        <heading>Short title</heading>

          <p>		This Act is the <i>Tertiary Education Quality and Standards Agency (Charges)</i><i> Act 20</i><i>21</i>.</p>

        <heading>Commencement</heading>
        <subsection eId="sec-2__subsec-1">
          <num>1</num>
          <content>
            <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

        <heading>Crown to be bound</heading>
        <content>
          <p><i>	</i><i>	</i>This Act binds the Crown in each of its capacities.</p>

        <heading>Act does not impose tax on property of a State</heading>
        <subsection eId="sec-4__subsec-1">
          <num>1</num>
          <content>
            <p>This Act does not impose a tax on property of any kind belonging to a State.</p>
          </content>
        </subsection>
        <subsection eId="sec-4__subsec-2">
          <num>2</num>
          <content>
            <p>	(2)	<b><i>Property of any kind belonging to a State</i></b> has the same meaning as in section 114 of the Constitution.</p>
          </content>
        </subsection>
      </section>
      <section eId="sec-5">
        <num>5</num>
        <heading>Definitions</heading>
        <content>
          <p>In this Act:</p>
          <p><b><i>property of any kind belonging to a State</i></b>: see subsection 4(2).</p>
          <p><term refersTo="#term-registered-higher-education-provider">registered higher education provider</term> has the same meaning as <def>in <ref href="">the Tertiary Education Quality and Standards Agency Act 2011</ref>.</def></p>
          <p><term refersTo="#term-registered-higher-education-provider-charge">registered higher education provider charge</term> means <def>charge imposed by <ref href="#sec-6">section 6</ref>.</def></p>
          <p><term refersTo="#term-teqsa">TEQSA</term> means <def>the Tertiary Education Quality and Standards Agency.</def></p>
          <p><term refersTo="#term-year">year</term> means <def>calendar year.</def></p>

      <section eId="sec-6">
        <num>6</num>
        <heading>Imposition of registered higher education provider charge</heading>
        <content>
          <p>A charge is imposed by this section on a body, for a year starting on or after the commencement of this section, if the body is a registered higher education provider at the start of the year.</p>
        </content>
      </section>
      <section eId="sec-7">
        <num>7</num>
        <heading>Amount of registered higher education provider charge</heading>
        <subsection eId="sec-7__subsec-1">
          <num>1</num>
          <content>
            <p>The amount of registered higher education provider charge for a year for a registered higher education provider is the amount (including a nil amount):</p>
          </content>
          <paragraph eId="sec-7__subsec-1__para-a">
            <num>a</num>
            <content>
              <p>prescribed by the regulations for that year; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7__subsec-1__para-b">
            <num>b</num>
            <content>
              <p>worked out for that year in accordance with a method prescribed by the regulations.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-7__subsec-2">
          <num>2</num>
          <content>
            <p>Without limiting paragraph (1)(b), the regulations may provide for the amount of registered higher education provider charge for a year for a registered higher education provider to be equal to the sum of such components as are prescribed by the regulations.</p>
          </content>
        </subsection>
        <subsection eId="sec-7__subsec-3">
          <num>3</num>
          <content>
            <p>Before the Governor-General makes regulations for the purposes of subsection (1), <role refersTo="#minister">the Minister</role> must be satisfied that the effect of those regulations will be to recover no more than the Commonwealth’s likely costs in connection with TEQSA’s performance of its functions under a Commonwealth law.</p>

            <p>	(4)	For the purposes of subsection (3), disregard any costs that are likely to be offset by fees determined by TEQSA under <i>Tertiary Education Quality and Standards Agency Act 2011</i>.<ref href="#sec-158">section 158</ref> of the </p>

          <num>5</num>

            <p>The regulations may provide for indexation of amounts specified in the regulations.</p>

          <p>The regulations may provide for exemptions from registered higher education provider charge.</p>

        <heading>Regulations</heading>
        <content>
          <p>The Governor-General may make regulations prescribing matters:</p>
        </content>

          <num>a</num>
          <content>
            <p>required or permitted by this Act to be prescribed; or</p>
          </content>
        </paragraph>
        <paragraph eId="sec-9__para-b">
          <num>b</num>
          <content>
            <p>necessary or convenient to be prescribed for carrying out or giving effect to this Act.</p>

              <b>Editorial changes</b>
            </p>
            <p>The <i>Legislation Act 2003</i> authorises First Parliamentary Counsel to make editorial and presentational changes to a compiled law in preparing a compilation of the law for registration. The changes must not change the effect of the law. Editorial changes take effect from the compilation registration date.</p>
            <p>If the compilation includes editorial changes, the endnotes include a brief outline of the changes in general terms. Full details of any changes can be obtained from the Office of Parliamentary Counsel.</p>

              <b>Misdescribed amendments</b>
            </p>
            <p>A misdescribed amendment is an amendment that does not accurately describe the amendment to be made. If, despite the misdescription, the amendment can be given effect as intended, the amendment is incorporated into the compiled law and the abbreviation “(md)” added to the details of the amendment included in the amendment history.</p>
            <p>If a misdescribed amendment cannot be given effect as intended, the abbreviation “(md not incorp)” is added to the details of the amendment included in the amendment history.</p>
