          <p>		This Act is the <i>Fair Work Amendment (Supporting Australia’s </i><i>Jobs and Economic Recovery) Act 2021.</i></p>

        <heading>Commencement</heading>
        <subsection eId="sec-2__subsec-1">
          <num>1</num>
          <content>
            <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

        <heading>Schedules</heading>
        <content>
          <p>Legislation that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.</p>
        </content>
      </section>
      <section eId="sec-4">
        <num>4</num>
        <heading>Review of operation of amendments</heading>
        <subsection eId="sec-4__subsec-1">
          <num>1</num>
          <content>
            <p><role refersTo="#minister">The Minister</role> must cause a review to be conducted of the operation of the amendments made by this Act.</p>
          </content>
        </subsection>
        <subsection eId="sec-4__subsec-2">
          <num>2</num>
          <content>
            <p>Without limiting the matters that may be considered when conducting the review, the review must:</p>
          </content>
          <paragraph eId="sec-4__subsec-2__para-a">
            <num>a</num>
            <content>
              <p>consider whether the operation of the amendments made by this Act is appropriate and effective in the context of Australia’s changing employment and economic conditions; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-4__subsec-2__para-b">
            <num>b</num>
            <content>
              <p>identify any unintended consequences of the amendments made by this Act; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-4__subsec-2__para-c">
            <num>c</num>
            <content>
              <p>	(c)	consider whether amendments to the <i>Fair Work Act 2009 </i>and the <i>Fair Work (Transitional Provisions and Consequential Amendments) Act 2009</i>, or any other legislation, are necessary to:</p>
            </content>
          </paragraph>
          <paragraph eId="sec-4__subsec-2__para-i">
            <num>i</num>
            <content>
              <p>improve the operation of the amendments made by this Act under paragraph (a); or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-4__subsec-2__para-ii">
            <num>ii</num>
            <content>
              <p>rectify any unintended consequences identified under paragraph (b).</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-4__subsec-3">
          <num>3</num>
          <content>
            <p>The review must start as soon as practicable after the end of 12 months after this section commences.</p>
          </content>
        </subsection>
        <subsection eId="sec-4__subsec-4">
          <num>4</num>
          <content>
            <p>The persons who conduct the review must give the Minister a written report of the review <quantity refersTo="#deadline">within 6 months</quantity> of the commencement of the review.</p>
          </content>
        </subsection>
        <subsection eId="sec-4__subsec-5">
          <num>5</num>
          <content>
            <p><role refersTo="#minister">The Minister</role> must cause a copy of the report of the review to be tabled in each House of the Parliament within 15 sitting days of that House after <role refersTo="#minister">the Minister</role> receives the report.</p>
          </content>

            <heading>Meaning of casual employee</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-15A__subclause-1">
              <num>1</num>
              <content>
                <p>	(1)	A person is a <b><i>casual employee</i></b> of an employer if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-15A__para-a">
              <num>a</num>
              <content>
                <p>an offer of employment made by the employer to the person is made on the basis that the employer makes no firm advance commitment to continuing and indefinite work according to an agreed pattern of work for the person; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-15A__para-b">
              <num>b</num>
              <content>
                <p>the person accepts the offer on that basis; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-15A__para-c">
              <num>c</num>
              <content>
                <p>the person is an employee as a result of that acceptance.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-15A__subclause-2">
              <num>2</num>
              <content>
                <p>For the purposes of subsection (1), in determining whether, at the time the offer is made, the employer makes no firm advance commitment to continuing and indefinite work according to an agreed pattern of work for the person, regard must be had only to the following considerations:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-15A__para-a">
              <num>a</num>
              <content>
                <p>whether the employer can elect to offer work and whether the person can elect to accept or reject work;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-15A__para-b">
              <num>b</num>
              <content>
                <p>whether the person will work as required according to the needs of the employer;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-15A__para-c">
              <num>c</num>
              <content>
                <p>whether the employment is described as casual employment;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-15A__para-d">
              <num>d</num>
              <content>
                <p>whether the person will be entitled to a casual loading or a specific rate of pay for casual employees under the terms of the offer or a fair work instrument.</p>
              </content>
            </paragraph>
            <content>
              <p>Note:	Under <ref href="#dvs-4A">Division 4A</ref> of <ref href="#part-2">Part 2</ref>-2, a casual employee who has worked for an employer for at least 12 months and has, during at least the last 6 months of that time, worked a regular pattern of hours on an ongoing basis may be entitled to be offered, or request, conversion to full-time employment or part-time employment.</p>
            </content>

              <num>3</num>
              <content>
                <p>To avoid doubt, a regular pattern of hours does not of itself indicate a firm advance commitment to continuing and indefinite work according to an agreed pattern of work.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-15A__subclause-4">
              <num>4</num>
              <content>
                <p>To avoid doubt, the question of whether a person is a casual employee of an employer is to be assessed on the basis of the offer of employment and the acceptance of that offer, not on the basis of any subsequent conduct of either party.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-15A__subclause-5">
              <num>5</num>
              <content>
                <p>	(5)	A person who commences employment as a result of acceptance of an offer of employment in accordance with subsection (1) remains a <b><i>casual employee</i></b> of the employer until:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-15A__para-a">
              <num>a</num>
              <content>
                <p>the employee’s employment is converted to full-time or part-time employment under <ref href="#dvs-4A">Division 4A</ref> of <ref href="#part-2">Part 2</ref>-2; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-15A__para-b">
              <num>b</num>
              <content>
                <p>the employee accepts an alternative offer of employment (other than as a casual employee) by the employer and commences work on that basis.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-3">
            <num>3</num>
            <heading>After Division 4 of Part 2-2</heading>
            <content>
              <p>Insert:</p>
              <p>Subdivision A—Application of Division</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-66A">
            <num>66A</num>
            <heading>Division applies to casual employees etc.</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-66A__subclause-1">
              <num>1</num>
              <content>
                <p>This Division applies in relation to an employee who is a casual employee.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-66A__subclause-2">
              <num>2</num>
              <content>
                <p>A reference in this Division to full-time employment or part-time employment is taken not to include employment for a specified period of time, for a specified task or for the duration of a specified season.</p>
              </content>
            </hcontainer>
            <content>
              <p>Subdivision B—Employer offers for casual conversion</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-66AA">
            <num>66AA</num>
            <heading>Subdivision does not apply to small business employers</heading>
            <content>
              <p>This Subdivision does not apply in relation to an employer that is a small business employer.</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-66B">
            <num>66B</num>
            <heading>Employer offers</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-66B__subclause-1">
              <num>1</num>
              <content>
                <p>Subject to <ref href="#sec-66C">section 66C</ref>, an employer must make an offer to a casual employee under this section if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-66B__para-a">
              <num>a</num>
              <content>
                <p>the employee has been employed by the employer for a period of 12 months beginning the day the employment started; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66B__para-b">
              <num>b</num>
              <content>
                <p>during at least the last 6 months of that period, the employee has worked a regular pattern of hours on an ongoing basis which, without significant adjustment, the employee could continue to work as a full-time employee or a part-time employee (as the case may be).</p>
              </content>
            </paragraph>
            <content>
              <p>Note:	An employee who meets the requirements of paragraphs (a) and (b) would also be a regular casual employee because the employee has been employed by the employer on a regular and systematic basis.</p>
              <p>Note:	If an offer is accepted, the conversion to full-time employment or part-time employment has effect for all purposes (see <i>).</i><ref href="#sec-66K">section 66K</ref></p>
            </content>
            <hcontainer name="subclause" eId="schedule-1__clause-66B__subclause-2">
              <num>2</num>
              <content>
                <p>The offer must:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-66B__para-a">
              <num>a</num>
              <content>
                <p>be in writing; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66B__para-b">
              <num>b</num>
              <content>
                <p>be an offer for the employee to convert:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66B__para-i">
              <num>i</num>
              <content>
                <p>for an employee that has worked the equivalent of full-time hours during the period referred to in paragraph (1)(b)—to full-time employment; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66B__para-ii">
              <num>ii</num>
              <content>
                <p>for an employee that has worked less than the equivalent of full-time hours during the period referred to in paragraph (1)(b)—to part-time employment that is consistent with the regular pattern of hours worked during that period; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66B__para-c">
              <num>c</num>
              <content>
                <p>be given to the employee within the period of 21 days after the end of the 12 month period referred to in paragraph (1)(a).</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-66B__subclause-3">
              <num>3</num>
              <content>
                <p>For the purposes of paragraph (2)(b), in determining whether an award/agreement free employee has worked the equivalent of full-time hours, regard may be had to the hours of work of any other full-time employees of the employer employed in the same position as (or in a position that is comparable to) the position of the employee.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-66C">
            <num>66C</num>
            <heading>When employer offers not required</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-66C__subclause-1">
              <num>1</num>
              <content>
                <p>Despite <ref href="#sec-66B">section 66B</ref>, an employer is not required to make an offer under that section to a casual employee if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-66C__para-a">
              <num>a</num>
              <content>
                <p>there are reasonable grounds not to make the offer; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66C__para-b">
              <num>b</num>
              <content>
                <p>the reasonable grounds are based on facts that are known, or reasonably foreseeable, at the time of deciding not to make the offer.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-66C__subclause-2">
              <num>2</num>
              <content>
                <p>Without limiting paragraph (1)(a), reasonable grounds for deciding not to make an offer include the following:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-66C__para-a">
              <num>a</num>
              <content>
                <p>the employee’s position will cease to exist in the period of 12 months after the time of deciding not to make the offer;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66C__para-b">
              <num>b</num>
              <content>
                <p>the hours of work which the employee is required to perform will be significantly reduced in that period;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66C__para-c">
              <num>c</num>
              <content>
                <p>there will be a significant change in either or both of the following in that period:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66C__para-i">
              <num>i</num>
              <content>
                <p>the days on which the employee’s hours of work are required to be performed;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66C__para-ii">
              <num>ii</num>
              <content>
                <p>the times at which the employee’s hours of work are required to be performed;</p>
              </content>
            </paragraph>
            <content>
              <p>which cannot be accommodated within the days or times the employee is available to work during that period;</p>
              <p>Note:	If an employer fails to give notice to a casual employee, the employee has a residual right to request conversion to full-time or part-time employment in certain circumstances: see Subdivision C.</p>
            </content>
            <paragraph eId="schedule-1__clause-66C__para-d">
              <num>d</num>
              <content>
                <p>making the offer would not comply with a recruitment or selection process required by or under a law of the Commonwealth or a State or a Territory.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-66C__subclause-3">
              <num>3</num>
              <content>
                <p>An employer must give written notice to a casual employee in accordance with subsection (4) if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-66C__para-a">
              <num>a</num>
              <content>
                <p>the employer decides under subsection (1) not to make an offer to the employee; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66C__para-b">
              <num>b</num>
              <content>
                <p>the employee has been employed by the employer for the 12 month period referred to in paragraph 66B(1)(a) but does not meet the requirement referred to in paragraph 66B(1)(b).</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-66C__subclause-4">
              <num>4</num>
              <content>
                <p>The notice must:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-66C__para-a">
              <num>a</num>
              <content>
                <p>advise the employee that the employer is not making an offer under <ref href="#sec-66B">section 66B</ref>; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66C__para-b">
              <num>b</num>
              <content>
                <p>include details of the reasons for not making the offer (including any grounds on which the employer has decided to not make the offer); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66C__para-c">
              <num>c</num>
              <content>
                <p>be given to the employee <quantity refersTo="#deadline">within 21 days</quantity> after the end of the 12 month period referred to in paragraph 66B(1)(a).</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-66D">
            <num>66D</num>
            <heading>Employee must give a response</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-66D__subclause-1">
              <num>1</num>
              <content>
                <p>The employee must give the employer a written response to the offer <quantity refersTo="#deadline">within 21 days</quantity> after the offer is given to the employee, stating whether the employee accepts or declines the offer.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-66D__subclause-2">
              <num>2</num>
              <content>
                <p>If the employee fails to give the employer a written response in accordance with subsection (1), the employee is taken to have declined the offer.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-66E">
            <num>66E</num>
            <heading>Acceptances of offers</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-66E__subclause-1">
              <num>1</num>
              <content>
                <p>If the employee accepts the offer, the employer must, <quantity refersTo="#deadline">within 21 days</quantity> after the day the acceptance is given to the employer, give written notice to the employee of the following:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-66E__para-a">
              <num>a</num>
              <content>
                <p>whether the employee is converting to full-time employment or part-time employment;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66E__para-b">
              <num>b</num>
              <content>
                <p>the employee’s hours of work after the conversion takes effect;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66E__para-c">
              <num>c</num>
              <content>
                <p>the day the employee’s conversion to full-time employment or part-time employment takes effect.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-66E__subclause-2">
              <num>2</num>
              <content>
                <p>However, the employer must discuss with the employee the matters the employer intends to specify for the purposes of paragraphs (1)(a), (b) and (c) before giving the notice.</p>
              </content>
            </hcontainer>

            <heading>Employee requests</heading>

              <num>1</num>

                <p>A casual employee may make a request of an employer under this section if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-66F__para-a">
              <num>a</num>
              <content>
                <p>the employee has been employed by the employer for a period of at least 12 months beginning the day the employment started; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66F__para-b">
              <num>b</num>
              <content>
                <p>the employee has, in the period of 6 months ending the day the request is given, worked a regular pattern of hours on an ongoing basis which, without significant adjustment, the employee could continue to work as a full-time employee or a part-time employee (as the case may be); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66F__para-c">
              <num>c</num>
              <content>
                <p>all of the following apply:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66F__para-i">
              <num>i</num>
              <content>
                <p>the employee has not, at any time during the period referred to in paragraph (b), refused an offer made to the employee under <ref href="#sec-66B">section 66B</ref>;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66F__para-ii">
              <num>ii</num>
              <content>
                <p>the employer has not, at any time during that period, given the employee a notice in accordance with paragraph 66C(3)(a) (which deals with notice of employer decisions not to make offers on reasonable grounds);</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66F__para-iii">
              <num>iii</num>
              <content>
                <p>the employer has not, at any time during that period, given a response to the employee under <ref href="#sec-66G">section 66G</ref> refusing a previous request made under this section;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66F__para-iv">
              <num>iv</num>
              <content>
                <p>if the employer is not a small business employer—the request is not made during the period of 21 days after the period referred to in paragraph 66B(1)(a).</p>
              </content>
            </paragraph>
            <content>
              <p>Note:	Nothing in this Subdivision prevents an employee from requesting to convert to full-time or part-time employment outside the provisions of this Division, or prevents an employer from granting such a request.</p>
              <p>Note:	If a request is accepted, the conversion to full-time employment or part-time employment has effect for all purposes (see <ref href="#sec-66K">section 66K</ref>).</p>

                <p>The request must:</p>
              </content>
            </hcontainer>

                <p>be in writing; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66F__para-b">
              <num>b</num>
              <content>
                <p>be a request for the employee to convert:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66F__para-i">
              <num>i</num>
              <content>
                <p>for an employee that has worked the equivalent of full-time hours during the period referred to in paragraph (1)(b)—to full-time employment; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66F__para-ii">
              <num>ii</num>
              <content>
                <p>for an employee that has worked less than the equivalent of full-time hours during the period referred to in paragraph (1)(b)—to part-time employment that is consistent with the regular pattern of hours worked during that period; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66F__para-c">
              <num>c</num>
              <content>
                <p>be given to the employer.</p>
              </content>
            </paragraph>

                <p>For the purposes of paragraph (1)(b), in determining whether an award/agreement free employee has worked the equivalent of full-time hours, regard may be had to the hours of work of any other full-time employees of the employer employed in the same position as (or in a position that is comparable to) the position of the employee.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-66G">
            <num>66G</num>
            <heading>Employer must give a response</heading>
            <content>
              <p>The employer must give the employee a written response to the request <quantity refersTo="#deadline">within 21 days</quantity> after the request is given to the employer, stating whether the employer grants or refuses the request.</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-66H">
            <num>66H</num>
            <heading>Refusals of requests</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-66H__subclause-1">
              <num>1</num>
              <content>
                <p>The employer must not refuse the request unless:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-66H__para-a">
              <num>a</num>
              <content>
                <p>the employer has consulted the employee; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66H__para-b">
              <num>b</num>
              <content>
                <p>there are reasonable grounds to refuse the request; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66H__para-c">
              <num>c</num>
              <content>
                <p>the reasonable grounds are based on facts that are known, or reasonably foreseeable, at the time of refusing the request.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-66H__subclause-2">
              <num>2</num>
              <content>
                <p>Without limiting paragraph (1)(b), reasonable grounds for refusing the request include the following:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-66H__para-a">
              <num>a</num>
              <content>
                <p>it would require a significant adjustment to the employee’s hours of work in order for the employee to be employed as a full-time employee or part-time employee;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66H__para-b">
              <num>b</num>
              <content>
                <p>the employee’s position will cease to exist in the period of 12 months after giving the request;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66H__para-c">
              <num>c</num>
              <content>
                <p>the hours of work which the employee is required to perform will be significantly reduced in the period of 12 months after giving the request;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66H__para-d">
              <num>d</num>
              <content>
                <p>there will be a significant change in either or both of the following in the period of 12 months after giving the request:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66H__para-i">
              <num>i</num>
              <content>
                <p>the days on which the employee’s hours of work are required to be performed;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66H__para-ii">
              <num>ii</num>
              <content>
                <p>the times at which the employee’s hours of work are required to be performed;</p>
              </content>
            </paragraph>
            <content>
              <p>which cannot be accommodated within the days or times the employee is available to work during that period;</p>
            </content>
            <paragraph eId="schedule-1__clause-66H__para-e">
              <num>e</num>
              <content>
                <p>granting the request would not comply with a recruitment or selection process required by or under a law of the Commonwealth or a State or a Territory.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-66H__subclause-3">
              <num>3</num>
              <content>
                <p>If the employer refuses the request, the written response under <ref href="#sec-66G">section 66G</ref> must include details of the reasons for the refusal.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-66J">
            <num>66J</num>
            <heading>Grants of requests</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-66J__subclause-1">
              <num>1</num>

                <p>If the employer grants the request, the employer must, <quantity refersTo="#deadline">within 21 days</quantity> after the day the request is given to the employer, give written notice to the employee of the following:</p>
              </content>
            </hcontainer>

              <num>a</num>
              <content>
                <p>whether the employee is converting to full-time employment or part-time employment;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66J__para-b">
              <num>b</num>
              <content>
                <p>the employee’s hours of work after the conversion takes effect;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66J__para-c">
              <num>c</num>
              <content>
                <p>the day the employee’s conversion to full-time employment or part-time employment takes effect.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-66J__subclause-2">
              <num>2</num>
              <content>
                <p>However, the employer must discuss with the employee the matters the employer intends to specify for the purposes of paragraphs (1)(a), (b) and (c) before giving the notice.</p>
              </content>

              <num>3</num>
              <content>

              <p>Subdivision D—Other provisions</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-66K">
            <num>66K</num>
            <heading>Effect of conversion</heading>
            <content>
              <p>To avoid doubt, an employee is taken, on and after the day specified in a notice for the purposes of paragraph 66E(1)(c) or 66J(1)(c), to be a full-time employee or part-time employee of the employer for the purposes of the following:</p>
            </content>
            <paragraph eId="schedule-1__clause-66K__para-a">
              <num>a</num>
              <content>
                <p>this Act and any other law of the Commonwealth;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66K__para-b">
              <num>b</num>
              <content>
                <p>a law of a State or Territory;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66K__para-c">
              <num>c</num>
              <content>
                <p>any fair work instrument that applies to the employee;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66K__para-d">
              <num>d</num>
              <content>
                <p>the employee’s contract of employment.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-66L">
            <num>66L</num>
            <heading>Other rights and obligations</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-66L__subclause-1">
              <num>1</num>
              <content>
                <p>An employer must not reduce or vary an employee’s hours of work, or terminate an employee’s employment, in order to avoid any right or obligation under this Division.</p>
              </content>
            </hcontainer>
            <content>
              <p>Note:	The general protections provisions in <ref href="#part-3">Part 3</ref>-1 also prohibit the taking of adverse action by an employer against an employee (which includes a casual employee) because of a workplace right of the employee under this Division.</p>
            </content>
            <hcontainer name="subclause" eId="schedule-1__clause-66L__subclause-2">
              <num>2</num>
              <content>
                <p>Nothing in this Division:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-66L__para-a">
              <num>a</num>

                <p>requires an employee to convert to full-time employment or part-time employment; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66L__para-b">
              <num>b</num>
              <content>
                <p>permits an employer to require an employee to convert to full-time employment or part-time employment; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66L__para-c">
              <num>c</num>
              <content>
                <p>requires an employer to increase the hours of work of an employee who requests conversion to full-time employment or part-time employment under this Division.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-66M">
            <num>66M</num>
            <heading>Disputes about the operation of this Division</heading>
            <content>
              <p>Application of this section</p>
              <p>Note:	Modern awards and enterprise agreements must include a term that provides a procedure for settling disputes in relation to the National Employment Standards (see paragraph 146(b) and subsection 186(6)).</p>
              <p>Resolving disputes</p>
              <p>FWC may deal with disputes</p>
              <p>Note:	For the purposes of paragraph (a), the FWC may deal with the dispute as it considers appropriate, including by mediation, conciliation, making a recommendation or expressing an opinion (see subsection 595(2)).</p>
              <p>Representatives</p>
              <p>Note:	A person may be represented by a lawyer or paid agent in a matter before the FWC only with the permission of the FWC (see <ref href="#sec-596">section 596</ref>).</p>
            </content>

                <p>This section applies to a dispute between an employer and employee about the operation of this Division.</p>
              </content>
            </hcontainer>

                <p>However, this section does not apply in relation to the dispute if any of the following includes a term that provides a procedure for dealing with the dispute:</p>
              </content>

              <content>
                <p>a fair work instrument that applies to the employee;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66M__para-b">

                <p>the employee’s contract of employment;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-66M__para-c">
              <num>c</num>
              <content>
                <p>another written agreement between the employer and employee.</p>

                <p>In the first instance, the parties to the dispute must attempt to resolve the dispute at the workplace level, by discussions between the parties.</p>
              </content>

              <content>
                <p>If discussions at the workplace level do not resolve the dispute, a party to the dispute may refer the dispute to the FWC.</p>

              <content>
                <p>If a dispute is referred under subsection (4):</p>
              </content>
            </hcontainer>

                <p>	(b)	the employer pays the person an identifiable amount (the <b><i>loading amount</i></b>) paid to compensate the person for not having one or more relevant entitlements during a period (the<i> </i><b><i>employment period</i></b>); and</p>
              </content>
            </paragraph>

                <p>during the employment period, the person was not a casual employee; and</p>

              <p>Note:	If the claim is below a certain amount, the person may choose to use the small claims procedure: see <ref href="#sec-548">section 548</ref>.</p>

                <p>	(2)	When making any orders in relation to the claim, a court must reduce (but not below nil) any amount payable by the employer to the person for the relevant entitlements (the <b><i>claim amount</i></b>) by an amount equal to the loading amount.</p>

                <p>Subclause (1) does not apply in relation to a person who is an employee of an employer as a result of accepting an offer that was made before commencement if either of the following apply in relation to that person:</p>

                <p>This clause applies in relation to an employee and an employer (other than a small business employer) if any or all of the following apply:</p>

              <num>a</num>

                <p>the employee was, immediately before commencement (and disregarding subclause 46(3)), a casual employee of the employer;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-47__para-b">
              <num>b</num>
              <content>
                <p>the employee was, immediately before commencement (and disregarding subclause 46(3)), designated as a casual employee by the employer for the purposes of:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-47__para-i">
              <num>i</num>

                <p>any fair work instrument that applies to the employee; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-47__para-ii">

                <p>the employee’s contract of employment;</p>

            <paragraph eId="schedule-2__clause-47__para-c">
              <num>c</num>
              <content>
                <p>the employee is a casual employee of the employer <ref href="#sec-15A">within the meaning of section 15A</ref> of the amended Act because of an offer of an employment made before commencement.</p>

              <p>Note:	The effect of this application provision is to provide a requirement for an employer (other than a small business employer) to assess whether to offer conversion under <ref href="#dvs-4A">Division 4A</ref> of <ref href="#part-2">Part 2</ref>-2 of the amended Act (as modified under this clause) to any employee who was, or may have been, a casual employee immediately before commencement, and to any employee who at commencement is a casual employee <ref href="#sec-15A">within the meaning of section 15A</ref> of the amended Act.</p>

                <p><ref href="#dvs-4A">Division 4A</ref> (including Subdivision C) of <ref href="#part-2">Part 2</ref>-2 of the amended Act applies in relation to the employee and employer to whom paragraph (1)(a) or (b) applies after the transition period as if the employee were a casual employee of the employer <ref href="#sec-15A">within the meaning of section 15A</ref> of the amended Act.</p>

              <num>5</num>
              <content>
                <p>An employer referred to in subclause (1) must give an employee referred to in that subclause a Casual Employment Information Statement as soon as practicable after the end of the transition period.</p>

          </hcontainer>
          <hcontainer name="clause" eId="schedule-2__clause-47A">
            <num>47A</num>
            <heading>Casual employees of small business employers</heading>
            <hcontainer name="subclause" eId="schedule-2__clause-47A__subclause-1">
              <num>1</num>
              <content>
                <p>This clause applies in relation to an employee and a small business employer if any or all of the following apply:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-47A__para-a">
              <num>a</num>
              <content>
                <p>the employee was, immediately before commencement (and disregarding subclause 46(3)), a casual employee of the employer;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-47A__para-b">
              <num>b</num>
              <content>
                <p>the employee was, immediately before commencement (and disregarding subclause 46(3)), designated as a casual employee by the employer for the purposes of:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-47A__para-i">
              <num>i</num>
              <content>
                <p>any fair work instrument that applies to the employee; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-47A__para-ii">
              <num>ii</num>
              <content>
                <p>the employee’s contract of employment;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-47A__para-c">
              <num>c</num>
              <content>
                <p>the employee is a casual employee of the employer <ref href="#sec-15A">within the meaning of section 15A</ref> of the amended Act because of an offer of an employment made before commencement.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-47A__subclause-2">
              <num>2</num>
              <content>
                <p><ref href="#dvs-4A">Division 4A</ref>, other than Subdivision B, of <ref href="#part-2">Part 2</ref>-2 of the amended Act applies in relation to the employee and employer to whom paragraph (1)(a) or (b) applies on and after commencement as if the employee were a casual employee of the employer <ref href="#sec-15A">within the meaning of section 15A</ref> of the amended Act.</p>

            <hcontainer name="subclause" eId="schedule-2__clause-47A__subclause-3">
              <num>3</num>
              <content>
                <p>An employer referred to in subclause (1) must give an employee referred to in that subclause a Casual Employment Information Statement as soon as practicable after commencement.</p>

          <hcontainer name="clause" eId="schedule-2__clause-48">
            <num>48</num>
            <heading>Variations to modern awards</heading>
            <hcontainer name="subclause" eId="schedule-2__clause-48__subclause-1">
              <num>1</num>
              <content>
                <p>If:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-48__para-a">
              <num>a</num>
              <content>
                <p>a modern award is made before commencement; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-48__para-b">
              <num>b</num>
              <content>
                <p>the modern award is in operation on commencement; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-48__para-c">
              <num>c</num>
              <content>
                <p>	(c)	immediately before commencement, the modern award includes a term (the <b><i>relevant term</i></b>) that:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-48__para-i">
              <num>i</num>
              <content>
                <p>defines or describes casual employment; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-48__para-ii">
              <num>ii</num>
              <content>
                <p>deals with the circumstances in which employees are to be employed as casual employees; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-48__para-iii">
              <num>iii</num>
              <content>
                <p>provides for the manner in which casual employees are to be employed; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-48__para-iv">
              <num>iv</num>
              <content>
                <p>provides for the conversion of casual employment to another type of employment;</p>
              </content>
            </paragraph>
            <content>
              <p>then the FWC must, <quantity refersTo="#deadline">within 6 months</quantity> after commencement, review the relevant term in accordance with subclause (2).</p>
              <p>then the FWC must make a determination varying the modern award to make the award consistent or operate effectively with the Act as so amended.</p>

                <p>The review must consider the following:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-48__para-a">
              <num>a</num>
              <content>
                <p>whether the relevant term is consistent with this Act as amended by Schedule 1 to the amending Act;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-48__para-b">
              <num>b</num>
              <content>
                <p>whether there is any uncertainty or difficulty relating to the interaction between the award and the Act as so amended.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-48__subclause-3">
              <num>3</num>
              <content>
                <p>If the review of a relevant term under subclause (1) finds that:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-48__para-a">
              <num>a</num>
              <content>
                <p>the relevant term is not consistent with this Act as amended by Schedule 1 to the amending Act; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-48__para-b">
              <num>b</num>
              <content>
                <p>there is a difficulty or uncertainty relating to the interaction between the award and the Act as so amended;</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-48__subclause-4">
              <num>4</num>
              <content>
                <p>The determination must be made as soon as reasonably practicable after the review is conducted.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-48__subclause-5">
              <num>5</num>
              <content>
                <p>A determination under subclause (2) comes into operation on (and takes effect from) the start of the day the determination is made.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-48__subclause-6">
              <num>6</num>
              <content>
                <p>Section 168 applies to a determination made under subclause (2) as if it were a determination made under <ref href="#part-2">Part 2</ref>-3.</p>
