets; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-18__para-b">
              <num>b</num>
              <content>
                <p>a service the sole or dominant purpose of which is to introduce individuals who wish to make or place bets to individuals who are willing to receive or accept those bets; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-18__para-c">
              <num>c</num>
              <content>
                <p>a service for the conduct of a lottery; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-18__para-d">
              <num>d</num>
              <content>
                <p>a service for the supply of lottery tickets; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-18__para-e">
              <num>e</num>
              <content>
                <p>a service for the conduct of a game, where:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-18__para-i">
              <num>i</num>
              <content>
                <p>the game is played for money or anything else of value; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-18__para-ii">
              <num>ii</num>
              <content>
                <p>the game is a game of chance or of mixed chance and skill; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-18__para-iii">
              <num>iii</num>
              <content>
                <p>a customer of the service gives or agrees to give consideration to play or enter the game; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-18__para-f">
              <num>f</num>
              <content>
                <p>a gambling service (within the ordinary meaning of that expression) that is not covered by any of the above paragraphs.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-2__clause-19">
            <num>19</num>
            <heading>Sporting event</heading>
            <hcontainer name="subclause" eId="schedule-2__clause-19__subclause-1">
              <num>1</num>
              <content>
                <p>	(1)	Each of the following is taken to be a <b><i>sporting event</i></b> for the purposes of this Schedule:</p>

            <paragraph eId="schedule-2__clause-19__para-a">
              <num>a</num>
              <content>
                <p>the Summer Olympic Games;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-19__para-b">
              <num>b</num>
              <content>
                <p>the Winter Olympic Games;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-19__para-c">
              <num>c</num>
              <content>
                <p>the Commonwealth Games;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-19__para-d">
              <num>d</num>
              <content>
                <p>any similar games.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-19__subclause-2">
              <num>2</num>
              <content>
                <p>	(2)	The online content service provider rules may provide that a specified thing is taken to be a <b><i>sporting event </i></b>for the purposes of this Schedule.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-19__subclause-3">
              <num>3</num>
              <content>
                <p>	(3)	The online content service provider rules may provide that a specified thing is taken not to be a <b><i>sporting event </i></b>for the purposes of this Schedule.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-19__subclause-4">
              <num>4</num>
              <content>
                <p>The following are examples of things that may be specified in the online content service provider rules made for the purposes of subclause (2) or (3):</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-19__para-a">
              <num>a</num>
              <content>
                <p>a match;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-19__para-b">
              <num>b</num>
              <content>
                <p>a series of matches;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-19__para-c">
              <num>c</num>
              <content>
                <p>a race;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-19__para-d">
              <num>d</num>
              <content>
                <p>a series of races;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-19__para-e">
              <num>e</num>
              <content>
                <p>a stage;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-19__para-f">
              <num>f</num>
              <content>
                <p>a time trial;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-19__para-g">
              <num>g</num>
              <content>
                <p>a qualification session;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-19__para-h">
              <num>h</num>
              <content>
                <p>a tournament;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-19__para-i">
              <num>i</num>
              <content>
                <p>a round.</p>
              </content>
            </paragraph>

                <p>	(5)	For the purposes of this clause, <b><i>thing </i></b>includes a series of things.</p>

            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-2__clause-20">
            <num>20</num>
            <heading>Live coverage of a sporting event</heading>
            <content>
              <p>For the purposes of this Schedule, if:</p>
              <p>any content provided on the service during the break is taken to be content that consists of live coverage of the sporting event.</p>
            </content>
            <paragraph eId="schedule-2__clause-20__para-a">
              <num>a</num>
              <content>
                <p>content that consists of live coverage of a sporting event is provided on an online content service; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-20__para-b">
              <num>b</num>
              <content>
                <p>there is an unscheduled break in the sporting event;</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-2__clause-21">
            <num>21</num>
            <heading>Gambling promotional content provided in conjunction with live coverage of a sporting event</heading>
            <hcontainer name="subclause" eId="schedule-2__clause-21__subclause-1">
              <num>1</num>
              <content>
                <p>For the purposes of this Schedule, gambling promotional content (other than a commentator betting odds promotion or a representative venue-based promotion) is provided on an online content service in conjunction with live coverage of a sporting event if, and only if, the content is provided on the service during the period:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-21__para-a">
              <num>a</num>
              <content>
                <p>beginning 5 minutes before the scheduled start of the sporting event; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-21__para-b">
              <num>b</num>
              <content>
                <p>ending 5 minutes after the conclusion of the sporting event.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-21__subclause-2">
              <num>2</num>
              <content>
                <p>However, if coverage of the sporting event is delayed, this clause has effect as if there were a corresponding delay to the period mentioned in subclause (1).</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-21__subclause-3">
              <num>3</num>
              <content>
                <p>For the purposes of this Schedule, gambling promotional content that consists of a commentator betting odds promotion or a representative venue-based promotion is provided on an online content service in conjunction with live coverage of a sporting event if, and only if, the promotion is provided on the service during the period:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-21__para-a">
              <num>a</num>
              <content>
                <p>beginning 30 minutes before the scheduled start of the sporting event; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-21__para-b">
              <num>b</num>
              <content>
                <p>ending 30 minutes after the conclusion of the sporting event.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-21__subclause-4">
              <num>4</num>
              <content>
                <p>However, if coverage of the sporting event is delayed, this clause has effect as if there were a corresponding delay to the period mentioned in subclause (3).</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-2__clause-22">
            <num>22</num>
            <heading>Scheduled start of a sporting event</heading>
            <content>
              <p>		The online content service provider rules may provide that, for the purposes of the application of this Schedule to a specified sporting event, <b><i>scheduled start</i></b> has the meaning given by the online content service provider rules.</p>
              <p>Note:	For specification by class, see subsection 13(3) of the <i>Legislation Act 2003</i>.</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-2__clause-23">
            <num>23</num>
            <heading>Conclusion of a sporting event</heading>
            <content>
              <p>		The online content service provider rules may provide that, for the purposes of the application of this Schedule to a specified sporting event, <b><i>conclusion</i></b> has the meaning given by the online content service provider rules.</p>

            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-2__clause-24">
            <num>24</num>
            <heading>Complaints to ACMA—online content service provider rules</heading>
            <hcontainer name="subclause" eId="schedule-2__clause-24__subclause-1">
              <num>1</num>
              <content>
                <p>If a person has reason to believe that an online content service provider has contravened the online content service provider rules, the person may make a complaint to the ACMA about the matter.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-24__subclause-2">
              <num>2</num>
              <content>
                <p>The ACMA may conduct an investigation into the complaint if it thinks that it is desirable to do so, but is not required to conduct an investigation.</p>
              </content>
            </hcontainer>
            <content>
              <p>Note:	One of the ACMA’s functions is to monitor compliance with the online content service provider rules.</p>
            </content>
          </hcontainer>

            <heading>Compliance with the online content service provider rules</heading>

                <p>An online content service provider must not contravene the online content service provider rules.</p>

                <p>The ACMA may give the provider a written direction requiring the provider to take specified action directed towards ensuring that the provider does not contravene the online content service provider rules, or is unlikely to contravene the online content service provider rules, in the future.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-26__subclause-3">
              <num>3</num>
              <content>
                <p>The following are examples of the kinds of direction that may be given to an online content service provider under subclause (2):</p>
              </content>
            </hcontainer>

              <num>a</num>
              <content>
                <p>a direction that the provider implement effective administrative systems for monitoring compliance with the online content service provider rules;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-26__para-b">
              <num>b</num>
              <content>
                <p>a direction that the provider implement a system designed to give the provider’s employees, agents and contractors a reasonable knowledge and understanding of the requirements of the online content service provider rules, in so far as those requirements affect the employees, agents or contractors concerned.</p>

            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-26__subclause-4">
              <num>4</num>
              <content>
                <p>An online content service provider must not contravene a direction under subclause (2).</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-26__subclause-5">
              <num>5</num>
              <content>
                <p>Subclause (4) is a civil penalty provision.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-26__subclause-6">

            <heading>Minister may direct the ACMA about the exercise of its powers</heading>

                <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, give the ACMA a direction about the exercise of the powers conferred on the ACMA by this Schedule (other than Part 4 or 5).</p>
