          <p>		This Act is the <i>Fair Work Amendment (Paid Family and Domestic Violence Leave)</i><i> Act 20</i><i>2</i><i>2</i>.</p>

            <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

        <heading>Schedules</heading>
        <content>
          <p>Legislation that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.</p>
        </content>
      </section>
      <section eId="sec-4">
        <num>4</num>
        <heading>Review of this Act</heading>
        <subsection eId="sec-4__subsec-1">
          <num>1</num>
          <content>
            <p><role refersTo="#minister">The Minister</role> must cause an independent review to be conducted of the operation of the amendments made by this Act.</p>
          </content>
        </subsection>
        <subsection eId="sec-4__subsec-2">
          <num>2</num>
          <content>
            <p>Without limiting subsection (1), the review must consider the impact of the amendments made by this Act on:</p>
          </content>
          <paragraph eId="sec-4__subsec-2__para-a">
            <num>a</num>
            <content>
              <p>small businesses; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-4__subsec-2__para-b">
            <num>b</num>
            <content>
              <p>sole traders; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-4__subsec-2__para-c">
            <num>c</num>
            <content>
              <p>people experiencing family and domestic violence.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-4__subsec-3">
          <num>3</num>
          <content>
            <p>The persons who conduct the review must consider both quantitative and qualitative research in conducting the review.</p>
          </content>
        </subsection>
        <subsection eId="sec-4__subsec-4">
          <num>4</num>
          <content>
            <p>The review must start as soon as practicable after the end of the period of 12 months after the commencement of Schedule 1.</p>
          </content>
        </subsection>
        <subsection eId="sec-4__subsec-5">
          <num>5</num>
          <content>
            <p>The persons who conduct the review must give the Minister a written report of the review <quantity refersTo="#deadline">within 3 months</quantity> of the commencement of the review.</p>
          </content>
        </subsection>
        <subsection eId="sec-4__subsec-6">
          <num>6</num>
          <content>
            <p><role refersTo="#minister">The Minister</role> must cause a copy of the report to be tabled in each House of the Parliament within 15 sitting days of that House after the report is given to <role refersTo="#minister">the Minister</role>.</p>

                <p>If, in accordance with this Subdivision, an employee takes a period of paid family and domestic violence leave, the employer must pay the employee, in relation to the period:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-106BA__para-a">
              <num>a</num>
              <content>
                <p>for an employee other than a casual employee—at the employee’s full rate of pay, worked out as if the employee had not taken the period of leave; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-106BA__para-b">
              <num>b</num>
              <content>
                <p>for a casual employee—at the employee’s full rate of pay, worked out as if the employee had worked the hours in the period for which the employee was rostered.</p>
              </content>
            </paragraph>

                <p>Without limiting paragraph (1)(b), an employee is taken to have been rostered to work hours in a period if the employee has accepted an offer by the employer of work for those hours.</p>

                <p>Paragraph (1)(b) does not prevent a casual employee from taking a period of paid family and domestic violence leave that does not include hours for which the employee is rostered to work. However, the employer is not required to pay the employee in relation to such a period.</p>

              <p><b><i>small business employee</i></b> means an employee whose employer was, on the day Schedule 1 to the amending Act commences, a small business employer (whether or not the employee was employed by the employer on that day).</p>

            <heading>Entitlement to paid family and domestic violence leave</heading>
            <content>
              <p>Non-small business employees</p>

              <p>the start of the employee’s employment is taken to be the start of the employee’s first employment with that employer.</p>

                <p>The amendments made by Schedule 1 to the amending Act also apply, from <date date="2023-08-01">1 August 2023</date>, in relation to a small business employee whose employment started before <date date="2023-08-01">1 August 2023</date>, as if the period:</p>

                <p>starting on <date date="2023-08-01">1 August 2023</date>; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-52__para-b">
              <num>b</num>
              <content>
                <p>ending on the first day after <date date="2023-08-01">1 August 2023</date> that is an anniversary of the day the employment started;</p>
              </content>
            </paragraph>

              <content>
                <p>For the purposes of this clause, if an employee is employed by a particular employer:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-52__para-a">
              <num>a</num>
              <content>
                <p>as a casual employee; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-52__para-b">
              <num>b</num>
              <content>
                <p>for a specified period of time, for a specified task or for the duration of a specified season;</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-53">
            <num>53</num>
            <heading>Resolving interactions between enterprise agreements and paid family and domestic violence leave</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-53__subclause-1">
              <num>1</num>
              <content>
                <p>On application by an employer, employee or employee organisation covered by a pre-commencement enterprise agreement, if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-53__para-a">
              <num>a</num>
              <content>
                <p>the agreement includes terms entitling employees to paid family and domestic violence leave within the ordinary meaning of that expression; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-53__para-b">
              <num>b</num>
              <content>
                <p>	(b)	the FWC considers that the effect of those terms is detrimental when compared with the entitlement under Subdivision CA of <b><i>NES entitlement</i></b>);<ref href="#dvs-7">Division 7</ref> of <ref href="#part-2">Part 2</ref>-2 as amended by Schedule 1 to the amending Act (the </p>
              </content>
            </paragraph>
            <content>
              <p>the FWC may make a determination varying the agreement to make the agreement consistent with the NES entitlement.</p>
            </content>
            <hcontainer name="subclause" eId="schedule-1__clause-53__subclause-2">
              <num>2</num>
              <content>
                <p>On application by an employer, employee or employee organisation covered by a pre-commencement enterprise agreement, the FWC may make a determination varying the agreement to make it operate effectively with the following:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-53__para-a">
              <num>a</num>
              <content>
                <p>the provisions of Subdivision CA of <ref href="#dvs-7">Division 7</ref> of <ref href="#part-2">Part 2</ref>-2 as amended by Schedule 1 to the amending Act;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-53__para-b">
              <num>b</num>
              <content>
                <p><ref href="#sec-107">section 107</ref>, to the extent that it relates to taking leave under that Subdivision.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-53__subclause-3">
              <num>3</num>
              <content>
                <p>A variation of a pre-commencement enterprise agreement under this clause operates from the day specified in the determination, which may be a day before the determination is made.</p>
              </content>
            </hcontainer>
