          <p>		This Act is the <i>Agricultural and Veterinary Chemicals Legislation Amendment (Australian Pesticides and Veterinary Medicines Authority Board and Other Improvements) Act 2021</i>.</p>

        <heading>Commencement</heading>
        <subsection eId="sec-2__subsec-1">

            <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

              <p>The amendments of <i>Agricultural and Veterinary Chemicals Code Act 1994</i> made by this Part apply in relation to the following:<ref href="#sec-8C">section 8C</ref> of the Code set out in the Schedule to the </p>
              <p>Agricultural and Veterinary Chemicals Code Act 1994</p>

              <num>a</num>
              <content>
                <p>applications lodged on or after the commencement of this item;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-3__para-b">
              <num>b</num>
              <content>
                <p>applications lodged before the commencement of this item but not determined by the APVMA before that commencement.</p>
              </content>
            </paragraph>

            <heading>Section 3 of the Code set out in the Schedule</heading>

              <p>Insert:</p>
              <p><b><i>prescribed active constituent </i></b>has the meaning given by subsection 14C(4).</p>
              <p><b><i>prescribed chemical product </i></b>has the meaning given by subsection 14D(4).</p>

                <p>Subdivision B provides for approval and registration for active constituents, chemical products or labels after assessment against certain criteria. Section 10 provides for applications to be made and applications must meet the application requirements in <ref href="#sec-8A">section 8A</ref>.</p>
              </content>

                <p>The APVMA must complete a preliminary assessment of an application. If the application passes preliminary assessment, the APVMA must notify the applicant and publish a summary of the application (<ref href="#sec-11">section 11</ref>).</p>
              </content>

              <num>4</num>
              <content>
                <p>Before determining certain applications that have passed preliminary assessment, the APVMA must publish a notice inviting public submissions (sections 12 and 13).</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-6__subclause-5">
              <num>5</num>
              <content>
                <p>The APVMA must approve an active constituent or label, or register a chemical product, if specified criteria are met (<ref href="#sec-14">section 14</ref>).</p>

              <num>5A</num>
              <content>
                <p>Subdivision C provides for approval and registration for a prescribed active constituent, prescribed chemical product or prescribed label for containers for a chemical product. Sections 14C, 14D and 14E provide for applications to be made and applications must meet the application requirements in <ref href="#sec-8A">section 8A</ref>.</p>

                <p>If an application meets the application requirements, the APVMA must approve the active constituent or label, or register the chemical product, if no disqualifying circumstances exist in relation to the applicant.</p>

                <p>The APVMA may alter the application with the written consent of the applicant.</p>

            <hcontainer name="subclause" eId="schedule-1__clause-14C__subclause-4">
              <num>4</num>
              <content>
                <p>	(4)	A <b><i>prescribed active constituent</i></b> is an active constituent that:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-14C__para-a">
              <num>a</num>
              <content>
                <p>is for a proposed or existing chemical product; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-14C__para-b">
              <num>b</num>
              <content>
                <p>is of a kind:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-14C__para-i">
              <num>i</num>
              <content>
                <p>prescribed by the regulations for the purposes of this subparagraph; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-14C__para-ii">
              <num>ii</num>
              <content>
                <p>determined by the APVMA under subsection (6).</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-14C__subclause-5">
              <num>5</num>
              <content>
                <p>The APVMA must not determine a kind of active constituent under subsection (6) unless it is satisfied that the kind of active constituent would meet the safety criteria.</p>
              </content>
            </hcontainer>

              <num>6</num>
              <content>
                <p>The APVMA may, by legislative instrument, determine a kind of active constituent for the purposes of subparagraph (4)(b)(ii).</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-14C__subclause-7">
              <num>7</num>
              <content>
                <p>The APVMA must approve the active constituent that is the subject of the application if it is satisfied that:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-14C__para-a">
              <num>a</num>
              <content>
                <p>the application meets the application requirements; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-14C__para-b">
              <num>b</num>
              <content>
                <p>the active constituent is a prescribed active constituent; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-14C__para-c">
              <num>c</num>
              <content>
                <p>none of the circumstances determined in an instrument under subsection (9) apply in relation to the applicant.</p>
              </content>
            </paragraph>

              <content>
                <p>Otherwise, the APVMA must refuse the application.</p>
              </content>
            </hcontainer>

                <p>The APVMA may, by legislative instrument, determine circumstances for the purposes of paragraph (7)(c).</p>

            <heading>Applications for registration of prescribed chemical products</heading>

                <p>A person may apply to the APVMA for registration of a prescribed chemical product.</p>
              </content>
            </hcontainer>

              <num>a</num>
              <content>
                <p>prescribed by the regulations for the purposes of this paragraph; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-14D__para-b">
              <num>b</num>
              <content>
                <p>determined by the APVMA under subsection (6).</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-14D__subclause-5">
              <num>5</num>
              <content>
                <p>The APVMA must not determine a kind of chemical product under subsection (6) unless it is satisfied that the kind of chemical product would:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-14D__para-a">
              <num>a</num>
              <content>
                <p>meet the safety criteria, the trade criteria and the efficacy criteria; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-14D__para-b">
              <num>b</num>
              <content>
                <p>comply with the established standard for the kind of chemical product.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-14D__subclause-6">
              <num>6</num>
              <content>
                <p>The APVMA may, by legislative instrument, determine a kind of chemical product for the purposes of paragraph (4)(b).</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-14D__subclause-7">
              <num>7</num>
              <content>
                <p>The APVMA must register the chemical product that is the subject of the application if it is satisfied that:</p>
              </content>
            </hcontainer>

              <num>a</num>
              <content>

                <p>a label for containers for the chemical product may not meet the labelling criteria; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-106__para-b">
              <num>b</num>
              <content>
                <p>the chemical product is not a registered chemical product.</p>
              </content>
            </paragraph>

            <heading>Remuneration</heading>

                <p>An appointed Board member is to be paid the remuneration that is determined by the Remuneration Tribunal. If no determination of that remuneration by the Tribunal is in operation, the member is to be paid the remuneration that is prescribed by the regulations.</p>

                <p>An appointed Board member is to be paid the allowances that are prescribed by the regulations.</p>

            <heading>Paid work</heading>

              <p>An appointed Board member must not engage in any paid work that, in <role refersTo="#minister">the Minister</role>’s opinion, conflicts or could conflict with the proper performance of the member’s duties.</p>

            <heading>Leave of absence</heading>

                <p><role refersTo="#minister">The Minister</role> may grant leave of absence to the Chair on the terms and conditions that <role refersTo="#minister">the Minister</role> determines.</p>

              <content>
                <p>The Chair may grant leave of absence to any other appointed Board member on the terms and conditions that the Chair determines.</p>

            <heading>Resignation of appointment</heading>

                <p>An appointed Board member may resign the member’s appointment by giving <role refersTo="#minister">the Minister</role> a written resignation.</p>
              </content>
            </hcontainer>

                <p>The resignation takes effect on the day it is received by <role refersTo="#minister">the Minister</role> or, if a later day is specified in the resignation, on that later day.</p>

            <heading>Termination of appointment</heading>
            <content>
              <p><role refersTo="#minister">The Minister</role> may terminate the appointment of an appointed Board member:</p>
              <p>Note:	The appointment of an appointed Board member may also be terminated under <i>Public Governance, Performance and Accountability Act 2013</i> (which deals with terminating the appointment of an accountable authority, or a member of an accountable authority, for contravening general duties of officials).<ref href="#sec-30">section 30</ref> of the </p>

                <p>for misbehaviour; or</p>
              </content>
            </paragraph>

                <p>if the appointed Board member is unable to perform the duties of the member’s office because of physical or mental incapacity; or</p>
              </content>
            </paragraph>

                <p>if the appointed Board member:</p>

            </paragraph>

                <p>becomes bankrupt; or</p>

                <p>applies to take the benefit of any law for the relief of bankrupt or insolvent debtors; or</p>

            </paragraph>

                <p>compounds with the member’s creditors; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-25__para-iv">
              <num>iv</num>

                <p>makes an assignment of the member’s remuneration for the benefit of the member’s creditors; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-25__para-d">
              <num>d</num>
              <content>
                <p>if the appointed Board member is absent, except on leave of absence, from 3 consecutive meetings of the Board; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-25__para-e">

                <p>if the appointed Board member engages in paid work that, in <role refersTo="#minister">the Minister</role>’s opinion, conflicts or could conflict with the proper performance of the member’s duties (see section 22); or</p>

              <p>Subdivision C—Meetings of the Board</p>

                <p>	(a)	a Board member is required by rules made for the purposes of <i>Public Governance, Performance and Accountability Act 2013</i> not to be present during the deliberations, or to take part in any decision, of the Board with respect to a particular matter; and<ref href="#sec-29">section 29</ref> of the </p>

                <p>when the Board member leaves the meeting concerned there is no longer a quorum present;</p>

              <p>the remaining Board members at the meeting constitute a quorum for the purpose of any deliberation or decision at that meeting with respect to that matter.</p>

                <p>A question arising at a meeting of the Board is to be determined by a majority of the votes of the Board members present and voting.</p>

                <p>The person presiding at the meeting of the Board has a deliberative vote and, if the votes are equal, a casting vote.</p>

            <heading>Conduct of meetings</heading>
            <content>
              <p>The Board may, subject to this Subdivision, regulate proceedings at its meetings as it considers appropriate.</p>
              <p>Note:	Section 33B of the <i>Acts Interpretation Act 1901</i> contains further information about the ways in which Board members may participate in meetings.</p>
            </content>
          </hcontainer>

                <p>The Board must keep minutes of its meetings.</p>

                <p>The Board must give <role refersTo="#secretary">the Secretary</role> of the Department a copy of the minutes, and the Board papers, from each meeting within 20 business days of the meeting.</p>

            <heading>Decisions without meetings</heading>

                <p>The Board is taken to have made a decision at a meeting if:</p>

            <paragraph eId="schedule-2__clause-27F__para-a">
              <num>a</num>
              <content>
                <p>without meeting, a majority of the Board members entitled to vote on the proposed decision indicate agreement with the decision; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-27F__para-b">
              <num>b</num>
              <content>
                <p>that agreement is indicated in accordance with the method determined by the Board under subsection (2); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-27F__para-c">
              <num>c</num>
              <content>
                <p>all the Board members were informed of the proposed decision, or reasonable efforts were made to inform all the Board members of the proposed decision.</p>
              </content>
            </paragraph>

                <p>Subsection (1) applies only if the Board:</p>
              </content>
            </hcontainer>

                <p>has determined that it may make decisions of that kind without meeting; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-27F__para-b">

                <p>has determined the method by which Board members are to indicate agreement with proposed decisions.</p>
              </content>
            </paragraph>

                <p>For the purposes of paragraph (1)(a), a Board member is not entitled to vote on a proposed decision if the Board member would not have been entitled to vote on that proposal if the matter had been considered at a meeting of the Board.</p>

                <p>The Board must comply with a direction under subsection (1).</p>
