              <p>This Act requires the making of a scheme called the National Anti-Doping Scheme (known as the NAD scheme). The NAD scheme implements the General Anti-Doping Convention and the UNESCO Anti-Doping Convention. Certain matters must be in the NAD scheme (see <ref href="#dvs-2">Division 2</ref> of <ref href="#part-2">Part 2</ref>).</p>
              <p>This Act establishes a body called the Australian Sports Anti-Doping Authority (known as the ASADA). The ASADA assists <role refersTo="#ceo">the CEO</role> of ASADA. <role refersTo="#ceo">The CEO</role> has functions relating to the NAD scheme and other sports doping and safety matters. <role refersTo="#ceo">The CEO</role> also maintains the Violations List, which contains information about certain persons who have been sanctioned in relation to an anti-doping rule violation.</p>

              <p>The object of this Act is to establish Sport Integrity Australia to prevent and address threats to sports integrity and to coordinate a national approach to matters relating to sports integrity in Australia, with a view to:</p>

                <p>achieving fair and honest sporting performances and outcomes; and</p>

                <p>promoting positive conduct by athletes, administrators, officials, supporters and other stakeholders, on and off the sporting arena; and</p>

                <p>achieving a safe, fair and inclusive sporting environment at all levels; and</p>

                <p>An Advisory Council member is to be paid the remuneration that is determined by the Remuneration Tribunal. If no determination of that remuneration by that Tribunal is in operation, an Advisory Council member is to be paid the remuneration that is prescribed by an instrument under subsection (4).</p>

            <heading>Disclosure of interests to the Minister</heading>

              <p>An Advisory Council member must give written notice to <role refersTo="#minister">the Minister</role> of all interests, pecuniary or otherwise, that the member has or acquires and that conflict or could conflict with the proper performance of the member’s duties.</p>

            <heading>Resignation</heading>

                <p>An Advisory Council member may resign the member’s appointment by giving <role refersTo="#minister">the Minister</role> a written resignation.</p>

                <p>The resignation takes effect on the day it is received by <role refersTo="#minister">the Minister</role> or, if a later day is specified in the resignation, on that later day.</p>

            </paragraph>

                <p>the Advisory Council member is absent, except on leave of absence, from 3 consecutive meetings of the Advisory Council; or</p>

                <p>(2)	Subsection 78(3) of the <i>Australian Sports Anti</i><i>-</i><i>Doping Authority Act 2006</i>, as in force immediately before the commencement of this item, continues to apply on and after that commencement in relation to a publication or disclosure made before that commencement:</p>

              <num>a</num>
              <content>
                <p>in the performance or purported performance of any function of the Chief Executive Officer of the Australian Sports Anti-Doping Authority; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-6__para-b">
              <num>b</num>
              <content>
                <p>in the exercise or purported exercise of any power of the Chief Executive Officer of the Australian Sports Anti-Doping Authority.</p>

              <num>3</num>
              <content>
                <p>(3)	Subsection 78(4) of the <i>Australian Sports Anti</i><i>-</i><i>Doping Authority Act 2006</i>, as in force immediately before the commencement of this item, continues to apply on and after that commencement in relation to the making of a statement to, or the giving of a document or information to, the Australian Sports Anti-Doping Authority, or the Chief Executive Officer of the Australian Sports Anti-Doping Authority, at any time before that commencement.</p>

            <num>7</num>
            <heading>References to the CEO of the Australian Sports Anti-Doping Authority etc. in instruments</heading>
            <hcontainer name="subclause" eId="schedule-4__clause-7__subclause-1">
              <num>1</num>
              <content>
                <p>This item applies to an instrument if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-4__clause-7__para-a">
              <num>a</num>
              <content>
                <p>the instrument was in force immediately before the commencement of this item; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-7__para-b">
              <num>b</num>

                <p>the instrument contains a reference to:</p>

                <p>a reference in the instrument to the Chief Executive Officer of the Australian Sports Anti-Doping Authority were a reference to the Chief Executive Officer of Sport Integrity Australia; and</p>

              <num>b</num>
              <content>
                <p>a reference in the instrument to the Australian Sports Anti-Doping Authority were a reference to Sport Integrity Australia.</p>

                <p>The rules may provide that subitem (2) does not apply in relation to a specified instrument or a specified reference.</p>

                <p>This item does not prevent the instrument from being amended or repealed after the commencement of this item.</p>

                <p>In this item:</p>

            </hcontainer>

              <p><b><i>instrument</i></b> includes:</p>

                <p>a contract, deed, undertaking, arrangement or agreement; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-7__para-b">
              <num>b</num>
              <content>
                <p>a notice, authority, order or instruction; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-7__para-c">
              <num>c</num>
              <content>
                <p>an instrument made under an Act or regulation.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-4__clause-8">
            <num>8</num>
            <heading>Rules</heading>
            <hcontainer name="subclause" eId="schedule-4__clause-8__subclause-1">
              <num>1</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, make rules prescribing matters:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-4__clause-8__para-a">
              <num>a</num>
              <content>
                <p>required or permitted by this Schedule to be prescribed by the rules; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-8__para-b">
              <num>b</num>
              <content>
                <p>necessary or convenient to be prescribed for carrying out or giving effect to this Act.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-4__clause-8__subclause-2">
              <num>2</num>
              <content>
                <p>Without limiting subitem (1), the rules may prescribe matters of a transitional nature (including prescribing any saving or application provisions) relating to:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-4__clause-8__para-a">
              <num>a</num>
              <content>
                <p>the amendments made by this Act; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-8__para-b">
              <num>b</num>
              <content>
                <p>the enactment of this Act.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-4__clause-8__subclause-3">
              <num>3</num>
              <content>
                <p>To avoid doubt, the rules may not do the following:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-4__clause-8__para-a">
              <num>a</num>
              <content>
                <p>create an offence or civil penalty;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-8__para-b">
              <num>b</num>
              <content>
                <p>provide powers of:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-8__para-i">
              <num>i</num>
              <content>
                <p>arrest or detention; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-8__para-ii">
              <num>ii</num>
              <content>
                <p>entry, search or seizure;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-8__para-c">
              <num>c</num>
              <content>
                <p>impose a tax;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-8__para-d">
              <num>d</num>
              <content>
                <p>set an amount to be appropriated from the Consolidated Revenue Fund under an appropriation in this Act;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-8__para-e">
              <num>e</num>
              <content>
                <p>directly amend the text of this Act.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-4__clause-8__subclause-4">
              <num>4</num>
              <content>
                <p>This Schedule (other than subitem (3)) does not limit the rules that may be made for the purposes of subitems (1) and (2).</p>
