          <p>		This Act is the <i>Defence </i><i>Legislation</i><i> </i><i>Amendment (Discipline Reform) </i><i>Act</i><i> 2021</i><i>.</i></p>

        <heading>Commencement</heading>
        <subsection eId="sec-2__subsec-1">
          <num>1</num>
          <content>
            <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

            <num>9A</num>
            <heading>Simplified outline of this Part</heading>
            <content>
              <p>A prescribed defence member (a junior officer or lower rank) may elect to be dealt with under the infringement scheme in this Part in relation to a disciplinary infringement if the member has been given an infringement notice in relation to the infringement. By electing, the member is taken to have admitted the infringement for the purposes of being dealt with under the infringement scheme.</p>
              <p>Disciplinary infringements are not service offences. However, if a prescribed defence member has been dealt with under the infringement scheme<b><i> </i></b>in relation to a disciplinary infringement (see subsection 9C(3)), the member is not liable to be tried by a service tribunal for an offence arising out of the infringement.</p>
              <p>Disciplinary infringements are dealt with by discipline officers and senior discipline officers who may decide to:</p>
              <p>Discipline officers may only deal with a contravention of a minor disciplinary infringement provision. Senior discipline officers may deal with a contravention of any disciplinary infringement provision and may impose a higher punishment. There are other limitations on the jurisdiction of a discipline officer or senior discipline officer (see <ref href="#sec-9F">section 9F</ref>).</p>
              <p>A decision by a senior discipline officer to impose a punishment is reviewed by a commanding officer. The commanding officer may confirm the decision or substitute the decision with a decision to impose a reduced punishment or no punishment or to dismiss the infringement with no punishment.</p>

                <p>impose a punishment; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9A__para-b">
              <num>b</num>

                <p>not impose a punishment if the infringement is trivial; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9A__para-c">
              <num>c</num>
              <content>
                <p>dismiss the infringement if the member has a reasonable excuse; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9A__para-d">
              <num>d</num>
              <content>
                <p>decline to deal with the infringement if it is too serious to be dealt with under this Part.</p>
              </content>
            </paragraph>

            <num>9B</num>
            <heading>Object of this Part</heading>
            <content>
              <p>The object of this Part is to provide a means of dealing with minor service discipline matters which:</p>
            </content>
            <paragraph eId="schedule-1__clause-9B__para-a">
              <num>a</num>
              <content>
                <p>is fair and efficient; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9B__para-b">
              <num>b</num>
              <content>
                <p>meets the disciplinary needs of the Defence Force.</p>
              </content>
            </paragraph>

          <hcontainer name="clause" eId="schedule-1__clause-9C">
            <num>9C</num>
            <heading>Election to be dealt with under the infringement scheme</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-9C__subclause-1">
              <num>1</num>
              <content>
                <p>A prescribed defence member may elect to be dealt with under the infringement scheme in relation to a disciplinary infringement if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-9C__para-a">
              <num>a</num>
              <content>
                <p>the member has been given an infringement notice in relation to the infringement; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9C__para-b">
              <num>b</num>
              <content>
                <p>the election is made within the period specified in the infringement notice.</p>
              </content>
            </paragraph>
            <content>
              <p>Note:	If the member elects, the member will be taken to have admitted to committing the disciplinary infringement for the purpose of being dealt with under the infringement scheme: see <ref href="#sec-9E">section 9E</ref>B.</p>
              <p>Note:	If a prescribed defence member has been charged under this Act for an offence arising out of a disciplinary infringement, there is no jurisdiction to deal with the member under the infringement scheme in relation to the infringement: see <ref href="#sec-9F">section 9F</ref>.</p>
              <p>Note:	A discipline officer or senior discipline officer may also make a decision under paragraph 9FB(1)(d) to decline to deal with a disciplinary infringement. In this case, the defence member may be tried by a service tribunal for an offence arising out of the infringement.</p>
            </content>
            <hcontainer name="subclause" eId="schedule-1__clause-9C__subclause-2">
              <num>2</num>
              <content>
                <p>If a prescribed defence member has been dealt with under the infringement scheme in relation to a disciplinary infringement (see subsection (3)), the member is not liable to be tried by a service tribunal for an offence arising out of the infringement.</p>
              </content>

            <hcontainer name="subclause" eId="schedule-1__clause-9C__subclause-3">
              <num>3</num>
              <content>
                <p>	(3)	A prescribed defence member has been dealt with under the infringement scheme<b><i> </i></b>in relation to a disciplinary infringement if a discipline officer or senior discipline officer has made one of the following decisions in relation to the infringement (whether or not the decision has been substituted on review under section 9G):</p>

              <content>
                <p>a decision under paragraph 9FB(1)(a) to impose a punishment;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9C__para-b">
              <num>b</num>
              <content>
                <p>a decision under paragraph 9FB(1)(b) not to impose a punishment;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9C__para-c">
              <num>c</num>
              <content>
                <p>a decision under paragraph 9FB(1)(c) to dismiss the infringement.</p>
              </content>
            </paragraph>

            <num>9CA</num>
            <heading>Prescribed defence member</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-9CA__subclause-1">
              <num>1</num>
              <content>
                <p>	(1)	A <b><i>prescribed defence member</i></b> is:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-9CA__para-a">
              <num>a</num>
              <content>
                <p>in the Navy—a defence member who holds a rank of or below the rank of lieutenant; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9CA__para-b">
              <num>b</num>
              <content>
                <p>in the Army—a defence member who holds a rank of or below the rank of captain; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9CA__para-c">
              <num>c</num>
              <content>
                <p>in the Air Force—a defence member who holds a rank of or below the rank of flight lieutenant;</p>
              </content>
            </paragraph>
            <content>
              <p>but does not include a member covered by a determination in force under subsection (2).</p>
              <p>Subdivision A—Key concepts</p>
            </content>
            <hcontainer name="subclause" eId="schedule-1__clause-9CA__subclause-2">
              <num>2</num>
              <content>
                <p>	(2)	A service chief may, by legislative instrument, determine that any of the following is not a <b><i>prescribed defence member</i></b>:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-9CA__para-a">
              <num>a</num>
              <content>
                <p>a specified defence member, or each member of a specified class of defence members, holding the rank of warrant officer;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9CA__para-b">
              <num>b</num>
              <content>
                <p>a specified defence member, or each member of a specified class of defence members, holding the rank of chief petty officer;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9CA__para-c">
              <num>c</num>
              <content>
                <p>a specified defence member, or each member of a specified class of defence members, holding the rank of flight sergeant.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-9D">
            <num>9D</num>
            <heading>When a disciplinary infringement is committed</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-9D__subclause-1">
              <num>1</num>
              <content>
                <p>	(1)	A <b><i>disciplinary infringement </i></b>is a contravention of a disciplinary infringement provision. If a prescribed defence member contravenes a disciplinary infringement provision, the member commits a disciplinary infringement.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-9D__subclause-2">
              <num>2</num>
              <content>
                <p>	(2)	A provision in Subdivision B or C is a <b><i>disciplinary infringement</i></b><b><i> provision</i></b><i>.</i></p>
              </content>
            </hcontainer>
            <content>
              <p>Note:	For the punishments that may be imposed on a prescribed defence member who commits a disciplinary infringement, see <ref href="#sec-9F">section 9F</ref>B.</p>
              <p>Note:	Discipline officers may only deal with contraventions of minor disciplinary infringement provisions. Senior discipline officers may deal with a contravention of any disciplinary infringement provision: see <ref href="#sec-9F">section 9F</ref>.</p>
              <p>Note:	For the meaning of <b><i>service offence</i></b>, see subsection 3(1).</p>
              <p>Subdivision B—Minor disciplinary infringement provisions</p>
            </content>

                <p>	(3)	A provision in Subdivision B is a <b><i>minor disciplinary infringement</i></b><b><i> provision</i></b>.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-9D__subclause-4">
              <num>4</num>
              <content>
                <p>To avoid doubt, a disciplinary infringement is not a service offence.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-9DA">
            <num>9DA</num>
            <heading>Disciplinary infringement provision—absent from duty</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-9DA__subclause-1">
              <num>1</num>
              <content>
                <p>A prescribed defence member contravenes this subsection if the member:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-9DA__para-a">
              <num>a</num>
              <content>
                <p>is required to attend for duty; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9DA__para-b">
              <num>b</num>
              <content>
                <p>does not attend for the duty.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-9DA__subclause-2">
              <num>2</num>
              <content>
                <p>A prescribed defence member contravenes this subsection if the member:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-9DA__para-a">
              <num>a</num>
              <content>
                <p>is required to perform a duty; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9DA__para-b">
              <num>b</num>
              <content>
                <p>ceases to perform the duty before the member is permitted to do so.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-9DB">
            <num>9DB</num>
            <heading>Disciplinary infringement provision—absent without leave not exceeding 3 hours</heading>
            <content>
              <p>A prescribed defence member contravenes this section if the member:</p>
              <p>Note:	A senior discipline officer may also have jurisdiction to deal with a contravention of the disciplinary infringement provision in <ref href="#sec-9D">section 9D</ref>H which covers absence without leave for a period not exceeding 24 hours.</p>

              <num>a</num>
              <content>
                <p>is absent without leave; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9DB__para-b">
              <num>b</num>

                <p>the absence is for a period not exceeding 3 hours.</p>

            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-9DC">
            <num>9DC</num>
            <heading>Disciplinary infringement provision—disobeying a lawful command</heading>
            <content>
              <p>A prescribed defence member contravenes this section if:</p>
            </content>
            <paragraph eId="schedule-1__clause-9DC__para-a">
              <num>a</num>
              <content>
                <p>a person gives the member a lawful command; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9DC__para-b">
              <num>b</num>
              <content>
                <p>the person giving the command is a superior officer; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9DC__para-c">
              <num>c</num>
              <content>
                <p>the member disobeys the command.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-9DD">
            <num>9DD</num>
            <heading>Disciplinary infringement provision—failing to comply with a general order</heading>
            <content>
              <p>A prescribed defence member contravenes this section if:</p>
            </content>
            <paragraph eId="schedule-1__clause-9DD__para-a">
              <num>a</num>
              <content>
                <p>a lawful general order applies to the member; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9DD__para-b">
              <num>b</num>
              <content>
                <p>the member does not comply with the order.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-9DE">
            <num>9DE</num>
            <heading>Disciplinary infringement provision—member on guard or on watch</heading>
            <content>
              <p>A prescribed defence member contravenes this section if the member is on guard duty or on watch and the member:</p>
              <p>Note:	For the meaning of <b><i>intoxicated</i></b>, see subsection 3(1).</p>
            </content>
            <paragraph eId="schedule-1__clause-9DE__para-a">
              <num>a</num>
              <content>
                <p>sleeps at the member’s post or on watch; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9DE__para-b">
              <num>b</num>
              <content>
                <p>is not on duty at a post but sleeps when the member’s duty requires the member to be awake; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9DE__para-c">
              <num>c</num>
              <content>
                <p>is intoxicated; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9DE__para-d">
              <num>d</num>
              <content>
                <p>leaves the member’s post before being regularly relieved or otherwise absents himself or herself from a place where it is the member’s duty to be.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-9DF">
            <num>9DF</num>
            <heading>Disciplinary infringement provision—failure to perform duty or carry out activity</heading>
            <content>
              <p>A prescribed defence member contravenes this section if:</p>
            </content>
            <paragraph eId="schedule-1__clause-9DF__para-a">
              <num>a</num>
              <content>
                <p>the member’s office or appointment, or the requirements of the Defence Force, require the member to perform a duty or carry out an activity; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9DF__para-b">
              <num>b</num>
              <content>
                <p>the member fails to perform the duty or carry out the activity.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-9DG">
            <num>9DG</num>
            <heading>Disciplinary infringement provision—prejudicial conduct</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-9DG__subclause-1">
              <num>1</num>
              <content>
                <p>A prescribed defence member contravenes this subsection if the member does an act that is likely to prejudice the discipline of, or bring discredit on, the Defence Force.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-9DG__subclause-2">
              <num>2</num>
              <content>
                <p>A prescribed defence member contravenes this subsection if the member:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-9DG__para-a">
              <num>a</num>
              <content>
                <p>omits to perform an act; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9DG__para-b">
              <num>b</num>
              <content>
                <p>the omission is likely to prejudice the discipline of, or bring discredit on, the Defence Force.</p>
              </content>
            </paragraph>
            <content>
              <p>Subdivision C—Disciplinary infringement provisions only within jurisdiction of senior discipline officers</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-9DH">
            <num>9DH</num>
            <heading>Disciplinary infringement provision—absent without leave not exceeding 24 hours</heading>
            <content>
              <p>A prescribed defence member contravenes this section if the member:</p>
              <p>Note:	A senior discipline officer may also have jurisdiction to deal with a contravention of the disciplinary infringement provision in <ref href="#sec-9D">section 9D</ref>B which covers absence without leave for a period not exceeding 3 hours.</p>

              <content>
                <p>is absent without leave; and</p>
              </content>
            </paragraph>

                <p>A prescribed defence member contravenes this subsection if:</p>

                <p>the member engages in conduct; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9DM__para-b">

                <p>the conduct causes, or contributes to, the discharge of a weapon; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9DM__para-c">
              <num>c</num>
              <content>
                <p>the member is negligent as to that result.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-9DM__subclause-2">

              <content>
                <p>For the purposes of paragraph (1)(c), in deciding whether the prescribed defence member is negligent, to the extent that it is required to have regard to the standard of care of a reasonable person to make that decision, regard is to be had to the standard of care that would have been exercised by a reasonable person who:</p>
              </content>

            <paragraph eId="schedule-1__clause-9DM__para-a">
              <num>a</num>
              <content>
                <p>was a defence member with the same training and experience in the Defence Force or other armed force as the prescribed defence member; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9DM__para-b">
              <num>b</num>
              <content>
                <p>was engaged in the conduct in the course of the member’s duty or in accordance with the requirements of the Defence Force, as the case may be.</p>
              </content>
            </paragraph>
          </hcontainer>

            <num>9DN</num>
            <heading>Disciplinary infringement provision—intoxicated while on duty etc.</heading>
            <content>
              <p>A prescribed defence member contravenes this section if:</p>

                <p>the member:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9DO__para-i">
              <num>i</num>

                <p>drives a service vehicle in any place, whether a public place or not; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9DO__para-ii">
              <num>ii</num>
              <content>
                <p>is not authorised to drive that vehicle; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9DO__para-b">
              <num>b</num>
              <content>
                <p>the member uses a service vehicle for an unauthorised purpose.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-9DP">

            <heading>Disciplinary infringement provision—driving without due care or attention etc.</heading>

                <p>the member does so without due care and attention or without reasonable consideration for another person in that place.</p>
              </content>
            </paragraph>

                <p>A prescribed defence member contravenes this subsection if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-9DP__para-a">

                <p>the member drives a vehicle on service land; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9DP__para-b">
              <num>b</num>
              <content>
                <p>the member does so without due care and attention or without reasonable consideration for another person on that land.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-9E">
            <num>9E</num>
            <heading>Infringement officer may give infringement notice</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-9E__subclause-1">
              <num>1</num>
              <content>
                <p>If an infringement officer:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-9E__para-a">
              <num>a</num>
              <content>
                <p>believes, on reasonable grounds, that a prescribed defence member has committed a disciplinary infringement; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9E__para-b">
              <num>b</num>
              <content>
                <p>believes, on reasonable grounds, that the member does not have a reasonable excuse for committing the infringement;</p>
              </content>
            </paragraph>
            <content>
              <p>the infringement officer may give the member an infringement notice in relation to the infringement.</p>
            </content>
            <hcontainer name="subclause" eId="schedule-1__clause-9E__subclause-2">
              <num>2</num>
              <content>
                <p>The infringement notice must be given as soon as is reasonably practicable after the infringement officer first has reasonable grounds for believing that the member has committed the infringement.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-9E__subclause-3">
              <num>3</num>
              <content>
                <p>The infringement notice must:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-9E__para-a">
              <num>a</num>
              <content>
                <p>give particulars of the infringement to which the notice relates; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9E__para-b">
              <num>b</num>
              <content>
                <p>inform the member of the following:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9E__para-i">
              <num>i</num>
              <content>
                <p>the member’s right to elect to be dealt with under the infringement scheme in relation to the infringement;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9E__para-ii">
              <num>ii</num>
              <content>
                <p>that, if the member so elects, the member will be taken to have admitted committing the infringement for the purposes of being dealt with under the infringement scheme in relation to the infringement;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9E__para-iii">
              <num>iii</num>
              <content>
                <p>the period within which the election must be made;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9E__para-iv">
              <num>iv</num>
              <content>
                <p>whether the member will be dealt with by a discipline officer or a senior discipline officer;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9E__para-v">
              <num>v</num>
              <content>
                <p>the penalties that may be imposed by that kind of officer; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9E__para-c">
              <num>c</num>
              <content>
                <p>inform the member that:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9E__para-i">
              <num>i</num>
              <content>
                <p>if the member has been dealt with under the infringement scheme in relation to the disciplinary infringement (see subsection 9C(3)), the member is not liable to be tried by a service tribunal for an offence arising out of the infringement; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9E__para-ii">
              <num>ii</num>
              <content>
                <p>if the member does not so elect, the infringement officer may refer the infringement to an authorized member of the Defence Force for the purposes of <ref href="#sec-87">section 87</ref> so that the authorized member may determine whether there are reasonable grounds to believe that the member has committed a service offence.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-9E__subclause-4">
              <num>4</num>
              <content>
                <p>An infringement notice must be in accordance with a form approved by the Chief of the Defence Force.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-9EA">
            <num>9EA</num>
            <heading>Election may be withdrawn</heading>
            <content>
              <p>A prescribed defence member may, at any time before a decision is made under <ref href="#sec-9F">section 9F</ref>B in relation to a disciplinary infringement, withdraw an election to be dealt with under the infringement scheme in relation to the disciplinary infringement.</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-9EB">
            <num>9EB</num>
            <heading>Member is taken to have admitted the infringement only for the purpose of being dealt with under the infringement scheme</heading>
            <content>
              <p>If a prescribed defence member elects to be dealt with under the infringement scheme in relation to a disciplinary infringement, the member is taken, for the purpose of being so dealt with but for no other purpose, to have admitted committing the infringement.</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-9EC">
            <num>9EC</num>
            <heading>Consequence of no election or withdrawing election</heading>
            <content>
              <p>If a prescribed defence member is given an infringement notice in relation to a disciplinary infringement and:</p>
              <p>an infringement officer may refer the infringement to an authorized member of the Defence Force for the purposes of <ref href="#sec-87">section 87</ref> so that the authorized member may determine whether there are reasonable grounds to believe that the member has committed a service offence.</p>
              <p>Note:	The election may be withdrawn at any time before a decision is made under <ref href="#sec-9F">section 9F</ref>B in relation to the disciplinary infringement: see <ref href="#sec-9E">section 9E</ref>A.</p>
            </content>
            <paragraph eId="schedule-1__clause-9EC__para-a">

                <p>the member does not make an election within the period specified in the notice; or</p>
              </content>
            </paragraph>

                <p>the member has not been charged under this Act with an offence arising out of the infringement; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9F__para-b">

                <p>the member has elected to be dealt with under the infringement scheme in relation to the infringement (see <ref href="#sec-9C">section 9C</ref>); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9F__para-c">
              <num>c</num>
              <content>
                <p>the member has not withdrawn the election; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9F__para-d">
              <num>d</num>
              <content>
                <p>the member is of a kind of prescribed defence member specified in the officer’s instrument of appointment (see <ref href="#sec-9H">section 9H</ref>); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9F__para-e">
              <num>e</num>
              <content>
                <p>the member:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9F__para-i">
              <num>i</num>
              <content>
                <p>holds the rank of officer cadet; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9F__para-ii">
              <num>ii</num>
              <content>
                <p>if the member is a junior officer—is at least one rank junior to the discipline officer; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9F__para-iii">
              <num>iii</num>
              <content>
                <p>otherwise—is at least 2 ranks junior to the officer; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9F__para-f">
              <num>f</num>
              <content>
                <p>the infringement is:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9F__para-i">
              <num>i</num>
              <content>
                <p>a contravention of a minor disciplinary infringement provision; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9F__para-ii">
              <num>ii</num>
              <content>
                <p>of a kind specified in the officer’s instrument of appointment (see <ref href="#sec-9H">section 9H</ref>).</p>
              </content>
            </paragraph>

              <content>
                <p>A senior discipline officer has jurisdiction to deal with a prescribed defence member under the infringement scheme in relation to a disciplinary infringement if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-9F__para-a">
              <num>a</num>
              <content>
                <p>the member has not been charged under this Act with an offence arising out of the infringement; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9F__para-b">
              <num>b</num>
              <content>
                <p>the member has elected to be dealt with under the infringement scheme in relation to the infringement (see <ref href="#sec-9C">section 9C</ref>); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9F__para-c">
              <num>c</num>
              <content>
                <p>the member has not withdrawn the election; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9F__para-d">
              <num>d</num>
              <content>
                <p>the member is of a kind of prescribed defence member specified in the officer’s instrument of appointment (see <ref href="#sec-9H">section 9H</ref>); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9F__para-e">
              <num>e</num>
              <content>
                <p>the member is at least one rank junior to the officer; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9F__para-f">
              <num>f</num>
              <content>
                <p>the infringement is of a kind specified in the officer’s instrument of appointment (see <ref href="#sec-9H">section 9H</ref>).</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-9F__subclause-3">
              <num>3</num>
              <content>
                <p>To avoid doubt, the exercise of jurisdiction by a discipline officer or senior discipline officer under this Part is not the exercise of jurisdiction by a service tribunal.</p>

          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-9FA">
            <num>9FA</num>
            <heading>Procedure in dealing with disciplinary infringements</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-9FA__subclause-1">
              <num>1</num>
              <content>
                <p>Subject to this section, the procedure followed by a discipline officer or a senior discipline officer in dealing with a prescribed defence member under the disciplinary infringement scheme in relation to a disciplinary infringement is to be in accordance with any requirements specified by the Chief of the Defence Force.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-9FA__subclause-2">
              <num>2</num>
              <content>
                <p>The Chief of the Defence Force may, by legislative instrument, specify requirements for the purpose of subsection (1).</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-9FA__subclause-3">
              <num>3</num>
              <content>
                <p>The prescribed defence member is not to be represented before the discipline officer or senior discipline officer.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-9FA__subclause-4">
              <num>4</num>
              <content>
                <p>The prescribed defence member may, when the member appears before the discipline officer or senior discipline officer, call witnesses and present evidence in relation to anything relevant to the exercise of the officer’s powers under <ref href="#sec-9F">section 9F</ref>B.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-9FB">
            <num>9FB</num>
            <heading>Decisions that may be made by discipline officers or senior discipline officers in dealing with disciplinary infringements</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-9FB__subclause-1">
              <num>1</num>
              <content>
                <p>A discipline officer or senior discipline officer, in dealing with a prescribed defence member under the infringement scheme in relation to a disciplinary infringement, may decide:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-9FB__para-a">
              <num>a</num>
              <content>
                <p>to impose a punishment on the member in accordance with subsection (2); or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9FB__para-b">
              <num>b</num>
              <content>
                <p>if the officer considers that the infringement is trivial—not to impose a punishment on the member; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9FB__para-c">
              <num>c</num>
              <content>
                <p>if the officer considers that the member has a reasonable excuse for committing the infringement—to dismiss the infringement; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9FB__para-d">
              <num>d</num>
              <content>
                <p>if the officer considers that the infringement is too serious to be dealt with under this Part—to decline to deal with the infringement.</p>
              </content>
            </paragraph>
            <content>
              <p>Note 1:	If a decision under paragraph (a), (b) or (c) is made the member cannot be tried by a service tribunal for an offence arising out of the infringement, see subsections 9C(2) and (3).</p>
              <p>Note 2:	If a decision is made under paragraph (d) to decline to deal with the member, the member may be tried by a service tribunal for an offence arising out of the infringement.</p>

                <p>A decision by a discipline officer or senior discipline officer to impose a punishment takes effect:</p>

                <p>if the punishment is imposed for a period—from the start of the period specified in the decision, which must be a period starting on a day not later than 14 days after the decision is made; or</p>

                <p>in any other case—at the time the decision is made.</p>

            <heading>Command review of decisions of senior discipline officers</heading>

                <p>A commanding officer must review a decision by a senior discipline officer under paragraph 9FB(1)(a) to impose a punishment on a prescribed defence member in relation to a disciplinary infringement.</p>
              </content>

                <p>As soon as practicable after the decision is made by the senior discipline officer, the commanding officer must make one of the following decisions:</p>

              <content>
                <p>a decision to confirm the senior discipline officer’s decision to impose the punishment;</p>
              </content>
            </paragraph>

                <p>a decision to substitute the senior discipline officer’s decision with a decision that:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9G__para-i">

                <p>a reduced punishment is imposed; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9G__para-ii">

                <p>A commanding officer may, by instrument in writing, appoint defence members who hold any of the following ranks to be senior discipline officers:</p>

              <num>a</num>
              <content>
                <p>in any case—a rank of or above lieutenant commander, major or squadron leader;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9H__para-b">
              <num>b</num>
              <content>
                <p>if the commanding officer is a lieutenant commander, major or squadron leader—a rank of lieutenant in the Navy, captain in the Army or flight lieutenant.</p>
              </content>
            </paragraph>

                <p>	(5)	A member appointed under subsection (4) is a <b><i>senior</i></b> <b><i>discipline officer</i></b>.</p>

            <heading>Consequences of punishments</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-9J__subclause-1">
              <num>1</num>

                <p>The Chief of the Defence Force or a service chief may, by legislative instrument, make rules with respect to the consequences, in relation to a prescribed defence member, that are to flow from the imposition under this Part on that member of any of the following punishments:</p>
              </content>
            </hcontainer>

              <num>a</num>
              <content>
                <p>restriction of privileges;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9J__para-b">
              <num>b</num>

                <p>stoppage of leave;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9J__para-c">
              <num>c</num>
              <content>
                <p>extra duties;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9J__para-d">
              <num>d</num>
              <content>
                <p>extra drill.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-9J__subclause-2">
              <num>2</num>
              <content>
                <p>The commanding officer of a prescribed defence member who is subject to a punishment referred to in paragraph (1)(a) or (c) may moderate the consequences of that punishment in relation to the member in such manner as the commanding officer considers appropriate, having regard to the particular circumstances of the case and to any directions, in writing, of the Chief of the Defence Force or a service chief.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-9J__subclause-3">
              <num>3</num>

                <p>A direction made under subsection (2) is not a legislative instrument.</p>
              </content>
            </hcontainer>

                <p>Even if a prescribed defence member is subject to a punishment of stoppage of leave, the commanding officer of the member may, if satisfied that it is appropriate to do so, grant leave of absence to the member.</p>

            <num>9JA</num>
            <heading>Monthly report by discipline officers and senior discipline officers</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-9JA__subclause-1">
              <num>1</num>

                <p>As soon as practicable after the end of each month, each discipline officer and senior discipline officer must give a report in accordance with subsection (2) to the officer’s commanding officer.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-9JA__subclause-2">
              <num>2</num>
              <content>
                <p>The report must be in writing and must contain in relation to each disciplinary infringement dealt with by the officer under this Part in the month:</p>
              </content>

                <p>the name of the prescribed defence member; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9JA__para-b">
              <num>b</num>

                <p>the nature of the disciplinary infringement; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9JA__para-c">
              <num>c</num>
              <content>
                <p>the decision made under subsection 9FB(1).</p>
              </content>
            </paragraph>

              <p><b><i>junior officer</i></b> means a defence member who is an officer (other than an officer cadet) who holds:</p>
              <p><b><i>minor disciplinary infringement</i></b><b> </b><b><i>provision </i></b>has the meaning given by subsection 9D(3).</p>
              <p><b><i>officer cadet</i></b> means a defence member who holds a rank of:</p>
