              <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

          <heading>Objects of this Act</heading>
          <content>
            <p>The objects of this Act are to increase the availability, and reduce the cost, of credit provided to small and medium enterprises by the Commonwealth investing in debt securities in accordance with this Act.</p>

          <heading>Simplified outline of this Act</heading>
          <content>
            <p>This Act sets up the Australian Business Securitisation Fund.</p>
            <p>The Fund consists of the Australian Business Securitisation Fund Special Account and the investments of the Fund.</p>
            <p>The investments of the Fund must be debt securities that meet certain requirements.</p>
            <p><role refersTo="#minister">The Minister</role> is responsible for making investment decisions for the Fund, however, <role refersTo="#minister">the Minister</role> may delegate the power to make these decisions.</p>
            <p>Investment decisions must be made in accordance with any directions given by <role refersTo="#minister">the Minister</role>.</p>

        <section eId="part-1__sec-5">
          <num>5</num>
          <heading>Definitions</heading>
          <content>
            <p>In this Act:</p>
            <p><term refersTo="#term-account">Account</term> means <def>the Australian Business Securitisation Fund Special Account established by <ref href="#sec-11">section 11</ref>.</def></p>
            <p><term refersTo="#term-amount-of-credit">amount of credit</term> has the same meaning as <def>in the National Credit Code.</def></p>
            <p><b><i>authorised </i></b><b><i>debt security</i></b>: see subsection 12(4).</p>
            <p><term refersTo="#term-credit">credit</term> has the same meaning as <def>in the National Credit Code.</def></p>
            <p><term refersTo="#term-debtor">debtor</term> has the same meaning as <def>in the National Credit Code.</def></p>
            <p><b><i>eligible delegate</i></b>: see subsection 19(2).</p>
            <p><term refersTo="#term-finance-minister">Finance Minister</term> means <def>the Minister who administers the Public Governance, Performance and Accountability Act 2013.</def></p>
            <p><term refersTo="#term-fund">Fund</term> means <def>the Australian Business Securitisation Fund established by <ref href="#sec-10">section 10</ref>.</def></p>
            <p><term refersTo="#term-investment">investment</term> means <def>any mode of application of money or financial assets for the purpose of gaining a return (whether by way of income, capital gain or any other form of return).</def></p>
            <p><term refersTo="#term-investment-mandate">Investment Mandate</term> has the meaning given by <def>subsection 13(1).</def></p>
            <p><term refersTo="#term-investment-of-the-fund">investment of the Fund</term> means <def>an investment that, under <ref href="#sec-12">section 12</ref>, is taken to be an investment of the Fund.</def></p>
            <p><term refersTo="#term-listed-entity">listed entity</term> has the same meaning as <def>in the Public Governance, Performance and Accountability Act 2013.</def></p>
            <p><term refersTo="#term-national-credit-code">National Credit Code</term> has the same meaning as <def>in <ref href="">the National Consumer Credit Protection Act 2009</ref>.</def></p>
            <p><term refersTo="#term-non-corporate-commonwealth-entity">non-corporate Commonwealth entity</term> has the same meaning as <def>in the Public Governance, Performance and Accountability Act 2013.</def></p>
            <p><term refersTo="#term-official">official</term> has the same meaning as <def>in the Public Governance, Performance and Accountability Act 2013.</def></p>
            <p><term refersTo="#term-rules">rules</term> means <def>rules made under <ref href="#sec-22">section 22</ref>.</def></p>

          <num>6</num>
          <heading>Crown to be bound</heading>
          <subsection eId="part-1__sec-6__subsec-1">
            <num>1</num>
            <content>
              <p>This Act binds the Crown in each of its capacities.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-6__subsec-2">
            <num>2</num>
            <content>
              <p>This Act does not make the Crown liable to be prosecuted for an offence.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-1__sec-7">
          <num>7</num>
          <heading>Extension to external Territories</heading>
          <content>
            <p>This Act extends to every external Territory.</p>
          </content>
        </section>
        <section eId="part-1__sec-8">
          <num>8</num>
          <heading>Extra-territorial application</heading>
          <content>
            <p>This Act extends to acts, omissions, matters and things outside Australia.</p>

        <num>2</num>
        <heading>The Australian Business Securitisation Fund</heading>
        <section eId="part-2__sec-9">
          <num>9</num>
          <heading>Simplified outline of this Part</heading>
          <content>
            <p>This Part sets up the Australian Business Securitisation Fund.</p>
            <p>The Fund consists of the Australian Business Securitisation Fund Special Account and the investments of the Fund.</p>
            <p>The investments of the Fund must be debt securities that meet certain requirements and the investments must be made in accordance with any directions given by <role refersTo="#minister">the Minister</role>.</p>
            <p>A total of $2 billion must be credited to the Account, with an initial amount of $250 million credited on <date date="2019-07-01">1 July 2019</date> and additional amounts credited on each 1 July for the following 4 years. The Minister may also, with the agreement of the Finance Minister, determine that additional amounts be credited to the Fund.</p>
            <p>Amounts may be debited from the Account for the purposes of the Account, which include paying the costs of making investments. <role refersTo="#minister">The Minister</role> may also determine that the balance of the Account be reduced.</p>

          <num>10</num>
          <heading>Establishment of the Australian Business Securitisation Fund</heading>
          <subsection eId="part-2__sec-10__subsec-1">
            <num>1</num>
            <content>
              <p>The Australian Business Securitisation Fund is established by this section.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-10__subsec-2">
            <num>2</num>
            <content>
              <p>The Australian Business Securitisation Fund consists of:</p>
            </content>
            <paragraph eId="part-2__sec-10__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>the Australian Business Securitisation Fund Special Account; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-10__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>the investments of the Fund.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-2__sec-11">
          <num>11</num>
          <heading>Establishment of the Australian Business Securitisation Fund Special Account</heading>
          <subsection eId="part-2__sec-11__subsec-1">
            <num>1</num>
            <content>
              <p>The Australian Business Securitisation Fund Special Account is established by this section.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-11__subsec-2">
            <num>2</num>
            <content>
              <p>	(2)	The Account is a special account for the purposes of the <i>Public Governance, Performance and Accountability Act 2013</i>.</p>
            </content>

                <p>Note:	An Appropriation Act may contain a provision to the effect that, if any of the purposes of a special account is a purpose that is covered by an item in the Appropriation Act (whether or not the item expressly refers to the special account), then amounts may be debited against the appropriation for that item and credited to that special account.</p>

        </section>
        <section eId="part-2__sec-12">
          <num>12</num>
          <heading>Investments of the Fund</heading>
          <subsection eId="part-2__sec-12__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	The Minister<i> </i>may, on behalf of the Commonwealth, invest amounts standing to the credit of the Account in any authorised debt security.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-12__subsec-2">
            <num>2</num>
            <content>
              <p>Investments under subsection (1) are taken to be investments of the Fund.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-12__subsec-3">
            <num>3</num>
            <content>
              <p>At any time before an investment of the Fund matures, <role refersTo="#minister">the Minister</role> may, on behalf of the Commonwealth, authorise the re-investment of the proceeds upon maturity in an authorised debt security with the same entity. The new investment is taken to be an investment of the Fund.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-12__subsec-4">
            <num>4</num>
            <content>
              <p>	(4)	An <b><i>authorised </i></b><b><i>debt security</i></b> is a debt security that:</p>
            </content>
            <paragraph eId="part-2__sec-12__subsec-4__para-a">
              <num>a</num>
              <content>
                <p>is issued by:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-12__subsec-4__para-i">
              <num>i</num>
              <content>
                <p>a trustee of a trust; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-12__subsec-4__para-ii">
              <num>ii</num>
              <content>
                <p>a body corporate that is a special purpose vehicle; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-12__subsec-4__para-b">
              <num>b</num>
              <content>
                <p>is expressed in Australian dollars; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-12__subsec-4__para-c">
              <num>c</num>
              <content>
                <p>relates to one or more amounts of credit provided (whether secured or unsecured) to one or more debtors where each such amount of credit:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-12__subsec-4__para-i">
              <num>i</num>
              <content>
                <p>is provided wholly or predominantly for business purposes; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-12__subsec-4__para-ii">
              <num>ii</num>
              <content>
                <p>is less than $5 million or, if the rules prescribe another amount of money, is less than that amount; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-12__subsec-4__para-iii">
              <num>iii</num>
              <content>
                <p>complies with any other requirements or restrictions prescribed by the rules; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-12__subsec-4__para-d">
              <num>d</num>
              <content>
                <p>complies with any other requirements or restrictions prescribed by the rules.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-12__subsec-5">
            <num>5</num>
            <content>
              <p>	(5)	Section 58 of the <i>Public Governance, Performance and Accountability Act 2013</i> (which deals with investment by the Commonwealth) does not apply to an investment of the Fund.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-2__sec-13">
          <num>13</num>
          <heading>Investment Mandate</heading>
          <subsection eId="part-2__sec-13__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	The Minister may, by legislative instrument, give directions about the exercise of the Minister’s powers under <b><i>Investment Mandate</i></b>.<ref href="#sec-12">section 12</ref>. The directions together constitute the </p>
            </content>

                <p>Note:	Section 42 (disallowance) and <i>Legislation Act 2003</i> do not apply to the directions (see regulations made for the purposes of paragraphs 44(2)(b) and 54(2)(b) of that Act).<ref href="#part-4">Part 4</ref> of Chapter 3 (sunsetting) of the </p>

          </subsection>
          <subsection eId="part-2__sec-13__subsec-2">
            <num>2</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> must comply with the Investment Mandate.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-13__subsec-3">
            <num>3</num>
            <content>
              <p>Without limiting subsection (1), the Investment Mandate may include directions about any of the following:</p>
            </content>
            <paragraph eId="part-2__sec-13__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>strategies and policies to be followed for making investments;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-13__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>decision-making criteria for making investments;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-13__subsec-3__para-c">
              <num>c</num>
              <content>
                <p>limits on making investments;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-13__subsec-3__para-d">
              <num>d</num>
              <content>
                <p>risk and return relating to investments;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-13__subsec-3__para-e">
              <num>e</num>
              <content>
                <p>governance arrangements relating to investments;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-13__subsec-3__para-f">
              <num>f</num>
              <content>
                <p>any other matters that <role refersTo="#minister">the Minister</role> thinks appropriate.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-13__subsec-4">
            <num>4</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> must not give a direction under subsection (1):</p>
            </content>
            <paragraph eId="part-2__sec-13__subsec-4__para-a">
              <num>a</num>
              <content>
                <p>that has the purpose, or is likely to have the effect, of directly or indirectly requiring <role refersTo="#minister">the Minister</role> to make, or not to make, a particular investment; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-13__subsec-4__para-b">
              <num>b</num>
              <content>
                <p>that is inconsistent with this Act (including the objects of this Act).</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-2__sec-14">
          <num>14</num>
          <heading>Credits to the Account</heading>
          <subsection eId="part-2__sec-14__subsec-1">
            <num>1</num>
            <content>
              <p>There must be credited to the Account amounts equal to the following:</p>
            </content>
            <paragraph eId="part-2__sec-14__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>$250 million, to be credited on <date date="2019-07-01">1 July 2019</date>;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-14__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>$250 million, to be credited on <date date="2020-07-01">1 July 2020</date>;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-14__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>$500 million, to be credited on <date date="2021-07-01">1 July 2021</date>;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-14__subsec-1__para-d">
              <num>d</num>
              <content>
                <p>$500 million, to be credited on <date date="2022-07-01">1 July 2022</date>;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-14__subsec-1__para-e">
              <num>e</num>
              <content>
                <p>$500 million, to be credited on <date date="2023-07-01">1 July 2023</date>;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-14__subsec-1__para-f">
              <num>f</num>
              <content>
                <p>income derived from an investment of the Fund;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-14__subsec-1__para-g">
              <num>g</num>
              <content>
                <p>a return of capital, or any other financial distribution, relating to an investment of the Fund;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-14__subsec-1__para-h">
              <num>h</num>
              <content>
                <p>the proceeds of the realisation of an investment of the Fund.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-14__subsec-2">
            <num>2</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> may, by notifiable instrument, determine that an amount equal to a specified amount is to be credited to the Account at a time specified in, or ascertained in accordance with, the determination.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-14__subsec-3">
            <num>3</num>
            <content>
              <p>The time specified in, or ascertained in accordance with, the determination must be on or after the time the determination is made.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-14__subsec-4">
            <num>4</num>
            <content>
              <p>The determination must be expressed to be for a specified budget year.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-14__subsec-5">
            <num>5</num>
            <content>
              <p>Before making a determination under subsection (2), <role refersTo="#minister">the Minister</role> must obtain the agreement of the Finance Minister to the determination.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-2__sec-15">
          <num>15</num>
          <heading>Purposes of the Account</heading>
          <content>
            <p>The purposes of the Account are as follows:</p>
          </content>
          <paragraph eId="part-2__sec-15__para-a">
            <num>a</num>
            <content>
              <p>paying the costs of the making of an investment under <ref href="#sec-12">section 12</ref>;</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-15__para-b">
            <num>b</num>

          <heading>Reducing the balance of the Account</heading>
          <subsection eId="part-2__sec-16__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> may, by writing, direct that a specified amount is to be debited from the Account on a specified day (which must be on or after the day the direction is made).</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-16__subsec-2">
            <num>2</num>
            <content>
              <p>A direction under subsection (1) is not a legislative instrument.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-16__subsec-3">

              <p><role refersTo="#minister">The Minister</role> must give a copy of a direction under subsection (1) to the Finance Minister.</p>

          <heading>Simplified outline of this Part</heading>
          <content>
            <p>This Part contains miscellaneous provisions, including provisions about constitutional limits, delegation of <role refersTo="#minister">the Minister</role>’s powers and functions under this Act, reporting on the operation of this Act and conducting a review of the operation of this Act.</p>
            <p>This Part also contains the general rule-making power.</p>

        </section>
        <section eId="part-3__sec-18">
          <num>18</num>
          <heading>Constitutional limits</heading>
          <content>
            <p><role refersTo="#minister">The Minister</role> may exercise a power or perform a function conferred on <role refersTo="#minister">the Minister</role> by section 12 only:</p>
          </content>
          <paragraph eId="part-3__sec-18__para-a">
            <num>a</num>
            <content>
              <p>with respect to trade or commerce:</p>
            </content>
          </paragraph>
          <paragraph eId="part-3__sec-18__para-i">
            <num>i</num>
            <content>
              <p>between Australia and places outside Australia; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-3__sec-18__para-ii">
            <num>ii</num>
            <content>
              <p>among the States; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-3__sec-18__para-iii">
            <num>iii</num>
            <content>
              <p>within a Territory, between a State and a Territory or between 2 Territories; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-3__sec-18__para-b">
            <num>b</num>
            <content>
              <p>with respect to a Territory; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-3__sec-18__para-c">
            <num>c</num>

              <p>with respect to the implied power of the Parliament to make laws with respect to nationhood; or</p>

          </paragraph>
        </section>
        <section eId="part-3__sec-19">
          <num>19</num>
          <heading>Delegations by the Minister</heading>
          <subsection eId="part-3__sec-19__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> may, by written instrument, delegate to an eligible delegate (see subsection (2)) any of <role refersTo="#minister">the Minister</role>’s powers or functions under this Act (other than <role refersTo="#minister">the Minister</role>’s powers under section 13, 14 or 22).</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-19__subsec-2">
            <num>2</num>
            <content>
              <p>	(2)	An <b><i>eligible delegate</i></b> is an official of the Department of the Treasury, or a listed entity that is prescribed by the rules, who:</p>
            </content>
            <paragraph eId="part-3__sec-19__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>is an SES employee; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-19__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>is an APS employee who holds or performs the duties of an Executive Level 2, or equivalent, position; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-19__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>occupies an office or position at an equivalent level to that of an SES employee, or an Executive Level 2 position.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-3__sec-19__subsec-3">
            <num>3</num>
            <content>
              <p>Before delegating a power or function under subsection (1), <role refersTo="#minister">the Minister</role> must have regard to:</p>
            </content>
            <paragraph eId="part-3__sec-19__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>if the power or function is to be delegated to a person holding, occupying, or performing the duties of, a specified office or position—whether the office or position is sufficiently senior for the person to exercise the power or perform the function or duty; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-19__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>otherwise—whether the person has appropriate qualifications or expertise to exercise the power or perform the function.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-3__sec-19__subsec-4">
            <num>4</num>
            <content>
              <p>A person exercising powers or performing functions under a delegation under subsection (1) must comply with any written directions of <role refersTo="#minister">the Minister</role>.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-19__subsec-5">
            <num>5</num>
            <content>
              <p>A direction under subsection (4) must not be inconsistent with this Act (including the objects of this Act) or a legislative instrument made under this Act.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-3__sec-20">
          <num>20</num>
          <heading>Annual report</heading>
          <content>
            <p>		The annual report prepared by the Chief Executive Officer of the Australian Office of Financial Management and given to the Minister under <i>Public Governance, Performance and Accountability Act 2013</i> for a period must include a report on the operation of this Act during the period.<ref href="#sec-46">section 46</ref> of the </p>
          </content>
        </section>
        <section eId="part-3__sec-21">
          <num>21</num>
          <heading>Review of operation of this Act</heading>
          <subsection eId="part-3__sec-21__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> must cause a review of the operation of this Act to be undertaken as soon as possible after each of the following:</p>
            </content>
            <paragraph eId="part-3__sec-21__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the second anniversary of the commencement of this Act;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-21__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>the fifth anniversary of the commencement of this Act.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-3__sec-21__subsec-2">
            <num>2</num>
            <content>
              <p>The review must include a review of the effectiveness of this Act in meeting the objectives of this Act.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-21__subsec-3">
            <num>3</num>
            <content>
              <p>The persons undertaking the review must give <role refersTo="#minister">the Minister</role> a written report of the review.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-21__subsec-4">
            <num>4</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> must cause a copy of the report of the review to be tabled in each House of the Parliament within 15 sitting days of that House after the report is given to <role refersTo="#minister">the Minister</role>.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-3__sec-22">
          <num>22</num>
          <heading>Rules</heading>
          <subsection eId="part-3__sec-22__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, make rules prescribing matters:</p>
            </content>
            <paragraph eId="part-3__sec-22__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>required or permitted by this Act to be prescribed by the rules; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-22__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>necessary or convenient to be prescribed for carrying out or giving effect to this Act.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-3__sec-22__subsec-2">
            <num>2</num>
            <content>
              <p>To avoid doubt, the rules may not do the following:</p>
            </content>
            <paragraph eId="part-3__sec-22__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>create an offence or civil penalty;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-22__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>provide powers of:</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-22__subsec-2__para-i">
              <num>i</num>
              <content>
                <p>arrest or detention; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-22__subsec-2__para-ii">
              <num>ii</num>
              <content>
                <p>entry, search or seizure;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-22__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>impose a tax;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-22__subsec-2__para-d">
              <num>d</num>
              <content>
                <p>set an amount to be appropriated from the Consolidated Revenue Fund under an appropriation in this Act;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-22__subsec-2__para-e">
              <num>e</num>
              <content>
                <p>directly amend the text of this Act.</p>
