          <p>Legislation that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.</p>

              <content>
                <p><role refersTo="#minister">The Minister</role> may, by legislative instrument:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-30EK__para-a">
              <num>a</num>
              <content>
                <p>	(a)	declare that there is a serious scarcity of specified medicine (the <b><i>scarce medicine</i></b>) across the whole or a specified part or parts of Australia; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30EK__para-b">
              <num>b</num>
              <content>
                <p>	(b)	specify the medicine (the <b><i>substitutable medicine</i></b>) that pharmacists are permitted to dispense in substitution for the scarce medicine and specify the circumstances in which that substitution is permitted.</p>
              </content>
            </paragraph>

                <p><role refersTo="#minister">The Minister</role> may make an instrument under subsection (1) only if <role refersTo="#minister">the Minister</role> is satisfied:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-30EK__para-a">
              <num>a</num>
              <content>
                <p>that either or both of the following apply:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30EK__para-i">
              <num>i</num>
              <content>
                <p>the supply of the scarce medicine in Australia is not currently meeting the demand for that medicine for all of the patients in Australia who take that medicine;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30EK__para-ii">
              <num>ii</num>
              <content>
                <p>there is an imminent risk that supply of the scarce medicine in Australia will not, or will not be likely to, meet the demand for that medicine for all of the patients in Australia who take, or who may need to take, that medicine; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30EK__para-b">
              <num>b</num>
              <content>
                <p>that there is a significant risk of adverse health consequences for patients in Australia if those patients are unable to take the scarce medicine; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30EK__para-c">
              <num>c</num>
              <content>
                <p>of any other matters prescribed by the regulations for the purposes of this paragraph.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-30EK__subclause-3">
              <num>3</num>
              <content>
                <p>The scarce medicine, and the substitutable medicine, must be medicine:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-30EK__para-a">
              <num>a</num>
              <content>
                <p>that contains one or more substances included in Schedule 4 to the current Poisons Standard; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30EK__para-b">
              <num>b</num>
              <content>
                <p>that does not contain any substances included in Schedule 8 to that standard.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-30EK__subclause-4">
              <num>4</num>
              <content>
                <p>Without limiting paragraph (1)(b), the circumstances may relate to:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-30EK__para-a">
              <num>a</num>
              <content>
                <p>the class of persons for whom the substitutable medicine is suitable; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30EK__para-b">
              <num>b</num>
              <content>
                <p>the class of persons for whom the substitutable medicine is not suitable.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-30EK__subclause-5">
              <num>5</num>
              <content>
                <p>Unless sooner revoked, an instrument under subsection (1) remains in force for the period specified in the instrument.</p>
              </content>

              <num>6</num>
              <content>
                <p>	(6)	For the purposes of this section, a <b><i>pharmacist</i></b> is a person registered as a pharmacist under a law of a State or Territory providing for the registration of pharmacists.</p>

            <heading>Substitution of prescription medicine by pharmacists</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-30EL__subclause-1">
              <num>1</num>

                <p>If:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-30EL__para-a">
              <num>a</num>
              <content>
                <p>an instrument is in force under subsection 30EK(1); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30EL__para-b">
              <num>b</num>
              <content>
                <p>	(b)	under a law of a State or Territory, a pharmacist is authorised to dispense medicine (the <b><i>scarce medicine</i></b>) covered by paragraph 30EK(1)(a) to a person;</p>
              </content>
            </paragraph>
            <content>
              <p>then, despite any law of a State or Territory, the pharmacist may dispense medicine covered by paragraph 30EK(1)(b) to that person in substitution for the scarce medicine, provided that the substitution is in the circumstances specified in the instrument under subsection 30EK(1).</p>

              <content>
                <p>	(2)	For the purposes of this section, a <b><i>pharmacist</i></b> is a person registered as a pharmacist under a law of a State or Territory providing for the registration of pharmacists.</p>

              <p>Insert:</p>
              <p>(10AA)	The power of <role refersTo="#minister">the Minister</role> under subsection 30EK(1) may be delegated only to <role refersTo="#secretary">the Secretary</role> or to an SES employee, or acting SES employee, in the Department.</p>

              <p>Insert:</p>
              <p><b><i>personal information </i></b>has the same meaning as in the <i>Privacy Act 1988</i>.</p>
              <p><b><i>unique device identifier </i></b>of a medical device means any combination of numbers, symbols and letters given to the device to enable identification of the device (whether or not that combination also allows identification of information relating to the device).</p>

            <heading>Section 41C</heading>
            <content>
              <p>Omit “compliance with essential principles.”, substitute “compliance with essential principles. The regulations may make provision for and in relation to <role refersTo="#secretary">the Secretary</role> causing a database of unique device identifiers of medical devices to be established and maintained.”.</p>

                <p>Regulations made for the purposes of subsection (1) may include requirements in relation to the inclusion in the database referred to in <ref href="#sec-41C">section 41C</ref>E of the following:</p>

                <p>The regulations must provide that the database must not include personal information, unless the personal information:</p>

                <p>is the name of a person in relation to whom a kind of medical device is included in the Register; or</p>
              </content>
            </paragraph>

                <p>is about an authorised representative of the manufacturer of a kind of medical device; or</p>
              </content>
            </paragraph>

                <p>is about an authorised representative of a person in relation to whom a kind of medical device is included in the Register.</p>

                <p>An APS employee in the Department who, for the purpose of finding out whether this Act or the regulations have been complied with, obtains, possesses or conveys, or facilitates the conveyance of, goods is not criminally responsible for an offence against a law of the Commonwealth, or a State law, relating to the obtaining, possession, conveyance or facilitation of the conveyance of the goods.</p>

                <p>If an APS employee in the Department, in connection with finding out whether this Act or the regulations have been complied with, arranges for another person to convey goods, the other person is not criminally responsible for an offence against a law of the Commonwealth, or a State law, relating to:</p>

                <p>the possession of the goods by the other person, to the extent the possession is in connection with that conveyance of the goods; or</p>

              <p>Section 62 of the <i>Therapeutic Goods Act 1989</i>, as inserted by this Schedule, applies in relation to the obtaining, possession, conveyance or facilitation of the conveyance of goods on or after the commencement of this item.</p>

            <heading>Simplified outline of this Chapter</heading>
            <content>
              <p>The regulations may prohibit imports into Australia, exports from Australia, the manufacture in Australia and supplies in Australia of therapeutic goods, or therapeutic goods containing a particular ingredient or component, to give effect to international agreements to which Australia is a party.</p>
              <p>There is an offence and a civil penalty for contravening such a prohibition.</p>

                <p>Before regulations are made prescribing an international agreement for the purposes of subsection (1), <role refersTo="#minister">the Minister</role> must be satisfied that the agreement requires parties to the agreement to take steps to prohibit or restrict one or more of the import, export, manufacture and supply of certain goods.</p>

              <num>3</num>
              <content>
                <p>If an ingredient or component of therapeutic goods is the subject of an international agreement prescribed for the purposes of this subsection, the regulations may prohibit one or more of the following:</p>

              <num>a</num>
              <content>
                <p>the import into Australia of all or specified therapeutic goods that contain that ingredient or component;</p>
              </content>
            </paragraph>

              <num>b</num>
              <content>
                <p>the export from Australia of all or specified therapeutic goods that contain that ingredient or component;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-9K__para-c">
              <num>c</num>
              <content>
                <p>the manufacture in Australia of all or specified therapeutic goods that contain that ingredient or component;</p>
              </content>
            </paragraph>

              <num>d</num>

                <p>the supply in Australia of all or specified therapeutic goods that contain that ingredient or component.</p>

              <content>
                <p>Before regulations are made prescribing an international agreement for the purposes of subsection (3), <role refersTo="#minister">the Minister</role> must be satisfied that the agreement requires parties to the agreement to take steps to prohibit or restrict one or more of the import, export, manufacture and supply of goods containing that ingredient or component.</p>

              <num>5</num>
              <content>
                <p>A prohibition referred to in subsection (1) or (3) may be absolute or be subject to such conditions as are prescribed.</p>

              <num>6</num>
              <content>
                <p>Regulations containing a prohibition referred to in subsection (1) or (3) must not be made unless:</p>
              </content>

              <num>a</num>
              <content>
                <p><role refersTo="#minister">the Minister</role> causes to be published on the Department’s website a notice setting out details of:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-9K__para-i">
              <num>i</num>
              <content>
                <p>the international agreement; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-9K__para-ii">
              <num>ii</num>
              <content>
                <p><role refersTo="#minister">the Minister</role>’s satisfaction mentioned in subsection (2) or (4); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-9K__para-iii">
              <num>iii</num>
              <content>
                <p>the proposed prohibition; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-9K__para-b">
              <num>b</num>
              <content>
                <p>a period of 30 days has passed since the notice was published.</p>
              </content>
            </paragraph>

                <p>Regulations containing a prohibition referred to in subsection (1) or (3) must not be expressed to commence on a day earlier than the day the international agreement enters into force for Australia.</p>

                <p>Without limiting subsection (5), regulations prescribing conditions referred to in that subsection may do one or more of the following:</p>

                <p>make provision in relation to a matter by conferring on <role refersTo="#minister">the Minister</role> or Secretary a power to make a decision of an administrative character;</p>

                <p>refer to <role refersTo="#minister">the Minister</role> or Secretary being satisfied of one or more specified matters;</p>

                <p>an absolute prohibition in force for the purposes of subsection 9K(1) or (3); or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-9L__para-ii">
              <num>ii</num>
              <content>
                <p>one or more conditions of a prohibition in force for the purposes of subsection 9K(1) or (3).</p>

            </paragraph>

            <heading>Application of Customs Act 1901</heading>
            <content>
              <p>If:</p>
              <p>the <i>Customs Act 1901</i> has effect as if the goods included in that importation or exportation were goods described as forfeited to the Crown under section 229 of that Act because they were:</p>
              <p>as the case requires.</p>
            </content>

              <num>a</num>
              <content>
                <p>the importation or exportation of goods is an offence under subsection 9L(1) or a contravention of subsection 9L(2); and</p>

                <p>	(b)	the Secretary notifies the Comptroller-General of Customs in writing that the Secretary wishes the <i>Customs Act 1901</i> to apply to that importation or exportation;</p>
