          <p>		This Act is the <i>Higher Education Legislation Amendment (Provider Category Standards and Other Measures) Act 2021.</i></p>

          <num>1</num>

            <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

          <p>Legislation that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.</p>

                <p>other standards against which the quality of higher education can be assessed.</p>

            </paragraph>

            <heading>Quality of research</heading>

              <content>
                <p>If TEQSA is considering the Threshold Standards, to the extent they relate to research, in relation to:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-59A__para-a">
              <num>a</num>
              <content>
                <p>a regulated entity that has applied under <ref href="#sec-18">section 18</ref> to TEQSA for registration within the “Australian University” provider category; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-59A__para-b">
              <num>b</num>
              <content>
                <p>a registered higher education provider that has applied under <ref href="#sec-38">section 38</ref> to change to the “Australian University” provider category; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-59A__para-c">
              <num>c</num>
              <content>
                <p>a registered higher education provider that is in the “Australian University” provider category;</p>
              </content>
            </paragraph>
            <content>
              <p>TEQSA must have regard to the quality of the research undertaken by the entity or provider.</p>
              <p>Matters relating to the quality of research</p>
            </content>
            <hcontainer name="subclause" eId="schedule-1__clause-59A__subclause-2">
              <num>2</num>
              <content>
                <p>In doing so, if an instrument is in force under subsection (7), TEQSA must have regard to the matters determined in the instrument.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-59A__subclause-3">
              <num>3</num>
              <content>
                <p>Subsection (2) does not limit the matters to which TEQSA may have regard.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-59A__subclause-4">
              <num>4</num>
              <content>
                <p>TEQSA may, in writing, determine matters relating to the quality of research for the purposes of this section.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-59A__subclause-5">
              <num>5</num>
              <content>
                <p>A determination under subsection (4) has no effect unless <role refersTo="#minister">the Minister</role> has approved it in writing.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-59A__subclause-6">
              <num>6</num>
              <content>
                <p>TEQSA must give <role refersTo="#minister">the Minister</role> such information as <role refersTo="#minister">the Minister</role> reasonably requires for the purposes of approving the determination.</p>

                <p>in relation to an entity that is a former registered higher education provider, means a document, or an object, in any form (including any electronic form) that was held by the entity when the entity was a registered higher education provider because of the document’s or object’s connection with a person who was enrolled in an accredited course provided by the entity.</p>

            <heading>Provision of higher education student records to another registered higher education provider</heading>
            <content>
              <p>If:</p>
              <p>then:</p>

                <p>	(a)	a person (the <b><i>student</i></b>) is enrolled in an accredited course provided by an entity (the <b><i>first entity</i></b>) that is a registered higher education provider; and</p>

              <content>
                <p>	(b)	the student transfers to another registered higher education provider (the <b><i>second entity</i></b>);</p>

                <p>the student may request the first entity to provide to the second entity a copy of the higher education student records relating to the student; or</p>
              </content>
            </paragraph>

                <p>the second entity may request, in writing, the first entity to provide to the second entity a copy of the higher education student records relating to the student.</p>
              </content>
            </paragraph>
          </hcontainer>

            <num>197AD</num>
            <heading>TEQSA’s management of higher education student records</heading>
            <content>
              <p>TEQSA may provide a copy of a higher education student record it holds to a registered higher education provider if:</p>
            </content>
            <paragraph eId="schedule-1__clause-197AD__para-a">
              <num>a</num>
              <content>
                <p>the person to whom the record relates has enrolled, or is seeking to enrol, in an accredited course provided by the provider and the person requests TEQSA, in writing, to provide the copy; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-197AD__para-b">
              <num>b</num>
              <content>
                <p>with the consent of the person to whom the record relates, the provider requests TEQSA, in writing, to provide the copy because that person has enrolled, or is seeking to enrol, in an accredited course provided by the provider.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-197AE">
            <num>197AE</num>
            <heading>Compensation</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-197AE__subclause-1">
              <num>1</num>
              <content>
                <p>If the operation of <ref href="#sec-197A">section 197A</ref>A would result in an acquisition of property from a person otherwise than on just terms, the Commonwealth is liable to pay a reasonable amount of compensation to the person.</p>
              </content>

                <p>a word or expression, that has the same or a similar meaning to the word “university” and that is determined in an instrument under subsection (3), in the domain name; and</p>

                <p>where the domain name includes an Australian top-level domain;</p>
              </content>
            </paragraph>

              <p>unless there is an approval in force under subsection (4) in relation to the person’s use of that domain name.</p>

                <p>no licence for the use of that domain name had been issued before that commencement to the licensee of the licence referred to in paragraph (a).</p>

                <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, determine words or expressions for the purposes of subparagraph (1)(a)(ii).</p>

                <p><role refersTo="#minister">The Minister</role> must give a copy of the approval to:</p>

                <p>the person; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-204A__para-b">

                <p>the licensor that issues licences for the use of a domain name to which paragraphs (1)(a) and (b) apply.</p>

            </paragraph>

                <p>An approval under subsection (4) comes into force at the time it is given.</p>

                <p>If a person makes an application for an approval and <role refersTo="#minister">the Minister</role> refuses to give the approval, <role refersTo="#minister">the Minister</role> must give written notice of the refusal and of the reasons for the refusal to:</p>

                <p>the person; and</p>

            </paragraph>

                <p>In deciding whether or not to give an approval under subsection (4), <role refersTo="#minister">the Minister</role> must have regard to:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-204A__para-a">
              <num>a</num>
              <content>
                <p>whether the person is a registered higher education provider; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-204A__para-b">

                <p>the matters determined in an instrument under subsection (10).</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-204A__subclause-9">

                <p>Subsection (8) does not limit the matters to which <role refersTo="#minister">the Minister</role> may have regard.</p>
