          <p>		This Act is the <i>Tertiary Education Quality and Standards </i><i>Agency </i><i>Amendment </i><i>(Prohibiting Academic Cheating Services)</i><i> Act 20</i><i>20</i>.</p>

        <heading>Commencement</heading>
        <subsection eId="sec-2__subsec-1">

            <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

          <p>Legislation that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.</p>

            <heading>Section 5</heading>
            <content>
              <p>Insert:</p>
              <p><b><i>academic cheating service</i></b> means the provision of work to or the undertaking of work for students, in circumstances where the work:</p>
              <p><b><i>academic cheating services information </i></b>means information that:</p>
              <p><b><i>assessment task</i></b> means an assignment, essay, examination, practicum, presentation, project or any other assessable part of a course of study, whether mandatory or optional.</p>
              <p><b><i>carriage service provider</i></b> has the same meaning as in the <i>Telecommunications Act 1997</i>.</p>
              <p><b><i>commercial purpose</i></b> means a purpose relating to the derivation of financial gain or reward.</p>
              <p><b><i>entrusted person</i></b> means a person who is or was any of the following:</p>
              <p><b><i>national security</i></b> has the same meaning as in the <i>National Security Information (Criminal and Civil Proceedings) Act 2004</i>.</p>
              <p><b><i>national security information</i></b> has the same meaning as in the <i>National Security Information (Criminal and Civil Proceedings) Act 2004</i>.</p>
            </content>
            <paragraph eId="schedule-1__clause-3__para-a">
              <num>a</num>
              <content>
                <p>is, or forms a substantial part of, an assessment task that students are required to personally undertake; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-3__para-b">
              <num>b</num>
              <content>
                <p>could reasonably be regarded as being, or forming a substantial part of, an assessment task that students are required to personally undertake.</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-3__para-a">
              <num>a</num>
              <content>
                <p>was obtained under, or for the purposes of, this Act; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-3__para-b">
              <num>b</num>
              <content>
                <p>relates to the use or provision of an academic cheating service by a person; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-3__para-c">
              <num>c</num>
              <content>
                <p>identifies, or is reasonably capable of being used to identify, the person.</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-3__para-a">
              <num>a</num>
              <content>
                <p>a Commissioner;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-3__para-b">
              <num>b</num>
              <content>
                <p>a Panel member;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-3__para-c">
              <num>c</num>
              <content>
                <p>the Chief Executive Officer;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-3__para-d">
              <num>d</num>

                <p>a member of the staff of TEQSA;</p>

              <p>Providing etc. an academic cheating service</p>
              <p>Civil penalty:	<quantity refersTo="#penaltyUnit">500 penalty units</quantity>.</p>
              <p>Generally not necessary to prove provision etc. of an academic cheating service to a particular student</p>

              <num>1</num>
              <content>
                <p>A person commits an offence if the person provides, offers to provide or arranges for a third person to provide an academic cheating service:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-114A__para-a">
              <num>a</num>
              <content>
                <p>to a student undertaking, with a higher education provider:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-114A__para-i">
              <num>i</num>
              <content>
                <p>an Australian course of study; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-114A__para-ii">
              <num>ii</num>
              <content>
                <p>an overseas course of study provided at Australian premises; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-114A__para-b">
              <num>b</num>
              <content>
                <p>for a commercial purpose.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-114A__subclause-2">
              <num>2</num>
              <content>
                <p>Strict liability applies to:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-114A__para-a">
              <num>a</num>
              <content>
                <p>paragraph (1)(a); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-114A__para-b">
              <num>b</num>
              <content>
                <p>	(b)	the physical element of circumstance in paragraphs (a) and (b) of the definition of <b><i>academic cheating service</i></b> in section 5.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-114A__subclause-3">
              <num>3</num>
              <content>
                <p>A person contravenes this subsection if the person provides, offers to provide or arranges for a third person to provide an academic cheating service to a student undertaking, with a higher education provider:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-114A__para-a">
              <num>a</num>
              <content>
                <p>an Australian course of study; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-114A__para-b">
              <num>b</num>
              <content>
                <p>an overseas course of study provided at Australian premises.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-114A__subclause-4">
              <num>4</num>
              <content>
                <p>In proceedings for a contravention of subsection (1) or (3), it is not necessary to prove that the person provided, offered to provide or arranged for a third person to provide an academic cheating service to a particular student.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-114A__subclause-5">
              <num>5</num>
              <content>
                <p>Subsection (4) does not apply in relation to proceedings for a contravention of subsection (1) or (3) (as that provision is given effect by paragraph 114C(4)(c)) if the student referred to in that subsection is an alien (within the meaning of paragraph 51(xix) of the Constitution).</p>
              </content>
            </hcontainer>

            <num>114B</num>
            <heading>Prohibition on advertising academic cheating services</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-114B__subclause-1">
              <num>1</num>
              <content>
                <p>A person commits an offence if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-114B__para-a">
              <num>a</num>
              <content>
                <p>the person advertises, or publishes or broadcasts an advertisement for, an academic cheating service to students undertaking, with a higher education provider:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-114B__para-i">
              <num>i</num>
              <content>
                <p>an Australian course of study; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-114B__para-ii">
              <num>ii</num>
              <content>
                <p>an overseas course of study provided at Australian premises; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-114B__para-b">
              <num>b</num>
              <content>
                <p>either:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-114B__para-i">
              <num>i</num>
              <content>
                <p>the person does so for a commercial purpose; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-114B__para-ii">
              <num>ii</num>
              <content>
                <p>the academic cheating service has a commercial purpose.</p>
              </content>
            </paragraph>
            <content>
              <p>Penalty:	<quantity refersTo="#custodialSentence">2 years imprisonment</quantity> or <quantity refersTo="#penaltyUnit">500 penalty units</quantity>, or both.</p>
              <p>Civil penalty:	<quantity refersTo="#penaltyUnit">500 penalty units</quantity>.</p>

              <content>
                <p>	(2)	A person contravenes this subsection if the person advertises, or publishes or broadcasts an advertisement for, an academic cheating service to students undertaking<i>, </i>with a higher education provider:</p>

              <num>a</num>
              <content>
                <p>an Australian course of study; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-114B__para-b">

                <p>an overseas course of study provided at Australian premises.</p>
              </content>
            </paragraph>

            <num>114C</num>
            <heading>Additional operation of sections 114A and 114B</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-114C__subclause-1">
              <num>1</num>

                <p>In addition to the effect they have in relation to higher education providers, sections 114A and 114B also have effect as provided by this section.</p>

              <content>
                <p>each reference to an offer to provide, or to an arrangement to provide, an academic cheating service were expressly confined to an offer or arrangement made in the course of trade and commerce to which paragraph 51(i) of the Constitution applies.</p>

              <num>3</num>
              <content>
                <p>Section 114A also has the effect it would have as if:</p>
              </content>

                <p>each reference to providing an academic cheating service were expressly confined to a service that is, or is to be, provided by means of a service to which paragraph 51(v) of the Constitution applies; or</p>

              <content>
                <p>each reference to an offer to provide, or to an arrangement to provide, an academic cheating service were expressly confined to an offer or arrangement made by means of a service to which paragraph 51(v) of the Constitution applies.</p>

                <p>Section 114A also has the effect it would have as if:</p>

                <p>Section 114A also has the effect it would have as if:</p>

                <p>each reference to a person who provides, offers to provide or arranges for a third person to provide an academic cheating service were expressly confined to a constitutional corporation; or</p>

                <p>each reference to a third person in respect of whom an arrangement is made were expressly confined to a constitutional corporation.</p>
              </content>
            </paragraph>

                <p>Section 114B also has the effect it would have as if:</p>

                <p>each reference to advertising, or publishing or broadcasting an advertisement for, an academic cheating service were expressly confined to a service that is, or is to be, provided in the course of trade and commerce to which paragraph 51(i) of the Constitution applies; or</p>

              <content>
                <p>each reference to advertising, or publishing or broadcasting an advertisement for, an academic cheating service were expressly confined to advertising, publishing or broadcasting in the course of trade and commerce to which paragraph 51(i) of the Constitution applies.</p>

                <p>Section 114B also has the effect it would have as if:</p>

                <p>each reference to advertising, or publishing or broadcasting an advertisement for, an academic cheating service were expressly confined to a service that is, or is to be, provided by means of a service to which paragraph 51(v) of the Constitution applies; or</p>

              <num>b</num>
              <content>
                <p>each reference to advertising, or publishing or broadcasting an advertisement for, an academic cheating service were expressly confined to advertising, publishing or broadcasting by means of a service to which paragraph 51(v) of the Constitution applies.</p>
