        <heading>Short title</heading>
        <content>
          <p>		This Act is the <i>Assistance for Severely Affected Regions (Special Appropriation) (Coronavirus Economic Response Package)</i><i> </i><i>Act 2020</i>.</p>

        <heading>Commencement</heading>
        <subsection eId="sec-2__subsec-1">
          <num>1</num>
          <content>
            <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

          <content>
            <p>Any information in column 3 of the table is not part of this Act. Information may be inserted in this column, or information in it may be edited, in any published version of this Act.</p>

      </section>
      <section eId="sec-3">
        <num>3</num>
        <heading>Definitions</heading>
        <content>
          <p>In this Act:</p>
          <p><term refersTo="#term-accountable-authority">accountable authority</term> has the meaning given by <def>the Public Governance, Performance and Accountability Act 2013.</def></p>
          <p><term refersTo="#term-commonwealth-entity">Commonwealth entity</term> has the meaning given by <def>the Public Governance, Performance and Accountability Act 2013.</def></p>
          <p><term refersTo="#term-constitutional-corporation">constitutional corporation</term> means <def>a corporation to which paragraph 51(xx) of the Constitution applies.</def></p>
          <p><term refersTo="#term-non-corporate-commonwealth-entity">non-corporate Commonwealth entity</term> has the meaning given by <def>the Public Governance, Performance and Accountability Act 2013.</def></p>
          <p><term refersTo="#term-official">official</term> has the meaning given by <def>the Public Governance, Performance and Accountability Act 2013.</def></p>
          <p><term refersTo="#term-rules">rules</term> means <def>the rules made under <ref href="#sec-7">section 7</ref>.</def></p>

      </section>
      <section eId="sec-4">
        <num>4</num>
        <heading>Appropriation</heading>
        <subsection eId="sec-4__subsec-1">
          <num>1</num>
          <content>
            <p>The Consolidated Revenue Fund is appropriated to the extent of $1 billion for the purposes of making payments to support communities, regions and industry sectors affected by the economic impacts of the Coronavirus known as COVID-19.</p>
          </content>
        </subsection>
        <subsection eId="sec-4__subsec-2">
          <num>2</num>
          <content>
            <p>Without limiting subsection (1), the purpose in that subsection includes the following:</p>
          </content>
          <paragraph eId="sec-4__subsec-2__para-a">
            <num>a</num>
            <content>
              <p>helping businesses and other organisations identify:</p>
            </content>
          </paragraph>
          <paragraph eId="sec-4__subsec-2__para-i">
            <num>i</num>
            <content>
              <p>alternative markets, including export markets; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-4__subsec-2__para-ii">
            <num>ii</num>
            <content>
              <p>alternative suppliers and supply chains;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-4__subsec-2__para-b">
            <num>b</num>
            <content>
              <p>promoting and supporting Australia’s tourism industry;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-4__subsec-2__para-c">
            <num>c</num>
            <content>
              <p>designing and delivering support measures for affected communities, regions and industry sectors;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-4__subsec-2__para-d">
            <num>d</num>
            <content>
              <p>designing and delivering recovery measures for affected communities, regions and industry sectors;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-4__subsec-2__para-e">
            <num>e</num>
            <content>
              <p>supporting those recovery measures;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-4__subsec-2__para-f">
            <num>f</num>
            <content>
              <p>reimbursing Commonwealth entities, including the Great Barrier Reef Marine Park Authority and the Director of National Parks, for fees and charges that are waived;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-4__subsec-2__para-g">
            <num>g</num>
            <content>
              <p>making payments to a State or Territory for a purpose set out in another provision of this section.</p>
            </content>
          </paragraph>
        </subsection>
      </section>
      <section eId="sec-5">
        <num>5</num>
        <heading>Terms and conditions relating to payments</heading>
        <content>
          <p>Payments to States and Territories</p>
        </content>
        <subsection eId="sec-5__subsec-1">
          <num>1</num>
          <content>
            <p>If money appropriated by this Act is paid to a State or Territory:</p>
          </content>
          <paragraph eId="sec-5__subsec-1__para-a">
            <num>a</num>
            <content>
              <p>the terms and conditions on which the money is payable must be set out in a written agreement between the Commonwealth and the State or Territory; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-5__subsec-1__para-b">
            <num>b</num>
            <content>
              <p>the State or Territory must comply with the terms and conditions.</p>
            </content>
            <content>
              <p>Payments to constitutional corporations</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-5__subsec-2">
          <num>2</num>
          <content>
            <p>If money appropriated by this Act is paid to a constitutional corporation:</p>
          </content>
          <paragraph eId="sec-5__subsec-2__para-a">
            <num>a</num>
            <content>
              <p>the terms and conditions on which the money is payable must be set out in a written agreement between the Commonwealth and the corporation; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-5__subsec-2__para-b">
            <num>b</num>
            <content>
              <p>the corporation must comply with the terms and conditions.</p>
            </content>
            <content>
              <p>Payments to other persons</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-5__subsec-3">
          <num>3</num>
          <content>
            <p>If money appropriated by this Act is paid to a person other than a State, Territory or constitutional corporation:</p>
          </content>
          <paragraph eId="sec-5__subsec-3__para-a">
            <num>a</num>
            <content>
              <p>the terms and conditions on which the money is payable must be set out in a written agreement between the Commonwealth and the person; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-5__subsec-3__para-b">
            <num>b</num>
            <content>
              <p>the person must comply with the terms and conditions.</p>
            </content>
            <content>
              <p>Making agreements</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-5__subsec-4">
          <num>4</num>
          <content>
            <p>Agreements for the purposes of this section may be entered into on behalf of the Commonwealth by:</p>
          </content>
          <paragraph eId="sec-5__subsec-4__para-a">
            <num>a</num>
            <content>
              <p>a Minister; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-5__subsec-4__para-b">
            <num>b</num>
            <content>
              <p>an accountable authority of a non-corporate Commonwealth entity.</p>
            </content>
          </paragraph>
        </subsection>
      </section>
      <section eId="sec-6">
        <num>6</num>
        <heading>Delegation</heading>
        <content>
          <p>Delegation by a Minister</p>
        </content>
        <subsection eId="sec-6__subsec-1">
          <num>1</num>
          <content>
            <p>A Minister may, by writing, delegate <role refersTo="#minister">the Minister</role>’s power to make an agreement for the purposes of section 5 to an official of any non-corporate Commonwealth entity who:</p>
          </content>
          <paragraph eId="sec-6__subsec-1__para-a">
            <num>a</num>
            <content>
              <p>is an SES employee, or an acting SES employee; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-6__subsec-1__para-b">
            <num>b</num>
            <content>
              <p>holds, or is acting in, a position that is equivalent to, or higher than, a position occupied by an SES employee.</p>
            </content>

                <p>Note:	The expressions <b><i>SES employee</i></b> and <b><i>acting SES employee</i></b> are defined in section 2B of the <i>Acts Interpretation Act 1901</i>.</p>

          </paragraph>
        </subsection>
        <subsection eId="sec-6__subsec-2">
          <num>2</num>
          <content>
            <p>In exercising powers under a delegation, the delegate must comply with any directions of <role refersTo="#minister">the Minister</role>.</p>
          </content>
          <content>
            <p>Delegation by an accountable authority</p>
          </content>
        </subsection>
        <subsection eId="sec-6__subsec-3">
          <num>3</num>
          <content>
            <p>An accountable authority of a non-corporate Commonwealth entity may, by writing, delegate <role refersTo="#authority">the authority</role>’s power to make an agreement for the purposes of section 5 to an official of any non-corporate Commonwealth entity who:</p>
          </content>
          <paragraph eId="sec-6__subsec-3__para-a">
            <num>a</num>
            <content>
              <p>is an SES employee, or an acting SES employee; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-6__subsec-3__para-b">
            <num>b</num>
            <content>
              <p>holds, or is acting in, a position that is equivalent to, or higher than, a position occupied by an SES employee.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-6__subsec-4">
          <num>4</num>
          <content>
            <p>In exercising powers under a delegation, the delegate must comply with any directions of the accountable authority.</p>
          </content>
        </subsection>
      </section>
      <section eId="sec-7">
        <num>7</num>
        <heading>Rules</heading>
        <subsection eId="sec-7__subsec-1">
          <num>1</num>
          <content>
            <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, make rules prescribing matters:</p>
          </content>
          <paragraph eId="sec-7__subsec-1__para-a">
            <num>a</num>
            <content>
              <p>required or permitted by this Act to be prescribed by the rules; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7__subsec-1__para-b">
            <num>b</num>
            <content>
              <p>necessary or convenient to be prescribed for carrying out or giving effect to this Act.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-7__subsec-2">
          <num>2</num>
          <content>
            <p>The rules may also do the following:</p>
          </content>
          <paragraph eId="sec-7__subsec-2__para-a">
            <num>a</num>
            <content>
              <p>prescribe circumstances in which the Commonwealth may pay money appropriated by this Act;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7__subsec-2__para-b">
            <num>b</num>
            <content>
              <p>set amounts to be appropriated for specified purposes under the appropriation in this Act;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7__subsec-2__para-c">
            <num>c</num>
            <content>
              <p>provide for another Minister to administer a specified amount appropriated for a specified purpose under the appropriation in this Act.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-7__subsec-3">
          <num>3</num>
          <content>
            <p>However, to avoid doubt, the rules may not do the following:</p>
          </content>
          <paragraph eId="sec-7__subsec-3__para-a">
            <num>a</num>
            <content>
              <p>create an offence or civil penalty;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7__subsec-3__para-b">
            <num>b</num>
            <content>
              <p>provide powers of:</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7__subsec-3__para-i">
            <num>i</num>
            <content>
              <p>arrest or detention; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7__subsec-3__para-ii">
            <num>ii</num>
            <content>
              <p>entry, search or seizure;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7__subsec-3__para-c">
            <num>c</num>
            <content>
              <p>impose a tax;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7__subsec-3__para-d">
            <num>d</num>
            <content>
              <p>directly amend the text of this Act.</p>
            </content>
            <content>
              <p>Legislative authority for spending</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-7__subsec-4">
          <num>4</num>
          <content>
            <p>To avoid doubt, subsection (2) does not limit the sources of legislative authority for spending money appropriated by this Act.</p>
          </content>

              <p>Note:	The Commonwealth might rely on other provisions as authority for spending money appropriated by this Act, including:</p>

          </authorialNote>
          <paragraph eId="sec-7__subsec-4__para-a">

              <p>the purposes set out in <ref href="#sec-4">section 4</ref>; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7__subsec-4__para-b">
            <num>b</num>
            <content>
              <p>(b)	provisions of the <i>Financial Framework (Supplementary Powers) Regulation</i><i>s 1997</i>.</p>

          </paragraph>
        </subsection>
      </section>
      <section eId="sec-8">
        <num>8</num>
        <heading>Time limit for payments under this Act</heading>
        <content>
          <p>The Commonwealth must not pay money under the appropriation in this Act after <date date="2021-06-30">30 June 2021</date>.</p>
