          <p>		This Act is the <i>Biosecurity Amendment (</i><i>Strengthening Biosecurity</i><i>) Act 2022</i>.</p>

          <p>Legislation that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.</p>

              <p>After “Powers may be exercised to assess the level of biosecurity risk associated with them, and biosecurity measures may be required to reduce that risk if it is considered to be unacceptable.”, insert “Requirements may also be determined for persons entering Australian territory on an incoming conveyance, in connection with diseases and pests that are considered to pose an unacceptable level of biosecurity risk.”.</p>

            <heading>Subsection 25(1)</heading>

              <p>Omit “(other than <ref href="#part-1">Part 1</ref> of Chapter 8 (biosecurity emergencies)) applies in relation to a pest”, substitute “applies in relation to a pest (subject to subsection (2))”.</p>

            <heading>Subsection 25(2)</heading>

              <p>Repeal the subsection, substitute:</p>

                <p>The following provisions of this Act apply only in relation to a pest that is referred to in paragraph (1)(a):</p>

              <num>b</num>
              <content>
                <p><ref href="#part-1">Part 1</ref> of Chapter 8 (biosecurity emergencies).</p>

            <heading>Section 190 (after the paragraph dealing with Division 3)</heading>

              <p>Insert:</p>
              <p><ref href="#dvs-3A">Division 3A</ref> allows the Agriculture Minister to determine requirements, for persons entering Australian territory on an incoming aircraft or vessel, in connection with diseases and pests that are considered to pose an unacceptable level of biosecurity risk.</p>

            <heading>Persons on incoming aircraft or vessel may be subject to requirements relating to diseases or pests</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-196A__subclause-1">
              <num>1</num>
              <content>
                <p>This section applies for the purposes of preventing, or reducing the risk of, a disease or pest that is considered to pose an unacceptable level of biosecurity risk entering, or establishing itself or spreading in, Australian territory or a part of Australian territory.</p>
              </content>
            </hcontainer>
            <content>
              <p>Note:	This Division does not apply in relation to invasive pests (see subsection 25(2)).</p>
              <p>Note:	An individual who fails to comply with a requirement may contravene a civil penalty provision (see <ref href="#sec-196C">section 196C</ref>).</p>
              <p>Where requirements apply</p>
              <p>Kinds of requirements that may be specified</p>
              <p>Note 1:	A person may commit an offence or contravene a civil penalty provision if the person provides false or misleading information or documents (see sections 137.1 and 137.2 of the <i>Criminal Code</i> and sections 532 and 533 of this Act).</p>
              <p>Note 2:	This section is not subject to the privilege against self-incrimination (see <ref href="#sec-635">section 635</ref>).</p>
              <p>Consultations before making determination</p>
            </content>
            <hcontainer name="subclause" eId="schedule-1__clause-196A__subclause-2">
              <num>2</num>
              <content>
                <p>The Agriculture Minister may determine one or more requirements for individuals who are entering Australian territory at a landing place or port in accordance with <ref href="#dvs-2">Division 2</ref> or 3 of <ref href="#part-4">Part 4</ref> of this Chapter.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-196A__subclause-3">
              <num>3</num>
              <content>
                <p>The determination must specify the disease or pest referred to in subsection (1).</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-196A__subclause-4">
              <num>4</num>
              <content>
                <p>	(4)	A determination made under subsection (2) is a legislative instrument, but <i>Legislation Act 2003</i> does not apply to the instrument.<ref href="#sec-42">section 42</ref> (disallowance) of the </p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-196A__subclause-5">
              <num>5</num>
              <content>
                <p>A requirement must not be specified in a determination unless the Agriculture Minister is satisfied that:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-196A__para-a">
              <num>a</num>
              <content>
                <p>the disease or pest poses an unacceptable level of biosecurity risk; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-196A__para-b">
              <num>b</num>
              <content>
                <p>the requirement is appropriate and adapted to prevent, or reduce the risk of, the disease or pest entering, or establishing itself or spreading in, Australian territory or a part of Australian territory.</p>
              </content>
            </paragraph>

              <num>6</num>
              <content>
                <p>The determination must specify where the requirements apply.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-196A__subclause-7">
              <num>7</num>
              <content>
                <p>Without limiting subsection (2), the determination may specify:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-196A__para-a">
              <num>a</num>
              <content>
                <p>requirements for all individuals, or classes of individuals; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-196A__para-b">
              <num>b</num>
              <content>
                <p>requirements in relation to particular diseases or pests or classes of diseases or pests; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-196A__para-c">
              <num>c</num>
              <content>
                <p>	(c)	general requirements in relation to<i> </i>all specified diseases or pests; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-196A__para-d">
              <num>d</num>
              <content>
                <p>requirements relating to the manner in which an individual must comply with a requirement.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-196A__subclause-8">
              <num>8</num>
              <content>
                <p>Without limiting subsection (2), the determination may specify one or more of the following requirements:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-196A__para-a">
              <num>a</num>
              <content>
                <p>a requirement for an individual to provide a declaration or evidence as to whether the individual has been exposed to goods, conveyances, premises or other things specified in the determination;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-196A__para-b">
              <num>b</num>
              <content>
                <p>a requirement for an individual to provide a declaration or evidence as to where the individual has been before entering Australian territory;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-196A__para-c">
              <num>c</num>
              <content>
                <p>a requirement for an individual to provide a declaration or evidence as to whether the individual has undertaken specified activities during a specified period before entering Australian territory, and, if so, specified details about those activities;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-196A__para-d">
              <num>d</num>
              <content>
                <p>a requirement for an individual to provide a declaration as to the individual’s intended destination or destinations in Australian territory during a specified period after entering Australian territory;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-196A__para-e">
              <num>e</num>
              <content>
                <p>	(e)	a requirement for an individual to provide a declaration as to the individual’s intended work (whether paid or unpaid) or occupation during a specified period<i> </i>after entering Australian territory;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-196A__para-f">
              <num>f</num>
              <content>
                <p>a requirement for an individual to be screened (whether by requiring the individual to be screened by equipment, by providing a declaration, or in any other way);</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-196A__para-g">
              <num>g</num>
              <content>
                <p>a requirement for an individual to move to a place, at the landing place or port, directed by a biosecurity officer (whether the direction is in relation to the individual or a class that includes the individual) for the purpose of a biosecurity officer assessing the level of biosecurity risk associated with either or both of the following:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-196A__para-i">
              <num>i</num>
              <content>
                <p>the individual;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-196A__para-ii">
              <num>ii</num>
              <content>
                <p>any goods the individual is bringing with them into Australian territory at the landing place or port.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-196A__subclause-9">
              <num>9</num>
              <content>
                <p>Before making a determination, the Agriculture Minister must consult with:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-196A__para-a">
              <num>a</num>
              <content>
                <p>the Director of Biosecurity; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-196A__para-b">
              <num>b</num>
              <content>
                <p>the Director of Human Biosecurity; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-196A__para-c">
              <num>c</num>
              <content>
                <p>the head (however described) of the State or Territory body that is responsible for the administration of matters relating to biosecurity in each State and Territory.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-196A__subclause-10">
              <num>10</num>
              <content>
                <p>A failure by the Agriculture Minister to comply with subsection (9) does not affect the validity of the determination.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-196B">
            <num>196B</num>
            <heading>Varying and revoking requirements</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-196B__subclause-1">
              <num>1</num>
              <content>
                <p>The Agriculture Minister must vary or revoke a determination in force under <ref href="#sec-196A">section 196A</ref> in relation to a disease or pest if the Agriculture Minister is satisfied that:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-196B__para-a">
              <num>a</num>
              <content>
                <p>the disease or pest no longer poses an unacceptable biosecurity risk; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-196B__para-b">
              <num>b</num>
              <content>
                <p>a requirement determined in relation to the disease or pest is no longer appropriate and adapted to prevent, or reduce the risk of, the disease or pest entering, or establishing itself or spreading in, Australian territory or a part of Australian territory.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-196B__subclause-2">
              <num>2</num>
              <content>
                <p>	(2)	An instrument that varies or revokes a determination made under <i>Legislation Act 2003</i> does not apply to the instrument.<ref href="#sec-196A">section 196A</ref> is a legislative instrument, but <ref href="#sec-42">section 42</ref> (disallowance) of the </p>

              <p>The Agriculture Minister may determine certain biosecurity measures for the purposes of preventing a specified behaviour or practice that causes, or contributes to, the entry into, or the emergence, establishment or spread in, Australian territory or a part of Australian territory of a specified disease (other than a listed human disease), or pest, that is considered to pose an unacceptable level of biosecurity risk.</p>

            <heading>Determining preventative biosecurity measures</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-393B__subclause-1">
              <num>1</num>
              <content>
                <p>This section applies for the purposes of preventing a behaviour or practice that:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-393B__para-a">
              <num>a</num>
              <content>
                <p>may cause a disease (other than a listed human disease), or pest, that is considered to pose an unacceptable level of biosecurity risk to enter, or emerge, establish itself or spread in, Australian territory or a part of Australian territory; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-393B__para-b">
              <num>b</num>
              <content>
                <p>may contribute to a disease or pest in relation to which paragraph (a) applies entering, or emerging, establishing itself or spreading in, Australian territory or a part of Australian territory.</p>

                <p>economic consequences in that foreign country associated with the entry, emergence, establishment or spread of the disease or pest as mentioned in paragraph (a).</p>

            <heading>Disclosure to person to whom information relates</heading>

              <p>An entrusted person may disclose relevant information to the person to whom the information relates.</p>

            <heading>Use or disclosure with consent</heading>

              <p>An entrusted person may use or disclose relevant information that relates to a person if:</p>

                <p>that Director reasonably believes that disclosing the information is necessary for the purposes of the administration of a law of a State or Territory; and</p>

                <p>the State or Territory body has undertaken not to use or further disclose the information except in accordance with an agreement that:</p>

                <p>the use is for a purpose prescribed by regulations made for the purposes of this paragraph; and</p>

            </paragraph>

                <p>the information is of a kind prescribed by regulations made for the purposes of this paragraph; and</p>

              <p><b><i>make</i></b>, in relation to an arrangement, includes enter into.</p>

                <p>whether the goods were subject to biosecurity control at the time the damage occurred;</p>

                <p>whether a biosecurity industry participant was in possession or control of the goods at the time the damage occurred;</p>
              </content>
            </paragraph>

                <p>whether the actions or omissions of any person, including the claimant, caused, or contributed to, the damage;</p>

                <p>in accordance with subsections 634(1A) and (1B), a claim for compensation is made to the Director alleging that the goods, conveyances or premises comprising buildings or other structures have been destroyed by a person in the course of performing functions or duties, or exercising powers, under this Act or by a biosecurity industry participant; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-7__clause-27__para-b">
              <num>b</num>
              <content>
                <p>the Director is satisfied that the circumstances of the alleged destruction are circumstances in relation to which it may be appropriate to give such an approval; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-7__clause-27__para-c">
              <num>c</num>
              <content>
                <p>the Director is satisfied that the goods, conveyances or premises comprising buildings or other structures have been destroyed by a person in the course of performing functions or duties, or exercising powers, under this Act or by a biosecurity industry participant; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-7__clause-27__para-d">
              <num>d</num>
              <content>
                <p>in a case where the Director is satisfied that the goods, conveyances or premises comprising buildings or other structures have been destroyed by a biosecurity industry participant—the Director is satisfied that the destruction occurred solely:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-7__clause-27__para-i">
              <num>i</num>
              <content>
                <p>as a result of the biosecurity industry participant complying with a direction given to the biosecurity industry participant under this Act by a biosecurity officer, the Director, the Director of Human Biosecurity, the Agriculture Minister or the Health Minister; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-7__clause-27__para-ii">
              <num>ii</num>
              <content>
                <p>as a result of the biosecurity industry participant complying with a condition to which the approved arrangement concerned is subject.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-7__clause-27__subclause-1A">
              <num>1A</num>
              <content>
                <p>In deciding whether to give the approval, the Director of Biosecurity may have regard to the following matters:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-7__clause-27__para-a">
              <num>a</num>
              <content>
                <p>the nature of the destruction;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-7__clause-27__para-b">
              <num>b</num>
              <content>
                <p>the circumstances in which the destruction occurred;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-7__clause-27__para-c">
              <num>c</num>
              <content>
                <p>the condition of the goods, conveyances or premises comprising buildings or other structures before the destruction occurred;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-7__clause-27__para-d">
              <num>d</num>
              <content>
                <p>in the case of the destruction of goods or conveyances—whether the goods or conveyances were subject to biosecurity control at the time the destruction occurred;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-7__clause-27__para-e">
              <num>e</num>
              <content>
                <p>in the case of the destruction of goods or conveyances—whether a biosecurity industry participant was in possession or control of the goods or conveyances at the time the destruction occurred;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-7__clause-27__para-f">
              <num>f</num>
              <content>
                <p>whether the actions or omissions of any person, including the claimant, caused, or contributed to, the destruction;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-7__clause-27__para-g">
              <num>g</num>
              <content>
                <p>any evidence provided by the claimant in relation to a matter covered by paragraph (a), (b), (c), (d), (e) or (f);</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-7__clause-27__para-h">
              <num>h</num>
              <content>
                <p>any other matter the Director considers relevant.</p>
              </content>
            </paragraph>
          </hcontainer>

            <num>28</num>
            <heading>After subsection 634(1)</heading>
            <content>
              <p>Insert:</p>
              <p>Claims for compensation</p>
            </content>
            <hcontainer name="subclause" eId="schedule-7__clause-28__subclause-1A">
              <num>1A</num>
              <content>
                <p>Any claim for compensation must be made by or on behalf of an owner of the compensable item before the end of:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-7__clause-28__para-a">
              <num>a</num>
              <content>
                <p>the period of 12 months beginning on the day on which the damage or destruction occurred, unless paragraph (b) applies; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-7__clause-28__para-b">
              <num>b</num>
              <content>
                <p>if, when the damage or destruction occurred, the owner did not know that the damage or destruction had occurred—the period of 12 months beginning on:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-7__clause-28__para-i">
              <num>i</num>
              <content>
                <p>the day on which the owner became aware of the damage or destruction, unless subparagraph (ii) applies; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-7__clause-28__para-ii">
              <num>ii</num>
              <content>
                <p>if the day on which the owner would have become aware of the damage or destruction if the owner had exercised due diligence is earlier than the day referred to in subparagraph (i)—that earlier day.</p>
              </content>
            </paragraph>

              <num>1B</num>
              <content>
                <p>A claim for compensation under subsection (1A) must:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-7__clause-28__para-a">
              <num>a</num>
              <content>
                <p>if a form is approved in an instrument under subsection (1C)—be in that form; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-7__clause-28__para-b">
              <num>b</num>
              <content>
                <p>be accompanied by the documents (if any) prescribed by the regulations; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-7__clause-28__para-c">
              <num>c</num>
              <content>
                <p>specify the compensable item; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-7__clause-28__para-d">
              <num>d</num>
              <content>
                <p>specify the day on which the owner became aware of the damage or destruction; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-7__clause-28__para-e">
              <num>e</num>
              <content>
                <p>specify the circumstances of the damage or destruction.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-7__clause-28__subclause-1C">
              <num>1C</num>
              <content>
                <p>The Director of Biosecurity may, by notifiable instrument, approve a form for the purposes of paragraph (1B)(a).</p>

                <p>For the purposes of subitem (1), paragraphs 632(1)(d) and 633(1)(d) of that Act, as substituted by this Part, apply in relation to a biosecurity industry participant, whether the direction concerned was given, or the arrangement concerned was approved, before, on or after the commencement of this item.</p>

                <p>A person is liable to a civil penalty if:</p>
              </content>

                <p>the person brings or imports goods into Australian territory; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-8__clause-186A__para-b">
              <num>b</num>
              <content>
                <p>the goods are conditionally non-prohibited goods; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-8__clause-186A__para-c">
              <num>c</num>
              <content>
                <p>a condition in relation to the goods specified in a determination in force under subsection 174(1) has not been complied with; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-8__clause-186A__para-d">
              <num>d</num>
              <content>
                <p>the goods are concealed for the purpose of preventing the goods from being found, or preventing the true nature of the goods from being determined, by a biosecurity official.</p>
              </content>
            </paragraph>
            <content>
              <p>Civil penalty:	<quantity refersTo="#penaltyUnit">1,200 penalty units</quantity>.</p>
              <p>Exception</p>
              <p>Note:	A defendant bears an evidential burden in relation to the matters in this subsection (see <ref href="#sec-96">section 96</ref> of the Regulatory Powers Act).</p>

                <p>	(b)	incorrectly<i> </i>marking or labelling the goods or any packaging or container in which the goods are located;</p>

              <content>
                <p>altering the goods (including by changing or suppressing the appearance, texture, smell or sound of the goods).</p>
              </content>
            </paragraph>

              <content>
                <p>Subsection (1) does not apply if the person:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-8__clause-186A__para-a">
              <num>a</num>

                <p>did not do the act, or omit to do the act, that constituted the failure to comply with the condition referred to in paragraph (1)(c); and</p>
              </content>
            </paragraph>

                <p>did not aid, abet, counsel or procure that act or omission; and</p>
              </content>
            </paragraph>

                <p>was not in any way knowingly concerned in, or party to, that act or omission (whether directly or indirectly and whether by any act or omission of the person).</p>
