              <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

          <heading>Object of this Act</heading>
          <content>
            <p>The object of this Act is to provide for the independent assessment of:</p>
          </content>

              <p>APRA’s effectiveness and capability; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-b">
            <num>b</num>
            <content>
              <p>ASIC’s effectiveness and capability.</p>

          <num>4</num>
          <heading>Simplified outline of this Act</heading>
          <content>
            <p>This Act establishes the Financial Regulator Assessment Authority.</p>
            <p>Every 5 financial years, <role refersTo="#authority">the Authority</role> is to assess the effectiveness and capability of APRA and ASIC and then report to <role refersTo="#minister">the Minister</role>. <role refersTo="#authority">The Authority</role> is also to undertake ad hoc assessments on any matter relating to APRA’s, or ASIC’s, effectiveness and capability when requested by <role refersTo="#minister">the Minister</role>.</p>
            <p><role refersTo="#authority">The Authority</role> consists of the Chair and 2 other members. It is assisted by APS employees in the Department whose services are made available by <role refersTo="#secretary">the Secretary</role>.</p>
            <p><role refersTo="#authority">The Authority</role> may request information from APRA and ASIC. There are limitations on how some of this information can be used and disclosed.</p>

          <num>5</num>
          <heading>Definitions</heading>
          <content>
            <p>In this Act:</p>
            <p><b><i>5</i></b><b><i>-</i></b><b><i>yearly report</i></b> means a report mentioned in paragraph 12(1)(a) or (b).</p>
            <p><term refersTo="#term-apra">APRA</term> means <def>the Australian Prudential Regulation Authority.</def></p>
            <p><term refersTo="#term-asic">ASIC</term> means <def>the Australian Securities and Investments Commission.</def></p>
            <p><term refersTo="#term-authority">Authority</term> means <def>the Financial Regulator Assessment Authority.</def></p>
            <p><term refersTo="#term-chair">Chair</term> means <def>the Chair of the Authority.</def></p>
            <p><term refersTo="#term-enforcement-body">enforcement body</term> has the same meaning as <def>in <ref href="">the Privacy Act 1988</ref>.</def></p>
            <p><term refersTo="#term-enforcement-related-activity">enforcement related activity</term> has the same meaning as <def>in <ref href="">the Privacy Act 1988</ref>.</def></p>
            <p><b><i>entrusted person</i></b> means:</p>
          </content>

            <num>a</num>

              <p>a member; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-b">
            <num>b</num>
            <content>
              <p>a staff member; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-c">
            <num>c</num>
            <content>
              <p><role refersTo="#secretary">the Secretary</role>; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-d">
            <num>d</num>
            <content>
              <p>an APS employee; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-e">
            <num>e</num>
            <content>
              <p>a consultant engaged under <ref href="#sec-37">section 37</ref>; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-f">
            <num>f</num>
            <content>
              <p>any other person employed or engaged to provide services to the Commonwealth in connection with <role refersTo="#authority">the Authority</role>; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-g">
            <num>g</num>
            <content>
              <p>an officer or employee of a person mentioned in paragraph (e) or (f) whose duties relate to <role refersTo="#authority">the Authority</role>.</p>
            </content>
            <content>
              <p><term refersTo="#term-member">member</term> means <def>a member of the Authority and includes the Chair.</def></p>
              <p><term refersTo="#term-officer">officer</term> has the same meaning as <def>in <ref href="#sec-9">section 9</ref> of <ref href="">the Corporations Act 2001</ref>.</def></p>
              <p><term refersTo="#term-paid-work">paid work</term> means <def>work for financial gain or reward (whether as an employee, a self-employed person or otherwise).</def></p>
              <p><term refersTo="#term-protected-information">protected information</term> means <def>information of any of the following kinds that is obtained by the Authority from APRA or ASIC (the source agency): information that is prohibited from being disclosed by a person under: a law of the Commonwealth other than this Act; or a law of a State or Territory; information the disclosure of which by the source agency would or could reasonably be expected to found an action by a person (other than the Commonwealth) for breach of a duty of confidence; information that is protected against disclosure by legal professional privilege; information the disclosure of which: could reasonably be expected to prejudice the security, defence or international relations of Australia; or could reasonably be expected to prejudice relations between the Commonwealth Government and the Government of a State or Territory; or would involve disclosing deliberations or decisions of the Cabinet, or of a Committee of the Cabinet; or could reasonably be expected to endanger a person’s life or physical safety; or could reasonably be expected to prejudice one or more enforcement related activities; or 	(vi)	would involve unreasonably disclosing personal information (within the meaning of the <i>Privacy Act 1988</i>). who the law prohibits from disclosing the information; the circumstances in which the law prohibits the disclosure.</def></p>

          <paragraph eId="part-1__sec-5__para-a">
            <num>a</num>
            <content>
              <p>information that is prohibited from being disclosed by a person under:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-i">
            <num>i</num>
            <content>
              <p>a law of the Commonwealth other than this Act; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-ii">
            <num>ii</num>
            <content>
              <p>a law of a State or Territory;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-b">
            <num>b</num>
            <content>
              <p>information the disclosure of which by the source agency would or could reasonably be expected to found an action by a person (other than the Commonwealth) for breach of a duty of confidence;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-c">
            <num>c</num>
            <content>
              <p>information that is protected against disclosure by legal professional privilege;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-d">
            <num>d</num>
            <content>
              <p>information the disclosure of which:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-i">
            <num>i</num>
            <content>
              <p>could reasonably be expected to prejudice the security, defence or international relations of Australia; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-ii">
            <num>ii</num>
            <content>
              <p>could reasonably be expected to prejudice relations between the Commonwealth Government and the Government of a State or Territory; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-iii">
            <num>iii</num>
            <content>
              <p>would involve disclosing deliberations or decisions of the Cabinet, or of a Committee of the Cabinet; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-iv">
            <num>iv</num>
            <content>
              <p>could reasonably be expected to endanger a person’s life or physical safety; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-v">
            <num>v</num>
            <content>
              <p>could reasonably be expected to prejudice one or more enforcement related activities; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-vi">
            <num>vi</num>
            <content>
              <p>	(vi)	would involve unreasonably disclosing personal information (within the meaning of the <i>Privacy Act 1988</i>).</p>

              <p><term refersTo="#term-secretary">Secretary</term> means <def>the Secretary of the Department.</def></p>
              <p><term refersTo="#term-staff-member">staff member</term> means <def>a member of the staff assisting the Authority (see <ref href="#sec-36">section 36</ref>).</def></p>
              <p><term refersTo="#term-use">use</term> includes <def>make a record of.</def></p>

        </section>

          <heading>Act binds the Crown</heading>

              <p>This Act binds the Crown in each of its capacities.</p>
            </content>

              <p>This Act does not make the Crown liable to be prosecuted for an offence.</p>

                  <p>to assess and report to <role refersTo="#minister">the Minister</role> on ASIC’s effectiveness and capability;</p>

                  <p>at any time when requested by <role refersTo="#minister">the Minister</role>, to assess and report to <role refersTo="#minister">the Minister</role> on any matter relating to:</p>

                <p>However, the functions of <role refersTo="#authority">the Authority</role> do not include assessing or reporting on only a single case.</p>

            </subsection>
            <subsection eId="part-2__dvs-3__sec-12__subsec-3">

              <content>
                <p>For the purposes of paragraph (1)(a), (b) or (c), <role refersTo="#authority">the Authority</role> may:</p>
              </content>
              <paragraph eId="part-2__dvs-3__sec-12__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>undertake an assessment itself; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-12__subsec-3__para-b">

                <content>
                  <p>cause an assessment, or the preparation of the resulting report, to be undertaken by someone else.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
          <section eId="part-2__dvs-3__sec-13">
            <num>13</num>
            <heading>Timing and requests relating to the 5-yearly assessment and reporting functions</heading>
            <subsection eId="part-2__dvs-3__sec-13__subsec-1">
              <num>1</num>
              <content>
                <p><role refersTo="#authority">The Authority</role> must undertake each of the assessments mentioned in paragraphs 12(1)(a) and (b):</p>
              </content>
              <paragraph eId="part-2__dvs-3__sec-13__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>once in the period that begins at the start of <date date="2023-07-01">1 July 2023</date> and ends at the end of <date date="2028-06-30">30 June 2028</date>; and</p>

              </paragraph>

                <num>b</num>
                <content>
                  <p>once in each successive period of 5 financial years.</p>
                </content>

                <p><role refersTo="#minister">The Minister</role> may request <role refersTo="#authority">the Authority</role> to:</p>

                  <p>consider one or more matters; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-13__subsec-2__para-b">

                  <p>not consider one or more matters;</p>
                </content>
                <content>
                  <p>when undertaking such an assessment.</p>
                </content>
              </paragraph>
            </subsection>

                <p><role refersTo="#authority">The Authority</role> must comply with such a request.</p>
              </content>
            </subsection>

                <p>If such a request is made in writing, the request is not a legislative instrument.</p>
              </content>
            </subsection>

                <p><role refersTo="#minister">The Minister</role> may withdraw or amend such a request at any time before <role refersTo="#authority">the Authority</role> reports to <role refersTo="#minister">the Minister</role>.</p>

            <heading>Requests relating to the ad hoc assessment and reporting function</heading>

                <p><role refersTo="#minister">The Minister</role> may request <role refersTo="#authority">the Authority</role> to assess and report on a matter mentioned in paragraph 12(1)(c).</p>

              <num>2</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may include in such a request terms of reference (including timeframes) for the assessment and report.</p>

              <num>3</num>
              <content>
                <p><role refersTo="#authority">The Authority</role> must comply with such a request.</p>
              </content>
            </subsection>

                <p>If such a request is made in writing, the request is not a legislative instrument.</p>

            </subsection>

            <heading>Assessments and reviews undertaken by others</heading>
            <subsection eId="part-2__dvs-3__sec-15__subsec-1">

              <content>
                <p>In performing the functions mentioned in paragraphs 12(1)(a) to (c), <role refersTo="#authority">the Authority</role> may take into account any of the following that <role refersTo="#authority">the Authority</role> considers relevant:</p>

                <num>a</num>
                <content>
                  <p>an assessment relating to:</p>
                </content>
              </paragraph>

                  <p>APRA’s effectiveness and capability; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-15__subsec-1__para-ii">

                  <p>ASIC’s effectiveness and capability;</p>
                </content>
                <content>
                  <p>undertaken by someone other than <role refersTo="#authority">the Authority</role>;</p>

                  <p>a review relating to APRA or ASIC undertaken by someone other than <role refersTo="#authority">the Authority</role>.</p>

                <p>Subsection (1) does not limit the matters <role refersTo="#authority">the Authority</role> may take into account in performing its functions or exercising its powers.</p>

            <heading>Reports to be given to APRA or ASIC</heading>

                <p>If the recipient of the proposed report gives written comments to <role refersTo="#authority">the Authority</role>, <role refersTo="#authority">the Authority</role> must consider the comments before giving the final report to <role refersTo="#minister">the Minister</role>.</p>

                <p>Final reports</p>

            </subsection>

                <p>If <role refersTo="#authority">the Authority</role> gives a report mentioned in section 12 to <role refersTo="#minister">the Minister</role>, <role refersTo="#authority">the Authority</role> must give a copy to the following:</p>

                  <p>if the report relates to APRA—APRA;</p>
                </content>

                <p><role refersTo="#authority">The Authority</role> must not publish a report mentioned in section 12 unless the report has been tabled in a House of the Parliament or published by <role refersTo="#minister">the Minister</role>.</p>

            <heading>5-yearly reports must be tabled</heading>
            <content>
              <p><role refersTo="#minister">The Minister</role> must cause a copy of a 5-yearly report to be tabled in each House of the Parliament within 20 sitting days of that House after the report is received by <role refersTo="#minister">the Minister</role>.</p>

            <heading>Powers</heading>

              <p><role refersTo="#authority">The Authority</role> has power to do all things necessary or convenient to be done for or in connection with the performance of its functions.</p>

            <heading>Independence</heading>
            <content>
              <p>Subject to this Act and to other laws of the Commonwealth:</p>
            </content>

                <p><role refersTo="#authority">the Authority</role> has complete discretion in the performance of <role refersTo="#authority">the Authority</role>’s functions and the exercise of <role refersTo="#authority">the Authority</role>’s powers; and</p>

              <num>b</num>
              <content>
                <p><role refersTo="#authority">the Authority</role> is not subject to direction from anyone in relation to:</p>

                <p>how a particular assessment will be undertaken; or</p>

              <p>A member holds office on the terms and conditions (if any) in relation to matters not covered by this Act that are determined by <role refersTo="#minister">the Minister</role>.</p>

            <heading>Other paid work</heading>
            <content>
              <p>A member must not engage in any paid work that, in <role refersTo="#minister">the Minister</role>’s opinion, conflicts or could conflict with the proper performance of the member’s duties.</p>

            <heading>Disclosure of interests</heading>
            <subsection eId="part-3__dvs-3__sec-31__subsec-1">

                <p>	(1)	A disclosure by a member under <i>Public Governance, Performance and Accountability Act 2013</i> (which deals with the duty to disclose interests) must be made to the Minister.<ref href="#sec-29">section 29</ref> of the </p>

                <p>Subsection (1) applies in addition to any rules made for the purposes of that section.</p>

            <heading>Resignation</heading>

                <p>A member may resign the member’s appointment by giving <role refersTo="#minister">the Minister</role> a written resignation.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-32__subsec-2">
              <num>2</num>
              <content>
                <p>The resignation takes effect on the day it is received by <role refersTo="#minister">the Minister</role> or, if a later day is specified in the resignation, on that later day.</p>

            </subsection>
          </section>

            <heading>Termination of appointment</heading>
            <subsection eId="part-3__dvs-3__sec-33__subsec-1">
              <num>1</num>

                <p><role refersTo="#minister">The Minister</role> may terminate the appointment of a member:</p>
              </content>
              <paragraph eId="part-3__dvs-3__sec-33__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>for misbehaviour; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-33__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>if the member is unable to perform the duties of the member’s office because of physical or mental incapacity.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-33__subsec-2">

              <content>
                <p><role refersTo="#minister">The Minister</role> may terminate the appointment of a member if:</p>
              </content>
              <paragraph eId="part-3__dvs-3__sec-33__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>the member:</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-33__subsec-2__para-i">
                <num>i</num>

                  <p>becomes bankrupt; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-33__subsec-2__para-ii">
                <num>ii</num>
                <content>
                  <p>applies to take the benefit of any law for the relief of bankrupt or insolvent debtors; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-33__subsec-2__para-iii">
                <num>iii</num>

                  <p>compounds with the member’s creditors; or</p>
                </content>
              </paragraph>

                  <p>makes an assignment of the member’s remuneration for the benefit of the member’s creditors; or</p>
                </content>
              </paragraph>

                  <p>the member is absent, except on leave of absence, from 3 consecutive meetings of <role refersTo="#authority">the Authority</role>; or</p>

                  <p>the member engages in paid work that, in <role refersTo="#minister">the Minister</role>’s opinion, conflicts or could conflict with the proper performance of member’s duties (see section 30); or</p>

                <p>The Chair must convene such meetings of <role refersTo="#authority">the Authority</role> as are, in the Chair’s opinion, necessary for the efficient performance of <role refersTo="#authority">the Authority</role>’s functions and exercise of <role refersTo="#authority">the Authority</role>’s powers.</p>

          <heading>Delegation by Minister</heading>
          <subsection eId="part-5__sec-48__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> may, in writing, delegate to:</p>
            </content>
            <paragraph eId="part-5__sec-48__subsec-1__para-a">
              <num>a</num>
              <content>
                <p><role refersTo="#secretary">the Secretary</role>; or</p>
              </content>
            </paragraph>

                <p>subsections 16(1) and (3) (reports to be given to APRA or ASIC);</p>

              <p><role refersTo="#authority">The Authority</role> may, in writing, delegate <role refersTo="#authority">the Authority</role>’s functions or powers under subsection 20(2) (cooperation with Authority) to:</p>

                <p>a member; or</p>
              </content>
            </paragraph>

          <heading>Rules</heading>
          <subsection eId="part-5__sec-51__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, make rules prescribing matters:</p>
            </content>
            <paragraph eId="part-5__sec-51__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>required or permitted by this Act to be prescribed by the rules; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-51__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>necessary or convenient to be prescribed for carrying out or giving effect to this Act.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-5__sec-51__subsec-2">
            <num>2</num>
            <content>
              <p>To avoid doubt, the rules may not do the following:</p>
            </content>

                <p>create an offence or civil penalty;</p>
              </content>

                <p>A misdescribed amendment is an amendment that does not accurately describe how an amendment is to be made. If, despite the misdescription, the amendment can be given effect as intended, then the misdescribed amendment can be incorporated through an editorial change made under <i>Legislation Act 2003</i>.<ref href="#sec-15V">section 15V</ref> of the </p>
