          <heading>Simplified outline of this Act</heading>
          <content>
            <p>This Act is about providing treatment and paying travelling expenses and pharmaceutical supplement to eligible persons.</p>
            <p>A person is eligible for treatment under this Act if the person is an Australian surgical-medical team member and an Australian resident. However, a person is not eligible under this Act if the person is eligible for treatment under certain other treatment schemes (for example, under certain provisions of the <i>Veterans’ Entitlements Act 1986</i>).</p>
            <p>The Commission arranges for the provision of treatment for eligible persons.</p>
            <p>The Commission determines claims to establish eligibility for treatment and travel expenses. A person is eligible for pharmaceutical supplement if the person is eligible for treatment under this Act.</p>
            <p>Certain decisions under this Act may be reviewed by the Commission and the Administrative Review Tribunal.</p>
            <p>This Act also deals with other administrative matters (such as the Commission’s power to obtain information and to delegate its functions and powers) and enforcement matters (such as offence provisions and the recovery of the costs of treatment and overpayments in certain circumstances).</p>

          <heading>Extension to external Territories</heading>
          <content>
            <p>This Act extends to every external Territory.</p>
          </content>
        </section>

          <num>5</num>
          <heading>Definitions</heading>
          <subsection eId="part-1__sec-5__subsec-1">
            <num>1</num>
            <content>
              <p>In this Act:</p>
            </content>
            <content>
              <p><term refersTo="#term-australian-resident">Australian resident</term> has the same meaning as <def>in <ref href="#sec-5G">section 5G</ref> of the Veterans’ Entitlements Act 1986.</def></p>
              <p><term refersTo="#term-australian-surgical-medical-team-member">Australian surgical-medical team member</term> means <def>a person who worked in Vietnam (Southern Zone) as a member of an Australian surgical-medical team under the Commonwealth Government’s Southeast Asia Treaty Organisation aid programme at any time during the period beginning on 1 October 1964 and ending on 31 December 1972.</def></p>
              <p><term refersTo="#term-commission">Commission</term> means <def>the Repatriation Commission continued in existence by <ref href="#sec-179">section 179</ref> of the Veterans’ Entitlements Act 1986.</def></p>
              <p><term refersTo="#term-dishonestly">dishonestly</term> has the meaning given by <def>subsection (2).</def></p>
              <p><term refersTo="#term-eligible-person">eligible person</term> means <def>a person who, under <ref href="#sec-7">section 7</ref>, is eligible to be provided with treatment under this Act.</def></p>
              <p><term refersTo="#term-hospital-or-other-institution">hospital or other institution</term> includes <def>the following: 	(a)	an approved residential care home (within the meaning of the <i>Aged Care Act 2024</i>); a medical centre; an out-patient clinic; a rehabilitation establishment.</def></p>
            </content>
            <paragraph eId="part-1__sec-5__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>	(a)	an approved residential care home (within the meaning of the <i>Aged Care Act 2024</i>);</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-5__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>a medical centre;</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-5__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>an out-patient clinic;</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-5__subsec-1__para-d">
              <num>d</num>
              <content>
                <p>a rehabilitation establishment.</p>
              </content>
              <content>
                <p><term refersTo="#term-medical-service-provider">medical service provider</term> means <def>a person: who is a pathology practitioner; or who is a proprietor of premises at which pathology services are rendered; or who is a proprietor of a hospital or other institution that is not operated by the Commonwealth, a State or a Territory; or who is acting on behalf of a proprietor of such a hospital or other institution.</def></p>

            </paragraph>

              <num>a</num>
              <content>
                <p>who is a pathology practitioner; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-5__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>who is a proprietor of premises at which pathology services are rendered; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-5__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>who is a proprietor of a hospital or other institution that is not operated by the Commonwealth, a State or a Territory; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-5__subsec-1__para-d">
              <num>d</num>
              <content>
                <p>who is acting on behalf of a proprietor of such a hospital or other institution.</p>
              </content>
              <content>
                <p><term refersTo="#term-pathology-practitioner">pathology practitioner</term> means <def>a person in respect of whom there is in force an undertaking given by the person, and accepted by <ref class="unresolved">the Minister administering the Health Insurance Act 1973</ref>, under <ref href="#sec-23D">section 23D</ref>C of that Act.</def></p>
                <p><term refersTo="#term-pathology-service">pathology service</term> has the meaning given by <def>subsection 3(1) of <ref href="">the Health Insurance Act 1973</ref>.</def></p>
                <p><term refersTo="#term-pharmaceutical-benefits">pharmaceutical benefits</term> means <def>drugs, medicinal preparations and other pharmaceutical items (including aids to treatment and dressings) for the treatment of sicknesses or injuries suffered by human beings.</def></p>
                <p><b><i>proprietor</i></b> means:</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-5__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>in relation to premises—the person, authority or body of persons having effective control of the premises (whether or not that person, authority or body is the holder of an estate or interest in the premises); or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-5__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>in relation to a hospital or other institution—the proprietor (within the meaning of paragraph (a)) of the premises occupied by the hospital or other institution.</p>
              </content>
              <content>
                <p><term refersTo="#term-repatriation-pharmaceutical-benefits-scheme">Repatriation Pharmaceutical Benefits Scheme</term> means <def>the Repatriation Pharmaceutical Benefits Scheme in force under <ref href="#sec-91">section 91</ref> of the Veterans’ Entitlements Act 1986.</def></p>
                <p><term refersTo="#term-repatriation-private-patient-principles">Repatriation Private Patient Principles</term> means <def>the Repatriation Private Patient Principles in force under <ref href="#sec-90A">section 90A</ref> of the Veterans’ Entitlements Act 1986.</def></p>
                <p><term refersTo="#term-rules">rules</term> means <def>the rules made under <ref href="#sec-63">section 63</ref>.</def></p>
                <p><term refersTo="#term-staff-member-assisting-the-commission">staff member assisting the Commission</term> means <def>a person engaged under <ref href="">the Public Service Act 1999</ref> and made available for the purposes of this Act by the Secretary of the Department.</def></p>
                <p><term refersTo="#term-treatment">treatment</term> means <def>treatment (<ref href="#sec-80__subsec-1">within the meaning of subsection 80(1)</ref> of the Veterans’ Entitlements Act 1986).</def></p>
                <p><term refersTo="#term-treatment-principles">Treatment Principles</term> means <def>the Treatment Principles in force under <ref href="#sec-90">section 90</ref> of the Veterans’ Entitlements Act 1986.</def></p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-1__sec-5__subsec-2">
            <num>2</num>
            <content>
              <p>	(2)	For the purposes of this Act, a person engages in conduct <b><i>dishonestly </i></b>if:</p>
            </content>
            <paragraph eId="part-1__sec-5__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>the person engages in conduct; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-5__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>the conduct is dishonest according to the standards of ordinary people; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-5__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>the defendant knows the conduct is dishonest according to the standards of ordinary people.</p>
              </content>
            </paragraph>

              <p>A person is eligible to be provided with treatment under this Act if the person is an Australian surgical-medical team member and an Australian resident. However, a person is not eligible under this Act if the person is eligible for treatment under certain other treatment schemes.</p>
              <p>A person must make a claim to establish their eligibility for treatment. The Commission determines claims and must give claimants written notice of the Commission’s determination.</p>
              <p>The Commission arranges for the provision of treatment for eligible persons.</p>
              <p>Generally, treatment is arranged by the Commission if it is approved by the Commission, provided in accordance with arrangements made by the Commission and provided in certain circumstances and in accordance with certain conditions.</p>

                <p>A person is eligible to be provided with treatment under this Act if the person:</p>
              </content>
              <paragraph eId="part-2__dvs-2__sec-7__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>is an Australian surgical-medical team member; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-7__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>is an Australian resident.</p>
                </content>

                <p>However, a person is not eligible to be provided with treatment under this Act if the person is:</p>

                <num>a</num>
                <content>
                  <p>	(a)	eligible for treatment under <i>Veterans’ Entitlements Act 1986</i> for any injury or disease (within the meaning of that Act); or<ref href="#sec-53D">section 53D</ref>, subsection 85(3), (4), (4A), (4B), (5), (7) or (7A) or <ref href="#sec-86">section 86</ref> of the </p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-7__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>	(b)	entitled to be provided with treatment under <i>Military Rehabilitation and Compensation Act 2004</i> for any injury or disease (within the meaning of that Act); or<ref href="#sec-281">section 281</ref>, 282 or 284 of the </p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-7__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>	(c)	is eligible for treatment under <i>Australian Participants in British Nuclear Tests and British Commonwealth Occupation Force (Treatment) Act 2006</i>.<ref href="#sec-7">section 7</ref> of the </p>
                </content>
              </paragraph>
            </subsection>
          </section>

            <num>8</num>
            <heading>Procedures for making claims etc.</heading>
            <subsection eId="part-2__dvs-2__sec-8__subsec-1">
              <num>1</num>
              <content>
                <p>For the purposes of this Act, a claim or application is taken to have been made, or a document is taken to have been given, in accordance with this section if it is made, or given, in accordance with procedures determined by <role refersTo="#secretary">the Secretary</role> under subsection (2).</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-8__subsec-2">
              <num>2</num>
              <content>
                <p><role refersTo="#secretary">The Secretary</role> may, by legislative instrument, determine the procedures for making claims and applications, and lodging documents.</p>

            </subsection>
          </section>
          <section eId="part-2__dvs-2__sec-9">
            <num>9</num>
            <heading>Claims for eligibility</heading>
            <content>
              <p>A person who wants to establish that the person is an eligible person must make a claim in accordance with <ref href="#sec-8">section 8</ref> for a determination that the person is an eligible person.</p>
            </content>
          </section>

            <num>10</num>
            <heading>Withdrawal of claims</heading>
            <subsection eId="part-2__dvs-2__sec-10__subsec-1">
              <num>1</num>
              <content>
                <p>A claimant may, at any time before the Commission determines the claim, withdraw the claim by giving written notice to the Commission in accordance with <ref href="#sec-8">section 8</ref>.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-10__subsec-2">
              <num>2</num>
              <content>
                <p>The withdrawal of a claim does not prevent the claimant from subsequently making another claim under this Act.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-2__dvs-2__sec-11">
            <num>11</num>
            <heading>Determination of claims</heading>
            <subsection eId="part-2__dvs-2__sec-11__subsec-1">
              <num>1</num>
              <content>
                <p>The Commission is to determine claims under <ref href="#sec-9">section 9</ref>.</p>
              </content>

                <p>The Commission must give to the claimant written notice of its determination.</p>
              </content>
            </subsection>

            <heading>Revocation of determination of eligibility</heading>
            <subsection eId="part-2__dvs-2__sec-12__subsec-1">
              <num>1</num>
              <content>
                <p>If:</p>
              </content>
              <paragraph eId="part-2__dvs-2__sec-12__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>the Commission has determined that a person is an eligible person; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-12__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>the Commission subsequently becomes satisfied that the information before the Commission when it made the determination was false in a material particular;</p>
                </content>
                <content>
                  <p>the Commission may revoke the determination.</p>
                </content>

                <p>The Commission may arrange for the provision of treatment for eligible persons.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-3__sec-13__subsec-2">
              <num>2</num>
              <content>
                <p>Subject to <ref href="#sec-14">section 14</ref>, the Commission is not taken to have arranged for the provision of treatment for a person unless:</p>
              </content>
              <paragraph eId="part-2__dvs-3__sec-13__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>the treatment was provided in accordance with arrangements made by the Commission under this Act; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-13__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>the treatment was provided in the circumstances in which, and in accordance with the conditions subject to which, the treatment may be provided under this Act; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-13__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>the Commission approved the provision of the treatment before the treatment was provided, or began to be provided, as the case may be.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
          <section eId="part-2__dvs-3__sec-14">
            <num>14</num>
            <heading>Approval of treatment already provided</heading>
            <subsection eId="part-2__dvs-3__sec-14__subsec-1">
              <num>1</num>
              <content>
                <p>The Commission may approve the provision of treatment for a person that was provided, or that began to be provided, without the prior approval of the Commission if:</p>
              </content>
              <paragraph eId="part-2__dvs-3__sec-14__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>the person is an eligible person; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-14__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>the Commission is satisfied that it would be proper for the Commission to approve provision of the treatment after it had been provided or had begun to be provided.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-3__sec-14__subsec-2">
              <num>2</num>
              <content>
                <p>However, the Commission must not approve the provision of treatment that was provided more than 3 months before the person made a claim under <ref href="#sec-9">section 9</ref> that the person is an eligible person.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-3__sec-14__subsec-3">
              <num>3</num>
              <content>
                <p>The Commission is taken to have arranged for the provision of treatment approved under this section.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-3__sec-14__subsec-4">
              <num>4</num>
              <content>
                <p>If the person for whom the treatment was provided has paid for the provision of treatment approved under this section, the Commonwealth may reimburse the person for the amount paid.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-2__dvs-3__sec-15">
            <num>15</num>
            <heading>Commission may accept financial responsibility for costs in relation to treatment not arranged by Commission</heading>
            <content>
              <p>If:</p>
            </content>
            <paragraph eId="part-2__dvs-3__sec-15__para-a">
              <num>a</num>
              <content>
                <p>the Commission is satisfied that an entity, other than the Commission, has arranged for the provision of treatment for an eligible person; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__dvs-3__sec-15__para-b">
              <num>b</num>
              <content>
                <p>the treatment is of a kind specified under paragraph 18(5)(a);</p>
              </content>
              <content>
                <p>then the Commission may, in accordance with paragraph 18(5)(b), accept financial responsibility for particular costs in relation to that treatment (including amounts of subsidy payable under <i>Aged Care Act 2024</i>.<ref href="#part-2">Part 2</ref> of Chapter 4 of the </p>
              </content>
            </paragraph>
          </section>
          <section eId="part-2__dvs-3__sec-16">
            <num>16</num>
            <heading>Limits on provision of treatment</heading>
            <subsection eId="part-2__dvs-3__sec-16__subsec-1">
              <num>1</num>
              <content>
                <p>Nothing in this Act is taken to:</p>
              </content>
              <paragraph eId="part-2__dvs-3__sec-16__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>impose a duty on the Commission to arrange for the provision of; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-16__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>confer a right on a person to be provided, under arrangements made by the Commission, with;</p>
                </content>
                <content>
                  <p>treatment outside Australia.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-3__sec-16__subsec-2">
              <num>2</num>
              <content>
                <p>Subject to subsection 13(1), nothing in this Act is taken to confer on a person a right to be provided with treatment:</p>
              </content>
              <paragraph eId="part-2__dvs-3__sec-16__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>by the Commonwealth; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-16__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>by the Commission otherwise than to the extent that, and in a manner that, the treatment may be provided under arrangements made by, or with the approval of, the Commission.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
          <section eId="part-2__dvs-3__sec-17">
            <num>17</num>
            <heading>Treatment at hospitals and other institutions</heading>
            <content>
              <p>For the purposes of this Part, the Commission may:</p>
            </content>
            <paragraph eId="part-2__dvs-3__sec-17__para-a">
              <num>a</num>
              <content>
                <p>enter into arrangements with the appropriate authority of the Commonwealth, a State or a Territory for the provision of care and welfare, at a public hospital or other institution operated by the Commonwealth, State or Territory, for eligible persons; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__dvs-3__sec-17__para-b">
              <num>b</num>
              <content>
                <p>enter into arrangements with any other body operating a hospital or other institution for the provision of care and welfare at that hospital or institution for eligible persons.</p>
              </content>
            </paragraph>

            <heading>Application and modification of the Treatment Principles</heading>

                <p>The Treatment Principles, or, if the Treatment Principles have been modified under this section, the Treatment Principles as so modified, are binding on the Commission in the Commission’s exercise of its powers and discretions under this Act.</p>

                <p>Modification of the Treatment Principles by Commission</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-3__sec-18__subsec-2">
              <num>2</num>
              <content>
                <p>The Commission may, in writing, prepare modifications of the Treatment Principles in their application for the purposes of this Act.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-3__sec-18__subsec-3">
              <num>3</num>
              <content>
                <p>The modifications are to set out circumstances in which, and conditions subject to which, treatment of a particular kind, or included in a particular class of treatment, may be provided under this Act for eligible persons.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-3__sec-18__subsec-4">
              <num>4</num>
              <content>
                <p>Without limiting subsection (2), the modifications may also include provisions dealing with the following matters in relation to treatment to be provided to eligible persons:</p>
              </content>
              <paragraph eId="part-2__dvs-3__sec-18__subsec-4__para-a">
                <num>a</num>
                <content>
                  <p>whether approval by the Commission of the treatment is required;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-18__subsec-4__para-b">
                <num>b</num>
                <content>
                  <p>if approval by the Commission of the treatment is required—the exercise of the Commission’s power to approve the treatment, whether before or after the treatment is given or begins to be given;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-18__subsec-4__para-c">
                <num>c</num>
                <content>
                  <p>where the treatment may be provided.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-3__sec-18__subsec-5">
              <num>5</num>
              <content>
                <p>Without limiting subsection (2), the modifications may also include provisions:</p>
              </content>
              <paragraph eId="part-2__dvs-3__sec-18__subsec-5__para-a">
                <num>a</num>
                <content>
                  <p>specifying kinds of treatment for the purposes of paragraph 15(b); and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-18__subsec-5__para-b">
                <num>b</num>
                <content>
                  <p>	(b)	specifying the circumstances in which, and the extent to which, the Commission may accept financial responsibility for particular costs relating to that treatment (including amounts of subsidy payable under <i>Aged Care Act 2024</i>.<ref href="#part-2">Part 2</ref> of Chapter 4 of the </p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-3__sec-18__subsec-6">
              <num>6</num>
              <content>
                <p>Without limiting subsection (2), the modifications may specify kinds or classes of treatment that:</p>
              </content>
              <paragraph eId="part-2__dvs-3__sec-18__subsec-6__para-a">
                <num>a</num>
                <content>
                  <p>will not be provided for eligible persons; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-18__subsec-6__para-b">
                <num>b</num>
                <content>
                  <p>will not be so provided at places, or in circumstances, specified or described in the modifications.</p>
                </content>
                <content>
                  <p>Variation and revocation of modification</p>
                </content>
              </paragraph>
            </subsection>

                <p>The Commission may, in writing, prepare variations or revocations of the modifications at any time.</p>

                <p>The Repatriation Private Patient Principles, or, if the Repatriation Private Patient Principles have been modified under this section, the Repatriation Private Patient Principles as so modified, are binding on the Commission in the Commission’s exercise of its powers and discretions under this Act.</p>

                <p>The modifications are to set out circumstances in which treatment provided under this Act for eligible persons is to be provided for those persons as private patients.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-3__sec-19__subsec-4">
              <num>4</num>
              <content>
                <p>Without limiting subsection (2), the modifications may also include provisions dealing with the following matters in relation to treatment provided under this Act for such persons as private patients:</p>
              </content>
              <paragraph eId="part-2__dvs-3__sec-19__subsec-4__para-a">
                <num>a</num>
                <content>
                  <p>whether approval by the Commission of the treatment is required;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-19__subsec-4__para-b">
                <num>b</num>
                <content>
                  <p>if approval by the Commission of the treatment is required—the exercise of the Commission’s power to approve the treatment, whether before or after the treatment is given or begins to be given;</p>

                  <p>where the treatment may be provided.</p>

                <p>Treatment provided to a person as a private patient</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-3__sec-19__subsec-8">
              <num>8</num>
              <content>
                <p>For the purposes of this section, treatment is taken to be provided to a person as a private patient if:</p>
              </content>
              <paragraph eId="part-2__dvs-3__sec-19__subsec-8__para-a">
                <num>a</num>
                <content>
                  <p>	(a)	the treatment is provided to the person as a person who is, for the purposes of the <i>Health Insurance Act 1973</i>, a private patient of a hospital; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-19__subsec-8__para-b">
                <num>b</num>
                <content>
                  <p>the treatment is provided to the person by a medical specialist to whom the person has been referred but is not provided at a hospital.</p>
                </content>
              </paragraph>
            </subsection>

            <num>20</num>
            <heading>Application and modification of Repatriation Pharmaceutical Benefits Scheme</heading>
            <content>
              <p>Repatriation Pharmaceutical Benefits Scheme binding on Commission</p>
            </content>
            <subsection eId="part-2__dvs-3__sec-20__subsec-1">
              <num>1</num>
              <content>
                <p>The Repatriation Pharmaceutical Benefits Scheme, or, if that scheme has been modified under this section, that scheme as so modified, applies to the provision of pharmaceutical benefits in connection with treatment of eligible persons.</p>

                <p>Modification of the Repatriation Pharmaceutical Benefits Scheme</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-3__sec-20__subsec-2">
              <num>2</num>
              <content>
                <p>The Commission may, in writing, prepare modifications of the Repatriation Pharmaceutical Benefits Scheme in its application for the purposes of this Act.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-3__sec-20__subsec-3">
              <num>3</num>
              <content>
                <p>Without limiting subsection (2), the modifications may specify classes of eligible persons for whom:</p>
              </content>
              <paragraph eId="part-2__dvs-3__sec-20__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>pharmaceutical benefits; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-20__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>pharmaceutical benefits of a kind specified in the instrument; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-20__subsec-3__para-c">
                <num>c</num>
                <content>
                  <p>pharmaceutical benefits included in a class of pharmaceutical benefits specified in the instrument;</p>
                </content>
                <content>
                  <p>will not be provided, or will not be provided in circumstances specified or described in the instrument.</p>
                  <p>Variation and revocation of modification</p>
                </content>
              </paragraph>
            </subsection>

                <p>The Commission may, in writing, prepare variations or revocations of the modifications at any time.</p>

            <p>Generally, a person is entitled to be paid travelling expenses if the person travels for the purpose of obtaining treatment, the Commission approves the travel and any other prescribed conditions are met.</p>
            <p>The Commission may authorise payment in advance of expected travelling expenses in certain circumstances.</p>
            <p>A person must make a claim to establish their eligibility to be paid travelling expenses. The Commission determines claims and must give claimants written notice of the Commission’s determination.</p>

          <heading>Entitlement to travelling expenses</heading>
          <subsection eId="part-3__sec-22__subsec-1">
            <num>1</num>
            <content>
              <p>If:</p>
            </content>
            <paragraph eId="part-3__sec-22__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>an eligible person travels for the purpose of obtaining treatment; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-22__subsec-1__para-b">

                <p>the Commission approves the travel; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-22__subsec-1__para-c">

                <p>such conditions as are prescribed are satisfied;</p>
              </content>
              <content>
                <p>the person is entitled to be paid such travelling expenses, in connection with the travel, as are prescribed.</p>

            </paragraph>
          </subsection>

              <p>If:</p>
            </content>
            <paragraph eId="part-3__sec-22__subsec-2__para-a">
              <num>a</num>

                <p>a person travels for the purpose of accompanying a person referred to in subsection (1) as the person’s attendant; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-22__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>the Commission authorises the travel for that purpose; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-22__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>such conditions as are prescribed are satisfied;</p>
              </content>
              <content>
                <p>the attendant is entitled to be paid such travelling expenses, in connection with the travel, as are prescribed.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-3__sec-22__subsec-3">
            <num>3</num>
            <content>
              <p>An approval under paragraph (1)(b) or an authorisation under paragraph (2)(b) may be given before or after the travel is completed.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-22__subsec-4">
            <num>4</num>
            <content>
              <p>Travelling expenses are not payable under this section in respect of travel outside Australia.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-3__sec-23">
          <num>23</num>
          <heading>Advances of travelling expenses</heading>
          <subsection eId="part-3__sec-23__subsec-1">
            <num>1</num>
            <content>
              <p>If the Commission is satisfied:</p>
            </content>
            <paragraph eId="part-3__sec-23__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>that a person may reasonably be expected to become entitled to be paid travelling expenses under <ref href="#sec-22">section 22</ref>; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-23__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>that it is in all the circumstances appropriate for the person to be paid an advance on account of the travelling expenses that the person is expected to become entitled to be paid;</p>
              </content>
              <content>
                <p>the Commission may authorise payment to the person of an advance on account of the travelling expenses that the person is expected to become entitled to be paid.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-3__sec-23__subsec-2">
            <num>2</num>
            <content>
              <p>If the amount of the advance paid to a person on account of any travelling expenses in respect of any travel of the person exceeds the amount of travelling expenses that become payable to the person in respect of that travel, the person is liable to repay an amount equal to the excess to the Commonwealth.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-23__subsec-3">
            <num>3</num>
            <content>
              <p>The Commonwealth may recover in a court of competent jurisdiction an amount that a person is liable to pay to the Commonwealth under subsection (2).</p>
            </content>
          </subsection>
        </section>
        <section eId="part-3__sec-24">
          <num>24</num>
          <heading>Claims for travelling expenses</heading>
          <subsection eId="part-3__sec-24__subsec-1">
            <num>1</num>
            <content>
              <p>A person who wants to establish that the person is entitled to be paid travelling expenses under this Part must make a claim in accordance with <ref href="#sec-8">section 8</ref> for a determination that the person is entitled to be paid travelling expenses under this Part.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-24__subsec-2">
            <num>2</num>
            <content>
              <p>A claim for travelling expenses must be made:</p>
            </content>
            <paragraph eId="part-3__sec-24__subsec-2__para-a">
              <num>a</num>
              <content>
                <p><quantity refersTo="#deadline">within 12 months</quantity> after the completion of the travel to which it relates; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-24__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>if the Commission thinks that there are exceptional circumstances that justify extending that period—such further period as the Commission allows.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-3__sec-25">
          <num>25</num>
          <heading>Withdrawal of claims</heading>
          <subsection eId="part-3__sec-25__subsec-1">
            <num>1</num>
            <content>
              <p>A claimant may, at any time before the Commission determines the claim, withdraw the claim by giving written notice to the Commission in accordance with <ref href="#sec-8">section 8</ref>.</p>

              <p>The withdrawal of a claim does not prevent the claimant from subsequently making another claim under this Act.</p>

              <p>A person who leaves Australia otherwise than temporarily is not eligible for pharmaceutical supplement under <ref href="#sec-28">section 28</ref> after the day on which the person left Australia.</p>
            </content>

              <p>Temporary absence from Australia</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-29__subsec-2">
            <num>2</num>
            <content>
              <p>A person who is temporarily absent from Australia and has been so absent for more than 26 weeks is not eligible for pharmaceutical supplement under <ref href="#sec-28">section 28</ref> after the first 26 weeks of the absence.</p>

              <p>When a person becomes eligible for pharmaceutical supplement after leaving Australia</p>
            </content>
          </subsection>

              <p>The person mentioned in subsections (1) and (2) again becomes eligible to receive pharmaceutical supplement under <ref href="#sec-28">section 28</ref> on the later of the following days:</p>

              <num>a</num>
              <content>
                <p>the day on which the person returns to Australia;</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-29__subsec-3__para-b">
              <num>b</num>

                <p>the day on which the person notifies the Commission of the person’s return to Australia.</p>
              </content>
              <content>
                <p>When pharmaceutical supplement is not payable</p>
              </content>
            </paragraph>
          </subsection>

            <content>
              <p>Even though a person is eligible for pharmaceutical supplement under <ref href="#sec-28">section 28</ref>, the supplement is not payable to the person if:</p>
            </content>
            <paragraph eId="part-4__sec-29__subsec-4__para-a">
              <num>a</num>
              <content>
                <p>	(a)	the person is receiving veterans supplement under <i>Veterans’ Entitlements Act 1986</i>; or<ref href="#sec-118A">section 118A</ref> of the </p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-29__subsec-4__para-b">
              <num>b</num>
              <content>
                <p>	(b)	the person is receiving MRCA supplement under <i>Military Rehabilitation and Compensation Act 2004</i>; or<ref href="#sec-300">section 300</ref> of the </p>

              <num>c</num>
              <content>
                <p>	(c)	the person is receiving a pharmaceutical allowance under the <i>Social Security Act 1991</i>; or</p>

              <num>d</num>
              <content>
                <p>	(d)	the person is a wholly dependent partner of a deceased member (within the meaning of the <i>Military Rehabilitation and Compensation Act 2004</i>); or</p>

              <num>e</num>
              <content>
                <p>	(e)	the person is receiving a social security payment (within the meaning of the <i>Social Security Act 1991</i>) for which a pension supplement amount (within the meaning of that Act) is used to work out the rate of the payment; or</p>

                <p>The Commission has the general administration of this Act, subject to the control of <role refersTo="#minister">the Minister</role>.</p>

            <heading>Commission not bound by technicalities</heading>
            <content>
              <p>In making a decision under this Act, the Commission:</p>
            </content>
            <paragraph eId="part-6__dvs-2__sec-41__para-a">
              <num>a</num>
              <content>
                <p>is not bound to act in a formal manner and is not bound by any rules of evidence, but may inform itself on any matter in such manner as it thinks just; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__dvs-2__sec-41__para-b">
              <num>b</num>
              <content>
                <p>may act according to substantial justice and the substantial merits of the case, without regard to legal form and technicalities; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__dvs-2__sec-41__para-c">
              <num>c</num>
              <content>
                <p>without limiting paragraph (a) or (b), must take into account any difficulties that, for any reason, lie in the way of ascertaining the existence of any fact, matter, cause or circumstance, including any reason attributable to:</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__dvs-2__sec-41__para-i">
              <num>i</num>
              <content>
                <p>the effects of the passage of time, including the effect of the passage of time on the availability of witnesses; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__dvs-2__sec-41__para-ii">
              <num>ii</num>
              <content>
                <p>the absence of, or a deficiency in, relevant official records.</p>
              </content>
            </paragraph>
          </section>
          <section eId="part-6__dvs-2__sec-42">
            <num>42</num>
            <heading>Delegation</heading>
            <content>
              <p>The Commission may, by resolution, delegate any of its functions or powers under a provision of this Act, or under the rules or any other legislative instrument made under this Act, to:</p>
            </content>
            <paragraph eId="part-6__dvs-2__sec-42__para-a">
              <num>a</num>
              <content>
                <p>a member of the Commission; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__dvs-2__sec-42__para-b">
              <num>b</num>
              <content>
                <p>a staff member assisting the Commission; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__dvs-2__sec-42__para-c">
              <num>c</num>
              <content>
                <p>a consultant to, or an employee of a consultant to, the Commission; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__dvs-2__sec-42__para-d">
              <num>d</num>
              <content>
                <p>	(d)	a person who is engaged under the <i>Public Service Act 1999</i> and performing duties in the Department.</p>
              </content>
            </paragraph>

          <heading>Obtaining and giving information etc.</heading>
          <section eId="part-6__dvs-3__sec-43">
            <num>43</num>
            <heading>Commission may obtain information etc.</heading>
            <subsection eId="part-6__dvs-3__sec-43__subsec-1">
              <num>1</num>
              <content>
                <p>The Commission may give a written notice to any person requiring the person, for the purposes of this Act:</p>
              </content>
              <paragraph eId="part-6__dvs-3__sec-43__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>to provide to the Commission (or a specified staff member assisting the Commission) such information as the Commission requires; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-6__dvs-3__sec-43__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>to produce to the Commission (or a specified staff member assisting the Commission) any documents in the custody or under the control of the person; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-6__dvs-3__sec-43__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>to appear before a specified staff member assisting the Commission to answer questions.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-6__dvs-3__sec-43__subsec-2">
              <num>2</num>
              <content>
                <p>To avoid doubt, the person given the notice may be a person employed:</p>
              </content>
              <paragraph eId="part-6__dvs-3__sec-43__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>in, or in connection with, a Department of the Commonwealth, a State or Territory; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-6__dvs-3__sec-43__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>by any authority of the Commonwealth, a State or Territory.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-6__dvs-3__sec-43__subsec-3">
              <num>3</num>
              <content>
                <p>The notice must specify:</p>
              </content>
              <paragraph eId="part-6__dvs-3__sec-43__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>if paragraph (1)(a) or (b) applies:</p>
                </content>
              </paragraph>
              <paragraph eId="part-6__dvs-3__sec-43__subsec-3__para-i">
                <num>i</num>
                <content>
                  <p>the period within which the person must comply with the notice; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-6__dvs-3__sec-43__subsec-3__para-ii">
                <num>ii</num>
                <content>
                  <p>the manner in which the person must comply with the notice; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-6__dvs-3__sec-43__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>if paragraph (1)(c) applies:</p>
                </content>
              </paragraph>
              <paragraph eId="part-6__dvs-3__sec-43__subsec-3__para-i">
                <num>i</num>
                <content>
                  <p>the time at which the person must appear before the staff member; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-6__dvs-3__sec-43__subsec-3__para-ii">
                <num>ii</num>
                <content>
                  <p>the place at which the person must appear before the staff member.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-6__dvs-3__sec-43__subsec-4">
              <num>4</num>
              <content>
                <p>The specified period or the specified time mentioned in subsection (3) must be at least 14 days after the notice is given.</p>
              </content>
            </subsection>
            <subsection eId="part-6__dvs-3__sec-43__subsec-5">
              <num>5</num>
              <content>
                <p>The Commission may require the information or answers provided under paragraph (1)(c) to be verified by, or given on, oath or affirmation and either orally or in writing.</p>
              </content>
            </subsection>
            <subsection eId="part-6__dvs-3__sec-43__subsec-6">
              <num>6</num>
              <content>
                <p>A staff member to whom information or answers are verified or given may administer the oath or affirmation.</p>
              </content>
            </subsection>
            <subsection eId="part-6__dvs-3__sec-43__subsec-7">
              <num>7</num>
              <content>
                <p>This section does not require a person to give information, produce a document or give evidence to the extent that, in doing so, the person would contravene a law of the Commonwealth (not being a law of a Territory).</p>
              </content>

            <heading>Failure to comply with a notice</heading>
            <subsection eId="part-6__dvs-3__sec-44__subsec-1">
              <num>1</num>
              <content>
                <p>A person commits an offence if the person fails to comply with a notice under <ref href="#sec-43">section 43</ref>.</p>
              </content>

            </subsection>

            <heading>Self-incrimination</heading>

                <p>An individual is not excused from giving information or evidence, or producing a document or a copy of a document, under <ref href="#sec-43">section 43</ref> on the ground that the information or evidence, or the production of the document or copy, might tend to incriminate the individual or expose the individual to a penalty.</p>
              </content>
            </subsection>
            <subsection eId="part-6__dvs-3__sec-45__subsec-2">
              <num>2</num>
              <content>
                <p>However:</p>
              </content>
              <paragraph eId="part-6__dvs-3__sec-45__subsec-2__para-a">
                <num>a</num>

                  <p>giving the information or evidence, or producing the document or copy; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-6__dvs-3__sec-45__subsec-2__para-b">

                <content>
                  <p>any information, document or thing obtained as a direct or indirect consequence of giving the information or evidence, or producing the document or copy;</p>

                  <p>is not admissible in evidence against the individual in any proceedings, other than proceedings for an offence under <i>Criminal Code </i>that relates to this Act.<ref href="#sec-137">section 137</ref>.1 or 137.2 of the </p>
                </content>

          </section>
          <section eId="part-6__dvs-3__sec-46">
            <num>46</num>
            <heading>Giving information</heading>
            <subsection eId="part-6__dvs-3__sec-46__subsec-1">
              <num>1</num>
              <content>
                <p>Nothing in a law of a State or a Territory operates to prevent a person from giving information, producing documents or giving evidence for the purposes of this Act.</p>
              </content>
            </subsection>
            <subsection eId="part-6__dvs-3__sec-46__subsec-2">
              <num>2</num>
              <content>
                <p><role refersTo="#secretary">The Secretary</role> or an employee in the Department may provide any information obtained in the performance of his or her duties under this Act to <role refersTo="#secretary">the Secretary</role> of another Department of the Commonwealth, or to the head of an authority of the Commonwealth, for the purposes of that Department or authority.</p>

            </subsection>
          </section>
        </division>

          <heading>Offences</heading>
          <section eId="part-6__dvs-4__sec-47">
            <num>47</num>
            <heading>False or misleading statements or documents relating to treatment</heading>
            <subsection eId="part-6__dvs-4__sec-47__subsec-1">

              <content>
                <p>A person commits an offence if:</p>
              </content>
              <paragraph eId="part-6__dvs-4__sec-47__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>any of the following applies:</p>
                </content>
              </paragraph>
              <paragraph eId="part-6__dvs-4__sec-47__subsec-1__para-i">
                <num>i</num>
                <content>
                  <p>the person makes a statement (whether oral or written);</p>
                </content>
              </paragraph>
              <paragraph eId="part-6__dvs-4__sec-47__subsec-1__para-ii">
                <num>ii</num>
                <content>
                  <p>the person issues or presents a document;</p>
                </content>
              </paragraph>
              <paragraph eId="part-6__dvs-4__sec-47__subsec-1__para-iii">
                <num>iii</num>
                <content>
                  <p>the person authorises a statement to be made or a document to be issued or presented; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-6__dvs-4__sec-47__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>the statement or document is false or misleading in a material particular; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-6__dvs-4__sec-47__subsec-1__para-c">

                  <p>the statement or document is capable of being used in connection with a claim for treatment provided under this Act.</p>
                </content>

                  <p>the person did not know, and could not reasonably be expected to have known, that the statement or document was capable of being used in connection with a claim for treatment provided under this Act.</p>

                <p>the person is a medical service provider; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__dvs-4__sec-48__para-b">
              <num>b</num>
              <content>
                <p>the person engages in conduct or omits to engage in conduct; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__dvs-4__sec-48__para-c">
              <num>c</num>
              <content>
                <p>the conduct or omission causes detriment to another person; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__dvs-4__sec-48__para-d">
              <num>d</num>
              <content>
                <p>the person engages in the conduct or omits to engage in the conduct intending:</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__dvs-4__sec-48__para-i">
              <num>i</num>
              <content>
                <p>the conduct or omission to cause detriment to the other person; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__dvs-4__sec-48__para-ii">
              <num>ii</num>
              <content>
                <p>to encourage the other person to request a pathology service in respect of treatment provided under this Act; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__dvs-4__sec-48__para-e">
              <num>e</num>
              <content>
                <p>the other person does not consent to the conduct or omission.</p>
              </content>

            <heading>Medical service providers threatening detriment</heading>

                <p>A person commits an offence if:</p>
              </content>
              <paragraph eId="part-6__dvs-4__sec-49__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>the person is a medical service provider; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-6__dvs-4__sec-49__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>the medical service provider makes a threat to another person to cause detriment to the other person or a third person; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-6__dvs-4__sec-49__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>the medical service provider is reckless as to causing the other person or the third person to fear that the threat will be carried out; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-6__dvs-4__sec-49__subsec-1__para-d">
                <num>d</num>
                <content>
                  <p>	(d)	the medical service provider makes the threat intending to encourage the other person<i> </i>to request a pathology service in respect of treatment provided under this Act.</p>
                </content>

                <p>For the purposes of subsection (1), a threat may be:</p>
              </content>
              <paragraph eId="part-6__dvs-4__sec-49__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>express or implied; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-6__dvs-4__sec-49__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>conditional or unconditional.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-6__dvs-4__sec-49__subsec-3">
              <num>3</num>
              <content>
                <p>In a prosecution for an offence against subsection (1), it is not necessary to prove that the person actually feared that the threat would be carried out.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-6__dvs-4__sec-50">

            <heading>Bribery by medical service providers</heading>
            <content>
              <p>A person commits an offence if:</p>
            </content>
            <paragraph eId="part-6__dvs-4__sec-50__para-a">
              <num>a</num>
              <content>
                <p>the person is a medical service provider; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__dvs-4__sec-50__para-b">
              <num>b</num>
              <content>
                <p>the person dishonestly:</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__dvs-4__sec-50__para-i">
              <num>i</num>
              <content>
                <p>provides a benefit to another person; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__dvs-4__sec-50__para-ii">
              <num>ii</num>
              <content>
                <p>causes a benefit to be provided to another person; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__dvs-4__sec-50__para-iii">
              <num>iii</num>
              <content>
                <p>offers or promises to provide a benefit to another person; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__dvs-4__sec-50__para-iv">
              <num>iv</num>
              <content>
                <p>causes an offer or a promise to provide a benefit to be made to another person; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__dvs-4__sec-50__para-c">
              <num>c</num>
              <content>
                <p>	(c)	the person does so intending to encourage the other person<i> </i>to request a pathology service in respect of treatment provided under this Act.</p>
              </content>

            <heading>Practitioners receiving bribes etc.</heading>
            <content>
              <p>A person commits an offence if:</p>
            </content>
            <paragraph eId="part-6__dvs-4__sec-51__para-a">
              <num>a</num>
              <content>
                <p>	(a)	the person is a practitioner (the <b><i>practitioner</i></b>); and</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__dvs-4__sec-51__para-b">
              <num>b</num>
              <content>
                <p>the practitioner dishonestly:</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__dvs-4__sec-51__para-i">
              <num>i</num>
              <content>
                <p>asks for a benefit for the practitioner, or for another person; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__dvs-4__sec-51__para-ii">
              <num>ii</num>
              <content>
                <p>receives or obtains a benefit for the practitioner, or for another person; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__dvs-4__sec-51__para-iii">
              <num>iii</num>
              <content>
                <p>agrees to receive or obtain a benefit for the practitioner, or for another person; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__dvs-4__sec-51__para-c">
              <num>c</num>
              <content>
                <p>the practitioner does so intending:</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__dvs-4__sec-51__para-i">
              <num>i</num>
              <content>
                <p>that treatment provided by the practitioner under this Act will be influenced; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__dvs-4__sec-51__para-ii">
              <num>ii</num>
              <content>
                <p>to induce, foster or sustain a belief that such treatment will be influenced.</p>
              </content>
              <hcontainer name="penalty">

            <heading>Pathology practitioners making payments to requesting practitioners</heading>
            <subsection eId="part-6__dvs-4__sec-52__subsec-1">
              <num>1</num>
              <content>
                <p>A person commits an offence if:</p>
              </content>
              <paragraph eId="part-6__dvs-4__sec-52__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>the person is a pathology practitioner; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-6__dvs-4__sec-52__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>	(b)	another practitioner (the <b><i>requesting practitioner</i></b>) requests the pathology practitioner to provide pathology services to a person (the <b><i>patient</i></b>); and</p>
                </content>
              </paragraph>

                  <p>the person has entered an arrangement with another practitioner to share the cost of:</p>
                </content>
              </paragraph>

                  <p>employing staff; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-6__dvs-4__sec-53__subsec-1__para-ii">

                  <p>buying, renting or maintaining items of equipment;</p>

                  <p>(whether or not the arrangement involves paying money or providing other consideration); and</p>

              </paragraph>
              <paragraph eId="part-6__dvs-4__sec-53__subsec-2__para-ii">

                  <p>for one of them to provide space in a building for the other to use or occupy; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-6__dvs-4__sec-53__subsec-2__para-iii">
                <num>iii</num>
                <content>
                  <p>for one of them to permit the other to use or occupy the building; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-6__dvs-4__sec-53__subsec-2__para-c">

                  <p>the charges payable under the arrangement are not charges fixed at normal commercial rates; and</p>
                </content>
              </paragraph>

                <p>the person is a pathology practitioner; and</p>
              </content>
            </paragraph>

                <p>the person provides nursing or other staff at the premises of another practitioner (whether the staff are present full-time, part-time or from time to time); and</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__dvs-4__sec-54__para-c">
              <num>c</num>
              <content>
                <p>the person intends the staff to be used in taking pathology specimens in respect of treatment under this Act.</p>

            <heading>Counselling statements inadmissible as evidence</heading>
            <subsection eId="part-6__dvs-4__sec-55__subsec-1">

                <p>This section applies if:</p>
              </content>
              <paragraph eId="part-6__dvs-4__sec-55__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>	(a)	a person (the <b><i>treatment provider</i></b>) has provided treatment under this Act; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-6__dvs-4__sec-55__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>the treatment provider has been counselled by a staff member assisting the Commission with respect to providing treatment under this Act; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-6__dvs-4__sec-55__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>the treatment provider makes a statement during the counselling.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-6__dvs-4__sec-55__subsec-2">
              <num>2</num>
              <content>
                <p>The statement is inadmissible as evidence against the treatment provider in proceedings prosecuting the treatment provider for an offence mentioned in subsection (3) unless:</p>
              </content>
              <paragraph eId="part-6__dvs-4__sec-55__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>the treatment provider consents to the statement being admitted as evidence in the proceedings; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-6__dvs-4__sec-55__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>both of the following apply:</p>
                </content>
              </paragraph>
              <paragraph eId="part-6__dvs-4__sec-55__subsec-2__para-i">
                <num>i</num>
                <content>
                  <p>evidence of another statement made by the treatment provider during such counselling is admitted on behalf of the provider;</p>
                </content>
              </paragraph>
              <paragraph eId="part-6__dvs-4__sec-55__subsec-2__para-ii">
                <num>ii</num>
                <content>
                  <p>evidence of the statement mentioned in paragraph (1)(c) is adduced to refute evidence of that other statement.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-6__dvs-4__sec-55__subsec-3">

                <p>For the purposes of subsection (2), the following are the offences:</p>
              </content>

                  <p>	(i)	<i>Crimes Act 1914 </i>(accessory after the fact); or<ref href="#sec-6">section 6</ref> of the </p>

                  <p>purportedly by way of reimbursement to a person under subsection 14(4); or</p>
                </content>
              </paragraph>

                  <p>purportedly as travelling expenses under <ref href="#part-3">Part 3</ref>; and</p>

                  <p>as a result of making a false or misleading statement, the amount paid exceeds the amount (if any) that should have been paid.</p>

                <p>The amount of the excess is recoverable, in a court of competent jurisdiction, as a debt due to the Commonwealth from:</p>

                  <p>the person by or on behalf of whom the statement was made; or</p>
                </content>
              </paragraph>

            </subsection>

                  <p>any person has been convicted of an offence in relation to the making of the statement.</p>

                <num>a</num>

                  <p>	(a)	an amount (the <b><i>principal sum</i></b>) is recoverable as a debt due to the Commonwealth from a person or estate under section 56; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-6__dvs-5__sec-57__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>the Commission has served a notice on the person or estate (as the case requires) claiming the amount as a debt due to the Commonwealth; and</p>

                <num>c</num>
                <content>
                  <p>	(c)	an arrangement has been entered into between the Commission and the person or estate (as the case requires) to repay the principal sum within the following period (the <b><i>relevant period</i></b>):</p>

                  <p>the period of 3 months from the day the notice is served;</p>

              </paragraph>

                  <p>purportedly as travelling expenses under <ref href="#part-3">Part 3</ref>; and</p>

                <p>The amendment history in endnote 4 provides information about amendments at the provision (generally section or equivalent) level. It also includes information about any provision of the compiled law that has been repealed in accordance with a provision of the law.</p>

                  <b>Editorial changes</b>
                </p>
                <p>The <i>Legislation Act 2003</i> authorises First Parliamentary Counsel to make editorial and presentational changes to a compiled law in preparing a compilation of the law for registration. The changes must not change the effect of the law. Editorial changes take effect from the compilation registration date.</p>
                <p>If the compilation includes editorial changes, the endnotes include a brief outline of the changes in general terms. Full details of any changes can be obtained from the Office of Parliamentary Counsel.</p>

                  <b>Misdescribed amendments</b>
                </p>
                <p>A misdescribed amendment is an amendment that does not accurately describe how an amendment is to be made. If, despite the misdescription, the amendment can be given effect as intended, then the misdescribed amendment can be incorporated through an editorial change made under <i>Legislation Act 2003</i>.<ref href="#sec-15V">section 15V</ref> of the </p>
                <p>If a misdescribed amendment cannot be given effect as intended, the amendment is not incorporated and “(md not incorp)” is added to the amendment history.</p>
