        <heading>Commencement</heading>
        <subsection eId="sec-2__subsec-1">
          <num>1</num>
          <content>
            <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

              <p><b><i>commencement day </i></b>means the day on which the new Act commences.</p>
              <p><b><i>new Act</i></b> means the <i>Underwater Cultural Heritage Act 2018</i>.</p>
              <p><b><i>old</i></b><b><i> Act</i></b> means the <i>Historic Shipwrecks Act 1976</i>, as in force immediately before the commencement day.</p>

                <p>Expressions used in this Schedule that are defined for the purposes of the new Act, and used in relation to the new Act, have the same meaning as in the new Act.</p>

            <heading>Section 4A declarations in relation to shipwrecks</heading>

                <p>This item applies in relation to the remains of ships that were covered by a declaration under subsection 4A(1) or (2) of the old Act immediately before <date>the commencement day</date>.</p>

              <num>2</num>
              <content>
                <p>To avoid doubt, the remains are covered by paragraph 16(1)(a) of the new Act.</p>

            <heading>Section 4A declarations in relation to relics</heading>

                <p>This item applies in relation to articles that were covered by a declaration under subsection 4A(6) or (7) of the old Act immediately before <date>the commencement day</date>.</p>
              </content>

              <content>
                <p>To avoid doubt, the articles are covered by paragraph 16(1)(b) of the new Act.</p>

            <num>4</num>
            <heading>Transition of section 5 declarations in relation to shipwrecks and relics</heading>
            <hcontainer name="subclause" eId="schedule-2__clause-4__subclause-1">
              <num>1</num>
              <content>
                <p>This item applies in relation to a declaration that was in force under <date>the commencement day</date> in relation to:<ref href="#sec-5">section 5</ref> of the old Act immediately before </p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-4__para-a">
              <num>a</num>
              <content>
                <p>the remains of a ship; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-4__para-b">
              <num>b</num>
              <content>
                <p>a particular article.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-4__subclause-2">
              <num>2</num>
              <content>
                <p>The declaration is taken, on and after <date>the commencement day</date>, to be a declaration in relation to the remains or the article (as the case may be) made under subsection 17(1) of the new Act.</p>

            <num>5</num>
            <heading>Transition of provisional declarations in relation to shipwrecks and relics</heading>
            <hcontainer name="subclause" eId="schedule-2__clause-5__subclause-1">
              <num>1</num>
              <content>
                <p>This item applies in relation to a declaration that was in force in relation to an article under <date>the commencement day</date>.<ref href="#sec-6">section 6</ref> of the old Act immediately before </p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-5__subclause-2">
              <num>2</num>
              <content>
                <p>The declaration is taken, on and after <date>the commencement day</date>, to be a declaration in relation to the article made under subsection 19(1) of the new Act.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-2__clause-6">
            <num>6</num>
            <heading>Transition of notices about possession etc. of articles</heading>
            <hcontainer name="subclause" eId="schedule-2__clause-6__subclause-1">
              <num>1</num>
              <content>
                <p>This item applies if, before <date>the commencement day</date>, a person had given the prescribed notice in relation to an article under section 9 of the old Act.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-6__subclause-2">
              <num>2</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> is taken to have granted a permit to the person under section 23 of the new Act in relation to the article.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-6__subclause-3">
              <num>3</num>
              <content>
                <p>For the purposes of subsection 23(5) of the new Act, the following things are taken to be specified in the permit:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-6__para-a">
              <num>a</num>
              <content>
                <p>the article referred to in subitem (1);</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-6__para-b">
              <num>b</num>
              <content>
                <p>that the permit applies to the person;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-6__para-c">
              <num>c</num>
              <content>
                <p>the conduct authorised is the possession, custody and control of the article;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-6__para-d">
              <num>d</num>
              <content>
                <p>that the permit comes into force on <date>the commencement day</date> and remains in force indefinitely, unless:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-6__para-i">
              <num>i</num>
              <content>
                <p>the permit is varied under <ref href="#sec-25">section 25</ref> of the new Act to specify an expiry date; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-6__para-ii">
              <num>ii</num>
              <content>
                <p>the permit is suspended or revoked under <ref href="#sec-26">section 26</ref> of the new Act;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-6__para-e">
              <num>e</num>
              <content>
                <p>that the permit includes a condition that it is non-transferable;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-6__para-f">
              <num>f</num>
              <content>
                <p>if, immediately before <date>the commencement day</date>:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-6__para-i">
              <num>i</num>
              <content>
                <p>particulars of the article were included in the Register of Historic Shipwrecks; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-6__para-ii">
              <num>ii</num>
              <content>
                <p>a unique identifier was allocated to the article in the Register;</p>
              </content>
            </paragraph>
            <content>
              <p>that the permit number is the unique identifier.</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-2__clause-7">
            <num>7</num>
            <heading>Notices about location of articles</heading>
            <content>
              <p>Transitioning notices given before commencement</p>
              <p>Notice may be given under new Act regardless of when possession etc. began</p>
            </content>
            <hcontainer name="subclause" eId="schedule-2__clause-7__subclause-1">
              <num>1</num>
              <content>
                <p>Subitem (2) applies if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-7__para-a">
              <num>a</num>
              <content>
                <p>a notice had been given to a person under subsection 10(1) of the old Act before <date>the commencement day</date>; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-7__para-b">
              <num>b</num>
              <content>
                <p>the notice had not been complied with before that day.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-7__subclause-2">
              <num>2</num>
              <content>
                <p>The notice is taken to have been given, on the day it was given, to the person under subsection 38(2) of the new Act.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-7__subclause-3">
              <num>3</num>
              <content>
                <p>If the period for compliance specified in the notice is less than 21 days after the notice was given to the person, the notice is taken to specify that it must be complied with <quantity refersTo="#deadline">within 21 days</quantity>, starting on the day the notice was given to the person.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-7__subclause-4">
              <num>4</num>
              <content>
                <p>The Minister may give a notice to a person in relation to an article under <date>the commencement day</date>.<ref href="#sec-38">section 38</ref> of the new Act whether the person obtained, or is reasonably believed to have obtained, possession, custody or control of the article before, on or after </p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-2__clause-8">
            <num>8</num>
            <heading>Directions about custody etc. of articles</heading>
            <content>
              <p>Transitioning notices given before commencement</p>
              <p>Notice may be given under new Act regardless of when possession etc. began</p>
            </content>
            <hcontainer name="subclause" eId="schedule-2__clause-8__subclause-1">
              <num>1</num>
              <content>
                <p>Subitem (2) applies if a notice had been given to a person under subsection 11(1) of the old Act before <date>the commencement day</date> requiring a person to take action in relation to an article.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-8__subclause-2">
              <num>2</num>
              <content>
                <p>On and after that day, the notice has effect in relation to the article as if it had been given by <role refersTo="#minister">the Minister</role> under subsection 39(1) of the new Act.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-8__subclause-3">
              <num>3</num>
              <content>
                <p>The Minister may give a direction to a person in relation to an article of protected underwater cultural heritage under <date>the commencement day</date>.<ref href="#sec-39">section 39</ref> of the new Act whether the person obtained possession, custody or control of the article before, on or after </p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-2__clause-9">
            <num>9</num>
            <heading>Pending applications for permits are taken to have been refused</heading>
            <content>
              <p>If an application for a permit under <date>the commencement day</date>, the application is taken, on <date>the commencement day</date>, to have been refused by the Minister.<ref href="#sec-15">section 15</ref> of the old Act was pending immediately before </p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-2__clause-10">
            <num>10</num>
            <heading>Transition of permits for exploration or recovery of articles</heading>
            <hcontainer name="subclause" eId="schedule-2__clause-10__subclause-1">
              <num>1</num>
              <content>
                <p>(1)	This item applies to a permit (the <b><i>old permit</i></b>) that was in force under section 15 of the old Act immediately before the commencement day.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-10__subclause-2">
              <num>2</num>
              <content>
                <p>(2)	The old permit is taken, on and after the commencement day, to be a permit (the <b><i>new permit</i></b>) granted under section 23 of the new Act.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-10__subclause-3">
              <num>3</num>
              <content>
                <p>The conduct authorised by the old permit is taken to be the conduct authorised by the new permit.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-10__subclause-4">
              <num>4</num>
              <content>
                <p>If the old permit was granted subject to one or more conditions, the conditions have effect as if they were imposed by <role refersTo="#minister">the Minister</role> on the new permit under paragraph 24(1)(b) of the new Act.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-10__subclause-5">
              <num>5</num>
              <content>
                <p>The new permit ceases to be in force on the day the old permit would have ceased to be in force, unless the new permit is earlier revoked under <ref href="#sec-26">section 26</ref> of the new Act.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-2__clause-11">
            <num>11</num>
            <heading>Continuation of register</heading>
            <hcontainer name="subclause" eId="schedule-2__clause-11__subclause-1">
              <num>1</num>
              <content>
                <p>The register that was:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-11__para-a">
              <num>a</num>
              <content>
                <p>kept under <ref href="#sec-12">section 12</ref> of the old Act; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-11__para-b">
              <num>b</num>
              <content>
                <p>known before <date>the commencement day</date> as the Register of Historic Shipwrecks;</p>
              </content>
            </paragraph>
            <content>
              <p>continues in existence under <ref href="#sec-48">section 48</ref> of the new Act.</p>
            </content>
            <hcontainer name="subclause" eId="schedule-2__clause-11__subclause-2">
              <num>2</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may make any changes to the register that <role refersTo="#minister">the Minister</role> considers appropriate because of the operation of subitem (1).</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-2__clause-12">
            <num>12</num>
            <heading>Evidentiary certificates</heading>
            <content>
              <p>Despite the repeal of <date>the commencement day</date>, as if that repeal had not happened.<ref href="#sec-29">section 29</ref> of the old Act, that section continues to apply, in relation to a certificate given before </p>
