                <p>emptied to the maximum extent in accordance with procedures in the Procedures and Arrangements Manual; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10__para-iv">
              <num>iv</num>
              <content>
                <p>washed in accordance with the prewash procedure specified in Appendix VI to Annex II; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10__para-b">
              <num>b</num>
              <content>
                <p>the resulting residues in the tank have been discharged to a reception facility at the port of unloading until the tank is empty; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10__para-c">

                <p>the residue then remaining in the tank has been subsequently diluted with water;</p>
              </content>
            </paragraph>

                <p>For the purposes of subsections (4), (5), (5A), (6) and (8), the following conditions must be satisfied in relation to the discharge of any residue into the sea:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-19__para-a">
              <num>a</num>
              <content>
                <p>the discharge is made when the ship is proceeding en route at a speed of:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-19__para-i">
              <num>i</num>
              <content>
                <p>at least 7 knots, if the ship is self-propelled; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-19__para-ii">
              <num>ii</num>
              <content>
                <p>at least 4 knots, if the ship is not self-propelled;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-19__para-b">
              <num>b</num>
              <content>
                <p>the discharge is made below the ship’s waterline through the ship’s underwater discharge outlets at a rate not exceeding the maximum rate for which each underwater discharge outlet is designed;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-19__para-c">
              <num>c</num>
              <content>
                <p>the discharge is made when the ship is at least 12 nautical miles from the nearest land;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-19__para-d">
              <num>d</num>

                <p>the discharge is made when the ship is in water at least 25 metres deep.</p>
              </content>
            </paragraph>

              <p>Subsections (5) and (6) do not apply to discharges of regulated persistent floaters in certain waters</p>

            <heading>Subsection 3(1)</heading>
            <content>
              <p>Insert:</p>
              <p><b><i>ship with fuel tank protection</i></b> means either of the following:</p>
              <p><b><i>ship without fuel tank protection</i></b> means a ship other than a ship with fuel tank protection.</p>
            </content>
            <paragraph eId="schedule-2__clause-1__para-a">
              <num>a</num>
              <content>
                <p>	(a)	a ship with an aggregate oil fuel capacity of 600 m<sup>3</sup> or above which is delivered on or after 1 August 2010 (as defined in regulation 1.28.9 of Annex I to the Convention);</p>

            </paragraph>
            <paragraph eId="schedule-2__clause-1__para-b">
              <num>b</num>
              <content>
                <p>	(b)	a category A ship, or category B ship, constructed on or after 1 January 2017 with an aggregate oil fuel capacity of less than 600 m<sup>3</sup>.</p>

              <content>
                <p>A person commits an offence if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-10AA__para-a">
              <num>a</num>
              <content>
                <p>the person is the master or owner of an Australian ship; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-10AA__para-b">
              <num>b</num>
              <content>
                <p>the person engages in conduct; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-10AA__para-c">
              <num>c</num>
              <content>
                <p>the conduct results in heavy grade oil being used, or carried for use, as fuel on the ship in Arctic waters; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-10AA__para-d">
              <num>d</num>
              <content>
                <p>either of the following apply:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-10AA__para-i">
              <num>i</num>
              <content>
                <p>for a ship without fuel tank protection—the person engages in the conduct on or after <date date="2024-07-01">1 July 2024</date>;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-10AA__para-ii">
              <num>ii</num>
              <content>
                <p>for a ship with fuel tank protection—the person engages in the conduct on or after <date date="2029-07-01">1 July 2029</date>.</p>
              </content>
            </paragraph>
            <content>
              <p>Penalty:	<quantity refersTo="#penaltyUnit">2,000 penalty units</quantity>.</p>
              <p>Penalty:	<quantity refersTo="#penaltyUnit">500 penalty units</quantity>.</p>

                <p>for a ship without fuel tank protection—the person engages in the conduct on or after <date date="2024-07-01">1 July 2024</date>;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-10AA__para-ii">
              <num>ii</num>
              <content>
                <p>for a ship with fuel tank protection—the person engages in the conduct on or after <date date="2029-07-01">1 July 2029</date>.</p>
              </content>
            </paragraph>

              <content>
                <p>An offence against subsection (2) is an offence of strict liability.</p>
              </content>
            </hcontainer>

                <p>Subsections (1) and (2) do not apply to heavy grade oil that is carried or used as fuel on an Australian ship that is:</p>

                <p>engaged in securing the safety of a ship; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-10AA__para-b">
              <num>b</num>
              <content>
                <p>engaged in a search and rescue operation; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-10AA__para-c">
              <num>c</num>
              <content>
                <p>dedicated to oil spill preparedness and response.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-10AA__subclause-5">
              <num>5</num>
              <content>
                <p>If, at any time (whether before or after this section commences) before an Australian ship enters Arctic waters, heavy grade oil is carried or used as fuel on the ship, subsections (1) and (2) do not apply to any residue of the oil that is not cleaned or flushed from a tank or pipeline of the ship.</p>
