                <p>the provider and the service meet the eligibility criteria (if any) specified in <role refersTo="#minister">the Minister</role>’s rules; and</p>

                <p>	(b)	a major disaster (within the meaning of the <i>Social Security Act 1991</i>); or</p>

              <p><b><i>relevant period</i></b> means the period beginning on 6 April 2020 and ending on 12 July 2020.</p>

            <heading>Relevant period not included in determining cessation of enrolment</heading>
            <content>
              <p>Subparagraph 200B(1)(b)(iii) of the Family Assistance Administration Act applies as if the period of 14 weeks mentioned in that subparagraph did not include a week that occurred in the relevant period.</p>

          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-35">
            <num>35</num>
            <heading>No requirement to report provision of care to children during relevant period</heading>

                <p>An approved provider is not required under <ref href="#sec-204B">section 204B</ref> of the Family Assistance Administration Act to give a report for a week if the week occurred in the relevant period.</p>

                <p>However, for the purposes of the operation of subsection 205A(1) of the Family Assistance Administration Act, the approved provider is taken to have been required to give the report.</p>

            <num>36</num>
            <heading>Recovery of business continuity payments during relevant period</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-36__subclause-1">
              <num>1</num>

                <p>This item applies in relation to an amount paid under <ref href="#sec-205A">section 205A</ref> of the Family Assistance Administration Act to an approved provider in relation to a period that occurred in the relevant period.</p>

            <hcontainer name="subclause" eId="schedule-1__clause-36__subclause-2">
              <num>2</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, make rules determining circumstances in which the whole or part of the amount is taken to be a debt due to the Commonwealth by the provider under Part 4 of the Family Assistance Administration Act.</p>
              </content>

            <heading>No set-off of business continuity payments during relevant period</heading>

              <p>Section 205B of the Family Assistance Administration Act does not apply in relation to a payment made under <ref href="#sec-205A">section 205A</ref> of that Act to an approved provider if the payment was made in relation to a period that occurred in the relevant period.</p>

            <num>38</num>
            <heading>Certain Minister’s rules taken to be valid</heading>
            <content>
              <p>The following, as in force at the commencement of this Schedule, are for all purposes taken to be, and always to have been, valid exercises of the power to make Minister’s rules under subsection 85GB(1) of the <i>A New Tax System (Family Assistance) Act 1999</i>:</p>

                <p>If the operation of this Part would result in an acquisition of property (within the meaning of paragraph 51(xxxi) of the Constitution) from a person otherwise than on just terms (within the meaning of that paragraph), the Commonwealth is liable to pay a reasonable amount of compensation to the person.</p>
