          <p>		This Act is the <i>Security Legislation Amendment (Critical Infrastructure Protection)</i><i> Act 20</i><i>2</i><i>2</i>.</p>

            <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

              <p>as assessed by the responsible entity for the asset.</p>

                <p>	(b)	a facility (within the meaning of the <i>Telecommunications Act 1997</i>) that is:</p>

                <p>owned or operated by a carrier or a carriage service provider; and</p>
              </content>
            </paragraph>

                <p>used to supply a carriage service.</p>

            </paragraph>

            <heading>Section 5</heading>
            <content>
              <p>Insert:</p>
              <p><b><i>critical worker</i></b><b> </b>means an individual, where the following conditions are satisfied:</p>
              <p>as assessed by the responsible entity for the asset;</p>
            </content>
            <paragraph eId="schedule-1__clause-11A__para-a">
              <num>a</num>
              <content>
                <p>the individual is an employee, intern, contractor or subcontractor of the responsible entity for a critical infrastructure asset to which <ref href="#part-2A">Part 2A</ref> applies;</p>
              </content>
            </paragraph>

              <num>b</num>
              <content>
                <p>the absence or compromise of the individual:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-11A__para-i">
              <num>i</num>
              <content>
                <p>would prevent the proper function of the asset; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-11A__para-ii">
              <num>ii</num>
              <content>
                <p>could cause significant damage to the asset;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-11A__para-c">
              <num>c</num>
              <content>
                <p>the individual has access to, or control and management of, a critical component of the asset.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-12">
            <num>12</num>
            <heading>Section 5</heading>
            <content>
              <p>Insert:</p>
              <p><b><i>custodial or depository service</i></b> has the same meaning as in the <i>Corporations Act 2001</i>.</p>
              <p><b><i>cyber security exercise</i></b> has the meaning given by section 30CN.</p>

            <heading>Section 5 (definition of data storage or processing service)</heading>
            <content>
              <p>Repeal the definition, substitute:</p>

              <p>However, the rules may prescribe that a specified service is not a data storage or processing service.</p>
              <p>Note:	For prescription by class, see subsection 13(3) of the <i>Legislation Act 2003</i>.</p>

              <p><b><i>external auditor</i></b> means a person authorised under section 30CT to be an external auditor for the purposes of this Act.</p>

                <p>if a hazard had a significant relevant impact on one or more of those assets during the relevant period—includes a statement that:</p>

                <p>identifies the hazard; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30AG__para-ii">

                <p>evaluates the effectiveness of the program in mitigating the significant relevant impact of the hazard on the assets concerned; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30AG__para-iii">
              <num>iii</num>
              <content>
                <p>if the program was varied during the financial year as a result of the occurrence of the hazard—outlines the variation; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30AG__para-e">
              <num>e</num>
              <content>
                <p>is in the approved form; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30AG__para-f">

                <p>if the entity has a board, council or other governing body—is approved by the board, council or other governing body, as the case requires.</p>

            </paragraph>

                <p>A report given by an entity under subsection (2) is not admissible in evidence against the entity in civil proceedings relating to a contravention of a civil penalty provision of this Act.</p>

            <heading>Critical infrastructure risk management program</heading>

                <p>	(1)	A <b><i>critical infrastructure risk management program</i></b> is a written program:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-30AH__para-a">
              <num>a</num>
              <content>
                <p>that applies to a particular entity that is the responsible entity for one or more critical infrastructure assets; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30AH__para-b">
              <num>b</num>
              <content>
                <p>the purpose of which is to do the following for each of those assets:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30AH__para-i">
              <num>i</num>
              <content>
                <p>identify each hazard where there is a material risk that the occurrence of the hazard could have a relevant impact on the asset;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30AH__para-ii">
              <num>ii</num>
              <content>
                <p>so far as it is reasonably practicable to do so—minimise or eliminate any material risk of such a hazard occurring;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30AH__para-iii">
              <num>iii</num>
              <content>
                <p>so far as it is reasonably practicable to do so—mitigate the relevant impact of such a hazard on the asset; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30AH__para-c">
              <num>c</num>
              <content>
                <p>that complies with such requirements (if any) as are specified in the rules.</p>
              </content>
            </paragraph>

                <p>Requirements specified under paragraph (1)(c):</p>

                <p>	(b)	provide that such a background check must include assessment of information relating to one or more of the matters mentioned in paragraphs 5(a), (b), (c) and (d) of the <i>AusCheck Act 2007</i>, as specified in the rules; and</p>

            </paragraph>
            <paragraph eId="schedule-1__clause-30AH__para-c">
              <num>c</num>
              <content>
                <p>	(c)	provide that, if such a background check includes an assessment of information relating to the matter mentioned in paragraph 5(a) of the <i>AusCheck Act 2007</i>, the criteria against which that information must be assessed are the criteria specified in the rules; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30AH__para-d">
              <num>d</num>
              <content>
                <p>	(d)	provide that, if such a background check includes assessment of information relating to the matter mentioned in paragraph 5(d) of the <i>AusCheck Act 2007</i>, the assessment must consist of whichever of the following is specified in the rules:</p>

                <p>an electronic identity verification check;</p>
              </content>

            </paragraph>

                <p>both an electronic identity verification check and an in person identity verification check.</p>

                <p>In specifying requirements in rules made for the purposes of paragraph (1)(c), <role refersTo="#minister">the Minister</role> must have regard to the following matters:</p>

                <p>any existing regulatory system of the Commonwealth, a State or a Territory that imposes obligations on responsible entities;</p>

                <p>the costs that are likely to be incurred by responsible entities in complying with those rules;</p>
              </content>
            </paragraph>

                <p>the reasonableness and proportionality of the requirements in relation to the purpose referred to in paragraph (1)(b);</p>

                <p>such other matters (if any) as <role refersTo="#minister">the Minister</role> considers relevant.</p>

                <p>For the purposes of this section, in determining whether a risk is a material risk, regard must be had to:</p>

                <p>the likelihood of the hazard occurring; and</p>
              </content>
            </paragraph>

                <p>the relevant impact of the hazard on the asset if the hazard were to occur.</p>

              <p>If an entity has adopted a critical infrastructure risk management program that applies to the entity, this Part does not prevent the entity from:</p>

                <p>do so as soon as practicable after the variation.</p>
              </content>
            </paragraph>

            <heading>Incident response plan</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-30CJ__subclause-1">
              <num>1</num>
              <content>
                <p>	(1)	An <b><i>incident response plan</i></b> is a written plan:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-30CJ__para-a">
              <num>a</num>
              <content>
                <p>that applies to an entity that is the responsible entity for a system of national significance; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30CJ__para-b">
              <num>b</num>
              <content>
                <p>that relates to the system; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30CJ__para-c">
              <num>c</num>
              <content>
                <p>that relates to cyber security incidents; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30CJ__para-d">
              <num>d</num>
              <content>
                <p>the purpose of which is to plan for responding to cyber security incidents that could have a relevant impact on the system; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30CJ__para-e">
              <num>e</num>
              <content>
                <p>that complies with such requirements (if any) as are specified in the rules.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-30CJ__subclause-2">
              <num>2</num>
              <content>
                <p>Requirements specified under paragraph (1)(e):</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-30CJ__para-a">

                <p>may be of general application; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30CJ__para-b">

            <heading>Variation of incident response plan</heading>
            <content>
              <p>An incident response plan may be varied, so long as the varied plan is an incident response plan.</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-30CL">
            <num>30CL</num>
            <heading>Revocation of adoption of incident response plan</heading>
            <content>
              <p>If an entity has adopted an incident response plan that applies to the entity, this Division does not prevent the entity from:</p>
            </content>
            <paragraph eId="schedule-1__clause-30CL__para-a">
              <num>a</num>
              <content>
                <p>revoking that adoption; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30CL__para-b">
              <num>b</num>
              <content>
                <p>adopting another incident response plan that applies to the entity.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-30CM">
            <num>30CM</num>
            <heading>Requirement to undertake cyber security exercise</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-30CM__subclause-1">
              <num>1</num>
              <content>
                <p><role refersTo="#secretary">The Secretary</role> may, by written notice given to an entity that is the responsible entity for a system of national significance, require the entity to:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-30CM__para-a">
              <num>a</num>
              <content>
                <p>undertake a cyber security exercise in relation to:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30CM__para-i">
              <num>i</num>
              <content>
                <p>the system; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30CM__para-ii">
              <num>ii</num>
              <content>
                <p>all types of cyber security incidents; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30CM__para-b">
              <num>b</num>
              <content>
                <p>do so within the period specified in the notice.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-30CM__subclause-2">
              <num>2</num>
              <content>
                <p><role refersTo="#secretary">The Secretary</role> may, by written notice given to an entity that is the responsible entity for a system of national significance, require the entity to:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-30CM__para-a">
              <num>a</num>
              <content>
                <p>undertake a cyber security exercise in relation to:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30CM__para-i">
              <num>i</num>
              <content>
                <p>the system; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30CM__para-ii">
              <num>ii</num>
              <content>
                <p>one or more specified types of cyber security incidents; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30CM__para-b">
              <num>b</num>
              <content>
                <p>do so within the period specified in the notice.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-30CM__subclause-3">
              <num>3</num>
              <content>
                <p>The period specified in a notice under subsection (1) or (2) must not be earlier than the end of the 30-day period that began when the notice was given.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-30CM__subclause-4">
              <num>4</num>
              <content>
                <p>A notice under subsection (1) or (2) may also require the entity to do any or all of the following things:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-30CM__para-a">
              <num>a</num>
              <content>
                <p>allow one or more specified designated officers to observe the cyber security exercise;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30CM__para-b">
              <num>b</num>
              <content>
                <p>provide those designated officers with access to premises for the purposes of observing the cyber security exercise;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30CM__para-c">
              <num>c</num>
              <content>
                <p>provide those designated officers with reasonable assistance and facilities that are reasonably necessary to allow those designated officers to observe the cyber security exercise;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30CM__para-d">
              <num>d</num>
              <content>
                <p>allow those designated officers to make such records as are reasonably necessary for the purposes of monitoring compliance with the notice;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30CM__para-e">
              <num>e</num>
              <content>
                <p>give those designated officers reasonable notice of the time when the cyber security exercise will begin.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-30CM__subclause-5">
              <num>5</num>
              <content>
                <p>In deciding whether to give a notice to an entity under subsection (1) or (2), <role refersTo="#secretary">the Secretary</role> must have regard to:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-30CM__para-a">
              <num>a</num>
              <content>
                <p>the costs that are likely to be incurred by the entity in complying with the notice; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30CM__para-b">
              <num>b</num>
              <content>
                <p>the reasonableness and proportionality of the requirement in the notice; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30CM__para-c">
              <num>c</num>
              <content>
                <p>such other matters (if any) as <role refersTo="#secretary">the Secretary</role> considers relevant.</p>
              </content>
            </paragraph>

            <heading>Cyber security exercise</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-30CN__subclause-1">
              <num>1</num>
              <content>
                <p>	(1)	A <b><i>cyber security exercise</i></b> is an exercise:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-30CN__para-a">
              <num>a</num>
              <content>
                <p>that is undertaken by the responsible entity for a system of national significance; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30CN__para-b">
              <num>b</num>
              <content>
                <p>that relates to the system; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30CN__para-c">
              <num>c</num>
              <content>
                <p>that either:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30CN__para-i">
              <num>i</num>
              <content>
                <p>relates to all types of cyber security incidents; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30CN__para-ii">
              <num>ii</num>
              <content>
                <p>relates to one or more specified types of cyber security incidents; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30CN__para-d">
              <num>d</num>
              <content>
                <p>if the exercise relates to all types of cyber security incidents—the purpose of which is to:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30CN__para-i">
              <num>i</num>
              <content>
                <p>test the entity’s ability to respond appropriately to all types of cyber security incidents that could have a relevant impact on the system; and</p>
              </content>
            </paragraph>

              <content>
                <p><i>	</i>(ii)<i>	</i>test the entity’s preparedness to respond appropriately to all types of cyber security incidents that could have a relevant impact on the system; and</p>

              <content>
                <p>test the entity’s ability to mitigate the relevant impacts that all types of cyber security incidents could have on the system; and</p>
              </content>
            </paragraph>

              <num>e</num>
              <content>
                <p>if the exercise relates to one or more specified types of cyber security incidents—the purpose of which is to:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30CN__para-i">
              <num>i</num>
              <content>
                <p>test the entity’s ability to respond appropriately to those types of cyber security incidents that could have a relevant impact on the system; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30CN__para-ii">
              <num>ii</num>

                <p><i>	</i>(ii)<i>	</i>test the entity’s preparedness to respond appropriately to those types of cyber security incidents that could have a relevant impact on the system; and</p>

                <p>test the entity’s ability to mitigate the relevant impacts that those types of cyber security incidents could have on the system; and</p>

                <p>do both of the following:</p>
              </content>
            </paragraph>

                <p>prepare an evaluation report relating to the cyber security exercise;</p>

            <paragraph eId="schedule-1__clause-30CQ__para-ii">

                <p>give a copy of the report to <role refersTo="#secretary">the Secretary</role>; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30CQ__para-b">

                <p>do so:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30CQ__para-i">
              <num>i</num>

                <p><quantity refersTo="#deadline">within 30 days</quantity> after the completion of the exercise; or</p>

                <p>the entity has prepared, or purported to prepare, an evaluation report under <ref href="#sec-30C">section 30C</ref>Q relating to the exercise;</p>

              <num>ii</num>
              <content>
                <p>the entity has given a copy of the report to <role refersTo="#secretary">the Secretary</role>;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30CR__para-iii">
              <num>iii</num>
              <content>
                <p><role refersTo="#secretary">the Secretary</role> has reasonable grounds to believe that the report was not prepared appropriately; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30CR__para-b">
              <num>b</num>
              <content>
                <p>the entity has contravened <ref href="#sec-30C">section 30C</ref>Q.</p>
              </content>
            </paragraph>

                <p><role refersTo="#secretary">The Secretary</role> may, by written notice given to the entity, require the entity to:</p>

                <p>appoint an external auditor; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30CR__para-b">

                <p>	(b)	arrange for the external auditor to prepare an evaluation report (the <b><i>new evaluation report</i></b>) relating to the exercise; and</p>
              </content>
            </paragraph>

              <content>
                <p>arrange for the external auditor to give the new evaluation report to the entity; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30CR__para-d">
              <num>d</num>

                <p>give <role refersTo="#secretary">the Secretary</role> a copy of the new evaluation report within:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30CR__para-i">
              <num>i</num>
              <content>
                <p>the period specified in the notice; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30CR__para-ii">
              <num>ii</num>
              <content>
                <p>if <role refersTo="#secretary">the Secretary</role> allows a longer period—that longer period.</p>
              </content>
            </paragraph>

                <p>The notice must specify:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-30CR__para-a">
              <num>a</num>

                <p>the matters to be covered by the new evaluation report; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30CR__para-b">

                <p>the form of the new evaluation report and the kinds of details it is to contain.</p>

            </paragraph>

                <p>Before giving a notice to an entity under this section in connection with a cyber security exercise that relates to a system of national significance, <role refersTo="#secretary">the Secretary</role> must consult:</p>

              <num>a</num>
              <content>
                <p>the entity; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30CR__para-b">
              <num>b</num>

                <p>if there is a relevant Commonwealth regulator that has functions relating to the security of that system—the relevant Commonwealth regulator.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-30CR__subclause-5">
              <num>5</num>
              <content>
                <p>An individual is not eligible to be appointed as an external auditor by the entity if the individual is an officer, employee or agent of the entity.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-30CR__subclause-6">
              <num>6</num>
              <content>
                <p>An entity must comply with a requirement under subsection (2).</p>
              </content>
            </hcontainer>

                <p>if the exercise relates to all types of cyber security incidents—the purpose of which is to:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30CS__para-i">
              <num>i</num>
              <content>
                <p>evaluate the entity’s ability to respond appropriately to all types of cyber security incidents that could have a relevant impact on the system; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30CS__para-ii">
              <num>ii</num>
              <content>
                <p><i>	</i>(ii)<i>	</i>evaluate the entity’s preparedness to respond appropriately to all types of cyber security incidents that could have a relevant impact on the system; and</p>

                <p>evaluate the entity’s ability to mitigate the relevant impacts that all types of cyber security incidents could have on the system; and</p>

                <p>if the exercise relates to one or more specified types of cyber security incidents—the purpose of which is to:</p>
              </content>
            </paragraph>

                <p>evaluate the entity’s ability to respond appropriately to those types of cyber security incidents that could have a relevant impact on the system; and</p>
              </content>
            </paragraph>

                <p><i>	</i>(ii)<i>	</i>evaluate the entity’s preparedness to respond appropriately to those types of cyber security incidents that could have a relevant impact on the system; and</p>

                <p>evaluate the entity’s ability to mitigate the relevant impacts that those types of cyber security incidents could have on the system; and</p>

                <p>that complies with such requirements (if any) as are specified in the rules.</p>

            <heading>External auditors</heading>

                <p><role refersTo="#secretary">The Secretary</role> may, by writing, authorise a specified individual to be an external auditor for the purposes of this Act.</p>

                <p>undertake, or cause to be undertaken, a vulnerability assessment in relation to:</p>
              </content>
            </paragraph>

                <p>the system; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30CU__para-ii">
              <num>ii</num>
              <content>
                <p>all types of cyber security incidents; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30CU__para-b">
              <num>b</num>
              <content>
                <p>do so within the period specified in the notice.</p>
              </content>
            </paragraph>

                <p><role refersTo="#secretary">The Secretary</role> may, by written notice given to an entity that is the responsible entity for a system of national significance, require the entity to:</p>

                <p>do so within the period specified in the notice.</p>

                <p>In deciding whether to give a notice to an entity under subsection (1) or (2), <role refersTo="#secretary">the Secretary</role> must have regard to:</p>

            <paragraph eId="schedule-1__clause-30CU__para-a">
              <num>a</num>
              <content>
                <p>the costs that are likely to be incurred by the entity in complying with the notice; and</p>
              </content>
            </paragraph>

                <p>the reasonableness and proportionality of the requirement in the notice; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30CU__para-c">

                <p>such other matters (if any) as <role refersTo="#secretary">the Secretary</role> considers relevant.</p>

                <p>If a request under subsection (2) or (3) is given to a designated officer, <role refersTo="#secretary">the Secretary</role> may, by written notice given to the entity, require the entity to do any or all of the following things:</p>

              <content>
                <p>provide the designated officer with access to premises for the purposes of undertaking the vulnerability assessment;</p>
              </content>
            </paragraph>

              <content>
                <p>provide the designated officer with access to computers for the purposes of undertaking the vulnerability assessment;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30CW__para-c">
              <num>c</num>
              <content>
                <p>provide the designated officer with reasonable assistance and facilities that are reasonably necessary to allow the designated officer to undertake the vulnerability assessment.</p>
              </content>
            </paragraph>

                <p>If a request under subsection (2) or (3) is given to a designated officer, <role refersTo="#secretary">the Secretary</role> must give a copy of the request to the entity.</p>

                <p>that relates to a system of national significance; and</p>
              </content>
            </paragraph>

            </paragraph>
            <paragraph eId="schedule-1__clause-30CY__para-i">
              <num>i</num>

                <p>relates to all types of cyber security incidents; or</p>
              </content>

              <num>ii</num>

                <p>relates to one or more specified types of cyber security incidents; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30CY__para-c">

                <p>if the assessment relates to all types of cyber security incidents—the purpose of which is to test the vulnerability of the system to all types of cyber security incidents; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30CY__para-d">
              <num>d</num>
              <content>
                <p>if the assessment relates to one or more specified types of cyber security incidents—the purpose of which is to test the vulnerability of the system to those types of cyber security incidents; and</p>

              <content>
                <p>that complies with such requirements (if any) as are specified in the rules.</p>

              <p>		A <b><i>vulnerability assessment report</i></b>, in relation to a vulnerability assessment that was undertaken in relation to a system of national significance,<b><i> </i></b>is a written report:</p>
              <p>Subdivision A—System information reporting notices</p>
            </content>
            <paragraph eId="schedule-1__clause-30DA__para-a">
              <num>a</num>
              <content>
                <p>if the assessment relates to all types of cyber security incidents—the purpose of which is to assess the vulnerability of the system to all types of cyber security incidents; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30DA__para-b">
              <num>b</num>
              <content>
                <p>if the assessment relates to one or more specified types of cyber security incidents—the purpose of which is to assess the vulnerability of the system to those types of cyber security incidents; and</p>

                <p>that complies with such requirements (if any) as are specified in the rules.</p>

              <content>
                <p>relates to the operation of the computer; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30DB__para-ii">
              <num>ii</num>
              <content>
                <p>may assist with determining whether a power under this Act should be exercised in relation to the system of national significance; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30DB__para-iii">
              <num>iii</num>
              <content>
                <p>	(iii)	is not personal information (within the meaning of the <i>Privacy Act 1988</i>).</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-30DB__subclause-2">
              <num>2</num>
              <content>
                <p><role refersTo="#secretary">The Secretary</role> may, by written notice given to the entity, require the entity to:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-30DB__para-a">
              <num>a</num>
              <content>
                <p>prepare periodic reports that:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30DB__para-i">
              <num>i</num>

                <p>consist of any such information; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30DB__para-ii">
              <num>ii</num>
              <content>
                <p>relate to such regular intervals as are specified in the notice; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30DB__para-b">
              <num>b</num>

                <p>prepare those periodic reports:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30DB__para-i">
              <num>i</num>

                <p>in the manner and form specified in the notice; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30DB__para-ii">
              <num>ii</num>
              <content>
                <p>in accordance with the information technology requirements specified in the notice; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30DB__para-c">
              <num>c</num>
              <content>
                <p>give each of those periodic reports to ASD within the period ascertained in accordance with the notice in relation to the periodic report concerned.</p>
              </content>
            </paragraph>

              <content>
                <p>	(3)	A notice under subsection (2) is to be known as a <b><i>system information periodic reporting notice</i></b>.</p>

                <p>the costs that are likely to be incurred by the entity in complying with the notice; and</p>

                <p>the reasonableness and proportionality of the requirements in the notice; and</p>
              </content>
            </paragraph>

              </content>

                <p>may assist with determining whether a power under this Act should be exercised in relation to the system of national significance; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30DC__para-iii">
              <num>iii</num>
              <content>
                <p>	(iii)	is not personal information (within the meaning of the <i>Privacy Act 1988</i>).</p>

            </paragraph>

                <p>prepare a report that consists of any such information;</p>
              </content>
            </paragraph>

                <p>prepare that report:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30DC__para-i">
              <num>i</num>
              <content>
                <p>in the manner and form specified in the notice; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30DC__para-ii">
              <num>ii</num>
              <content>
                <p>in accordance with the information technology requirements specified in the notice;</p>
              </content>
            </paragraph>

                <p>give that report to ASD as soon as practicable after the event occurs.</p>
              </content>
            </paragraph>

                <p>	(3)	A notice under subsection (2) is to be known as a <b><i>system information event</i></b><b><i>-</i></b><b><i>based reporting notice</i></b>.</p>

                <p>In deciding whether to give a system information event-based reporting notice to the entity, <role refersTo="#secretary">the Secretary</role> must have regard to:</p>

              <num>a</num>
              <content>
                <p>the costs that are likely to be incurred by the entity in complying with the notice; and</p>

                <p>the reasonableness and proportionality of the requirements in the notice; and</p>

              <p>Before giving:</p>
              <p>to a relevant entity for a system of national significance, <role refersTo="#secretary">the Secretary</role> must consult:</p>

              <num>a</num>
              <content>
                <p>a system information periodic reporting notice; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30DD__para-b">
              <num>b</num>
              <content>
                <p>a system information event-based reporting notice;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30DD__para-c">
              <num>c</num>
              <content>
                <p>the relevant entity; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30DD__para-d">
              <num>d</num>
              <content>
                <p>if the relevant entity is not the responsible entity for the system of national significance—the responsible entity for the system of national significance.</p>
              </content>
            </paragraph>

            <heading>Duration of system information periodic reporting notice or system information event-based reporting notice</heading>

                <p>A system information periodic reporting notice or a system information event-based reporting notice:</p>

                <p>remains in force for the period specified in the notice.</p>

                <p>The period specified in the notice must not be longer than 12 months.</p>

                <p>An entity is not excused from giving a report under <ref href="#sec-30D">section 30D</ref>B or 30DC on the ground that the report might tend to incriminate the entity.</p>

              <num>2</num>
              <content>
                <p>If, at general law, an individual would otherwise be able to claim the privilege against self-exposure to a penalty (other than a penalty for an offence) in relation to giving a report under <ref href="#sec-30D">section 30D</ref>B or 30DC, the individual is not excused from giving a report under that section on that ground.</p>

              </content>
            </paragraph>

                <p>may assist with determining whether a power under this Act should be exercised in relation to the system of national significance; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30DJ__para-iii">

                <p>maintain the computer program installed in accordance with paragraph (a); and</p>

                <p>take all reasonable steps to ensure that the computer is continuously supplied with an internet carriage service that enables the computer program to function.</p>

                <p>	(3)	A notice under subsection (2) is to be known as a <b><i>system information software notice</i></b>.</p>

                <p>A computer program may only be specified in a system information software notice if the purpose of the computer program is to:</p>

                <p>collect and record information that:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30DJ__para-i">
              <num>i</num>

                <p>relates to the operation of the computer; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30DJ__para-ii">
              <num>ii</num>
              <content>
                <p>may assist with determining whether a power under this Act should be exercised in relation to the system of national significance; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30DJ__para-iii">
              <num>iii</num>
              <content>
                <p>	(iii)	is not personal information (within the meaning of the <i>Privacy Act 1988</i>); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30DJ__para-b">
              <num>b</num>
              <content>
                <p>cause the information to be transmitted electronically to ASD.</p>
              </content>
            </paragraph>

                <p>A system information software notice must set out the effect of <ref href="#sec-30D">section 30D</ref>M.</p>

                <p>This section does not, by implication, limit a power conferred by another provision of this Act.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-30DK">

            <heading>Consultation</heading>
            <content>
              <p>Before giving a system information software notice to a relevant entity for a system of national significance, <role refersTo="#secretary">the Secretary</role> must consult:</p>
            </content>
            <paragraph eId="schedule-1__clause-30DK__para-a">
              <num>a</num>
              <content>
                <p>the relevant entity; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30DK__para-b">
              <num>b</num>
              <content>
                <p>if the relevant entity is not the responsible entity for the system of national significance—the responsible entity for the system of national significance.</p>
              </content>
            </paragraph>
          </hcontainer>

            <heading>Duration of system information software notice</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-30DL__subclause-1">
              <num>1</num>

                <p>A system information software notice:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-30DL__para-a">
              <num>a</num>
              <content>
                <p>comes into force:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30DL__para-i">
              <num>i</num>

                <p>when it is given; or</p>
              </content>
            </paragraph>

                <p>if a later time is specified in the notice—at that later time; and</p>

                <p>	(3)	If a system information software notice (the <b><i>original notice</i></b>) is in force, this Act does not prevent the Secretary from giving a fresh system information software notice that:</p>

                <p>is in the same, or substantially the same, terms as the original notice; and</p>
              </content>
            </paragraph>

                <p>comes into force immediately after the expiry of the original notice.</p>
              </content>
            </paragraph>
          </hcontainer>

            <heading>Compliance with system information software notice</heading>
            <content>
              <p>An entity must comply with a system information software notice to the extent that the entity is capable of doing so.</p>
              <p>Civil penalty:	<quantity refersTo="#penaltyUnit">200 penalty units</quantity>.</p>
            </content>
          </hcontainer>

            <num>30DN</num>
            <heading>Self-incrimination etc.</heading>

              <num>1</num>
              <content>
                <p>An entity is not excused from complying with a system information software notice on the ground that complying with the notice might tend to incriminate the entity.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-30DN__subclause-2">
              <num>2</num>
              <content>
                <p>If, at general law, an individual would otherwise be able to claim the privilege against self-exposure to a penalty (other than a penalty for an offence) in relation to complying with a system information software notice, the individual is not excused from complying with the notice on that ground.</p>
              </content>
            </hcontainer>
            <content>
              <p>Note:	A body corporate is not entitled to claim the privilege against self-exposure to a penalty.</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-30DP">
            <num>30DP</num>
            <heading>Admissibility of information etc.</heading>
            <content>
              <p>If:</p>
              <p>the information is not admissible in evidence against an entity:</p>
            </content>
            <paragraph eId="schedule-1__clause-30DP__para-a">
              <num>a</num>
              <content>
                <p>a computer program is installed in compliance with a system information software notice; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30DP__para-b">
              <num>b</num>
              <content>
                <p>information is transmitted to ASD as a result of the operation of the computer program;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30DP__para-c">
              <num>c</num>
              <content>
                <p>in criminal proceedings; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-30DP__para-d">
              <num>d</num>
              <content>
                <p>in civil proceedings other than proceedings for recovery of a penalty in relation to a contravention of <ref href="#sec-30D">section 30D</ref>M.</p>

            </paragraph>

            <heading>Designated officer</heading>

                <p>	(1)	A <b><i>designated officer</i></b> is an individual appointed by the Secretary, in writing, to be a designated officer for the purposes of this Act.</p>

                <p>the Director-General of ASD has agreed to the appointment.</p>
              </content>
            </paragraph>

                <p><role refersTo="#secretary">The Secretary</role> may, in writing, declare that each Departmental employee included in a specified class of Departmental employees is a designated officer.</p>

              </content>
            </paragraph>

            <heading>Regular reports about consultation</heading>

              <num>1</num>
              <content>
                <p><role refersTo="#secretary">The Secretary</role> must give <role refersTo="#minister">the Minister</role> a report relating to the conduct, progress and outcomes of consultations undertaken by the Department in relation to:</p>

              <num>a</num>
              <content>
                <p>	(a)	the amendments made by the <i>Security Legislation Amendment (Critical Infrastructure Protection) Act 2022</i>; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-60AAA__para-b">
              <num>b</num>
              <content>
                <p>	(b)	the amendments of this Act made by the <i>Security Legislation Amendment (Critical Infrastructure) Act 2021</i>;</p>
              </content>
            </paragraph>

              <p>during a designated reporting period (see subsection (4)).</p>

              <num>2</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> must give a copy of a report under subsection (1) to the Parliamentary Joint Committee on Intelligence and Security.</p>

              <num>3</num>
              <content>
                <p>	(3)	A report under subsection (1) must not include personal information (within the meaning of the <i>Privacy Act 1988</i>).</p>

              <num>4</num>
              <content>
                <p>	(4)	For the purposes of this section, <b><i>designated reporting period</i></b> means:</p>

              <num>a</num>
              <content>
                <p>the period beginning at the commencement of this section and ending at the earlier of the following times:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-60AAA__para-i">
              <num>i</num>
              <content>
                <p>the end of the 6-month period that began at the commencement of this section;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-60AAA__para-ii">
              <num>ii</num>
              <content>
                <p>the time when the Parliamentary Joint Committee on Intelligence and Security began to conduct a review under <ref href="#sec-60B">section 60B</ref>; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-60AAA__para-b">
              <num>b</num>
              <content>
                <p>the period beginning immediately after the end of the immediately preceding designated reporting period and ending at the earlier of the following times:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-60AAA__para-i">
              <num>i</num>
              <content>
                <p>the end of the 6-month period that began immediately after the end of the immediately preceding designated reporting period;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-60AAA__para-ii">
              <num>ii</num>
              <content>
                <p>the time when the Parliamentary Joint Committee on Intelligence and Security began to conduct a review under <ref href="#sec-60B">section 60B</ref>.</p>

            <heading>Independent review</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-60A__subclause-1">
              <num>1</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> must cause an independent review to be conducted of the operation of this Act.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-60A__subclause-2">
              <num>2</num>
              <content>
                <p>The review must be conducted after the end of the 12-month period that began at the commencement of this section.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-60A__subclause-3">
              <num>3</num>
              <content>
                <p>The person or persons who conduct the review must:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-60A__para-a">
              <num>a</num>
              <content>
                <p>give <role refersTo="#minister">the Minister</role> a written report of the review; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-60A__para-b">
              <num>b</num>
              <content>
                <p>do so <quantity refersTo="#deadline">within 12 months</quantity> after the commencement of the review.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-60A__subclause-4">
              <num>4</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> must cause copies of the report to be tabled in each House of the Parliament within 15 sitting days of that House after the report is given to <role refersTo="#minister">the Minister</role>.</p>
