          <p>		This Act is the <i>Interstate Road Transport </i><i>Legislation</i><i> (Repeal)</i><i> Act 2018</i>.</p>

        <subsection eId="sec-2__subsec-1">
          <num>1</num>

            <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

                <p>A Registration Authority must not register a motor vehicle or trailer if the registration would come into force on or after <date date="2018-07-01">1 July 2018</date>.</p>

                <p>If the registration of a motor vehicle or trailer would come into force on or after <date date="2018-07-01">1 July 2018</date>, the registration is valid until it is cancelled.</p>

            <heading>At the end of subsection 9(4)</heading>

                <p>an arrangement that is in force under that section immediately before this item commences is taken, after that commencement, to continue in force in relation to the exercise after that commencement of functions under that Act as a result of this Part; and</p>

                <p>subsection 6(5) of that Act (amounts received by an officer or authority of a State) continues to apply in relation to amounts received after this item commences as a result of this Part.</p>

            <heading>Cancellation of registration</heading>
            <content>
              <p>If, but for the repeal of the <i>Interstate Road Transport Act 1985</i> by this Schedule, the registration of a motor vehicle or trailer would expire after this item commences, the registration is taken to be cancelled immediately before that commencement.</p>

            <heading>Refund of charges etc.</heading>

              <p>Refund of charge on cancellation or surrender of registration</p>

                <p>(1)	Despite the repeal by this Schedule of <i>Interstate Road Transport Act 1985</i>, that section continues to apply, after this item commences, in relation to the cancellation or surrender of the registration of a motor vehicle or trailer if:<ref href="#sec-18">section 18</ref> of the </p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-8__para-a">
              <num>a</num>
              <content>
                <p>the cancellation or surrender occurs before that commencement; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-8__para-b">
              <num>b</num>
              <content>
                <p>a refund is not given before that commencement in relation to the cancellation or surrender.</p>
              </content>
            </paragraph>

              <content>
                <p>(2)	Despite the repeal by this Schedule of <i>Interstate Road Transport Act 1985</i>, that section continues to apply, after this item commences, in relation to the use of a registered motor vehicle or trailer in accordance with paragraphs 19(1)(a) and (b) of that Act if:<ref href="#sec-19">section 19</ref> of the </p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-8__para-a">
              <num>a</num>
              <content>
                <p>that use occurs before that commencement; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-8__para-b">
              <num>b</num>
              <content>
                <p>a refund is not given before that commencement in relation to that use.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-8__subclause-3">
              <num>3</num>
              <content>
                <p>(3)	Despite the repeal by this Schedule of subsection 19(3) of the <i>Interstate Road Transport Act 1985</i>, that subsection continues to apply, after this item commences, in relation to a proceeding commenced before or after this item commences.</p>

            <num>9</num>
            <heading>Arrangements relating to the Interstate Road Transport Account and COAG Reform Fund</heading>
            <hcontainer name="subclause" eId="schedule-2__clause-9__subclause-1">
              <num>1</num>
              <content>
                <p>(1)	Despite the repeal by this Schedule of <i>Interstate Road Transport Act 1985</i> and paragraph 7(1)(c) of the <i>COAG Reform Fund Act 2008</i>, those provisions and any related instruments continue to apply, after this item commences, in accordance with this item.<ref href="#part-I">Part I</ref>V of the </p>
              </content>
            </hcontainer>
            <content>
              <p>Crediting amounts to special accounts</p>
              <p>Debiting and crediting arrangements after repeal</p>
              <p>Interpretation</p>
              <p><b><i>related instruments</i></b> means any of the following (as in force immediately before this item commences):</p>
            </content>

              <num>2</num>
              <content>
                <p>(2)	An amount must be credited to the Interstate Road Transport Account in accordance with <i>Interstate Road Transport Act 1985</i> until 20 October 2019.<ref href="#part-I">Part I</ref>V of the </p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-9__subclause-3">
              <num>3</num>
              <content>
                <p>If, but for the repeal of that Part by this Schedule, an amount would have been credited to that Account between <date date="2019-10-21">21 October 2019</date> and <date date="2019-10-31">31 October 2019</date>, the amount is to be credited to the COAG Reform Fund:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-9__para-a">
              <num>a</num>
              <content>
                <p>for the purposes of making grants of financial assistance to a State, the Australian Capital Territory or the Northern Territory for expenditure by the State or Territory on the maintenance and upkeep of roads in the State or Territory that are used by registered motor vehicles or trailers; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-9__para-b">
              <num>b</num>
              <content>
                <p>	(b)	in accordance with a determination under subsection 23(1) of the <i>Interstate Road Transport Act 1985</i> as if the amount were standing to the credit of the Interstate Road Transport Account on the 20th day of the month.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-9__subclause-4">
              <num>4</num>
              <content>
                <p>(4)	Section 23 of the <i>Interstate Road Transport Act 1985</i> and paragraph 7(1)(c) of the <i>COAG Reform Fund Act 2008</i>, and any related instruments, continue to apply, after this item commences, to:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-9__para-a">
              <num>a</num>
              <content>
                <p>any amounts credited to the Interstate Road Transport Account between <date date="2019-06-21">21 June 2019</date> and <date date="2019-10-20">20 October 2019</date>; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-9__para-b">
              <num>b</num>
              <content>
                <p>	(b)	any amounts credited to the COAG Reform Fund under the <i>Interstate Road Transport Act 1985</i> between 21 June 2019 and 31 October 2019; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-9__para-c">
              <num>c</num>
              <content>
                <p>any amounts credited to the COAG Reform Fund under subitem (3).</p>
              </content>
            </paragraph>

                <p>(5)	For the purposes of this item, a reference in <i>Interstate Road Transport Act 1985</i> to an amount credited to the COAG Reform Fund under subsection 23(1) of that Act is taken to include a reference to an amount credited to that Fund under subitem (3).<ref href="#sec-23">section 23</ref> of the </p>

              <num>b</num>
              <content>
                <p>any regulations made under <ref href="#sec-56">section 56</ref> of that Act for the purposes of <ref href="#sec-23">section 23</ref> of that Act.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-2__clause-10">
            <num>10</num>
            <heading>Delegation</heading>
            <content>
              <p>Despite the repeal of <i>Interstate Road Transport Act 1985 </i>by this Schedule:<ref href="#sec-50">section 50</ref> of the </p>
            </content>
            <paragraph eId="schedule-2__clause-10__para-a">
              <num>a</num>
              <content>
                <p>any instruments that are in force under that section immediately before this item commences are taken, after that commencement, to continue in force in relation to the exercise after that commencement of powers as a result of this Part; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-10__para-b">
              <num>b</num>
              <content>
                <p>subsections 50(2) and (3) of that Act continue to apply in relation to those instruments.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-2__clause-11">
            <num>11</num>
            <heading>Reconsideration and review of certain decisions</heading>
            <content>
              <p>Despite the repeal of <i>Interstate Road Transport Act 1985 </i>by this Schedule, the section continues to apply, after this item commences, in relation to a decision made before this item commences.<ref href="#sec-51">section 51</ref> of the </p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-2__clause-12">
            <num>12</num>
            <heading>Transitional rules</heading>
            <hcontainer name="subclause" eId="schedule-2__clause-12__subclause-1">
              <num>1</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, make rules prescribing matters of a transitional nature (including prescribing any saving or application provisions) relating to the amendments and repeals made by this Act.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-12__subclause-2">
              <num>2</num>
              <content>
                <p>However, to avoid doubt, the rules may not do the following:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-12__para-a">
              <num>a</num>
              <content>
                <p>create an offence or civil penalty;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-12__para-b">
              <num>b</num>
              <content>
                <p>provide powers of:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-12__para-i">
              <num>i</num>
              <content>
                <p>arrest or detention; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-12__para-ii">
              <num>ii</num>
              <content>
                <p>entry, search or seizure;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-12__para-c">
              <num>c</num>
              <content>
                <p>impose a tax;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-12__para-d">
              <num>d</num>
              <content>
                <p>set an amount to be appropriated from the Consolidated Revenue Fund under an appropriation in this Act;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-12__para-e">
              <num>e</num>
              <content>
                <p>directly amend the text of this Act.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-12__subclause-3">
              <num>3</num>
              <content>
                <p>This Act (other than subitem (2)) does not limit the rules that may be made for the purposes of subitem (1).</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-12__subclause-4">
              <num>4</num>
              <content>
                <p>(4)	Rules made for the purposes of this item that are registered under the <i>Legislation Act 2003</i> before 1 July 2020:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-12__para-a">
              <num>a</num>
              <content>
                <p>may be expressed to take effect from a date before the rules are registered; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-12__para-b">
              <num>b</num>
              <content>
                <p>apply despite subsection 12(2) (retrospective application of legislative instruments) of that Act.</p>
              </content>
            </paragraph>
