          <heading>Objects of this Act</heading>
          <content>
            <p>The objects of this Act are as follows:</p>
          </content>

            <num>a</num>
            <content>
              <p>to give effect to an intergovernmental scheme involving the Commonwealth and the States that relates to the establishment of nationally consistent standards to minimise risks to the environment from industrial chemicals;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-b">
            <num>b</num>
            <content>
              <p>to provide for the Government of the Commonwealth, as the national Government of Australia, to establish a register of scheduling decisions for relevant industrial chemicals;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-c">
            <num>c</num>
            <content>
              <p>to provide for the Register to operate as a national scheme in that another law of the Commonwealth or a law of a State:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-i">
            <num>i</num>

              <p>may apply or adopt the Register (with or without modification); and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-ii">

              <p>may make provision for, or in relation to, its implementation and enforcement, as so applied or adopted;</p>
            </content>
          </paragraph>

              <p>to reflect, through scheduling decisions for relevant industrial chemicals that are included in the Register, the views of the Commonwealth on the controls, including the risk management measures, that should be applied to those chemicals;</p>

            <num>e</num>
            <content>
              <p>to regulate the conduct of the Commonwealth, and persons employed or engaged by the Commonwealth, in connection with the Register;</p>
            </content>
          </paragraph>

            <num>f</num>
            <content>
              <p>to contribute to meeting Australia’s international obligations in relation to industrial chemicals.</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-1__sec-4">
          <num>4</num>
          <heading>Simplified outline of this Act</heading>
          <content>
            <p>This Act provides for <role refersTo="#minister">the Minister</role> to make one or more scheduling decisions for a relevant industrial chemical and to vary or revoke such a decision. Before making, varying or revoking such a decision, <role refersTo="#minister">the Minister</role> must consult the public, may seek information from a person and may consult with the State Environment Ministers.</p>
            <p>In making, varying or revoking a scheduling decision for a relevant industrial chemical, <role refersTo="#minister">the Minister</role> must, among other things, comply with the decision-making principles. The decision-making principles are made by <role refersTo="#minister">the Minister</role> and <role refersTo="#minister">the Minister</role> must consult the public and State Environment Ministers before making, varying or revoking them.</p>
            <p><role refersTo="#minister">The Minister</role> must ensure that a scheduling decision for a relevant industrial chemical, as made or as varied, is recorded in the Register. If such a decision is revoked, <role refersTo="#minister">the Minister</role> must ensure it is removed from the Register.</p>
            <p>The Register is made by <role refersTo="#minister">the Minister</role> but it does not create prohibitions, restrictions or obligations that are enforceable in judicial or other proceedings.</p>
            <p>Another law of the Commonwealth, or a law of a State, may apply or adopt the Register (with or without modification) and may make provision for, or in relation to, the implementation and enforcement of the Register, as so applied or adopted.</p>
            <p>There is to be an Advisory Committee whose members will be appointed by <role refersTo="#minister">the Minister</role>. The Committee will have functions that include advising <role refersTo="#minister">the Minister</role> about certain matters.</p>
            <p>This Act also includes provisions dealing with confidentiality and information sharing, scheduling charge and other miscellaneous matters (such as the functions of the Executive Director).</p>

          <num>5</num>
          <heading>Crown to be bound</heading>
          <content>
            <p>This Act binds the Crown in each of its capacities.</p>
          </content>
        </section>
        <section eId="part-1__sec-6">

          <heading>Extension to external Territories</heading>
          <content>
            <p>This Act extends to the external Territories.</p>
          </content>

          <heading>Definitions</heading>
          <content>
            <p>In this Act:</p>
            <p><term refersTo="#term-aacn">AACN</term> has the same meaning as <def>in the Industrial Chemicals Act.</def></p>
            <p><term refersTo="#term-advisory-committee">Advisory Committee</term> means <def>the Advisory Committee on the Environmental Management of Industrial Chemicals established under <ref href="#sec-27">section 27</ref>.</def></p>
            <p><term refersTo="#term-advisory-committee-member">Advisory Committee member</term> means <def>a member of the Advisory Committee, and includes the Chair.</def></p>
            <p><term refersTo="#term-assessment-certificate">assessment certificate</term> means <def>an assessment certificate issued under <ref href="#sec-37">section 37</ref> of the Industrial Chemicals Act.</def></p>
            <p><term refersTo="#term-cas-name-for-an-industrial-chemical">CAS name for an industrial chemical</term> has the same meaning as <def>in the Industrial Chemicals Act.</def></p>
            <p><term refersTo="#term-cas-number-for-an-industrial-chemical">CAS number for an industrial chemical</term> has the same meaning as <def>in the Industrial Chemicals Act.</def></p>

            <p><b><i>Commonwealth risk assessment</i></b> means:</p>

              <p>an assessment statement (within the meaning of the Industrial Chemicals Act); or</p>

              <p>an evaluation statement (within the meaning of the Industrial Chemicals Act); or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-7__para-d">

              <p>a risk assessment (however described) of a kind specified in the rules.</p>
            </content>
            <content>
              <p><term refersTo="#term-confidential-information">confidential information</term> means <def>information in relation to which a request under subsection 42(1) has been given to the Minister.</def></p>
              <p><term refersTo="#term-decision-making-principles">decision-making principles</term> means <def>the instrument made under subsection 23(1) and includes such an instrument as varied under subsection 23(2).</def></p>
              <p><term refersTo="#term-end-use-for-an-industrial-chemical">end use for an industrial chemical</term> has the same meaning as <def>in the Industrial Chemicals Act.</def></p>
              <p><b><i>enforcement body</i></b>: see subsection 59(2).</p>
              <p><term refersTo="#term-entrusted-ic-person">entrusted IC person</term> means <def>an entrusted person within the meaning of the Industrial Chemicals Act.</def></p>
              <p><b><i>entrusted person</i></b> means:</p>

            </content>

          <paragraph eId="part-1__sec-7__para-d">

              <p>the Executive Director; or</p>

              <p>	(i)	a person employed, under the <i>Members of Parliament (Staff) Act 1984</i>, as a personal employee of the Minister.</p>

              <p><b><i>environment</i></b> includes:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-7__para-a">
            <num>a</num>
            <content>
              <p>ecosystems and their constituent parts, including people and communities; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-7__para-b">
            <num>b</num>
            <content>
              <p>natural and physical resources; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-7__para-c">
            <num>c</num>
            <content>
              <p>the qualities and characteristics of locations, places and areas;</p>
            </content>
            <content>
              <p>but does not include the social, economic or cultural aspects of the expression <b><i>environment</i></b>.</p>
              <p><term refersTo="#term-environment-department">Environment Department</term> means <def>the Department administered by the Minister administering this Act.</def></p>
              <p><term refersTo="#term-executive-director">Executive Director</term> has the same meaning as <def>in the Industrial Chemicals Act.</def></p>
              <p><term refersTo="#term-federal-court">Federal Court</term> means <def>the Federal Court of Australia.</def></p>
              <p><b><i>foreign government body</i></b> means:</p>

              <p>a department of the government of a foreign country or a part of a foreign country; or</p>
            </content>
          </paragraph>

              <p>an agency or authority of a foreign country or a part of a foreign country.</p>

            <content>
              <p><term refersTo="#term-generalised-end-use">generalised end use</term> has the same meaning as <def>in the Industrial Chemicals Act.</def></p>
              <p><term refersTo="#term-health-department">Health Department</term> means <def>the Department administered by the Minister administering the Industrial Chemicals Act.</def></p>
              <p><term refersTo="#term-holder-of-an-assessment-certificate">holder of an assessment certificate</term> has the same meaning as <def>in the Industrial Chemicals Act.</def></p>
              <p><b><i>industrial chemical</i></b>: see section 8.</p>
              <p><term refersTo="#term-industrial-chemicals-act">Industrial Chemicals Act</term> means <def><ref href="">the Industrial Chemicals Act 2019</ref>.</def></p>
              <p><term refersTo="#term-international-agreement">international agreement</term> means <def>an agreement: whose parties are Australia and one or more foreign countries; and that is in force for Australia.</def></p>

              <p><term refersTo="#term-personal-information">personal information</term> has the same meaning as <def>in <ref href="">the Privacy Act 1988</ref>.</def></p>
              <p><term refersTo="#term-protected-ic-information">protected IC information</term> means <def>protected information within the meaning of the Industrial Chemicals Act and includes information that is taken to be protected information for the purposes of that Act.</def></p>
              <p><b><i>protected information</i></b> means:</p>

              <p><term refersTo="#term-register">Register</term> means <def>the instrument made under subsection 22(1) and includes such an instrument as varied.</def></p>
              <p><term refersTo="#term-registered-introducer-for-a-registration-year">registered introducer for a registration year</term> means <def>a person who is registered under <ref href="#sec-17">section 17</ref> of the Industrial Chemicals Act for the registration year.</def></p>
              <p><term refersTo="#term-registration-charge">registration charge</term> has the same meaning as <def>in the Industrial Chemicals Act.</def></p>
              <p><term refersTo="#term-registration-year">registration year</term> means <def>the period of 12 months beginning on: <date date="2021-09-01">1 September 2021</date>; or 1 September of a later year.</def></p>

              <p><term refersTo="#term-rules">rules</term> means <def>the rules made under <ref href="#sec-76">section 76</ref>.</def></p>
              <p><term refersTo="#term-scheduling-charge">scheduling charge</term> means <def>charge imposed by: 	(a)	the <i>Industrial Chemicals Environmental Management (Register) Charge (Customs) Act </i><i>2021</i>; or 	(b)	the <i>Industrial Chemicals Environmental Management (Register) Charge (Excise) Act </i><i>2021</i>; or 	(c)	the <i>Industrial Chemicals Environmental Management (Register) Charge (General) Act </i><i>2021</i>. <b><i>scheduling decision</i></b> for a relevant industrial chemical: see subsection 11(3).</def></p>

          <heading>Meaning of industrial chemical</heading>
          <subsection eId="part-1__sec-8__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	<b><i>Industrial chemical</i></b> is an industrial chemical within the meaning of section 10 of the Industrial Chemicals Act.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-8__subsec-2">
            <num>2</num>
            <content>
              <p>To avoid doubt, this Act only applies in relation to an industrial chemical to the extent that the industrial chemical is used, or proposed to be used, for an industrial use (within the meaning of the Industrial Chemicals Act).</p>

          <heading>Vacancy in the office of an Advisory Committee member</heading>
          <content>
            <p>For the purposes of a reference in:</p>

        <heading>Register of scheduling decisions for relevant industrial chemicals</heading>

          <heading>Introduction</heading>

            <heading>Simplified outline of this Part</heading>
            <content>
              <p>This Part provides for <role refersTo="#minister">the Minister</role> to make one or more scheduling decisions for a relevant industrial chemical and to vary or revoke such a decision. Before making, varying or revoking such a decision, <role refersTo="#minister">the Minister</role> must consult the public, may seek information from a person and may consult with the State Environment Ministers.</p>
              <p>In making, varying or revoking a scheduling decision for a relevant industrial chemical, <role refersTo="#minister">the Minister</role> must, among other things, comply with the decision-making principles. The decision-making principles are made by <role refersTo="#minister">the Minister</role> and <role refersTo="#minister">the Minister</role> must consult the public and State Environment Ministers before making, varying or revoking them.</p>
              <p><role refersTo="#minister">The Minister</role> must ensure that a scheduling decision for a relevant industrial chemical, as made or as varied, is recorded in the Register. If such a decision is revoked, <role refersTo="#minister">the Minister</role> must ensure it is removed from the Register.</p>
              <p>The Register is made by <role refersTo="#minister">the Minister</role> but it does not create prohibitions, restrictions or obligations that are enforceable in judicial or other proceedings.</p>
              <p>Another law of the Commonwealth, or a law of a State, may apply or adopt the Register (with or without modification) and may make provision for, or in relation to, the implementation and enforcement of the Register, as so applied or adopted.</p>

          <heading>Scheduling decisions for relevant industrial chemicals</heading>

            <heading>Minister may make scheduling decision for relevant industrial chemical</heading>
            <subsection eId="part-2__dvs-2__sec-11__subsec-1">
              <num>1</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may make one or more scheduling decisions for a relevant industrial chemical.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-11__subsec-2">
              <num>2</num>
              <content>
                <p>	(2)	If the Minister makes a scheduling decision for a relevant industrial chemical, the Minister must<i> </i>ensure that the decision for the chemical is recorded in the Register.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-11__subsec-3">
              <num>3</num>
              <content>
                <p>	(3)	A <b><i>scheduling decision</i></b> for a relevant industrial chemical is any one or more of the following decisions:</p>
              </content>

                <num>a</num>
                <content>
                  <p>a decision to list the chemical in a particular Schedule or Schedules of the Register;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-11__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>a decision to specify any one or more of the following matters in relation to the chemical as so listed:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-11__subsec-3__para-i">
                <num>i</num>
                <content>
                  <p>that the exportation, importation or manufacture of the chemical is prohibited, or restricted, in all circumstances or in specified circumstances;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-11__subsec-3__para-ii">
                <num>ii</num>
                <content>
                  <p>that all or any end uses for the chemical are prohibited, or restricted, in all circumstances or in specified circumstances;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-11__subsec-3__para-iii">
                <num>iii</num>
                <content>
                  <p>one or more end uses for the chemical;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-11__subsec-3__para-iv">
                <num>iv</num>
                <content>
                  <p>one or more risk management measures for the chemical or for any specified end uses for the chemical;</p>
                </content>
              </paragraph>

                  <p>a decision relating to the chemical that is of a kind specified in the rules.</p>

                <p>For the purposes of listing a relevant industrial chemical in a Schedule of the Register, <role refersTo="#minister">the Minister</role> may identify the chemical:</p>
              </content>
              <paragraph eId="part-2__dvs-2__sec-11__subsec-4__para-a">
                <num>a</num>
                <content>
                  <p>in a single way; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-11__subsec-4__para-b">
                <num>b</num>
                <content>
                  <p>in 2 or more ways.</p>
                </content>

                  <p>the name recommended by the International Union of Pure and Applied Chemistry for the chemical;</p>

              </paragraph>

                  <p>the molecular formula of the chemical.</p>
                </content>

                <p><role refersTo="#minister">The Minister</role> may decide to list a particular industrial chemical in a Schedule of the Register even if it is included in a particular class of industrial chemicals that is listed in that Schedule or another Schedule of the Register.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-11__subsec-6">
              <num>6</num>
              <content>
                <p>A risk management measure specified by <role refersTo="#minister">the Minister</role> may:</p>
              </content>
              <paragraph eId="part-2__dvs-2__sec-11__subsec-6__para-a">
                <num>a</num>
                <content>
                  <p>prohibit or restrict particular conduct or things in all circumstances or in specified circumstances; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-11__subsec-6__para-b">
                <num>b</num>
                <content>
                  <p>require particular conduct or things in all circumstances or in specified circumstances; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-11__subsec-6__para-c">
                <num>c</num>
                <content>
                  <p>impose an obligation in relation to particular conduct or things in all circumstances or in specified circumstances; or</p>
                </content>
              </paragraph>

                <p>If <role refersTo="#minister">the Minister</role> makes a scheduling decision for a relevant industrial chemical under subsection 11(1), <role refersTo="#minister">the Minister</role> may vary or revoke the decision for the chemical.</p>

                <p>If <role refersTo="#minister">the Minister</role> varies a scheduling decision for a relevant industrial chemical under subsection (1), <role refersTo="#minister">the Minister</role> must ensure that the decision for the chemical, as so varied, is recorded in the Register.</p>

                <p>If <role refersTo="#minister">the Minister</role> revokes a scheduling decision for a relevant industrial chemical under subsection (1), <role refersTo="#minister">the Minister</role> must ensure that the decision for the chemical is removed from the Register.</p>

            <heading>Compliance with decision-making principles etc.</heading>
            <subsection eId="part-2__dvs-2__sec-13__subsec-1">

                <p><role refersTo="#minister">The Minister</role> must not make a scheduling decision for a relevant industrial chemical unless the decision-making principles are in force.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-13__subsec-2">
              <num>2</num>
              <content>
                <p>In making, varying or revoking a scheduling decision for a relevant industrial chemical, <role refersTo="#minister">the Minister</role> must comply with the decision-making principles.</p>
              </content>
            </subsection>

            <num>14</num>
            <heading>Minister must specify AACN, or generalised end use, for industrial chemical in certain circumstances</heading>

              <p>Specification of AACN for an industrial chemical</p>
            </content>

              <num>1</num>
              <content>
                <p>If:</p>
              </content>
              <paragraph eId="part-2__dvs-2__sec-14__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>an AACN has been determined under the Industrial Chemicals Act for an industrial chemical; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-14__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>the Executive Director is required under subsection 109(1) of that Act to publish the AACN for the chemical in lieu of the proper name for the chemical (including the CAS name, CAS number and molecular formula for the chemical); and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-14__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>the period mentioned in subsection 109(3) of that Act that relates to that determination has begun but not ended; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-14__subsec-1__para-d">
                <num>d</num>
                <content>
                  <p><role refersTo="#minister">the Minister</role> proposes to make or vary, during that period, a scheduling decision for the chemical;</p>
                </content>
                <content>
                  <p><role refersTo="#minister">the Minister</role> must, for the purposes of making or varying the scheduling decision, identify the chemical by specifying the AACN for the chemical in lieu of the proper name for the chemical (including the CAS name, CAS number and molecular formula for the chemical).</p>
                  <p>Specification of generalised end use for an industrial chemical</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-14__subsec-2">
              <num>2</num>

                <p>If:</p>
              </content>
              <paragraph eId="part-2__dvs-2__sec-14__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>a generalised end use has been determined under the Industrial Chemicals Act for an industrial chemical; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-14__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>the Executive Director is required under subsection 109(2) of that Act to publish the generalised end use for the chemical in lieu of the end use for the chemical; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-14__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>the period mentioned in subsection 109(3) of that Act that relates to that determination has begun but not ended; and</p>

                  <p><role refersTo="#minister">the Minister</role> must, for the purposes of making or varying the scheduling decision, specify the generalised end use for the chemical in lieu of the end use for the chemical.</p>

            </subsection>
          </section>
          <section eId="part-2__dvs-2__sec-15">
            <num>15</num>
            <heading>Minister must have regard to certain matters in making etc. scheduling decision</heading>
            <subsection eId="part-2__dvs-2__sec-15__subsec-1">
              <num>1</num>
              <content>
                <p>In making, varying or revoking a scheduling decision for a relevant industrial chemical, <role refersTo="#minister">the Minister</role> must have regard to the following:</p>
              </content>
              <paragraph eId="part-2__dvs-2__sec-15__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>if there is a single relevant Commonwealth risk assessment in relation to the chemical—that assessment;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-15__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>if there are 2 or more relevant Commonwealth risk assessments in relation to the chemical—the most recent of those assessments;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-15__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>any relevant risks that the chemical poses, or may pose, to the environment and how any such risks may be minimised;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-15__subsec-1__para-d">
                <num>d</num>
                <content>
                  <p>any relevant risks that a relevant end use of the chemical poses, or may pose, to the environment and how any such risks may be minimised;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-15__subsec-1__para-e">
                <num>e</num>
                <content>
                  <p>any relevant advice given to <role refersTo="#minister">the Minister</role> by the Advisory Committee;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-15__subsec-1__para-f">
                <num>f</num>
                <content>
                  <p>if Australia has any relevant obligations in relation to the chemical under an international agreement specified in the rules—those obligations;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-15__subsec-1__para-g">
                <num>g</num>
                <content>
                  <p>any relevant submissions made in accordance with an invitation under subsection 17(1);</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-15__subsec-1__para-h">
                <num>h</num>
                <content>
                  <p>any relevant information given to <role refersTo="#minister">the Minister</role> under subsection 19(3) or 20(3);</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-15__subsec-1__para-i">
                <num>i</num>
                <content>
                  <p>any such matters as are specified in the rules.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-15__subsec-2">
              <num>2</num>
              <content>
                <p>Subsection (1) does not apply to a variation of a scheduling decision for a relevant industrial chemical if the variation is of a minor nature.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-15__subsec-3">
              <num>3</num>
              <content>
                <p>For the purposes of subsection (2), a variation of a scheduling decision for a relevant industrial chemical that does no more than change the way or ways in which the chemical is identified is taken to be a variation of a minor nature.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-15__subsec-4">
              <num>4</num>
              <content>
                <p>If:</p>
              </content>
              <paragraph eId="part-2__dvs-2__sec-15__subsec-4__para-a">
                <num>a</num>
                <content>
                  <p>a scheduling decision for a relevant industrial chemical specified a generalised end use for the chemical in lieu of the end use for the chemical; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-15__subsec-4__para-b">
                <num>b</num>
                <content>
                  <p>a variation of the scheduling decision does no more than to specify the end use for the chemical instead of that generalised end use;</p>
                </content>
                <content>
                  <p>then, for the purposes of subsection (2), the variation is taken to be a variation of a minor nature.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
          <section eId="part-2__dvs-2__sec-16">
            <num>16</num>
            <heading>Minister may have regard to certain matters in making etc. scheduling decision</heading>
            <subsection eId="part-2__dvs-2__sec-16__subsec-1">
              <num>1</num>
              <content>
                <p>In making, varying or revoking a scheduling decision for a relevant industrial chemical, <role refersTo="#minister">the Minister</role> may have regard to the following:</p>
              </content>
              <paragraph eId="part-2__dvs-2__sec-16__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>if there are 2 or more relevant Commonwealth risk assessments in relation to the chemical—those assessments other than the most recent of them;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-16__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>if a Commonwealth entity has undertaken a relevant risk assessment (however described) in relation to the chemical and that assessment is not a Commonwealth risk assessment—that assessment;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-16__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>if a State government body has undertaken a relevant risk assessment (however described) in relation to the chemical—that assessment;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-16__subsec-1__para-d">
                <num>d</num>
                <content>
                  <p>if a foreign government body has undertaken a relevant risk assessment (however described) in relation to the chemical—that assessment;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-16__subsec-1__para-e">
                <num>e</num>
                <content>
                  <p>if a public international organisation has undertaken a relevant risk assessment (however described) in relation to the chemical—that assessment;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-16__subsec-1__para-f">
                <num>f</num>
                <content>
                  <p>any environmental, social or economic matter that <role refersTo="#minister">the Minister</role> considers relevant to the making, varying or revoking (as the case may be) of the decision for the chemical;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-16__subsec-1__para-g">
                <num>g</num>
                <content>
                  <p>any relevant information given to <role refersTo="#minister">the Minister</role> by an entrusted IC person for the purposes of this Act;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-16__subsec-1__para-h">
                <num>h</num>
                <content>
                  <p>any other matters as are specified in the rules;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-16__subsec-1__para-i">
                <num>i</num>
                <content>
                  <p>any other matters as <role refersTo="#minister">the Minister</role> considers relevant.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-16__subsec-2">
              <num>2</num>
              <content>
                <p>In determining for the purposes of paragraph (1)(f) whether any environmental, social or economic matter is relevant to the making, varying or revoking (as the case may be) of the scheduling decision for the relevant industrial chemical, it is to be assumed that the Commonwealth and each State has made a law:</p>
              </content>
              <paragraph eId="part-2__dvs-2__sec-16__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>applying or adopting the Register; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-16__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>making provision for, or in relation to, the implementation and enforcement of the Register, as so applied or adopted.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
          <section eId="part-2__dvs-2__sec-17">
            <num>17</num>
            <heading>Public consultation about scheduling decision for relevant industrial chemical</heading>
            <subsection eId="part-2__dvs-2__sec-17__subsec-1">
              <num>1</num>
              <content>
                <p>Before making, varying or revoking a scheduling decision for a relevant industrial chemical, <role refersTo="#minister">the Minister</role> must cause to be published on the Environment Department’s website a notice:</p>
              </content>
              <paragraph eId="part-2__dvs-2__sec-17__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>setting out the proposed decision or the proposed variation or revocation of the decision; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-17__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>inviting persons to make submissions to <role refersTo="#minister">the Minister</role> about the proposed decision, or the proposed variation or revocation of the decision, in the manner, and within the time limit, specified in the notice.</p>
                </content>

              <num>2</num>

                <p>The time limit must not be shorter than 20 business days after the notice is published.</p>

            </subsection>
            <subsection eId="part-2__dvs-2__sec-17__subsec-3">
              <num>3</num>
              <content>
                <p>Subsection (1) does not apply to a variation of a scheduling decision for a relevant industrial chemical if the variation is of a minor nature.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-17__subsec-4">
              <num>4</num>
              <content>
                <p>For the purposes of subsection (3), a variation of a scheduling decision for a relevant industrial chemical that does no more than change the way or ways in which the chemical is identified is taken to be a variation of a minor nature.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-17__subsec-5">
              <num>5</num>
              <content>
                <p>If:</p>
              </content>
              <paragraph eId="part-2__dvs-2__sec-17__subsec-5__para-a">
                <num>a</num>
                <content>
                  <p>a scheduling decision for a relevant industrial chemical specified a generalised end use for the chemical in lieu of the end use for the chemical; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-17__subsec-5__para-b">
                <num>b</num>
                <content>
                  <p>a variation of the scheduling decision does no more than to specify the end use for the chemical instead of that generalised end use;</p>
                </content>
                <content>
                  <p>then, for the purposes of subsection (3), the variation is taken to be a variation of a minor nature.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
          <section eId="part-2__dvs-2__sec-18">
            <num>18</num>
            <heading>Consultation about scheduling decision for particular industrial chemical to which assessment certificate relates</heading>
            <subsection eId="part-2__dvs-2__sec-18__subsec-1">
              <num>1</num>
              <content>
                <p>This section applies if:</p>
              </content>
              <paragraph eId="part-2__dvs-2__sec-18__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>an assessment certificate is issued in relation to a particular industrial chemical; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-18__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p><role refersTo="#minister">the Minister</role> is considering making a scheduling decision for the particular industrial chemical under subsection 11(1).</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-18__subsec-2">
              <num>2</num>
              <content>
                <p>Unless <role refersTo="#minister">the Minister</role> determines otherwise, section 17 does not apply in relation to the making of the scheduling decision for the particular industrial chemical.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-18__subsec-3">
              <num>3</num>
              <content>
                <p>If <role refersTo="#minister">the Minister</role> considers it is appropriate to do so, <role refersTo="#minister">the Minister</role> may consult the holder of the assessment certificate about the making of the scheduling decision for the particular industrial chemical.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-2__dvs-2__sec-19">
            <num>19</num>
            <heading>Minister may request information relevant to the making etc. of scheduling decision</heading>
            <subsection eId="part-2__dvs-2__sec-19__subsec-1">
              <num>1</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may, by written notice given to a person, request the person to:</p>
              </content>
              <paragraph eId="part-2__dvs-2__sec-19__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>give <role refersTo="#minister">the Minister</role> information that is relevant to the making, variation or revocation of a scheduling decision for a relevant industrial chemical; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>do so in the manner, and within the time limit, specified in the notice.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-19__subsec-2">
              <num>2</num>
              <content>
                <p>The time limit must not be shorter than 20 business days after the notice is given to the person.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-19__subsec-3">
              <num>3</num>
              <content>
                <p>The person may give <role refersTo="#minister">the Minister</role> information in accordance with the request.</p>
              </content>
            </subsection>
          </section>

            <heading>Minister may invite persons to give information relevant to the making etc. of scheduling decision</heading>
            <subsection eId="part-2__dvs-2__sec-20__subsec-1">
              <num>1</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may cause to be published on the Environment Department’s website a notice inviting any persons who have:</p>
              </content>
              <paragraph eId="part-2__dvs-2__sec-20__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>specified information; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-20__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>a specified type of information;</p>
                </content>
                <content>
                  <p>that is relevant to the making, variation or revocation of a scheduling decision for a relevant industrial chemical to give <role refersTo="#minister">the Minister</role> that information in the manner, and within the time limit, specified in the notice.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-20__subsec-2">
              <num>2</num>
              <content>
                <p>The time limit must not be shorter than 20 business days after the notice is published.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-20__subsec-3">

                <p>A person may give <role refersTo="#minister">the Minister</role> information in accordance with the invitation.</p>

                <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, establish a register of scheduling decisions for relevant industrial chemicals that are made or varied under Division 2 of this Part.</p>

                <p>	(3)	Despite subsection 14(2) of the <i>Legislation Act 2003</i>, the Register may make provision in relation to a matter by applying, adopting or incorporating, with or without modification, a matter contained in an instrument or writing:</p>

            <heading>Public consultation about decision-making principles</heading>
            <subsection eId="part-2__dvs-4__sec-24__subsec-1">
              <num>1</num>
              <content>
                <p>Before making, varying or revoking the decision-making principles, <role refersTo="#minister">the Minister</role> must:</p>
              </content>
              <paragraph eId="part-2__dvs-4__sec-24__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>cause to be published on the Environment Department’s website a notice:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-4__sec-24__subsec-1__para-i">
                <num>i</num>
                <content>
                  <p>setting out the proposed principles or the proposed variation or revocation of the principles; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-4__sec-24__subsec-1__para-ii">
                <num>ii</num>
                <content>
                  <p>inviting persons to make submissions to <role refersTo="#minister">the Minister</role> about the proposed principles, or the proposed variation or revocation of the principles, in the manner, and within the time limit, specified in the notice; and</p>
                </content>
              </paragraph>

                  <p>consider any submissions that:</p>

              <p>There is to be an Advisory Committee on the Environmental Management of Industrial Chemicals.</p>
              <p>The Advisory Committee will have functions that include advising <role refersTo="#minister">the Minister</role> about matters that are referred to it by <role refersTo="#minister">the Minister</role> and that relate to the making, variation or revocation of a scheduling decision for a relevant industrial chemical, the Register or the decision-making principles.</p>
              <p>The Advisory Committee consists of a Chair and at least 3, but not more than 8, other members.</p>
              <p><role refersTo="#minister">The Minister</role> will appoint the members of the Advisory Committee.</p>

            <heading>Functions of the Advisory Committee</heading>

              <p>The Advisory Committee has the following functions:</p>
            </content>

                <p>to advise <role refersTo="#minister">the Minister</role> about matters that are referred to the Advisory Committee by <role refersTo="#minister">the Minister</role> and that relate to the making, variation or revocation of any of the following:</p>

              <p>The Advisory Committee consists of the following members:</p>

                <p>Each Advisory Committee member is to be appointed by <role refersTo="#minister">the Minister</role> by written instrument, on a part-time basis.</p>

                <p>An Advisory Committee member holds office for the period specified in the instrument of appointment. The period must not exceed 5 years.</p>

              <content>
                <p>A person is not eligible for appointment as an Advisory Committee member unless <role refersTo="#minister">the Minister</role> is satisfied that the person has substantial experience or knowledge, and significant standing, in any of the following fields:</p>

                  <p>industrial chemistry;</p>
                </content>
              </paragraph>

              <paragraph eId="part-3__dvs-3__sec-30__subsec-3__para-d">
                <num>d</num>

                  <p>environmental health;</p>
                </content>
              </paragraph>

                <p>In appointing the Advisory Committee members, <role refersTo="#minister">the Minister</role> must ensure that the Advisory Committee members collectively possess an appropriate balance of experience or knowledge in the fields mentioned in subsection (3).</p>

            </subsection>

            <heading>Acting appointments</heading>
            <content>
              <p>Chair</p>
            </content>

                <p><role refersTo="#minister">The Minister</role> may appoint an Advisory Committee member (other than the Chair) to act as the Chair:</p>

                <content>
                  <p>during a vacancy in the office of the Chair (whether or not an appointment has previously been made to the office); or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-31__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>during any period, or during all periods, when the Chair:</p>
                </content>
              </paragraph>

                <p>An Advisory Committee member is to be paid the remuneration that is determined by the Remuneration Tribunal. If no determination of that remuneration by the Tribunal is in operation, the member is to be paid the remuneration that is specified in the rules.</p>

              <num>2</num>
              <content>
                <p>An Advisory Committee member is to be paid the allowances that are specified in the rules.</p>
              </content>
            </subsection>

                <p>	(3)	This section has effect subject to the <i>Remuneration Tribunal Act 1973</i>.</p>

            </subsection>

            <heading>Leave of absence</heading>
            <subsection eId="part-3__dvs-3__sec-33__subsec-1">

                <p><role refersTo="#minister">The Minister</role> may grant leave of absence to the Chair on the terms and conditions that <role refersTo="#minister">the Minister</role> determines.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-33__subsec-2">
              <num>2</num>
              <content>
                <p>The Chair may grant leave of absence to another Advisory Committee member on the terms and conditions that the Chair determines.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-3__dvs-3__sec-34">

            <heading>Disclosure of interests to the Minister</heading>
            <content>
              <p>An Advisory Committee member must give written notice to <role refersTo="#minister">the Minister</role> of all interests, pecuniary or otherwise, that the member has or acquires and that conflict or could conflict with the proper performance of the member’s functions.</p>
            </content>
          </section>
          <section eId="part-3__dvs-3__sec-35">
            <num>35</num>
            <heading>Disclosure of interests to the Advisory Committee</heading>
            <subsection eId="part-3__dvs-3__sec-35__subsec-1">
              <num>1</num>
              <content>
                <p>An Advisory Committee member who has an interest, pecuniary or otherwise, in a matter being considered or about to be considered by the Advisory Committee must disclose the nature of the interest to a meeting of the Committee.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-35__subsec-2">
              <num>2</num>
              <content>
                <p>	(2)	The disclosure must be made as soon as possible after the relevant facts have come to the Advisory Committee member’s<i> </i>knowledge.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-35__subsec-3">
              <num>3</num>
              <content>
                <p>The disclosure must be recorded in the minutes of the meeting of the Advisory Committee.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-35__subsec-4">
              <num>4</num>
              <content>
                <p>Unless the Advisory Committee otherwise determines, the Advisory Committee member:</p>
              </content>
              <paragraph eId="part-3__dvs-3__sec-35__subsec-4__para-a">
                <num>a</num>
                <content>
                  <p>must not be present during any deliberation by the Committee on the matter; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-35__subsec-4__para-b">
                <num>b</num>
                <content>
                  <p>must not take part in any decision of the Committee with respect to the matter.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-35__subsec-5">
              <num>5</num>
              <content>
                <p>For the purposes of making a determination under subsection (4), the Advisory Committee member:</p>
              </content>
              <paragraph eId="part-3__dvs-3__sec-35__subsec-5__para-a">
                <num>a</num>
                <content>
                  <p>must not be present during any deliberation of the Advisory Committee for the purpose of making the determination; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-35__subsec-5__para-b">
                <num>b</num>
                <content>
                  <p>must not take part in making the determination.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-35__subsec-6">

                <p>A determination under subsection (4) must be recorded in the minutes of the meeting of the Advisory Committee.</p>
              </content>
            </subsection>
          </section>

            <heading>Other paid work</heading>
            <content>
              <p>An Advisory Committee member must not engage in any paid work that conflicts or could conflict with the proper performance of the member’s duties.</p>
            </content>
          </section>

            <heading>Resignation</heading>
            <subsection eId="part-3__dvs-3__sec-37__subsec-1">
              <num>1</num>
              <content>
                <p>An Advisory Committee member may resign the member’s appointment by giving <role refersTo="#minister">the Minister</role> a written resignation.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-37__subsec-2">
              <num>2</num>
              <content>
                <p>The resignation takes effect on the day it is received by <role refersTo="#minister">the Minister</role> or, if a later day is specified in the resignation, on that later day.</p>
              </content>
            </subsection>
          </section>

            <heading>Termination of appointment</heading>
            <subsection eId="part-3__dvs-3__sec-38__subsec-1">
              <num>1</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may terminate the appointment of an Advisory Committee member:</p>
              </content>
              <paragraph eId="part-3__dvs-3__sec-38__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>for misbehaviour; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-38__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>if the member is unable to perform the duties of the member’s office because of physical or mental incapacity.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-38__subsec-2">
              <num>2</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may terminate the appointment of an Advisory Committee member if:</p>
              </content>
              <paragraph eId="part-3__dvs-3__sec-38__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>the member:</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-38__subsec-2__para-i">
                <num>i</num>
                <content>
                  <p>becomes bankrupt; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-38__subsec-2__para-ii">
                <num>ii</num>
                <content>
                  <p>applies to take the benefit of any law for the relief of bankrupt or insolvent debtors; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-38__subsec-2__para-iii">
                <num>iii</num>
                <content>
                  <p>compounds with the member’s creditors; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-38__subsec-2__para-iv">
                <num>iv</num>
                <content>
                  <p>makes an assignment of the member’s remuneration for the benefit of the member’s creditors; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-38__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>the member is absent, except on leave of absence, for 3 consecutive meetings of the Advisory Committee; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-38__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>the member engages in paid work that conflicts or may conflict with the proper performance of the member’s duties (see <ref href="#sec-36">section 36</ref>); or</p>
                </content>
              </paragraph>

                <num>d</num>
                <content>
                  <p>the member fails, without reasonable excuse, to comply with <ref href="#sec-34">section 34</ref> or 35 (which deal with the disclosure of interests).</p>

                <p>The Advisory Committee may, subject to any direction given under subsection (2), determine its own procedures.</p>

            <heading>Simplified outline of this Part</heading>
            <content>
              <p>This Part deals with confidential information, the use and disclosure of protected information and other information sharing matters.</p>
              <p>A person who gives information to <role refersTo="#minister">the Minister</role> in relation to the making, variation or revocation of a scheduling decision for a relevant industrial chemical may request that the information not be publicly disclosed. If such a request is made, the information will be confidential information for the purposes of this Part.</p>
              <p>If <role refersTo="#minister">the Minister</role> proposes to publicly disclose confidential information, <role refersTo="#minister">the Minister</role> must give the nominated person for the information notice of that proposal. The nominated person may, within the time limit specified in the notice, apply to <role refersTo="#minister">the Minister</role> for the information not to be publicly disclosed.</p>
              <p>If the nominated person makes such an application, <role refersTo="#minister">the Minister</role> must decide whether or not to approve the application. <role refersTo="#minister">The Minister</role> may publicly disclose the information in certain circumstances, including if <role refersTo="#minister">the Minister</role> decides not to approve the application and any reconsideration and review rights in relation to the decision have been exhausted or have expired.</p>
              <p>Both confidential information and protected IC information will be protected information for the purposes of this Part. If an entrusted person obtains protected information in the person’s capacity as an entrusted person, the person must not use or disclose the information unless the use or disclosure is authorised by this Act, the rules or another law of the Commonwealth.</p>

          <num>2</num>
          <heading>Confidential information</heading>
          <section eId="part-4__dvs-2__sec-42">
            <num>42</num>
            <heading>Request that information not be publicly disclosed</heading>
            <subsection eId="part-4__dvs-2__sec-42__subsec-1">
              <num>1</num>
              <content>
                <p>If a person gives information to <role refersTo="#minister">the Minister</role> (whether under this Act or otherwise) in relation to the making, variation or revocation of a scheduling decision for a relevant industrial chemical, the person may request that the information not be publicly disclosed under section 61.</p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-2__sec-42__subsec-2">
              <num>2</num>
              <content>
                <p>However, a request under subsection (1) must not relate to:</p>
              </content>
              <paragraph eId="part-4__dvs-2__sec-42__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>information in relation to which an application was made under subsection 113(2) of the Industrial Chemicals Act if that application was not approved under subsection 114(2) of that Act; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-42__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>information in relation to which a notice was given under subsection 112(1) of that Act if no application in relation to the information was made under subsection 113(2) of that Act within the period specified in the notice.</p>

              </paragraph>
            </subsection>
            <subsection eId="part-4__dvs-2__sec-42__subsec-3">
              <num>3</num>
              <content>
                <p>A request under subsection (1) must:</p>
              </content>
              <paragraph eId="part-4__dvs-2__sec-42__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>be made in writing; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-42__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p><i>	</i>(b)	be given to the Minister at the same time as the information is given to the Minister; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-42__subsec-3__para-c">
                <num>c</num>
                <content>
                  <p>nominate a person to whom <role refersTo="#minister">the Minister</role> must give any notice under section 43 that relates to the information; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-42__subsec-3__para-d">
                <num>d</num>
                <content>
                  <p>be accompanied by any documents or information specified in the rules.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
          <section eId="part-4__dvs-2__sec-43">
            <num>43</num>
            <heading>Notice of proposed public disclosure of confidential information</heading>
            <subsection eId="part-4__dvs-2__sec-43__subsec-1">
              <num>1</num>
              <content>
                <p>If <role refersTo="#minister">the Minister</role> proposes to publicly disclose confidential information under section 61, <role refersTo="#minister">the Minister</role> must give the nominated person for the information a written notice stating that:</p>
              </content>
              <paragraph eId="part-4__dvs-2__sec-43__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p><role refersTo="#minister">the Minister</role> proposes to publicly disclose the information under that section; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-43__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>the nominated person may, within the time limit specified in the notice, apply under <ref href="#sec-44">section 44</ref> for the information not to be publicly disclosed under <ref href="#sec-61">section 61</ref>; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-43__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>if no such application is made within that time limit, <role refersTo="#minister">the Minister</role> may publicly disclose the information under section 61.</p>
                </content>

            </subsection>

              <num>2</num>
              <content>
                <p>The time limit must not be shorter than 20 business days after the day the notice is given.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-4__dvs-2__sec-44">
            <num>44</num>
            <heading>Application for confidential information not to be publicly disclosed</heading>
            <subsection eId="part-4__dvs-2__sec-44__subsec-1">
              <num>1</num>
              <content>
                <p>If the nominated person for confidential information is given a notice under subsection 43(1) in relation to the information, the nominated person may apply for the information not to be publicly disclosed under <ref href="#sec-61">section 61</ref>.</p>

                  <p>be made within the time limit specified in the notice; and</p>

              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-44__subsec-2__para-c">

                <content>
                  <p>be accompanied by any documents or information specified in the rules; and</p>
                </content>
              </paragraph>

                  <p>be accompanied by the fee (if any) specified in the rules.</p>
                </content>

            </subsection>
            <subsection eId="part-4__dvs-2__sec-44__subsec-3">

              <content>
                <p>The application may be made by the nominated person alone or jointly with another person.</p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-2__sec-44__subsec-4">
              <num>4</num>
              <content>
                <p>The fee specified for the purposes of paragraph (2)(d) must not be such as to amount to taxation.</p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-2__sec-44__subsec-5">
              <num>5</num>
              <content>
                <p>The rules may make provision for, or in relation to, the refund, remission or waiver of the fee specified for the purposes of paragraph (2)(d).</p>
              </content>
            </subsection>
          </section>
          <section eId="part-4__dvs-2__sec-45">
            <num>45</num>
            <heading>Minister may request further information in relation to application</heading>
            <subsection eId="part-4__dvs-2__sec-45__subsec-1">
              <num>1</num>
              <content>
                <p>If:</p>
              </content>
              <paragraph eId="part-4__dvs-2__sec-45__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>the nominated person for confidential information makes an application under subsection 44(1) in relation to the information (whether alone or jointly with another person); and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-45__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p><role refersTo="#minister">the Minister</role> needs further information to make a decision on the application;</p>
                </content>
                <content>
                  <p><role refersTo="#minister">the Minister</role> may, by written notice given to the nominated person, request the nominated person to give further information to <role refersTo="#minister">the Minister</role> within the time limit specified in the notice.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-4__dvs-2__sec-45__subsec-2">
              <num>2</num>
              <content>
                <p>The time limit must not be shorter than 20 business days after the day the notice is given.</p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-2__sec-45__subsec-3">

              <content>
                <p>If the nominated person does not give the requested further information within the time limit specified in the notice, the application is taken to be withdrawn at the end of the time limit.</p>

            <heading>Decision on application for confidential information not to be publicly disclosed</heading>
            <subsection eId="part-4__dvs-2__sec-46__subsec-1">
              <num>1</num>
              <content>
                <p>If an application is made under subsection 44(1) in relation to confidential information, <role refersTo="#minister">the Minister</role> must decide whether or not to approve the application.</p>
              </content>
              <content>
                <p>Matters <role refersTo="#minister">the Minister</role> must have regard to</p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-2__sec-46__subsec-2">
              <num>2</num>
              <content>
                <p>In deciding whether or not to approve the application, <role refersTo="#minister">the Minister</role> must have regard to:</p>
              </content>
              <paragraph eId="part-4__dvs-2__sec-46__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>whether public disclosure of the confidential information could reasonably be expected to substantially prejudice the commercial interests of an applicant; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-46__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>whether the prejudice outweighs the public interest in the public disclosure of the confidential information.</p>
                </content>
                <content>
                  <p>Minister must not approve the application in certain cases</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-4__dvs-2__sec-46__subsec-3">
              <num>3</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> must not approve the application to the extent that the application relates to confidential information that is:</p>
              </content>
              <paragraph eId="part-4__dvs-2__sec-46__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>physical and chemical data about a relevant industrial chemical that does not reveal the chemical’s composition; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-46__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>summaries of data relating to risks to human health or the environment from the export, import, manufacture or use of a relevant industrial chemical.</p>
                </content>
                <content>
                  <p>Notice of decision</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-4__dvs-2__sec-46__subsec-4">
              <num>4</num>
              <content>
                <p>If the Minister decides to approve the application, the Minister must, <quantity refersTo="#deadline">within 14 days</quantity> after making the decision, give the applicant or applicants written notice of the decision.</p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-2__sec-46__subsec-5">
              <num>5</num>
              <content>
                <p>If the Minister decides to not approve the application, the Minister must, <quantity refersTo="#deadline">within 14 days</quantity> after making the decision, give the applicant or applicants written notice of the following:</p>

                <num>a</num>
                <content>
                  <p>the decision;</p>
                </content>
              </paragraph>

                  <p>the reasons for the decision;</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-46__subsec-5__para-c">
                <num>c</num>
                <content>
                  <p>the effect of <ref href="#sec-61">section 61</ref>;</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-46__subsec-5__para-d">

                  <p>information regarding their rights to seek reconsideration or review of the decision under sections 47 and 48.</p>

            <heading>Reconsideration of decision not to approve application for confidential information not to be publicly disclosed</heading>

              <p>Request for reconsideration of original decision</p>
            </content>
            <subsection eId="part-4__dvs-2__sec-47__subsec-1">
              <num>1</num>
              <content>
                <p>	(1)	A person whose interests are affected<i> </i>by a decision (the <b><i>original decision</i></b>) made under subsection 46(1) to not approve an application made under subsection 44(1) may request the Minister to reconsider the original decision.</p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-2__sec-47__subsec-2">
              <num>2</num>
              <content>
                <p>The request must be made in writing and given to <role refersTo="#minister">the Minister</role> within:</p>
              </content>

                  <p>	(a)	20 business days after the day on which notice of<i> </i>the original decision was given under subsection 46(5); or</p>
                </content>
              </paragraph>

                  <p>	(b)	such longer period as the Minister<i> </i>allows.</p>

                  <p>Reconsideration of original decision</p>

                <p>Within 70 business days after the day the request is given, <role refersTo="#minister">the Minister</role> must reconsider the original decision.</p>

                <p>If a delegate of <role refersTo="#minister">the Minister</role> is to reconsider the original decision, the delegate must:</p>
              </content>

                <content>
                  <p>not have been involved in making the decision; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-47__subsec-4__para-b">

                  <p>occupy a position that is at least the same level as that occupied by the person who made the decision.</p>
                </content>
              </paragraph>
            </subsection>

                <p>After reconsidering the original decision, <role refersTo="#minister">the Minister</role> must:</p>
              </content>

                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-47__subsec-5__para-b">

              <paragraph eId="part-4__dvs-2__sec-47__subsec-5__para-c">

            <heading>Disclosure of protected information to Commonwealth entities</heading>

              <content>
                <p><role refersTo="#minister">The Minister</role> may disclose protected information to a Commonwealth entity if <role refersTo="#minister">the Minister</role> is satisfied that the information will assist the entity to perform its functions or exercise its powers.</p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-3__sec-52__subsec-2">
              <num>2</num>
              <content>
                <p>A person contravenes this subsection if:</p>
              </content>
              <paragraph eId="part-4__dvs-3__sec-52__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>the person is, or has been, an official of a Commonwealth entity; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-52__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>the person has obtained information in the person’s capacity as an official of the entity; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-52__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>the information is protected information that was disclosed to the entity under subsection (1); and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-52__subsec-2__para-d">
                <num>d</num>
                <content>
                  <p>the person uses or discloses the information other than for the purpose for which it was disclosed to the entity.</p>
                </content>
                <content>
                  <p>Fault-based offence</p>
                </content>
              </paragraph>

                <p>A person commits an offence if the person contravenes subsection (2). The physical elements of the offence are set out in that subsection.</p>

            <heading>Disclosure of protected information to State Environment Minister or State government body</heading>
            <content>
              <p>		The Minister (the <b><i>Commonwealth Minister</i></b>) may disclose protected information to a State Environment Minister or State government body if:</p>
            </content>
            <paragraph eId="part-4__dvs-3__sec-53__para-a">
              <num>a</num>
              <content>
                <p>the Commonwealth Minister is satisfied that the disclosure of the information is necessary for the purposes of the Commonwealth Minister performing functions, or exercising powers, under:</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__dvs-3__sec-53__para-i">
              <num>i</num>
              <content>
                <p>this Act; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__dvs-3__sec-53__para-ii">
              <num>ii</num>
              <content>
                <p>the decision-making principles; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__dvs-3__sec-53__para-iii">
              <num>iii</num>
              <content>
                <p>the rules; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__dvs-3__sec-53__para-b">
              <num>b</num>
              <content>
                <p>the State Environment Minister or State government body (as the case may be) has undertaken not to use or further disclose the information except in accordance with an agreement that:</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__dvs-3__sec-53__para-i">
              <num>i</num>
              <content>
                <p>is in force between the Commonwealth and the State; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__dvs-3__sec-53__para-ii">
              <num>ii</num>
              <content>
                <p>applies in relation to the information; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__dvs-3__sec-53__para-c">
              <num>c</num>
              <content>
                <p>the Commonwealth Minister is satisfied that the information will be used and further disclosed only in accordance with the agreement.</p>
              </content>
            </paragraph>
          </section>

            <num>54</num>
            <heading>Use or disclosure of protected information with consent</heading>
            <content>
              <p>An entrusted person may use or disclose protected information that relates to the affairs of a person if:</p>
            </content>
            <paragraph eId="part-4__dvs-3__sec-54__para-a">
              <num>a</num>
              <content>
                <p>the person has consented to the use or disclosure; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__dvs-3__sec-54__para-b">
              <num>b</num>
              <content>
                <p>the use or disclosure is in accordance with that consent.</p>
              </content>
            </paragraph>
          </section>

            <heading>Disclosure of protected information that is publicly available</heading>

              <p>An entrusted person may disclose protected information if the information has already been lawfully made available to the public.</p>

            <heading>Disclosure of protected information to person to whom protected information relates</heading>

              <p>An entrusted person may disclose protected information to the person to whom the information relates.</p>

                <p>for the purposes of proceedings before:</p>
              </content>

            <paragraph eId="part-4__dvs-3__sec-58__para-ii">
              <num>ii</num>

                <p>a tribunal, authority or person that has the power to require the answering of questions or the production of documents; or</p>

            </paragraph>
            <paragraph eId="part-4__dvs-3__sec-58__para-b">
              <num>b</num>
              <content>
                <p>in accordance with an order of a court or such a tribunal, authority or person.</p>
              </content>
            </paragraph>
          </section>

            <heading>Disclosure of protected information for the purposes of law enforcement etc.</heading>
            <subsection eId="part-4__dvs-3__sec-59__subsec-1">
              <num>1</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may disclose protected information to an enforcement body if:</p>
              </content>
              <paragraph eId="part-4__dvs-3__sec-59__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p><role refersTo="#minister">the Minister</role> reasonably believes that the disclosure of the information is necessary for:</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-59__subsec-1__para-i">
                <num>i</num>
                <content>
                  <p>the enforcement of the criminal law; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-59__subsec-1__para-ii">
                <num>ii</num>
                <content>
                  <p>the enforcement of a law imposing a pecuniary penalty; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-59__subsec-1__para-iii">
                <num>iii</num>
                <content>
                  <p>the protection of the public revenue; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-59__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>the functions of the body include that enforcement or protection; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-59__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>the information is disclosed for the purposes of that enforcement or protection.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-4__dvs-3__sec-59__subsec-2">
              <num>2</num>
              <content>
                <p>	(2)	Each of the following is an <b><i>enforcement body</i></b>:</p>
              </content>
              <paragraph eId="part-4__dvs-3__sec-59__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>a department, agency or authority of the Commonwealth;</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-59__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>a State government body;</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-59__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>the Australian Federal Police;</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-59__subsec-2__para-d">
                <num>d</num>
                <content>
                  <p>the police force or police service of a State.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
          <section eId="part-4__dvs-3__sec-60">
            <num>60</num>
            <heading>Disclosure of protected information to reduce serious risk to human health or the environment</heading>
            <content>
              <p><role refersTo="#minister">The Minister</role> may disclose protected information if:</p>
            </content>
            <paragraph eId="part-4__dvs-3__sec-60__para-a">
              <num>a</num>
              <content>
                <p><role refersTo="#minister">the Minister</role> reasonably believes that the disclosure is necessary to prevent or lessen a serious risk to human health or the environment; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__dvs-3__sec-60__para-b">
              <num>b</num>
              <content>
                <p>the disclosure is for the purposes of preventing or lessening that risk.</p>
              </content>
            </paragraph>
          </section>
          <section eId="part-4__dvs-3__sec-61">
            <num>61</num>
            <heading>Public disclosure of confidential information by the Minister</heading>
            <subsection eId="part-4__dvs-3__sec-61__subsec-1">
              <num>1</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may publicly disclose protected information that is confidential information if:</p>
              </content>
              <paragraph eId="part-4__dvs-3__sec-61__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>	(a)	the Minister has given a notice (the <b><i>proposed disclosure notice</i></b>) under subsection 43(1) in relation to the information; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-61__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>subsection (2) applies in relation to the information.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-4__dvs-3__sec-61__subsec-2">
              <num>2</num>
              <content>
                <p>This subsection applies in relation to confidential information if any of the following apply:</p>
              </content>
              <paragraph eId="part-4__dvs-3__sec-61__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>no application in relation to the information has been made under subsection 44(1) within the time limit specified in the proposed disclosure notice;</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-61__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>an application in relation to the information that was made under subsection 44(1) is taken to have been withdrawn under subsection 45(3);</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-61__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>both of the following apply:</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-61__subsec-2__para-i">
                <num>i</num>

                  <p><role refersTo="#minister">the Minister</role> has decided under subsection 46(1) to not approve an application in relation to the information that was made under subsection 44(1);</p>

                <content>
                  <p>any reconsideration and review rights under sections 47 and 48 in relation to the decision have been exhausted or have expired.</p>

            <heading>Public disclosure of Advisory Committee recommendations</heading>

              <p>If <role refersTo="#minister">the Minister</role> considers that it is appropriate to do so, <role refersTo="#minister">the Minister</role> may publicly disclose a recommendation made by the Advisory Committee in advising <role refersTo="#minister">the Minister</role> about a matter referred to in paragraph 28(a).</p>

            <heading>Disclosure of protected IC information to the Minister</heading>

            <p>Scheduling charge payable by a registered introducer for a registration year is due and payable at the same time that registration charge that is payable by the registered introducer for the registration year is due and payable.</p>

              <p>The rules may make provision for, or in relation to, the collection and recovery of scheduling charge.</p>

          </subsection>

              <p>Without limiting subsection (1), the rules may make provision for, or in relation to, any one or more of the following matters:</p>
            </content>

              <num>a</num>
              <content>
                <p>the payment of a penalty for the late payment of scheduling charge;</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-69__subsec-2__para-b">

              <content>
                <p>the refund, remission or waiver of scheduling charge;</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-69__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>the overpayment or underpayment of scheduling charge;</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-69__subsec-2__para-d">
              <num>d</num>

                <p>the payment of a penalty for the underpayment of scheduling charge;</p>

                <p>the giving of information and keeping of records relating to a person’s liability to pay scheduling charge.</p>

          <heading>Recovery of scheduling charge and late payment penalty etc.</heading>
          <subsection eId="part-5__sec-70__subsec-1">
            <num>1</num>
            <content>
              <p>Scheduling charge that is due and payable:</p>
            </content>
            <paragraph eId="part-5__sec-70__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>is a debt due to the Commonwealth; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-70__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>may be recovered by the Executive Director, on behalf of the Commonwealth, in:</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-70__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>the Federal Court; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-70__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>the Federal Circuit and Family Court of Australia (<ref href="#dvs-2">Division 2</ref>); or</p>

              <p>If a penalty for the late payment, or the underpayment, of scheduling charge is due and payable, the penalty:</p>

                <p>is a debt due to the Commonwealth; and</p>
              </content>

            <p><role refersTo="#minister">The Minister</role> may, on behalf of the Commonwealth, engage consultants to assist <role refersTo="#minister">the Minister</role> in the performance of <role refersTo="#minister">the Minister</role>’s functions, or the exercise of <role refersTo="#minister">the Minister</role>’s powers, under:</p>

            <num>a</num>
            <content>
              <p>this Act; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-6__sec-73__para-b">
            <num>b</num>
            <content>
              <p>the decision-making principles; or</p>

          <paragraph eId="part-6__sec-73__para-c">
            <num>c</num>
            <content>
              <p>the rules.</p>

          <heading>Delegation by the Minister</heading>

              <p><role refersTo="#minister">The Minister</role> may, in writing, delegate all or any of <role refersTo="#minister">the Minister</role>’s functions or powers under this Act, the decision-making principles or the rules to the following:</p>

              <num>a</num>
              <content>
                <p><role refersTo="#secretary">the Secretary</role> of the Environment Department;</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-74__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>an SES employee, or acting SES employee, in the Environment Department;</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-74__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>a person who holds, or is acting in, an Executive Level 1 or 2, or equivalent, position in the Environment Department.</p>
              </content>
            </paragraph>
          </subsection>

              <p>Despite subsection (1), <role refersTo="#minister">the Minister</role> must not delegate <role refersTo="#minister">the Minister</role>’s functions or powers under the following provisions of this Act:</p>

                <p>an SES employee, or acting SES employee, in the Environment Department;</p>
              </content>
            </paragraph>

              <p>The Executive Director may, in writing, delegate all or any of the Executive Director’s functions or powers under this Act or the rules to the following:</p>

              <num>a</num>
              <content>
                <p>an SES employee, or acting SES employee, in the Environment Department or the Health Department;</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-75__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>a person who holds, or is acting in, an Executive Level 1 or 2, or equivalent, position in the Environment Department or the Health Department.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-6__sec-75__subsec-2">
            <num>2</num>
            <content>
              <p>A person exercising powers or performing functions under a delegation under subsection (1) must comply with any written directions of the Executive Director.</p>

          <heading>Rules</heading>
          <subsection eId="part-6__sec-76__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, make rules prescribing matters:</p>
            </content>
            <paragraph eId="part-6__sec-76__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>required or permitted by this Act to be prescribed by the rules; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-76__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>necessary or convenient to be prescribed for carrying out or giving effect to this Act.</p>

                <p>create an offence or civil penalty;</p>

              <p>	(3)	Despite subsection 14(2) of the <i>Legislation Act 2003</i>, the rules may make provision in relation to a matter by applying, adopting or incorporating, with or without modification, a matter contained in an instrument or writing:</p>

                  <b>Misdescribed amendments</b>
                </p>
                <p>A misdescribed amendment is an amendment that does not accurately describe how an amendment is to be made. If, despite the misdescription, the amendment can be given effect as intended, then the misdescribed amendment can be incorporated through an editorial change made under <i>Legislation Act 2003</i>.<ref href="#sec-15V">section 15V</ref> of the </p>
