          <p>		This Act is the <i>Health Insurance Amendment (</i><i>Continuing the Office of the </i><i>National Rural Health Commissioner)</i><i> Act 20</i><i>20</i>.</p>

            <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

              <p>Insert:</p>
              <p><b><i>paid work</i></b> means work for financial gain or reward (whether as an employee, a self-employed person or otherwise).</p>
              <p><b><i>Rural Health Minister</i></b> means the Minister responsible for health in rural, regional or remote areas.</p>

            <heading>Object of this Part</heading>
            <content>
              <p>The object of this Part is to establish the National Rural Health Commissioner to assist in improving health outcomes in rural, regional and remote areas, particularly in relation to improving the quality and sustainability of, and access to, health services in those areas.</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-79AB">
            <num>79AB</num>
            <heading>Simplified outline of this Part</heading>
            <content>
              <p>The National Rural Health Commissioner’s functions are:</p>
              <p><role refersTo="#commissioner">The Commissioner</role> must perform those functions in an independent and impartial manner.</p>
              <p>The Rural Health Minister must cause an independent review of the operation of this Part to be conducted <quantity refersTo="#deadline">within 6 months</quantity> of the fifth anniversary of the commencement of this Part.</p>

                <p>to provide advice to the Rural Health Minister about matters relating to health in rural, regional and remote areas; and</p>
              </content>
            </paragraph>

                <p>to undertake specified projects about those matters; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-79AB__para-c">

                <p>to inquire into and report on specified aspects of those matters; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-79AB__para-d">
              <num>d</num>

                <p>to support the implementation of Commonwealth strategies, priorities and measures about those matters; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-79AB__para-e">
              <num>e</num>
              <content>
                <p>to undertake research, and to collect, analyse, interpret and share information, about approaches to those matters; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-79AB__para-f">
              <num>f</num>
              <content>
                <p>to consult with a broad range of rural, regional and remote stakeholders about those matters; and</p>
              </content>
            </paragraph>

                <p>to build and maintain effective working relationships with those stakeholders; and</p>
              </content>
            </paragraph>

              <p>There is to be a National Rural Health Commissioner.</p>

            <heading>Functions of the National Rural Health Commissioner</heading>
            <content>
              <p>Commissioner’s functions</p>
              <p>Paragraphs (a) to (h) do not limit each other.</p>
              <p>Note:	For the purposes of paragraph (h), a function may be conferred on <role refersTo="#commissioner">the Commissioner</role> under subsection (7).</p>

                <p>The functions of the National Rural Health Commissioner are as follows:</p>
              </content>
            </hcontainer>

              <num>a</num>
              <content>
                <p>to provide advice to the Rural Health Minister about matters relating to health in rural, regional or remote areas, including in relation to:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-79AD__para-i">
              <num>i</num>
              <content>
                <p>developing, aligning and implementing Commonwealth strategies, priorities or measures so as to improve health outcomes in those areas; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-79AD__para-ii">
              <num>ii</num>
              <content>
                <p>developing and promoting innovative and integrated approaches to the delivery of health services in those areas so as to improve the quality and sustainability of, and access to, health services in those areas; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-79AD__para-iii">
              <num>iii</num>
              <content>
                <p>identifying opportunities to strengthen and align health workforce training in those areas; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-79AD__para-iv">
              <num>iv</num>
              <content>
                <p>strengthening and promoting regionally-based, patient-centred approaches to the delivery of health services in those areas that take into account the needs of the communities, families and individuals in those areas;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-79AD__para-b">
              <num>b</num>
              <content>
                <p>to undertake projects specified by the Rural Health Minister under subsection (3);</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-79AD__para-c">
              <num>c</num>
              <content>
                <p>to inquire into and report on matters specified by the Rural Health Minister under subsection (4);</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-79AD__para-d">
              <num>d</num>
              <content>
                <p>to support the implementation of Commonwealth strategies, priorities and measures for improving the quality and sustainability of, and access to, health services in those areas;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-79AD__para-e">
              <num>e</num>
              <content>
                <p>to undertake research, and to collect, analyse, interpret and share information, about approaches for improving the quality and sustainability of, and access to, health services in those areas;</p>
              </content>
            </paragraph>

              <num>f</num>
              <content>
                <p>to consult with the following persons, groups and bodies about matters relating to health in those areas:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-79AD__para-i">
              <num>i</num>
              <content>
                <p>health professionals;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-79AD__para-ii">
              <num>ii</num>
              <content>
                <p>State and Territory governmental bodies;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-79AD__para-iii">
              <num>iii</num>
              <content>
                <p>industry, non-profit and other community groups;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-79AD__para-iv">
              <num>iv</num>
              <content>
                <p>other health stakeholders;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-79AD__para-g">
              <num>g</num>
              <content>
                <p>to build and maintain effective working relationships with the persons, groups and bodies referred to in paragraph (f);</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-79AD__para-h">
              <num>h</num>
              <content>
                <p>to perform any function conferred on <role refersTo="#commissioner">the Commissioner</role> under a law of the Commonwealth.</p>
              </content>
            </paragraph>

              <num>2</num>
              <content>
                <p><role refersTo="#commissioner">The Commissioner</role> must perform those functions in an independent and impartial manner.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-79AD__subclause-3">
              <num>3</num>
              <content>
                <p>For the purposes of paragraph (1)(b), the Rural Health Minister may give a written notice to the National Rural Health Commissioner requesting <role refersTo="#commissioner">the Commissioner</role>:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-79AD__para-a">
              <num>a</num>
              <content>
                <p>to undertake a project that:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-79AD__para-i">
              <num>i</num>
              <content>
                <p>relates to health in rural, regional or remote areas; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-79AD__para-ii">
              <num>ii</num>
              <content>
                <p>is specified in the notice; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-79AD__para-b">
              <num>b</num>
              <content>
                <p>to complete the project within the timeframe specified in the notice.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-79AD__subclause-4">
              <num>4</num>
              <content>
                <p>For the purposes of paragraph (1)(c), the Rural Health Minister may give a written notice to the National Rural Health Commissioner requesting <role refersTo="#commissioner">the Commissioner</role>:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-79AD__para-a">
              <num>a</num>
              <content>
                <p>to inquire into a matter that:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-79AD__para-i">
              <num>i</num>
              <content>
                <p>relates to health in rural, regional or remote areas; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-79AD__para-ii">
              <num>ii</num>
              <content>
                <p>is specified in the notice; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-79AD__para-b">
              <num>b</num>
              <content>
                <p>to give a written report on the matter to the Rural Health Minister within the timeframe specified in the notice.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-79AD__subclause-5">
              <num>5</num>
              <content>
                <p>The National Rural Health Commissioner must comply with a notice given under subsection (3) or (4).</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-79AD__subclause-6">
              <num>6</num>
              <content>
                <p>A notice under subsection (3) or (4) is not a legislative instrument.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-79AD__subclause-7">
              <num>7</num>
              <content>
                <p>For the purposes of paragraph (1)(h), the Rural Health Minister may, by legislative instrument, confer on the National Rural Health Commissioner a function that relates to health in rural, regional or remote areas.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-79AE">
            <num>79AE</num>
            <heading>Keeping the Rural Health Minister informed</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-79AE__subclause-1">
              <num>1</num>
              <content>
                <p>The National Rural Health Commissioner must:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-79AE__para-a">
              <num>a</num>
              <content>
                <p>keep the Rural Health Minister informed of the activities of <role refersTo="#commissioner">the Commissioner</role>; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-79AE__para-b">
              <num>b</num>
              <content>
                <p>provide the Rural Health Minister with any information specified by <role refersTo="#minister">the Minister</role> under subsection (2).</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-79AE__subclause-2">
              <num>2</num>
              <content>
                <p>For the purposes of paragraph (1)(b), the Rural Health Minister may give a written notice to the National Rural Health Commissioner requesting <role refersTo="#commissioner">the Commissioner</role>:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-79AE__para-a">
              <num>a</num>
              <content>
                <p>to provide information that:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-79AE__para-i">
              <num>i</num>
              <content>
                <p>relates to the activities of <role refersTo="#commissioner">the Commissioner</role>; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-79AE__para-ii">
              <num>ii</num>
              <content>
                <p>is specified in the notice; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-79AE__para-b">
              <num>b</num>
              <content>
                <p>to provide the information to the Rural Health Minister within the timeframe specified in the notice.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-79AE__subclause-3">
              <num>3</num>
              <content>
                <p>The National Rural Health Commissioner must comply with a notice given under subsection (2).</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-79AE__subclause-4">
              <num>4</num>
              <content>
                <p>A notice under subsection (2) is not a legislative instrument.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-79AF">
            <num>79AF</num>
            <heading>Appointment</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-79AF__subclause-1">
              <num>1</num>
              <content>
                <p>The National Rural Health Commissioner is to be appointed by the Rural Health Minister by written instrument, on a full-time basis or a part-time basis.</p>
              </content>
            </hcontainer>
            <content>
              <p>Note:	The Commissioner may be reappointed: see <i>Acts Interpretation Act 1901</i>.<ref href="#sec-33A">section 33A</ref>A of the </p>
            </content>
            <hcontainer name="subclause" eId="schedule-1__clause-79AF__subclause-2">
              <num>2</num>
              <content>
                <p>The National Rural Health Commissioner holds office for the period specified in the instrument of appointment. The period must not exceed 2 years.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-79AF__subclause-3">
              <num>3</num>
              <content>
                <p>A person is only eligible to be appointed as the National Rural Health Commissioner if the person has experience in rural health.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-79AG">
            <num>79AG</num>
            <heading>Acting appointments</heading>
            <content>
              <p>The Rural Health Minister may, by written instrument, appoint a person to act as the National Rural Health Commissioner:</p>
              <p>Note:	For rules that apply to acting appointments, see sections 33AB and 33A of the <i>Acts Interpretation Act 1901</i>.</p>
            </content>
            <paragraph eId="schedule-1__clause-79AG__para-a">
              <num>a</num>
              <content>
                <p>during a vacancy in the office of <role refersTo="#commissioner">the Commissioner</role> (whether or not an appointment has previously been made to the office); or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-79AG__para-b">
              <num>b</num>
              <content>
                <p>during any period, or during all periods, when <role refersTo="#commissioner">the Commissioner</role>:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-79AG__para-i">
              <num>i</num>
              <content>
                <p>is absent from duty or from Australia; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-79AG__para-ii">
              <num>ii</num>
              <content>
                <p>is, for any reason, unable to perform the duties of the office.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-79AH">
            <num>79AH</num>
            <heading>Terms and conditions</heading>
            <content>
              <p>The National Rural Health Commissioner holds office on the terms and conditions (if any) in relation to matters not covered by this Part that are determined by the Rural Health Minister.</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-79AI">
            <num>79AI</num>
            <heading>Remuneration</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-79AI__subclause-1">
              <num>1</num>
              <content>
                <p>The National Rural Health Commissioner is to be paid the remuneration that is determined by the Remuneration Tribunal. If no determination of that remuneration by the Tribunal is in operation, <role refersTo="#commissioner">the Commissioner</role> is to be paid the remuneration that is prescribed by the instrument under subsection (4).</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-79AI__subclause-2">
              <num>2</num>
              <content>
                <p>The National Rural Health Commissioner is to be paid the allowances that are prescribed by the instrument under subsection (4).</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-79AI__subclause-3">
              <num>3</num>
              <content>
                <p>	(3)	This section has effect subject to the <i>Remuneration Tribunal Act 1973</i>.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-79AI__subclause-4">
              <num>4</num>
              <content>
                <p>The Rural Health Minister may, by legislative instrument, prescribe:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-79AI__para-a">
              <num>a</num>
              <content>
                <p>remuneration for the purposes of subsection (1); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-79AI__para-b">
              <num>b</num>
              <content>
                <p>allowances for the purposes of subsection (2).</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-79AJ">
            <num>79AJ</num>
            <heading>Leave of absence</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-79AJ__subclause-1">
              <num>1</num>
              <content>
                <p>If the National Rural Health Commissioner is appointed on a full-time basis, <role refersTo="#commissioner">the Commissioner</role> has the recreation leave entitlements that are determined by the Remuneration Tribunal.</p>
              </content>
            </hcontainer>

              <num>2</num>
              <content>

                <p>If the National Rural Health Commissioner is appointed on a full-time basis, <role refersTo="#commissioner">the Commissioner</role> must not engage in paid work outside the duties of <role refersTo="#commissioner">the Commissioner</role>’s office without the Rural Health Minister’s approval.</p>

              <num>2</num>
              <content>
                <p>If the National Rural Health Commissioner is appointed on a part-time basis, <role refersTo="#commissioner">the Commissioner</role> must not engage in any paid work that, in the Rural Health Minister’s opinion, conflicts or could conflict with the proper performance of <role refersTo="#commissioner">the Commissioner</role>’s duties.</p>

            <heading>Resignation</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-79AL__subclause-1">
              <num>1</num>
              <content>
                <p>The National Rural Health Commissioner may resign <role refersTo="#commissioner">the Commissioner</role>’s appointment by giving the Rural Health Minister a written resignation.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-79AL__subclause-2">
              <num>2</num>
              <content>
                <p>The resignation takes effect on the day it is received by the Rural Health Minister or, if a later day is specified in the resignation, on that later day.</p>

            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-79AM">
            <num>79AM</num>
            <heading>Termination of appointment</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-79AM__subclause-1">
              <num>1</num>
              <content>
                <p>The Rural Health Minister may terminate the appointment of the National Rural Health Commissioner:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-79AM__para-a">
              <num>a</num>
              <content>
                <p>for misbehaviour; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-79AM__para-b">
              <num>b</num>
              <content>
                <p>if <role refersTo="#commissioner">the Commissioner</role> is unable to perform the duties of <role refersTo="#commissioner">the Commissioner</role>’s office because of physical or mental incapacity.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-79AM__subclause-2">
              <num>2</num>
              <content>
                <p>The Rural Health Minister may terminate the appointment of the National Rural Health Commissioner if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-79AM__para-a">
              <num>a</num>
              <content>
                <p><role refersTo="#commissioner">the Commissioner</role>:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-79AM__para-i">
              <num>i</num>
              <content>
                <p>becomes bankrupt; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-79AM__para-ii">
              <num>ii</num>
              <content>
                <p>applies to take the benefit of any law for the relief of bankrupt or insolvent debtors; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-79AM__para-iii">
              <num>iii</num>
              <content>
                <p>compounds with <role refersTo="#commissioner">the Commissioner</role>’s creditors; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-79AM__para-iv">
              <num>iv</num>
              <content>
                <p>makes an assignment of <role refersTo="#commissioner">the Commissioner</role>’s remuneration for the benefit of <role refersTo="#commissioner">the Commissioner</role>’s creditors; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-79AM__para-b">
              <num>b</num>
              <content>
                <p>if <role refersTo="#commissioner">the Commissioner</role> is appointed on a full-time basis—<role refersTo="#commissioner">the Commissioner</role> is absent, except on leave of absence, for 14 consecutive days or for 28 days in any 12 months; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-79AM__para-c">
              <num>c</num>
              <content>
                <p>if <role refersTo="#commissioner">the Commissioner</role> is appointed on a full-time basis—<role refersTo="#commissioner">the Commissioner</role> engages, except with the Rural Health Minister’s approval, in paid work outside the duties of <role refersTo="#commissioner">the Commissioner</role>’s office (see subsection 79AK(1)); or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-79AM__para-d">
              <num>d</num>
              <content>
                <p>if <role refersTo="#commissioner">the Commissioner</role> is appointed on a part-time basis—<role refersTo="#commissioner">the Commissioner</role> engages in paid work that, in the Rural Health Minister’s opinion, conflicts or could conflict with the proper performance of <role refersTo="#commissioner">the Commissioner</role>’s duties (see subsection 79AK(2)); or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-79AM__para-e">
              <num>e</num>
              <content>
                <p><role refersTo="#commissioner">the Commissioner</role> fails, without reasonable excuse, to comply with section 79AN.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-79AN">
            <num>79AN</num>
            <heading>Disclosure of interests</heading>
            <content>
              <p>		The National Rural Health Commissioner must disclose to the Rural Health Minister details of any direct or indirect pecuniary interests<i> </i>that the Commissioner has or acquires and that conflict or could conflict with the proper performance of the Commissioner’s functions.</p>
            </content>
          </hcontainer>

            <num>79AO</num>
            <heading>Application of the finance law</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-79AO__subclause-1">
              <num>1</num>
              <content>
                <p>	(1)	For the purposes of the finance law (within the meaning of the <i>Public Governance, Performance and Accountability Act 2013</i>), the National Rural Health Commissioner is an official (within the meaning of that Act) of the Department.</p>
              </content>
            </hcontainer>
            <content>
              <p>Note:	The Commissioner’s responsibilities as an official under the finance law include duties in relation to exercising due care and diligence, acting in good faith and for a proper purpose and not improperly using information or position (see <i>Public Governance, Performance and Accountability Act 2013</i>).<ref href="#dvs-3">Division 3</ref> of <ref href="#part-2">Part 2</ref>-2 of the </p>
              <p>Note:	Section 29 of that Act does not apply to <role refersTo="#commissioner">the Commissioner</role> because the duty is instead imposed on <role refersTo="#commissioner">the Commissioner</role> under section 79AN of this Act.</p>

              <num>2</num>
              <content>
                <p>	(2)	However, <i>Public Governance, Performance and Accountability Act 2013</i> (which deals with the duty to disclose interests) does not apply to the Commissioner.<ref href="#sec-29">section 29</ref> of the </p>

          </hcontainer>

            <num>79AP</num>
            <heading>Annual report</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-79AP__subclause-1">
              <num>1</num>
              <content>
                <p>	(1)	The National Rural Health Commissioner must prepare and give to the Rural Health Minister, for presentation to the Parliament, an annual report about the Commissioner’s activities during the previous financial year (the <b><i>reporting period</i></b>).</p>
              </content>
            </hcontainer>
            <content>
              <p>Note:	See also <i>Acts Interpretation Act 1901</i>, which contains extra rules about annual reports.<ref href="#sec-34C">section 34C</ref> of the </p>
            </content>
            <hcontainer name="subclause" eId="schedule-1__clause-79AP__subclause-2">
              <num>2</num>
              <content>
                <p>The report must include:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-79AP__para-a">
              <num>a</num>
              <content>
                <p>details of the National Rural Health Commissioner’s activities during the reporting period; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-79AP__para-b">
              <num>b</num>
              <content>
                <p>any other matters the Rural Health Minister directs <role refersTo="#commissioner">the Commissioner</role> to include in the report under section 79AQ.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-79AP__subclause-3">
              <num>3</num>
              <content>
                <p>The report must be given to the Rural Health Minister by:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-79AP__para-a">
              <num>a</num>
              <content>
                <p>the 15th day of the fourth month after the end of the reporting period; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-79AP__para-b">
              <num>b</num>
              <content>
                <p>	(b)	the end of any further period granted under subsection 34C(5) of the <i>Acts Interpretation Act 1901</i>.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-79AP__subclause-4">
              <num>4</num>
              <content>
                <p>	(4)	The report may be included in a report prepared in relation to the Department and given<i> </i>to the Minister administering this Act under section 46 of the <i>Public Governance, Performance and Accountability Act 2013</i>.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-79AQ">
            <num>79AQ</num>
            <heading>Minister may give directions to the National Rural Health Commissioner</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-79AQ__subclause-1">
              <num>1</num>
              <content>
                <p>The Rural Health Minister may, by notifiable instrument, give written directions to the National Rural Health Commissioner about:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-79AQ__para-a">
              <num>a</num>
              <content>
                <p>the performance of <role refersTo="#commissioner">the Commissioner</role>’s functions; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-79AQ__para-b">
              <num>b</num>
              <content>
                <p>matters to be included in a report under <ref href="#sec-79A">section 79A</ref>P.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-79AQ__subclause-2">
              <num>2</num>
              <content>
                <p><role refersTo="#commissioner">The Commissioner</role> must comply with a direction under subsection (1).</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-79AR">
            <num>79AR</num>
            <heading>Assistance from APS employees</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-79AR__subclause-1">
              <num>1</num>
              <content>
                <p><role refersTo="#secretary">The Secretary</role> of the Department may enter into an arrangement with the National Rural Health Commissioner for the services of APS employees in the Department to be made available to assist <role refersTo="#commissioner">the Commissioner</role>.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-79AR__subclause-2">
              <num>2</num>
              <content>
                <p>When performing services for the National Rural Health Commissioner under this section, a person is subject to the directions of <role refersTo="#commissioner">the Commissioner</role>.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-79AS">
            <num>79AS</num>
            <heading>Review of the operation of this Part</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-79AS__subclause-1">
              <num>1</num>
              <content>
                <p>The Rural Health Minister must cause an independent review of the operation of this Part to be conducted <quantity refersTo="#deadline">within 6 months</quantity> after the fifth anniversary of the commencement of this Part.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-79AS__subclause-2">
              <num>2</num>
              <content>
                <p>The persons who conduct the review must give the Rural Health Minister a written report of the review.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-79AS__subclause-3">
              <num>3</num>
              <content>
                <p>The Rural Health Minister must cause a copy of the report to be tabled in each House of the Parliament within 15 sitting days of that House after the report is given to the Rural Health Minister.</p>
