              <p>Repeal the subsections, substitute:</p>
              <p>Basic offence</p>
              <p>Penalty:	<quantity refersTo="#custodialSentence">Imprisonment for 20 years</quantity> or a fine of <quantity refersTo="#penaltyUnit">5,000 penalty units</quantity>, or both.</p>

                <p>A person commits an offence if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-1__para-a">
              <num>a</num>
              <content>
                <p>	(a)	the person engages in conduct that constitutes an offence (the <b><i>underlying offence</i></b>) against a firearm law; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-1__para-b">
              <num>b</num>
              <content>
                <p>the person does so in the course of trade or commerce:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-1__para-i">
              <num>i</num>
              <content>
                <p>among the States; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-1__para-ii">
              <num>ii</num>
              <content>
                <p>between a State and a Territory, or between 2 Territories; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-1__para-c">
              <num>c</num>
              <content>
                <p>the primary element of the underlying offence involves:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-1__para-i">
              <num>i</num>
              <content>
                <p>the disposal of a firearm or a firearm part by the person; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-1__para-ii">
              <num>ii</num>
              <content>
                <p>the acquisition of a firearm or a firearm part by the person.</p>
              </content>
            </paragraph>

              <num>2</num>
              <content>
                <p>A person commits an offence if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-1__para-a">
              <num>a</num>
              <content>
                <p>	(a)	the person engages in conduct on one or more occasions that constitutes an offence (the <b><i>underlying offence</i></b>) against a firearm law; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-1__para-b">
              <num>b</num>
              <content>
                <p>the person does so in the course of trade or commerce:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-1__para-i">
              <num>i</num>
              <content>
                <p>among the States; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-1__para-ii">
              <num>ii</num>
              <content>
                <p>between a State and a Territory, or between 2 Territories; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-1__para-c">
              <num>c</num>
              <content>
                <p>the primary element of the underlying offence involves:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-1__para-i">

                <p>the disposal of a firearm or a firearm part by the person; or</p>

              <content>
                <p>the conduct on any occasion, or on 2 or more occasions taken together, results in the disposal, or acquisition, by the person of:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-1__para-i">
              <num>i</num>
              <content>
                <p>50 or more firearms; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-1__para-ii">
              <num>ii</num>
              <content>
                <p>50 or more firearm parts; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-1__para-iii">
              <num>iii</num>
              <content>
                <p>a combination of firearms and firearm parts such that the sum of the firearms and the firearm parts is 50 or more; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-1__para-e">
              <num>e</num>
              <content>
                <p>if the disposal or acquisition of the firearms or parts mentioned in paragraph (d) resulted from conduct on 2 or more occasions taken together—the occasions of conduct occurred during a 6 month period.</p>
              </content>
            </paragraph>

              <num>2A</num>
              <content>
                <p>There is no fault element for any of the physical elements described in paragraphs (1)(a) and (2)(a), other than the fault elements (however described), if any, for the underlying offence.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-1__subclause-2B">
              <num>2B</num>
              <content>
                <p>To avoid doubt:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-1__para-a">
              <num>a</num>
              <content>
                <p>in determining whether the conduct referred to in paragraph (1)(a) or (2)(a) constitutes the underlying offence, any defences or special liability provisions (however described) that apply in relation to the underlying offence have effect; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-1__para-b">
              <num>b</num>
              <content>
                <p>a person may be convicted of an offence against subsection (1) or (2) even if the person has not been convicted of the underlying offence; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-1__para-c">
              <num>c</num>
              <content>
                <p>for the purposes of subsection (2)—it is immaterial whether:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-1__para-i">
              <num>i</num>
              <content>
                <p>the underlying offence is the same on each occasion; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-1__para-ii">
              <num>ii</num>
              <content>
                <p>the conduct constituting the underlying offence is the same on each occasion; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-1__para-iii">
              <num>iii</num>
              <content>
                <p>the firearms or firearm parts to which the conduct relates are of the same kind.</p>
              </content>
            </paragraph>

                <p>Absolute liability applies to paragraphs (1)(b) and (c) and (2)(b), (c) and (e).</p>

            <heading>Before subsection 360.3(1) of the Criminal Code</heading>
            <content>
              <p>Insert:</p>
              <p>Basic offence</p>
            </content>
          </hcontainer>

            <num>3</num>
            <heading>Paragraph 360.3(1)(a) of the Criminal Code</heading>
            <content>
              <p>Repeal the paragraph, substitute:</p>
            </content>
            <paragraph eId="schedule-1__clause-3__para-a">
              <num>a</num>
              <content>
                <p>the person takes or sends a thing from one State or Territory to another State or Territory; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-3__para-aa">
              <num>aa</num>
              <content>
                <p>the thing is a firearm or firearm part; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-3__para-ab">
              <num>ab</num>
              <content>
                <p>the person does so in the course of trade or commerce:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-3__para-i">
              <num>i</num>
              <content>
                <p>among the States; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-3__para-ii">
              <num>ii</num>
              <content>
                <p>between a State and a Territory, or between 2 Territories; and</p>
              </content>
            </paragraph>

            <num>4</num>
            <heading>Subsection 360.3(1) of the Criminal Code (penalty)</heading>
            <content>
              <p>Repeal the penalty, substitute:</p>
              <p>Penalty:	<quantity refersTo="#custodialSentence">Imprisonment for 20 years</quantity> or a fine of <quantity refersTo="#penaltyUnit">5,000 penalty units</quantity>, or both.</p>
            </content>

            <heading>After subsection 360.3(1) of the Criminal Code</heading>

              <p>would happen in circumstances that would constitute an offence against the firearm law of that other State or Territory; and</p>
              <p>Penalty:	Imprisonment for life or a fine of <quantity refersTo="#penaltyUnit">7,500 penalty units</quantity>, or both.</p>

                <p>the thing is, or the things include, a firearm or firearm part; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5__para-c">
              <num>c</num>
              <content>
                <p>the person does so in the course of trade or commerce:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5__para-i">
              <num>i</num>
              <content>
                <p>among the States; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5__para-ii">
              <num>ii</num>
              <content>
                <p>between a State and a Territory, or between 2 Territories; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5__para-d">
              <num>d</num>
              <content>
                <p>the person does so intending that any of the firearms or parts will be disposed of in the other State or Territory (whether by the person or another); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5__para-e">
              <num>e</num>
              <content>
                <p>the person knows that, or is reckless as to whether:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5__para-i">
              <num>i</num>
              <content>
                <p>the disposal of any of the firearms or parts; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5__para-ii">
              <num>ii</num>
              <content>
                <p>any acquisition of any of the firearms or parts that results from the disposal;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5__para-f">
              <num>f</num>
              <content>
                <p>the conduct on any occasion, or on 2 or more occasions taken together, results in the taking, or sending, by the person of:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5__para-i">
              <num>i</num>
              <content>
                <p>50 or more firearms; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5__para-ii">
              <num>ii</num>
              <content>
                <p>50 or more firearm parts; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5__para-iii">
              <num>iii</num>
              <content>
                <p>a combination of firearms and firearm parts such that the sum of the firearms and the firearm parts is 50 or more; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5__para-g">
              <num>g</num>
              <content>
                <p>if the taking or sending of the firearms or parts mentioned in paragraph (f) resulted from conduct on 2 or more occasions taken together—the occasions of conduct occurred during a 6 month period.</p>

                <p>Absolute liability applies to paragraphs (1)(ab) and (1A)(c) and (g).</p>

                <p>Strict liability applies to paragraph (1A)(f).</p>

                <p>To avoid doubt, it is immaterial for the purposes of paragraphs (1A)(b) and (f) whether the firearms or firearm parts are of the same kind.</p>

            <heading>Subsection 360.3(2) of the Criminal Code (at the end of the definition of firearm)</heading>
            <content>
              <p>Add “or (1A)(e) (as the case requires)”.</p>
            </content>
          </hcontainer>

            <heading>Subsection 360.3(2) of the Criminal Code (definition of firearm part)</heading>
            <content>
              <p>Omit “(1)(c)”, substitute “(1)(c) or (1A)(e) (as the case requires)”.</p>

            <num>8</num>
            <heading>After section 360.3 of the Criminal Code</heading>
            <content>
              <p>Insert:</p>

              <num>360.3A</num>
              <heading>Minimum penalties</heading>
              <hcontainer name="subclause" eId="schedule-1__clause-8__subclause-360-3A__subclause-1">
                <num>1</num>
                <content>
                  <p>Subject to subsections (2) and (3), the court must impose a sentence of imprisonment of at least 5 years for a person convicted of an offence against this Division.</p>
                </content>
              </hcontainer>
              <content>
                <p>People aged under 18</p>
                <p>Reduction of minimum penalty</p>
              </content>
              <hcontainer name="subclause" eId="schedule-1__clause-8__subclause-360-3A__subclause-2">
                <num>2</num>
                <content>
                  <p>Subsection (1) does not apply to a person who was aged under 18 years when the offence was committed.</p>
                </content>
              </hcontainer>
              <hcontainer name="subclause" eId="schedule-1__clause-8__subclause-360-3A__subclause-3">
                <num>3</num>
                <content>
                  <p>A court may impose a sentence of imprisonment of less than the period specified in subsection (1) only if the court considers it appropriate to reduce the sentence because of either or both of the following:</p>
                </content>
              </hcontainer>
              <paragraph eId="schedule-1__clause-8__subclause-360-3A__para-a">
                <num>a</num>
                <content>
                  <p>	(a)	the court is taking into account, under paragraph 16A(2)(g) of the <i>Crimes Act 1914</i>, the person pleading guilty;</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-8__subclause-360-3A__para-b">
                <num>b</num>
                <content>
                  <p>the court is taking into account, under paragraph 16A(2)(h) of that Act, the person having cooperated with law enforcement agencies in the investigation of the offence.</p>
                </content>
              </paragraph>
              <hcontainer name="subclause" eId="schedule-1__clause-8__subclause-360-3A__subclause-4">
                <num>4</num>
                <content>
                  <p>If a court may reduce a sentence, the court may reduce the sentence as follows:</p>
                </content>
              </hcontainer>
              <paragraph eId="schedule-1__clause-8__subclause-360-3A__para-a">
                <num>a</num>
                <content>
                  <p>	(a)	if the court is taking into account, under paragraph 16A(2)(g) of the <i>Crimes Act 1914</i>, the person pleading guilty—by an amount that is up to 25% of the period specified in subsection (1);</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-8__subclause-360-3A__para-b">
                <num>b</num>
                <content>
                  <p>if the court is taking into account, under paragraph 16A(2)(h) of that Act, the person having cooperated with law enforcement agencies in the investigation of the offence—by an amount that is up to 25% of the period specified in subsection (1);</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-8__subclause-360-3A__para-c">
                <num>c</num>
                <content>
                  <p>if the court is taking into account both of the matters in paragraphs (a) and (b)—by an amount that is up to 50% of the period specified in subsection (1).</p>
                </content>
              </paragraph>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-8__subclause-360-3B">
              <num>360.3B</num>
              <heading>Double jeopardy and alternative verdicts</heading>
              <content>
                <p>Double jeopardy</p>
                <p>Alternative verdict—aggravated offence not proven</p>
                <p>it may find the defendant not guilty of the aggravated offence but guilty of the basic offence, so long as the defendant has been accorded procedural fairness in relation to that finding of guilt.</p>
                <p>Definitions</p>
                <p><b><i>aggravated offence</i></b> means an offence against subsection 360.2(2) or 360.3(1A).</p>
                <p><b><i>basic offence</i></b> relating to an aggravated offence means:</p>
              </content>
              <hcontainer name="subclause" eId="schedule-1__clause-8__subclause-360-3B__subclause-1">
                <num>1</num>
                <content>
                  <p>A person who has been convicted or acquitted of an aggravated offence may not be convicted of a basic offence relating to the aggravated offence that is alleged to have been committed in the period during which the person was alleged to have committed the aggravated offence.</p>
                </content>
              </hcontainer>
              <hcontainer name="subclause" eId="schedule-1__clause-8__subclause-360-3B__subclause-2">
                <num>2</num>
                <content>
                  <p>However, subsection (1) does not prevent an alternative verdict under subsection (4).</p>
                </content>
              </hcontainer>

                  <p>A person who has been convicted or acquitted of a basic offence relating to an aggravated offence may not be convicted of the aggravated offence if any of the occasions relied on as evidence of the commission of the aggravated offence includes the conduct that constituted the basic offence.</p>
