        <heading>Short title</heading>

          <p>		This Act is the <i>Foreign </i><i>Intelligence </i><i>Legislation Amendment Act 2021</i>.</p>

        <heading>Commencement</heading>
        <subsection eId="sec-2__subsec-1">
          <num>1</num>
          <content>
            <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

        <heading>Schedules</heading>
        <content>
          <p>Legislation that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.</p>
        </content>

      <section eId="sec-4">
        <num>4</num>
        <heading>Review</heading>
        <content>
          <p>The Parliamentary Joint Committee on Intelligence and Security may, after the fifth anniversary of the day this Act receives the Royal Assent, commence a review of the operation, effectiveness and implications of the amendments made by this Act.</p>

              <p>Omit “foreign communications for the purpose of obtaining that intelligence”, substitute “communications for the purpose of obtaining that foreign intelligence from foreign communications intercepted under the warrant”.</p>

            <heading>Subsection 11C(2)</heading>
            <content>
              <p>Omit “except foreign communications”, substitute “except for the purpose of obtaining foreign intelligence relating to a matter specified in the notice referred to in subsection (1) from foreign communications intercepted under the warrant”.</p>

            <heading>Paragraph 11C(3)(a)</heading>
            <content>
              <p>Repeal the paragraph, substitute:</p>
            </content>
            <paragraph eId="schedule-1__clause-6__para-a">
              <num>a</num>
              <content>
                <p>specify how the interception of communications is proposed to be conducted under the warrant, including how the risk of intercepting domestic communications will be minimised; and</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-7">
            <num>7</num>
            <heading>Subsection 11C(4)</heading>
            <content>
              <p>Repeal the subsection, substitute:</p>
              <p>unless the Attorney-General is satisfied that the giving of such a notice would not be in the interests of national security or reasonable in the circumstances.</p>

                <p>The Attorney-General must not issue a warrant under this section if the mandatory procedure under subsection (6) is not in force.</p>
              </content>

              <num>4A</num>
              <content>
                <p>If a warrant is issued under this section, then the Director-General of Security must prepare a notice that:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-7__para-a">
              <num>a</num>
              <content>
                <p>is addressed to any carrier who operates any part of the telecommunications system that is covered by the warrant; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-7__para-b">
              <num>b</num>
              <content>
                <p>gives a description that is sufficient to identify that part of the telecommunications system covered by the warrant;</p>
              </content>
            </paragraph>
          </hcontainer>

            <heading>Before subsection 11C(5)</heading>

              <p>Insert:</p>
              <p>Destruction of irrelevant intercepted communications</p>

            <heading>Subsection 11C(5)</heading>

              <p>Omit all the words after “Director-General of Security” (last occurring), substitute:</p>

                <p>cause all records of the communication to be destroyed (unless the communication relates, or appears to relate, to activities that present a significant risk to a person’s life); and</p>

            <num>10</num>
            <heading>After subsection 11C(5) (before the note)</heading>
            <content>
              <p>Insert:</p>
              <p>Mandatory procedure for all intercepted communications</p>
              <p>but the Attorney-General may review the mandatory procedure at any other time as well.</p>
            </content>

              <content>
                <p>	(6)	The Attorney-General must, in writing, issue a mandatory procedure (the <b><i>mandatory procedure</i></b>):</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-10__para-a">
              <num>a</num>
              <content>
                <p>for screening communications intercepted under a warrant under this section for the purpose of identifying any domestic communications that may have been intercepted; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10__para-b">
              <num>b</num>
              <content>
                <p>for destroying all records of any domestic communication so identified from that screening (other than a domestic communication that relates, or appears to relate, to activities that present a significant risk to a person’s life); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10__para-c">
              <num>c</num>
              <content>
                <p>for notifying the Inspector-General of Intelligence and Security of any identified domestic communication if all records of the communication are not destroyed because the communication relates, or appears to relate, to activities that present a significant risk to a person’s life.</p>
              </content>
            </paragraph>

              <num>7</num>
              <content>
                <p>The mandatory procedure may also deal with other matters relating to communications intercepted under a warrant under this section.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-10__subclause-8">
              <num>8</num>
              <content>
                <p>A person must comply with the mandatory procedure to the extent that it applies to the person.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-10__subclause-9">
              <num>9</num>
              <content>
                <p>Before issuing or varying the mandatory procedure, the Attorney-General must consult:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-10__para-a">
              <num>a</num>
              <content>
                <p><role refersTo="#minister">the Minister</role> for Defence; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10__para-b">
              <num>b</num>
              <content>
                <p><role refersTo="#minister">the Minister</role> for Foreign Affairs; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10__para-c">
              <num>c</num>
              <content>
                <p>the Inspector-General of Intelligence and Security; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10__para-d">
              <num>d</num>
              <content>
                <p>the Director-General of Security.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-10__subclause-10">
              <num>10</num>
              <content>
                <p>The Attorney-General must review the mandatory procedure as soon as practicable after:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-10__para-a">
              <num>a</num>
              <content>
                <p>the end of the first anniversary of the mandatory procedure being issued; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10__para-b">
              <num>b</num>
              <content>
                <p>every 3-year period after that;</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-10__subclause-10A">
              <num>10A</num>
              <content>
                <p>The Attorney-General must, as soon as practicable, cause the Parliamentary Joint Committee on Intelligence and Security to be notified about the issuing or varying of the mandatory procedure.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-10__subclause-10B">
              <num>10B</num>
              <content>
                <p>The Parliamentary Joint Committee on Intelligence and Security may request a briefing on the mandatory procedure and on any variations to it.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-10__subclause-11">
              <num>11</num>
              <content>
                <p>The mandatory procedure, or any variation of the mandatory procedure, is not a legislative instrument.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-10__subclause-12">
              <num>12</num>
              <content>
                <p>	(12)	For the purposes of this section, a <b><i>domestic communication</i></b> is a communication that is not a foreign communication.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-11">

            <heading>Section 14 (note)</heading>
            <content>
              <p>After “subsection 11C(5)”, insert “and paragraph 11C(6)(b)”.</p>

                <p>The amendments made by this Schedule apply in relation to the communication, use or making of records of foreign intelligence information that occurs after the commencement of this Schedule, whether the foreign intelligence information was obtained from interceptions made before or after that commencement.</p>

                <p>(2)	Despite the amendments made to subsections 65(2) and 137(3) of the <i>Telecommunications (Interception and Access) Act 1979</i> made by this Schedule, approvals given under those subsections that are in force immediately before the commencement of this Schedule continue in force after that commencement as if they were made under the relevant subsection (as amended by this Schedule).</p>
