                <p>It is a condition of the ongoing fee arrangement that the arrangement terminates if any of the following provisions have not been complied with in relation to the arrangement, whether by the current or a previous fee recipient:</p>

                <p><ref href="#sec-962R">section 962R</ref> (fee recipient must not deduct ongoing fees without consent);</p>
              </content>
            </paragraph>

              <num>b</num>
              <content>
                <p><ref href="#sec-962S">section 962S</ref> (fee recipient must not arrange for deduction of ongoing fees without consent or accept such deductions).</p>
              </content>
            </paragraph>
            <content>
              <p>Note:	A Court may order that the fee recipient refund amounts deducted without consent (see <ref href="#sec-1317G">section 1317G</ref>B).</p>
            </content>

                <p>The client is not taken to have waived the client’s rights under the condition (subject to subsection (3)), or to have entered into a new ongoing fee arrangement, if the client gives consent under Subdivision C, in relation to the deduction of ongoing fees relating to the ongoing fee arrangement, after a failure to comply with a provision referred to in subsection (1) in relation to the ongoing fee arrangement.</p>

            <heading>Section 962G (heading)</heading>

              <p>Repeal the subsection, substitute:</p>

                <p>The current fee recipient in relation to an ongoing fee arrangement must, no later than 60 days after the anniversary day for the arrangement in each year, give the client a fee disclosure statement for the arrangement and the anniversary day.</p>
              </content>

            <heading>At the end of section 962G</heading>

              <p>Note:	Section 1673C provides a modified meaning of <b><i>anniversary day</i></b> in relation to ongoing fee arrangements in force before 1 July 2021.</p>
              <p>Civil penalty</p>
              <p>Note:	This subsection is a civil penalty provision (see <ref href="#sec-1317E">section 1317E</ref>).</p>

                <p>	(3)	<b><i>Anniversary day</i></b>, for an ongoing fee arrangement, means the anniversary of the day on which the arrangement was entered into.</p>

                <p>A person contravenes this subsection if the person contravenes subsection (1).</p>

              <p>Repeal the subsection, substitute:</p>

                <p>includes the information and statements required under this section; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-11__para-b">
              <num>b</num>

                <p>relates to:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-11__para-i">
              <num>i</num>
              <content>
                <p>	(i)	the period of 12 months (the <b><i>previous year</i></b>) ending immediately before the anniversary day; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-11__para-ii">
              <num>ii</num>
              <content>
                <p>	(ii)	the period of 12 months (the <b><i>upcoming year</i></b>) starting on the anniversary day.</p>
              </content>
            </paragraph>

                <p>A fee disclosure statement may also include other information.</p>
              </content>

                <p>The fee disclosure statement must include the following information relating to the upcoming year, subject to subsection (3):</p>
              </content>

              <num>a</num>
              <content>
                <p>the amount of each ongoing fee that the client will be required to pay under the arrangement during the upcoming year;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-16__para-b">
              <num>b</num>
              <content>
                <p>information about the services that the client will be entitled to receive under the arrangement during the upcoming year;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-16__para-c">
              <num>c</num>
              <content>
                <p>if the client will be required to pay under the arrangement an ongoing fee after the end of the upcoming year for a service referred to in paragraph (b)—the amount of any such ongoing fee;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-16__para-d">
              <num>d</num>

                <p>information about any other prescribed matters.</p>
              </content>
            </paragraph>

                <p>If an amount of an ongoing fee that is required to be included in a fee disclosure statement under subsection (2A) cannot be determined at the time of preparing the statement, the statement must include a reasonable estimate of the amount of the ongoing fee and an explanation of the method used to work out the estimate.</p>

                <p>The fee disclosure statement must include:</p>

                <p>a statement that the client may renew the ongoing fee arrangement by giving the current fee recipient notice in writing of the election; and</p>
              </content>
            </paragraph>

                <p>a statement that the arrangement will terminate, and no further advice will be provided or fee charged under it, if the client does not elect to renew the arrangement; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-16__para-c">
              <num>c</num>
              <content>
                <p>a statement that the client will be taken to have elected not to renew the arrangement if the client does not give the current fee recipient notice in writing of an election to renew before the end of the renewal period; and</p>
              </content>

                <p>a statement that the renewal period is a period of 120 days beginning on the anniversary day.</p>

                <p>This section applies if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-962R__para-a">
              <num>a</num>
              <content>
                <p>an ongoing fee is, or will be, payable to a fee recipient under an ongoing fee arrangement; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-962R__para-b">
              <num>b</num>
              <content>
                <p>	(b)	a person (the <b><i>account holder</i></b>) holds an account with the fee recipient; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-962R__para-c">
              <num>c</num>
              <content>
                <p>the account is not:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-962R__para-i">
              <num>i</num>
              <content>
                <p>an account linked to a credit card; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-962R__para-ii">
              <num>ii</num>
              <content>
                <p>a basic deposit product; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-962R__para-d">
              <num>d</num>
              <content>
                <p>the fee recipient proposes to deduct the amount of the ongoing fee from the account holder’s account.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-962R__subclause-2">
              <num>2</num>
              <content>
                <p>Subject to subsection (3), the fee recipient must not deduct the amount of the ongoing fee from the account unless all of the following are satisfied:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-962R__para-a">
              <num>a</num>
              <content>
                <p>the account holder has given the fee recipient written consent for the fee recipient to deduct amounts from the account in respect of ongoing fees under the ongoing fee arrangement;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-962R__para-b">
              <num>b</num>
              <content>
                <p>if requirements that apply in relation to the consent are determined under <ref href="#sec-962T">section 962T</ref>—the consent complies with those requirements;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-962R__para-c">
              <num>c</num>
              <content>
                <p>at the time of making the deduction:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-962R__para-i">
              <num>i</num>
              <content>
                <p>the consent has not been withdrawn under paragraph 962U(1)(a); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-962R__para-ii">
              <num>ii</num>
              <content>
                <p>if the consent has been varied under paragraph 962U(1)(b)—the consent as varied still allows for the deduction to be made; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-962R__para-iii">
              <num>iii</num>
              <content>
                <p>the consent has not ceased to have effect under <ref href="#sec-962V">section 962V</ref>.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-962R__subclause-3">
              <num>3</num>
              <content>
                <p>If the account holder holds the account jointly with one or more other persons, the fee recipient must not deduct the amount of the ongoing fee from the account unless all of the paragraphs in subsection (2) are satisfied in relation to the account holder as well as each of those other persons as account holders.</p>
              </content>

                <p>an ongoing fee is, or will be, payable to a fee recipient under an ongoing fee arrangement; and</p>

            </paragraph>
            <paragraph eId="schedule-1__clause-962S__para-b">
              <num>b</num>
              <content>
                <p>	(b)	a person (the <b><i>account holder</i></b>) holds an account with another person (the <b><i>account provider</i></b>) who is not the fee recipient; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-962S__para-c">
              <num>c</num>
              <content>
                <p>the account is not:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-962S__para-i">
              <num>i</num>
              <content>
                <p>an account linked to a credit card; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-962S__para-ii">
              <num>ii</num>
              <content>
                <p>a basic deposit product; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-962S__para-d">
              <num>d</num>
              <content>
                <p>the fee recipient proposes to arrange with the account provider for the amount of the ongoing fee to be deducted from the account holder’s account.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-962S__subclause-2">
              <num>2</num>
              <content>
                <p>To avoid doubt, the fee recipient proposes to arrange with the account provider for the amount of the ongoing fee to be deducted from the account holder’s account:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-962S__para-a">
              <num>a</num>
              <content>
                <p>if the fee recipient is a financial services licensee—by doing so directly or through another entity such as a representative of the financial services licensee; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-962S__para-b">
              <num>b</num>
              <content>
                <p>if the fee recipient is a representative of a financial services licensee—by doing so directly or through another entity such as the financial services licensee.</p>
              </content>
            </paragraph>
            <content>
              <p>Fee recipient must not arrange deductions without consent</p>

                <p>Subject to subsection (4), the fee recipient must not arrange for the account provider to deduct the amount from the account unless all of the following are satisfied:</p>

              <num>a</num>
              <content>
                <p>the account holder has given the fee recipient written consent for the fee recipient to arrange for amounts to be deducted from the account in respect of ongoing fees under the ongoing fee arrangement;</p>

              <num>b</num>
              <content>
                <p>if requirements that apply in relation to the consent are determined under <ref href="#sec-962T">section 962T</ref>—the consent complies with those requirements;</p>
              </content>
            </paragraph>

              <num>c</num>
              <content>
                <p>the fee recipient has given a copy of the account holder’s consent to the account provider;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-962S__para-d">
              <num>d</num>
              <content>
                <p>at the time of giving the copy of the consent to the account provider:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-962S__para-i">
              <num>i</num>
              <content>
                <p>the consent has not been withdrawn under paragraph 962U(1)(a); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-962S__para-ii">
              <num>ii</num>
              <content>
                <p>if the consent has been varied under paragraph 962U(1)(b)—the consent as varied still allows for the deduction to be made; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-962S__para-iii">
              <num>iii</num>
              <content>
                <p>the consent has not ceased to have effect under <ref href="#sec-962V">section 962V</ref>.</p>
              </content>
            </paragraph>

                <p>If the account holder holds the account jointly with one or more other persons, the fee recipient must not arrange for deductions from the account unless all of the paragraphs in subsection (3) are satisfied in relation to the account holder as well as each of those other persons as account holders.</p>

                <p>A person contravenes this subsection if the person contravenes subsection (3) or (4).</p>

                <p>Subject to subsection (7), if the fee recipient has arranged with the account provider, with the account holder’s consent, for an amount to be deducted from the account, the fee recipient must not accept payment of the amount unless at the time the payment is made to the fee recipient all of the following are satisfied:</p>

                <p>However, subsection (8) does not apply if an amount accepted in contravention of subsection (6) or (7) is repaid into the account holder’s account within 10 business days of the day on which the payment was accepted.</p>

            <heading>Requirements relating to consent</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-962T__subclause-1">

                <p>ASIC may, by legislative instrument, determine requirements for the giving of consent to deductions from an account for the purposes of this Subdivision.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-962T__subclause-2">
              <num>2</num>
              <content>
                <p>Without limiting subsection (1), the instrument may require that:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-962T__para-a">
              <num>a</num>
              <content>
                <p>a specified form, or specified form of words, must be used for giving consent; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-962T__para-b">
              <num>b</num>
              <content>
                <p>a consent must include specified information.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-962U">
            <num>962U</num>
            <heading>Variation or withdrawal of consent</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-962U__subclause-1">
              <num>1</num>
              <content>
                <p>	(1)	If a person (the <b><i>account holder</i></b>) who holds an account gives consent to a fee recipient under section 962R or 962S for the purposes of this Subdivision, the account holder may:</p>

              <num>a</num>
              <content>
                <p>withdraw the consent at any time, by notice in writing to the fee recipient; and</p>
              </content>
            </paragraph>

              <num>b</num>
              <content>
                <p>vary the consent at any time, by notice in writing to the fee recipient.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-962U__subclause-2">
              <num>2</num>
              <content>
                <p>If the fee recipient receives a notice from the account holder under subsection (1), the fee recipient must within 10 business days of receipt:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-962U__para-a">
              <num>a</num>
              <content>
                <p>give written confirmation to the account holder that the notice was received; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-962U__para-b">
              <num>b</num>
              <content>
                <p>if the fee recipient gave a copy of the account holder’s consent to an account provider under paragraph 962S(3)(c)—give the account provider a copy of the notice.</p>
              </content>
            </paragraph>

                <p>A person contravenes this subsection if the person contravenes subsection (2).</p>

            <heading>When consent ceases to have effect</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-962V__subclause-1">

                <p>A consent given in relation to an ongoing fee arrangement for the purposes of this Subdivision ceases to have effect:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-962V__para-a">
              <num>a</num>
              <content>
                <p>unless paragraph (b) or (c) applies—at the end of the period of 150 days after the anniversary day for the ongoing fee arrangement; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-962V__para-b">
              <num>b</num>
              <content>
                <p>if the ongoing fee arrangement is terminated—at the time the ongoing fee arrangement terminates; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-962V__para-c">
              <num>c</num>
              <content>
                <p>if a new consent is given in relation to the ongoing fee arrangement for the purposes of this Subdivision—at the time that new consent is given.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-962V__subclause-2">
              <num>2</num>
              <content>
                <p>If:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-962V__para-a">
              <num>a</num>
              <content>
                <p>a consent given in relation to an ongoing fee arrangement for the purposes of this Subdivision ceases to have effect under subsection (1); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-962V__para-b">
              <num>b</num>
              <content>
                <p>a fee recipient gave a copy of the consent to an account provider under paragraph 962S(3)(c);</p>
              </content>
            </paragraph>
            <content>
              <p>the fee recipient must give written notice of the cessation to the account provider within 10 business days of the cessation.</p>

                <p>A person contravenes this subsection if the person contravenes subsection (2).</p>

            <heading>Conditions requiring consent to be given are void</heading>
            <content>
              <p>Any condition of the ongoing fee arrangement, or any other arrangement, that requires the client to do either or both of the following is void:</p>

                <p>to give consent under this Subdivision in relation to the deduction of ongoing fees relating to the ongoing fee arrangement;</p>

                <p>not to vary or withdraw such consent.</p>
              </content>
            </paragraph>
          </hcontainer>

            <heading>Obligation to keep records of compliance</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-962X__subclause-1">
              <num>1</num>
              <content>
                <p>A fee recipient in relation to an ongoing fee arrangement must keep records sufficient to enable the fee recipient’s compliance with this Division in relation to the ongoing fee arrangement to be readily ascertained.</p>
              </content>
            </hcontainer>

                <p>	(a)	deducts an amount of an ongoing fee payable under an ongoing fee arrangement from an account held by a person (the <b><i>account holder</i></b>) with the fee recipient; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-1317GB__para-b">
              <num>b</num>
              <content>
                <p>	(b)	accepts payment of the amount of the ongoing fee that has been deducted from an account held by a person (the <b><i>account holder</i></b>) with another person (the <b><i>account provider</i></b>) under an arrangement the fee recipient made with the account provider.</p>
              </content>
            </paragraph>

                <p>A Court may order that the fee recipient refund the amount if the Court is satisfied that:</p>

                <p>if paragraph (1)(a) applies—the fee recipient knowingly or recklessly contravened <ref href="#sec-962R">section 962R</ref> (fee recipient must not deduct ongoing fees without consent) in deducting the amount; or</p>
