          <p>		This Act is the <i>Criminal Code Amendment (Impersonating a Commonwealth Body) </i><i>Act 201</i><i>8</i>.</p>

        <heading>Commencement</heading>
        <subsection eId="sec-2__subsec-1">
          <num>1</num>
          <content>
            <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

          <p>Legislation that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.</p>

              <p>Note:	Part 7 of the Regulatory Powers Act creates a framework for using injunctions to enforce provisions.</p>

              <heading>False representations in relation to a Commonwealth body</heading>

                <content>
                  <p>A person commits an offence if:</p>
                </content>
              </hcontainer>
              <paragraph eId="schedule-1__clause-2__subclause-150-1__para-a">
                <num>a</num>
                <content>
                  <p>the person engages in conduct; and</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-2__subclause-150-1__para-b">
                <num>b</num>
                <content>
                  <p>the conduct results in, or is reasonably capable of resulting in, a representation that the person:</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-2__subclause-150-1__para-i">
                <num>i</num>
                <content>
                  <p>is a Commonwealth body; or</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-2__subclause-150-1__para-ii">
                <num>ii</num>
                <content>
                  <p>is acting on behalf of, or with <role refersTo="#authority">the authority</role> of, a Commonwealth body; and</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-2__subclause-150-1__para-c">
                <num>c</num>
                <content>
                  <p>the person is not:</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-2__subclause-150-1__para-i">
                <num>i</num>
                <content>
                  <p>the Commonwealth body; or</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-2__subclause-150-1__para-ii">
                <num>ii</num>
                <content>
                  <p>acting on behalf of, or with <role refersTo="#authority">the authority</role> of, the Commonwealth body.</p>
                </content>
              </paragraph>

                <num>2</num>
                <content>
                  <p>A person commits an offence if:</p>
                </content>
              </hcontainer>

                  <p>the person engages in conduct; and</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-2__subclause-150-1__para-b">
                <num>b</num>
                <content>
                  <p>the conduct results in, or is reasonably capable of resulting in, a representation that the person:</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-2__subclause-150-1__para-i">
                <num>i</num>
                <content>
                  <p>is a Commonwealth body; or</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-2__subclause-150-1__para-ii">
                <num>ii</num>
                <content>
                  <p>is acting on behalf of, or with <role refersTo="#authority">the authority</role> of, a Commonwealth body; and</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-2__subclause-150-1__para-c">
                <num>c</num>
                <content>
                  <p>the person engages in the conduct with the intention of:</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-2__subclause-150-1__para-i">
                <num>i</num>
                <content>
                  <p>obtaining a gain; or</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-2__subclause-150-1__para-ii">
                <num>ii</num>
                <content>
                  <p>causing a loss; or</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-2__subclause-150-1__para-iii">
                <num>iii</num>
                <content>
                  <p>influencing the exercise of a public duty or function; and</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-2__subclause-150-1__para-d">
                <num>d</num>
                <content>
                  <p>the person is not:</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-2__subclause-150-1__para-i">
                <num>i</num>
                <content>
                  <p>the Commonwealth body; or</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-2__subclause-150-1__para-ii">
                <num>ii</num>
                <content>
                  <p>acting on behalf of, or with <role refersTo="#authority">the authority</role> of, the Commonwealth body.</p>
                </content>
              </paragraph>

                <num>3</num>
                <content>
                  <p>For the purposes of this section, it is immaterial whether the Commonwealth body exists or is fictitious.</p>
                </content>
              </hcontainer>
              <hcontainer name="subclause" eId="schedule-1__clause-2__subclause-150-1__subclause-4">
                <num>4</num>
                <content>
                  <p>If the Commonwealth body is fictitious, subsection (1) or (2) does not apply unless a person would reasonably believe that the Commonwealth body exists.</p>
                </content>

                <num>5</num>
                <content>
                  <p>	(5)	Without limiting <i>Acts Interpretation Act 1901</i>, this section does not apply to the extent (if any) that it would infringe any constitutional doctrine of implied freedom of political communication.<ref href="#sec-15A">section 15A</ref> of the </p>

                  <p>Section 15.3 (extended geographical jurisdiction—category C) applies to each offence against this section.</p>
                </content>
              </hcontainer>
              <hcontainer name="subclause" eId="schedule-1__clause-2__subclause-150-1__subclause-7">
                <num>7</num>
                <content>
                  <p>In this section:</p>
                </content>
              </hcontainer>
              <content>
                <p><b><i>Commonwealth body</i></b> means:</p>
                <p><b><i>conduct</i></b> does not include conduct engaged in solely for genuine satirical, academic or artistic purposes.</p>
                <p>Subdivision B—Injunctions</p>
              </content>
              <paragraph eId="schedule-1__clause-2__subclause-150-1__para-a">
                <num>a</num>
                <content>
                  <p>a Commonwealth entity; or</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-2__subclause-150-1__para-b">
                <num>b</num>
                <content>
                  <p>	(b)	a Commonwealth company (within the meaning of the <i>Public Governance, Performance and Accountability Act 2013</i>); or</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-2__subclause-150-1__para-c">
                <num>c</num>
                <content>
                  <p>a service, benefit, program or facility for some or all members of the public that is provided by or on behalf of the Commonwealth, whether under a law of the Commonwealth or otherwise.</p>

              <heading>Injunctions</heading>

                  <p>Section 150.1 is enforceable under Part 7 of the Regulatory Powers Act.</p>
                </content>
              </hcontainer>
              <hcontainer name="subclause" eId="schedule-1__clause-2__subclause-150-5__subclause-2">
                <num>2</num>
                <content>
                  <p>For the purposes of Part 7 of the Regulatory Powers Act, any person whose interests have been, or would be, affected by conduct mentioned in subsection 150.1(1) or (2) is an authorised person in relation to <ref href="#sec-150">section 150</ref>.1.</p>
                </content>
              </hcontainer>
              <hcontainer name="subclause" eId="schedule-1__clause-2__subclause-150-5__subclause-3">
                <num>3</num>
                <content>
                  <p>For the purposes of Part 7 of the Regulatory Powers Act, each of the following courts is a relevant court in relation to <ref href="#sec-150">section 150</ref>.1:</p>
                </content>

                <num>a</num>
                <content>
                  <p>the Federal Court of Australia;</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-2__subclause-150-5__para-b">
                <num>b</num>
                <content>
                  <p>the Federal Circuit Court of Australia;</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-2__subclause-150-5__para-c">
                <num>c</num>
                <content>
                  <p>the Supreme Court of a State or Territory;</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-2__subclause-150-5__para-d">
                <num>d</num>
                <content>
                  <p>the District Court (or equivalent) of a State or Territory.</p>
                </content>
              </paragraph>
              <hcontainer name="subclause" eId="schedule-1__clause-2__subclause-150-5__subclause-4">
                <num>4</num>
                <content>
                  <p>Part 7 of the Regulatory Powers Act, as that Part applies in relation to <ref href="#sec-150">section 150</ref>.1, extends to:</p>
                </content>
              </hcontainer>

                <num>a</num>
                <content>
                  <p>every external Territory; and</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-2__subclause-150-5__para-b">
                <num>b</num>
                <content>
                  <p>conduct outside Australia; and</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-2__subclause-150-5__para-c">
                <num>c</num>
                <content>
                  <p>conduct that results in, or is reasonably capable of resulting in, a representation outside Australia; and</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-2__subclause-150-5__para-d">
                <num>d</num>
                <content>
                  <p>conduct that is intended to result in a gain, a loss or influence outside Australia.</p>
