          <p>		This Act is the <i>National Health Amendment (Pharmaceutical Benefits) Act 2019.</i></p>

            <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

              <p>Approved pharmacist is a partnership and partners are bankrupt</p>
              <p><role refersTo="#secretary">the Secretary</role> must grant, or refuse to grant, the applicant permission to supply pharmaceutical benefits at those premises.</p>
              <p>External administrator in relation to pharmacy</p>
              <p><role refersTo="#secretary">the Secretary</role> must grant, or refuse to grant, the applicant permission to supply pharmaceutical benefits at those premises.</p>
              <p>Note:	For <b><i>external administrator</i></b>, see subsection (16). For <b><i>pharmacy</i></b>, see subsection (17).</p>

              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-91B__para-b">
              <num>b</num>
              <content>
                <p>	(b)	the trustee (the <b><i>applicant</i></b>) of the estate of the bankrupt individual makes an application to the Secretary for permission to supply pharmaceutical benefits at those premises;</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-91B__subclause-2">
              <num>2</num>
              <content>
                <p>If:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-91B__para-a">
              <num>a</num>
              <content>
                <p>an approval under <ref href="#sec-90">section 90</ref> in respect of particular premises covers a partnership that consists only of individuals and each of the partners is bankrupt; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-91B__para-b">
              <num>b</num>
              <content>
                <p>either:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-91B__para-i">
              <num>i</num>
              <content>
                <p>	(i)	if the same person is the trustee of the estate of each of the bankrupt partners—the trustee (the <b><i>applicant</i></b>) makes an application to the Secretary for permission to supply pharmaceutical benefits at those premises; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-91B__para-ii">
              <num>ii</num>
              <content>
                <p>	(ii)	otherwise—the trustees (the <b><i>applicant</i></b>) of the estates of the bankrupt partners make a joint application to the Secretary for permission to supply pharmaceutical benefits at those premises;</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-91B__subclause-3">
              <num>3</num>
              <content>
                <p>If:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-91B__para-a">
              <num>a</num>
              <content>
                <p>an approval under <ref href="#sec-90">section 90</ref> is in force in respect of particular premises; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-91B__para-b">
              <num>b</num>
              <content>
                <p>there is an external administrator in relation to the pharmacy situated at those premises; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-91B__para-c">
              <num>c</num>
              <content>
                <p>	(c)	the external administrator (the <b><i>applicant</i></b>) makes an application to the Secretary for permission to supply pharmaceutical benefits at those premises;</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-91B__subclause-4">
              <num>4</num>
              <content>
                <p>An application under subsection (1), (2) or (3) in relation to particular premises must:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-91B__para-a">
              <num>a</num>
              <content>
                <p>be in writing and in a form approved by <role refersTo="#secretary">the Secretary</role>; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-91B__para-b">
              <num>b</num>
              <content>
                <p>unless <role refersTo="#secretary">the Secretary</role> otherwise allows, be made before the end of the period of 10 business days beginning on:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-91B__para-i">
              <num>i</num>
              <content>
                <p>for an application under subsection (1)—the day <role refersTo="#trustee">the trustee</role> became <role refersTo="#trustee">the trustee</role> of the estate of the bankrupt individual; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-91B__para-ii">
              <num>ii</num>
              <content>
                <p>for an application under subsection (2)—the first day on which there was a trustee of the estate of each bankrupt partner; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-91B__para-iii">
              <num>iii</num>
              <content>
                <p>for an application under subsection (3)—the day the applicant became the external administrator; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-91B__para-c">
              <num>c</num>
              <content>
                <p>be accompanied by documentary evidence that:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-91B__para-i">
              <num>i</num>
              <content>
                <p>for an application under subsection (1) or (2)—there is a trustee of the estate of the bankrupt individual or of the estate of each bankrupt partner; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-91B__para-ii">
              <num>ii</num>
              <content>
                <p>for an application under subsection (3)—there is an external administrator in relation to the pharmacy; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-91B__para-d">
              <num>d</num>
              <content>
                <p>be accompanied by a statement setting out:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-91B__para-i">
              <num>i</num>
              <content>
                <p>whether, at the time of the application, the pharmacy situated at the premises is operating at the premises; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-91B__para-ii">
              <num>ii</num>
              <content>
                <p>if the pharmacy is not operating at the premises—the day the pharmacy ceased operating and the day of the proposed resumption of operation; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-91B__para-iii">
              <num>iii</num>
              <content>
                <p>the grounds on which the applicant considers the pharmacy can continue or resume operating at the premises.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-91B__subclause-5">
              <num>5</num>
              <content>
                <p>For the purposes of considering the application, <role refersTo="#secretary">the Secretary</role> may, by written notice given to the applicant, require the applicant to give <role refersTo="#secretary">the Secretary</role> further specified information, or produce to <role refersTo="#secretary">the Secretary</role> further specified documents, within a specified period.</p>

            <hcontainer name="subclause" eId="schedule-2__clause-91B__subclause-6">
              <num>6</num>
              <content>
                <p>If the applicant does not give the information, or produce the documents, within the specified period, <role refersTo="#secretary">the Secretary</role> may treat the application as having been withdrawn.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-91B__subclause-7">
              <num>7</num>
              <content>
                <p><role refersTo="#secretary">The Secretary</role> must, under subsection (1), (2) or (3), grant the applicant permission to supply pharmaceutical benefits at the premises if <role refersTo="#secretary">the Secretary</role> is satisfied that:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-91B__para-a">
              <num>a</num>
              <content>
                <p>at the time of the application, the pharmacy situated at the premises is operating at the premises; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-91B__para-b">
              <num>b</num>
              <content>
                <p>the pharmacy can continue operating after the grant of the permission; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-91B__para-c">
              <num>c</num>
              <content>
                <p>the premises are accessible by members of the public for the purpose of receiving pharmaceutical benefits at times that, in the opinion of <role refersTo="#secretary">the Secretary</role>, are reasonable.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-91B__subclause-8">
              <num>8</num>
              <content>
                <p>However, while a permission granted under this section is in force in relation to particular premises, <role refersTo="#secretary">the Secretary</role> must not grant any further permission under this section in relation to those premises.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-91B__subclause-9">
              <num>9</num>
              <content>
                <p><role refersTo="#secretary">The Secretary</role> must:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-91B__para-a">
              <num>a</num>
              <content>
                <p>give the applicant written notice of <role refersTo="#secretary">the Secretary</role>’s decision on the application; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-91B__para-b">
              <num>b</num>
              <content>
                <p>if <role refersTo="#secretary">the Secretary</role> refuses to grant the permission—state in the notice the reasons for the refusal.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-91B__subclause-10">
              <num>10</num>
              <content>
                <p>If <role refersTo="#secretary">the Secretary</role> grants a permission under subsection (1), (2) or (3) to supply pharmaceutical benefits at particular premises:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-91B__para-a">
              <num>a</num>
              <content>
                <p>the holder of the permission is to be treated for all purposes of this Act as if the holder were, on and after the day the application for the permission was made, approved under <ref href="#sec-90">section 90</ref> as an approved pharmacist in relation to those premises; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-91B__para-b">
              <num>b</num>
              <content>
                <p>any supply of pharmaceutical benefits at or from those premises by a pharmacist, who is not an approved pharmacist, on or after the day the application for the permission was made and before the grant of that permission is to be treated as if it had been a supply of those pharmaceutical benefits by the holder of the permission; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-91B__para-c">
              <num>c</num>
              <content>
                <p>references in this Act to an approval granted under <ref href="#sec-90">section 90</ref> include references to an approval treated as having been granted under <ref href="#sec-90">section 90</ref> by paragraph (a) of this subsection; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-91B__para-d">
              <num>d</num>
              <content>
                <p>the conditions to which an approval granted under <role refersTo="#minister">the Minister</role>’s determination for the purposes of paragraph 92A(1)(f)) also apply to an approval treated as having been granted under section 90 by paragraph (a) of this subsection; and<ref href="#sec-90">section 90</ref> is subject (including any condition that is imposed by means of </p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-91B__para-e">
              <num>e</num>
              <content>
                <p>the rights conferred and obligations imposed on an approved pharmacist apply to the holder of the permission in the holder’s activities as such an approved pharmacist.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-91B__subclause-11">
              <num>11</num>
              <content>
                <p>A permission granted under subsection (1), (2) or (3) in relation to particular premises continues, unless it is sooner revoked, until <role refersTo="#secretary">the Secretary</role> grants another approval under section 90 in respect of those premises.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-91B__subclause-12">
              <num>12</num>
              <content>
                <p><role refersTo="#secretary">The Secretary</role> may, by written notice given to the holder of the permission, revoke the permission if <role refersTo="#secretary">the Secretary</role> is satisfied that:</p>
              </content>
            </hcontainer>

              <num>a</num>

                <p>there has been a contravention of a condition covered by paragraph (10)(d); or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-91B__para-b">
              <num>b</num>
              <content>
                <p>the holder of the permission is not carrying on the business of a pharmacist at the premises in respect of which the permission is granted; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-91B__para-c">
              <num>c</num>
              <content>
                <p>the premises are not accessible by members of the public for the purpose of receiving pharmaceutical benefits at times that, in the opinion of <role refersTo="#secretary">the Secretary</role>, are reasonable; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-91B__para-d">
              <num>d</num>
              <content>
                <p>it is otherwise appropriate in the circumstances to revoke the permission.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-91B__subclause-13">
              <num>13</num>
              <content>
                <p><role refersTo="#secretary">The Secretary</role> must, by written notice given to the holder of the permission, revoke the permission if the holder makes a request in writing (including reasons for the request) to <role refersTo="#secretary">the Secretary</role> for revocation of the permission.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-91B__subclause-14">
              <num>14</num>
              <content>
                <p><role refersTo="#secretary">The Secretary</role> may, by notice in writing, vary a permission granted under subsection (1), (2) or (3) to reflect changes in <role refersTo="#trustee">the trustee</role> or trustees of the estate or estates concerned or in the external administrator in relation to the pharmacy concerned. A variation takes effect on the day specified in the notice (which may be earlier than the day the variation is made).</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-91B__subclause-15">
              <num>15</num>
              <content>
                <p>Nothing in this section authorises <role refersTo="#secretary">the Secretary</role> to grant a permission under subsection (1), (2) or (3) to a person to supply pharmaceutical benefits at premises at which the person is not permitted, under the law of the State or Territory in which the premises are situated, to carry on business.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-91B__subclause-16">
              <num>16</num>
              <content>
                <p>	(16)	For the purposes of this section, an <b><i>external administrator</i></b>, in relation to a pharmacy, is:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-91B__para-a">
              <num>a</num>
              <content>
                <p>an administrator of the pharmacy; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-91B__para-b">
              <num>b</num>
              <content>
                <p>	(b)	a managing controller (within the meaning of the <i>Corporations Act 2001</i>) in relation to property of any company operating the pharmacy; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-91B__para-c">
              <num>c</num>
              <content>
                <p>	(c)	an external administrator (<i>Corporations Act 2001</i>) of any company operating the pharmacy.<ref href="#sec-5">within the meaning of section 5</ref>-20 of Schedule 2 to the </p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-91B__subclause-17">
              <num>17</num>
              <content>
                <p>	(17)	For the purposes of this section, a <b><i>pharmacy</i></b> is a business in the course of the carrying on of which pharmaceutical benefits are supplied.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-91B__subclause-18">
              <num>18</num>
              <content>
                <p>A reference in this section to <role refersTo="#trustee">the trustee</role> of the estate of a bankrupt is to be read:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-91B__para-a">
              <num>a</num>
              <content>
                <p>in relation to an estate in respect of which there are 2 or more joint trustees—as a reference to all the trustees; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-91B__para-b">
              <num>b</num>
              <content>
                <p>in relation to an estate in respect of which there are 2 or more joint and several trustees—as a reference to all of the trustees or any one or more of the trustees.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-91B__subclause-19">
              <num>19</num>
              <content>
                <p>A reference in this section to the external administrator in relation to a pharmacy is to be read:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-91B__para-a">
              <num>a</num>
              <content>
                <p>in relation to a pharmacy in respect of which there are 2 or more joint external administrators—as a reference to all of the external administrators; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-91B__para-b">
              <num>b</num>
              <content>
                <p>in relation to a pharmacy in respect of which there are 2 or more joint and several external administrators—as a reference to all of the external administrators or any one or more of the external administrators.</p>
              </content>
            </paragraph>

            <num>4</num>
            <heading>After subsection 98(2)</heading>
            <content>
              <p>Insert:</p>

              <num>2A</num>
              <content>
                <p>Despite subsections (1) and (2), <role refersTo="#secretary">the Secretary</role> may refuse to cancel an approval of an approved pharmacist in respect of particular premises if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-4__para-a">
              <num>a</num>
              <content>
                <p>the approved pharmacist is bankrupt; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-4__para-b">
              <num>b</num>
              <content>
                <p>there is an external administrator (<ref href="#sec-91B">within the meaning of section 91B</ref>) in relation to the pharmacy (within the meaning of that section) situated at those premises.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-2__clause-5">
            <num>5</num>
            <heading>After subsection 98(3)</heading>
            <content>
              <p>Insert:</p>
              <p>(3AA)	If:</p>
              <p><role refersTo="#secretary">the Secretary</role> must cancel the approval. <role refersTo="#secretary">The Secretary</role> must give written notice of the cancellation to the pharmacist and the holder of the permission.</p>
              <p>(3AB)	If a permission under <role refersTo="#secretary">the Secretary</role> may cancel the approval of the pharmacist under section 90 in respect of those premises. <role refersTo="#secretary">The Secretary</role> must give written notice of the cancellation to the pharmacist.<ref href="#sec-91B">section 91B</ref> in relation to particular premises is revoked under subsection 91B(12) or (13), </p>
            </content>
            <paragraph eId="schedule-2__clause-5__para-a">
              <num>a</num>
              <content>
                <p>a permission under <ref href="#sec-91B">section 91B</ref> is in force in relation to particular premises; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-5__para-b">
              <num>b</num>
              <content>
                <p>the holder of the permission requests that the approval of the pharmacist under <ref href="#sec-90">section 90</ref> in respect of those premises be cancelled;</p>
              </content>
            </paragraph>

            <heading>After subsection 105AB(7AB)</heading>
            <content>
              <p>Insert:</p>
              <p>(7AC)	An application may be made to the Tribunal for review of a decision of <role refersTo="#secretary">the Secretary</role>:</p>
