            <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

                <p>An approved course provider to whom <ref href="#part-5A">Part 5A</ref> applies must pay the following when it is due and payable by the provider:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-49A__para-a">
              <num>a</num>
              <content>
                <p>VSL tuition protection levy;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-49A__para-b">
              <num>b</num>
              <content>
                <p>any penalty for late payment of VSL tuition protection levy.</p>
              </content>
            </paragraph>
            <content>
              <p>Note 1:	VSL tuition protection levy is imposed by the <i>VET Student Loans (VSL Tuition Protection Levy) Act 201</i><i>9</i>. Amounts of levy for a year are either determined before, or indexed on, 1 August in the year: see sections 9 and 10 of that Act.</p>
              <p>Note 2:	See <ref href="#sec-66A">section 66A</ref> for the providers to whom <ref href="#part-5A">Part 5A</ref> applies.</p>
            </content>

                <p>The rules may make provision for, or in relation to, all or any of the following matters:</p>
              </content>
            </hcontainer>

                <p>the issue of notices setting out the amount of VSL tuition protection levy payable by a provider;</p>
              </content>
            </paragraph>

                <p>when VSL tuition protection levy is due and payable;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-49A__para-c">
              <num>c</num>

                <p>the issue of notices extending the time for payment of VSL tuition protection levy;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-49A__para-d">
              <num>d</num>
              <content>
                <p>penalties for late payment of VSL tuition protection levy;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-49A__para-e">
              <num>e</num>
              <content>
                <p>to whom VSL tuition protection levy and any penalties for late payment are payable;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-49A__para-f">

                <p>the refund, remission or waiver of VSL tuition protection levy or penalties for late payment;</p>
              </content>
            </paragraph>

                <p>the notional liability of the Commonwealth to pay VSL tuition protection levy;</p>
              </content>
            </paragraph>

                <p>the review of decisions made under the rules in relation to the collection or recovery of VSL tuition protection levy;</p>
              </content>
            </paragraph>

                <p>Despite subsection (1), sections 66F and 66G apply to all approved course providers.</p>

              <p>Note:	Section 66F deals with provider obligations to provide information about replacement courses and <ref href="#sec-66G">section 66G</ref> deals with obligations of providers who provide replacement courses.</p>

          </hcontainer>

            <heading>When an approved course provider defaults in relation to a student</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-66B__subclause-1">
              <num>1</num>
              <content>
                <p>	(1)	An approved course provider <b><i>defaults</i></b> in relation to a student if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-66B__para-a">
              <num>a</num>
              <content>
                <p>the provider fails to start to provide a course or a part of a course to the student on the day on which the course or part was scheduled to start; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66B__para-b">
              <num>b</num>
              <content>
                <p>the student has not withdrawn before that day; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66B__para-c">
              <num>c</num>
              <content>
                <p>either:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66B__para-i">
              <num>i</num>
              <content>
                <p>a VET student loan has been approved for the student for the course on or before that day; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66B__para-ii">
              <num>ii</num>
              <content>
                <p>the student is an eligible student for the course and has a HELP balance of greater than zero on that day.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-66B__subclause-2">
              <num>2</num>
              <content>
                <p>	(2)	An approved course provider <b><i>defaults</i></b> in relation to a student if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-66B__para-a">
              <num>a</num>
              <content>
                <p>the provider ceases to provide a course or a part of a course to the student on a day that is after the course or part starts but before it is completed; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66B__para-b">
              <num>b</num>
              <content>
                <p>the student has not withdrawn before that day; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66B__para-c">
              <num>c</num>
              <content>
                <p>either:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66B__para-i">
              <num>i</num>
              <content>
                <p>a VET student loan has been approved for the student for the course on or before that day; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66B__para-ii">
              <num>ii</num>
              <content>
                <p>the student is an eligible student for the course and has a HELP balance of greater than zero on that day.</p>
              </content>
            </paragraph>

              <num>3</num>
              <content>
                <p>	(3)	An approved course provider <b><i>defaults</i></b> in relation to a student if circumstances prescribed by the rules apply in relation to the provider and the student.</p>

                <p>This section applies if an approved course provider defaults in relation to a student.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-66C__subclause-2">
              <num>2</num>
              <content>
                <p>The approved course provider must, within 24 hours of the default occurring, give written notice to the VSL Tuition Protection Director of the circumstances of the default.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-66C__subclause-3">
              <num>3</num>
              <content>
                <p>The approved course provider must, within 3 business days of the default occurring, give a written notice to the VSL Tuition Protection Director specifying:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-66C__para-a">
              <num>a</num>
              <content>
                <p>the following information for each student in relation to whom the provider has defaulted:</p>
              </content>
            </paragraph>

                <p>details about the payment of those tuition fees, including the amounts that are covered fees; and</p>
              </content>
            </paragraph>

                <p>any other matter prescribed by the rules.</p>

            </paragraph>

                <p>If requested in writing by the VSL Tuition Protection Director, the approved course provider must give to the Director either of the following for a student in relation to whom the provider has defaulted:</p>

            </paragraph>

                <p>In deciding whether the VSL Tuition Protection Director is satisfied that there is a suitable replacement course for a student, the Director must have regard to the following matters:</p>
              </content>

              <num>a</num>
              <content>
                <p>whether the replacement course leads to the same or a comparable qualification as the original course;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66E__para-b">
              <num>b</num>
              <content>
                <p>whether the mode of delivery of the replacement course is the same as the mode of delivery of the original course;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66E__para-c">
              <num>c</num>
              <content>
                <p>the location where the replacement course for a student will be primarily delivered;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66E__para-d">
              <num>d</num>
              <content>
                <p>whether a student who enrols in the replacement course:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66E__para-i">
              <num>i</num>
              <content>
                <p>will incur additional fees that are unreasonable; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66E__para-ii">
              <num>ii</num>
              <content>
                <p>will be able to attend the course without unreasonable impacts on the student’s prior commitments;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66E__para-e">
              <num>e</num>
              <content>
                <p>any other matters prescribed by the rules.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-66E__subclause-3">
              <num>3</num>
              <content>
                <p>If paragraph (1)(a) applies, the VSL Tuition Protection Director must give a written notice to the student that includes the following:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-66E__para-a">
              <num>a</num>
              <content>
                <p>a description of each suitable replacement course, including the qualification that the course leads to;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66E__para-b">
              <num>b</num>
              <content>
                <p>the contact details of the provider of each suitable replacement course;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66E__para-c">
              <num>c</num>
              <content>
                <p>an explanation that, if tuition fees have been paid for the affected part of the original course, tuition fees would not be payable for the replacement component of the replacement course;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66E__para-d">
              <num>d</num>
              <content>
                <p>an explanation that if the student chooses to enrol in another course, there is no obligation on the provider of the other course to offer a replacement component without charge to the student;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66E__para-e">
              <num>e</num>
              <content>
                <p>an explanation of the matters the Director must have regard to under subsection (2);</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66E__para-f">
              <num>f</num>
              <content>
                <p>an explanation of the student’s right to request reconsideration, under <quantity refersTo="#deadline">within 28 days</quantity> after the day on which the student is given the notice (or such longer period as the Director allows);<ref href="#sec-76">section 76</ref>, of the Director’s decision </p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66E__para-g">
              <num>g</num>

                <p>an explanation that if, upon reconsideration, it is determined that there is no suitable replacement course for the student, an amount equal to the student’s loan amount that has been used to pay tuition fees for the student for the affected part will be re-credited to the student’s HELP balance;</p>

                <p>an explanation of the student’s right to request reconsideration, under <quantity refersTo="#deadline">within 28 days</quantity> after the day on which the student is given the notice (or such longer period as the Director allows);<ref href="#sec-76">section 76</ref>, of the Director’s decision </p>

            <paragraph eId="schedule-1__clause-66E__para-c">

                <p>a statement that, to facilitate early re-crediting, the student may, at any time during the 28 days, give the VSL Tuition Protection Director notice in writing that the student will not seek reconsideration of the decision;</p>

              <num>d</num>
              <content>
                <p>a statement that, if the decision is not reconsidered or is confirmed, an amount equal to the student’s loan amount that has been used to pay tuition fees for the student for the affected part will be re-credited to the student’s HELP balance.</p>

            <num>66F</num>
            <heading>Obligations of providers to provide information about replacement courses</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-66F__subclause-1">
              <num>1</num>
              <content>
                <p>The VSL Tuition Protection Director may, by notice in writing, require an approved course provider to provide such information that the Director reasonably requires to enable the Director to make a decision under subsection 66E(1) regarding suitable replacement courses for a student in relation to whom a provider has defaulted.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-66F__subclause-2">
              <num>2</num>
              <content>
                <p>The information must be provided:</p>

                <p>in a form (if any) approved by the VSL Tuition Protection Director for the information; and</p>

                <p>in accordance with such other requirements as the Director makes.</p>

                <p>The approved course provider who provides the replacement course must give written notice of the acceptance to the VSL Tuition Protection Director <quantity refersTo="#deadline">within 14 days</quantity> of the acceptance.</p>

              <num>3</num>

                <p>The approved course provider who provides the replacement course must ensure that the student:</p>
              </content>

                <p>is granted course credits for parts of the original course successfully completed by the student, as evidenced by:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66G__para-i">
              <num>i</num>
              <content>
                <p>a statement of attainment or other Australian Qualifications Framework certification documentation issued in accordance with the Australian Qualifications Framework; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66G__para-ii">
              <num>ii</num>
              <content>
                <p>	(ii)	an authenticated VET transcript prepared by the Registrar (within the meaning of the <i>Student Identifiers Act 2014</i>); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66G__para-b">
              <num>b</num>
              <content>
                <p>if tuition fees have been paid for the affected part of the original course—is not charged tuition fees for the replacement component of the replacement course; and</p>

                <p>is enrolled in the replacement course as soon as practicable.</p>

            <heading>Obligations where there is no replacement course</heading>

                <p>This section applies if:</p>

            <paragraph eId="schedule-1__clause-66H__para-a">
              <num>a</num>
              <content>
                <p>an approved course provider defaults in relation to a student; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66H__para-b">
              <num>b</num>
              <content>
                <p>the VSL Tuition Protection Director decides, under paragraph 66E(1)(b), that the Director is not satisfied that there is a suitable replacement course for the student.</p>
              </content>
            </paragraph>

              <num>2</num>
              <content>
                <p>The VSL Tuition Protection Director must give a written notice to <role refersTo="#secretary">the Secretary</role> of that fact.</p>

              <num>3</num>
              <content>
                <p>The VSL Tuition Protection Director must give a written notice to the provider:</p>
              </content>
            </hcontainer>

              <num>a</num>
              <content>
                <p>stating that an amount equal to the loan amount that has been used to pay tuition fees for the student for the affected part:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66H__para-i">
              <num>i</num>
              <content>
                <p>will be re-credited to the student’s HELP balance; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66H__para-ii">
              <num>ii</num>
              <content>
                <p>will be required to be paid by the provider to the Commonwealth; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66H__para-b">

                <p>inviting the provider to make written submissions to the Director about the amount of the re-credit <quantity refersTo="#deadline">within 28 days</quantity>.</p>

            <heading>Credits to the VSL Tuition Protection Fund</heading>
            <content>
              <p>There must be credited to the VSL Tuition Protection Fund amounts equal to the following:</p>
              <p>Note 1:	An Appropriation Act may contain a provision to the effect that, if any of the purposes of a special account is a purpose that is covered by an item in the Appropriation Act (whether or not the item expressly refers to the special account), then amounts may be debited against the appropriation for that item and credited to that special account.</p>
              <p>Note 2:	VSL tuition protection levy is imposed by the <i>VET Student Loans (VSL Tuition Protection Levy) Act 201</i><i>9</i>. The rules deal with collection of the levy (see subsection 49A(2)).</p>
            </content>

                <p>each amount of VSL tuition protection levy received from an approved course provider;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66K__para-b">

                <p>each amount paid by a course provider to the Commonwealth under <ref href="#sec-22">section 22</ref> that relates to an amount re-credited under <ref href="#sec-72A">section 72A</ref> if the balance of the Fund had previously been reduced under paragraph 66L(1)(f) in relation to that amount;</p>

            <heading>Purposes of the VSL Tuition Protection Fund</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-66L__subclause-1">
              <num>1</num>
              <content>
                <p>The purposes of the VSL Tuition Protection Fund are as follows:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-66L__para-a">
              <num>a</num>
              <content>
                <p>making payments in connection with tuition protection;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66L__para-b">
              <num>b</num>
              <content>
                <p>paying or discharging the costs, expenses and other obligations incurred by the Commonwealth in the performance of the VSL Tuition Protection Director’s functions, including in managing the VSL Tuition Protection Fund;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66L__para-c">
              <num>c</num>
              <content>
                <p>paying any remuneration and allowances payable to the VSL Tuition Protection Director;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66L__para-d">
              <num>d</num>
              <content>
                <p>paying any remuneration and allowances payable to the members of the VSL Tuition Protection Fund Advisory Board;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66L__para-e">
              <num>e</num>
              <content>
                <p>paying any amount that is required or permitted to be repaid;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66L__para-f">
              <num>f</num>
              <content>
                <p>reducing the balance of the Fund (and therefore the available appropriation for the Fund) without making a real or notional payment.</p>
              </content>
            </paragraph>
            <content>

                <p>the circumstances in which payments may be made;</p>

            </paragraph>

                <p>reporting to <role refersTo="#minister">the Minister</role> on:</p>

              <p>The HELP Tuition Protection Director must assist affected students to find replacement courses. If the Director is not satisfied that there is a suitable replacement course for an affected student, or if the student elects re-crediting, the student’s HELP balance is re-credited.</p>

            <heading>Application of this Part</heading>

                <p>This Part applies to higher education providers other than:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-166-5__para-a">
              <num>a</num>
              <content>
                <p>*Table A providers; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-166-5__para-b">
              <num>b</num>

                <p>providers of a kind prescribed by the Higher Education Provider Guidelines.</p>

                <p>Despite subsection (1), <role refersTo="#minister">the Minister</role> may, by written notice, determine that this Part:</p>

            <heading>When a higher education provider defaults in relation to a student</heading>

              </content>
            </paragraph>

                <p>the following information in relation to each student in relation to whom the provider has defaulted:</p>

                <p>the student’s full name and contact details;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-166-15__para-ii">
              <num>ii</num>
              <content>
                <p>the units of study and the *course of study that the student was enrolled in at the time of the default;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-166-15__para-iii">
              <num>iii</num>
              <content>
                <p>the amount of the tuition fees for each unit of study that the student was enrolled in at the time of the default;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-166-15__para-iv">
              <num>iv</num>
              <content>
                <p>details about the payment of those tuition fees; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-166-15__para-b">
              <num>b</num>
              <content>
                <p>any other matter prescribed by the Higher Education Provider Guidelines.</p>
              </content>
            </paragraph>

            </paragraph>

                <p>In deciding whether the *HELP Tuition Protection Director is satisfied that there is a suitable *replacement course, the Director must have regard to the following matters:</p>
              </content>

              <num>a</num>
              <content>
                <p>whether the replacement course leads to the same or a comparable qualification as the *original course;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-166-25__para-b">
              <num>b</num>
              <content>
                <p>what course credits the student may receive for the units of study of the original course successfully completed by the student;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-166-25__para-c">
              <num>c</num>
              <content>
                <p>whether the mode of delivery of the replacement course is the same as the mode of delivery of the original course;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-166-25__para-d">
              <num>d</num>
              <content>
                <p>the location where the replacement course for a student will be primarily delivered;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-166-25__para-e">
              <num>e</num>
              <content>
                <p>whether a student who enrols in the course:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-166-25__para-i">
              <num>i</num>
              <content>
                <p>will incur additional fees that are unreasonable; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-166-25__para-ii">
              <num>ii</num>
              <content>
                <p>will be able to attend the course without unreasonable impacts on the student’s prior commitments;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-166-25__para-f">
              <num>f</num>
              <content>
                <p>any other matters prescribed by the Higher Education Provider Guidelines.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-166-25__subclause-3">
              <num>3</num>
              <content>
                <p>If paragraph (1)(a) applies, the *HELP Tuition Protection Director must give a written notice to the student that includes the following:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-166-25__para-a">
              <num>a</num>
              <content>
                <p>a statement that the student may decide to do one of the following:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-166-25__para-i">

                <p>enrol in a suitable *replacement course;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-166-25__para-ii">
              <num>ii</num>

                <p>enrol in another course;</p>

            </paragraph>
            <paragraph eId="schedule-2__clause-166-25__para-iii">
              <num>iii</num>
              <content>
                <p>elect to have an amount equal to the amounts of *FEE-HELP assistance or *HECS-HELP assistance that the student received for the *affected unit *re-credited to the student’s *HELP balance;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-166-25__para-b">
              <num>b</num>
              <content>
                <p>a description of each suitable replacement course, including the qualification that the course leads to;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-166-25__para-c">
              <num>c</num>
              <content>
                <p>the contact details of the provider of each suitable replacement course;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-166-25__para-d">
              <num>d</num>
              <content>
                <p>an explanation that, if *tuition fees have been paid for the affected unit of the original course, tuition fees would not be payable for a *replacement unit of a suitable replacement course;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-166-25__para-e">
              <num>e</num>
              <content>
                <p>an explanation that if the student chooses to enrol in another course, there is no obligation on the provider of the other course to offer a replacement unit without charge to the student;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-166-25__para-f">
              <num>f</num>
              <content>
                <p>an explanation of the matters the Director must have regard to under subsection (2);</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-166-25__para-g">
              <num>g</num>
              <content>
                <p>any other matters prescribed by the Higher Education Provider Guidelines.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-166-25__subclause-4">
              <num>4</num>
              <content>
                <p>If paragraph (1)(b) applies, the *HELP Tuition Protection Director must give a written notice to the student that includes the following:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-166-25__para-a">
              <num>a</num>
              <content>
                <p>an explanation of the matters the Director must have regard to under subsection (2);</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-166-25__para-b">
              <num>b</num>
              <content>
                <p>an explanation of the student’s right to request reconsideration, under <quantity refersTo="#deadline">within 28 days</quantity> after the day on which the student is given the notice;<ref href="#sec-209">section 209</ref>-10, of the Director’s decision </p>

            <heading>Obligations of providers to provide information about replacement courses</heading>

                <p>The *HELP Tuition Protection Director may, by notice in writing, require a higher education provider to provide such information that the Director reasonably requires to enable the Director to make a decision under subsection 166-25(1) regarding suitable *replacement courses for a student in relation to whom a provider has *defaulted.</p>

                <p>The information must be provided:</p>

              </content>
            </paragraph>

                <p>	(b)	in accordance with such other requirements as the Director<i> </i>makes.</p>

                <p>The higher education provider who provides the *replacement course must ensure that the student:</p>

                <p>is granted course credits for units of study of the *original course successfully completed by the student; or</p>
              </content>
            </paragraph>

                <p>if the student has been charged a *student contribution amount or a *tuition fee for an *affected unit—is not charged a student contribution amount or a tuition fee for a *replacement unit of the replacement course; and</p>
              </content>

                <p>A higher education provider who provides a *replacement course to a student must keep up to date records of the following in relation to the student:</p>
              </content>

              <num>a</num>

                <p>the student’s full name and contact details;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-166-32__para-b">
              <num>b</num>
              <content>
                <p>the name of the replacement course and the *units of study the student is currently enrolled in;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-166-32__para-c">
              <num>c</num>
              <content>
                <p>any *student contribution amounts or *tuition fees charged to the student for any units of the replacement course;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-166-32__para-d">
              <num>d</num>
              <content>
                <p>details of the units of study successfully completed by the student;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-166-32__para-e">
              <num>e</num>
              <content>
                <p>details of the course credits for units of study of the *original course successfully completed by the student granted to the student.</p>
              </content>
            </paragraph>

            <heading>Notification obligations where there is no replacement course or student elects re-crediting</heading>
            <hcontainer name="subclause" eId="schedule-2__clause-166-35__subclause-1">
              <num>1</num>

                <p>This section applies if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-166-35__para-a">
              <num>a</num>
              <content>
                <p>a higher education provider *defaults in relation to a student; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-166-35__para-b">
              <num>b</num>
              <content>
                <p>either:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-166-35__para-i">
              <num>i</num>
              <content>
                <p>the *HELP Tuition Protection Director decides, under paragraph 166-25(1)(b), that the Director is not satisfied that there is a suitable *replacement course for the student; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-166-35__para-ii">
              <num>ii</num>
              <content>
                <p>the student elects, under subparagraph 166-25(3)(a)(iii), to have an amount equal to the amounts of *FEE-HELP assistance or *HECS-HELP assistance that the student received for the *affected unit *re-credited to the student’s *HELP balance.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-166-35__subclause-2">
              <num>2</num>
              <content>
                <p>The *HELP Tuition Protection Director must give a written notice to the *Secretary of that fact.</p>
              </content>
            </hcontainer>

              <content>
                <p>The *HELP Tuition Protection Director must give a written notice to the provider stating that an amount equal to the amounts of *FEE-HELP assistance or *HECS-HELP assistance that the student received for the *affected unit will be *re-credited to the student’s *HELP balance.</p>

                <p>	(2)	The *HELP Tuition Protection Fund is a special account for the purposes of the <i>Public Governance, Performance and Accountability Act 2013</i>.</p>

            <num>167-5</num>
            <heading>Credits to the HELP Tuition Protection Fund</heading>
            <content>
              <p>There must be credited to the *HELP Tuition Protection Fund amounts equal to the following:</p>
              <p>Note 1:	An Appropriation Act may contain a provision to the effect that, if any of the purposes of a special account is a purpose that is covered by an item in the Appropriation Act (whether or not the item expressly refers to the special account), then amounts may be debited against the appropriation for that item and credited to that special account.</p>
              <p>Note 2:	HELP tuition protection levy is imposed by the <i>Higher Education Support </i><i>(</i><i>HELP</i><i> Tuition Protection Levy) Act 201</i><i>9</i>. The Higher Education Provider Guidelines deal with collection of the levy: see section 19-66A.</p>
            </content>
            <paragraph eId="schedule-2__clause-167-5__para-a">
              <num>a</num>
              <content>
                <p>each amount of *HELP tuition protection levy received from a higher education provider;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-167-5__para-b">
              <num>b</num>

                <p>each amount paid by a higher education provider to the Commonwealth under paragraph 36-24A(2)(b), or subsection 110-5(1) because of re-crediting under <ref href="#sec-104">section 104</ref>-42, if the balance of the Fund had previously been reduced under paragraph 167-10(1)(f) in relation to that amount;</p>

            </paragraph>

                <p>any other money appropriated by the Parliament for the purposes of the HELP Tuition Protection Fund;</p>

              </content>
            </paragraph>

              </content>
            </paragraph>
          </hcontainer>

            <heading>Purposes of the HELP Tuition Protection Fund</heading>
            <hcontainer name="subclause" eId="schedule-2__clause-167-10__subclause-1">
              <num>1</num>
              <content>
                <p>The purposes of the *HELP Tuition Protection Fund are as follows:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-167-10__para-a">
              <num>a</num>
              <content>
                <p>making payments in connection with tuition protection;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-167-10__para-b">
              <num>b</num>
              <content>
                <p>paying or discharging the costs, expenses and other obligations incurred by the Commonwealth in the performance of the *HELP Tuition Protection Director’s functions, including in managing the HELP Tuition Protection Fund;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-167-10__para-c">
              <num>c</num>
              <content>
                <p>paying any remuneration and allowances payable to the HELP Tuition Protection Director;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-167-10__para-d">
              <num>d</num>
              <content>
                <p>paying any remuneration and allowances payable to the members of the *HELP Tuition Protection Fund Advisory Board;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-167-10__para-e">
              <num>e</num>
              <content>
                <p>paying any amount that is required or permitted to be repaid;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-167-10__para-f">
              <num>f</num>
              <content>
                <p>reducing the balance of the Fund (and therefore the available appropriation for the Fund) without making a real or notional payment.</p>
              </content>
            </paragraph>
            <content>
              <p>Note:	See <i>Public Governance, Performance and Accountability Act 2013</i> (which deals with special accounts).<ref href="#sec-80">section 80</ref> of the </p>
              <p>Note:	For example, the Higher Education Provider Guidelines may provide that a replacement provider may receive a transfer payment if a student accepts an offer of a replacement course with the provider.</p>
            </content>

              <num>2</num>
              <content>
                <p>The Higher Education Provider Guidelines may, for the purposes of paragraph (1)(a), make provision in relation to such payments, including in relation to the following:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-167-10__para-a">
              <num>a</num>
              <content>
                <p>the circumstances in which payments may be made;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-167-10__para-b">
              <num>b</num>
              <content>
                <p>amounts of different kinds of payments;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-167-10__para-c">
              <num>c</num>
              <content>
                <p>methods for calculating different kinds of payments.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-167-10__subclause-3">
              <num>3</num>
              <content>
                <p>	(3)	The purposes in subsection (1) do not include paying or discharging any costs, expenses or other obligations associated with services provided to the *HELP Tuition Protection Director by any employee or officer of a Commonwealth entity (within the meaning of the <i>Public Governance, Performance and Accountability Act 2013</i>).</p>

            <heading>HELP Tuition Protection Director</heading>

                <p>There is to be a *HELP Tuition Protection Director.</p>
              </content>
            </hcontainer>

                <p>	(2)	The office of *HELP Tuition Protection Director is to be held by the person who holds the office of TPS Director under <i>Education Services for Overseas Students Act 2000</i>.<ref href="#sec-54A">section 54A</ref> of the </p>

              <p>Note:	The TPS Director also holds the office of VSL Tuition Protection Director under the <i>VET Student Loans Act 2016</i>.</p>
            </content>

            <heading>Functions of the HELP Tuition Protection Director</heading>
            <hcontainer name="subclause" eId="schedule-2__clause-167-20__subclause-1">
              <num>1</num>
              <content>
                <p>The *HELP Tuition Protection Director has the following functions:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-167-20__para-a">
              <num>a</num>
              <content>
                <p>facilitating and monitoring the placement of students in relation to whom a higher education provider has *defaulted;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-167-20__para-b">
              <num>b</num>
              <content>
                <p>paying amounts out of, or reducing the balance of, the *HELP Tuition Protection Fund under <ref href="#sec-167">section 167</ref>-10;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-167-20__para-c">
              <num>c</num>
              <content>
                <p>reporting to <role refersTo="#minister">the Minister</role> on:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-167-20__para-i">
              <num>i</num>
              <content>
                <p>the operation of <ref href="#part-5">Part 5</ref>-1A (tuition protection); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-167-20__para-ii">
              <num>ii</num>
              <content>
                <p>the financial status of the HELP Tuition Protection Fund;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-167-20__para-d">
              <num>d</num>
              <content>
                <p>managing the HELP Tuition Protection Fund in a way that ensures that it is able to meet all its liabilities from time to time (including entering into a loan agreement for the benefit of the HELP Tuition Protection Fund);</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-167-20__para-e">
              <num>e</num>
              <content>
                <p>	(e)	making the legislative instrument each year for the purposes of <i>Higher Education Support (HELP</i><i> T</i><i>uition Protection Levy) Act 2019</i>;<ref href="#sec-12">section 12</ref> of the </p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-167-20__para-f">
              <num>f</num>
              <content>
                <p>recommending that <role refersTo="#secretary">the Secretary</role> take action against a higher education provider that has defaulted in relation to a student;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-167-20__para-g">
              <num>g</num>
              <content>
                <p>any other function conferred by this Act or any other law of the Commonwealth;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-167-20__para-h">

                <p>any other function that is incidental or conducive to the performance of the above functions.</p>
              </content>
            </paragraph>

                <p>The *HELP Tuition Protection Director has power to do all things necessary or convenient to be done for, or in connection with, the performance of the Director’s functions.</p>
              </content>

            <heading>Administrative provisions relating to the HELP Tuition Protection Director</heading>

                <p>the HELP Tuition Protection Director to engage in paid employment as the TPS Director.</p>
              </content>
            </paragraph>

                <p><role refersTo="#minister">The Minister</role> may terminate the appointment of the TPS Director if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-167-25__para-a">
              <num>a</num>
              <content>
                <p>the TPS Director engages, except with <role refersTo="#minister">the Minister</role>’s approval, in paid employment outside the duties of his or her office as *HELP Tuition Protection Director; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-167-25__para-b">
              <num>b</num>
              <content>
                <p>	(b)	the HELP Tuition Protection Director fails, without reasonable excuse, to comply with <i>Education Services for Overseas Students Act 2000</i> as applied to the HELP Tuition Protection Director by item 1 of the table in subsection (1) of this section.<ref href="#sec-54F">section 54F</ref> of the </p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-167-25__subclause-5">
              <num>5</num>
              <content>
                <p>The *HELP Tuition Protection Director is not personally subject to any liability to any person (other than the Commonwealth) in respect of anything done, or omitted to be done, in good faith in the exercise or performance of powers or functions under this Act.</p>
              </content>
            </hcontainer>

              <p><b><i>replacement unit</i></b> means a unit of study of a *replacement course that replaces an *affected unit of an *original course.</p>
