            <heading>Definitions</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-994A__subclause-1">
              <num>1</num>
              <content>
                <p>In this Part:</p>
              </content>
            </hcontainer>
            <content>
              <p><b><i>appropriate</i></b>: a target market determination for a financial product is <b><i>appropriate</i></b> if it satisfies the requirements of subsection 994B(8).</p>
              <p><b><i>complaint</i></b>, in relation to a financial product, means a complaint made to a regulated person about the product, which is covered by a dispute resolution system complying with subsection 912A(2).</p>
              <p><b><i>dealing</i></b> in a financial product has the meaning given by section 766C, subject to the following:</p>
              <p><b><i>distribution condition</i></b> has the meaning given by paragraph 994B(5)(c).</p>
              <p><b><i>distribution information</i></b>, in relation to a financial product, has the meaning given by subsection 994F(3).</p>
              <p><b><i>excluded conduct</i></b> means:</p>
              <p><b><i>excluded dealing</i></b> means a dealing in a financial product that consists of arranging for a retail client to apply for or acquire the product, where the arranging is undertaken:</p>
              <p><b><i>financial product</i></b> has the meaning given by subsection 994AA(1).</p>
              <p><b><i>MySuper product</i></b> has the same meaning as in the <i>Superannuation Industry (Supervision) Act 1993</i>.</p>
              <p><b><i>regulated person</i></b>, in relation to a financial product, means:</p>
              <p><b><i>regulated sale </i></b>means a sale:</p>
              <p><b><i>reporting period</i></b> means:</p>
              <p><b><i>retail product distribution conduct</i></b>, in relation to a financial product, means any of the following:</p>
              <p><b><i>review period</i></b>, for a target market determination, means each of the following:</p>
              <p><b><i>review triggers</i></b>, for a target market determination, has the meaning given by paragraph 994B(5)(d).</p>
              <p><b><i>target market</i></b>, for a financial product, means the class of retail clients described in the target market determination for the product under paragraph 994B(5)(b).</p>
              <p><b><i>target market determination</i></b> means a determination that:</p>
              <p>Note:	Section 1010C affects references to sale<i> </i>and offer.</p>

              <num>a</num>
              <content>
                <p>paragraphs 766C(1)(d) and (e) do not apply;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994A__para-b">
              <num>b</num>
              <content>
                <p>despite subsection 766C(3), a person deals in a financial product if the dealing is a regulated sale of the product on the person’s own behalf;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994A__para-c">
              <num>c</num>
              <content>
                <p>paragraph 766C(4)(c) does not apply if the dealing is an offer of securities that needs disclosure to investors under <ref href="#part-6D">Part 6D</ref>.2.</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994A__para-a">
              <num>a</num>
              <content>
                <p>an excluded dealing; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994A__para-b">
              <num>b</num>
              <content>
                <p>providing personal advice.</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994A__para-a">
              <num>a</num>
              <content>
                <p>by a person, or by an associate of a person; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994A__para-b">
              <num>b</num>
              <content>
                <p>for the purpose of implementing personal advice that the person has given to the retail client.</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994A__para-a">
              <num>a</num>
              <content>
                <p>the seller of the financial product, if a sale takes place in circumstances described in subsection 707(2), (3) or (5) or 1012C(5), (6) or (8); or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994A__para-b">
              <num>b</num>
              <content>
                <p>a regulated person <ref href="#sec-1011B">as defined in section 1011B</ref> (modified so that the references to financial products include references to securities); or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994A__para-c">
              <num>c</num>
              <content>
                <p>a person prescribed, in relation to the product, by regulations made for the purposes of this paragraph.</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994A__para-a">
              <num>a</num>
              <content>
                <p>that, under subsection 707(2), (3) or (5), needs disclosure to investors under <ref href="#part-6D">Part 6D</ref>.2; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994A__para-b">
              <num>b</num>
              <content>
                <p>in relation to which a Product Disclosure Statement must be given under subsection 1012C(5), (6) or (8); or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994A__para-c">
              <num>c</num>
              <content>
                <p>made in circumstances prescribed by regulations made for the purposes of this paragraph.</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994A__para-a">
              <num>a</num>
              <content>
                <p>for information about the number of complaints about a financial product—a period specified under paragraph 994B(5)(g), in the target market determination for the product, as a reporting period for that kind of information; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994A__para-b">
              <num>b</num>
              <content>
                <p>for other kinds of information that must be reported under subsection 994F(5)—a period specified under subparagraph 994B(5)(h)(ii), in the target market determination for the product, as a reporting period for those other kinds of information.</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994A__para-a">
              <num>a</num>
              <content>
                <p>dealing in the product in relation to a retail client;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994A__para-b">
              <num>b</num>
              <content>
                <p>under <ref href="#part-6D">Part 6D</ref>.2, giving a disclosure document in relation to an offer of the product to a retail client;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994A__para-c">
              <num>c</num>
              <content>
                <p>under <ref href="#part-7">Part 7</ref>.9, giving a Product Disclosure Statement for the product to a retail client;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994A__para-d">
              <num>d</num>
              <content>
                <p>providing financial product advice in relation to the product to a retail client.</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994A__para-a">
              <num>a</num>
              <content>
                <p>the period starting on the day the determination is made and ending on the earlier of:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994A__para-i">
              <num>i</num>
              <content>
                <p>the day that a review of the determination under <ref href="#sec-994C">section 994C</ref> is started; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994A__para-ii">
              <num>ii</num>
              <content>
                <p>the last day of the maximum period specified in the determination under paragraph 994B(5)(e);</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994A__para-b">
              <num>b</num>
              <content>
                <p>a period starting on the day after a review of the determination under <ref href="#sec-994C">section 994C</ref> is finished and ending on the earlier of:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994A__para-i">
              <num>i</num>
              <content>
                <p>the day on which the next review of the determination under <ref href="#sec-994C">section 994C</ref> is started; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994A__para-ii">
              <num>ii</num>
              <content>
                <p>the last day of the maximum period specified in the determination under paragraph 994B(5)(f).</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994A__para-a">
              <num>a</num>
              <content>
                <p>is made as required by <ref href="#sec-994B">section 994B</ref>; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994A__para-b">
              <num>b</num>
              <content>
                <p>meets the requirements of subsections 994B(5) and (8).</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-994A__subclause-2">
              <num>2</num>
              <content>
                <p>Section 1010C applies for the purposes of this Part.</p>
              </content>
            </hcontainer>

          <hcontainer name="clause" eId="schedule-1__clause-994AA">
            <num>994AA</num>
            <heading>Extended operation of this Part in relation to ASIC Act financial products</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-994AA__subclause-1">
              <num>1</num>
              <content>
                <p>	(1)	In this Part, <b><i>financial product</i></b> means each of the following:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-994AA__para-a">
              <num>a</num>
              <content>
                <p>a financial product (within the meaning of this Chapter) (see <ref href="#sec-761A">section 761A</ref>);</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994AA__para-b">
              <num>b</num>
              <content>
                <p>a financial product (within the meaning of <ref href="#dvs-2">Division 2</ref> of Part 2 of the ASIC Act), other than a financial product covered by paragraph (a).</p>
              </content>
            </paragraph>
            <content>
              <p>Note:	Whether a target market determination is required to be made in relation to financial products covered by this extended definition is determined under <ref href="#sec-994B">section 994B</ref>, including any regulations made for the purposes of paragraph 994B(3)(f).</p>
            </content>
            <hcontainer name="subclause" eId="schedule-1__clause-994AA__subclause-2">
              <num>2</num>
              <content>
                <p>In determining the meaning of a term used in a provision of this Part (other than this section), treat a reference in this Act to a financial product as being a reference to a financial product within the meaning of subsection (1) of this section.</p>
              </content>

          <hcontainer name="clause" eId="schedule-1__clause-994B">
            <num>994B</num>
            <heading>Target market determinations for financial products</heading>
            <content>
              <p>Requirement to make a target market determination</p>
              <p>Note 1:	Failure to comply with this subsection is an offence (see subsection 1311(1)).</p>
              <p>Note 2:	This subsection is also a civil penalty provision (see <ref href="#sec-1317E">section 1317E</ref>). For relief from liability to a civil penalty relating to this subsection, see <ref href="#sec-1317S">section 1317S</ref>.</p>
              <p>Requirements for target market determinations</p>
              <p>Note 1:	For paragraph (c), an example of a distribution condition for a financial product is a restriction limiting the distribution of the product to specified methods of distribution.</p>
              <p>Note 2:	The requirements of this subsection also apply when a new target market determination is made as a result of a review under <ref href="#sec-994C">section 994C</ref>.</p>
              <p>Making target market determinations public</p>
              <p>Note 1:	Contravention of this subsection is an offence (see subsection 1311(1)).</p>
              <p>Note 2:	This subsection is also a civil penalty provision (see <ref href="#sec-1317E">section 1317E</ref>). For relief from liability to a civil penalty relating to this subsection, see <ref href="#sec-1317S">section 1317S</ref>.</p>
              <p>Note 3:	This subsection applies to all target market determinations, including those that have ceased to apply.</p>
            </content>
            <hcontainer name="subclause" eId="schedule-1__clause-994B__subclause-1">
              <num>1</num>
              <content>
                <p>Subject to subsection (3), a person must make a target market determination for a financial product if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-994B__para-a">
              <num>a</num>
              <content>
                <p>under <ref href="#part-6D">Part 6D</ref>.2, the person is required to prepare a disclosure document for the product; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994B__para-b">
              <num>b</num>
              <content>
                <p>under <ref href="#part-7">Part 7</ref>.9, the person is required to prepare a Product Disclosure Statement for the product; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994B__para-ba">
              <num>ba</num>
              <content>
                <p>the product is covered by paragraph 994AA(1)(b) (about the extended operation of this Part) and:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994B__para-i">
              <num>i</num>
              <content>
                <p>the person issues the product to another person as a retail client; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994B__para-ii">
              <num>ii</num>
              <content>
                <p>the person sells the product under a regulated sale; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994B__para-c">
              <num>c</num>
              <content>
                <p>regulations made for the purpose of this paragraph require the person to make a target market determination for the product.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-994B__subclause-2">
              <num>2</num>
              <content>
                <p>A person required by subsection (1) to make a target market determination for a financial product must do so before:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-994B__para-a">
              <num>a</num>
              <content>
                <p>if paragraph (1)(a), (b) or (ba) applies—any person engages in retail product distribution conduct in relation to the product; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994B__para-b">
              <num>b</num>
              <content>
                <p>if paragraph (1)(c) applies:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994B__para-i">
              <num>i</num>
              <content>
                <p>the time or event specified in regulations made for the purposes of that paragraph; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994B__para-ii">
              <num>ii</num>
              <content>
                <p>if there is no time or event so specified—any person engages in retail product distribution conduct in relation to the product.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-994B__subclause-3">
              <num>3</num>
              <content>
                <p>Subsections (1) and (2) do not apply to:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-994B__para-a">
              <num>a</num>
              <content>
                <p>a MySuper product; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994B__para-b">
              <num>b</num>
              <content>
                <p>a margin lending facility; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994B__para-c">
              <num>c</num>
              <content>
                <p>a security that has been or will be issued under an employee share scheme; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994B__para-d">
              <num>d</num>
              <content>
                <p>a fully paid ordinary share in a company or a foreign company (except a fully paid ordinary share covered by subsection (4)); or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994B__para-e">
              <num>e</num>
              <content>
                <p>a financial product issued, or offered for regulated sale, by an exempt body or an exempt public authority; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994B__para-f">
              <num>f</num>
              <content>
                <p>a financial product of a kind prescribed by regulations made for the purposes of this paragraph.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-994B__subclause-4">
              <num>4</num>
              <content>
                <p>Paragraph (3)(d) does not apply to a fully paid ordinary share in a company or a foreign company if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-994B__para-a">
              <num>a</num>
              <content>
                <p>on the issue of the share, the company intended that the share be converted into a preference share <quantity refersTo="#deadline">within 12 months</quantity> after the date of issue; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994B__para-b">
              <num>b</num>
              <content>
                <p>the company:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994B__para-i">
              <num>i</num>
              <content>
                <p>carries on a business of investment in financial products, interests in land or other investments; and</p>
              </content>
            </paragraph>

                <p>in the course of carrying on that business, invests funds subscribed, whether directly or indirectly, after an offer or invitation to the public (<ref href="#sec-82">within the meaning of section 82</ref>) made on terms that the funds subscribed would be invested.</p>

                <p>A target market determination for a financial product must:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-994B__para-a">
              <num>a</num>
              <content>
                <p>be in writing; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994B__para-b">
              <num>b</num>
              <content>
                <p>describe the class of retail clients that comprises the target market (within the ordinary meaning of the term) for the product; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994B__para-c">
              <num>c</num>
              <content>
                <p>	(c)	specify any conditions and restrictions on retail product distribution conduct in relation to the product (<b><i>distribution conditions</i></b>), other than a condition or restriction imposed by or under another provision of this Act; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994B__para-d">
              <num>d</num>
              <content>
                <p>	(d)	specify events and circumstances (<b><i>review triggers</i></b>) that would reasonably suggest that the determination is no longer appropriate; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994B__para-e">
              <num>e</num>
              <content>
                <p>specify the maximum period from the start of the day the determination is made to the start of the day the first review of the determination under <ref href="#sec-994C">section 994C</ref> is to finish; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994B__para-f">
              <num>f</num>
              <content>
                <p>specify the maximum period from the start of the day a review of the determination under <ref href="#sec-994C">section 994C</ref> is finished to the start of the day the next review of the determination is to finish; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994B__para-g">
              <num>g</num>
              <content>
                <p>specify a reporting period for reporting information about the number of complaints about the product (see subsection 994F(4)); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994B__para-h">
              <num>h</num>
              <content>
                <p>specify the kinds of information needed to enable the person who made the target market determination to identify promptly whether a review trigger for the determination, or another event or circumstance that would reasonably suggest that the determination is no longer appropriate, has occurred and, for each kind of information, specify:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994B__para-i">
              <num>i</num>
              <content>
                <p>the regulated person or regulated persons that, under subsection 994F(5), are required to report the information to the person who made the determination; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994B__para-ii">
              <num>ii</num>
              <content>
                <p>a reporting period for reporting the information under subsection 994F(5).</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-994B__subclause-6">
              <num>6</num>
              <content>
                <p>A period specified under paragraph (5)(e) or (f), and a reporting period specified under paragraph (5)(g) or subparagraph (5)(h)(ii), must be reasonable.</p>

              <num>7</num>
              <content>
                <p>In determining what is reasonable for the purposes of subsection (6), regard must be had to:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-994B__para-a">
              <num>a</num>
              <content>
                <p>the need to identify promptly whether a review trigger for the determination, or another event or circumstance that would reasonably suggest that the determination is no longer appropriate, has occurred; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994B__para-b">
              <num>b</num>
              <content>
                <p>the likelihood, nature and extent of detriment to retail clients that may result if:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994B__para-i">
              <num>i</num>
              <content>
                <p>a review trigger for the determination, or another event or circumstance that would reasonably suggest that the target market determination is no longer appropriate, has occurred; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994B__para-ii">
              <num>ii</num>
              <content>
                <p>the target market determination is not promptly reviewed.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-994B__subclause-8">
              <num>8</num>
              <content>
                <p>A target market determination for a financial product must be such that it would be reasonable to conclude that, if the product were to be issued, or sold in a regulated sale:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-994B__para-a">
              <num>a</num>
              <content>
                <p>to a retail client in accordance with the distribution conditions—it would be likely that the retail client is in the target market; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994B__para-b">
              <num>b</num>
              <content>
                <p>to a retail client in the target market—it would likely be consistent with the likely objectives, financial situation and needs of the retail client.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-994B__subclause-9">
              <num>9</num>
              <content>
                <p>A person who makes a target market determination must ensure that the determination is available to the public free of charge.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-994C">
            <num>994C</num>
            <heading>Target market determinations to be reviewed</heading>
            <content>
              <p>Reviews of target market determinations</p>
              <p>Note 1:	Contravention of this subsection is an offence (see subsection 1311(1)).</p>
              <p>Note 2:	This subsection is also a civil penalty provision (see <ref href="#sec-1317E">section 1317E</ref>). For relief from liability to a civil penalty relating to this subsection, see <ref href="#sec-1317S">section 1317S</ref>.</p>
              <p>Distribution where target market determinations not appropriate: maker of determination</p>
              <p>then, from as soon as practicable, but no later than 10 business days, after the person first knew of the occurrence of the review trigger, event or circumstance, the person must not engage in retail product distribution conduct in relation to the product unless:</p>
              <p>Note 1:	Failure to comply with this subsection is an offence (see subsection 1311(1)).</p>
              <p>Note 2:	In a prosecution for an offence, the defendant bears an evidential burden in relation to the matters in paragraphs (d) and (e) (see subsection 13.3(3) of the <i>Criminal Code</i>).</p>
              <p>then, from as soon as practicable, but no later than 10 business days, after the person first knew of the occurrence of the review trigger, event or circumstance, the person must not engage in retail product distribution conduct in relation to the product unless:</p>
              <p>Note:	This subsection is a civil penalty provision (see <ref href="#sec-1317E">section 1317E</ref>). For relief from liability to a civil penalty relating to this subsection, see <ref href="#sec-1317S">section 1317S</ref>.</p>
              <p>the person must, as soon as practicable, but no later than 10 business days, after the person first knew of the occurrence of the review trigger, event or circumstance, take all reasonable steps to ensure that regulated persons who engage in retail product distribution conduct in relation to the product (or are expected to do so) are informed that they must not engage in retail product distribution conduct in relation to the product unless:</p>
              <p>Note 1:	Contravention of this subsection is an offence (see subsection 1311(1)).</p>
              <p>Note 2:	This subsection is also a civil penalty provision (see <ref href="#sec-1317E">section 1317E</ref>). For relief from liability to a civil penalty relating to this subsection, see <ref href="#sec-1317S">section 1317S</ref>.</p>
              <p>Distribution where target market determinations not appropriate: regulated persons</p>
              <p>Note 1:	Contravention of this subsection is an offence (see subsection 1311(1)).</p>

                <p>A person who makes a target market determination may at any time:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-994C__para-a">
              <num>a</num>
              <content>
                <p>review the determination; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994C__para-b">
              <num>b</num>
              <content>
                <p>make a new target market determination in accordance with <ref href="#sec-994B">section 994B</ref>.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-994C__subclause-2">
              <num>2</num>
              <content>
                <p>A person contravenes this subsection if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-994C__para-a">
              <num>a</num>
              <content>
                <p>the person makes a target market determination for a financial product; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994C__para-b">
              <num>b</num>
              <content>
                <p>the product is on offer for acquisition by issue, or for regulated sale, to retail clients at or after the end of the review period; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994C__para-c">
              <num>c</num>
              <content>
                <p>the person did not complete a review of the determination during the review period.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-994C__subclause-3">
              <num>3</num>
              <content>
                <p>If:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-994C__para-a">
              <num>a</num>
              <content>
                <p>a person makes a target market determination for a financial product; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994C__para-b">
              <num>b</num>
              <content>
                <p>the product is on offer for acquisition by issue, or for regulated sale, to retail clients at any time during a review period for the determination; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994C__para-c">
              <num>c</num>
              <content>
                <p>the person knows that:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994C__para-i">
              <num>i</num>
              <content>
                <p>a review trigger for the determination has occurred; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994C__para-ii">
              <num>ii</num>
              <content>
                <p>an event or circumstance has occurred that would reasonably suggest that the determination is no longer appropriate;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994C__para-d">
              <num>d</num>
              <content>
                <p>the person has reviewed the determination and, if the determination is no longer appropriate, made a new determination in accordance with <ref href="#sec-994B">section 994B</ref>; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994C__para-e">
              <num>e</num>
              <content>
                <p>the retail product distribution conduct is excluded conduct.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-994C__subclause-4">
              <num>4</num>
              <content>
                <p>If:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-994C__para-a">
              <num>a</num>
              <content>
                <p>a person makes a target market determination for a financial product; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994C__para-b">
              <num>b</num>
              <content>
                <p>the product is on offer for acquisition by issue, or for regulated sale, to retail clients at any time during a review period for the determination; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994C__para-c">
              <num>c</num>
              <content>
                <p>the person knows, or ought reasonably to know, that:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994C__para-i">
              <num>i</num>
              <content>
                <p>a review trigger for the determination has occurred; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994C__para-ii">
              <num>ii</num>
              <content>
                <p>an event or circumstance has occurred that would reasonably suggest that the determination is no longer appropriate;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994C__para-d">
              <num>d</num>
              <content>
                <p>the person has reviewed the determination and, if the determination is no longer appropriate, made a new target market determination in accordance with <ref href="#sec-994B">section 994B</ref>; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994C__para-e">
              <num>e</num>
              <content>
                <p>the retail product distribution conduct is excluded conduct.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-994C__subclause-5">
              <num>5</num>
              <content>
                <p>If:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-994C__para-a">
              <num>a</num>
              <content>
                <p>a person makes a target market determination for a financial product; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994C__para-b">
              <num>b</num>
              <content>
                <p>the product is on offer for acquisition by issue, or for regulated sale, to retail clients at any time during a review period for the determination; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994C__para-c">
              <num>c</num>
              <content>
                <p>the person knows that:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994C__para-i">
              <num>i</num>
              <content>
                <p>a review trigger for the determination has occurred; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994C__para-ii">
              <num>ii</num>
              <content>
                <p>an event or circumstance has occurred that would reasonably suggest that the determination is no longer appropriate;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994C__para-d">
              <num>d</num>
              <content>
                <p>the determination has been reviewed since the review trigger, event or circumstance occurred and, if a new target market determination is required, it has been made; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994C__para-e">
              <num>e</num>
              <content>
                <p>the retail product distribution conduct is excluded conduct.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-994C__subclause-6">
              <num>6</num>
              <content>
                <p>If a regulated person in relation to a financial product knows that the person who made the target market determination for the product has taken steps referred to in subsection (5), the regulated person must, as soon as practicable, but no later than 10 business days, after the regulated person first became aware that the steps had been taken, cease to engage in retail product distribution conduct in relation to the product unless:</p>

            <paragraph eId="schedule-1__clause-994C__para-a">
              <num>a</num>
              <content>
                <p>the determination has been reviewed since a review trigger, event or circumstance mentioned in paragraph (5)(c) occurred and, if a new target market determination is required, it has been made; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994C__para-b">
              <num>b</num>
              <content>
                <p>the regulated person:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994C__para-i">
              <num>i</num>
              <content>
                <p>made all inquiries (if any) that were reasonable in the circumstances; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994C__para-ii">
              <num>ii</num>
              <content>
                <p>after doing so, believed on reasonable grounds that the determination had been reviewed since a review trigger, event or circumstance mentioned in paragraph (5)(c) occurred and, if a new target market determination was required, it had been made; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994C__para-c">
              <num>c</num>
              <content>
                <p>the retail product distribution conduct is excluded conduct.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-994C__subclause-7">
              <num>7</num>

                <p>If a regulated person knows or ought reasonably to know that the person who made the target market determination for a financial product has taken steps referred to in subsection (5), the regulated person must, as soon as practicable, but no later than 10 business days, after the regulated person first became aware or should have become aware that the steps had been taken, cease to engage in retail product distribution conduct in relation to the product unless:</p>

              <num>a</num>

                <p>the determination has been reviewed since a review trigger, event or circumstance mentioned in paragraph (5)(c) occurred and, if a new target market determination is required, it has been made; or</p>

              <num>b</num>
              <content>
                <p>the regulated person:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994C__para-i">

                <p>made all inquiries (if any) that were reasonable in the circumstances; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994C__para-ii">
              <num>ii</num>

                <p>after doing so, believed on reasonable grounds that the determination had been reviewed since a review trigger, event or circumstance mentioned in paragraph (5)(c) occurred and, if a new target market determination was required, it had been made; or</p>

                <p>the retail product distribution conduct is excluded conduct.</p>

            </paragraph>

            <heading>Prohibition on engaging in retail product distribution conduct unless target market determination made</heading>
            <content>
              <p>If:</p>
              <p>a regulated person must not engage in retail product distribution conduct in relation to the product unless:</p>

                <p>the product is on offer for acquisition by issue, or for regulated sale, to retail clients;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994D__para-c">

                <p>the regulated person made all inquiries (if any) that were reasonable in the circumstances and, after doing so, believed on reasonable grounds that:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994D__para-i">
              <num>i</num>
              <content>
                <p>the determination had been made; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994D__para-ii">
              <num>ii</num>
              <content>
                <p>this Part does not require a target market determination for the product; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994D__para-d">
              <num>d</num>
              <content>
                <p>the retail product distribution conduct is excluded conduct.</p>
              </content>
            </paragraph>

            <heading>Reasonable steps to ensure consistency with target market determinations</heading>
            <content>
              <p>Persons who make target market determinations</p>

              <p>What are reasonable steps</p>
            </content>
            <hcontainer name="subclause" eId="schedule-1__clause-994E__subclause-1">
              <num>1</num>
              <content>
                <p>A person who makes a target market determination for a financial product must take reasonable steps that will, or are reasonably likely to, result in retail product distribution conduct in relation to the product (other than excluded conduct) being consistent with the determination.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-994E__subclause-2">
              <num>2</num>
              <content>
                <p>A person is not taken to have failed to take reasonable steps for the purpose of subsection (1) merely because:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-994E__para-a">
              <num>a</num>
              <content>
                <p>retail product distribution conduct of a regulated person (other than the person) in relation to the product is inconsistent with the target market determination; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994E__para-b">
              <num>b</num>
              <content>
                <p>a retail client who is not in the target market for the product acquires the product.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-994E__subclause-3">
              <num>3</num>
              <content>
                <p>If:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-994E__para-a">
              <num>a</num>
              <content>
                <p>a target market determination for a financial product has been made; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994E__para-b">
              <num>b</num>
              <content>
                <p>the product is on offer for acquisition by issue, or for regulated sale, to retail clients; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994E__para-c">
              <num>c</num>
              <content>
                <p>a regulated person engages in retail product distribution conduct in relation to the product; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994E__para-d">
              <num>d</num>
              <content>
                <p>the regulated person failed to take reasonable steps that would have resulted in, or would have been reasonably likely to have resulted in, the retail product distribution conduct being consistent with the determination;</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-994E__subclause-4">
              <num>4</num>
              <content>
                <p>A regulated person is not taken to have failed to take reasonable steps for the purpose of paragraph (3)(d) merely because a retail client who is not in the target market for the product acquires the product.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-994E__subclause-5">
              <num>5</num>
              <content>
                <p>	(5)	Without limiting subsections (1) and (3), <b><i>reasonable steps</i></b> in relation to a person are steps that, in the circumstances, the person is reasonably able to take that will, or are reasonably likely to, result in retail product distribution conduct in relation to the financial product being consistent with the target market determination for the product, taking into account all relevant matters, including:</p>

            <paragraph eId="schedule-1__clause-994E__para-a">

            </paragraph>

            <paragraph eId="schedule-1__clause-994E__para-c">
              <num>c</num>
              <content>
                <p>what the person knows, or ought reasonably to know, about:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994E__para-i">
              <num>i</num>
              <content>
                <p>the matters referred to in paragraphs (a) and (b); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994E__para-ii">
              <num>ii</num>
              <content>
                <p>ways of eliminating or minimising the likelihood and the harm; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994E__para-d">
              <num>d</num>
              <content>
                <p>the availability and suitability of ways to eliminate or minimise the likelihood and the harm.</p>
              </content>
            </paragraph>

                <p>A regulated person is not taken to have failed to take reasonable steps for the purpose of paragraph (3)(d) if the person engages in retail product distribution conduct that:</p>

              <content>
                <p>relates to a particular retail client; and</p>
              </content>
            </paragraph>

            <paragraph eId="schedule-1__clause-994E__para-c">
              <num>c</num>
              <content>
                <p>is necessary to implement personal advice given to the client in relation to the product.</p>

            <heading>Record keeping and notification obligations</heading>

              <p>Record keeping by persons who make, or are required to make, target market determinations</p>

                <p>A person who makes, or who is required by this Part to make, a target market determination for a financial product must collect and keep complete and accurate records of:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-994F__para-a">
              <num>a</num>
              <content>
                <p>the person’s decisions in relation to the following:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994F__para-i">
              <num>i</num>
              <content>
                <p>all target market determinations for the product;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994F__para-ii">
              <num>ii</num>
              <content>
                <p>review triggers for those target market determinations;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994F__para-iii">
              <num>iii</num>
              <content>
                <p>review periods for those target market determinations;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994F__para-iv">
              <num>iv</num>
              <content>
                <p>the requirements of subsections 994B(5) and (8) for those target market determinations; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994F__para-b">
              <num>b</num>
              <content>
                <p>the reasons for those decisions.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-994F__subclause-2">
              <num>2</num>
              <content>
                <p>Subsections (3) to (6) apply if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-994F__para-a">
              <num>a</num>
              <content>
                <p>a target market determination has been made for a financial product; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994F__para-b">
              <num>b</num>
              <content>
                <p>the product is on offer for acquisition by issue, or for regulated sale, to retail clients; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994F__para-c">
              <num>c</num>
              <content>
                <p>a regulated person engages in retail product distribution conduct in relation to the product.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-994F__subclause-3">
              <num>3</num>
              <content>
                <p>	(3)	The regulated person must collect and keep complete and accurate records of the following information (<b><i>distribution information</i></b>) in relation to the product:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-994F__para-a">
              <num>a</num>
              <content>
                <p>the number of complaints in relation to the product that the regulated person receives;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994F__para-b">
              <num>b</num>
              <content>
                <p>the steps the regulated person has taken in relation to the product as required by <ref href="#sec-994E">section 994E</ref> (reasonable steps to ensure consistency with the target market determination);</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994F__para-c">
              <num>c</num>
              <content>
                <p>if the regulated person is specified in the determination as required to report information of a specified kind to the person who made the determination (see subparagraph 994B(5)(h)(i))—information of that kind that the regulated person acquires;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994F__para-d">
              <num>d</num>
              <content>
                <p>if the regulated person is not the person that made the determination—the dates on which the regulated person reported as required by subsection (4), (5) or (6) and the substance of the reports.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-994F__subclause-4">
              <num>4</num>
              <content>
                <p>If the regulated person engages in the retail product distribution conduct during a reporting period specified under paragraph 994B(5)(g) (which relates to complaints), the regulated person must, as soon as practicable, but in any case within 10 business days, after the end of the reporting period, report in writing to the person who made the target market determination:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-994F__para-a">
              <num>a</num>
              <content>
                <p>whether the regulated person received complaints in relation to the product during the reporting period; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994F__para-b">
              <num>b</num>
              <content>
                <p>if the regulated person received such complaints—the number of complaints the regulated person received.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-994F__subclause-5">
              <num>5</num>
              <content>
                <p>If:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-994F__para-a">
              <num>a</num>
              <content>
                <p>under the target market determination for the financial product, the regulated person is required to report information of a specified kind to the person that made the determination (see subparagraph 994B(5)(h)(i)); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994F__para-b">
              <num>b</num>
              <content>
                <p>the regulated person engages in the retail product distribution conduct in relation to the product during a reporting period for that kind of information;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994F__para-c">
              <num>c</num>
              <content>
                <p>all the information of that kind that the regulated person acquired during the reporting period; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994F__para-d">
              <num>d</num>
              <content>
                <p>if the regulated person did not acquire information of that kind during the reporting period—that fact.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-994F__subclause-6">
              <num>6</num>
              <content>
                <p>If the regulated person:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-994F__para-a">
              <num>a</num>
              <content>
                <p>becomes aware of a significant dealing in the product; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994F__para-b">
              <num>b</num>
              <content>
                <p>becomes aware that the dealing is not consistent with the target market determination;</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-994F__subclause-7">
              <num>7</num>
              <content>
                <p>The regulations may impose requirements in relation to records relating to compliance with this Part.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-994F__subclause-8">
              <num>8</num>
              <content>
                <p>A person contravenes this subsection if the person refuses or fails to comply with the requirements of regulations made for the purposes of subsection (7).</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-994G">
            <num>994G</num>
            <heading>Notice to ASIC</heading>
            <content>
              <p>If:</p>
              <p>the person must give written notice to ASIC as soon as practicable, and in any case within 10 business days, after becoming so aware.</p>

                <p>a person makes a target market determination for a financial product; and</p>
              </content>
            </paragraph>

              <num>b</num>
              <content>
                <p>the person becomes aware of a significant dealing in the product in relation to a retail client (except an excluded dealing); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994G__para-c">
              <num>c</num>
              <content>
                <p>the person becomes aware that the dealing is not consistent with the determination;</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-994H">
            <num>994H</num>
            <heading>Information to be provided to ASIC</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-994H__subclause-1">
              <num>1</num>
              <content>
                <p>ASIC may, in writing, require:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-994H__para-a">
              <num>a</num>
              <content>
                <p>a person who makes, or is required by this Part to make, a target market determination for a financial product; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994H__para-b">
              <num>b</num>
              <content>
                <p>a regulated person who engages in retail product distribution conduct in relation to a financial product;</p>
              </content>
            </paragraph>
            <content>
              <p>to provide ASIC with distribution information, relating to the financial product, that is in the person’s possession or to which the person has access.</p>
              <p>Note 1:	Failure to comply with this subsection is an offence (see subsection 1311(1)).</p>

              <content>
                <p>ASIC may, in writing, require a person who makes, or is required by this Part to make, a target market determination for a financial product to provide records referred to in subsection 994F(1) relating to the product.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-994H__subclause-3">
              <num>3</num>
              <content>
                <p>A person who is required by ASIC to provide it with distribution information or records under subsection (1) or (2) must comply with the requirement:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-994H__para-a">
              <num>a</num>
              <content>
                <p>by the date specified by ASIC in the requirement; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994H__para-b">
              <num>b</num>
              <content>
                <p>if no date is so specified, within 10 business days after the day the person is notified by ASIC of the requirement in subsection (1) or (2).</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-994J">
            <num>994J</num>
            <heading>Stop orders</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-994J__subclause-1">
              <num>1</num>
              <content>
                <p>This section applies if ASIC is satisfied that a provision of <ref href="#dvs-2">Division 2</ref>, or <ref href="#sec-994E">section 994E</ref>, has been contravened in relation to a financial product.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-994J__subclause-2">
              <num>2</num>
              <content>
                <p>ASIC may order, in writing, that specified conduct in relation to retail clients in respect of the financial product (except excluded conduct) must not be engaged in while the order is in force. The order is not a legislative instrument.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-994J__subclause-3">
              <num>3</num>
              <content>
                <p>Before making an order under subsection (2), ASIC must:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-994J__para-a">
              <num>a</num>
              <content>
                <p>hold a hearing; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994J__para-b">
              <num>b</num>
              <content>
                <p>give a reasonable opportunity to any interested person to make oral or written submissions to ASIC on whether an order should be made.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-994J__subclause-4">
              <num>4</num>
              <content>
                <p>If ASIC considers that any delay in making an order under subsection (2) pending the holding of a hearing would be prejudicial to the public interest, ASIC may make an interim order under that subsection. The interim order may be made without holding a hearing and lasts for 21 days after the day on which it is made unless revoked before then.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-994J__subclause-5">
              <num>5</num>
              <content>
                <p>At any time during the hearing, ASIC may make an interim order under subsection (2). The interim order lasts until:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-994J__para-a">
              <num>a</num>
              <content>
                <p>ASIC makes an order under subsection (2) after the conclusion of the hearing; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994J__para-b">
              <num>b</num>
              <content>
                <p>the interim order is revoked;</p>
              </content>
            </paragraph>
            <content>
              <p>whichever happens first.</p>

              <content>
                <p>The person on whom the order is served must take all reasonable steps to ensure that other people who engage in conduct to which the order applies are aware of the order.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-994J__subclause-8">
              <num>8</num>
              <content>
                <p>The person on whom the order is served, or a person who is aware of the order, must not engage in conduct contrary to the order.</p>
              </content>

                <p>If conduct (including an omission) of a person would not have constituted an offence if a particular declaration under paragraph (1)(c) or (2)(c) had not been made, that conduct does not constitute an offence unless, before the conduct occurred:</p>

                <p>a Court has ordered the first person (or anyone else) to pay the Commonwealth a pecuniary penalty under <ref href="#sec-1317G">section 1317G</ref> in relation to the contravention.</p>

              <content>
                <p>An action under subsection (1) may be begun at any time within 6 years after the day on which the cause of action arose.</p>

                <p>This section does not affect any liability that a person has under any other law.</p>

            <heading>Additional powers of court to make orders</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-994N__subclause-1">
              <num>1</num>
              <content>
                <p>The court dealing with an action under subsection 994M(1) may, in addition to awarding loss or damage under that subsection and if it thinks it necessary in order to do justice between the parties:</p>

                <p>make an order declaring void a contract entered into by the client who suffered loss or damage relating to a financial product; and</p>
              </content>
            </paragraph>

                <p>if it makes an order under paragraph (a)—make such other order or orders as it thinks are necessary or desirable because of that order.</p>
              </content>
            </paragraph>

                <p>Without limiting paragraph (1)(b), an order under that paragraph may include either or both of the following:</p>
              </content>

                <p>an order for the return of money paid by a person;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994N__para-b">

                <p>an order for payment of an amount of interest specified in, or calculated in accordance with, the order.</p>
              </content>
            </paragraph>
          </hcontainer>

            <heading>Orders to redress loss or damage suffered by non-party consumers etc.</heading>
            <content>
              <p>Orders</p>
              <p>the Court may, on the application of ASIC, make such order or orders (other than an award of damages) as the Court thinks appropriate against a person referred to in subsection (2) of this section.</p>
              <p>Note:	The orders that the Court may make include all or any of the orders set out in <ref href="#sec-994Q">section 994Q</ref>.</p>

                <p>	(a)	a person engaged in conduct (the <b><i>contravening conduct</i></b>) in contravention of section 994B, 994C or 994D or subsection 994E(1) or (3); and</p>

            </paragraph>

              <num>b</num>
              <content>
                <p>the contravening conduct caused, or is likely to cause, a class of persons to suffer loss or damage; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994P__para-c">
              <num>c</num>
              <content>
                <p>	(c)	the class includes persons (<b><i>non</i></b><b><i>-</i></b><b><i>party consumers</i></b>) who have not been a party to proceedings under this Act in relation to the contravening conduct;</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-994P__subclause-2">
              <num>2</num>
              <content>
                <p>An order under subsection (1) may be made against the person who engaged in the contravening conduct, or a person involved in that conduct.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-994P__subclause-3">
              <num>3</num>
              <content>
                <p>The Court must not make an order under subsection (1) unless the Court considers that the order will:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-994P__para-a">
              <num>a</num>
              <content>
                <p>redress, in whole or in part, the loss or damage suffered by the non-party consumers in relation to the contravening conduct; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994P__para-b">
              <num>b</num>
              <content>
                <p>prevent or reduce the loss or damage suffered, or likely to be suffered, by the non-party consumers in relation to the contravening conduct.</p>
              </content>
            </paragraph>

              <num>4</num>
              <content>
                <p>An application may be made under subsection (1) even if a proceeding in relation to the contravening conduct has not been instituted.</p>
              </content>

              <content>
                <p>An application under subsection (1) may be made at any time within 6 years after the day on which the cause of action that relates to the contravening conduct accrues.</p>

                <p>In determining whether to make an order under subsection (1) against a person referred to in subsection (2), the Court may have regard to the conduct of the person, and of the non-party consumers in relation to the contravening conduct, since the contravention occurred.</p>

              <num>7</num>
              <content>
                <p>In determining whether to make an order under subsection (1), the Court need not make a finding about either of the following matters:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-994P__para-a">
              <num>a</num>
              <content>
                <p>which persons are non-party consumers in relation to the contravening conduct;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994P__para-b">
              <num>b</num>
              <content>
                <p>the nature of the loss or damage suffered, or likely to be suffered, by such persons.</p>
              </content>
            </paragraph>

                <p>the loss or damage suffered, or likely to be suffered, by a non-party consumer in relation to the contravening conduct to which the order relates has been redressed, prevented or reduced in accordance with the order; and</p>

                <p>the non-party consumer has accepted the redress, prevention or reduction;</p>
              </content>
            </paragraph>

                <p>the non-party consumer is bound by the order; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994P__para-e">
              <num>e</num>

                <p>any other order made under subsection (1) that relates to that loss or damage has no effect in relation to the non-party consumer; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-994P__para-f">
              <num>f</num>

                <p>despite any other provision of this Act or any other law of the Commonwealth, or a State or Territory, no claim, action or demand may be made or taken against the person by the non-party consumer in relation to that loss or damage.</p>

            <heading>Kinds of orders that may be made to redress loss or damage suffered by non-party consumers etc.</heading>
            <content>
              <p>		Without limiting subsection 994P(1), the orders that the Court may make under that subsection against a person (the <b><i>respondent</i></b>) include all or any of the following:</p>
            </content>

              <num>a</num>

                <p>an order declaring the whole or any part of a contract made between the respondent and a non-party consumer referred to in that subsection, or a collateral arrangement relating to such a contract:</p>

              <p>Note 1:	An example of conditions that may be specified in a product intervention order include that the product not be issued to a retail client unless the retail client has received personal advice.</p>
              <p>Note 2:	Section 1023E specifies matters to be taken into account in considering whether a financial product has resulted in, or will or is likely to result in, significant detriment to retail clients.</p>
              <p>Note 3:	Section 1023N also provides that product intervention orders may include requirements for notifying retail clients.</p>
              <p>ASIC may, in accordance with this Part and by legislative instrument, order that a person must not engage in specified conduct in relation to the class of products, either entirely or except in accordance with conditions specified in the order.</p>
              <p>Note 1:	An example of conditions that may be specified in a product intervention order include that a product in a class of products not be issued to a retail client unless the retail client has received personal advice.</p>
              <p>Note 2:	Section 1023E specifies matters to be taken into account in considering whether a financial product has resulted in, or will or is likely to result in, significant detriment to retail clients.</p>

            <heading>Significant detriment to retail clients</heading>

                <p>In considering whether a financial product has resulted in, or will or is likely to result in, significant detriment to retail clients for the purposes of this Part, the following must be taken into account:</p>
              </content>

                <p>the nature and extent of the detriment;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-1023E__para-b">

                <p>without limiting paragraph (a), the actual or potential financial loss to retail clients resulting from the product;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-1023E__para-c">
              <num>c</num>
              <content>
                <p>the impact that the detriment has had, or will or is likely to have, on retail clients;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-1023E__para-d">
              <num>d</num>
              <content>
                <p>any other matter prescribed by regulations made for the purposes of this paragraph.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-1023E__subclause-2">

              <content>
                <p>Subsection (1) does not limit the matters to be taken into account in considering whether a financial product has resulted in, or will or is likely to result in, significant detriment to retail clients for the purposes of this Part.</p>

                <p>A financial product may result in significant detriment to retail clients even if a person has complied with the disclosure requirements in Chapter 6D or this Chapter, and with the person’s obligations under <ref href="#part-7">Part 7</ref>.8A, in relation to the product.</p>

            <heading>ASIC to consult before making product intervention orders</heading>

                <p>ASIC must not make a product intervention order unless ASIC has:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-1023F__para-a">
              <num>a</num>
              <content>
                <p>consulted persons who are reasonably likely to be affected by the proposed order; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-1023F__para-b">
              <num>b</num>
              <content>
                <p>if the proposed order will apply to a body that is regulated by APRA—consulted APRA; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-1023F__para-c">
              <num>c</num>
              <content>
                <p>complied with any other requirements as to consultation prescribed by regulations made for the purposes of this paragraph.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-1023F__subclause-2">
              <num>2</num>
              <content>
                <p>Without limiting paragraph (1)(a), ASIC is taken to comply with that paragraph if ASIC, on its website:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-1023F__para-a">
              <num>a</num>
              <content>
                <p>makes the proposed order, or a description of the content of the proposed order, available; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-1023F__para-b">
              <num>b</num>
              <content>
                <p>invites the public to comment on the proposed order.</p>
              </content>
            </paragraph>

                <p>A failure to comply with subsection (1) does not invalidate a product intervention order.</p>
              </content>
            </hcontainer>

                <p>	(4)	Section 17 of the <i>Legislation Act 2003 </i>(rule-makers should consult before making legislative instruments) does not apply to the making of a product intervention order.</p>

                <p>	(a)	for an order that is a legislative instrument—on the day after the instrument is registered under the <i>Legislation Act 2003</i>; or</p>

                <p>otherwise—on the day after the notice under subsection 1023L(3) in relation to the order is published;</p>
              </content>
            </paragraph>

                <p>A product intervention order remains in force for:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-1023G__para-a">

                <p>18 months, or any shorter period specified by the regulations; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-1023G__para-b">
              <num>b</num>
              <content>
                <p>any shorter period specified in the order.</p>
              </content>
            </paragraph>

                <p>Subsection (2) does not apply to a product intervention order if a declaration under <ref href="#sec-1023H">section 1023H</ref> (which relates to extensions of product intervention orders) is in force in relation to the order.</p>

                <p>A product intervention order that is a legislative instrument that ceases to be in force is repealed by force of this subsection.</p>

            <heading>Extension of product intervention orders</heading>

                <p>ASIC may, in accordance with an approval under subsection (4), by legislative instrument, declare that a product intervention order that is in force:</p>
              </content>

                <p>remains in force until it is revoked; or</p>
              </content>
            </paragraph>

              <p>Note:	A declaration under this subsection has the effect of overriding any provisions in a product intervention order about the duration of the order: see subsection 1023G(3).</p>

                <p>describes the consultation that ASIC undertook in relation to the order; and</p>

                <p>if the order comes into force after it is published—specifies the day it comes into force.</p>
              </content>
            </paragraph>

            </paragraph>

                <p>if the day the amendment is to take effect is later than the day after the day of publication of the amendment—specifies the day the amendment is to take effect.</p>
              </content>
            </paragraph>

                <p>If a product intervention order is revoked, ASIC must publish notice of the revocation on its website.</p>

            <heading>Remaking product intervention orders</heading>
            <content>
              <p>If a product intervention order ceases to be in force or is revoked, ASIC must not remake the order, or make an order in substantially the same terms, unless:</p>

              <num>a</num>
              <content>
                <p>ASIC is satisfied the circumstances have materially changed since the order was made; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-1023M__para-b">
              <num>b</num>
              <content>
                <p><role refersTo="#minister">the Minister</role> approves, in writing, the remaking or making of the order.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-2__clause-1023N">

            <heading>Product intervention orders may require notification</heading>
            <hcontainer name="subclause" eId="schedule-2__clause-1023N__subclause-1">

                <p>A product intervention order in relation to a financial product may:</p>
              </content>

                <p>require that a specified person who has:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-1023N__para-i">
              <num>i</num>
              <content>
                <p>dealt in, or dealt in a specified way in, a financial product in relation to a retail client; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-1023N__para-ii">
              <num>ii</num>
              <content>
                <p>provided financial product advice, or a specified kind of financial product advice, to a retail client in relation to a financial product;</p>
              </content>
            </paragraph>
            <content>
              <p>take reasonable steps to notify the retail client:</p>
            </content>
            <paragraph eId="schedule-2__clause-1023N__para-iii">
              <num>iii</num>
              <content>
                <p>of the terms of the order; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-1023N__para-iv">
              <num>iv</num>
              <content>
                <p>of any other matter specified in regulations made for the purposes of this subparagraph; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-1023N__para-b">
              <num>b</num>
              <content>
                <p>specify requirements in relation to giving those notifications (including requirements as to the periods within which to give those notifications).</p>
              </content>
            </paragraph>

                <p>A person must not engage in conduct contrary to a product intervention order that is in force in relation to the person.</p>
              </content>
            </hcontainer>

                <p>A person who is required by a product intervention order to take reasonable steps to notify a retail client must comply with the requirement.</p>

            <hcontainer name="subclause" eId="schedule-2__clause-1023P__subclause-3">

              <content>
                <p>Subsections (1) and (2) do not apply if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-1023P__para-a">
              <num>a</num>
              <content>
                <p>the product intervention order is not a legislative instrument; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-1023P__para-b">
              <num>b</num>
              <content>
                <p>the person was not aware, and could not reasonably have been aware, of the order.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-1023P__subclause-4">

                <p>If a product intervention order has been served on a person, the person must take all reasonable steps as soon as practicable to ensure that other persons who engage in conduct to which the order applies are aware of the order.</p>

            <heading>Civil liability</heading>

                <p>If:</p>

              <num>a</num>

                <p>	(a)	a person (the <b><i>first person</i></b>) contravenes a product intervention order; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-1023Q__para-b">
              <num>b</num>
              <content>
                <p>a retail client suffers loss or damage because of the contravention;</p>
              </content>
            </paragraph>
            <content>
              <p>the retail client may recover the amount of the loss or damage by action against the first person, whether or not:</p>
            </content>
            <paragraph eId="schedule-2__clause-1023Q__para-c">
              <num>c</num>
              <content>
                <p>the first person (or anyone else) has been convicted of an offence in relation to the contravention; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-1023Q__para-d">
              <num>d</num>
              <content>
                <p>a Court has made a declaration of contravention under subsection 1317E(1) in relation to the contravention; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-1023Q__para-e">
              <num>e</num>
              <content>
                <p>a Court has ordered the first person (or anyone else) to pay the Commonwealth a pecuniary penalty under <ref href="#sec-1317G">section 1317G</ref> in relation to the contravention.</p>
              </content>
            </paragraph>

              <num>2</num>
              <content>

              <p>ASIC may, in accordance with this Part, order that a specified person must not engage in specified conduct in relation to the product, either entirely or except in accordance with conditions specified in the order.</p>
              <p>Note 1:	Section 301E specifies matters to be taken into account in considering whether a credit product has resulted in, or will or is likely to result in, significant detriment to consumers.</p>
              <p>Note 2:	Section 301N also provides that product intervention orders may include requirements for notifying consumers.</p>
              <p>ASIC may, in accordance with this Part and by legislative instrument, order that a person must not engage in specified conduct in relation to the class of products and consumers, either entirely or except in accordance with conditions specified in the order.</p>
              <p>Note 1:	Section 301E specifies matters to be taken into account in considering whether a credit product has resulted in, or will or is likely to result in, significant detriment to consumers.</p>

                <p>a condition that a person satisfy a standard of training, or meet a professional standard, other than a standard prescribed for the person by or under this Act;</p>

                <p>a condition that a person who is not required to hold an Australian credit licence become a member of an external dispute resolution scheme;</p>
              </content>
            </paragraph>

                <p>a condition related to a person’s remuneration, other than a condition related to so much of the person’s remuneration as is conditional on the achievement of objectives directly related to the credit product.</p>

                <p>In considering whether a credit product has resulted in, or will or is likely to result in, significant detriment to consumers for the purposes of this Part, the following must be taken into account:</p>
              </content>
            </hcontainer>

              <content>
                <p>the nature and extent of the detriment;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-301E__para-b">

                <p>without limiting paragraph (a), the actual or potential financial loss to consumers resulting from the product;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-301E__para-c">
              <num>c</num>
              <content>
                <p>the impact that the detriment has had, or will or is likely to have, on consumers;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-301E__para-d">
              <num>d</num>

                <p>any other matter prescribed by regulations made for the purposes of this paragraph.</p>
              </content>
            </paragraph>

                <p>Subsection (1) does not limit the matters to be taken into account in considering whether a credit product has resulted in, or will or is likely to result in, significant detriment to consumers for the purposes of this Part.</p>

                <p>consulted persons who are reasonably likely to be affected by the proposed order; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-301F__para-b">
              <num>b</num>

                <p>if the proposed order will apply to a body that is regulated by APRA—consulted APRA; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-301F__para-c">
              <num>c</num>

                <p>complied with any other requirements as to consultation prescribed by regulations made for the purposes of this paragraph.</p>
              </content>
            </paragraph>

                <p>Without limiting paragraph (1)(a), ASIC is taken to comply with that paragraph if ASIC, on its website:</p>

                <p>makes the proposed order, or a description of the content of the proposed order, available; and</p>
              </content>
            </paragraph>

                <p>describes the significant detriment to consumers that has resulted from, or will or is likely to result from, the credit product or class of credit products to which the order relates, and sets out why the order is an appropriate way of reducing the detriment; and</p>

            <paragraph eId="schedule-2__clause-301L__para-b">
              <num>b</num>
              <content>
                <p>describes the consultation that ASIC undertook in relation to the order; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-301L__para-c">
              <num>c</num>
              <content>
                <p>if the order comes into force after it is published—specifies the day it comes into force.</p>
              </content>
            </paragraph>

                <p>ASIC must publish on its website, with the product intervention order, each declaration under <ref href="#sec-301H">section 301H</ref> (which relates to extensions of product intervention orders) that relates to the order.</p>

                <p>ASIC must serve a copy of the instrument amending a product intervention order that is not a legislative instrument on any person to whom ASIC considers the order applies. Failure to comply with this subsection does not invalidate the order.</p>

              <num>6</num>
              <content>
                <p>ASIC must publish on its website, with the product intervention order, each amendment of the product intervention order.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-301L__subclause-7">
              <num>7</num>
              <content>
                <p>ASIC must also publish on its website, with the amendment, a notice that:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-301L__para-a">
              <num>a</num>
              <content>
                <p>sets out why the amendment is appropriate; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-301L__para-b">
              <num>b</num>
              <content>
                <p>describes the consultation that ASIC undertook in relation to the amendment; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-301L__para-c">
              <num>c</num>
              <content>
                <p>if the day the amendment is to take effect is later than the day after the day of publication of the amendment—specifies the day the amendment is to take effect.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-301L__subclause-8">
              <num>8</num>
              <content>
                <p>If a product intervention order is revoked, ASIC must publish notice of the revocation on its website.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-2__clause-301M">
            <num>301M</num>
            <heading>Remaking product intervention orders</heading>
            <content>
              <p>If a product intervention order ceases to be in force or is revoked, ASIC must not remake the order, or make an order in substantially the same terms, unless:</p>
            </content>
            <paragraph eId="schedule-2__clause-301M__para-a">
              <num>a</num>
              <content>
                <p>ASIC is satisfied the circumstances have materially changed since the order was made; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-301M__para-b">
              <num>b</num>
              <content>
                <p><role refersTo="#minister">the Minister</role> approves, in writing, the remaking or making of the order.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-2__clause-301N">
            <num>301N</num>
            <heading>Product intervention orders may require notification</heading>
            <content>
              <p>A product intervention order in relation to a credit product may:</p>
            </content>
            <paragraph eId="schedule-2__clause-301N__para-a">
              <num>a</num>
              <content>
                <p>require that a specified person who has engaged in a credit activity in relation to the product in respect of a consumer take reasonable steps to notify the consumer:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-301N__para-i">
              <num>i</num>
              <content>
                <p>of the terms of the order; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-301N__para-ii">
              <num>ii</num>
              <content>
                <p>of any other matter specified in regulations made for the purposes of this subparagraph; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-301N__para-b">
              <num>b</num>
              <content>
                <p>specify requirements in relation to giving those notifications (including requirements as to the periods within which to give those notifications).</p>
              </content>
            </paragraph>

            <num>301P</num>
            <heading>Enforcement of product intervention orders</heading>
            <hcontainer name="subclause" eId="schedule-2__clause-301P__subclause-1">
              <num>1</num>

                <p>A person must not engage in conduct contrary to a product intervention order that is in force in relation to the person.</p>
              </content>
            </hcontainer>
            <content>
              <p>Civil penalty:	<quantity refersTo="#penaltyUnit">200 penalty units</quantity>.</p>
              <p>Criminal penalty:	<quantity refersTo="#penaltyUnit">200 penalty units</quantity>, or <quantity refersTo="#custodialSentence">imprisonment for 5 years</quantity>, or both.</p>
              <p>Civil penalty:	<quantity refersTo="#penaltyUnit">200 penalty units</quantity>.</p>

                <p>Subsections (1), (2), (3) and (4) do not apply if:</p>
              </content>

                <p>the product intervention order is not a legislative instrument; and</p>
              </content>
            </paragraph>

                <p>the person was not aware, and could not reasonably have been aware, of the order.</p>

            </paragraph>

                <p>If a product intervention order has been served on a person, the person must take all reasonable steps to ensure that other persons who engage in conduct to which the order applies are aware of the order.</p>

                <p>If a product intervention order has been served on a person, the person must take all reasonable steps as soon as practicable to ensure that other persons who engage in conduct to which the order applies are aware of the order.</p>
