          <p>		This Act is the <i>Space Activities Amendment (Launches and Returns) Act 201</i><i>8</i>.</p>

            <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

              <p>•	Australian nationals carrying on various space activities outside Australia must have the activities approved.</p>
              <p>•	There are provisions about liability for damage caused by space objects or high power rockets.</p>
              <p>•	There is a Register of Space Objects that is publicly available on the Department’s website. The register includes details for certain space objects launched under an Australian launch permit, overseas payload permit or authorisation certificate.</p>
              <p>•	Investigators can investigate accidents or incidents involving:</p>

              <p>Note:	The Agreement is in Australian Treaty Series 1986 No. 8 ([1986] ATS 8) and could in 2018 be viewed in the Australian Treaties Library on the AustLII website (http://www.austlii.edu.au).</p>
              <p><b><i>Australian aircraft </i></b>means an aircraft registered in Australia.</p>
              <p><b><i>Australian high power rocket</i></b> <b><i>permit </i></b>means a permit granted under section 38.</p>
              <p><b><i>Australian launch permit</i></b> means a permit granted under section 28.</p>

            </paragraph>

                <p>remains in force for the period specified in the licence, which must be no longer than 20 years; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-19__para-c">
              <num>c</num>

                <p>is granted subject to the conditions in <ref href="#sec-20">section 20</ref> and any other conditions specified in the licence.</p>
              </content>
            </paragraph>

            <heading>Standard launch facility licence conditions</heading>
            <content>
              <p>The following are conditions of each launch facility licence granted to a person, except to the extent that the licence otherwise specifies:</p>

              <num>a</num>
              <content>
                <p>the holder of the licence must give <role refersTo="#minister">the Minister</role> any information that <role refersTo="#minister">the Minister</role> asks for under section 60 about the licence;</p>

              <num>b</num>
              <content>
                <p>any other condition prescribed by the rules for the purposes of this paragraph.</p>
              </content>
            </paragraph>
          </hcontainer>

            <heading>Breaching a launch facility licence condition</heading>
            <content>
              <p>The holder of a launch facility licence must not contravene a condition of the licence.</p>

            <heading>Transfer of launch facility licence</heading>

                <p><role refersTo="#minister">The Minister</role> may, by written notice, transfer a launch facility licence to another person if <role refersTo="#minister">the Minister</role> could grant the licence to the other person under section 18.</p>

                <p>The licence continues to cover the same launch facility.</p>

                <p>The licence is subject to the same conditions as those in force immediately before the transfer (unless <role refersTo="#minister">the Minister</role> varies the conditions).</p>

                <p>The period for which the licence remains in force continues to run despite the transfer.</p>

            <heading>Varying or revoking a launch facility licence</heading>

                <p><role refersTo="#minister">The Minister</role> may, in writing, vary or revoke a launch facility licence held by a person.</p>

            <heading>Applying for the grant, variation or transfer of a launch facility licence</heading>

                <p>An application for the grant, variation or transfer of a launch facility licence must be made in accordance with the rules.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-24__subclause-2">

              <content>
                <p>Without limiting subsection (1), the rules may provide for the lodging of documents at times worked out in accordance with the rules.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-25">
            <num>25</num>
            <heading>Procedure etc.</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-25__subclause-1">
              <num>1</num>
              <content>
                <p>If <role refersTo="#minister">the Minister</role> considers that there may be grounds to vary, revoke or transfer a launch facility licence (other than at the licensee’s request), <role refersTo="#minister">the Minister</role> must:</p>
              </content>
            </hcontainer>

              <num>a</num>
              <content>
                <p>give the licensee written notice of <role refersTo="#minister">the Minister</role>’s opinion specifying the reasons for that opinion; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-25__para-b">
              <num>b</num>
              <content>
                <p>invite the licensee to make a written submission to <role refersTo="#minister">the Minister</role> about the matter within a reasonable period specified in the notice.</p>
              </content>
            </paragraph>

              <num>2</num>
              <content>
                <p>In deciding whether to vary, revoke or transfer a launch facility licence, <role refersTo="#minister">the Minister</role> must consider the matters raised in any submission received within the period specified in the notice.</p>

                <p><role refersTo="#minister">The Minister</role> must not vary a launch facility licence in a way that changes the location of the licensed launch facility.</p>

              <content>
                <p>The rules may prescribe other ways in which <role refersTo="#minister">the Minister</role> must not vary a launch facility licence.</p>
              </content>
            </hcontainer>
          </hcontainer>

            <heading>Suspending a launch facility licence</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-26__subclause-1">

                <p><role refersTo="#minister">The Minister</role> may, in writing, suspend a launch facility licence if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-26__para-a">
              <num>a</num>
              <content>
                <p>the holder of the licence contravenes a condition of the licence; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-26__para-b">
              <num>b</num>
              <content>
                <p><role refersTo="#minister">the Minister</role> considers that, for reasons relevant to the security, defence or international relations of Australia, the licence should be suspended.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-26__subclause-2">
              <num>2</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> must give notice of the suspension to the holder of the licence. The notice must specify the day the suspension takes effect.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-26__subclause-3">
              <num>3</num>
              <content>
                <p>A launch facility licence has no effect while suspended, but the period for which it remains in force continues to run despite the suspension.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-26__subclause-4">

              <content>
                <p><role refersTo="#minister">The Minister</role> may, in writing, revoke a suspension under subsection (1).</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-26__subclause-5">
              <num>5</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> must give notice of the revocation to the holder of the licence. The notice must specify the day the revocation takes effect.</p>
              </content>
            </hcontainer>

              <content>
                <p><role refersTo="#minister">The Minister</role> may vary or revoke a launch facility licence even while it is suspended.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-27">
            <num>27</num>
            <heading>Basis on which launch facility licence is granted</heading>
            <content>
              <p>		A launch facility licence<i> </i>is granted on the basis that:</p>
            </content>
            <paragraph eId="schedule-1__clause-27__para-a">
              <num>a</num>
              <content>
                <p>the licence may be transferred under <ref href="#sec-22">section 22</ref>; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-27__para-b">
              <num>b</num>
              <content>
                <p>the licence may be revoked under <ref href="#sec-23">section 23</ref>; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-27__para-c">
              <num>c</num>
              <content>
                <p>the licence may be varied under <ref href="#sec-23">section 23</ref>; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-27__para-d">
              <num>d</num>
              <content>
                <p>the licence may be suspended under <ref href="#sec-26">section 26</ref>; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-27__para-e">
              <num>e</num>
              <content>
                <p>the licence may be transferred, revoked, varied or suspended by or under later legislation; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-27__para-f">
              <num>f</num>
              <content>
                <p>no compensation is payable if the licence is transferred, revoked, varied or suspended as mentioned in any of the above paragraphs.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-28">
            <num>28</num>
            <heading>Granting an Australian launch permit</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-28__subclause-1">
              <num>1</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may grant to a person an Australian launch permit authorising:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-28__para-a">
              <num>a</num>
              <content>
                <p>the launch of one or more space objects; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-28__para-b">
              <num>b</num>
              <content>
                <p>a particular series of launches of space objects that, in <role refersTo="#minister">the Minister</role>’s opinion, having regard to the nature of any payloads to be carried, may appropriately be authorised by a single Australian launch permit;</p>
              </content>
            </paragraph>
            <content>
              <p>from a specified launch facility in Australia, a specified Australian aircraft that is in flight or a specified foreign aircraft that is in the airspace over Australian territory.</p>
              <p>Note:	A returning space object need not be the same as the space object launched. For example, a launch vehicle could carry a payload into an area beyond the distance of 100 km above mean sea level and return without it, or even collect a different payload from an area beyond the distance of 100 km above mean sea level and return that to Earth.</p>
            </content>
            <hcontainer name="subclause" eId="schedule-1__clause-28__subclause-2">
              <num>2</num>
              <content>
                <p>The Australian launch permit may also authorise one or more space objects to be returned, in connection with the launch or launches, to a specified place or area in Australia.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-28__subclause-3">
              <num>3</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may grant the Australian launch permit to the person only if all of the following criteria are met:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-28__para-a">
              <num>a</num>
              <content>
                <p><role refersTo="#minister">the Minister</role> is satisfied that the person who is to carry out the launch or launches, and any connected return, is competent to do so;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-28__para-b">
              <num>b</num>
              <content>
                <p><role refersTo="#minister">the Minister</role> is satisfied that the insurance/financial requirements in Division 7 will be satisfied for the launch or launches, and any connected return;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-28__para-c">
              <num>c</num>
              <content>
                <p><role refersTo="#minister">the Minister</role> is satisfied that the probability of the launch or launches, or any connected return, causing substantial harm to public health or public safety or causing substantial damage to property is as low as is reasonably practicable;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-28__para-d">
              <num>d</num>
              <content>
                <p>the space object or objects concerned are not and do not contain a nuclear weapon or a weapon of mass destruction of any other kind;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-28__para-e">
              <num>e</num>
              <content>
                <p><role refersTo="#minister">the Minister</role> does not consider that, for reasons relevant to the security, defence or international relations of Australia, the permit should not be granted;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-28__para-f">
              <num>f</num>
              <content>
                <p>any other criteria prescribed by the rules for the purposes of this paragraph.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-28__subclause-4">

                <p>If a foreign country is also a launching State for the space object or any of the space objects, <role refersTo="#minister">the Minister</role> may, in deciding whether to grant the Australian launch permit, have regard to:</p>
              </content>
            </hcontainer>

              <num>a</num>
              <content>
                <p>whether there is an agreement between Australia and that foreign country under which that foreign country assumes any liability, and indemnifies Australia, for any damage that the space object or objects may cause; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-28__para-b">
              <num>b</num>
              <content>
                <p>the terms of that agreement.</p>
              </content>
            </paragraph>

                <p>Subsections (3) and (4) do not limit the matters to which <role refersTo="#minister">the Minister</role> may have regard.</p>

            <heading>Terms of Australian launch permit</heading>

                <p>An Australian launch permit authorising the launch of a space object or objects, and any connected return:</p>

                <p>must specify the day on which the permit comes into force and the period for which it remains in force; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-29__para-b">

                <p>is granted subject to the conditions in <ref href="#sec-30">section 30</ref> and any other conditions specified in the permit.</p>
              </content>
            </paragraph>

                <p>An Australian launch permit may specify that the period for which it remains in force ends on the occurrence of a particular event (rather than at a specified time). For this purpose, the rules may set out how to determine when events of a particular kind occur.</p>

              <p>Example:	An Australian launch permit might specify that it expires when the relevant launch has been (successfully or unsuccessfully) completed. The rules could set out how to determine when this is.</p>
            </content>

                <p>At any time when an Australian launch permit is in force, <role refersTo="#minister">the Minister</role> may, by written notice given to the holder of the permit, extend or further extend the period for which the permit remains in force.</p>

            <heading>Standard Australian launch permit conditions</heading>
            <content>
              <p>The following are conditions of each Australian launch permit, except to the extent that the permit otherwise specifies:</p>

              <num>a</num>
              <content>
                <p>the launch or launches, and any connected return, must not be conducted in a way that is likely to cause substantial harm to public health or public safety or to cause substantial damage to property;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30__para-b">
              <num>b</num>
              <content>
                <p>the space object or objects must not be or contain a nuclear weapon or a weapon of mass destruction of any other kind;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30__para-c">
              <num>c</num>
              <content>
                <p>the space object or objects must not contain a nuclear power source unless <role refersTo="#minister">the Minister</role>’s written approval has first been obtained;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30__para-d">

                <p>the holder of the permit must satisfy the insurance/financial requirements in <ref href="#dvs-7">Division 7</ref> for each launch, and each return, conducted under the permit;</p>
              </content>
            </paragraph>

                <p>any other conditions prescribed by the rules for the purposes of this paragraph.</p>

                <p>The strategy must address the matters prescribed by the rules for the purposes of this subsection.</p>

                <p>Subsection (3) does not limit the matters that may be included in the strategy.</p>

                <p>If <role refersTo="#minister">the Minister</role> considers that there may be grounds to vary, revoke or transfer an Australian launch permit (other than at the permit holder’s request), <role refersTo="#minister">the Minister</role> must:</p>

                <p>give the holder of the permit written notice of <role refersTo="#minister">the Minister</role>’s opinion specifying the reasons for that opinion; and</p>

                <p>invite the holder to make a written submission to <role refersTo="#minister">the Minister</role> about the matter within a reasonable period specified in the notice.</p>

            <heading>Suspending an Australian launch permit</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-36__subclause-1">
              <num>1</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may, in writing, suspend an Australian launch permit if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-36__para-a">
              <num>a</num>
              <content>
                <p>the holder of the permit contravenes a condition of the permit; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-36__para-b">
              <num>b</num>
              <content>
                <p><role refersTo="#minister">the Minister</role> considers that, for reasons relevant to the security, defence or international relations of Australia, the permit should be suspended; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-36__para-c">
              <num>c</num>
              <content>
                <p>an incident involving a space object covered by the permit occurs during the liability period for the launch or return of the object.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-36__subclause-2">

              <content>
                <p><role refersTo="#minister">The Minister</role> must give notice of the suspension to the holder of the permit. The notice must specify the day the suspension takes effect.</p>

                <p>An Australian launch permit has no effect while suspended, but the period for which it remains in force continues to run despite the suspension.</p>

                <p><role refersTo="#minister">The Minister</role> may, in writing, revoke a suspension under subsection (1).</p>

                <p><role refersTo="#minister">The Minister</role> must give notice of the revocation to the holder of the permit. The notice must specify the day the revocation takes effect.</p>

            <heading>Basis on which Australian launch permit is granted</heading>
            <content>
              <p>		An Australian launch permit<i> </i>is granted on the basis that:</p>
            </content>
            <paragraph eId="schedule-1__clause-37__para-a">
              <num>a</num>
              <content>
                <p>the permit may be transferred under <ref href="#sec-32">section 32</ref>; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-37__para-b">
              <num>b</num>
              <content>
                <p>the permit may be revoked under <ref href="#sec-33">section 33</ref>; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-37__para-c">
              <num>c</num>
              <content>
                <p>the permit may be varied under <ref href="#sec-33">section 33</ref>; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-37__para-d">
              <num>d</num>
              <content>
                <p>the permit may be suspended under <ref href="#sec-36">section 36</ref>; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-37__para-e">
              <num>e</num>

                <p>the permit may be transferred, revoked, varied or suspended by or under later legislation; and</p>
              </content>
            </paragraph>

                <p>no compensation is payable if the permit is transferred, revoked, varied or suspended as mentioned in any of the above paragraphs.</p>
              </content>
            </paragraph>
          </hcontainer>

            <heading>Granting an Australian high power rocket permit</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-38__subclause-1">
              <num>1</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may grant to a person an Australian high power rocket permit authorising the launch of a high power rocket from a specified facility (whether fixed or mobile), or specified place, in Australia.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-38__subclause-2">
              <num>2</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may grant the Australian high power rocket permit to the person only if all of the following criteria are met:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-38__para-a">
              <num>a</num>
              <content>
                <p><role refersTo="#minister">the Minister</role> is satisfied that the person who is to carry out the launch is competent to do so;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-38__para-b">
              <num>b</num>
              <content>
                <p><role refersTo="#minister">the Minister</role> is satisfied that the insurance/financial requirements in Division 7 will be satisfied for the launch;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-38__para-c">
              <num>c</num>
              <content>
                <p><role refersTo="#minister">the Minister</role> is satisfied that the probability of the launch causing substantial harm to public health or public safety or causing substantial damage to property is as low as is reasonably practicable;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-38__para-d">
              <num>d</num>
              <content>
                <p><role refersTo="#minister">the Minister</role> does not consider that, for reasons relevant to the security, defence or international relations of Australia, the permit should not be granted;</p>
              </content>
            </paragraph>

              <num>e</num>
              <content>
                <p>any other criteria prescribed by the rules for the purposes of this paragraph.</p>
              </content>
            </paragraph>
          </hcontainer>

            <heading>Terms of Australian high power rocket permit</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-39__subclause-1">
              <num>1</num>
              <content>
                <p>An Australian high power rocket permit authorising the launch of a high power rocket:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-39__para-a">
              <num>a</num>
              <content>
                <p>must specify the day on which the permit comes into force and the period for which it remains in force; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-39__para-b">
              <num>b</num>
              <content>
                <p>is granted subject to the conditions in <ref href="#sec-40">section 40</ref> and any other conditions specified in the permit.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-39__subclause-2">
              <num>2</num>
              <content>
                <p>An Australian high power rocket permit may specify that the period for which it remains in force ends on the occurrence of a particular event (rather than at a specified time). For this purpose, the rules may set out how to determine when events of a particular kind occur.</p>
              </content>
            </hcontainer>
            <content>
              <p>Example:	An Australian high power rocket permit might specify that it expires when the relevant launch has been (successfully or unsuccessfully) completed. The rules could set out how to determine when this is.</p>
            </content>
            <hcontainer name="subclause" eId="schedule-1__clause-39__subclause-3">
              <num>3</num>
              <content>
                <p>At any time when an Australian high power rocket permit is in force, <role refersTo="#minister">the Minister</role> may, by written notice given to the holder of the permit, extend or further extend the period for which the permit remains in force.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-40">
            <num>40</num>
            <heading>Standard Australian high power rocket permit conditions</heading>
            <content>
              <p>The following are conditions of each Australian high power rocket permit, except to the extent that the permit otherwise specifies:</p>
            </content>
            <paragraph eId="schedule-1__clause-40__para-a">
              <num>a</num>
              <content>
                <p>the launch must not be conducted in a way that is likely to cause substantial harm to public health or public safety or to cause substantial damage to property;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-40__para-b">
              <num>b</num>
              <content>
                <p>the holder of the permit must satisfy the insurance/financial requirements in <ref href="#dvs-7">Division 7</ref> for the launch conducted under the permit;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-40__para-c">
              <num>c</num>
              <content>
                <p>any other conditions prescribed by the rules for the purposes of this paragraph.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-41">

            <heading>Breaching an Australian high power rocket permit condition</heading>
            <content>

                <p>the act or omission contravenes a condition of the permit; and</p>

            </paragraph>
            <paragraph eId="schedule-1__clause-41__para-d">
              <num>d</num>

                <p>the condition is a condition to which the permit is subject under paragraph 40(a) or (b).</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-41__para-a">

                <p>for an individual—<quantity refersTo="#custodialSentence">imprisonment for 10 year</quantity> or <quantity refersTo="#penaltyUnit">5,500 penalty units</quantity>, or both; or</p>

                <p><role refersTo="#minister">The Minister</role> may, by written notice, transfer an Australian high power rocket permit to another person if <role refersTo="#minister">the Minister</role> could grant the permit to the other person under section 38.</p>

                <p>The permit continues to cover the same facility or place and the same high power rocket.</p>

                <p>The permit is subject to the same conditions as those in force immediately before the transfer (unless <role refersTo="#minister">the Minister</role> varies the conditions).</p>

                <p>an incident involving the high power rocket covered by the permit occurs during the liability period for the launch of the rocket.</p>

                <p><role refersTo="#minister">The Minister</role> may grant to a person an overseas payload permit authorising:</p>

            </hcontainer>

              <num>a</num>
              <content>
                <p>the launch of one or more space objects; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-46B__para-b">
              <num>b</num>
              <content>
                <p>a particular series of launches of space objects that, in <role refersTo="#minister">the Minister</role>’s opinion, having regard to the nature of any payloads to be carried, may appropriately be authorised by a single overseas payload permit;</p>
              </content>
            </paragraph>
            <content>

              <p>Note:	Overseas payload permits are required only if an Australian national would be a responsible party for the launch—see <ref href="#sec-14">section 14</ref>.</p>

              <num>2</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may grant the overseas payload permit to the person only if all of the following criteria are met:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-46B__para-a">
              <num>a</num>
              <content>
                <p>either:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-46B__para-i">
              <num>i</num>
              <content>
                <p><role refersTo="#minister">the Minister</role> is satisfied that the insurance/financial requirements in Division 7 will be satisfied for each launch to be conducted under the permit; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-46B__para-ii">
              <num>ii</num>
              <content>
                <p><role refersTo="#minister">the Minister</role> notifies the person, in writing, that, having regard to the nature and purpose of the space object or space objects concerned, those requirements are not required to be satisfied;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-46B__para-b">
              <num>b</num>
              <content>
                <p><role refersTo="#minister">the Minister</role> is satisfied that the probability of the launch or launches causing substantial harm to public health or public safety or causing substantial damage to property is sufficiently low;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-46B__para-c">
              <num>c</num>
              <content>
                <p><role refersTo="#minister">the Minister</role> does not consider that, for reasons relevant to the security, defence or international relations of Australia, the permit should not be granted;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-46B__para-d">
              <num>d</num>
              <content>
                <p>any other criteria prescribed by the rules for the purposes of this paragraph.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-46B__subclause-3">
              <num>3</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may, in deciding whether to grant the overseas payload permit, have regard to:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-46B__para-a">
              <num>a</num>
              <content>
                <p>whether there is an agreement or arrangement between Australia and the other launching State, or any of the other launching States, under which that State or those States assume liability, and indemnify Australia, for any damage that the space object or objects may cause; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-46B__para-b">
              <num>b</num>
              <content>
                <p>the terms of that agreement or arrangement.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-46B__subclause-4">
              <num>4</num>
              <content>
                <p>Subsections (2) and (3) do not limit the matters to which <role refersTo="#minister">the Minister</role> may have regard.</p>
              </content>
            </hcontainer>
          </hcontainer>

            <heading>Terms of overseas payload permit</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-46C__subclause-1">
              <num>1</num>
              <content>
                <p>An overseas payload permit authorising the launch of a space object or objects:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-46C__para-a">
              <num>a</num>
              <content>
                <p>must specify the day on which it comes into force and the period for which it remains in force; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-46C__para-b">
              <num>b</num>
              <content>
                <p>is granted subject to any conditions specified in the permit.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-46C__subclause-2">
              <num>2</num>
              <content>
                <p>An overseas payload permit may specify that the period for which it remains in force ends on the occurrence of a particular event (rather than at a specified time). For this purpose, the rules may set out how to determine when events of a particular kind occur.</p>
              </content>
            </hcontainer>
            <content>
              <p>Example:	An overseas payload permit might specify that its period expires when the relevant launch has been (successfully or unsuccessfully) completed. The rules could set out how to determine when this is.</p>
            </content>
            <hcontainer name="subclause" eId="schedule-1__clause-46C__subclause-3">
              <num>3</num>
              <content>
                <p>At any time when an overseas payload permit is in force, <role refersTo="#minister">the Minister</role> may, by written notice given to the holder of the permit, extend or further extend the period for which the permit remains in force.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-46D">
            <num>46D</num>
            <heading>Breaching an overseas payload permit condition</heading>
            <content>
              <p>The holder of an overseas payload permit must not contravene a condition of the permit.</p>
              <p>Civil penalty:	<quantity refersTo="#penaltyUnit">1,000 penalty units</quantity>.</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-46E">
            <num>46E</num>
            <heading>Transfer of overseas payload permit</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-46E__subclause-1">
              <num>1</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may, by written notice, transfer an overseas payload permit to another person if <role refersTo="#minister">the Minister</role> could grant the permit to the other person under section 46B.</p>
              </content>
            </hcontainer>
            <content>
              <p>Note:	See <ref href="#sec-46H">section 46H</ref> for the procedure for transferring an overseas payload permit.</p>
            </content>
            <hcontainer name="subclause" eId="schedule-1__clause-46E__subclause-2">

                <p>The transfer takes effect at the time specified in the notice.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-46E__subclause-3">

                <p><role refersTo="#minister">The Minister</role> must give a copy of the notice to:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-46E__para-a">
              <num>a</num>
              <content>
                <p>the holder of the permit immediately before the transfer; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-46E__para-b">
              <num>b</num>
              <content>
                <p>the other person.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-46E__subclause-4">
              <num>4</num>
              <content>
                <p>The permit continues to cover the same facility or place, the same launch vehicle and the same space object or objects.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-46E__subclause-5">
              <num>5</num>
              <content>
                <p>The permit is subject to the same conditions as those in force immediately before the transfer (unless <role refersTo="#minister">the Minister</role> varies the conditions).</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-46E__subclause-6">
              <num>6</num>
              <content>
                <p>The period for which the permit remains in force continues to run despite the transfer.</p>
              </content>
            </hcontainer>
          </hcontainer>

            <heading>Varying or revoking an overseas payload permit</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-46F__subclause-1">
              <num>1</num>

                <p><role refersTo="#minister">The Minister</role> may, in writing, vary or revoke an overseas payload permit held by a person.</p>
              </content>
            </hcontainer>

            <heading>Applying for the grant, variation or transfer of an overseas payload permit</heading>

                <p>An application for the grant, variation or transfer of an overseas payload permit must be made in accordance with the rules.</p>
              </content>
            </hcontainer>
            <content>
              <p>Debris mitigation strategy</p>
            </content>
            <hcontainer name="subclause" eId="schedule-1__clause-46G__subclause-2">
              <num>2</num>
              <content>
                <p>Without limiting subsection (1), an application for the grant of an overseas payload permit must include a strategy for debris mitigation.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-46G__subclause-3">
              <num>3</num>
              <content>
                <p>The strategy must address the matters prescribed by the rules for the purposes of this subsection.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-46G__subclause-4">
              <num>4</num>
              <content>
                <p>Subsection (3) does not limit the matters that may be included in the strategy.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-46H">
            <num>46H</num>
            <heading>Procedure etc.</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-46H__subclause-1">
              <num>1</num>
              <content>
                <p>If <role refersTo="#minister">the Minister</role> considers that there may be grounds to vary, revoke or transfer an overseas payload permit (other than at the permit holder’s request), <role refersTo="#minister">the Minister</role> must:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-46H__para-a">
              <num>a</num>
              <content>
                <p>give the holder of the permit written notice of <role refersTo="#minister">the Minister</role>’s opinion specifying the reasons for that opinion; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-46H__para-b">
              <num>b</num>
              <content>
                <p>invite the holder to make a written submission to <role refersTo="#minister">the Minister</role> about the matter within a reasonable period specified in the notice.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-46H__subclause-2">
              <num>2</num>
              <content>
                <p>In deciding whether to vary, revoke or transfer the permit, <role refersTo="#minister">the Minister</role> must consider the matters raised in any submission received within the period specified in the notice.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-46H__subclause-3">
              <num>3</num>
              <content>
                <p>The rules may prescribe the ways in which <role refersTo="#minister">the Minister</role> must not vary an overseas payload permit.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-46J">
            <num>46J</num>
            <heading>Suspending an overseas payload permit</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-46J__subclause-1">
              <num>1</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may, in writing, suspend an overseas payload permit if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-46J__para-a">
              <num>a</num>
              <content>
                <p>the holder of the permit contravenes a condition of the permit; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-46J__para-b">
              <num>b</num>
              <content>
                <p>if subparagraph 46B(2)(a)(i) applied—<role refersTo="#minister">the Minister</role> is satisfied that the insurance/financial requirements in Division 7 are not satisfied for a launch to be conducted under the permit; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-46J__para-c">
              <num>c</num>
              <content>
                <p><role refersTo="#minister">the Minister</role> considers that, for reasons relevant to the security, defence or international relations of Australia, the permit should be suspended.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-46J__subclause-2">
              <num>2</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> must give notice of the suspension to the holder of the permit. The notice must specify the day the suspension takes effect.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-46J__subclause-3">
              <num>3</num>
              <content>
                <p>An overseas payload permit has no effect while suspended, but the period for which it remains in force continues to run despite the suspension.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-46J__subclause-4">
              <num>4</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may, in writing, revoke a suspension under subsection (1).</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-46J__subclause-5">
              <num>5</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> must give notice of the revocation to the holder of the permit. The notice must specify the day the revocation takes effect.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-46J__subclause-6">
              <num>6</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may vary or revoke an overseas payload permit even while it is suspended.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-46K">
            <num>46K</num>
            <heading>Basis on which overseas payload permit is granted</heading>
            <content>
              <p>		An overseas payload permit<i> </i>is granted on the basis that:</p>
            </content>
            <paragraph eId="schedule-1__clause-46K__para-a">
              <num>a</num>
              <content>
                <p>the permit may be transferred under <ref href="#sec-46E">section 46E</ref>; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-46K__para-b">
              <num>b</num>
              <content>
                <p>the permit may be revoked under <ref href="#sec-46F">section 46F</ref>; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-46K__para-c">
              <num>c</num>
              <content>
                <p>the permit may be varied under <ref href="#sec-46F">section 46F</ref>; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-46K__para-d">
              <num>d</num>
              <content>
                <p>the permit may be suspended under <ref href="#sec-46J">section 46J</ref>; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-46K__para-e">
              <num>e</num>
              <content>
                <p>the permit may be transferred, revoked, varied or suspended by or under later legislation; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-46K__para-f">
              <num>f</num>
              <content>
                <p>no compensation is payable if the permit is transferred, revoked, varied or suspended as mentioned in any of the above paragraphs.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-46L">
            <num>46L</num>
            <heading>Giving a return authorisation</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-46L__subclause-1">
              <num>1</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may give a person a return authorisation that authorises:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-46L__para-a">
              <num>a</num>
              <content>
                <p>the return of a space object to a specified place or area in Australia or outside Australia; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-46L__para-b">
              <num>b</num>
              <content>
                <p>a particular series of such returns that, in <role refersTo="#minister">the Minister</role>’s opinion, having regard to the nature of the space objects to be returned, may appropriately be authorised by a single return authorisation.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-46L__subclause-2">
              <num>2</num>
              <content>
                <p>The return or returns may be authorised under this section only if all of the following criteria are met:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-46L__para-a">
              <num>a</num>
              <content>
                <p><role refersTo="#minister">the Minister</role> is satisfied that the person who is to carry out the return or returns is competent to do so;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-46L__para-b">
              <num>b</num>
              <content>
                <p><role refersTo="#minister">the Minister</role> is satisfied that the insurance/financial requirements in Division 7 will be satisfied for the return or returns;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-46L__para-c">
              <num>c</num>
              <content>
                <p><role refersTo="#minister">the Minister</role> is satisfied that the probability of the return or returns causing substantial harm to public health or public safety or causing substantial damage to property is as low as is reasonably practicable;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-46L__para-d">
              <num>d</num>
              <content>
                <p>the space object or objects concerned are not and do not contain a nuclear weapon or a weapon of mass destruction of any other kind;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-46L__para-e">
              <num>e</num>
              <content>
                <p><role refersTo="#minister">the Minister</role> does not consider that, for reasons relevant to the security, defence or international relations of Australia, the authorisation should not be given;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-46L__para-f">
              <num>f</num>
              <content>
                <p>any other criteria prescribed by the rules for the purposes of this paragraph.</p>
              </content>
            </paragraph>

                <p><role refersTo="#minister">The Minister</role> may, in deciding whether to give a return authorisation, have regard to:</p>
              </content>

                <p>whether there is an agreement or arrangement between Australia and any country that is a launching State for any space object concerned under which that country assumes any liability, and indemnifies Australia, for any damage that the space object may cause; and</p>

            </paragraph>
            <paragraph eId="schedule-1__clause-46L__para-b">
              <num>b</num>
              <content>
                <p>the terms of that agreement or arrangement.</p>
              </content>
            </paragraph>

                <p>the return is conducted in a way that is likely to cause substantial harm to public health or public safety or to cause substantial damage to property;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-46M__para-ii">
              <num>ii</num>
              <content>
                <p>the space object is or contains a nuclear weapon or a weapon of mass destruction of any other kind;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-46M__para-iii">
              <num>iii</num>
              <content>
                <p>the space object contains a nuclear power source and <role refersTo="#minister">the Minister</role>’s written approval for this has not first been obtained;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-46M__para-iv">
              <num>iv</num>
              <content>
                <p>the insurance/financial requirements in <ref href="#dvs-7">Division 7</ref> are not satisfied for the return.</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-46M__para-a">
              <num>a</num>
              <content>
                <p>for an individual—<quantity refersTo="#custodialSentence">imprisonment for 10 years</quantity> or <quantity refersTo="#penaltyUnit">5,500 penalty units</quantity>, or both; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-46M__para-b">
              <num>b</num>

                <p>for a body corporate—<quantity refersTo="#penaltyUnit">100,000 penalty units</quantity>.</p>

                <p>the space object is or contains a nuclear weapon or a weapon of mass destruction of any other kind;</p>
              </content>
            </paragraph>

                <p>the space object contains a nuclear power source and <role refersTo="#minister">the Minister</role>’s written approval for this has not first been obtained;</p>

            <heading>Suspending a return authorisation</heading>

                <p><role refersTo="#minister">The Minister</role> may, in writing, suspend a return authorisation if:</p>
              </content>
            </hcontainer>

                <p>the holder of the authorisation contravenes a condition of the authorisation; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-46S__para-b">
              <num>b</num>
              <content>
                <p><role refersTo="#minister">the Minister</role> considers that, for reasons relevant to the security, defence or international relations of Australia, the authorisation should be suspended; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-46S__para-c">
              <num>c</num>
              <content>
                <p>an incident involving a space object covered by the authorisation occurs during the liability period for the return of the object.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-46S__subclause-2">

                <p><role refersTo="#minister">The Minister</role> must give notice of the suspension to the holder of the authorisation. The notice must specify the day the suspension takes effect.</p>

                <p>A return authorisation has no effect while suspended.</p>
              </content>

            <heading>Basis on which return authorisation is given</heading>
            <content>
              <p>A return authorisation is given on the basis that:</p>
            </content>

                <p>the authorisation may be revoked under <ref href="#sec-46P">section 46P</ref>; and</p>
              </content>
            </paragraph>

                <p>the authorisation may be varied under <ref href="#sec-46P">section 46P</ref>; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-46T__para-c">

                <p>the authorisation may be suspended under <ref href="#sec-46S">section 46S</ref>; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-46T__para-d">

                <p>the authorisation may be revoked, varied or suspended by or under later legislation; and</p>

            </paragraph>

                <p><role refersTo="#minister">The Minister</role> may issue to any person an authorisation certificate covering specified conduct that might otherwise be prohibited by section 11, 12, 13, 14, 15 or 15A.</p>

              <p>Note:	Under subsection 33(3A) of the <i>Acts Interpretation Act 1901</i>, conduct may be specified by reference to a particular class or classes of conduct.</p>
              <p>Example:	The rules might set out criteria such as whether a launch would be in the national interest or would confer a significant national benefit, whether there is a risk that a launch might cause substantial harm to public health or public safety or damage to property or whether there is a risk that a launch might expose the Commonwealth to liability for damage caused.</p>
