          <p>		This Act is the <i>Health </i><i>Legislation Amendment </i><i>(</i><i>Improved</i><i> Medicare Compliance</i><i> and Other Measures</i><i>) </i><i>Act 201</i><i>8</i>.</p>

            <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

                <p>ascertaining whether the amount paid, purportedly by way of benefit or payment under this Act, in respect of the service, should have been paid;</p>

              <num>b</num>
              <content>
                <p>whether <role refersTo="#ceo">the CEO</role> should make a determination under subsection 129ACA(2) in relation to the amount paid, purportedly by way of benefit or payment under this Act, in respect of the service.</p>

            <heading>Shared debt determinations</heading>
            <content>
              <p>Making shared debt determinations</p>
              <p>the excess (the <b><i>recoverable amount</i></b>) is recoverable as a debt due to the Commonwealth from that person (the <b><i>primary debtor</i></b>) (or from the estate of that person) and another person (the <b><i>secondary debtor</i></b>) (or from the estate of that person) specified in the determination.</p>
              <p>Notice of intention to make shared debt determinations</p>
              <p>Minister may make legislative instrument</p>
              <p>Giving notices to State and Territory Health Departments</p>
              <p>then, a copy of the determination or notice may be given to the head (however described) of the Health Department (within the meaning of the <i>National Health Reform Act 2011</i>) of that State or Territory.</p>

              <num>1</num>
              <content>
                <p>If:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-129ACA__para-a">
              <num>a</num>
              <content>
                <p>as a result of the making of a false or misleading statement, an amount paid, purportedly by way of benefit or payment under this Act, exceeds the amount (if any) that should have been paid in respect of a professional service rendered, or purportedly rendered by a person; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-129ACA__para-b">
              <num>b</num>
              <content>
                <p>	(b)	the Chief Executive Medicare (the <b><i>CEO</i></b>) makes a determination under subsection (2) in relation to the amount;</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-129ACA__subclause-2">
              <num>2</num>
              <content>
                <p><role refersTo="#ceo">The CEO</role> may make a written determination under this subsection in relation to an amount if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-129ACA__para-a">
              <num>a</num>
              <content>
                <p>notice has been given under subsection (7) in relation to the recoverable amount to the primary debtor and the secondary debtor; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-129ACA__para-b">
              <num>b</num>
              <content>
                <p>any of the following apply:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-129ACA__para-i">
              <num>i</num>
              <content>
                <p>the secondary debtor employed or otherwise engaged the primary debtor to render professional services of the kind mentioned in paragraph (1)(a);</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-129ACA__para-ii">
              <num>ii</num>
              <content>
                <p>the secondary debtor had an arrangement or agreement with the primary debtor relating to professional services of that kind;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-129ACA__para-iii">
              <num>iii</num>
              <content>
                <p>the secondary debtor is a person in a class of persons prescribed under paragraph (9)(a);</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-129ACA__para-iv">
              <num>iv</num>
              <content>
                <p>the secondary debtor is not a person in a class of persons prescribed under paragraph (9)(b); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-129ACA__para-c">
              <num>c</num>
              <content>
                <p><role refersTo="#ceo">the CEO</role> reasonably believes the determination should be made having regard to the following:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-129ACA__para-i">
              <num>i</num>
              <content>
                <p>whether the relationship of the secondary debtor with the primary debtor was such that the secondary debtor could have controlled or influenced the circumstances that led to the making of the false or misleading statement to which the debt relates;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-129ACA__para-ii">
              <num>ii</num>
              <content>
                <p>whether the secondary debtor directly or indirectly obtained a financial benefit from the making of the false or misleading statement;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-129ACA__para-iii">
              <num>iii</num>
              <content>
                <p>whether any other factors in all the circumstances of the case make it fair and reasonable for the determination to be made.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-129ACA__subclause-3">
              <num>3</num>
              <content>
                <p>The determination must be given to the primary debtor, or estate, and the secondary debtor, or estate, and set out the following:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-129ACA__para-a">
              <num>a</num>
              <content>
                <p>the decision to make a determination to claim the recoverable amount under subsection (1) as a debt due to the Commonwealth;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-129ACA__para-b">
              <num>b</num>
              <content>
                <p>	(b)	an amount (the <b><i>shared amount</i></b>) equal to a percentage of the recoverable amount that is recoverable from the secondary debtor or estate;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-129ACA__para-c">
              <num>c</num>
              <content>
                <p>	(c)	an amount (the <b><i>remaining amount</i></b>) equal to the recoverable amount less the shared amount that is recoverable from the primary debtor or estate;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-129ACA__para-d">
              <num>d</num>
              <content>
                <p>the reasons for the decision;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-129ACA__para-e">
              <num>e</num>
              <content>
                <p>the right to seek review of the decision under <ref href="#sec-129A">section 129A</ref>CB.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-129ACA__subclause-4">
              <num>4</num>
              <content>
                <p>The percentage determined by <role refersTo="#ceo">the CEO</role> for the purposes of paragraph (3)(b) must be the percentage prescribed under paragraph (9)(c), unless <role refersTo="#ceo">the CEO</role> reasonably believes in all the circumstances of the case that it is fair and reasonable that a different percentage be determined.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-129ACA__subclause-5">
              <num>5</num>
              <content>
                <p><role refersTo="#ceo">The CEO</role> must not serve a notice on a person or an estate claiming a shared amount or remaining amount (as the case may be) as a debt before the end of the period of 28 days after the determination referred to in subsection (2) is given to the person or estate.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-129ACA__subclause-6">
              <num>6</num>
              <content>
                <p>An amount is recoverable under subsection (1) whether or not:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-129ACA__para-a">
              <num>a</num>
              <content>
                <p>the amount was paid to the primary debtor or secondary debtor (or the estates of those persons); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-129ACA__para-b">
              <num>b</num>
              <content>
                <p>any person has been convicted of an offence in relation to the making of the statement.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-129ACA__subclause-7">
              <num>7</num>
              <content>
                <p>Before making a determination under subsection (2) in relation to a recoverable amount, <role refersTo="#ceo">the CEO</role> must give the following to the primary debtor or estate and the other person or estate <role refersTo="#ceo">the CEO</role> is considering specifying in the determination as the secondary debtor:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-129ACA__para-a">
              <num>a</num>
              <content>
                <p>written notice that <role refersTo="#ceo">the CEO</role> is considering making a determination under that subsection in relation to the recoverable amount;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-129ACA__para-b">
              <num>b</num>
              <content>
                <p>a copy of any document produced under subsection 129AAD(2) or (3) in relation to the recoverable amount.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-129ACA__subclause-8">
              <num>8</num>
              <content>
                <p>A person who is given a notice under subsection (7) may, <quantity refersTo="#deadline">within 14 days</quantity> after the notice is given, provide a written response to the CEO which states:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-129ACA__para-a">
              <num>a</num>
              <content>
                <p>the reasons why the person considers a determination under subsection (2) should, or should not, be made; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-129ACA__para-b">
              <num>b</num>
              <content>
                <p>the percentage that the person considers should be determined for the purposes of paragraph 129ACA(3)(b).</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-129ACA__subclause-9">
              <num>9</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, prescribe the following:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-129ACA__para-a">
              <num>a</num>
              <content>
                <p>classes of persons for the purposes of subparagraph (2)(b)(iii);</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-129ACA__para-b">
              <num>b</num>
              <content>
                <p>classes of persons for the purposes of subparagraph (2)(b)(iv);</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-129ACA__para-c">
              <num>c</num>
              <content>
                <p>a percentage for the purposes of subsection (4);</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-129ACA__para-d">
              <num>d</num>
              <content>
                <p>matters or statements for the purposes of paragraph 129AAD(8)(bc).</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-129ACA__subclause-10">
              <num>10</num>
              <content>
                <p>If:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-129ACA__para-a">
              <num>a</num>
              <content>
                <p>either of the following is given to a person in relation to a professional service:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-129ACA__para-i">
              <num>i</num>
              <content>
                <p>a determination under subsection (2);</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-129ACA__para-ii">
              <num>ii</num>
              <content>
                <p>a notice mentioned in subsection (5); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-129ACA__para-b">
              <num>b</num>
              <content>
                <p>the professional service was rendered, or purportedly rendered, in or at a hospital mentioned in subsection (11) of a State or Territory;</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-129ACA__subclause-11">
              <num>11</num>
              <content>
                <p>For the purposes of subsection (10), a hospital is a facility in that State or Territory for which:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-129ACA__para-a">
              <num>a</num>
              <content>
                <p>	(a)	a declaration is in force under paragraph 121-5(6)(a) of the <i>Private Health Insurance Act 2007</i>; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-129ACA__para-b">
              <num>b</num>
              <content>
                <p>a statement is included in the declaration (as mentioned in subsection 121-5(8) of that Act) that the hospital is a public hospital.</p>
              </content>
            </paragraph>

                <p>	(1)	If the Chief Executive Medicare (the <b><i>CEO</i></b>) makes a determination under subsection 129ACA(2) to claim a recoverable amount as a debt, the primary debtor and secondary debtor (or the estates of those persons) may apply in writing to the CEO, in the form approved in writing by the CEO, for a review of the decision to make the determination.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-129ACB__subclause-2">
              <num>2</num>
              <content>
                <p>An application under subsection (1) for review of a decision must be made <quantity refersTo="#deadline">within 28 days</quantity> after the person or estate is notified of the decision under subsection 129ACA(3).</p>

                <p>whether the decision should be confirmed, varied or revoked; and</p>
              </content>

                <p>the person’s reasons for why the decision should be confirmed, varied or revoked.</p>
              </content>
            </paragraph>

                <p>On receiving the application and any written submissions under subsection (4), <role refersTo="#ceo">the CEO</role> must:</p>
              </content>

                <p>review the decision; and</p>
              </content>
            </paragraph>

                <p>	(6)	The CEO must give to the applicant and each other person mentioned in subsection (1) written notice of the decision (the <b><i>reconsidered decision</i></b>) on the review.</p>

                <p>Applications may be made to the Administrative Appeals Tribunal for review of reconsidered decisions.</p>

                <p>However, subsection (7) applies only if a garnishee notice is given under subsection 129AEG(1) in relation to the debt to which the reconsidered decision relates.</p>

                <p>	(9)	Despite paragraph 29(1)(d) of the <i>Administrative Appeals Tribunal Act 1975</i>, if a garnishee notice is given under subsection 129AEG(1) in relation to the debt to which the reconsidered decision relates, an application mentioned in subsection (7) of this section must be made within the period of 28 days after the day the garnishee notice is given.</p>

                <p>	(a)	that would help the CEO locate another person (the <b><i>debtor</i></b>) who owes a debt due to the Commonwealth for which notice has been served as mentioned in subsection 129AAI(4); or</p>

            </paragraph>
            <paragraph eId="schedule-3__clause-129AECA__para-b">
              <num>b</num>
              <content>
                <p>that is relevant to the debtor’s financial situation;</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-3__clause-129AECA__subclause-5">
              <num>5</num>
              <content>
                <p>A notice under subsection (1) or (4) must specify the following:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-3__clause-129AECA__para-a">
              <num>a</num>
              <content>
                <p>how the person is to give the information in writing or produce the document;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-3__clause-129AECA__para-b">
              <num>b</num>
              <content>
                <p>the period (which must be at least 14 days after the day the notice is given) within which the person is to give the information or produce the document;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-3__clause-129AECA__para-c">
              <num>c</num>
              <content>
                <p>that the notice is given under subsection (1) or (4) (as the case requires).</p>
              </content>
            </paragraph>

                <p>A person contravenes this subsection if:</p>
              </content>
            </hcontainer>

                <p>the person is given a notice under subsection (1) or (4) requiring the person to give information in writing or produce a document; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-3__clause-129AECA__para-b">
              <num>b</num>
              <content>
                <p>the person fails to comply with the requirement within the period specified in the notice.</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-3__clause-129AECA__para-a">
              <num>a</num>

                <p>for an individual—<quantity refersTo="#penaltyUnit">20 penalty units</quantity>; and</p>
              </content>
            </paragraph>

                <p>	(1)	This section applies in relation to an amount (the <b><i>recoverable amount</i></b>) recoverable from a person, or from the estate of that person, as a debt due to the Commonwealth if the amount is one of the following:</p>

                <p>an amount under subsection 129AC(1), (1A), (1C), (1E) or (1G) where:</p>

                <p>	(i)	any rights of review by the Chief Executive Medicare (the <b><i>CEO</i></b>) under section 129AAJ have been exhausted or have expired; and</p>

              <num>ii</num>
              <content>
                <p>the 3 month period referred to in subparagraph 129AC(2)(c)(i) has expired;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-3__clause-129AEF__para-b">

                <p>an amount under <ref href="#sec-129A">section 129A</ref>D where:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-3__clause-129AEF__para-i">
              <num>i</num>

                <p>the amount is specified in a final determination under <ref href="#sec-106T">section 106T</ref>A; and</p>
              </content>
            </paragraph>

                <p>the Commonwealth is the payee;</p>
              </content>
            </paragraph>

                <p>	(2)	The CEO may, on behalf of the Commonwealth, set off the whole or a part of the recoverable amount against the whole or a part of an amount payable (the <b><i>payable amount</i></b>) to the person or estate under this Act.</p>

                <p>However, an amount set off under subsection (2) must not exceed:</p>

              </content>

                <p>if <role refersTo="#ceo">the CEO</role> and the person or estate agree to a higher percentage of the amount payable—that percentage.</p>

                <p>is a person by whom the available money is due or accruing to the debtor or estate; or</p>
              </content>

                <p>holds the money for, or on account of, the debtor or estate; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-3__clause-129AEG__para-c">

                <p>holds the money on account of some other person for payment to the debtor or estate; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-3__clause-129AEG__para-d">

                <p>has authority from some other person to pay the money to the debtor or estate.</p>

                <p>the recoverable amount; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-3__clause-129AEG__para-ii">
              <num>ii</num>

                <p>the available money; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-3__clause-129AEG__para-b">
              <num>b</num>
              <content>
                <p>if there will be amounts of the available money from time to time—require the third party to pay to the Commonwealth a specified amount, or a specified percentage, of each amount of the money, until the recoverable amount is recovered.</p>

              <num>5</num>
              <content>
                <p>The garnishee notice must require the third party to pay an amount under paragraph (4)(a), or each amount under paragraph (4)(b), within the period specified in the notice.</p>

              <num>6</num>
              <content>
                <p><role refersTo="#ceo">The CEO</role> must send a copy of the garnishee notice to the debtor or estate.</p>

              <num>7</num>
              <content>
                <p>If a person other than the third party has paid an amount to the Commonwealth that satisfies all or part of the recoverable amount:</p>
              </content>

            <paragraph eId="schedule-3__clause-129AEG__para-a">
              <num>a</num>
              <content>
                <p><role refersTo="#ceo">the CEO</role> must notify the third party of that fact; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-3__clause-129AEG__para-b">
              <num>b</num>
              <content>
                <p>any amount that the third party is required to pay under the garnishee notice is reduced by that amount.</p>
              </content>
            </paragraph>

                <p>If an amount is paid by the third party in accordance with the garnishee notice:</p>
              </content>

                <p>the payment is taken to have been authorised by:</p>
              </content>
            </paragraph>

            <paragraph eId="schedule-3__clause-129AEG__para-ii">
              <num>ii</num>

                <p>any other person who is entitled to all or a part of the amount; and</p>

            </paragraph>
            <paragraph eId="schedule-3__clause-129AEG__para-b">
              <num>b</num>
              <content>
                <p>the third party is indemnified for the payment.</p>
              </content>
            </paragraph>

                <p>If the third party mentioned in subsection (2) is the Commonwealth, a State or a Territory, <role refersTo="#ceo">the CEO</role> may give the garnishee notice to a person who is (as the case requires):</p>

                <p>employed by the Commonwealth, State or Territory; and</p>

                <p>required, or authorised, to disburse public money under a law of the Commonwealth, State or Territory.</p>
              </content>
            </paragraph>

                <p>This section binds the Crown in right of the Commonwealth, of each of the States, of the Australian Capital Territory and of the Northern Territory.</p>

              <content>
                <p>However, this section does not make the Crown liable to be prosecuted for an offence.</p>

            <heading>Failure to comply with garnishee notice</heading>

                <p>A person commits an offence if:</p>

            <paragraph eId="schedule-3__clause-129AEH__para-a">
              <num>a</num>

                <p>the person is given a garnishee notice under <ref href="#sec-129A">section 129A</ref>EG; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-3__clause-129AEH__para-b">
              <num>b</num>
              <content>
                <p>the person fails to comply with the notice.</p>
              </content>
            </paragraph>

              <p>If, in proceedings for a civil penalty order against a person for a contravention of a civil penalty provision, the person wishes to rely on any exception, exemption, excuse, qualification or justification provided by the law creating the civil penalty provision, then the person bears an evidential burden in relation to that matter.</p>

            <heading>Obligations not affected by State or Territory laws</heading>
            <content>
              <p>Nothing contained in a law of a State or a Territory, or in the general law, operates to prevent a person from:</p>
              <p>that the person is required, or authorised, to give or produce under a provision of this Act.</p>

                <p>A person’s base penalty amount for a dental service is reduced in accordance with the following table.</p>
              </content>

                <p>A person’s base penalty amount for a dental service is increased by 25% if:</p>
              </content>
            </hcontainer>

                <p>the Chief Executive Medicare gives a notice to the person under subsection 32C(1) that specifies the service; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-56F__para-b">

                <p>the person does not comply with the notice in respect of the service, or any other dental service specified in the notice, within the period specified in the notice.</p>
              </content>
            </paragraph>

                <p>If a base penalty amount is subject to both a reduction and an increase, apply the reduction first.</p>

            <heading>Notice of administrative penalty and review of assessments</heading>

                <p>The Chief Executive Medicare must give to a person who the Chief Executive Medicare has assessed, in accordance with sections 56E and 56F, is liable for an administrative penalty, written notice of the assessment which includes the following:</p>
              </content>

              <num>a</num>
              <content>
                <p>the person’s liability to pay an administrative penalty in respect of one or more dental services;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-56G__para-b">
              <num>b</num>
              <content>
                <p>the dental service to which each administrative penalty relates;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-56G__para-c">
              <num>c</num>
              <content>
                <p>if there is more than one dental service—the total of the administrative penalties;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-56G__para-d">
              <num>d</num>
              <content>
                <p>the day by which the penalty becomes due for payment (which must be at least 14 days after the day on which the notice is given);</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-56G__para-e">
              <num>e</num>
              <content>
                <p>the fact that the notice is given under this section.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-4__clause-56G__subclause-2">
              <num>2</num>
              <content>
                <p>The notice may also deal with a debt due to the Commonwealth under <ref href="#sec-56">section 56</ref> or 56A arising in relation to the dental service.</p>

                <p>A person may apply to the Administrative Appeals Tribunal for review of an assessment by the Chief Executive Medicare of the person’s liability to pay an administrative penalty for which notice has been given under subsection (1).</p>

            <hcontainer name="subclause" eId="schedule-4__clause-56G__subclause-4">
              <num>4</num>
              <content>
                <p>However, subsection (3) applies only if a garnishee notice is given under subsection 58AA(2) in relation to the debt to which the administrative penalty relates.</p>

            <heading>Power to obtain information relating to a debt</heading>
            <hcontainer name="subclause" eId="schedule-4__clause-56H__subclause-1">
              <num>1</num>
              <content>
                <p>The Chief Executive Medicare may, by written notice given to a person who owes a debt to the Commonwealth for which notice has been served as mentioned in subsection 56C(4), require the person to do either or both of the following:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-4__clause-56H__para-a">
              <num>a</num>
              <content>
                <p>give to the Chief Executive Medicare, or a Human Services employee, information in writing that is relevant to the person’s financial situation;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-56H__para-b">
              <num>b</num>
              <content>
                <p>produce to the Chief Executive Medicare, or a Human Services employee, a document that is in the person’s custody or under the person’s control and is relevant to the person’s financial situation.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-4__clause-56H__subclause-2">
              <num>2</num>
              <content>
                <p>An individual who owes a debt to the Commonwealth for which notice has been served as mentioned in subsection 56C(4) must, <quantity refersTo="#deadline">within 14 days</quantity> after the notice is served, notify the Chief Executive Medicare of an address for the purposes of giving documents to the individual relating to the debt.</p>
              </content>
            </hcontainer>
            <content>
              <p>Civil penalty:	<quantity refersTo="#penaltyUnit">20 penalty units</quantity>.</p>
              <p>then the individual must notify the Chief Executive Medicare of the change <quantity refersTo="#deadline">within 14 days</quantity> after the change.</p>

              <p>the Chief Executive Medicare may, by written notice given to the person, require the person to give the information in writing, or produce the document, to the Chief Executive Medicare or a Human Services employee.</p>

              <p>Note:	<i>Health Insurance Act 1973</i> provides a regime for the obtaining of orders for a civil penalty.<ref href="#part-VI">Part VI</ref>A of the </p>
              <p>Note:	A person who wishes to rely on subsection (8) in proceedings for a civil penalty order bears an evidential burden in relation to the matter in that subsection (see <i>Health Insurance Act 1973</i>).<ref href="#sec-130H">section 130H</ref> of the </p>
            </content>
            <hcontainer name="subclause" eId="schedule-4__clause-56H__subclause-3">

                <p>If:</p>

                <p>an individual owes a debt to the Commonwealth for which notice has been served as mentioned in subsection 56C(4); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-56H__para-b">
              <num>b</num>
              <content>
                <p>the individual has notified the Chief Executive Medicare of an address under subsection (2) of this section; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-56H__para-c">
              <num>c</num>
              <content>
                <p>the address changes;</p>
              </content>
            </paragraph>

                <p>If the Chief Executive Medicare reasonably believes that a person may have information or a document:</p>

                <p>	(a)	that would help the Chief Executive Medicare locate another person (the <b><i>debtor</i></b>) who owes a debt to the Commonwealth for which notice has been served as mentioned in subsection 56C(4); or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-56H__para-b">
              <num>b</num>
              <content>
                <p>that is relevant to the debtor’s financial situation;</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-4__clause-56H__subclause-5">
              <num>5</num>

                <p>A notice under subsection (1) or (4) must specify the following:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-4__clause-56H__para-a">
              <num>a</num>
              <content>
                <p>how the person is to give the information in writing or produce the document;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-56H__para-b">
              <num>b</num>
              <content>
                <p>the period (which must be at least 14 days after the day the notice is given) within which the person is to give the information in writing or produce the document;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-56H__para-c">
              <num>c</num>
              <content>
                <p>that the notice is given under subsection (1) or (4) (as the case requires).</p>
              </content>
            </paragraph>

                <p>A person contravenes this subsection if:</p>
              </content>
            </hcontainer>

                <p>the person is given a notice under subsection (1) or (4) requiring the person to give information or produce a document; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-56H__para-b">
              <num>b</num>
              <content>
                <p>the person fails to comply with the requirement within the period specified in the notice.</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-56H__para-a">
              <num>a</num>
              <content>
                <p>for an individual—<quantity refersTo="#penaltyUnit">20 penalty units</quantity>; and</p>
              </content>
            </paragraph>

                <p>the money is not due, or is not so held, or payable under <role refersTo="#authority">the authority</role>, unless a condition is fulfilled; and</p>

                <p>the condition has not been fulfilled.</p>

                <p>The garnishee notice must:</p>

              </content>
            </paragraph>

                <p>	(b)	if there will be amounts of the available money from time to time—require the third party to pay to the<i> </i>Commonwealth<i> </i>a specified amount, or a specified percentage, of each amount of the money, until the debt is satisfied.</p>

              <content>
                <p>The garnishee notice must require the third party to pay an amount under paragraph (5)(a), or each amount under paragraph (5)(b), within the period specified in the notice.</p>

              <num>7</num>
              <content>
                <p>The Chief Executive Medicare must send a copy of the garnishee notice to the debtor or estate.</p>

                <p>	(8)	If a person other than the third party has paid an amount to<i> </i>the<i> </i>Commonwealth that satisfies all or part of the debt:</p>

              <num>a</num>
              <content>
                <p>the Chief Executive Medicare must notify the third party of that fact; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-58AA__para-b">
              <num>b</num>
              <content>
                <p>any amount that the third party is required to pay under the garnishee notice is reduced by that amount.</p>
              </content>
            </paragraph>

                <p>If an amount is paid by the third party in accordance with the garnishee notice:</p>
              </content>
            </hcontainer>

                <p>the payment is taken to have been authorised by:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-58AA__para-i">

                <p>the third party is indemnified for the payment.</p>

                <p>If the third party is the Commonwealth, a State or a Territory, the Chief Executive Medicare may give the notice to a person who is (as the case requires):</p>

                <p>employed by the Commonwealth, State or Territory; and</p>
              </content>
            </paragraph>

                <p>required, or authorised, to disburse public money under a law of the Commonwealth, State or Territory.</p>
              </content>
            </paragraph>

                <p>This section binds the Crown in right of the Commonwealth, of each of the States, of the Australian Capital Territory and of the Northern Territory.</p>

                <p>However, this section does not make the Crown liable to be prosecuted for an offence.</p>

            <heading>Failure to comply with garnishee notice</heading>

                <p>the person was an approved pharmacist, approved medical practitioner or approved hospital authority when the amount was paid; and</p>
              </content>
            </paragraph>

                <p>the person is required, under a provision of this Act, the regulations or another legislative instrument under this Act, to keep a document relating to the supply of the pharmaceutical benefit.</p>

                <p>If <role refersTo="#secretary">the Secretary</role> makes a decision referred to in subsection 99ABC(1) about a person or an estate, the person or estate may apply in writing to <role refersTo="#secretary">the Secretary</role>, in the form approved in writing by <role refersTo="#secretary">the Secretary</role>, for a review of the decision.</p>

                <p>An application for review of a decision must be made <quantity refersTo="#deadline">within 28 days</quantity> after the person or estate is notified of the decision.</p>

              <content>
                <p>On receiving an application for review of a decision, <role refersTo="#secretary">the Secretary</role> must:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-5__clause-99ABD__para-a">
              <num>a</num>
              <content>
                <p>review the decision; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-5__clause-99ABD__para-b">
              <num>b</num>
              <content>
                <p>confirm, vary or revoke the decision.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-5__clause-99ABD__subclause-6">
              <num>6</num>
              <content>
                <p>	(6)	The Secretary must give to the applicant written notice of the decision (the <b><i>reconsidered decision</i></b>) on the review within 28 days after receiving the application for review.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-5__clause-99ABD__subclause-7">
              <num>7</num>
              <content>
                <p>A failure to comply with the requirements of subsection (6) does not affect the validity of the review or of the reconsidered decision.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-5__clause-99ABD__subclause-8">
              <num>8</num>
              <content>
                <p>An application may be made to the Administrative Appeals Tribunal for review of a reconsidered decision.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-5__clause-99ABD__subclause-9">
              <num>9</num>
              <content>
                <p>However, subsection (8) applies only if a garnishee notice is given under subsection 99ABJ(2) in relation to the debt to which the reconsidered decision relates.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-5__clause-99ABD__subclause-10">
              <num>10</num>
              <content>
                <p>	(10)	Despite paragraph 29(1)(d) of the <i>Administrative Appeals Tribunal Act 1975</i>, if a garnishee notice is given under subsection 99ABJ(2) in relation to the debt to which the reconsidered decision relates, an application mentioned in subsection (8) of this section must be made within the period of 28 days after the day the garnishee notice is given.</p>

            <hcontainer name="subclause" eId="schedule-5__clause-99ABD__subclause-11">
              <num>11</num>
              <content>
                <p>To avoid doubt:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-5__clause-99ABD__para-a">
              <num>a</num>
              <content>
                <p>a decision mentioned in subsection (1) may be reviewed by <role refersTo="#secretary">the Secretary</role> under subsection (5) once only; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-5__clause-99ABD__para-b">
              <num>b</num>
              <content>
                <p>a reconsidered decision takes effect:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-5__clause-99ABD__para-i">
              <num>i</num>
              <content>
                <p>on the day specified in the reconsidered decision; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-5__clause-99ABD__para-ii">
              <num>ii</num>
              <content>
                <p>if a day is not specified—on the day on which the reconsidered decision is made.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-5__clause-99ABE">
            <num>99ABE</num>
            <heading>Liability for administrative penalty</heading>
            <content>
              <p>A person is liable for an administrative penalty in respect of the supply or purported supply of a pharmaceutical benefit if:</p>
            </content>
            <paragraph eId="schedule-5__clause-99ABE__para-a">
              <num>a</num>
              <content>
                <p>	(a)	the Secretary has served a notice (as mentioned in subsection 99ABC(4)) on the person claiming an amount (the <b><i>total amount</i></b>) as a debt due to the Commonwealth under subsection 99ABC(1); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-5__clause-99ABE__para-b">
              <num>b</num>
              <content>
                <p>	(b)	the total amount consists of, or includes, an amount (the <b><i>recoverable amount</i></b>) in respect of the benefit recoverable as a debt due to the Commonwealth from the person; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-5__clause-99ABE__para-c">
              <num>c</num>
              <content>
                <p>the total amount is more than:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-5__clause-99ABE__para-i">
              <num>i</num>
              <content>
                <p>$2,500; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-5__clause-99ABE__para-ii">
              <num>ii</num>
              <content>
                <p>if a higher amount is prescribed by the regulations—that higher amount.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-5__clause-99ABF">
            <num>99ABF</num>
            <heading>Amount of administrative penalty</heading>
            <hcontainer name="subclause" eId="schedule-5__clause-99ABF__subclause-1">
              <num>1</num>
              <content>
                <p>The amount of the administrative penalty for a pharmaceutical benefit is worked out in accordance with this section.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-5__clause-99ABF__subclause-2">
              <num>2</num>
              <content>
                <p>	(2)	The amount (the <b><i>base penalty amount</i></b>) of the administrative penalty for a pharmaceutical benefit is 20% of the recoverable amount mentioned in paragraph 99ABE(b) in respect of the benefit.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-5__clause-99ABF__subclause-3">
              <num>3</num>
              <content>
                <p>However, a person’s base penalty amount for a pharmaceutical benefit is reduced by 50% if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-5__clause-99ABF__para-a">
              <num>a</num>
              <content>
                <p><role refersTo="#secretary">the Secretary</role> gives a notice to the person under subsection 99ABB(2) relating to the benefit; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-5__clause-99ABF__para-b">
              <num>b</num>
              <content>
                <p>before the end of the period specified in the notice, the person voluntarily tells <role refersTo="#secretary">the Secretary</role>, in the form approved in writing by <role refersTo="#secretary">the Secretary</role>, that the amount paid to the person under this Act in respect of the benefit exceeds the amount (if any) that should have been paid.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-5__clause-99ABG">
            <num>99ABG</num>
            <heading>Notice of administrative penalty and review of assessments</heading>
            <hcontainer name="subclause" eId="schedule-5__clause-99ABG__subclause-1">
              <num>1</num>
              <content>
                <p><role refersTo="#secretary">The Secretary</role> must give to a person who <role refersTo="#secretary">the Secretary</role> has assessed, in accordance with sections 99ABE and 99ABF, is liable for an administrative penalty, written notice of the assessment which includes the following:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-5__clause-99ABG__para-a">
              <num>a</num>
              <content>
                <p>the person’s liability to pay an administrative penalty in respect of one or more pharmaceutical benefits;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-5__clause-99ABG__para-b">
              <num>b</num>
              <content>
                <p>the pharmaceutical benefit to which each administrative penalty relates;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-5__clause-99ABG__para-c">
              <num>c</num>
              <content>
                <p>if there is more than one pharmaceutical benefit—the total of the administrative penalties;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-5__clause-99ABG__para-d">
              <num>d</num>
              <content>
                <p>the day by which the penalty becomes due for payment (which must be at least 14 days after the day on which the notice is given);</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-5__clause-99ABG__para-e">
              <num>e</num>
              <content>
                <p>the fact that the notice is given under this section.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-5__clause-99ABG__subclause-2">
              <num>2</num>
              <content>
                <p>The notice may also deal with a debt due to the Commonwealth under subsection 99ABA(2) or 99ABB(4) arising in relation to the pharmaceutical benefit.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-5__clause-99ABG__subclause-3">
              <num>3</num>
              <content>
                <p>If:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-5__clause-99ABG__para-a">
              <num>a</num>
              <content>
                <p>a person is given a notice under subsection (1) of the person’s liability to pay an administrative penalty; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-5__clause-99ABG__para-b">
              <num>b</num>
              <content>
                <p>the person does not pay the penalty by the day set out in the notice as the day by which the penalty becomes due for payment;</p>
              </content>
            </paragraph>
            <content>
              <p>the amount set out in the notice is recoverable as a debt due to the Commonwealth from the person or the estate of the person.</p>
            </content>
            <hcontainer name="subclause" eId="schedule-5__clause-99ABG__subclause-4">
              <num>4</num>
              <content>
                <p>A person may apply to the Administrative Appeals Tribunal for review of an assessment by <role refersTo="#secretary">the Secretary</role> of the person’s liability to pay an administrative penalty for which notice has been given under subsection (1).</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-5__clause-99ABG__subclause-5">
              <num>5</num>
              <content>
                <p>However, subsection (4) applies only if a garnishee notice is given under subsection 99ABJ(2) in relation to the debt to which the administrative penalty relates.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-5__clause-99ABG__subclause-6">
              <num>6</num>
              <content>
                <p>	(6)	Despite paragraph 29(1)(d) of the <i>Administrative Appeals Tribunal Act 1975</i>, if a garnishee notice is given under subsection 99ABJ(2) in relation to the debt to which the administrative penalty relates, an application mentioned in subsection (4) of this section must be made within the period of 28 days after the day the garnishee notice is given.</p>

          <hcontainer name="clause" eId="schedule-5__clause-99ABH">
            <num>99ABH</num>
            <heading>Power to obtain information relating to a debt</heading>
            <hcontainer name="subclause" eId="schedule-5__clause-99ABH__subclause-1">
              <num>1</num>
              <content>
                <p><role refersTo="#secretary">The Secretary</role> may, by written notice given to a person who owes a debt to the Commonwealth for which notice has been served as mentioned in subsection 99ABC(4), require the person to do either or both of the following:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-5__clause-99ABH__para-a">
              <num>a</num>
              <content>
                <p>give to <role refersTo="#secretary">the Secretary</role> information in writing that is relevant to the person’s financial situation;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-5__clause-99ABH__para-b">
              <num>b</num>
              <content>
                <p>produce to <role refersTo="#secretary">the Secretary</role> a document that is in the person’s custody or under the person’s control and is relevant to the person’s financial situation.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-5__clause-99ABH__subclause-2">
              <num>2</num>
              <content>
                <p>An individual who owes a debt to the Commonwealth for which notice has been served as mentioned in subsection 99ABC(4) must, <quantity refersTo="#deadline">within 14 days</quantity> after the notice is served, notify the Secretary of an address for the purposes of giving documents to the individual relating to the debt.</p>
              </content>
            </hcontainer>
            <content>
              <p>Civil penalty:	<quantity refersTo="#penaltyUnit">20 penalty units</quantity>.</p>
              <p>then the individual must notify the Secretary of the change <quantity refersTo="#deadline">within 14 days</quantity> after the change.</p>
              <p>Civil penalty:	<quantity refersTo="#penaltyUnit">20 penalty units</quantity>.</p>
              <p><role refersTo="#secretary">the Secretary</role> may, by written notice given to the person, require the person to give the information in writing, or produce the document, to <role refersTo="#secretary">the Secretary</role>.</p>
              <p>Civil penalty:	<quantity refersTo="#penaltyUnit">20 penalty units</quantity>.</p>
              <p>Note:	A person who wishes to rely on this subsection bears an evidential burden in relation to the matters in this subsection (see <ref href="#sec-96">section 96</ref> of the Regulatory Powers Act).</p>
            </content>
            <hcontainer name="subclause" eId="schedule-5__clause-99ABH__subclause-3">
              <num>3</num>
              <content>
                <p>If:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-5__clause-99ABH__para-a">
              <num>a</num>
              <content>
                <p>an individual owes a debt to the Commonwealth for which notice has been served as mentioned in subsection 99ABC(4); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-5__clause-99ABH__para-b">
              <num>b</num>
              <content>
                <p>the individual has notified <role refersTo="#secretary">the Secretary</role> of an address under subsection (2) of this section; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-5__clause-99ABH__para-c">
              <num>c</num>
              <content>
                <p>the address changes;</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-5__clause-99ABH__subclause-4">
              <num>4</num>
              <content>
                <p>If <role refersTo="#secretary">the Secretary</role> reasonably believes that a person may have information or a document:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-5__clause-99ABH__para-a">
              <num>a</num>
              <content>
                <p>	(a)	that would help the Secretary locate another person (the <b><i>debtor</i></b>) who owes a debt to the Commonwealth for which notice has been served as mentioned in subsection 99ABC(4); or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-5__clause-99ABH__para-b">
              <num>b</num>
              <content>
                <p>that is relevant to the debtor’s financial situation;</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-5__clause-99ABH__subclause-5">
              <num>5</num>
              <content>
                <p>A notice under subsection (1) or (4) must specify the following:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-5__clause-99ABH__para-a">
              <num>a</num>
              <content>
                <p>how the person is to give the information in writing or produce the document;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-5__clause-99ABH__para-b">
              <num>b</num>
              <content>
                <p>the period (which must be at least 14 days after the day the notice is given) within which the person is to give the information in writing or produce the document;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-5__clause-99ABH__para-c">
              <num>c</num>
              <content>
                <p>that the notice is given under subsection (1) or (4) (as the case requires).</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-5__clause-99ABH__subclause-6">
              <num>6</num>
              <content>
                <p>A person contravenes this subsection if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-5__clause-99ABH__para-a">
              <num>a</num>
              <content>
                <p>the person is given a notice under subsection (1) or (4) requiring the person to give information in writing or produce a document; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-5__clause-99ABH__para-b">
              <num>b</num>
              <content>
                <p>the person fails to comply with the requirement within the period specified in the notice.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-5__clause-99ABH__subclause-7">
              <num>7</num>
              <content>
                <p>Subsection (2), (3) or (6) does not apply if the person has a reasonable excuse.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-5__clause-99ABI">
            <num>99ABI</num>
            <heading>Amounts recoverable once only</heading>
            <content>
              <p>To avoid doubt, an amount recoverable from a person, or an estate of a person, in respect of the supply, or purported supply, of a pharmaceutical benefit is recoverable under this Division once only.</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-5__clause-99ABJ">
            <num>99ABJ</num>
            <heading>Garnishee notices</heading>
            <hcontainer name="subclause" eId="schedule-5__clause-99ABJ__subclause-1">
              <num>1</num>
              <content>
                <p>This section applies in relation to an amount that is:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-5__clause-99ABJ__para-a">
              <num>a</num>
              <content>
                <p>	(a)	a debt due to the Commonwealth under subsection 99ABA(2), 99ABB(4) or 99ABG(3) (the <b><i>debt</i></b>); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-5__clause-99ABJ__para-b">
              <num>b</num>
              <content>
                <p>	(b)	recoverable from a person (the <b><i>debtor</i></b>) or from the estate of that person; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-5__clause-99ABJ__para-c">
              <num>c</num>
              <content>
                <p>in relation to which any rights to review by <role refersTo="#secretary">the Secretary</role> under section 99ABD have been exhausted or have expired.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-5__clause-99ABJ__subclause-2">
              <num>2</num>
              <content>
                <p>	(2)	If a person (the <b><i>third party</i></b>) owes or may later owe money to the debtor or estate, the Secretary may give a written notice (the <b><i>garnishee notice</i></b>) to the third party.</p>

                <p>is a person by whom the available money is due or accruing to the debtor or estate; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-5__clause-99ABJ__para-b">
              <num>b</num>
              <content>
                <p>holds the money for, or on account of, the debtor or estate; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-5__clause-99ABJ__para-c">
              <num>c</num>
              <content>
                <p>holds the money on account of some other person for payment to the debtor or estate; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-5__clause-99ABJ__para-d">
              <num>d</num>
              <content>
                <p>has authority from some other person to pay the money to the debtor or estate.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-5__clause-99ABJ__subclause-4">
              <num>4</num>
              <content>
                <p>The third party is taken to owe the available money to the debtor or estate even if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-5__clause-99ABJ__para-a">
              <num>a</num>
              <content>
                <p>the money is not due, or is not so held, or payable under <role refersTo="#authority">the authority</role>, unless a condition is fulfilled; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-5__clause-99ABJ__para-b">
              <num>b</num>
              <content>
                <p>the condition has not been fulfilled.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-5__clause-99ABJ__subclause-5">
              <num>5</num>

                <p>The garnishee notice must:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-5__clause-99ABJ__para-a">
              <num>a</num>

                <p>require the third party to pay to the Commonwealth the lesser of, or a specified amount not exceeding the lesser of:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-5__clause-99ABJ__para-i">
              <num>i</num>
              <content>
                <p>the debt; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-5__clause-99ABJ__para-ii">
              <num>ii</num>
              <content>
                <p>the available money; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-5__clause-99ABJ__para-b">
              <num>b</num>
              <content>
                <p>	(b)	if there will be amounts of the available money from time to time—require the third party to pay to the Commonwealth<i> </i>a specified amount, or a specified percentage, of each amount of the money, until the debt is satisfied.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-5__clause-99ABJ__subclause-6">
              <num>6</num>
              <content>
                <p>The garnishee notice must require the third party to pay an amount under paragraph (5)(a), or each amount under paragraph (5)(b), within the period specified in the notice.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-5__clause-99ABJ__subclause-7">
              <num>7</num>
              <content>
                <p>	(7)	The Secretary<i> </i>must send a copy of the garnishee notice to the debtor or estate.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-5__clause-99ABJ__subclause-8">
              <num>8</num>
              <content>
                <p>If a person other than the third party has paid an amount to the Commonwealth that satisfies all or part of the debt:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-5__clause-99ABJ__para-a">
              <num>a</num>
              <content>
                <p>	(a)	the Secretary<i> </i>must notify the third party of that fact; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-5__clause-99ABJ__para-b">
              <num>b</num>
              <content>
                <p>any amount that the third party is required to pay under the garnishee notice is reduced by that amount.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-5__clause-99ABJ__subclause-9">
              <num>9</num>
              <content>
                <p>If an amount is paid by the third party in accordance with the garnishee notice:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-5__clause-99ABJ__para-a">
              <num>a</num>
              <content>
                <p>the payment is taken to have been authorised by:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-5__clause-99ABJ__para-i">
              <num>i</num>
              <content>
                <p>the debtor or estate; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-5__clause-99ABJ__para-ii">
              <num>ii</num>
              <content>
                <p>any other person who is entitled to all or a part of the amount; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-5__clause-99ABJ__para-b">
              <num>b</num>
              <content>
                <p>the third party is indemnified for the payment.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-5__clause-99ABJ__subclause-10">
              <num>10</num>
              <content>
                <p>If the third party is the Commonwealth, a State or a Territory, <role refersTo="#secretary">the Secretary</role> may give the notice to a person who is (as the case requires):</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-5__clause-99ABJ__para-a">
              <num>a</num>
              <content>
                <p>employed by the Commonwealth, State or Territory; and</p>
              </content>
            </paragraph>

                <p>required, or authorised, to disburse public money under a law of the Commonwealth, State or Territory.</p>

                <p>This section binds the Crown in right of the Commonwealth, of each of the States, of the Australian Capital Territory and of the Northern Territory.</p>

                <p>However, this section does not make the Crown liable to be prosecuted for an offence.</p>

                <p>The debtor or estate may apply to the Administrative Appeals Tribunal for review of a decision by <role refersTo="#secretary">the Secretary</role> to give a garnishee notice to a person under subsection (2).</p>

            <num>99ABK</num>
            <heading>Failure to comply with garnishee notice</heading>
            <hcontainer name="subclause" eId="schedule-5__clause-99ABK__subclause-1">
              <num>1</num>
              <content>
                <p>A person commits an offence if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-5__clause-99ABK__para-a">
              <num>a</num>
              <content>
                <p>the person is given a garnishee notice under <ref href="#sec-99A">section 99A</ref>BJ; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-5__clause-99ABK__para-b">
              <num>b</num>
              <content>
                <p>the person fails to comply with the notice.</p>
              </content>
            </paragraph>
            <content>
              <p>Penalty:	<quantity refersTo="#penaltyUnit">20 penalty units</quantity>.</p>
            </content>
            <hcontainer name="subclause" eId="schedule-5__clause-99ABK__subclause-2">
              <num>2</num>
              <content>
                <p>The court may, in addition to imposing a penalty on a person convicted of an offence against subsection (1) in relation to failing to pay an amount under the notice, order the person to pay to the Commonwealth an amount not exceeding that amount.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-5__clause-99ABL">
            <num>99ABL</num>
            <heading>Recoverable amounts may be set off</heading>
            <hcontainer name="subclause" eId="schedule-5__clause-99ABL__subclause-1">
              <num>1</num>
              <content>
                <p>	(1)	This section applies in relation to an amount (the <b><i>recoverable amount</i></b>) if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-5__clause-99ABL__para-a">
              <num>a</num>
              <content>
                <p>the amount is recoverable from a person as a debt due to the Commonwealth under subsection 99ABA(2), 99ABB(4) or 99ABG(3); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-5__clause-99ABL__para-b">
              <num>b</num>
              <content>
                <p>any review rights under <ref href="#sec-99A">section 99A</ref>BD in relation to the amount have been exhausted or have expired.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-5__clause-99ABL__subclause-2">
              <num>2</num>
              <content>
                <p>	(2)	The Secretary may, on behalf of the Commonwealth, set off the whole or a part of the recoverable amount against the whole or a part of an amount payable (the <b><i>payable amount</i></b>) to the person or estate under this Act.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-5__clause-99ABL__subclause-3">
              <num>3</num>
              <content>
                <p>To avoid doubt:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-5__clause-99ABL__para-a">
              <num>a</num>
              <content>
                <p>an amount set off under subsection (2) may be equal to or less than 100% of the payable amount; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-5__clause-99ABL__para-b">
              <num>b</num>
              <content>
                <p>the payable amount is taken to have been paid in full to the person or estate if the payable amount, less any amount set off against the payable amount under this section, is paid to the person or estate.</p>

              <p>Note:	Part 4 of the Regulatory Powers Act allows a civil penalty provision to be enforced by obtaining an order for a person to pay a pecuniary penalty for the contravention of the provision.</p>

              <num>1</num>
              <content>
                <p>Each civil penalty provision of this Act is enforceable under Part 4 of the Regulatory Powers Act.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-5__clause-134D__subclause-2">
              <num>2</num>
              <content>
                <p>For the purposes of Part 4 of the Regulatory Powers Act, as that Part applies in relation to the civil penalty provisions of this Act:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-5__clause-134D__para-a">
              <num>a</num>
              <content>
                <p><role refersTo="#secretary">the Secretary</role> is an authorised applicant; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-5__clause-134D__para-b">
              <num>b</num>
              <content>
                <p>each of the following is a relevant court:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-5__clause-134D__para-i">
              <num>i</num>
              <content>
                <p>the Federal Court of Australia;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-5__clause-134D__para-ii">
              <num>ii</num>
              <content>
                <p>the Federal Circuit Court of Australia;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-5__clause-134D__para-iii">
              <num>iii</num>
              <content>
                <p>a court of a State or Territory that has jurisdiction in relation to matters arising under this Act.</p>
              </content>
            </paragraph>

            <num>134E</num>
            <heading>Obligations not affected by State or Territory laws</heading>
            <content>
              <p>Nothing contained in a law of a State or a Territory, or in the general law, operates to prevent a person from:</p>
              <p>that the person is required, or authorised, to give or produce under a provision of this Act.</p>
            </content>
            <paragraph eId="schedule-5__clause-134E__para-a">
              <num>a</num>
              <content>
                <p>giving information; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-5__clause-134E__para-b">
              <num>b</num>
              <content>
                <p>producing a document; or</p>

              <num>c</num>
              <content>
                <p>giving evidence;</p>

            <heading>Application provisions</heading>

              <num>1</num>

                <p>(1)	Section 99ABA of the <i>National Health Act 1953</i>, as inserted by this Schedule, applies in relation to false or misleading statements made in relation to an amount on or after the commencement of this item.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-5__clause-7__subclause-2">
              <num>2</num>
              <content>
                <p>(2)	Section 99ABB of the <i>National Health Act 1953</i>, as inserted by this Schedule, applies in relation to documents relating to the supply of a pharmaceutical benefit required to be first kept on or after the commencement of this item.</p>

            </hcontainer>
            <hcontainer name="subclause" eId="schedule-5__clause-7__subclause-3">
              <num>3</num>
              <content>
                <p>(3)	Section 99ABH of the <i>National Health Act 1953</i>, as inserted by this Schedule, applies in relation to debts for which notice is served (as mentioned in subsection 99ABC(4) of that Act) on or after the commencement of this item (regardless of whether the debt became due to the Commonwealth before, on or after the commencement of this item).</p>
