          <p>		This Act is the <i>Migration Amendment (Regulation of Migration Agents)</i> <i>Act 20</i><i>20</i><i>.</i></p>

              <p><b><i>Australian legal practitioner</i></b> means a lawyer who holds a practising certificate (whether restricted or unrestricted) granted under a law of a State or Territory.</p>
              <p>Note:	For the meaning of <b><i>lawyer</i></b>, see subsection 5(1).</p>
              <p><b><i>client</i></b>: see section 306C.</p>

              <p><b><i>related by employment</i></b>: see section 278.</p>
              <p><b><i>restricted</i></b>: a practising certificate held by an Australian legal practitioner is <b><i>restricted </i></b>if:</p>
              <p>Note:	A practising certificate subject to a supervision condition of the kind mentioned in paragraph (a) is, however, taken to be <b><i>unrestricted</i></b> if the condition was imposed as a disciplinary measure as mentioned in paragraph (b) (see the definition of <b><i>unrestricted</i></b> in this section).</p>
              <p><b><i>restricted legal practitioner</i></b> means an Australian legal practitioner whose practising certificate is restricted (within the meaning of this Part).</p>

            <heading>Eligibility for restricted legal practitioners</heading>
            <content>
              <p>Eligibility—general</p>
              <p>Note 1:	A person may be <b><i>eligible</i></b> whether or not the person is a registered migration agent at the time of becoming a restricted legal practitioner.</p>
              <p>Note 2:	While a restricted legal practitioner is <b><i>eligible</i></b>, the practitioner may become, or continue to be, a registered migration agent (see sections 289B and 302A). However, to be registered as a migration agent, an eligible restricted legal practitioner must also satisfy the requirements of section 289A, including completing a prescribed course and passing a prescribed exam.</p>
              <p>Note:	However, the <b><i>eligible period </i></b>for a person who was a restricted legal practitioner immediately before Division 8 commences (which is also when this section commences) is 2 years after that commencement: see section 333C.</p>
              <p>Extension of eligible period</p>
              <p>Note:	An eligible person may apply for an extension under this subsection whether or not the person is a registered migration agent at the time of the extension application.</p>
              <p>Review by Administrative Appeals Tribunal</p>
              <p>Note:	Section 27A of the <i>Administrative Appeals Tribunal Act 1975</i> requires that people whose interests are affected by reviewable decisions of the Authority be given notice of their rights to seek review of the decisions.</p>
            </content>

              <num>1</num>
              <content>
                <p>	(1)	A person who is a restricted legal practitioner is <b><i>eligible</i></b>, subject to this section.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-278A__subclause-2">
              <num>2</num>
              <content>
                <p>	(2)	The person remains <b><i>eligible </i></b>until the earliest of the following times:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-278A__para-a">
              <num>a</num>
              <content>
                <p>the end of the eligible period, or of a longer period as extended under this section;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-278A__para-b">
              <num>b</num>
              <content>
                <p>when the person becomes an unrestricted legal practitioner.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-278A__subclause-3">
              <num>3</num>
              <content>
                <p>	(3)	The <b><i>eligible period</i></b> is the period of 2 years after the person first held a restricted practising certificate.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-278A__subclause-4">
              <num>4</num>
              <content>
                <p>An eligible person may apply to the Migration Agents Registration Authority for an extension of the eligible period for a period of up to 2 years:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-278A__para-a">
              <num>a</num>
              <content>
                <p>in a form approved in writing by <role refersTo="#authority">the Authority</role>, containing such information relevant to the application as is required by the form; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-278A__para-b">
              <num>b</num>
              <content>
                <p>if the application is made 3 months or more before the end of the eligible period.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-278A__subclause-5">
              <num>5</num>
              <content>
                <p>A person may make no more than one application for extension under subsection (4).</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-278A__subclause-6">
              <num>6</num>
              <content>
                <p>On an application under subsection (4), <role refersTo="#authority">the Authority</role> must, by written notice given to the applicant no later than 28 days before the end of the eligible period:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-278A__para-a">
              <num>a</num>
              <content>
                <p>extend the eligible period by a stated period of no more than 2 years; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-278A__para-b">
              <num>b</num>
              <content>
                <p>refuse to extend the eligible period.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-278A__subclause-7">
              <num>7</num>
              <content>
                <p><role refersTo="#authority">The Authority</role> may extend the eligible period by a particular period only if <role refersTo="#authority">the Authority</role> considers it reasonable to do so in the circumstances, including (but not limited to) any circumstances determined under subsection (9).</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-278A__subclause-8">
              <num>8</num>
              <content>
                <p>The notice of the decision must include any details determined under subsection (9) in relation to the decision.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-278A__subclause-9">
              <num>9</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, make a determination for the purposes of subsection (7) or (8).</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-278A__subclause-10">
              <num>10</num>
              <content>
                <p>Applications may be made to the Administrative Appeals Tribunal for review of a decision by <role refersTo="#authority">the Authority</role>:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-278A__para-a">
              <num>a</num>
              <content>
                <p>under paragraph (6)(a), to extend the eligible period by a particular stated period; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-278A__para-b">

                <p>under paragraph (6)(b), to refuse to extend the eligible period.</p>
              </content>
            </paragraph>

                <p>An applicant who is an unrestricted legal practitioner must not be registered.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-289B__subclause-2">

              <content>
                <p>An applicant who is a restricted legal practitioner must not be registered unless the applicant is eligible.</p>
              </content>
            </hcontainer>
            <content>
              <p>Note 1:	For when a person is <b><i>eligible</i></b>, see sections 278A and 333C.</p>
              <p>Note 2:	A registered migration agent must notify the Migration Agents Registration Authority <quantity refersTo="#deadline">within 28 days</quantity> after becoming a restricted legal practitioner or an unrestricted legal practitioner (see section 312).</p>

                <p>The Migration Agents Registration Authority must cancel the registration of a registered migration agent, by removing the agent’s name from the Register, if <role refersTo="#authority">the Authority</role> is satisfied:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-302A__para-a">
              <num>a</num>
              <content>
                <p>that the agent is an unrestricted legal practitioner; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-302A__para-b">
              <num>b</num>
              <content>
                <p>that the agent is a restricted legal practitioner who is not eligible.</p>
              </content>
            </paragraph>
            <content>
              <p>Note 1:	For when a person is eligible, see sections 278A and 333C.</p>
              <p>Note 2:	A registered migration agent must notify the Authority <quantity refersTo="#deadline">within 28 days</quantity> after becoming a restricted legal practitioner or an unrestricted legal practitioner (see section 312).</p>
              <p>Note 3:	An unrestricted legal practitioner, or a restricted legal practitioner other than an eligible restricted legal practitioner, cannot be registered as a migration agent (see <ref href="#sec-289B">section 289B</ref>).</p>
              <p>Note:	Section 332H sets out when the agent is taken to have been given the notice.</p>

                <p>This section applies in relation to an applicant who, on the day the registration application is taken to have been made, is not a registered migration agent.</p>

              <num>2</num>
              <content>
                <p>The Migration Agents Registration Authority may, by written notice given to the applicant, require the applicant to provide information in relation to the application, that is stated in the notice, by doing either of the following:</p>
              </content>

              <num>a</num>
              <content>
                <p>providing to <role refersTo="#authority">the Authority</role>, within a period prescribed for the purposes of this paragraph (or that period as extended under subsection (5)) and stated in the notice:</p>

            </paragraph>

              <num>i</num>
              <content>
                <p>a statutory declaration; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-288B__para-ii">
              <num>ii</num>
              <content>
                <p>any other specified documents;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-288B__para-b">
              <num>b</num>
              <content>
                <p>appearing before <role refersTo="#authority">the Authority</role>, at a time and place stated in the notice (or at another time or place fixed under subsection (5)), and providing such information, with any specified documents, at such an appearance.</p>
              </content>
            </paragraph>

              <num>3</num>
              <content>
                <p><role refersTo="#authority">The Authority</role> may consider refusing the application if the applicant fails to comply with a requirement in the notice under subsection (2).</p>

                <p>An applicant must not be registered if:</p>
              </content>

                <p>the applicant has failed to comply with a requirement of a notice under subsection (2):</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-288B__para-i">
              <num>i</num>
              <content>
                <p>within the period to which paragraph (2)(a) applies; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-288B__para-ii">
              <num>ii</num>
              <content>
                <p>at the time to which paragraph (2)(b) applies; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-288B__para-b">
              <num>b</num>
              <content>
                <p><role refersTo="#authority">the Authority</role> has invited the applicant to make a further submission under subsection 309(1) in relation to the information required by the notice under subsection (2); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-288B__para-c">
              <num>c</num>
              <content>
                <p>any of the following applies:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-288B__para-i">
              <num>i</num>
              <content>
                <p>the applicant fails to make such a further submission within a reasonable time after the invitation is given;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-288B__para-ii">
              <num>ii</num>
              <content>
                <p>if the applicant is given an opportunity to appear before <role refersTo="#authority">the Authority</role> under paragraph 310(3)(b)—the applicant fails to appear before <role refersTo="#authority">the Authority</role>;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-288B__para-iii">
              <num>iii</num>
              <content>
                <p><role refersTo="#authority">the Authority</role> is not satisfied that the applicant has provided the information required by the notice under subsection (2) of this section after consideration of such a further submission, and (if the applicant is given an opportunity to appear before <role refersTo="#authority">the Authority</role> under paragraph 310(3)(b)) any information given by the applicant at such an appearance.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-4__clause-288B__subclause-5">
              <num>5</num>
              <content>
                <p><role refersTo="#authority">The Authority</role> may, by written notice given to the applicant:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-4__clause-288B__para-a">
              <num>a</num>
              <content>
                <p>upon a request of the applicant made within the period to which paragraph (2)(a) applies, extend the period; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-288B__para-b">
              <num>b</num>
              <content>
                <p>upon a request of the applicant made before the time to which paragraph (2)(b) applies, fix a new time or place for the applicant to appear before <role refersTo="#authority">the Authority</role>.</p>

                <p>A notice under subsection (2) must include a statement explaining the consequences under this section of failing to comply with the requirements of the notice.</p>

            <heading>Application of amendments made by Part 1</heading>
            <content>
              <p>Despite the amendments of the <i>Migration Act 1958</i> made by Part 1 of this Schedule, section 288B of that Act as in force immediately before the commencement of this Schedule continues to apply in relation to a requirement made under subsection 288B(1) of that Act before that commencement.</p>
