          <p>		This Act is the <i>Australian Organ and Tissue Donation and Transplantation Authority Amendment</i><i> </i><i>(Governance</i><i> and Other Measures</i><i>) </i><i>Act 20</i><i>21</i>.</p>

            <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

              <p>The following is a simplified outline of this Act:</p>
              <p>This Act establishes the Australian Organ and Tissue Donation and Transplantation Authority. <role refersTo="#authority">The Authority</role> has a number of functions relating to organ or tissue donation and transplantation matters.</p>
              <p><role refersTo="#authority">The Authority</role> consists of the Chief Executive Officer and the staff of <role refersTo="#authority">the Authority</role>. The functions of <role refersTo="#ceo">the CEO</role> include:</p>
              <p>The Australian Organ and Tissue Donation and Transplantation Advisory Board is also established by this Act. The Advisory Board’s main function is advising <role refersTo="#ceo">the CEO</role> about a number of matters including organ or tissue donation and transplantation matters.</p>
              <p>The Act also provides for <role refersTo="#ceo">the CEO</role> to establish expert advisory committees and for <role refersTo="#authority">the Authority</role> to make grants relating to organ or tissue donation and transplantation matters.</p>

                <p>with respect to the granting of financial assistance to a constitutional corporation for the purposes of carrying out the corporation’s activities; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-15__para-h">
              <num>h</num>
              <content>
                <p>with respect to the provision of medical services; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-15__para-i">

                <p>with respect to a postal, telegraphic, telephonic or other like service; or</p>

            </paragraph>

                <p><role refersTo="#minister">The Minister</role> may terminate the appointment of an Advisory Board member if:</p>

                <p>the Advisory Board member:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-38__para-i">

            <paragraph eId="schedule-1__clause-38__para-ii">
              <num>ii</num>
              <content>
                <p>applies to take the benefit of any law for the relief of bankrupt or insolvent debtors; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-38__para-iii">
              <num>iii</num>
              <content>
                <p>compounds with that member’s creditors; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-38__para-iv">
              <num>iv</num>
              <content>
                <p>makes an assignment of that member’s remuneration for the benefit of that member’s creditors; or</p>
              </content>
            </paragraph>

                <p>the Advisory Board member is absent, except on leave of absence, from 3 consecutive meetings of the Advisory Board; or</p>

                <p>This item applies to an expert advisory committee if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-5__para-a">
              <num>a</num>
              <content>
                <p>the committee was established by the Board under <ref href="#sec-44">section 44</ref> of the OTA Act before the commencement time; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-5__para-b">
              <num>b</num>
              <content>
                <p>the committee existed immediately before that time.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-5__subclause-2">
              <num>2</num>
              <content>
                <p>The expert advisory committee is continued in existence and may be dealt with, after the commencement time, as if it were an expert advisory committee established by <role refersTo="#ceo">the CEO</role> under section 44 of the OTA Act, as amended by Schedule 1 to this Act.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-2__clause-6">
            <num>6</num>
            <heading>Expert advisory committee members</heading>
            <hcontainer name="subclause" eId="schedule-2__clause-6__subclause-1">
              <num>1</num>
              <content>
                <p>This item applies to a person if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-6__para-a">
              <num>a</num>
              <content>
                <p>the person was appointed by the Board as an expert advisory committee member under <ref href="#sec-46">section 46</ref> of the OTA Act before the commencement time; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-6__para-b">
              <num>b</num>
              <content>
                <p>the appointment was in effect immediately before that time.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-6__subclause-2">
              <num>2</num>
              <content>
                <p>The person is taken, after the commencement time, to have been appointed by <role refersTo="#ceo">the CEO</role> under section 46 of the OTA Act, as amended by Schedule 1 to this Act, as an expert advisory committee member:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-6__para-a">
              <num>a</num>
              <content>
                <p>for the balance of the person’s term of appointment that remained immediately before that time; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-6__para-b">
              <num>b</num>
              <content>
                <p>on the same terms and conditions as applied to the person immediately before that time.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-6__subclause-3">
              <num>3</num>
              <content>
                <p>This item does not prevent those terms and conditions being varied after the commencement time.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-2__clause-7">
            <num>7</num>
            <heading>Agreements regarding grants of financial assistance</heading>
            <hcontainer name="subclause" eId="schedule-2__clause-7__subclause-1">
              <num>1</num>
              <content>
                <p>This item applies if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-7__para-a">
              <num>a</num>
              <content>
                <p>a grant of financial assistance of a kind referred to in subsection 54(1), 55(1) or 56(1) of the OTA Act was made by the Board to a person before the commencement time; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-7__para-b">
              <num>b</num>
              <content>
                <p>immediately before that time, an agreement setting out the terms and conditions on which the financial assistance was granted has not been entered into between the Commonwealth and the person.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-7__subclause-2">
              <num>2</num>
              <content>
                <p><role refersTo="#authority">The Authority</role> may, after the commencement time, enter into such an agreement on behalf of the Commonwealth.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-2__clause-8">
            <num>8</num>
            <heading>Compliance with terms and conditions of grants of financial assistance</heading>
            <content>
              <p>Subsection 56(2A) of the OTA Act, as inserted by Schedule 1 to this Act, applies in relation to the terms and conditions set out in an agreement that is entered into after the commencement time.</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-2__clause-9">
            <num>9</num>
            <heading>Protection of patient confidentiality</heading>
            <content>
              <p>Section 58 of the OTA Act, as amended by Schedule 1 to this Act, applies in relation to information that was obtained before or after the commencement time.</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-2__clause-10">
            <num>10</num>
            <heading>Annual report etc.</heading>
            <content>
              <p>For the purposes of sections 39, 42 and 46 of the <i>Public Governance, Performance and Accountability Act 2013</i>, and rules made for the purposes of those sections, the CEO is the accountable authority in relation to the following reporting periods for the Authority:</p>
            </content>
            <paragraph eId="schedule-2__clause-10__para-a">
              <num>a</num>
              <content>
                <p>the reporting period commencing on <date date="2021-07-01">1 July 2021</date>;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-10__para-b">
              <num>b</num>
              <content>
                <p>each later reporting period.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-2__clause-11">
            <num>11</num>
            <heading>Transitional rules</heading>
            <hcontainer name="subclause" eId="schedule-2__clause-11__subclause-1">
              <num>1</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, make rules prescribing matters of a transitional nature (including prescribing any saving or application provisions) relating to the amendments or repeals made by this Act.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-11__subclause-2">
              <num>2</num>
              <content>
                <p>To avoid doubt, the rules may not do the following:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-11__para-a">
              <num>a</num>
              <content>
                <p>create an offence or civil penalty;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-11__para-b">
              <num>b</num>
              <content>
                <p>provide powers of:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-11__para-i">
              <num>i</num>
              <content>
                <p>arrest or detention; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-11__para-ii">
              <num>ii</num>
              <content>
                <p>entry, search or seizure;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-11__para-c">
              <num>c</num>
              <content>
                <p>impose a tax;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-11__para-d">
              <num>d</num>
              <content>
                <p>set an amount to be appropriated from the Consolidated Revenue Fund under an appropriation in this Act;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-11__para-e">
              <num>e</num>
              <content>
                <p>directly amend the text of this Act.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-11__subclause-3">
              <num>3</num>
              <content>
                <p>This Schedule (other than subitem (2)) does not limit the rules that may be made for the purposes of subitem (1).</p>
