        <heading>Short title</heading>
        <content>
          <p>		This Act is the <i>Industrial Chemicals </i><i>Charges </i><i>(General) </i><i>Act 201</i><i>9</i>.</p>

        <heading>Commencement</heading>
        <subsection eId="sec-2__subsec-1">
          <num>1</num>
          <content>
            <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

(a) the start of the day after this Act receives the Royal Assent; and
(b) immediately after the commencement of section 3 of the Industrial Chemicals Act 2019.
However, the provisions do not commence at all if the event mentioned in paragraph (b) does not occur.</td>

      <section eId="sec-3">
        <num>3</num>
        <heading>Extension to external Territories</heading>
        <content>
          <p>This Act extends to every external Territory.</p>
        </content>
      </section>
      <section eId="sec-4">
        <num>4</num>
        <heading>Act binds the Crown</heading>
        <content>
          <p>This Act binds the Crown in each of its capacities. However, it does not bind the Crown in right of the Commonwealth.</p>
        </content>

      <section eId="sec-5">
        <num>5</num>
        <heading>Definitions</heading>
        <content>
          <p>In this Act:</p>
          <p><term refersTo="#term-amount">amount</term> includes <def>a nil amount.</def></p>
          <p><term refersTo="#term-charge">charge</term> means <def>charge imposed by this Act.</def></p>
          <p><term refersTo="#term-industrial-chemical">industrial chemical</term> has the same meaning as <def>in <ref href="">the Industrial Chemicals Act 2019</ref>.</def></p>
          <p><term refersTo="#term-introduce-an-industrial-chemical">introduce an industrial chemical</term> has the same meaning as <def>in <ref href="">the Industrial Chemicals Act 2019</ref>.</def></p>
          <p><term refersTo="#term-property-of-any-kind-belonging-to-a-state">property of any kind belonging to a State</term> has the same meaning as <def>in <ref href="#sec-114">section 114</ref> of the Constitution.</def></p>
          <p><term refersTo="#term-registration-year">registration year</term> has the same meaning as <def>in <ref href="">the Industrial Chemicals Act 2019</ref>.</def></p>

        <num>6</num>
        <heading>Imposition of charge</heading>
        <subsection eId="sec-6__subsec-1">
          <num>1</num>
          <content>
            <p>	(1)	Charge is imposed in relation to the registration of a person under <i>Industrial Chemicals Act 2019</i> for a registration year.<ref href="#sec-17">section 17</ref> of the </p>
          </content>
        </subsection>
        <subsection eId="sec-6__subsec-2">
          <num>2</num>
          <content>
            <p>This section imposes charge only so far as that charge is neither a duty of customs nor a duty of excise <ref href="#sec-55">within the meaning of section 55</ref> of the Constitution.</p>
          </content>
        </subsection>
      </section>
      <section eId="sec-7">
        <num>7</num>
        <heading>Amount of charge</heading>
        <subsection eId="sec-7__subsec-1">
          <num>1</num>
          <content>
            <p>The amount of charge payable by a person is the amount:</p>
          </content>
          <paragraph eId="sec-7__subsec-1__para-a">
            <num>a</num>
            <content>
              <p>prescribed by the regulations; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7__subsec-1__para-b">
            <num>b</num>
            <content>
              <p>worked out in accordance with a method prescribed by the regulations.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-7__subsec-2">
          <num>2</num>
          <content>
            <p>Without limiting subsection (1), the regulations may prescribe different charges or methods depending on the value of industrial chemicals introduced by the person during a registration year or a financial year.</p>
          </content>
        </subsection>
      </section>
      <section eId="sec-8">
        <num>8</num>
        <heading>Act does not impose tax on property of a State</heading>
        <content>
          <p>This Act does not impose a tax on property of any kind belonging to a State.</p>
        </content>
      </section>
      <section eId="sec-9">
        <num>9</num>
        <heading>Regulations</heading>
        <content>
          <p>The Governor-General may make regulations prescribing matters:</p>
        </content>
        <paragraph eId="sec-9__para-a">
          <num>a</num>
          <content>
            <p>required or permitted by this Act to be prescribed; or</p>
          </content>
        </paragraph>
        <paragraph eId="sec-9__para-b">
          <num>b</num>
          <content>
            <p>necessary or convenient to be prescribed for carrying out or giving effect to this Act.</p>
